Vice Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at
6:38 p.m., April 14, 2004.

Mr. Pogalz made a MOTION approve the March 10, 2004 Minutes and was supported by
Mr. Root. Motion carried 4 -0.

Vice Chair Rafferty opened the public hearing at 6:41 p.m.
Staff stated applicant had requested approval to develop Outlot A of the Highland
Meadows East development approved in 1999. The comprehensive plan guides the site
for medium density residential use. The applicant requests rezoning to R -3 Medium
Density. The request also includes a Planned Unit Development (PUD) in order to allow
for a private road and other departures from standard zoning requirements. A preliminary
plat also is required with the PUD. The project also requires a site plan review for the
townhomes. This typically is an administrative review. However, it is inherent part of
the PUD.
Staff presented their analysis and recommended approval of the project, subject to the
following conditions:
1. The project shall not be final platted until 2005, as dictated by the growth
management policy.
2. Issues discussed in the City Engineer review must be addressed to his satisfaction.
3. Drainage and utility easements shall cover the ponds and stormwater facilities.
Easements also shall be platted along all the external property lines.
4. The applicant must submit geotechnical information on existing groundwater levels
and soils in adequate time for review prior to City Council consideration of the
application.
5. Sanitary sewer and water utilities in the private drive shall be City facilities, just as
they would if it were a public street right of way.
6. Park dedication of $1,665 per unit shall be paid: 18 units for a total of $29,970.
7. A revised landscaping plan shall include additional spruce added to the extreme
southwest corner, behind units 9, 10, and 11 and specified sod or grass seeded areas.
City wetland seeding shall be included and noted on the revised landscaping plan.
8. The project must obtain approval by the Rice Creek Watershed District prior to
consideration of the preliminary plat by the City Council.
9. A street light shall be added at the access to 79th St., at the developer's cost.
10. New building elevations shall be submitted to demonstrate an exterior finish of brick,
stucco, and /or natural or artificial stone to meet the requirements in the ordinance.
These shall be submitted three weeks prior to consideration of the preliminary plat by
the City Council.
Mr. Hyden asked how open space was calculated. Mr. Smyser replied they took the
amount of non -hard surface (i.e. not building or driveway), so that did include the areas
within the private lots. He noted the site was oddly configured and how to deal with the
open space was "tricky ".
Mr. Hyden asked if the City was comfortable waiting for the Rice Creek Watershed's
decision. Mr. Smyser replied they were comfortable moving ahead, but this would need
to be clarified before this was final platted.
Mr. Pogalz asked what would the builder be allowed to do this year if final platting was
not allowed until 2005. Mr. Smyser replied after preliminary plat approval a
development agreement could be put together that would allow only grading of the site.

• He stated utilities were not allowed to be brought in until the final plat was issued and no

construction of the buildings would occur until final platting.
Mr. Pogalz asked if there was any consideration by the City as to the type of material
brought in to fill the site. Mr. Smyser replied all fill brought into the site had to be
approved by the City Engineer.
Mr. Root asked if any grading had taken place on this site. Mr. Studenski replied there
had been some grading in the past that actually improved the site, but there had been
nothing since that time.
Mr. Root asked if the two downsized ponds made up for the larger area that would be
lost. Mr. Studenski replied the proposed ponds would be adequate.
Mr. Root asked if all of the other engineering issues had been completed. Mr. Studenski
replied basically they had been satisfied, with the exception of a few minor ones.
Mr. Root asked if it was common to have the City responsible for utilities beyond the lot
line. Mr. Smyser replied this was an unusual situation. He stated they were concerned
about the homeowners association properly maintaining and repairing the utilities. He
noted if the association did not maintain them, it would come back to the City for repair
because it was a public health and safety issue, so staff was recommending the City be
responsible for the utilities beyond the lot line.
Mr. Hyden asked what would happen if the association would dissolve. Mr. Smyser
replied the road would not be that heavily traveled, so it would be required to be
constructed as if it were a public street, only a little narrower and the maintenance would
be essentially plowing and patching. He stated because of the minimal traffic, this should
not be a problem.
Mr. Pogalz asked if there would be a dual point of connection for the waterline. Mr.
Studenski replied a dual point of connection for the waterline would not be an issue in
this development.
Vice Chair Rafferty asked what had they determined with the phasing plan for the
different years. Mr. Smyser replied there was a goal of 147 new units per year, but it did
allow an additional 20 percent at the Council's discretion, which would make another 29
units, which totaled 176 units. What this did was subtract from the total number
available for the year 2010. He stated for 2004 they had "maxed" out and with the
projects that they had received applications for so far, 2005 would also be full. He noted
the City could not go over the 20 percent without amending the Comprehensive Plan.
Vice Chair Rafferty invited the public to make comment.
Joe LaCroix, 79th Street and the new proposed road, asked if the density had been
changed since the last plan. Vice Chair Rafferty replied it had been reduced by two units,
instead of 20 there were now 18.

