CALL TO ORDER AND ROLL CALL Chair Schaps called the Lino Lakes Planning and Zoning Board meeting to order at 6:39 p.m., December 10, 2003. II. APPROVAL OF AGENDA Chair Schaps moved item V. E. to the first item on the agenda. III. APPROVAL OF MINUTES: November 12, 2003 Mr. Tralle made a MOTION approve the November 12, 2003 Minutes and was supported by Mr. Rafferty. Motion carried 5 -0 -1 (Lane abstained). IV. OPEN MIKE Chair Schaps declared open mike open at 6:38 p.m. There was no one present for Open Mike Mr. Corson made a MOTION to close Open Mike at 6:39 p.m., and was supported by Mr. Tralle. Motion carried 5 -0. V. ACTION ITEMS • E. PUBLIC HEARING for Preliminary Plat, Sue Carpenter, "Justin's Preserve," 171 White Pine Road Chair Schaps opened the public hearing at 6:40 p.m. DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 2 Staff stated Carpenter Homes had requested approval of a preliminary plat for Justin's Preserve. This project involved splitting an existing fourteen -acre parcel into two lots of four acres and ten acres. Under the current subdivision ordinance, the creation of new lots on city sanitary sewer requires a plat rather than a minor subdivision. Staff indicated this application highlighted an unusual situation that should be corrected. The existing house on the property is connected to city sanitary sewer and water. However, it is not within the MUSA. It should have been included when it connected to the utilities. He noted this also was the case with the lot at 173 White Pine Rd. Neither of these properties is in the MUSA although both are connected to utilities. This should be resolved now by allocating MUSA reserve. The area being platted included approximately four acres of upland. The smaller lot, which is not included in the plat application was 0.35 acres. Staff presented their analysis and recommended approval of the allocation of 3.7 acres of 2004 MUSA reserve; variance for lot depth; and preliminary plat with the seven conditions as noted in staff's December 10, 2003 report. Mr. Rafferty asked was there any relationship between the two sites. Mr. Smyser replied he did not know the answer to that question. Mr. Raffery asked if it would make sense to move the lot line to move the minimum width, with a shared driveway. Mr. Smyser replied what they had found over time was that they experienced problems with shared driveways, especially if the neighbors did not get along. Mr. Corson expressed concern about the ordinary high water level and if the home would be affected. Chair Schaps invited applicant to make comment. Applicant had no comment. Chair Schaps the public to make comment. There were no public comments. Ms. Lane made a MOTION to close the public hearing at 6:58 p.m. and was supported by Mr. Tralle. Motion carried 5 -0. Ms. Lane made a MOTION to approve preliminary plat with the seven conditions as noted in staff's December 10, 2003 report and was supported by Mr. Corson. Motion carried 5 -0. Ms. Lane made a MOTION to approve the lot depth variance with the seven conditions as noted in staff's December 10, 2003 report and was supported by Mr. Tralle. Motion carried 5 -1 (Rafferty — Nay). DRAFT MINUTES • • • • • Planning & Zoning Board December 10, 2003 Page 3 Ms. Lane made a MOTION to approve the allocation of 3.7 acres of 2004 MUSA reserve with the seven conditions as noted in staff's December 10, 2003 report and was supported by Mr. Tralle. Motion carried 5 -0. A. PUBLIC HEARING for Preliminary Plat and CONTINUED PUBLIC HEARING for Conditional Use Permit, Eagle Brook Church, 7709 20th Avenue N. Chair Schaps opened the public hearing at 7:03 p.m. Staff stated the P &Z opened the public hearing on the Conditional Use Permit application at the November meeting. That public hearing was continued. A number of issues remain unanswered, one of which was the existing house on the site. In the interim, the church had submitted an application for a preliminary plat to create a separate lot to allow the house to remain. A preliminary plat required a public hearing. New notices were published and mailed. He noted they could now combine the public hearings for the Conditional Use Permit and the preliminary plat. Staff noted the November report also called for additional information on the stormwater design and roadway improvements. Public comments at the hearing resulted in requests for further information on several specific issues, which requests were outlined in staff s November 12, 2003 report. Staff indicated representatives of the church met with residents on Tuesday, December 2, 2003. The discussion covered several issues. Staff presented their analysis and noted there were still many issues remaining to be resolved prior to approval. Staff recommended they continue the public hearing on the CUP and preliminary plat to the January 14, 2003 meeting. Mr. Rafferty asked how many acres was upland. Mr. Smyser replied he believed this was in his first report, but he could not come up with that information at this time. Chair Schaps believed it was 65 acres of upland. Mr. Tralle asked who would monitor Ditch 72. Mr. Smyser replied Ditch 72 was the responsibility of the Rice Creek Watershed District. Mr. Tralle asked if Ditch 72 fluctuated throughout the year. Mr. Smyser replied it did fluctuate. Mr. Studenski replied at times the ditch did not have full flow and that was taken into account. Mr. Smyser noted the rate that flows through there would be the same. • Mr. Studenski stated they were relocating the pipe in the ditch. To clarify, Mr. Smyser noted it was called a County Ditch, but there was actually a pipe flowing on the property. DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 4 Mr. Tralle clarified it was the size of the pipe and not the flowage. Mr. Studenski replied that was correct. Mr. Hyser asked if the pipe was at maximum flow all year. Mr. Studenski replied that was correct. Mr. Hyser asked if the pipe went to maximum flow, would that change the amount of water going through the pipe. Mr. Smyser replied the pipe had capacity for more flow and this project did not have an effect on it. He stated if someone was changing something upstream, it would change the flow, but this project would not change it. Mr. Hyser asked who ultimately would be responsible if the calculations were wrong. Mr. Smyser replied that would have to be determined as to what the cause was. He noted there might be changes downstream or upstream, but that does not mean this project changed the flow. Chair Schaps invited applicant to make comment. Katherine Leonidas, BWBR Architects, stated they had met with the neighbors and the result of that was some design changes. She believed the neighborhood meeting was successful. She showed the primary changes, which included the roadway moving 200 feet along the southern property line. She noted additional screening was added to the north, as well as screening along road 21. She summarized the hours of operation. She asked them to keep it in mind that this church would operate on two campuses. She summarized how they would prepare for crime control. She noted it was still being discussed about the lighting at the two intersections to the east. She summarized the site lighting for the Board. She noted the lighting was identical to the lighting around City Hall. She indicated they would have some lighting in the back for security and some lighting around the drop off canopy. She noted the spire would be lit with the same fixture lighting the flag outside of City Hall. With respect to snow removal, there was a concern that they not be pushing snow into neighbor's yards. She stated the church had met with the landscaping contractor and summarized where the snow would be placed, all of it on pervious soil. She stated the design of Ditch 72 would not change the drainage and the area it served. She asked her septic design engineer and traffic consultant to address the septic design and traffic flow concerns. Peter Miller, Ecosystems Engineering, Elk River, Minnesota, noted they had vast experience regarding septic designs. He noted they have been involved in this project since 2002 and they had done a preliminary investigation of the soils and had submitted a preliminary report. He noted Anoka County would be handling the permitting of the system. He stated they had submitted a permitting process to Anoka County and they had approved their plans. He stated Anoka County had approved their submittal. He summarized the project for the Board. He noted the monitoring system consisted of a dedicated phone line so the monitor of the system had on -line instant access to the system. He stated Anoka County had agreed with the design and it was appropriate for the site, but they did have a concern about the length of the sewer line and the possibility of freezing. He informed the Board as to how they would address those concerns, DRAFT MINUTES • • • • • • Planning & Zoning Board December 10, 2003 Page 5 including insulating the lines and placing the lines at a depth that would not encourage freezing. He noted there was another area identified for the drainfield of the house and they would be visiting the site within the next 10 days to look at that location and they were confident they could locate another drainfield site for that property. Mr. Corson asked if they would put in some type of barrier around the drainfield to ensure that area was protected. Mr. Miller replied they would comply with State law, which required an owner being made aware of the drainfield area. Ms. Leonidas replied they would fence off the drainfield area, which would consist of a split rail fence, both on this property and the church property. Mr. Rafferty expressed concern about the aesthetics of having a bunch of split rail fences on the site. Mr. Tralle asked if the septic tank would be pumped annually. Mr. Miller replied they would check it annually to see if it needed to be pumped, but it would be pumped minimally every three years, according to State law, unless the City had other requirements. Ria Cote, Traffic Consultant, noted they were aware of the Wednesday, weekday evening and Saturday traffic She stated they were in the process of gathering this information, but they expected the results to be identical to what was completed for the Sunday morning peak periods. She recommended the use of traffic control officers at key intersections and driveways. She noted there should not be a delay in the approval based on the anticipated traffic study results. Pat Smith, 9922 West Shadow Lake Drive, asked about the $500,000 request by Anoka County to MNDot for the two interchanges in the Quad paper. Mr. Smyser replied he had not seen that article. Chair Schaps invited the public to make comment. Mr. Wayne LaBlanc, 1677 Peltier Lake Drive, Centerville, thanked the church for the neighborhood meetings. He expressed concern about the conservation easement and the protection of the herons, as well as the timing of the start of the construction. He stated the island that the herons were on was very fragile and for three years it was not successful for nesting, except for the last year. He noted there was only 200 -300 herons that had come back, which was considerably lower than what had previously nested there. He stated this next year was critical for the survival of these birds. He urged the church and the City to go the "extra mile" and protect this area and to shift the construction until July. He indicated the birds nested from March through June. He expressed concern about the conservation easement. He stated he did not see the leadership of the church implement this easement at the time of the permitting process, instead of later. He stated as a condition of the conditional use, the conservation easement should be in place. He expressed concern about the traffic and roads. He believed all of these concerns should be solved before the church received the Conditional Use Permit also. He noted he hoped the church paid their fair share for DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 6 providing infrastructure. He expressed concern about the septic system and noted he was skeptical if they had a season like 2002 that this water would have no place to go, except in the lake. He asked if they could have a computer simulation of the 2002 season to see what happened if it rained all of the time as it did in 2002. He stated unless these concerns were addressed, he requested the Board not to recommend the Conditional Use Permit. Ron Marier, 1801 77th Street East, stated he had pulled Section maps from Anoka County for Ditch 72 and 55, as well as having a discussion with Rice Creek Watershed District and it was determined that all of the data was from the 1920 maps and they did not know what the actual drainage