CALL TO ORDER AND ROLL CALL Chair Schaps called the Lino Lakes Planning and Zoning Board meeting to order at 6:30 p.m., November 13, 2002. II. APPROVAL OF AGENDA The agenda was approved. III. APPROVAL OF MINUTES — October 9, 2002 Ms. Lane made a MOTION to approve the minutes of the October 9, 2002, meeting of the Lino Lakes Planning and Zoning Board, and was supported by Mr. Rafferty. Motion carried 5 -0. IV. OPEN MIKE Chair Schaps declared open mike open at 6:32 p.m. There was no one present for open mike. Mr. Corson made a MOTION to close Open Mike at 6:33 p.m., and was supported by Mr. Rafferty. Motion carried 5 -0. V. ACTION ITEMS A. PUBLIC HEARING - Ray Benkler, Car Wash, XXX Lake Drive, Conditional Use Permit and Site Plan Review DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 2 Staff explained Mr. Benkler had requested approval of site and building plans and a conditional use permit to allow the construction of a full service carwash, a self - service carwash and a quick lube facility (within a single structure) upon a 1.6 acre site located west of Lake Drive and between I -35W and Elm Street. Staff stated while the applicable LI, Light Industrial district provisions do not specifically list carwashes as a permitted or conditional uses, the district does state that uses permitted in commercial zoning districts shall be allowed within LI districts. As a result, the use will be treated as a conditional use and processed accordingly. Staff presented its analysis by explaining the subject property is described as part of Auditor's Subdivision # 54 and comprises two individual lots. As part of the CUP processing, the two lots which comprise the subject property should be legally combined. Staff noted access to the subject site is to be provided via a 30 -foot wide curb cut along Lake Drive. Appropriately, the access point is in direct alignment with Church Drive to the east. Staff stated the acceptability of the proposed curb cut location and width as well as the need for associated roadway improvements (i.e. turn lanes) should however, be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. Staff indicated the proposed use includes a full service carwash, a self - service carwash and a quick lube facility. Recognizing the co- existence of these activities, a well - conceived plan for site circulation is both very important and very challenging. Staff noted as shown on the submitted site plan, site circulation is proposed to occur in a counter - clockwise fashion. While the proposed circulation pattern is considered well conceived and follows a natural tendency to "keep right ", some concern exists in regard to a users understanding of the circulation pattern and a potential for congestion at the sites entry point. Staff stated to address this concern, the applicants are proposing to separate site entry and exit areas with a landscaped median and identify desired site circulation routes with freestanding directional signage. To further identify desired traffic movements, it is suggested that pavement directional signage also be provided. Staff noted two circulation - related concerns exist in regard to the by -pass lane on the west side of the property. One concern relates to the necessary u -turn maneuvers that will occur west of the building where full service carwash vehicles move from the staging area to the conveyor area. It appears conceivable that such maneuvers could interfere with access to both the self - service carwash and quick lube facility. Staff indicated a second concern with the by -pass lane relates to the areas west of the self - service wash and quick lube facility where a potential overlapping of vehicular stacking could potentially occur. The applicant has indicated that the self -serve wash is to accommodate recreational vehicles. It appears likely that a recreational vehicle DRAFT MINUTES • Planning & Zoning Board November 13, 2002 Page 3 waiting to occupy the southerly self - service stall may block access to the quick lube stacking area. Staff noted while the applicant is encouraged to address the aforementioned concerns, it is acknowledged that such circulation issues are internal to the site and constitute more of an inconvenience to site patrons than a threat to public safety. Staff stated according to the Ordinance, the architectural appearance of the building may not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. Staff stated the building is to be finished in a combination of colored rock face block, face brick and stucco. Such materials are consistent with the building material requirements of the Ordinance. While the elevation indicates that the building is to be finished in two varied colors of rock face block, specific building colors have not been indicated. As a condition of site and building plan approval, building colors should be specified. Staff noted although the proposed building materials satisfy the requirements of the Ordinance, some concern exists in regard to the presentation of the building to Lake Drive. As proposed, the eastern facade of the building will consist of ten garage doors. To draw attention away from the garage doors, the applicant has proposed landscaped medians in the front of the building. Aside from "softening" the appearance of the building to Lake Drive passersby, the landscape medians also serve to channel traffic throughout the site. Staff stated the Ordinance does not indicate whether or not stacking spaces may be counted toward fulfilling this requirement. While the need for drying and employee stalls is obvious, it is believed that excluding stacking space from the off -street parking requirement for the carwash would result in an excessive off-street parking supply. Therefore, stacking spaces are considered acceptable off -street parking spaces. Staff noted including exterior stacking spaces, a total of 56 spaces are provided on site, exceeding that required by Ordinance. Staff stated the site plan illustrates one handicap parking stall. To satisfy applicable State requirements, one additional handicap stall should be provided. Staff noted at 18 feet in depth and 9 feet in width, all