Mr. LaCroix expressed concern about traffic on 79th Street. Mr. Studenski stated in the
future there might be some type of a traffic control, but at this time, the traffic did not
justify a traffic control.
Mr. LaCroix expressed concern regarding the elevations and that all of the townhomes
looked the same.
Eric Englebretson, 712 79th Street, requested a stipulation of having a berm with trees.
He expressed concern about the density of this development. He stated for his privacy,
he would like berms with tall trees. Mr. Hyden stated it was his past experience that trees
did not live on berms.
Mr. Englebretson replied he would be agreeable to not berm, but having dense trees.
Mr. Englebretson expressed concern about the angled parking and the lights shining in
his home. He asked if the parking could be angled differently so the headlights did not
shine in his home. Vice Chair Rafferty replied they would discuss this with the
developer.
Kirk Nelson, 710 79th Street, expressed concern about the zoning. He stated it was his
understanding that this was going to be phased in. He indicated this development did not
fit in with single - family homes. He asked if this could be R -2. Vice Chair Rafferty
replied the Comprehensive Plan zoned this as R -3 and the Met Council would have to
approve any zoning changes, but right now this was zoned as R -3.
Mr. Nelson asked what could he do as a citizen to get this changed. Mr. Smyser replied
the process began years ago and this is what ultimately came out of the commission. He
stated this had been approved in 2002.
Mr. Nelson expressed concern about the density. He presented to the Board a proposed
drawing showing the density to be at 10 buildings, instead of 20. He asked if this would
be feasible.
Vice Chair Rafferty asked Mr. Nelson how he would feel if he were the developer and his
development was cut down from 18 to 10 units.
Mr. Nelson replied he realized the more units that were put in there, the more money the
developer would get.
Vice Chair Rafferty invited the applicant to make comment.
Steve Schmidt, developer, stated when the association would be set up, the association
dues became a lien on the property, and those due could be collected by the association
through foreclosure. He noted the association dues came ahead of the mortgage. He
stated he did not know if an association could "disband" themselves or not, and this was
something the City Attorney would need to answer. He stated, however, that the City did
approve the association documents. He indicated the developer would be in charge of the
association for the first two years, at which time it would be turned over to the

association. He stated he was confused about the ordinance regarding the exterior
material. He asked for guidance regarding this. He stated it was not conducive to put
brick everywhere because of the elevations. He noted he would be in agreement to
putting more brick on the front entryways, if they wanted. He stated he would like to sit
down with staff to discuss these things before it came to Council.
Mr. Hyden replied he did not have a problem with the development itself, but he wanted
more "character" to the buildings. Mr. Schmidt replied he intended to make each
building different than the other ones. He stated his struggle was putting the brick on the
sides and back without making the whole building brick.
Mr. Tralle arrived at 7:55 p.m.
Mr. Smyser suggested Mr. Schmidt look at the ordinance and show staff what they could
do with the materials and colors, but staff needed to see everything in writing.
Mr. Root stated the landscape buffer was important and he wanted to see a lot of
coverage. He suggested more black hill spruce be placed in the center of the half circle
so it would block all of the headlights. Mr. Schmidt replied he did not have any issues
with adding additional landscaping and trees.
• Vice Chair Rafferty asked him to have colors that were not the usual. He stated the
density he was not in favor of, but he appreciated the efforts he has made.

Mr. Pogalz made a MOTION to recommend closing the public hearing at 8:15 p.m. and
was supported by Mr. Hyden. Motion carried 5 -0.
Mr. Root stated he believed there was a lot of density in this area and asked if the
buildings could be shifted around. Mr. Schmidt replied they already had 20 feet between
the garages, when the ordinance required 10 feet, so they had much more space than what
was required by City ordinance. He stated he had heard the comments the last time and
he had removed two units and he believed this was a good use for the property with the
additional screening they requested.
Mr. Hyden made a MOTION to recommend Rezoning from R -1 Single Family
Residential to R -3 Medium Density Residential, approval of the Conditional Use Permit
for a residential Planned Unit Development, and approval of the development stage
plan/preliminary plat with the conditions as noted in staff s April 14, 2004 report with the
addition of condition 11 for adding the additional trees and was supported by Mr. Pogalz.
Motion carried 4 -1 (Vice Chair Rafferty).
B. CONTINUED PUBLIC HEARING for a Comprehensive Plan Amendment,
Rezoning and Preliminary Plat/PUD for Oakwood View, 125 Ash Street
(Rice Creek Covenant Church)

Staff stated applicant had submitted an application to further develop its current site at
125 Ash Street. The application includes several elements. The goal is to create ten
single - family detached home lots on the north part of the property as well as a lot for a
duplex on the southern part of the property. The duplex is intended for a group residence
for people with disabilities. This project includes an odd mixture of actions because of
the existing land use category and zoning.
Staff indicated a conditional use permit (CUP) was approved by the City in 1996 to
provide for building the church. That CUP approval included a three -phase plan. Each
new building must undergo a site plan review, but would not require a CUP amendment
review. However, the CUP did not include a residential facility, as is being proposed
now. Therefore, the CUP is not relevant here inasmuch as no additions to the church
building itself are being proposed.
Staff noted the zoning ordinance provides for two different types of PUD. If only
residential uses were included in the project, the PUD would require only a conditional
use permit. However, the church and the group residence is a mix of uses. A mixed use
PUD requires a rezoning to PUD.
Staff reviewed their analysis and recommended approval of the Comprehensive Plan
Amendment, Rezoning and Preliminary Plat /PUD, subject to the following conditions:
1. The comprehensive plan amendment must obtain the approval of the Metropolitan
Council prior to any further City project approvals. The rezoning and preliminary
plat are contingent upon the comprehensive plan amendment approval.
2. This approval provides for use of the duplex group residential facility for foster care
for developmentally disabled persons. Alternative uses under different county and /or
state license shall be subject to City review and state statutory requirements, and at
the City's discretion may require an amendment of the planned unit development.
3. The project shall be final platted in two phases. The group resident duplex may be
final platted in 2004. The ten single - family lots shall not be final platted until 2005.
4. The conditional use permit approved in 1996 to allow the construction of the church
is still in effect. Future expansion of the church shall be as approved with the
conditional use permit.
5. The duplex residential facility shall be constructed as depicted on the plans included
as part of this approval.
6. The relocation of sanitary sewer and water services may occur within the 2004, phase
one final plat because these utilities already existed. However, the construction of the
Oakwood Lane street extension shall not occur until final plat approval of the single
family lots in phase two, in 2005. All lots and units shall connect to City sanitary
sewer and water.
7. Park dedication of $1,665 per unit shall be paid. Park dedication for the group
residence, two units, shall be paid when that lot if final platted. Park dedication for
the ten single - family lots shall be paid with that final plat.
8. The new plat must obtain approval by the Rice Creek Watershed District prior to final
plat approval by the City Council.