area was. He stated because the pipe was limited, the system became overloaded, which made a large river flowing through several properties. He noted this affected 1100 to 1200 acres being drained. He indicated this was done by overlaying 1920 and 1972 maps. He stated they could limit the pipe, but they could not control the water once the land became saturated and did not filter through the ground. He stated the water would fill up and overflow, which would result in the water flowing into the watershed. Once the woods flooded, the trees would be gone forever. He indicated Rice Creek Watershed agreed that this was a possibility. He stated someone needed to go back and find out what the ramifications were. Chair Schaps asked if the Rice Creek Watershed indicated they were going to do an additional study, or if they were going to change their opinion. Mr. Marier replied he did not have a definitive answer from them that they were going to do anything, except they had agreed to look at this area with him. Mr. Marier noted with all of the impervious surfaces, any overflow drainage would drain into the lakes. Chair Schaps asked if there was anyone from Rice Creek would agree to this. Mr. Marier replied Rice Creek was just made aware of this situation and he had not received any confirmation from them regarding this issue yet. He expressed concern that Rice Creek Watershed had not gone the extra distance to obtain the correct maps prior to issuing their opinion. He expressed concern about the conservation easement for the herons. He showed where the herons utilized the site to gather the sticks. He asked the conservation easement be extended to preserve the area east of the conservation area, which was where the herons gathered their sticks for their nesting. Barbara Bor, 7797 20`h Avenue North, asked for clarification of Anoka County and the State's intent for the road infrastructure. She noted she had heard there was no money beyond 2006. She stated she also wanted the seven driveways included in the traffic study. She asked for further information about the lighting of the traffic that would be leaving the site. She acknowledged Sheri Broker for her efforts in communication in this process. Barbara Bauman, Eagle Brook Church and resident of Lino Lakes, reiterated the Church's committee had been in conversation with the Church Board and the easement was approved to proceed as proposed. She noted they were also given approval to start negotiations with Rice Creek to establish the Conservation. However, she indicated until DRAFT MINUTES • • • • • • Planning & Zoning Board December 10, 2003 Page 7 they knew they could build on this site, they did not want to start the process on obtaining the conservation easement. She noted the church was very concerned about the herons on the site and they were committed to working on this issue and were committed to hearing all ideas. She noted as far as the issue of timing of construction, they had looked into this issue also. She pointed out that the closest construction would be 2500 feet from the island, and that would be the septic system. She stated they were going by the State of Washington's recommendation for the preservation of the herons and it was recommended a minimum of 984 feet from human contact be kept away from the nesting season. She noted the primary activity for this construction would be 3,000 feet. She stated they were checking into if it was possible to work the construction schedule around the nesting season and have the loudest construction done at the end of the season. Staci Wittner, 7542 Peltier Lake Drive, stated she was not looking forward to the development of this land, but she was not opposed to it either. However, she was opposed to the size of the church. She expressed concern about the traffic, the herons, the septic system, and the lake. She presented a calendar of events held at the church and noted the church would be used every day at all times of the day. With respect to traffic, she expressed concern for safety on the residential streets and the increase of traffic on Sunday morning. With respect to the herons, she expressed concern that the loud spring construction would cause the herons to abandon their nests and the continued noise would cause the herons to permanently leave this area, as well as the incursion into he southeast corner of the property. With respect to the septic system, she expressed concern about the septic system backing up, or a failure of the system would be disastrous. With respect to Peltier Lake, she expressed concern that pumping water from the lake, increased run off and increased boat traffic, which could destroy plants and water quality. She requested as a condition of approval, no type of outdoor amplification be allowed; the church not use 77th or Peltier Lake Drive, and no construction be allowed during the heron - nesting season. Scott Anderson, staff on Eagle Brook Church, stated throughout the process, they had tried to be honest. He noted they were a growing church and was a large church. He noted he schedule was public and he would provide a schedule for the whole year if requested. However, he noted this was still a two- campus church and all of the activities would not be moved to this proposed church. He noted their current building was approximately 60,000 square feet and they were located in a residential area. He noted they had performed a traffic study last weekend and they found that people who came to the church understood the challenges and the peak times tended to be 17 -18 minutes. He noted their most attended service was the 11:00 a.m. Sunday service, with Saturdays services being less. He noted the Saturday services was when more families attended. He stated there were two services on Saturday night and four on Sunday morning at 9:30, 10:15, 11:00 and 11:45. He stated they managed the traffic well with one traffic officer and when they had a large event, they hired more traffic officers. He noted it was in the best interest of the parishioners to get them in and out as efficiently as possible. He stated when they have issues of traffic, their attendance reflected that and they made improvements. He stated they would do whatever was necessary to keep traffic flowing and make the residents access first priority. He noted, however, that there would be challenges to traffic and they were not trying to hide this fact. He thanked the board and DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 8 residents for their input and they would continue to look at the neighborhood issues and find solutions. Ms. Wittner stated she had attended last week's service and she was there from 10:30 to 11:15 a.m. and the traffic was nonstop. Roxy Greifenhagen, 8925 20th Avenue North, stated she had just moved here from White Bear Lake and the church traffic had been a major problem since it was built in that area. She stated the church also had promised to protect the bird population in that area and now the birds had left. She expressed concern about the traffic and stated this proposal was not appropriate for this site. Mr. Corson made a MOTION to continue the public hearing on the CUP and preliminary plat to the January 14, 2003 meeting and was supported by Mr. Hyden. Motion carried 5- 0. Ms. Smyser asked for comments regarding what the Board wanted for the level of service at 20th and Main. Chair Schaps stated the issue was what the peak times were. He indicated he did not know if there was good answer and the best way to handle this was to deal with it the best way you could and deal with it. He stated this was a limited period of time that traffic would be affected, but it was not going to be a continuous issue. Mr. Corson noted he did not think the City of Lino Lakes had jurisdiction to add a turn lane, as he had suggested previously. Mr. Tralle stated traffic was a problem in the City and it boiled down to one thing — nothing was going to change, unless the City developed. He stated he believed they should keep building and bring the roads up to the developments. Ms. Lane agreed with Mr. Tralle's opinion, acknowledging this was a painful process, but this was the process. Mr. Rafferty noted traffic problems were everywhere and noted there were many residents who did not want road improvements, so he did not believe there was an answer. However, he did agree with Mr. Tralle's opinion. Mr. Hyden stated he also agreed with Mr. Tralle. He noted nothing was going to change until development or a terrible accident occurred. He indicated there was no easy answer to this problem. Chair Schaps recessed the meeting at 9:21 and reconvened at 9:35 p.m. B. CONTINUED PUBLIC HEARING for Conditional Use Permit, Circle -Lex VFW, 7868 Lake Drive DRAFT MINUTES • • • • Planning & Zoning Board December 10, 2003 Page 9 Staff noted they had met with applicant to discuss the project design. The applicant had requested this item be continued to the January 14, 2004 meeting to allow time to work out unresolved issues. Mr. Tralle made a MOTION to continue the Conditional Use Permit, CircleLex VFW, 7868 Lake Drive to the January 14, 2004 meeting and was supported by Ms. Lane. Motion carried 5 -0. C. PUBLIC HEARING for Rezone and Preliminary Plat, Legacy Holdings Lino Lakes LLC, Legacy at Woods Edge, SE corner of 35W and Lake Drive Chair Schaps opened the public hearing at 9:37 p.m. Staff stated in 1998 the City of Lino Lakes retained the services of the Calthorp Associates to design a Master Plan for the City's Town Center District. He noted the purpose of the Lino Lakes "Town Center" development was to provide for the orderly and integrated development of a high - quality Town Center which included a mix of shops, offices, entertainment, housing, recreation, community facilities, and open space. He indicated his development was a cooperative effort that would leverage public and private investment to create sustainable value, ecologically, economically and culturally. • Staff summarized the project and presented its analysis to the Board. Staff stated generally, the proposed development was consistent with the original Calthorpe Master Plan and Design Standards. The Hartford Group had been very receptive to design modifications to insure a high quality development. He noted there were some further changes and clarifications that needed to be incorporated into a final plan as suggested in staff's report. He indicated due to the complexity of he project and the amount of information presented to the Board, it was staff's recommendation to continue the public hearing until January. In addition to receiving preliminary comments from the Board and the general public, staff would also request consideration of a special Planning and Zoning Board meeting in January. Mr. Hyden asked if the bridge would be a part of the deal. Mr. Grochala replied this was still being worked out with the County, but at this point, they were going to make it work without a new bridge. He indicated they were trying to improve the safety in the area. Mr. Corson asked if it was possible the City do the ramps. Mr. Grochala stated the southern ramps had been an issue since 1986. He stated their proposal would be to align the ramps and add a left turn lane. He stated how this ultimately got funded, they would be working with the County and State. Chair Schaps invited applicant to make comments. • Bill Griffith, Hartford Group, summarized the project for the Board. He noted this was a truly mixed project, which would create an intergenerational village. DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 10 Mr. Rafferty noted in staffs report, staff had requested the building facades be simplified. He asked how would they be simplified. Mr. Grochala replied they wanted the buildings to be broken up so it looked like they were multiple buildings. He indicated staff believed they were getting too many different designs. He noted staff did not want mirror images of the buildings. Mr. Rafferty stated he liked the concept of the design and he liked the direction they were going. He stated the past had been proven successful and he believed there was no reason not to look back to the past for those ideas. He asked staff to not simplify the design too much. Chair Schaps asked how difficult of an issue was the parking. Mr. Grochala replied it was not difficult and there was shared parking where practical. Mr. Griffith stated the range of the housing had not been established at this point, and they were studying this at this time. He stated he estimated they would have this information for the next meeting. Chair Schaps asked if there would always be a set percentage of owned real estate and non - workforce rentals. Mr. Grochala stated the number one requirements for the townhomes