off -street parking stalls have been found to meet the minimum dimensional requirements of Section 3, Subd. 5 of the Ordinance. Staff stated in regard to vehicular stacking space, the Ordinance states that stacking space associated with carwashes should accommodate the number of vehicles that can be washed during a maximum thirty- minute period and shall be subject to comment by the City Engineer. DRAFT MINUTES • • • Planning & Zoning Board November 13, 2002 Page 4 Staff noted according to the applicant, it is anticipated that the full service carwash can accommodate 30 vehicles in a half hour period. As shown on the submitted site plan, four stacking lanes have been provided for the full serve carwash accommodating a total of 30 vehicles. Staff stated as shown on the landscape plan, a variety of trees are proposed on site. Specifically, mixtures of Swamp White Oak, Austrian Pine and River Birch trees have been proposed along Lake Drive. Additionally, shrub plantings have been proposed within the two medians (within the interior of the site) and clump grass has been proposed at the northwest corner of the building. Staff noted two concerns exist in regard to the landscape plan. As noted in the attached Environmental Board comments, concern exists in regard to the number of plantings provided on site. The Board has specifically recommended that additional trees be provided. Staff stated a second concern is the placement of trees within the "rainwater garden" in the southeastern area of the property and their ability to survive. As a condition of site and building plan approval, the tree plantings proposed within the "rainwater garden" should be relocated. Staff noted the tree preservation plan has been superimposed on the landscape plan. The plan however, does not specify the types and sizes of trees to be saved and removed. As a condition of site and building plan approval, the tree preservation plan should be modified to indicate all significant trees on site and those to be saved. Staff indicated as a condition of site and building plan approval, all off -street parking areas and associated drive lanes should be provided a continuous concrete curb. This includes the planting medians on the east side of the building where such curbing will both define the drive lanes and serve to protect the vegetation within such medians. Staff noted aside from the striping of off -street parking stalls (a standard ordinance requirement), it is recommended that the one -way bypass lane around the perimeter of the building be striped and thereby segregated from adjacent stacking lanes. Staff stated according to Section 3, Subd. 4.G of the Ordinance, all refuse and recyclable materials must be stored within the principal building or within an accessory structure (within a side or rear yard) that is totally screened from eye level view from neighboring uses and public rights of way. Staff noted the submitted site plan does not illustrate a trash enclosure. If trash is to be stored outdoors, the location of the enclosure should be illustrated on the site plan. Staff stated within LI districts, a minimum green area of 10 percent of the lot area is required. The amount of impervious surface coverage on the site has not been specified. As a condition of site and building plan approval, the applicant should demonstrate compliance with the minimum green area requirement. DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 5 Staff stated the site plan illustrates a freestanding sign in the northeast corner of the site within the "rainwater garden ". The acceptability of the sign placement (within the "rainwater garden ") should be subject to comment by the City Engineer. Staff noted details regarding site signage have yet to be submitted. As a condition of site and building plan approval, all site signage must comply with the applicable requirements of the Sign Code. Staff indicated the applicant is proposing freestanding directional signage to identify desired traffic movements on the site. In addition to such freestanding signage, it is recommended that pavement directional signage also be provided to ensure proper site circulation. Staff stated as required by ordinance, a lighting plan identifying illumination levels on the subject site has been provided. The proposed illumination levels and fixture details have been found to be acceptable. Staff noted according to the plan, freestanding shoebox style fixtures have been proposed within parking areas while wall mounted fixtures have been proposed on the north, south and east sides of the building. Staff indicated according to the Ordinance, the source of lights should be hooded and controlled so as not to illuminate adjacent properties or public rights -of -way. More specifically, low- impact, downward- focused, low spill, low intensity fixtures should be used. Staff stated while the shoebox style fixtures meet this requirement, the source of the light from the wall - mounted fixtures will be visible from adjacent properties. As a condition of site and building plan approval, the wall - mounted fixtures should be changed such that the source of the light will not be visible from adjacent properties. Staff noted a utility plan has been submitted for review by the City Engineer. As a condition of site and building plan approval, the utility related modifications and comments as set forth in the City Engineer's memo should to be incorporated into the plans. Staff stated a grading and drainage plan has been submitted for review by the City Engineer. Staff indicated one noteworthy concern related to drainage involves the handling of wastewater from the self -serve carwash. Of particular concern is the potential "dragging" of water toward the site's egress point (on Lake Drive) in the winter months and the potential for the creation of an ice slick. As a condition of site and building plan approval, the issue should be addressed to the satisfaction of the City Engineer. Staff stated as a condition of site and building plan approval, the grading and drainage related modifications and comments as set forth in the TKDA letter dated 11/5/02 should to