9. Drainage and utility easements around all wetlands must be large enough to include at
a minimum a ten (10) foot buffer extending outward from the delineated wetland
boundary.
10. The applicant must submit geotechnical information on existing groundwater levels
and soils in adequate time for review prior to City Council consideration of the
application.
11. Issues discussed in the City Engineer review must be addressed to his satisfaction.
12. The City seeding mix must be used for ponds and wetland areas. This must be noted
on the plans.
13. The property owner must obtain approval from the City Council to vacate the existing
ponding and flowage easements.
14. Site plan information for the group residence duplex shall be provided prior to
issuance of a building permit. This shall include architectural elevations, floor plan,
landscaping, and site lighting. Any lighting in the park area must meet City
requirements.
15. There must be a shared driveway easement to allow the new lot to use the existing
driveway on Ash St. This easement must be recorded with the final plat.
Mr. Tralle inquired about the garage and asked if a two -stall garage would be an issue.
Mr. Smyser replied the residents would not be driving, so they would not have cars. He
believed there would be sufficient garage space.
Mr. Tralle expressed concern about the insufficient garage space in the event this duplex
was ever converted to two single - family homes. Mr. Smyser replied if this ever occurred
this could be addressed at that time and the garage could be expanded if necessary.
Mr. Root asked about the radius of the street. Mr. Studenski replied the design made it
less than a 30 mph road, and that would be posted. He noted this was not out of the
ordinary.
Mr. Hyden asked if they should be concerned that they were asking for an amended
Comprehensive Plan. Mr. Smyser replied he did not believe this would be a concern.
Vice Chair Rafferty invited public to make comment.
Erin Mielke, 165 Ash, asked what was going to be the dimension of the duplex. Mr.
Smyser replied he did not have a floor plan, but applicant should be able to answer this.
Ms. Mielke stated she was concerned about the lighting of the parking lot. Mr. Smyser
replied they did not have any plan for the lighting right now. However, there were very
specific limitations on lighting and they would have to meet those requirements, if
lighting was proposed.
Ms. Mielke stated the duplex as directly behind her house and while there were trees
there, they were tall trees and she asked if smaller trees could also be put in. Vice Chair
Rafferty replied they would ask the applicant if they would be willing to do that.
Vice Chair Rafferty invited the public to make comment.

TimYantos, Chair of Development Task Force, stated the square footage would be 3500
per floor (7,000 for the entire building). He stated they would follow whatever the City
Ordinance required with respect to lighting.
Mr. Smyser stated he did not believe the City would require any lighting of the parking
area.
Mr. Yantos stated they were agreeable to adding additional pine trees for screening.
Vice Chair Rafferty also expressed concern about the two -car garage. He stated he
would prefer to see what the City had outlined with respect to garages. Mr. Tralle stated
he disagreed with this; that this was a Conditional Use Permit and he did not think they
needed to add an attached garage, especially with the use they were intending it for. He
stated his only concern was if this were to change to a single - family duplex, but he
believed that was a remote possibility and he believed they needed the living space and
not more garage space.
Mr. Yantos stated they were willing to do whatever the City wanted.
Mr. Pogalz asked about moving the water main stub to and manhole to the center of
Oakwood Lane. Mr. Studenski replied that was feasible.
Ms. Mielke asked how many attractive homes were 7,000 square feet. She expressed
concern about the size of the building. She stated this did not fit in the area and would
not blend in with the neighborhood.
Mr. Tralle made a MOTION to close the public hearing at 9:00 p.m. and was supported
by Mr. Hyden. Motion carried 5 -0.
Mr. Tralle stated he was opposed to adding additional landscaping. He stated he believed
there was sufficient landscaping in that area.
Mr. Pogalz stated he was also opposed to this because he believed the new landscaping
would not survive under the existing canopy.
Mr. Tralle made a MOTION to recommend amending the Comprehensive Plan to change
the site from Public Semi - Public to Low Density Sewered Residential, recommend
approval of the rezoning of the southern portion from R -1X to Planned Unit
Development (PUD) for mixed uses: the existing church and group residence,
recommend the PUD development stage plan/preliminary plat subject to the conditions
noted in staff s April 14, 2004 report with the 15 conditions as noted in staffs April 14,
2004 report and adding the following condition:
16. To move the sanitary sewer manhole 4 north to the centerline of Oakwood Lane, and
also to move the water main to the center of Oakwood Lane with an adjacent stub and
gate valve to the west.