would be a for -sale market, with the remainder being rental. He stated roughly just under 50 percent would be rental. Chair Schaps stated a lot of what happened commercially depended on income level and how did the City protect itself that the rental income would not increase. Mr. Grochala replied he believed this would not increase and they were continuing to work on this with the developer. Mr. Griffith replied the maximum of rentals would be 20 percent and that could not be changed. He noted, however, that an individual owner could rent their unit, which would not be a part of the 20 percent, but that was uncommon. Mr. Rafferty asked if this type of development had been done in other cities. Mr. Griffith replied they were currently working on a Master Development in three cities and each have similar elements. He noted they had also done similar developments in three other cities and invited the Board members to visit those cities. Mr. Rafferty asked about the livable communities grant and asked Ms. Couts if she saw something in that proposal that make this site desirable. Elizabeth Couts, Executive Vice President of Hartford Group, stated she was the Mayor of Burnsville and she had seen things that made this site a very desirable place for this type of a development. Mr. Corson asked if they had considered what would be on the other side of Lake Drive and stated if this concept worked, could it be expanded to that area. Mr. Grochala replied they would like to see this development take place and expand to other areas. He stated he believed there were opportunities to the west of Lake Drive for some type of a development in that area. DRAFT MINUTES • • • • • • Planning & Zoning Board December 10, 2003 Page 11 Mr. Rafferty asked when/if this was approved, what would be the first things to be developed. Mr. Grochala replied the senior housing would go in first. Mr. Griffith indicated they had a sit down restaurant very interested in this site also. Mr. Tralle asked what type of retail would there be on this site. Mr. Griffith replied it would be a mix of retail, however, they hoped to have some franchise businesses also because those businesses were proven successful. He noted there might be a grocer, as well as one or two unique restaurants. He stated there would not be a big box user in this project. Mr. Rafferty asked if the Fire Chief had any comments about this development with respect to one entrance. Mr. Grochala stated they had been working with Public Safety and Public Works on these issues and there were design considerations with the street widths, but this did not appear to be too much of a concern at this point. Chair Schaps invited the public to make comment. There were no comments from the public. Mr. Tralle asked for a list of other projects Hartford had done. Mr. Griffith noted their projects were listed on their website and if the Board needed further information, to contact him. Mr. Grochala asked the Board if they would oppose a second special meeting in January to discuss only this project. The Board agreed to another meeting. Mr. Corson made a MOTION to continue the Public Hearing for Rezone and Preliminary Plat, Legacy Holdings Lino Lakes LLC, Legacy at Woods Edge, SE Corner of 35W and Lake Drive and was supported by Mr. Tralle. Motion carried 5 -0. D. PUBLIC HEARING for Comprehensive Plan Amendment, Preliminary Plat/Planned Unit Development and Conditional Use Permit, Hokanson Family Partnership, Marshan Townhomes 2nd Addition, NE corner of Lake Drive & Aqua Lane Chair Schaps opened the public hearing at 10:55 p.m. Staff stated applicant had submitted a request for a comprehensive plan amendment, a residential planned unit development/conditional use permit, and preliminary plat. The subject site was four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. Staff indicated the request was to change the land use category from Medium Density Residential to High Density Residential, and to plat the site as a planned unit development (PUD). A residential PUD required only a conditional use permit under the 2003 ordinance, rather than a rezoning as before. DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 12 Staff noted this was the same site discussed by the P &Z previously on August 13, 2003 when a comprehensive plan amendment was considered. The P &Z recommended denial of that application. The City Council then discussed the application at a work session on October 22, 2003 and indicated they would not support it. The applicant subsequently withdrew that application. A question did arise at the work session about whether or not a PUD could accommodate a higher density than the Medium Density category allows. The Ordinance requires that a PUD comply with the density in the comprehensive plan. Staff presented their analysis and recommended denying the amendment to the comprehensive plan to change the land use category from Medium Density to High Density and to also deny the conditional use permit/planned unit development/preliminary plat. He noted staff would prepare an amendment to the zoning ordinance to rezone the site to R -3 to bring it into conformance with the comprehensive plan. Staff stated the recommendation to deny all aspects of the Marshan Townhomes 2nd Addition application was based on the following findings: 1. The comprehensive plan guides the four -acre site proposed for development and the existing Marshan Lake Townhomes site for Medium Density Residential: 3 -6 units per acre. 2. The existing townhomes were built at a density of 6.4 units per acre. That is, the land use map shows the development at a lower density than how it was actually approved and built. 3. The site is zoned R -4, High Density Residential. Under the City's current zoning ordinance, R -4 is intended for the High Density land use category: 6 -12 units per acre. 4. Therefore, the current R -4 zoning is not consistent with the current Medium Density classification. Such inconsistencies should be corrected by amending either the zoning or the comprehensive plan. 5. Hokanson Development has requested a comprehensive plan amendment. The request is to change the land use category from Medium Density Residential to High Density Residential. 6. A residential conditional use permit PUD may include a variety of residential units, including single family and multifamily units as long as it complies with the density requirements, as stated in the zoning ordinance, Section 2, Subd. 10.A., Purpose and Intent (for a planned unit development). 7. The maximum allowable density within an urban residential PUD shall be consistent with the density directives of the Comprehensive Plan, as stated in he zoning ordinance, Section 2, Subd. 10.D.3., Urban Residential Planned Unit Development Requirements. DRAFT MINUTES • • • • • Planning & Zoning Board December 10, 2003 Page 13 8. High Density of up to 12 units /acre is not consistent with the existing townhome neighborhood, which is 6.4 units /acre. Medium Density (six units /acre) will allow development that will be very close to and thus consistent with the existing neighborhood. 9. The site should be rezoned to R -3 to be consistent with the comprehensive plan classification of Medium Density. 10. The Lino Lakes Growth Management Ordinance, Ordinance No. 01 -03 establishes a goal to limit new growth in the City to an average of 147 new housing units per year, with discretion to exceed this target by 20 %. 11. The proposed Marshan Townhomes 2nd Addition would exceed the growth goal by 45% if it were final platted in year 2004. Chair Schaps invited applicant to make comment. Mr. Ron Fuchs, 9174 Isanti Street NE, Blaine, Hokanson Development, stated they had submitted recent documents clarifying some of the concerns the Environmental Board had. He presented various documentation to staff and the Board clarifying their position. He stated the reason why this plan had changed from the initial comprehensive plan was because of the Brugemann development that as approved and that the changes that had been requested previously. He noted they had 50 percent open space with this proposed development. Chair Schaps asked how did they expect this proposed to be received, when they were not addressing the concerns of the existing residents and the concerns the Board expressed at the August meeting. Mr. Fuchs replied he hoped the Board would approach this with an open mind. He noted he did not believe what they were proposing was different than what was already there. Chair Schaps asked if they had considered proposing this as a concept plan. Mr. Rafferty noted he did not see elevations on their plans. Mr. Fuchs replied he had submitted elevations to staff and he did not know why those were not provided to the Board. Mr. Smyser replied staff had received full size drawings only, not reductions to distribute. Chair Schaps asked if he believed they should disregard everything the residents had concerns about. Mr. Fuchs replied they were asking them to take the information provided to the City, review the information and make a decision with the understanding that the Comprehensive Plan could be changed. Chair Schaps invited the public to make comment. Jim Crawford, President of Marshan Lake Condominium Association, agreed with staff that this amendment should be denied. He stated the Association wanted this area to DRAFT MINUTES Planning & Zoning Board December 10, 2003 Page 14 remain medium density. He stated when their townhomes were built, Mr. Hokanson did not own the property under consideration and they were not aware of any second addition plans so how the statement could be made that this was a Master Plan was inaccurate. He stated he had appeared before the Environmental Board and agreed with their concerns. He stated he hoped that this request would be denied. He expressed concern about the density of this proposal. He stated they were currently involved in litigation with Mr. Hokanson and the developer, but nothing had been corrected. Mr. Fuchs stated when Marshan was initially developed, Mr. Hokanson did own the vast majority of this property. Ms. Lane made a MOTION to close the Public Hearing at 11:30 p.m. and was supported by Mr. Rafferty. Motion carried 5 -0. Ms. Lane made a MOTION to deny the requested change of land use category from medium to high density and was supported by Mr. Tralle. Motion carried 5 -0. Temporary Signs/Banners Staff stated they were seeking direction from the P &Z Board on how to address the issue to banners and other types of temporary signs. He noted staff would then take those recommendations and prepare an ordinance for a future public meeting. A STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: January 14, 2004 TOPIC: CONTINUEDPUBLIC HEARING: Preliminary Plat and Conditional Use Permit For A Church In the Rural Zoning District Eagle Brook Church BACKGROUND The P & Z opened the public hearing on the conditional use permit application at the November meeting. That public hearing was continued to the December meeting. A number of issues remained unanswered, one of which was the existing house on the site. We received an application to plat the property to create two lots, one for the church and one for the house. The public hearing on the plat was opened at the December meeting. We can combine the two public hearings into one. The hearing was continued to the January 2004 meeting. The November staff report also called for additional information on the stormwater design and roadway improvements. Public comments at the hearing resulted in requests for further information on several specific issues. The December staff report updated information in the previous report. We received new plans and information on December 18. ANALYSIS Issues that were not resolved after the December meeting are listed and discussed below: • A revised preliminary plat was needed indicating the locations in Lot 2 of the existing well, the existing septic system, and a site for a secondary drainfield. All must meet the required setback and separation distances. A soils analysis is needed for the secondary drainfield site. We received a revised set of plans on December 18. The plans indicate the locations of the existing well and drainfield as well as a secondary drainfield site. Setbacks from lot lines must be 10 for the drainfields. The drainfields must be 100' from the well. The plan meets these requirements. The soils analysis supports the designed mound system. • Typical lot line easements must be included on the plat. The lot line easements have been added to the plat and grading plan. Easements are shown over ponds, swales, and wetlands. These must be included on the final plat, as normally required. • The traffic analysis must be revised to address service times on Saturdays and