be incorporated into the plans. DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 6 Staff noted the primary issues of the CEPTED review regard traffic flow through the development. The development has been redesigned to address these issues. Staff indicated the Environmental Board reviewed the request at their October 30, 2002 meeting and recommended approval. Their comments are attached to this report. Staff noted is that the Board's recommendations related to lighting and landscaping has been included as conditions of site and building plan/conditional use permit approval. Staff stated the Rice Creek Watershed District (RCWD) has determined that the proposed development will not require a Watershed District Permit as the impervious surface coverage on the property does not exceed one acre. Staff noted prior to the commencement of any site work, the applicant will be required to enter into a development agreement with the City and post all the necessary securities required by it. Staff stated as previously indicated, the applicant is requesting approval of a conditional use permit to allow a carwash within an I -1, Light Industrial zoning District (both drive - through and self - service carwashes are listed as conditional uses). Staff stated in considering conditional use permit requests, the Ordinance states that the Planning and Zoning Board shall recommend approval and the City Council shall order the issuance of such permit only if it finds that such use at such location: 1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. Comment: The proposed use is not anticipated to be detrimental or endanger the public. 2. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. Comment: The Comprehensive Plan suggests industrial use of the site. Within the applicable LI, Light Industrial zoning district, carwashes are considered a conditional use. Thus, the proposed land use satisfies the land use directives of the Plan. 3. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. Comment: The building design is consistent with material requirements of the Ordinance and therefore will not negatively affect the essential character of the area. The proposed building is in fact anticipated to improve the appearance of the area. 4. Will be served adequately by essential public facilities and services, including street, police and fire protection, drainage structures, refuse disposal, water and sewer DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 7 systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Comment: As a condition of project approval, the building will be adequately served by essential public facilities and services. 5. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. Comment: This development is not expected to increase public costs, nor be detrimental to the economic welfare of the community. 6. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. Comment: The proposed use of the property is not expected to create any excessive externalities that would be abnormal to the character of the area. 7. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. • Comment: The site layout meets standards held within the City's Zoning Ordinance including turn lanes, access width, and access spacing /location. 8. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Comment: The applicant is currently working with the City Engineer to satisfy drainage related issues. 9. Will conform to specific standards of this ordinance applicable to the particular use. Comment: The proposed use will as a condition of approval meet the applicable requirements of the Ordinance. Staff stated based on the findings contained in this report, our office recommends approval of the Site and Building Plan and Conditional Use Permit to allow the construction of a full service carwash, a self - service carwash and a quick lube facility (within a single structure) upon a 1.6 acre site located west of Lake Drive between I -35W and Elm Street subject to the following conditions: 1. The two lots, which comprise the subject property, be legally combined. 2. The acceptability of the proposed curb cut location and width as well as the need for associated roadway improvements (i.e. turn lanes) be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. The City Engineer provide comment and recommendation regarding the proposed sign placement within the "rainwater garden ". 12. All site signage comply with the applicable requirements of the Sign Code. 13. Pavement directional signage be provided to ensure proper site circulation. 14. The wall mounted light fixtures be changed such that the source of the light is hooded and controlled so as not to illuminate adjacent properties or public rights -of -way. Specifically, low- impact, downward - focused, low- spill, low - intensity fixtures shall be used. Revised plans depicting such change shall be provided prior to City Council consideration of the application. 15. The conditions of the TKDA letter (dated 11/5/02) related to grading, drainage and utilities are satisfied. The easement issues must be resolved prior to City Council approval of the application. Prior to the commencement of any site work, the applicant enter into a development agreement with the City and post all the necessary securities required by it. The agreement shall also contain an operation and maintenance agreement. 