and was supported by Mr. Pogalz.
Mr. Root made a friendly amendment to add a condition 17: To add screening along the
south side of the duplex 3 -4 evergreen trees, 6 feet tall. Mr. Tralle did not accept the
friendly amendment.
Motion carried 5 -0.
Vice Chair Rafferty recessed the hearing at 9:10 p.m. and reconvened at 9:20 p.m.
C. Variance for St. Paul Water Services, Peltier Lake dam site
Staff stated St. Paul Regional Water Services owns- numerous pieces of property on and
near lakes in Lino Lakes and Centerville. One of these parcels includes the dam between
Peltier Lake and George Watch Lake. St. Paul Water wishes to divide this parcel, keep
the part with the dam, and sell the rest of Anoka County to include in the regional park.
Because the parcel has no road frontage and is shaped very oddly, several variances are
needed. No development will occur on the site.
Staff presented their analysis and recommended approval of the requested variances for
lot area, lot width, and lack of road frontage, subject to the following conditions:
1. Anoka County shall grant an access easement to the dam parcel from CSAH 14.
2. Anoka County shall combine the land that does not include the same with an
existing parcel to avoid creating a completely new parcel.
Mr. Root made a MOTION to recommend the variance request for lot area, lot width and
road frontage subject to the conditions as noted in staff's April 14, 2004 report and was
supported by Mr. Tralle. Motion carried 5 -0.
D. Variance for 1612 Birch Street
Staff stated applicants have submitted a request for variances from requirements for
minimum lot area and lot width. Their property at 1612 Birch St. comprises of 15 acres.
They wish to divide the property into two parcels. This would be a minor subdivision
and does not require public review: it is done administratively. However, the
subdivision proposal does not meet lot dimension requirements. The property owners
have requested the variances from those requirements.
Staff presented its analysis and recommended denying the request because the proposed
variances would provide for a minor subdivision that is inconsistent with the
comprehensive plan strategy. A new lot would exceed the allowable growth under the
growth management policy. The variance requested is based on economic
considerations.
Mr. Hyden asked which acreage was the home sitting on. Mr. Smyser replied it was on
the proposed Parcel B on the survey.

Vice Chair Rafferty invited the applicant to make comment.
John DeHaven, 1612 Birch Street, stated the reason they wanted to do this was so they
could get a reverse mortgage to supplement their income. He stated they were on social
security and they could no longer survive on their social security. He pointed out that
there was a City sign indicating that there would be a road eventually cutting across their
property. He stated this was a hardship for them and he believed this request fit into the
hardship. He noted they had done a lot to beautify the property by planting over 2,000
trees.
Mr. Hyden asked before they paid the $250.00, did staff inform them that this request
would not apply. Mr. DeHaven stated staff had given them the rules which showed
hardship and he believed their request fit under the hardship. He indicated this was their
"only out ".
Mr. Tralle asked why couldn't they reverse mortgage the entire 15 acres. Ms. Houle
stated they wanted to leave the rest of the land for their children. She noted with a
reserve mortgage, once they died, the home would go to the bank. She indicated it was
very important that they plan their estate now.
Mr. Rafferty asked if they could put the reverse mortgage on their house and barn only.
Ms. Houle replied they needed a legal description and the legal description as it was
today, included the whole parcel. She noted they could not sell the land either because of
the Comprehensive Plan requirements.
Vice Chair Rafferty asked if they realized that there was a 10 -acre minimum and that a
five -acre parcel was not standard. Ms. Houle replied their entire parcel was originally 38
acres. She noted this was farmland and if they wanted to they could raise pigs, but she
did not believe their neighbors would appreciate that.
Ms. Houle stated their intent was to avoid a mess with their estate planning. Vice Chair
Rafferty stated it was not the intent of the City to avoid or make messes of people's
estates. He stated they had seen hardships when it came to dollars and cents, but this did
not follow the guidelines.
Ms. Houle stated breaking off their small parcel of land did not affect the City. Vice
Chair Rafferty stated it did affect the City because it would set a precedent.
Mr. DeHaven stated the City should get rid of the hardship requirement then because they
were coming before the Board with this requirement. Mr. Smyser stated the hardship
could not be due to economic considerations alone, according to the State legislature. He
noted an economic hardship was not the type of hardship the variance was based on. He
stated this was a difficult concept to understand, but the law did not say that economics
was a hardship and the City was required to follow State law.
Mr. Pogalz made a MOTION to deny the variance request for 1612 Birch Street, Martha
Houle /DeHaven, because the proposed variances would provide for a minor subdivision
that is inconsistent with the comprehensive plan strategy. A new lot would exceed the

• allowable growth under the growth management policy. The variance requested is based

on economic considerations and was supported by Mr. Hyden. Motion carried 5 -0.
Mr. DeHaven requested the City sign stating a road would go through their property be
removed. He stated they would not sell their property to the City for a road.

Staff stated applicant has requested approval of a single family residential development
called Fox Den acres. The comprehensive plan guides the site for low- density residential
use and it is zoned R -1. The request also includes an amendment of the comprehensive
plan and MUSA reserve allocation. This would allow the development to extend beyond
the boundary of the area currently guided for development to provide for an additional
eight lots.
Staff noted there are several challenging design issues including a "ponding and flowage"
easement, single access point due to past development design, the growth management
policies, and wetlands. The City must consider these issues in the project design while
acknowledging that that property is guided and zoned for development, and has been for
some years.
Staff stated the public hearing is for the comprehensive plan amendment and the
preliminary plat. The allocation of MUSA reserve does not require a public hearing
because such allocation must be in areas already designed for it under the comprehensive
plan.
Staff presented its analysis and recommended continuing this item for further information
including the proposed plat extends beyond the stage 1 (pre -2010) growth area, the
MUSA, the Low Density Sewered Residential land use area, and the R -1 zone. It would
also require the vacation of a ponding and flowage easement. The proposed requested
amendments to the comprehensive plan and zoning map to accommodate the extra 3 -4
acres of development. There is not clear justification other than to increase developable
area. Staff does not yet know if water service is adequate. The traffic study is based on
outdated road information and should be revised. A ghost plat must be created for
property north of the proposed northern road stub.
Staff stated this should have been noticed as a public hearing and he apologized to the
applicant that this had not been done. He stated, however, that there were issues that
needed to be resolved and he believed the outcome would still be the same. He indicated
the proper notice would be sent out and this would be on the May agenda.
Mr. Tralle inquired about the roadways crossing wetlands. He asked how would the
water flowage through the wetlands would be addressed. Mr. Smyser replied this was a
tough site and they wanted to fill various areas and they would need the approval of the
Rice Creek Watershed to do that, but they would also mitigate the site.