weekdays. • • Eagle Brook Church page 2 We received the new analysis on January 8, 2004. Staff did not have time to review it prior to this report being completed. If the new analysis shows impacts similar to the Sunday peak periods, the mitigation measures would be the same: traffic personnel at driveways and affected intersections. If the analysis shows impacts far more severe than the Sunday peaks, it may warrant reconsideration. If the analysis is such that staff cannot conduct a preliminary review, staff may recommend tabling the project to the February P & Z meeting. This will require an extension agreement from the church. The alternative is to recommend denial of the project. • Information needed for review of the stormwater management design must be provided, as discussed in the City Engineer's memo. The new plans properly address drainage from 20th Ave. and from properties on the south. The previously proposed berm on the south property edge has been removed from the new grading plan. The ditch realignment design meets requirements. • Information needed for review of the roadway improvements. The new plans show the proposed turn lanes and pavement widening for bypass lanes. The design is acceptable. The plans also show the proposed right of way dedication. The existing right of way is 66' wide, or 33' on each side of the center line. The church proposed to dedicate an additional 30', to total 63' on the west side. The existing house lot fronting on 20th Ave. within the north portion of the site is not part of the plat. A separate deed will be necessary to dedicate the right of way along the 165' of frontage of that lot. • Traffic criteria and policy must be considered as it applies to the application and other development in the eastern part of the city. This relates to the level of service (LOS) criterion for plats, conditional use permits, and site plans. The traffic analysis prepared for the Environmental Assessment Worksheet concluded that the peak periods will create unacceptable levels of service at 35E ramps and at 20th Ave./Main St. Under the City's site plan and CUP requirements, this would be justification for denial of a project unless the project applicant proposes a way to resolve the level of service problem. The difficulty arises when looking at the larger picture. The 20th Ave./Main St. intersection is over 1 1/2 miles from the proposed church site. This is quite a distance for establishing levels of service for roadways. In addition, that intersection is in another municipality (Centerville), over which Lino Lakes has no jurisdiction. These questions loom even larger in relation to the I -35E interchange. Clearly, no project applicant can reconstruct a freeway interchange unless the proposed development project is huge • • Eagle Brook Church page 3 enough to cover the costs. (For example, a large shopping mall, sports arena, or commercial development such as the Best Buy site in Richfield.) Both MnDOT and Anoka County would have to be involved in such a project for design and funding. An even more difficult question arises in considering the implications of denying the project because of the traffic impacts. Land in the vicinity of the interchange is guided and zoned for commercial and industrial development. If a retail, office, or industrial project is proposed in that area, we would have to deny it as well unless the interchange were reconstructed to handle the traffic. Forty acres of retail development will generate far more traffic than the proposed church. In response to a staff request for direction on the question, the P & Z discussed this question at the December meeting. Board members made several points. The interchange at I -35E is bad now but unfortunately, funding for transportation projects comes in response to a major problem. Funding is not available for proactive construction to prevent problems. Besides, even when road improvements were offered by the county to address an existing bad situation, Lino Lakes residents opposed them. The church peak traffic events are a few times a week, for a matter of minutes, not hours. There is no easy answer, but the interchange and intersection won't get fixed until development pressure makes the situation worse. Therefore, the unanimous view of the P & Z was that the traffic issue should not be the reason to deny the church's application. • Additional landscaping has been added on the new plans. • We sought examples of other wastewater treatment systems like the one proposed. I spoke with Environmental Services staff at Carver County. She said they have a number of multi - mound treatment systems in the county, and have experienced no problems. One has five mounds, with a design for more wastewater flow than the Eagle Brook system. They do not have an Advantex pretreatment system (as proposed by Eagle Brook). They do have at least one other with a different type of pretreatment. She said she likes the Advantex system and wishes somebody would build one in her area. I also spoke with Anoka County staff. Likewise, there are several multi -mound systems, and there have been no problems. Burns Township has a multi -mound system with a pretreatment design that is different from the Advantex system. As with any onsite system, use and maintenance are key to a successful system. • Existing driveways have been added on the new plan sheets. • The driveways to the site should be lit with typical street lights to ensure the safety of traffic control personnel at night. At planning staff's request, the CPTED officer looked at the typical street lights in the city and recommended that one would be adequate at each driveway. • Eagle Brook Church page 4 • The cross on the side of the church will be lit, though the light can be turned off with the other site lights after events. • Signage: This was not discussed previously, as signage typically is a permit issue. However, the issue arose from discussions with the church. The sign ordinance states: Illuminated signs are permitted only in limited and general business, shopping center, central business and light and general [industrial] districts. Section IV. G., Ordinance No. 12 -97 The church wants two monument signs, one at each entrance. They plan to illuminate both. The ordinance clearly prohibits illuminated signs in a Rural zoning district. CONDITIONS OF APPROVAL The following issues should be considered as conditions of approval: • 1. Additional right of way shall be dedicated to Anoka County for 20th Ave. (CSAH 21), as indicated on the plans. This shall be shown on the final plat. 2. A separate deed for the right of way along the exception lot (7791 20th Ave.) shall be recorded with the final plat because this lot is not part of the plat. 3. All necessary permits shall be obtained by the applicant from Anoka County for work in the 20th Ave. (CSAH 21) right of way. 4. Signage is governed by the City's sign ordinance and permits are required for all signs. 5. Additional screening shall be added on a revised landscaping plan. 6. Drainage and utility easements must be created over all ponds and wetlands. These must include land 25' from the delineated wetland edge, as proposed on the plans. These easements must be included on the final plat. 7. Easements must be placed over the relocated drain tile for Co. Ditch 72 and deeded to the Rice Creek Watershed District. 8. Issues listed in the January 7, 2004 memo by the City Engineer must be resolved to his satisfaction. • 9. Stop signs shall be installed for vehicles exiting both driveways. 10. The church shall enter into a site performance agreement prior to issuance of a building permit. • • • Eagle Brook Church page 5 11. The church shall enter into a maintenance agreement for the stormwater facilities prior to issuance of a building permit. 12. A management plan for the prairie areas must be prepared and obtain approval from the City prior to building permit issueance. 13. Traffic control personnel shall be employed during peak periods at the I -35E interchange, at the 20th Ave. and Main St. intersection, and at the access driveways to the site. These personnel shall be law enforcement officers. 14. During church services and large events, the northern driveway shall be entry only and the south driveway shall be exit only. Traffic control personnel shall be present at the driveways to assure this. 15. Parking lot lighting shall be turned off no later than two hours after services or other events at night. 16. The terms and dimensions of the conservation easement in the southwest portion of the site must be agreed to by the church and the easement holder prior to issuance of a building pe�niit. 17. The sewer line from the building line to the septic tanks must be insulated to prevent freezing. 18. A fence or other barrier shall be built to protect the septic system treatment areas. 19. Street lights typical for road intersections shall be installed at the church's cost at the end of each access driveway on CSAH 21 (20th Ave.). OPTIONS 1. Approve the preliminary plat subject to the conditions listed. 2. Approve the conditional use permit subject to the conditions listed. 3. Deny the applications. Review memorandums dated November 5, 2003, and December 4, 2003, have also been previously prepared for this proposed church construction. Since the previous review of December 26, 2003, drainage calculations have been reviewed, and some additional issues have been identified. This review memorandum is therefore essentially a repeat of the December 26, 2003 memorandum with some additional comments added. Comments provided in other previous memorandums may also remain effective as applicable. Comments are as follows: General 1. Potential drainfield sites were analyzed at 7709 20th Avenue North and soil borings performed. A requirement of replatting the property is that the existing home must have an alternative drainfield site within its proposed boundaries. As a result of the findings (loamy fine sand over clay loam and a seasonal high water table ranging from 28 -42" below the surface), an above grade drainfield or mound system will be required. A Preliminary Plat sheet for Eagle Brook Addition has been received. The plat provides for division of the property into two lots: An 82.897 acre parcel containing the Church, and a 6.232 acre parcel to provide for maintaining the existing residential property on the southeast side of the property. A table figure of 2.385 acres for right -of -way dedication for 20th Avenue North (County Road 21) is also provided. An additional 165 feet right of way will also be required from the small parcel of property located along 20th Avenue North near the north end of the property. This is an existing single family unit that is not part of the Church property. However, the proposed roadway widening does extend in front of this property, and the additional dedication is required. The Plat will require the review and approval of Anoka County, and approval will likely be contingent upon dedication of all required right -of -way. The applicant shall therefore be responsible for all right of way dedication and acquisition as required, including property not owned by the Church. In addition, provisions regarding septic and drain field for this property as explained in Item 1 above must be considered. Drainage and utility easements per City requirements are shown on the plat, including standard easement dedications of 10 -foot in width around the perimeter of the property and 5 -feet on each side of property lines. Drainage and utility easements have also been provided around all wetland areas and proposed drainage detention facilities. It is also recommended that a utility easement be provided to encompass the proposed sanitary sewer conveyance and treatment system. Traffic and Roadways Issues relating to traffic have been discussed and addressed significantly throughout the review process for this proposed development. Mitigation of traffic issues and requirements as expressed in previous memorandums, including requirements of Anoka County and the City of Lino Lakes, remain applicable. This includes the requirement to provide mitigative traffic control measures on Sunday mornings at the intersections of Main Street with 20th Avenue North (County Road 21) and the freeway ramps, and at the church entrance on 20th Avenue North. Roadway improvements to 20th Avenue North have also been proposed in consultation with Anoka County, and the plans shall be subject to approval by the County. It is our understanding that the applicant is in the process of preparing and submitting additional traffic 40 information for further review. Stormwater Management 1. A CAPROC (Conditional Approval Pending Receipt of Changes) has been received from the Rice Creek Watershed District (RCWD). The CAPROC lists several outstanding items (primarily administrative) that must be addressed or received prior to the approval of a formal permit. Rice Creek Watershed District Permit Application Number 03 -073 may be referred to for further details regarding the CAPROC conditions. The requirements of RCWD must be adhered to throughout construction. 