17. Applicant must address concerns about the dragging of water thereby turning it to ice at the exit point. Mr. Corson asked if Rice Creek Watershed not needing a permit was a new requirement. Mr. Kirmis replied this site did not meet the minimum requirements. Mr. Rafferty expressed concern about the color scheme of the building and asked what the color scheme was going to be. Chair Schaps invited applicant to make comment. Gary Raffel, architect, stated the colors of the building would be earth, neutral colors, similar to the coloring of the City Hall building. He noted there would be no painting requires. Any stucco used would be colored stucco. He stated they would get a color scheme to staff as soon as possible. Mr. Rafferty suggested before anything was approved, those colors were represented to the Council at their meeting. Mr. Raffel stated concern for the water coming off the self - service car wash would be taken care of. He proposed a heated apron and a drain so as soon as the vehicle got out of the self - service area, the heater slab would present it from freezing and it would go directly into the drain. He noted the typical heating pad was 10 feet. Mr. Rafferty stated self - service generally speaking did not involve dryers. Mr. Raffel replied there were no dryers with the self - service facility. Chair Schaps inquired about the landscape plan. Chair Schaps asked if there was an example of this building in the City. Mr. Raffel replied there was a similar service in Stillwater. Chair Schaps stated staff was concerned about circulation and asked if there was a specific set up in the area that was the same type of facility. Mr. Raffel replied he did not know of a facility near here that had the exact same proposal. He noted they had the best circulation possible for this site. Chair Schaps asked how many cars could be in line before they reached the street. Mr. Raffel replied 30 cars could be waiting. • Mr. Smyser stated this was a public hearing and requested the Chair open the hearing at this time. DRAFT MINUTES • Planning & Zoning Board November 13, 2002 Page 10 Derek Lash, engineer, replied with respect to landscaping, he anticipated applicant would add more landscaping. He noted the water garden (holding pond) would not be an eyesore. He stated there was no reason the trees could not be removed. He stated applicant agreed with the staff's recommendations. He asked about the removal of the evergreen trees and replacing them with deciduous trees. He noted salt from the road was harder on deciduous trees than evergreens and that was why they had evergreens. Mr. Hyden asked where the trash enclosure was located and how was that being addressed. Mr. Raffel replied the trash enclosure would be the same material as the building, made out of concrete block. He noted there were two sites that could accommodate a trash enclosure, but it would be located behind the building. Chair Schaps asked what type of trash were they likely to have. Mr. Raffel replied cardboard would be one item. Terry Landeen, Specialty Equipment Co., stated the trash enclosure was located alongside the automatic bay, inside the building. The trash enclosure would have double doors on it and would be wheeled out to be emptied. Mr. Hyden asked were did all of the water go. Mr. Landeen replied it went inside the carwash base (pits) and from there it went into a waste trap, which catches any excess oil before it went to the City sewer. He stated the pit and trap was cleaned at least once a year. He stated there would be small drainage areas also, which could just evaporate or drain into the carwash pits. He stated they could heat 15 -20 feet at the exit and the if they wanted, but the standard was 10 feet. He noted the full service car wash would have full heat at the exit ends. Chair Schaps opened the Public Hearing at 7:04 p.m. Ray Benkler, owner, stated the purpose of the self - service was to have high ceilings that would accommodate a larger vehicle, but they would not be marketing to the RV vehicles, it would be an all purpose use. He noted a semi -cab would not be a problem. With respect to circulation, there would be no problems because they would take the cars off themselves onto the conveyor lane. Mr. Corson asked if he has had any problems at the Stillwater facility regarding circulation. Mr. Benkler replied he did not believe so. He stated he had spoken with the owner of the Stillwater facility and this was no an issue there. Rene Quimby, 7319 Lake Drive, asked what the hours of operation were of the car wash and the types of vehicles using the car wash. Mr. Benkler stated the hours of operation would be 7:00 a.m. to 9:00 p.m. He stated they had the room for semi -cabs and motor homes in the facility, but he did not believe they would have a lot of traffic from these larger vehicles. He noted the use would be all purpose. DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 11 Ms. Quimby explained her previous comments by stating she wanted to know if semi - trucks would be going through the oil change facility because her CUP restricted them from working on semi - trucks. Mr. Smyser replied the Quick Lube would not accommodate a semi - truck, only the car wash portion. Ms. Lane made a MOTION to close the public hearing at 7:11 p.m. The motion was supported by Mr. Corson. Motion carried 5 -0. Mr. Rafferty made a MOTION to table this issue until later in tonight's meeting when they have the further information they need. The motion was supported by Mr. Hyden. Motion carried 5 -0. (This issue is continued after item 5B — UDOR. Please see additional minutes for final motion on this item.) B. Gordon Johnson, UDOR, 500 Apollo Drive, Site Plan Review Staff stated Mr. Johnson of UDOR company is applying for a site plan review in order to construct a second expansion onto their current facility at 500 Apollo Drive. UDOR first constructed their 6,000 sq.ft. building in 1994. In 1999 a 2,400 sq. ft. addition was constructed. The applicant is now asking for approval for a second addition of 3,600 square feet, to be used for cold storage /warehousing and testing. Staff presented its analysis by explaining UDOR is located at 500 Apollo Drive, with the rear of the property abutting the 35W interstate highway. The proposed addition site is immediately adjacent (south) of the 1999 addition. There is a ponding area to the southwest of the proposed addition site. Access to the addition is to be completely internal; there are no docking bays, parking, or sidewalks proposed to access the addition. Staff stated the applicant has submitted no full -view elevation plans. The proposed addition is to be constructed of rock faced block to match the existing building in terms of construction material and height. Staff noted since the addition site is at the rear of the lot, with a ponding area to the south of the site and only approximately 15 feet on the north side of the site, access