Bob Schack stated he represented the association and indicated they had a concern about
the traffic and the one access in and out. He noted an average household would make 8
trips in and out a day and with 70 homes, they were estimating that there would be over
500 cars coming in and out daily. He expressed concern about the loss of the wetland
area. He asked where would they make up the wetland loss as required. He indicated
they had several homeowners on the east side of West Shadow Lake Road that had put in
the landscaping to keep water levels away from their homes and if some of the wetland
were filled in, there was a concern that it would cause additional flooding and wet
basements in their association. He noted there was a natural waterflow and he expressed
concern that their ponds would be affected by this development.
Steve Cavanagh, 6331 Deerwood Lane, stated traffic was his number one concern. He
stated there were many children in the area and he was concerned for their safety. He
indicated this was not a safe area for traffic. He stated they did have water issues in their
basements. He asked what was the point of a Comprehensive Plan if they were not going
to follow it.
Mike Black of Royal Oaks Realty, 1000 County Road E, Shoreview, applicant, stated
they wanted to build an upscale single - family neighborhood. He stated there would be no
variances requested. He stated in May he would have color drawings for the Board's
review. He stated Rice Creek was currently reviewing their proposal. He stated they
would be filling less than one acre of the 11 acres of wetland on the site. He indicated he
was willing to review tonight whatever the Board wanted him to. Vice Chair Rafferty
stated because this would be continued to the next meeting, the Board would prefer to
hear everything at that time so all of the information did not need to be repeated.
Mr. Pogalz asked for further information about the connection to the strip to the north for
the next meeting. Mr. Black stated that was their only way out and they had looked at
other options.
Mr. Hyden made a MOTION to continue this item to the next meeting for further
information and was supported by Mr. Root. Motion carried 5 -0.
F. Elect EDAC liaison
Staff stated the Economic Development Advisory Committee (EDAC) is an advisory
body appointed by the City Council to advise the Council on economic development
matters. In the past, there have been liaisons among the different advisory boards, but
this has not been a particularly formal system. EDAC has requested the P &Z to consider
if any P &Z members would like to act as a liaison to the EDAC. This would involve
attending occasional EDAC meetings to exchange information on the status of
development policies, project, and other issues. There is no formal minimum
commitment, and the liaison could arrange his or her own schedule for attending
meetings or otherwise communicating on these topics.
Mr. Hyden stated he was interested in being the liaison.

Royal Oaks Realty has requested approval of single family residential development called Fox
Den Acres. The comprehensive plan guides the majority of the site for low density residential
use and it is zoned R -1. The request also includes an amendment of the comprehensive plan and
MUSA reserve allocation. This would allow the development to extend beyond the boundary of
the area currently guided for development to provide for an additional eight lots.
There are several challenging design issues including a "ponding and flowage" easement, single
access point due to past development designs, the growth management policies, and wetlands.
The City must consider these issues in the project design while acknowledging that most of the
property is guided and zoned for development, and has been for some years. There is usable
upland outside of the growth boundary and the applicant wishes to utilize this upland.
The public hearing is for the comprehensive plan amendment and the preliminary plat. The
allocation of MUSA reserve does not require a public hearing because such allocation must be in
areas already designed for it under the comprehensive plan. The site is in the existing MUSA.
To accommodate the proposal, the following approvals are necessary:

*The majority of the site, a 40 -acre square, is guided for Low Density Sewered Residential land

Growth Management:
MUSA Reserve: The comprehensive plan and the growth management policy establish a
specific number of MUSA acres for residential growth for stage one (prior to year 2010). Most
of the site is within the current MUSA. However, the plat extends beyond the existing MUSA
on the east and south edges, so MUSA reserve allocation is needed for those areas.
On the southwest edge, approximately two acres of the house lots are outside the MUSA and
growth area (parts of Lots 9 -13, Block 4). On the eastern edge, about two acres of lots are
outside the MUSA and growth area (Lots 23 -27, Block 4). Therefore, about 4 -5 acres of MUSA
reserve would be needed. As shown in the table at the end of the report, MUSA allocation is
possible in 2005 without exceeding the annual goal.
Growth Management, Units/Year: The comprehensive plan and the growth management
policy establish a specific number of dwelling units of residential growth for stage one (prior to
year 2010). The goal is 147 per year. The City Council has the flexibility to exceed the limit by
20% (29 units) in a year without amending the comprehensive plan.
The goal for 2004 has been exceeded and the additional 20% also has been used. This means
that additional new development cannot be final platted until 2005. This applies to this project.