2 A main issue of concern has been the maintaining of Anoka County Ditch No. 72 (Main and Branch 1), that runs through the church site and exists as drain tile. It is proposed to re -route the ditch around and through the site as storm sewer pipe. The flow capacity of the existing ditch must be maintained. Hydraulic calculations have been submitted to the City for verification, and have been reviewed. Review comments for the calculations are provided further below. Previous concerns had been expressed regarding the maintaining of existing drainage from neighboring properties to the south, and the ditches along County Road 21. These issues have been addressed with the revised grading plans. Based upon the information provided, there will be no increase in the developed rate of runoff from the site. Best Management Practices (BMP's) have been incorporated into the site design to limit and control the rate of runoff, and provide stormwater treatment per RCWD requirements. There is no filling and/or impact to existing wetlands or flood plain proposed. Existing woodlands and buffer Eagle Brook Church Review Page 3 January 7, 2004 City of Lino Lakes, Minnesota areas adjacent to Peltier Lake are proposed to be left naturally as is. In addition, dedicated wetland buffers are shown on the Preliminary Plat. 5. Further construction details for the bioretention basins have been provided as required and included in the plans. Groundwater levels have also been addressed to verify that the infiltration basins will function as intended. 6. A permit in accordance with the requirements of the NPDES (National Pollution Discharge Elimination System) in accordance with the most recently adopted requirements of the MPCA and the City of Lino Lakes shall be obtained by the church, and shall be administered as required. Drainage calculations have been submitted for review. Review comments are as follows: 1. Existing condition runoff curve number information was not given. However, the narrative mentions existing row crops. A curve number of 61, pasture, good condition should therefore be used for the row crops. 2. The following information is missing and should be provided: Existing and proposed drainage area maps. • Existing and proposed hydrology information, including curve number computations and time of concentration computations. • 10 -year storm summary information. • High water levels for all pond, wetlands, and ditches on the grading plan. Low floor elevation of the Church building on the grading plan (the finished floor elevation is provided). Wastewater Treatment 1. In accordance with the City's Comprehensive Plan, the church is located in an area designated as rural, and the extension of sanitary sewer into this area is not anticipated in the immediate future. An on -site treatment system has therefore been proposed. Existing septic systems must be removed and/or abandoned in accordance with local and state requirements. 2. An on -site wastewater treatment system is proposed, based on the Onsite Wastewater Treatment System Final Design Report and Specifications for Eagle Brook Church, dated October 8, 2003, by Eco Systems Engineering, Inc. The system and Design Report have been reviewed by TKDA and the Anoka County Public Health Specialist. The system is acceptable and has been proven successfully in similar applications in Minnesota. The system as proposed exceeds design requirements. Eagle Brook Church Review Page 4 January 7, 2004 City of Lino Lakes, Minnesota 3. The sewer line from the building line to the septic tanks should be insulated to assure that freezing of the line will not occur. 4. An appropriate barrier must be constructed around the treatment area and drainfields for protection from off-road vehicles and snowmobiles. 5. It is highly recommended that the installation, performance, and reliability of the treatment system be guaranteed or strongly assured in some written fashion. It is therefore recommended that either Final Plans and Specifications for the treatment system be signed by a Registered Professional Engineer, or that the manufacturer and installer provide a warranty that covers the unit and performance for a reasonable period of time after installation (at least 5 years). Water Supply In accordance with the City's Comprehensive Plan, the church is located in an area designated as rural, and the extension of water into this area is not anticipated in the immediate future. An on -site new well is therefore proposed, and shall be subject to the review and approval of the Minnesota Department of Natural Resources (DNR), the Minnesota Department of Health, and City of Lino Lakes as required. *Additional Comments Previous review comments stated that the plans generally were considered adequate for preliminary review and comment, but incomplete for construction purposes. The set of plans received for this submittal have been revised significantly to include the required information. Remaining comments are as follows: Site Plan Additional construction details have been provided for improvements (widening) of County Road 21. As previously stated, the plan improvements to County Road 21 will be subject to the review and approval of Anoka County. 2. The church building's main floor (finished floor elevation) has now been provided (896.0). Adjacent lake, wetland, and proposed detention basin flood elevations, and groundwater elevations are all critical to the established building elevation. The finished floor elevation is well above the established flood elevation of the lake and detention areas. However, it is unknown if levels below the finished floor elevation are proposed, and how groundwater levels may or may not affect any lower levels. Per City of Lino lakes requirements, the lowest building opening must be a minimum of 1-foot higher than detention basin emergency overflow elevations. Basement floor elevations must be at least 4 -feet above the normal water elevation and 2 -feet above the design flood level. Grading Plan • The Grading Plan has been revised to address concerns previously expressed. All gradin g shall be confined to the property. No additional runoff from the site shall enter upon neighboring properties. If grading Eagle Brook Church Review Page 5 January 7, 2004 AliCity of Lino Lakes, Minnesota requires any work into the adjoining property, the Contractor shall be responsible for obtaining authorization as needed. The grading and stormwater routing for the County Ditch and County Road 21 ditch system must also be maintained throughout the duration of construction. Easements have been provided around all wetland and stormwater detention areas. Utility Plan All utility installations shall be performed in accordance with the recommendations of the geotechnical engineer. The site has a conditional use permit (CUP) which will need to be amended to allow the construction of the new building. The required site and building plan review is an administrative review, but the review elements are relevant to the CUP. The City approved a CUP amendment in April 1999 for the construction of an addition onto the existing VFW building. That project was never constructed. The work proposed by this new application would replace that approved plan. The public hearing for this application was opened at the November 12 meeting, continued to December 10, and continued to the January meeting. Several site design issues were unaddressed. We received new plans December 19. As stated in the comprehensive plan and reiterated in Ordinance 01 -03, the Growth Management Policy, we have a total of 74 acres of commercial/industrial MUSA reserve. Fire suppression sprinklers will be required. • • • Circle -Lex VFW page 3 The trash enclosure on the east side of the building will be constructed of materials to match the principal building. The existing garage, not shown on the survey, must be removed. The setbacks from Lois Lane is 70'. The parking setbacks are 15'. Since the Lois Lane side is the shorter fronting on a road, it is considered the front for measuring setbacks. This makes the east the side lot line, where the setback of 20' complies with the requirement. The following discussion addresses setbacks from Lake Drive. Variance: On previous plans, the existing and proposed right of way for Lake Drive was an issue. The existing right of way is not of consistent width along the entire property. It is 40' from the centerline along the southern portion, then 50' along the northern portion. The VFW is proposing to dedicate additional right of way to provide for future needs and make the right of way consistent. An additional 20' will be dedicated on the south, and an additional 10' along the north. This will result in a consistent 60' from centerline. Future right of way width recommended for this arterial is 120' total. Additional width will be obtained when/if land on the west side of the road subdivides. (In fact, the Crystal Cove plat will dedicate an additional 10'.) This squeezes the site a little. In order to fit the proposed building and parking drive, The VFW is requesting a setback variance. The required setback from an arterial roadway (Lake Drive, CSAH 23) is 40'. The building will be approximately 34' from the new property line. The parking drive will be about 5' from the line instead of the required 15'. The building is then eight feet closer than normally required. The full right of way will be in place. This eliminates concern about additional roadway needs and public costs of condemning and and, possibly, demolishing buildings or other facilities. The parking drive will be about 9' closer than normally required. The main issue here is the 5 +' of land for landscaping. It is difficult to provide extensive landscaping and screening. However, there is little screening along Lake Drive in this commercial area. The project will significantly improve the appearance of the site, including landscaping. Lighting: Light fixtures in the parking lot will be on six poles. Three, in the northern parking area, will have two fixtures each. One single fixture will be near the Lois Lane driveway, and two others in the southern parking area. The submitted photometric plan indicates that lighting meets city standards: no more than 0.4 foot candles at the residential property line to the east, and no more than 1.0 at street right of way lines. The exterior building lighting is included. The submitted fixture cut sheets show 90 degree cut off fixtures in compliance with city requirements. The lighting under the north and south entry canopies is completely recessed, as is required for motor fuel station canopies. Signage: No additional ground signs are indicated on the plan. An area of the south wall indicates an area for wall signage. Signage is governed by the City's sign ordinance and permits are required for all signs. All signs will be reviewed with the sign permit applications. • • • Circle -Lex VFW page 4 Landscaping, Screening: As shown on the landscape plan, a variety of trees, shrubs and ornamental plantings are proposed on site. A new six -foot, cedar privacy fence is proposed, to continue the segment of existing fence, which will extend along the residential property lines on the east. This provides screening for those lots. Plantings labeled "vide" are not listed in the plant list. These must be identified. The height of plantings near the driveway must not interfere with sight lines. The City native seed schedule should be used in infiltration and ponding areas. Utilities: The VFW site currently is not within the MUSA, but the City has plenty of commercial MUSA reserve to accommodate the needed 2.24 acres needed. Water and sanitary sewer service are available to serve the site in Lake Drive. The existing VFW building has a well and onsite septic system. Both are in locations that will be completely or partially covered by the new building. If the existing building is to continue operating during construction of the new building, there must be a way to supply water and dispose of wastewater. The new plans show temporary connections to city utilities as well as the permanent connections. As a condition of plan approval, utility related modifications and comments as set forth in the City Engineer's memo should to be incorporated into the final plans. Stormwater management: The new plan proposes ponding along the northern and eastern borders of the site. (Ponds proposed