for construction purposes will be via the property to the north, with which the applicant has acquired an access agreement. • Staff indicated this site is served by both City water and sewer. The existing building is, and the proposed addition will be, sprinkled and meet fire code. DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 12 Staff stated UDOR is a warehouse -type facility with approximately 2,000 sq.ft. of office space. However, parking requirements for the initial building approved in 1994 were based solely on warehouse use and square footage (1 stall for each 2,000 sq.ft.). The parking calculations made at that time were for 6,000 sq.ft. of warehouse and 6,000 sq.ft. of future warehouse expansion, for a total of 12,000 sq.ft. of warehouse. Thus, 6 parking stalls were required, with 7 stalls actually constructed. As a result, parking for the proposed 3,600 sq.ft. addition has already been provided for. The applicant reports that there are actually eight stalls at the site and that parking is not a problem. The applicant further reports that there are seven employees at the company, with no additional employees proposed. Staff indicated access to the site is via a shared access driveway off Apollo Drive, which is a County road. As a result, plans have been forwarded to Anoka County for review. Staff noted there is no additional lighting proposed for the addition or site. Staff stated City Code allows impervious site coverage up to 90 %, and the proposed addition is within this requirement. Staff indicated approval of the initial building in 1994 came with the following requirement: "Following completion of the proposed expansion, plantings will be located to the rear of the property line to provide an appealing view from I -35W." Staff stated since this second expansion appears to use the space limits of the site, with no room for further expansion in the future, it is now appropriate to require the landscaping be done. As a result, the applicant has proposed planting 11 trees of various varieties (oak, maple, spruce) in the buffer area between the proposed addition and 35W. Staff noted additionally, there is a ponding area on the site, to the southwest of the proposed addition. This should be protected with silt fencing during construction Staff stated the City Engineer Jim Studenski has reviewed the submitted plans and reports that they generally meet City requirements. The following two outstanding issues need to be resolved, after which final approval can be given: 1. Drainage calculations must be submitted. 2. Documentation allowing access to the construction site from the adjacent site must be submitted. In conclusion, staff noted as the proposed addition appears to meet all requirements, staff would recommend approval, with the following conditions: 1. Drainage calculations must be submitted prior to City Council review. 2. Documentation allowing access to the construction site from the adjacent site must be submitted. DRAFT MINUTES Planning & Zoning Board November 13, 2002 Page 13 3. Silt fencing shall be staked at the top of the ponding area, rather than on the sides, to prevent erosion. 4. No additional lighting is to be added without review. 5. Landscaping should be completed within one year of issuance of the building permit. 6. Trees to the east are to remain preserved where possible and staff to review the applicants plans regarding removal of trees, with replacement trees be added as staff directs. Chair Schaps invited applicant to make comment. Gordon Johnson, stated they would lose one oak tree that was "Y" shaped, but he planned on planting four to five maples in its place. He noted he would not be able to save that tree. The maples would go in the rear of the addition and one the side towards the Fogerty building. Mr. Smyser stated they would look at the site to see what tree he was referring to and would make a recommendation to the City Council. Chair Schaps asked if Mr. Johnson agreed with all of the conditions recommended by staff. Mr. Johnson replied he did. Mr. Johnson noted they would also landscape any of Mr. Fogerty's property that went down to the curb. Ms. Lane asked if it would be appropriate to change condition six to read to preserve as many trees to the east of the building as possible. To accommodate the development proposal, the following approvals are necessary: 1. MUSA Reserve Allocation (85.3 acres) 2. Rezoning from R (rural) to R -1 (single family residential) and R -3, Medium Density Residential. 3. PUD to allow airplane hangers, private streets and multiple buildings on a single lot. 4. While the physical characteristics of the site make development challenging, such characteristics also offer unique design possibilities. The northeasterly portion of the site is open meadow with scattered brush and trees. The southern portion of the site includes wooded areas, wetlands and a County ditch and borders the Lino Air Park. The western portion of the site is somewhat fragmented due to a number of property exceptions along Sunset Road and includes several acres of unbuildable wetland areas. MUSA Reserve Allocation. To accommodate the proposed development, the allocation of 83.5 acres of MUSA will be necessary. Considering that the Comprehensive Plan calls for the urbanization of the subject property, such allocation is considered appropriate. Land Use and Zoning. The City's Comprehensive Plan calls for sewered low density residential uses in the southwest portion of the site and low density /medium density uses on the balance of the site. While, the proposed land use designations are consistent with the land use directives of the Comprehensive Plan, concern exists that the applicant is proposing to apply the R -3 zone to numerous single family lots within the subdivision. Considering that the R -3 • zoning district does not allow single family dwellings, it is suggested that the R -1 designation be applied to the single family dwellings in the subdivision and that the R -3 designation be applied to the areas in which multi - family units are proposed. To be noted is that the rezoning request also includes a PDO, Planned