As seen in the table at the end of this report, no more than 34 lots could be allowed for year 2005
if other applications proceed. This is about half of the project.
Premature Subdivision Criteria: The subdivision ordinance is one of the City's official
controls designed to implement and support the policies in the comprehensive plan. Section
1002 -6 of the ordinance lists criteria for determining if a proposed development is premature.
These include consistency with the land use plan, including the staged growth area boundaries.
The applicant's position is that the growth area boundaries area likely were drawn to
approximate the developable area. There is usable upland beyond those mapped lines, and it is
reasonable to utilize the upland, which includes the area proposed for parkland.
The City currently is beginning a discussion of the comprehensive plan and the implementation
tools such as the growth management policy and the subdivision and zoning ordinances. With
the strict controls that currently are in place, it is difficult for staff to support development
beyond the mapped growth boundaries, particularly with the ponding and flowage easement that
is there and the City's desire for some greenway. These two issues are discussed further below.
Lots: The minimum lot size in an R -1 zone is 10,800 sf. Minimum lot width is 80', minimum
lot depth is 135'. All lots meet these requirements. As noted above, several lots are outside the
growth area and MUSA.
Streets, Access, Parking: Fox Road is the only access point for this site. Extending Fox Rd.
as proposed would exceed the maximum cul de sac length of 500' unless a future
outlet/connection is included. Wetland extends to the east and south for more than 1000'. There
is no possible additional connection on the west because the existing homes of Reshanau Lake
Estates South 4th Addn. (Hindsight shows that Deerwood Lane should have been designed to
provide a connection to the east at its southern end instead of curving west into a cul de sac.
This is no longer an option, however.)
The 500' radio tower on the north is likely to stay. The proposed road stub to the north of the
plat avoids the tower property. Land to the north of the stub does have on it several
communication facilities such as satellite dishes and the like, but nothing so imposing as the tall
tower. It seems possible that a road could extend to the north where pictured if these facilities
were removed in the future. That area includes upland, though it is impossible to know how
much. It will necessary to have a "ghost plat" of the area to see if there is at least the possibility
of fitting in a road and some lots. As of May 5a', we have not seen a ghost plat.
The City typically does not allow islands in cul de sacs due to maintenance and plowing issues.
In addition, the northern road stub must accommodate a temporary cul de sac. These must be
revised.
Fox Road leads to Deerwood Lane and West Shadow Lake Drive. Both lead to Birch St.
Deerwood is a local street, West Shadow Lake Drive is a collector which runs from Birch St. to
62nd St., both of which are collectors.

Traffic: The developer submitted a traffic study. The original study did not recognize the
completion of West Shadow Lake Drive through to 62nd. St. or the reconstruction of 62nd St. The
study assumed all traffic from the new development will follow Deerwood Lane to Birch St.
The amended study takes into account the current and planned roadways. The result is that the
Birch St. approach and intersection will continue to operate at a level of service C.
Parks, Open Space: The proposal includes the dedication of 6.79 acres of parkland.
The current (1992) park plan does not anticipate a park in this location. The plan does envision a
"linear trail corridor" from the neighborhood on the west, across the northern part of the site, and
leading to Birch Park to the east. This trail was envisioned to be part of what we currently refer
to as a "greenway ". A greenway is a corridor of protected open space managed for conservation
and recreational purposes. The comprehensive plan includes a greenway map (see attached
detail). The City has no automatic ownership rights within areas envisioned as greenways.
Greenway corridors on the map are conceptual and are to be refined through the development
review process. The greenway map includes the entire site within a conceptual greenway.
The City has begun the process to update the parks and trails plan. The new planning effort will
address open space that is not part of active use parks. The planning process will include
discussion on the different types of open space— active recreation parkland and passive space
with natural resource preservation goals —and how they do or don't fit into the community's
future. The goal is to complete that plan in 2004.
The 1992 park plan has not been implemented as envisioned, largely due to the lack of consensus
on how to accomplish its goals. The lack of consensus on how to achieve the greenway vision
laid out in the comprehensive plan is further manifestation of the need to address these concepts.
The intent of the new parks and open space planning effort is to resolve these issues.
We can say that it would be physically possible to retain some greenway along the south and east
edges of this site and make progress on the creation of a linear trail corridor. This could involve
cooperating with the developer and possible granting some flexibility on lot sizes and/or other
design elements.
The proposed plan substitutes the park (Parcel B). This would provide a possible connection to
the northeast.
The Park Board discussed the project at its May 3rd meeting and recommended only a cash
dedication. The subdivision ordinance includes park dedication requirements. Park dedication is
$1665 per residential unit. The Park Board's view was that the proposed park is marginal land
and can't be used for active park purposes.
• Utilities: Sanitary sewer and water service will connect to existing facilities in Fox Road.
As of May 6th, the analysis of the water system was pending to determine if pressure and
circulation are adequate for this development. If not, this project is premature.