within the Lake Drive right of way on earlier plans have been eliminated.) The City Engineer review is attached. Drainage and utility easements must be created over all ponds. The applicant will be required to enter into a ponding maintenance agreement with the city. As a condition of plan approval, the grading and drainage related modifications and comments as set forth in the City Engineer's memo should be incorporated into the plans. The residential properties on the east have wells. State law requires that there must be at least 50' separation between a well and a stormwater pond. The applicant must demonstrate this requirement is met. Access, Circulation, Parking: Right Of Way Lake Drive is CSAH 23, a principal arterial roadway. Ultimately, Anoka County will need 60 feet of right of way on each side of the centerline for Lake Drive, for a total width of 120 feet. There is some discrepancy over the current width of the Lake Drive right of way. The half - section shows the right of way as 100' along the entire frontage of the site. The submitted survey, however, shows a jog in the property /right of way line: the total ROW is 100 feet along the northern part of the property, but only 90' along the southern part. Circle -Lex VFW page 5 • As explained above under "variance ", the VFW is proposing to dedicate additional ROW to create an even line, a consistent 60' from the centerline. • Access, Circulation Current access to the site is not well defined. Neither Lake Drive nor Lois Lane have curbs. Access occurs along the property line, not necessarily by defined driveways. In the future, Anoka County is planning to construct a median as part of Lake Drive improvements. This will restrict access to many properties, as it will eliminate left turns in and out of many driveways. The improved site will be accessed from two driveways, one each on Lake Drive and Lois Lane. A full access through a future Lake Drive median may have better probability if the driveway aligns with a public road (79th St.), though this is not assured. Whether or not the median is constructed, the Lake Drive driveway should align with 79th St. for a safe "intersection ", even if it's only for the interim. As currently shown, it creates an offset intersection. The Lois Lane driveway is as far back from the Lake Drive intersection as possible while still providing the minimum 10' setback from the side property line. The plan proposes two distinct parking areas. The smaller area on the south side is intended to accommodate the bar and restaurant. The northern area will serve the assembly hall. The parking lots and driveways will be asphalt with curbs. In the northern area, the drive lane that parallels Lake Drive has the potential to connect with a parking area on property to the north when it develops. This serves as a de facto frontage road. With the likelihood of a median in Lake Drive, access for both sites will be better if they can use one another's driveway. It increases the number of Lake Drive driveways available for each site from one to two, while only building one on each site. This will require a cross access easement for both sites. Because Lake Drive is an arterial, it will be a good idea to require a stop sign for vehicles exiting the parking lot onto Lake Drive. Parking For bars and restaurants, our code requires 10 spaces per 1000 sf, plus one space per employee on the maximum shift. This criterion was applied to the whole building when the American Legion was reviewed. Zoning Ord. Req. The VFW should demonstrate how parking will be accommodated during the construction period. Conditional Use Permit There are general criteria for all CUPs and specific conditions that apply to private clubs. General Criteria: The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: Land Use Plan, Transportation Plan, Utility (Sewer and Water) Plans, Local Water Management Plan, Capital Improvement Plan, Policy Plan, Natural Environment Plan. • The proposed project creates no conflicts with the plans. b. The proposed development application is compatible with present and future land uses of the area. • The site has been used for the same use for many years. The increase in size of the building will not create incompatibilities as long as the use complies with the performance standards and conditions. c. The proposed development application conforms to performance standards herein and other applicable City Codes. • The proposal complies with the zoning ordinance requirements if the variances are approved. d. Traffic generated by a proposed development application is within the capabilities of the City when: 1) If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 2) If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3) If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. 4) The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5) Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. 6) The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement • • • Circle -Lex VFW page 7 Plan. However, the City may, at its discretion, consider developer - financed improvements to correct any street deficiencies. 7) The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I- 35EIMain St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must deteiniine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. 8) The City does not relinquish any rights of local deteimination. • Traffic generated by the new building will increase somewhat over the existing use, but is not expected to create ongoing traffic problems. Large events will bring additional vehicles periodically. However, the number of vehicles likely will not create a safety hazard or significant impacts. The Apollo Drive and Main St. intersections with Lake Drive both are controlled intersections. If, in the future, traffic becomes an issue, the City can revisit the CUP and consider adding additional conditions such as traffic control personnel for large events. e. The proposed development shall be served with adequate and safe water supply. f. The proposed development shall be served with an adequate and safe sanitary sewer system. • The new building will be connected to city water and sanitary sewer. g. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. • There will be no city capital expenditures for this project. h. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. • The project will create no such undesirable effects. i. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. • No such features exist on the site. Specific CUP Conditions: Private lodges and clubs are allowed as conditional uses in the GB zone provided that: a. Adequate screening from abutting and adjoining residential uses and landscaping is provided. b. Adequate off- street parking and access is provided and that such parking is adequately screened and landscaped from adjoining and residential uses. c. Adequate off - street loading and service entrances are provided and regulated where applicable by Section 3, Subd. 6. of this Ordinance. • • Circle -Lex VFW page 8 • The review has discussed these issues, and they are addressed in the plans and conditions of approval. ENVIRONMENTAL BOARD ACTION The Environmental Board reviewed the project on October 29, 2003. The Board's recommendations are attached. CONDITIONS OF APPROVAL The project approval should be subject to the following conditions: 1. The separate parcels shall be combined into one tax parcel. The applicant must submit documentation that a lot combination has been filed with Anoka County prior to issuance of a building permit. 2. Additional right of way shall be dedicated to Anoka County for Lake Drive, as indicated on the plans. A deed for this right of way shall be filed prior to building permit issuance. 3. The Lake Drive driveway must align with 79th St. The southern edge of the driveway must be moved to the south from what is shown on the 12/18/03 plans. A new plan must be submitted showing this change prior to City Council consideration. 4. The VFW must demonstrate a 50' separation between existing wells on all adjacent residential properties and the proposed stormwater ponds. This must be demonstrated prior to City Council consideration. 5. The VFW must demonstrate how parking will be accommodated during the construction period prior to City Council consideration. Construction limits should be shown on a plan. 6. Drainage and utility easements must be created over all ponds. Deeds for these easements shall be provided to the City prior to building permit issuance. 7. The new building must connect to city water and sanitary sewer and pay appropriate connection charges. 8. Any existing septic systems or wells must be properly abandoned according to law. 9. Plantings labeled "vide" are not listed in the plant list. These must be identified. The • height of plantings near the driveway must not interfere with sight lines. 10. The City native seed schedule shall be used in infiltration and ponding areas. Circle -Lex VFW page 9 11. Issues listed in the January 8, 2004 memo by the City Engineer must be resolved to his satisfaction. 12. A stop sign shall be installed for the Lake Drive driveway. 13. All necessary permits shall be obtained by the applicant from Anoka County for work in the Lake Drive (CSAH 23) right of way. 14. Lighting must be as shown on submitted plan and fixture cut sheets. 15. Signage is governed by the City's sign ordinance and permits are required for all signs. 16. The VFW shall enter into a site performance agreement prior to issuance of a building permit. 17. The VFW must agree to a mutual cross- access easement with the property to the north when that property develops. 18. If parking or traffic generation create problems in the future, the City may impose additional requirements to resolve such issues. 19. Project approval includes approval of setback variances to allow the building to be 34 feet from the new Lake Drive right of way, and the parking drive to be 5 feet from the new Lake Drive right of way. OPTIONS 1. Approve the conditional use permit amendment, including a variance for setbacks from Lake Drive and the allocation of MUSA reserve, with the conditions listed. 2. Deny the application. 3. Return to staff with direction. (This will require agreement from applicant to extend the deadline period.) The proposed 2.25 acre site development shall be subject to the requirements of NPDES (National Pollution Discharge Elimination System) as most recently adopted by the Minnesota Pollution Control Agency (MPCA) and the City of Lino Lakes. Because the site is less than 2.5 acres, a review and approval of the Rice Creek Watershed District (RCWD) will not be required. 2. Because the property is adjacent to Lake Drive (County Road 23), the plan will require the review and approval of Anoka County. The County has provided review comments in a letter to the City dated September 22, 2003. Because the site plan has been revised since then, it is recommended that the County again review the proposed plans and provide comment. A summary of the County's comments from the September 22, 2003 letter is as follows: • The dedication of an additional 10 feet of right -of -way will be required for future reconstruction purposes. At this time, it is not proposed to construct a right tum lane into the property. However, increases in future traffic volumes and safety concerns may warrant such a requirement from the County in the future, and will be the responsibility of the property owner to construct if required by the County. • Currently, there are three driveways to CSAH 23 from the property. A single access to CSAH 23 opposite 79th Street is proposed, and is acceptable to the County. The Applicant shall be aware, that pending any future improvements to CSAH 23, a raised median or limiting of full access to the driveway may eventually become a possibility. Sight comer visibilities shall be maintained per City and County requirements. No plantings, berms, business signs, or other features may be installed within the right -of -way, and that any such features installed outside of the right -of -way must not compromise safe visibility. The site Landscape Plan shall consider this issue accordingly. At the time of the County's review (September 22, 2003), a Grading and Erosion Control Plan had not yet been submitted. The County will require a Grading and Erosion Control Plan for review along with drainage calculations. • A permit from Anoka County will be required for any and all work within the County right -of -way. Provisions for restoration, traffic control, and safety as required by the County shall be incorporated into the Plans. Site Plan(Sheet A1.1) The following comments regarding the Site Plan are offered as follows: 1. As previously stated, the three existing access points into the property from CSAH 23 have been combined into a single access point. This improves overall traffic safety with regards to the County Roadway and is viewed favorably by Anoka County. However, the access point must line up directly with 79th Street on the opposite side of the roadway. Circle -Lex VFW Post 6583 Page 3 January 8, 2004 'City of Lino Lakes, Minnesota 2. Right of way lines on the plans (for both Lake Drive and Lois Lane) must be identified at all locations as existing or proposed. The applicant must dedicate all additional right of way as proposed. 