Develop Overlay to allow airplane hangers, private streets and multiple buildings on a single lot. Additionally, the PDO can accommodate the proposed detached townhome development concept (a deviation from R -1 District requirements). The table below identifies the existing and land use and zoning as well as guided land uses for the area. While the location of the various unit types are considered acceptable, examples of the proposed housing types should be submitted for review as a condition of PDO approval. Density. As calculated below, the development proposal calls for a total of 250 dwelling units resulting in an overall net density of 2.89 units per acre. The proposed densities consistent with the directives of the Comprehensive Plan and are therefore considered acceptable. Street Configuration. The Carl Street/Century Trail extension through the site is considered positive as it fulfills a directive of the City's Transportation Plan. While the street is not a continuous, uninterrupted collector street route, the intersection in the southeast corner of the site is considered an acceptable compromise considering traffic speed related concerns voiced by area residents. While such connection may not be immediate (constructed as part of the first phase of the development), the physical connection of the two street segments is imperative. • To improve vehicular convenience, provide a more efficient traffic flow and minimize home exposure to oncoming traffic however, it is recommended that the street located approximately 150 feet north of the Carl Street/Century Trail intersection be shifted southward to create a four way intersection. • The "L" shaped cul -de -sac in the southwest corner should be shifted approximately 150 feet to the east to align with the street to the south. • The cul -de -sac south of Carl Street in the southeast corner of the site lies approximately150 feet from what is likely to be a high volume intersection. The spacing of such intersection should be increased to minimize turning maneuver /vehicular stacking conflicts. It is recognized that such easterly shift of the intersection may result in the loss of an airpark lot (Lot 9, Block 5). Lot Size and Setbacks. The following table compares lot size and setback requirements imposed within R -1 and R -3 Districts with those shown on the development plans. Note: Bold type signifies non - compliance. While most "traditional" single family lots have been found to meet or exceed to minimum R -1 district dimensional requirements, several concerns exist as summarized below: • Century Farm North Page 5 of 11 • Lots 1 and 13, Block 2 have been found to measure only 95 feet in width. As corner lots, their width should be increased to 100 feet as required within R -1 zoning districts. • In review of the grading and drainage plan, there appears to be substantial topography upon Lot 12, Block 2 which may limit its buildability. As a result, it is recommended that the applicant demonstrate its buildability via the submission of a custom plan. • Considering that Carl Street/Century Trail is expected to be a high volume roadway, it is believed the impact of such roadway upon Lots 3 and 4, Block 2 (at the intersection of Sunset Road and Century Trail) could be lessened by providing interior access to such lots from the northeast via the "L" shaped cul -de -sac. In conjunction with such modification, screening could be provided in the rear yard areas at the Sunset /Century Trail intersection (see attached development plan alternative). • The home and driveway upon Lot 20, Block 2 should be re- oriented toward the cul -de sac. • One final concern relates to Lots 6 and 7, Block 6 (as depicted on the preliminary site plan) where it appears the side lot line between the two lots was inadvertently not shown. In regard to Lot 7, Block 6 specifically, it is recommended that the driveway of such lot be oriented to the west rather than the south (to eliminate driveway maneuvering at what is expected to be a busy intersection and not to isolate the home from neighboring dwellings). Airpark Lots. As shown on the submitted development plans, the subject site borders the Lino Airpark and includes 15 "airpark" lots. To accommodate such lots, the processing of a PDO is necessary. Considering that the Comprehensive Plan identifies the airpark as a long -term use within the City and that non - inhabitable structures over the gas line are preferred, the inclusion of such lots is considered generally acceptable. In regard to such lots however, some concerns do exist as summarized below: • The locations of Lots 4 and 9, Block 4. Of primary concern is the location of an airpark lot (Lot 4. Block 4) between two "traditional" single family lots and the adjacency of Lots 5 -8, Block 4 to the airpark taxiway and hanger building. To address this concern, it is suggested that Lot 4 be converted from an "airpark" to "traditional" single family lot and that Lot 9 be eliminated combined with the lots to the north to create a buffer yard. • The impact of runway safety zone extensions upon area lots. As a condition of PUD approval, the applicant should provide documentation to the City that all applicable runway safety zone requirements have or will be satisfied. • • Century Farm North Page 6 of 11 • Anticipated market demand for the airpark lots. The applicant has indicated that if demand for the airpark lots does not exist, they would likely be converted to "traditional" single family lots. Such change would require the processing of a PDO amendment. • The size of the hangers appears equal to the size of the homes they are to serve. As a condition of PUD approval, specific hanger designs should be submitted subject to City approval. • The direct visual (and audible) exposure of both hangers and the taxiway to Century Trail (in the southeast corner of the plat). While this has been addressed to some extent via landscaping, it is suggested that a berming along the street segment be provided as well. Townhome Issues Architecture. As a PDO, the City is afforded an opportunity to provide impose conditions related to the appearance of the townhomes. While