Grading and Stormwater Management: Stormwater ponds will be created in several
locations on the site. There are unresolved questions regarding if the ponds will function as
proposed due to high water elevations relative to surrounding wetlands. This requires
geotechnical tests to determine ground water elevation. As of May 5th, we have not test data.
The drainage design along the western edge must not impact the existing homes. Several lots are
noted for "custom grading." However, we do need to ensure that the grading plan establishes
fundamental grading parameters in these areas. Further information must be supplied.
Drainage and utility easements will need to cover the ponds and stormwater facilities.
Easements also must be platted along all the external property lines.
The project requires the approval of the Rice Creek Watershed District.
Existing City Easement: The project also proposes the partial vacation of an existing
ponding and flowage easement held by the City. This easement covers most of the land to the
east and south of the site, which comprises a large wetland area. A 100' strip (approx. one acre)
of the easement would need to be vacated on the eastern side of the plat. This also would include
triangle on the south (about 0.8 acre, within the 40 -acre area), and some narrow strips elsewhere
in the proposed plat.
Though this easement vacation technically is not a P & Z item (the City Council holds a public
hearing on vacations), it is an issue now because of the additional area proposed for development
outside the existing MUSA and growth area. The vacation of the flowage easement would be
necessary if the additional growth area is approved.
The City looks carefully at requests to vacate such easements. We require that the applicant
prove that the easement is not necessary and that the vacation will have no negative effect. The
only reason to vacate the portion of the easement on the east edge of the project would be to
provide for the additional lots outside the growth area and MUSA. On the south, the lots within
the growth area can be created with the easement in place. It does not appear that the vacation is
justified.
ENVIRONMENTAL BOARD
The Environmental Board reviewed this application on March 31St. Recommendations are
attached. The recommendations include pursuing a conservation development, with design
flexibility, to facilitate a greenway corridor along the south and east sides of the site.
• OPTIONS.
1. Approve the project, including the three elements:
a. Comprehensive Plan Amendment

2. Deny the project.
3. Continue public hearing and return to staff with direction.
(The next meeting is June 9. The deadline for city action is July 9. This would allow
only the June 14 and June 28 city council meetings for a final decision unless the
applicant extends the review.)
RECOMMENDATION
Option 2
• The City's growth management policy and subdivision ordinance prohibit development
outside of defined growth boundaries. The proposed plat extends beyond the stage 1 (pre -
2010) growth area, the MUSA, the Low Density Sewered Residential land use area, and the
R -1 zone. The proposer requests amendments to the comprehensive plan and zoning map to
accommodate the extra 3 -4 acres of development. It also would require the vacation of parts
of a ponding and flowage easement. There is no clear justification for these actions other
than to increase developable area.
• Section 1002 -6 of the subdivision ordinance lists criteria for determining if a proposed
development is premature. These include consistency with the land use plan, including the
staged growth area boundaries. A project that is inconsistent with these criteria is premature.
• We do not yet know if water service is adequate. If it isn't, the project is premature.

1. The proposed project area is located south of Birch Street and east of Deerwood Lane, at the east
termination point of Fox Road. The total property area is 50 acres. It is proposed to install streets,
sanitary sewer, water, and storm sewer to serve 64 single family residential units.
2. Of the 50 acres, approximately 75% is upland or developable, while the remainder is pockets of
wetlands scattered throughout the property or portions of DNR Wetland No. 565P, which borders the
south and east edge of the properties. According to the information provided, the Ordinary High
Water Level of the wetland is 893.0, and the Flood Zone limits have been indicated on the survey in

accordance with the local Flood Insurance Rate Map. A ponding and flowage easement in favor of
the City of Lino Lakes, corresponding roughly to the Flood Zone limits, is also indicated on the Plan.
A Letter of Map Amendment (LOMA) will ultimately be required to perform the improvements as
proposed.
3. Ordinary and High Water Elevations for the remaining wetlands on the site have been provided. The
wetland sizes and water elevations vary throughout the site. The wetland boundaries were performed
by Earth Sciences in September 2003.
4. A Resource Inventory Survey has also been prepared for this site. The site is generally undulating
with mixtures of wooded areas, pasture, and wetlands. Soils are generally fine sands and fine sandy
loams with the exception of areas of muck in the vicinity of the lower flood plain areas. The soils
indicated are from the Soil Survey by the USDA Soil Conservation service. However, actual soil
borings, including groundwater elevations have not been provided.
5. MUSA Boundaries: A majority of the proposed subdivision is within the MUSA Boundaries.
However, Parcel B along with Lots 23, 24, 25, and 27 in Block 4 on the easterly side of the
subdivision are not within the MUSA service area. Thus, utility services can not be provided to these
four lots at this time based on current MUSA Boundaries. The Developer will need to discuss with
City Staff the implications of the MUSA restrictions. For example, the location of a temporary cul-
de -sac and/or other utility placement may be necessary.
Also, Parcel C along with portions of Lots 9, 10, 11, 12, 13, and 18 are outside the current MUSA
service area. The MCES staff will need to be consulted to determine if there are service restrictions in
these circumstances.
Grading and Drainage
1. A General Stormwater Discharge Permit, Minnesota Pollution Control Agency (MPCA), will be
required in accordance with the most current requirements of NPDES Phase II and State of
Minnesota regulations. All NPDES regulations and requirements in accordance with the MPCA shall
be adhered to, including submittal to the City of a Stormwater Pollution Prevention Plan (SWPPP).
2. Sedimentation and Erosion Control must be enforced at all times during the course of all grading and
utility work. This includes the establishment of silt fence around all graded and disturbed areas, and
the sweeping of streets on a regular basis, and as directed by the City. In the event the Contractor
does not maintain erosion control as required, any costs incurred by the City as a result will be
withheld from escrows or other monies due. It is strongly suggested that a note be added to all
construction Plan sheets (including grading, streets, and utilities) reminding the Contractor to address
erosion control requirements be added to all grading and erosion control sheets.
3. The Grading Plan indicates that wetlands shall be replaced at a 2:1 ratio per requirements of the
Wetland Conservation Act. At this time, it does not appear that any filling into the Flood Plain is
proposed. The Plans also must be approved by the Rice Creek Watershed District (RCWD). A permit
application has been submitted to RCWD (Permit No. 04 -039, dated March 12, 2004). RCWD has
determined the application to be Incomplete, pending the receipt of several additional items. All
requirements of the RCWD must be met.