3. Proposed improvement features should be labeled accordingly, including concrete curb and gutter and parking area pavement. The type of concrete curb and gutter and pavement section design is not specified on any of the plan sheets. Radius dimensions for the driveway entrances should also be provided. Construction related items such as standard construction details may be provided on a separate detail sheet as needed. This would include pavement thicknesses, and references to Mn/DOT, County, and City standard plates and details as needed. 4. The building's main finished floor elevation has been provided as 909.8. The lowest building opening must be a minimum of 1 -foot higher than the emergency overflow elevation. At this time, it is not clear from the plans submitted if there will be a basement or lower level. Any basement floor elevations must be at least 4 -feet above the normal water elevation and 2 -feet above the design flood level. 5. In addition to additional right of way dedication required by the County along Lake Drive, it is recommended that a 10 -foot drainage and utility easement be dedicated around the perimeter of the property, with the exception of the northeast portion where the easement must expand to include the pond and detention area. A variance will be required to meet set -back distance requirements for the parking area and building from the newly dedicated right -of -way limits. 6. A north arrow and bar scale must be provided on the Plan. 7. The proposed ponding area is essentially squeezed or "shoe- horned" into a narrow space between the parking lot and the adjacent property. This does cause some concerns with regards to possible encroachment into neighboring properties, and an immediate drop behind the curbing of the parking lot. Because there is no space on the property for the deposit of snow removal, it is conceivable that the pond may be filled with snow in winter, and may cause concern with regards to snowmelt and/or late winter and spring rainfalls. The deposit of snow in this area is therefore highly discouraged. Proper long term maintenance of the pond must also be assured. In addition, it is recommended that the 6 -foot privacy (wood fence) be extended along the entire east and north sides of the property to protect and prevent encroachment and/or grading into the neighboring properties. The fence must be placed on the applicant's side of the property line in accordance with the requirements of the City of Lino Lakes. 8. An existing building and other structures must be removed to provide for the new construction. All existing fixtures shall be removed in accordance with the requirements of the City of Lino Lakes and the State of Minnesota, including foundations and any other underground fixtures that may exist such as storage tanks or other. In the event there are environmental issues such as contaminated soil and/or materials or other removal issues, the applicant shall be responsible for complying with all environmental requirements of the City, County, and State as applicable. This also includes the abandoning and capping of wells and removal of septic systems as may be applicable. The site Grading Plan provides for a system of collection and detention areas prior to discharging into an existing storm sewer that runs parallel to Lake Drive and under the east edge of the pavement. The size and ownership of the pipe (City or County) should be verified and identified accordingly on the plan. 3. Revised drainage calculations are currently under review. However, the following additional comments can be offered at this time: a. As of September 4, 2003, the MPCA requires a Storm Water Pollution Prevention Plan (SWPP) as part of the NPDES construction permit submittal. A copy of this Plan must be forwarded to the City when applying for the permit. b. A 10 -foot wide 10:1 bench is typically required at the normal water level for stormwater ponds. 4. Erosion control measures (silt fencing) are shown on the Plan accordingly. 5. Any imported topsoil, fill material, or granular materials to be used as roadway or building pad fill must be approved by the City Engineer (material and source). 6. Notes regarding clearing of trees shall be provided and include language stating that clearing and grubbing shall be performed in accordance with the requirements of the City of Lino Lakes and Mn/DOT 2101. 7. Notes regarding seeding, mulching and turf establishment shall be provided and refer to the appropriate Mn/DOT Specification for turf establishment (2575) and for the seed mixture. The City of Lino Lakes has a specific seed specification for ponding areas that shall be incorporated into the plans (Grading and Landscape plans). All boulevards shall be provided with four- inches of topsoil and seed or sod as approved by the City. 8. All grading shall be confined to the property. No additional runoff from the site shall enter upon neighboring properties. This may be of particular concern along the east side of the property adjacent to the proposed building. If grading requires any work into adjoining property, the Contractor shall be responsible for attaining authorization as needed. It is assumed that this retaining wall will be left in place and left undisturbed. If not, the Grading Plan must address accordingly. 9. The Grading Plan suggests that at least some portions of the parking lot and driveways will drain directly to the neighboring streets (Lake Drive and Lois Lane). Additional spot elevations at the driveway entrances should be shown to verify the intended drainage patterns. 10. As previously stated, provisions for existing wells and septic systems shall be addressed on the grading plan in accordance with City and State of Minnesota requirements. Utility Plan(Sheet U1) The following comments can be made with regards to the Utility Plan: 1. Sanitary sewer and water currently exist in Lake Drive (12 -inch diameter water and 21 -inch diameter sanitary sewer). The Plans propose utilizing existing services to these mains. The watermain service shown on the plan is not shown as connected to the watermain and should be reviewed and revised. The size and condition of these services should be verified to assure their adequacy. In addition, the size and depth of the existing sanitary sewer is not provided on the plan. All utility connections also cross beneath an existing ditch/swale along Lake Drive. The amount of filllcover over all pipes shall be identified and all water and sanitary sewer services not meeting the minimum bury depth of 8 feet shall be insulated. 2. The plan does not show any existing or proposed fire hydrants. The plan shall be subject to the review of the City Fire Chief, and the installation of additional hydrants may be required if desired by the Fire Chief. 3. As previously stated, an existing storm sewer runs parallel to Lake Drive and under the east edge of the pavement. The utility and grading plans propose connecting to this storm sewer. The size and ownership of the pipe (City or County), and capacity to receive the drainage should be further verified. In addition, the pipe appears to be located beneath the roadway itself and will therefore require a permit from Anoka County. Traffic control and restoration of the roadway must adhere to the requirements of the County: 4. All trenches (including services) shall be backfilled and compacted and meet 100% maximum Standard Proctor Density in the upper 3 -feet from finished road elevation, and 95% maximum Standard Proctor Density below the upper 3 -feet. 5. Water pipe and appurtenances shall meet the requirements of the City of Lino Lakes, and as follows: Hydrants - Waterous Pacer WB -67; Valves - Mueller A2370 -20; or equal. DIP pipe shall be Class 52. Storm Sewer manholes and catch basins shown on the plan must be per the standards of the City of Lino Lakes. A note must be added stating that all work performed within the right of way of Lake Drive will require a permit from Anoka County, and shall be subject to all requirements of the County, including provisions for traffic control. 9. A note shall be added stating that the City of Lino Lakes Utility Superintendent must be contacted at least 48 hours prior to commencing any connections to existing City utilities. 10. A proposed driveway apron is shown at the same location as the 6 foot high wood privacy fence. The reason for the driveway apron is unknown, and should be confirmed. Other A geotechnical report has not been provided. As previously mentioned, re- development of the site will require demolition of the existing building and removal of smaller buildings and surface features. There may also be underground items required for removal as well, including foundations, storage tanks, old septic systems, etc. as previously stated. The Applicant shall verify the existence of all surface and underground items and shall remove and dispose of those required in accordance with State and Local regulations. 2. The type of light fixtures proposed shall be subject to the approval of the City of Lino Lakes. 3. The Landscape Plan (Sheet L1.0) and Lighting Plan shall be subject to any further requirements of the City of Lino Lakes. Special consideration shall be given to assure that no plantings shall be installed over any existing or proposed utilities. Plantings shall not cause corner or other visibility problems. D STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: January 14, 2004 TOPIC: PUBLIC HEARING Rezoning Site from R -4 to R -3 Northeast Corner Lake Drive and Aqua Lane. BACKGROUND A recent development application has brought to light an inconsistency between the comprehensive plan and the zoning on a property. When this occurs, the inconsistency must be corrected. This rezoning was initiated by the City to address the inconsistency. The subject site is four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. The entire Marshan Lake Condominiums site and the remaining four -acres along Lake Drive is guided Medium Density Residential. This allows a density of 3 -6 units per acre. The site is zoned R -4, a high- density zone. This is not consistent with the comprehensive plan's Medium Density classification. To address this inconsistency, either the comprehensive plan or the zoning should change. Based on the recommendation of the P & Z and the City Council work session discussions, the site should be rezoned to R -3. Staff has prepared an amendment to the zoning ordinance to rezone the site to R -3 to bring it into conformance with the comprehensive plan. ANALYSIS The comprehensive plan was adopted by the City Council in August 2002. The plan includes a land us map indicating proposed land uses. As indicated on the attached land use map, the site is guided Medium Density Residential. As stated on page 86 in the comprehensive plan: The City has defined density as follows: Low Medium High Town Center = 1 to 3 units per acre = 3 to 6 units per acre = 6 to 12 units per acre = 10 to 24 units per acre Section 6 of the 2003 zoning ordinance describes the intended land use categories that each • residential zoning district should be in. The R -3 and R -4 zones are intended as follows: • Subd. 5. R -3, Medium Density Residential District. • • C. Development Density. Land to be zoned R -3 must be in a Medium Density land use category according to the comprehensive plan, and development density within an R -3 District shall be within a range of three (3) to six (6) units per net acre and shall be based on the buildable area. Subd. 6. R -4, High Density Residential District. C. Development Density. Land to be zoned R -4 must be in a High Density land use category according to the comprehensive plan, and development density within an R -4 District shall be within a range of six (6) to twelve (12) units per acre and shall be based on the buildable area. As shown on the attached zoning map detail, the site is zoned R -4 High Density. This inconsistency should be resolved. Minnesota Statutes address such situations directly. Underlining is added to emphasize the relevant passages. 