specific townhome building elevations have not been submitted, the plan drawings illustrate a "garage forward" design. Recognizing this and to avoid visual monotony, creative building design is considered very important. As a condition of PDO approval, specific townhome building elevations should be submitted subject to City approval. Parking. According to the Ordinance, townhomes are required to provide at least two and one -half rent -free spaces per unit. The Ordinance further states that for projects involving eight or more units, the City may require additional clustered guest parking. While the "per unit" parking requirement has been satisfied, it should be noted that the proposed private street widths (16to 18 feet) prohibit on- street parking. Therefore, as a condition of PDO approval, the townhome area in the northeast corner of the site should be modified to incorporate specific visitor parking areas. Homeowners Association. According to the applicant, the project will be subject to the bylaws of three homeowner's associations. From the City's perspective, such bylaws should address issues associated with open space use and private street maintenance. As a condition of PDO approval, all homeowner association by -laws should be subject to review and approval by the City Attorney. Exceptions. As shown on the submitted development plans, a number of property exceptions exist west of the subject property along Sunset Road. In considering the proposed development, an assurance should be made that, to the extent possible, opportunities for future subdivision are provided. This is particularly relevant in that Sunset Road is a designated collector street and direct single family lot access to such streets are to be discouraged. Century Farm North • Page 7 of 11 • • Appropriately, an opportunity for future subdivision of the northerly extension has been provided via access to Stallion Road. Considering home placement and wetland infringements, street access to the southerly exception is not considered practical. Wetlands. Three designated wetlands are located within the central area of the property and comprise a significant portion of the site. Such wetlands are considered a site amenity and obviously influence the configuration of the development. As required by ordinance, a wetland mitigation plan has been submitted for review. Such plan should be subject to comment and recommendation by the City Engineer and Rice Creek Watershed District. To date, the City has no information regarding the Watershed District review Greenways. The concept plan illustrates a series of interconnecting eight foot wide bituminous trails. While the inclusion of the trails in considered positive, it would seem appropriate to extend the east/west trail segment beneath the power easement to the west to connect to Sunset Road. The acceptability of the trailways in fulfilling the greenway directive of the Comprehensive Plan should be subject to comment and recommendation by the Park Board. Park Dedication. As shown on the Parks /Open Space Plan, a significant portion of the subject property is to be dedicated as public park land. Specifically, the concept plan provides 22.5 acres of gross public park land, 7.3 acres of which is contiguous upland. The integration of such park areas responds to a specific directive of the Comprehensive Plan of providing a greenway in the area. While the inclusion of such park land is considered positive, an assurance should be made that problems do not result from the combination of private and public park ownership. Of specific concern is that the primary east/west trailway through the property be available to all park users (regardless of private and public ownership). As a condition of PDO approval, park related issues raised by the Park Board should be addressed. Tree Preservation. According to the applicant, a significant amount of existing tree massings in the southern portion of the site are to be preserved. While the existing conditions map identifies generalized tree massings, a specific tree inventory has not, to date, been submitted. Because the Subdivision Ordinance does not specifically mandate the submission of a tree inventory, the need for such inventory should be subject to comment and recommendation by the Environmental Board and determination City Officials. Easements. The subdivision design is responsive to the 90' electrical easement and 60' gas easement that traverse the property. As shown on the submitted plan, a trail has been proposed within the electrical easement while airpark hangers border the gas easement in the southeast corner of the property. Century Farm North Page 8 of 11 As shown on the preliminary plat, drainage and utility easements have been proposed along all property lines and over wetland and ponding areas. The acceptability of such easements should be subject to comment and recommendation by the City Engineer. Carl Street Vacation. To accommodate the development proposal, the vacation of a portion of Carl Street will be necessary. Such vacation will require a separate public hearing to be held by the City Council. Issues associated with the street vacation should be subject to comment by the City Engineer. Traffic Generation. Issues related to traffic generation and the ability of the development proposal to accommodate such traffic should be subject to comment and recommendation by the City Engineer. Utilities. A utility plan has been submitted for review by the City Engineer. As a condition of preliminary plat approval, the utility related modifications and comments as set forth by the City Engineer should be incorporated into the plans. Landscaping. As required by Ordinance, landscape plan has been submitted for review. The plan calls for a series of overstory trees along the public streets and a combination of understory and evergreen trees scattered throughout the site. Evergreen trees have been specifically proposed in areas where screening is desired (i.e. between Century Trail and the airpark hangers). As a condition of PDO approval, the landscape plan should be subject to comment and recommendation by the Environmental