473.858 Comprehensive plans; local governmental units. Subdivision 1. No conflicting zoning, fiscal device, official control. Within three years following the receipt of the metropolitan system statement, every local governmental unit shall have prepared a comprehensive plan in accordance with sections 462.355, subdivision 4, 473.175, and 473.851 to 473.871 and the applicable planning statute and shall have submitted the plan to the Metropolitan Council for review pursuant to section 473.175. The provisions of sections 462.355, subdivision 4, 473.175, and 473.851 to 473.871 shall supersede the provisions of the applicable planning statute wherever a conflict may exist. If the comprehensive municipal plan is in conflict with the zoning ordinance, the zoning ordinance shall be brought into conformance with the plan by local government units in conjunction with the review and, if necessary, amendment of its comprehensive plan required under section 473.864, subdivision 2. After August 1, 1995, a local government unit shall not adopt any fiscal device or official control which is in conflict with its comprehensive plan, including any amendments to the plan, or which permits activity in conflict with metropolitan system plans,... 473.865 Adoption; conflicts, amendment of controls, devices. Subdivision 1. Control copies to council. Each local governmental unit shall adopt official controls as described in its adopted comprehensive plan and shall submit copies of the official controls to the council within 30 days following adoption thereof, for information purposes only. • • Subd. 2. No conflict with plans. A local governmental unit shall not adopt any official control or fiscal device which is in conflict with its comprehensive plan or which permits activity in conflict with metropolitan system plans. Subd. 3. Amendments. If an official control conflicts with a comprehensive plan as the result of an amendment to the plan, the official control shall be amended by the unit within nine months following the amendment to the plan so as to not conflict with the amended comprehensive plan. The comprehensive plan was amended in 2002. The zoning ordinance is an official control. The zoning map is part of the zoning ordinance. The R -4 High Density zoning of the site conflicts with the Medium Density land use category in the comprehensive plan. Though this conflict was not corrected within nine months of the plan amendment, it does not remove the city's obligation to correct the conflict. The zoning ordinance lays out the process and criteria for a rezoning. SECTION 2. ADMINISTRATION Subd. 1. Administration: Amendments and Rezonings. In accordance with the provisions of Minnesota Statutes, the City Council may from time to time amend the Zoning Ordinance text or map (rezoning). Amendments may be initiated by City Council, Planning and Zoning Board, or property owner. The procedure for an amendment to the Zoning Ordinance or Zoning District Map (rezone) shall be as follows: E. The Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgement shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. As explained above, the current R -4 High Density Zoning conflicts with the Medium Density land use category of the comprehensive plan. The purpose of the rezoning is to correct this inconsistency between the comprehensive plan and the zoning. State statute requires that official controls found to be in conflict with the comprehensive plan must be amended so as not to conflict. 2. The proposed use is or will be compatible with present and future land uses of the area. As deteiniined in the review of a development application for the site, the surrounding neighborhood was developed at approximately 6.4 units per acre. The Wenzel Farms townhomes across Lake Drive were built at approximately 5 units per acre. A High Density land use category would provide for 6 to 12 units per acre. A Medium Density category allows up to 6 units per acre. Six units per acre is compatible with the surrounding neighborhood. 3. The proposed use conforms with all performance standards contained herein. This rezoning action is not based on a specific proposed use. It is intended to correct a conflict between the zoning ordinance and the comprehensive plan. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. Projects built at an R -3 Medium Density will pose less burden on existing services and infrastructure. After discussion, it was agreed by board members and applicant that this application would be tabled pending two actions by the applicant: 1.) A full Certificate of Survey would be submitted, with complete setback information and proposed garage dimensions and setbacks. 2.) The applicant would explore the possibility of swapping land with the neighboring property owner to the north, whereby land could be acquired so that a driveway could be constructed along the northern property boundary with a garage to be place to the east of the home. Certificate of Survey — dated 11/04/03 ANALYSIS Land Use & Zoning The following chart describes the land use and zoning for the subject site, as well as surrounding properties. Residential Rural Executive (R -X) Setbacks The applicant has made alterations to the proposed garage site as a result of comments by members of the Planning & Zoning Board and staff: whereas previously the garage was to be detached, it is now proposed as an attached garage. As a result of this change, the garage is now sited farther from the road right -of -way. The proposed garage setback is now 15 feet from the front property line, or the street right -of -way. Previous configurations had it placed one foot from the front property line. The City's required setback is 40 feet, so there is still a 25 -foot difference between what the applicant is proposing and what the Zoning Ordinance directs. • ID Planning & Zoning Board January 14, 2004 Kivel Variance Additionally, this new configuration also achieves another prime objective: siting the garage outside of Anoka County's stated future right -of -way area. The memo from Roger Butler, Anoka County Traffic Engineering Coordinator (Exhibit 2), states that Anoka will require an additional 10 of right -of -way for Otter Lake Road. With the applicant's new proposal, the garage would result in a setback of five feet from the property line once this additional ten feet is taken, whereas with previous configurations the garage would have been sited within this future right -of -way area. Lastly, the new configuration also eliminates the need for a second variance. That is, the variance to allow a detached accessory structure to be placed closer the front lot line that the principle structure is no longer needed because the garage is now attached. Grounds for Variance The applicant is requesting a variance from the required street setback based on the following physical constraints /impediments: a holding tank, a drainfield, and topography which drops on the southern portion of the lot. All three of these constraints constitute legitimate hardships in terms of variance criteria, as they prohibit the applicant from complying with what the ordinance directs. Accessory Building Requirements The Lino Lakes Zoning Ordinance (Sec. 3, subd. 4.D.8.f)='directs that the subject property be allowed up to 1,200 sq.ft. of accessory building square footage. Additionally, the number of accessory buildings is limited to either two detached accessory structures OR one detached and one attached structure. The proposed garage would meet these requirements. The Zoning Ordinance (Sec. 5, subd. 2.C.3) further states that all dwellings located in the R -X District shall have a double garage. Otter Lake Road Right -of -Way The County reports it currently has 50 feet of right -of -way east of the centerline of Otter Lake Road, but that it will require an additional 10 feet of right -of -way for future road improvements, for a total of 60 feet of right -of -way east of the centerline. The applicant's current proposal sites the garage 15 feet from the current right -of- way /property line under (50 feet R.O.W.), which would then decrease to 5 feet from the right -of -way /property line under the future Anoka conditions (60 feet R.O.W.). Additionally, the Lino Lakes Park & Trail plan shows a future trail to be located along Otter Lake Road. Public Services Director Rick DeGardner states that any such future • • Planning & Zoning Board January 14, 2004 Kivel Variance should be adequately accommodated within the 60 feet right -of -way that the County requires (Exhibit #3). Anoka County Right -of -Way Acquisitions staff person Mike Kelly, however, counsels that Anoka County — in light of budget cuts — is currently reviewing how it administers its right -of -way and urged Lino Lakes to consider its own right -of -way needs for paths /trails in situations such as the subject application, rather than fully relying on the County. Neighboring Property to the North Planning & Zoning Board members requested that the applicant explore a possible purchase or land swap with his neighbor to the north, whereby it might be possible to construct a driveway on the north side of the home which would lead to a garage site on the lake -side of the home. The applicant has reported that his neighbor has no interest in selling or swapping land. Conclusion There is definitely hardship demonstrated in the form of the location of the holding tank, drain field, and topography, the locations of which are precluding a garage from being sited in areas which would satisfy zoning ordinance requirements. For these reasons, staff would recommend approval of this variance, with the following condition: 1.) The applicants, their successors, and assigns are hereby notified that should Otter Lake Road expand by ten feet or less, neither the City and/or road authority will pay compensation to the property owners for severance damages due to their encroachment in the setback area. OPTIONS 1.) Recommend approval of the proposed variance. 2.) Recommend denial of the proposed variance. 3.) Return to staff with direction. F STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: January 14, 2004 TOPIC: Final Plat: Miller's Crossroads BACKGROUND The City Council approved the preliminary plat for Miller's Crossroads with Resolution 03 -142 on September 22, 2003. The final plat needs P & Z review prior to City Council approval. The final plat conforms to the approved preliminary plat. The rezoning of the site is in effect. Prior to City Council approval of the final plat, the City Attorney will review the title commitment. The City Engineer will prepare a development agreement. Estimates for utilities and road work will be used by the City Engineer approval in order to prepare the development agreement. Other conditions of approval must be satisfied prior to City Council approval or included in the development agreement. This project includes a phasing plan in four phases, 2003 through 2006. Since the first phase did not occur before winter, the first two phases are being combined in this final plat. This is acceptable under the city ordinances. The developer is requesting an amendment to the phasing plan that would change the specific building that are constructed in certain phases. The number of units stays the same for each phase, as shown here: This change results from the recognition that an eight -unit building originally included in phase 1 cannot be connected to utilities until phase 4. The requested amendment transfers the eight units from this one building, on Hodgson Rd., to twin homes and a three -unit building along Ojibway Path on the east side of the project. Again, the total number does not change. The change will require an amendment to the phasing plan in the form of a city council resolution. The final plat needs P & Z review prior to City Council approval. The final plat conforms to the approved preliminary plat. The rezoning of the site is in effect. The City Attorney has approved the title commitment. The City Engineer has prepared a development agreement. One condition of approval was: 2. If an area identification monument sign is planned, information specifying sign design, location, ownership, and maintenance must be submitted for City review with the final plat. The intent was that this would be addressed in the homeowners association declaration. We have received a copy, but there is no mention of maintaining the monument signs. Prior to city council approval, the applicant should submit documentation that addresses maintaining the signs. The park dedication condition read as follows: 6. Park dedication shall be $93,240 less the agreed -upon value of a trail dedication along the northern edge of the site. This shall be clarified prior to final plat approval. The developer has agreed to deed to the City a trail easement 30 feet wide that will cover the existing trail and a park dedication credit of $8,000.