Board. Grading and Drainage. A grading and drainage plan has been submitted for review by the City Engineer. As a condition of preliminary plat approval, the grading and drainage related modifications and comments as set forth by the City Engineer should to be incorporated into the plans. The plan is also subject to review and approval from the Rice Creek Watershed District. Environmental Issues. The Environmental Board reviewed the request at their December 5, 2002 meeting. Their comments are attached to this report. Rice Creek Watershed District Review. The proposed development is subject to Rice Creek Watershed District (RCWD) approval. To date, comments from the District regarding the acceptability of the project have not been received. As a condition of PDO approval, all conditions imposed by the Watershed District must be satisfied. Century Farm North Page 9 of 11 Development Agreement. Prior to the commencement of any site work, the applicant will be required to enter into a development agreement with the City and post all the necessary securities required by it. RECOMMENDATION While the proposed development concept and its arrangement of land uses and streets is considered generally acceptable, numerous outstanding issues remain which, in the opinion of our office, should be addressed prior to the development process moving forward. As a result, we cannot recommend approval until the following issues are addressed: 1. The base R -1 district zoning designation be specifically applied to single family dwelling areas within the project and the base R -3 designation be applied to the multi- family areas. 2. The Carl Street connection be physically constructed as part of the development proposal. 3. Lots 1 and 13, Block 2 be increased from 95 to 100 feet in width as required within • R -1 zoning districts. 4. The home and driveway upon Lot 20, Block 2 be re- oriented toward its bordering cul- de sac. 5. The applicant demonstrate the buildability of Lot 12, Block 2 via the submission of a custom plan. 6. Lots 3 and 4, Block 2 (at the intersection of Sunset Road and Century Trail) be re- oriented and provided interior access from the northeast via the "L" shaped cul -de- sac. In conjunction with such modification, screening be provided in the rear yard areas of the lots (at the Sunset/Century Trail intersection) 7. The preliminary site plan be revised to illustrate a side lot line between Lots 6 and 7, Block 6. 8. The driveway of Lot 7, Block 6 be oriented to the west rather than the south. 9. There was consensus among the Park Board Members that the concerns /issues discussed at the August 5 Park Board Meeting have been addressed. I have identified some issues that should be discussed prior to the final design being completed: Sidewalk along Century Trail — Current plans are to install a 6' wide concrete sidewalk along the southern side of Century Trail, within the right -of -way. The trail begins at Sunset Road and extends to Carl Street. The plan indicates the sidewalk continuing easterly along Carl Street. We need to make sure this sidewalk extension makes sense, depending upon the future plans of the existing Carl Street. Trail along northern most street — The plans currently indicate a 8' wide bituminous trail along the southern edge of the road, from Sunset Drive to the eastern edge of the development. We need to look at the future plans for the property to the east to determine whether an 8' wide bituminous trail will make sense when the road is extended to 4th Avenue. Perhaps we may need to consider a 6' wide concrete sidewalk. Trails within park area — The preliminary grading plan indicates the developer will be grading the entire park area. Past practice has been to have the developer grade and install the base for the trails. However, this should not be done within the park area as depicted on the Preliminary Tree/Landscape Plan. We will need to develop a master plan for the park area, which will include trails. I expect that we will not locate the trails as illustrated. I am interested in being involved in the discussion regarding the application of the Park Dedication Ordinance related to this development. This may be a complicated process to determine what park dedication has already been fulfilled with prior plats. Also, we will need to ensure that the proposed trails along the streets are adequately funded. There was consensus from the Park Board Members to approve the plan as presented with the following caveat: Assurance that when the wetland area within the park is defined there is at least 4 1/2 acres of contiguous upland area suitable for park development. In addition there should be a minimum of eight acres of useable upland within the entire park area. There is a concern from the Park Board that the open space /green ways are reducing the size of active park areas. For example, the 150'x100' area east of the park is classified as upland but really can't be used for anything than a trail corridor and open space. If the open space areas are credited towards fulfillment of the park dedication requirements, this reduces the amount of active park land (or cash) derived from the developer. The open space areas proposed to be owned by the city need to be addressed. A determination must be made as to whether any enhancements will take place (i.e. natural prairie, native plantings) and any maintenance plan so all interested parties, including potential adjoining home owners, are aware of the plans for the open space areas. I think the development has done a good job incorporating several linear trail corridors. However, I question the necessity of having two trails branching out southward from Carl Street. The western most trail will result in a property owner having a trail on the front and the side of their home. Unless this is a pristine, natural area that residents will use for the aesthetic value, perhaps one trail access directly south of the proposed park area will suffice Perhaps we can get together and discuss the proposed park area, trail corridors, and open space to determine what is reasonable in fulfilling the park dedication requirements.