4. Minimum grades and slopes must be provided and shown on the Plans as follows: 0.5% for streets
(including curb and gutter), and 2.0% for turfed/non -paved areas including all swales and slopes.
5. Proposed house pad information, including floor elevations are provided on the Plans, including the
City's requirements for floor elevations. The minimum lowest floor must be the greater of 2 feet
above the HWL, 4 feet above the NWL, 4 feet above the groundwater elevation, and 1 -foot above the
emergency overflow. The emergency overflow elevation and location is shown on some but not all
ponds. In addition, it appears that at least some of the units do not meet the minimum 4 feet
separation from the NWL. The emergency overflow information must be provided at all locations on
the Plan, and the proposed floor elevations shall be reviewed and adjusted as needed. The Grading
Plans shall specify that all house pads on filled areas shall be designed by a registered Professional
Engineer (per geotechnical recommendations) and approved by the City of Lino Lakes.
6. The submittal of a geotechnical and groundwater investigation and report is essential for determining
pond capacities and minimum low floor elevations. For example, the Ordinary High Water Elevations
of many of the existing wetlands are higher than the lower elevations of some of the proposed
NURP /detention ponds. This must be investigated further to assure that drainage will function as
required.
7. At Lot 17, Block 4, it is indicated that a future retaining wall will be needed. A wall location and
additional information to clarify must be provided.
8. On the Preliminary Plat, drainage and utility easements along all property lines shall be provided per
typical detail provided. In addition, drainage easements shall be provided around all wetland and
detention areas to cover the 100 -year levels and provide access for maintenance vehicles /equipment.
9. At least three of the lots are indicated as "custom graded ". Additional grading information shall be
submitted.
10. A Certified As -built Survey shall be provided by the Developer's Engineer upon completion of
grading, certifying that all grading complies with the Grading Plan. This Certification shall be
required prior to the issuance of any building permits. Final certification that the grading meets City
requirements for adequate drainage and minimum slopes will be required prior to the issuing of
building permits. Percent grades shall be shown on the Plan.
11. Storm Sewer System and Drainage Calculations:
a. Existing condition computations are acceptable. Proposed condition curve numbers and time of
concentration are acceptable. However, the discharge rates from the proposed 2 -, 10 -, and 100-
year design rainfall events cannot exceed the existing conditions discharge rates. It is helpful to
provide a discharge rate comparison table with the revised discharge rate calculations.
b. The City Standard for storm sewer systems is the 5 -year rainfall event for this type of residential
development. However, a 10 -year design storm system will also be accepted.
c. Minimum storm sewer pipe full velocity is 3 feet per second; 2.5 feet per second was used on the
submitted Plans and calculations.

° d. The following storm sewer structures do not have enough cover: 3, 4, 22, and 23.
Streets and Trails
1. Access to this property is proposed from only one location, from Fox Road just east of its intersection
with Deerwood Lane. This essentially results in a very large "cul -de -sac" or single point access for
the entire Development. The extension of Fox Road through the property considers further extension
to the north in the future. However, it is unknown at this time when and if such a second access into
the site would happen. Traffic levels of service, safety, and impacts to existing streets and
intersections shall be addressed to the City's satisfaction. Comments regarding the Traffic Study are
provided further in this report.
2. A park and trail loop are proposed in the northeast corner of the property (Parcel B). The City's
Comprehensive Plan provides for a regional trail linkage between Reshanau Lake Estates and Birch
Park in this area. It is recommended that provisions for the trail link be investigated further as part of
this Development.
3. The street layout as proposed on the Preliminary Plat appears to attempt to limit impacts to existing
wetlands. However, some filling of wetlands is proposed, and mitigation will be required. As
previously mentioned, the Plans shall be subject to the review and approval of the Rice Creek
Watershed District in accordance with the Wetland Conservation Act.
4. Further details regarding the streets and trails shall be provided on the Plans, including a typical street
section, pavement section required, street widths, radii, type of curb, etc., all in accordance with City
of Lino Lakes standards. As mentioned in comments under Utilities, a Detail Sheet that includes all
applicable City standard plates and additional requirements of the City must be provided.
5. "Islands" are shown in the center of the proposed cul -de -sacs. Such islands shall be permitted only if
allowed by the City. Construction details (turf, landscaping, etc.), and long term maintenance
responsibilities shall be addressed by the Developer with the City.
6. The cul -de -sac at the north end of the subdivision on Fox Road is not drawn per City engineering
standards (92' diameter). However, it is recognized that this cul -de -sac may be considered
temporary, pending extension of Fox Road to the north at a later date. The cul -de -sac as proposed
may therefore be considered acceptable. In addition, as previously mentioned, a temporary cul -de-
sac at the end of Fox Hollow may be appropriate since the properties (Lots 23 -27) are outside of the
MUSA boundary.
Utility Plan
1. It is proposed to connect sanitary sewer to an existing 10 -inch sanitary sewer stub that extends
easterly from the intersection of Fox Road and Deerwood Drive. The rim elevation for MH 18
appears to be incorrect.

2. It is proposed to connect 8 -inch watermain pipe from an existing stub extending from the intersection
of Deerwood Drive and Fox Road. However, records indicate that this stub may be 6 -inch. The size
of the existing stub must therefore be confirmed. Adequate water pressure and circulation into the
proposed Development shall be verified by the Developer, as there is no loop or secondary feed
available to serve the Development.
3. Notes addressing private utilities, and erosion and sedimentation control must be provided on the
Utility Plan.
4. A note shall be provided on the Utility Plan stating that utility installations shall meet the
requirements of the Standard Specifications of the City Engineers Association of Minnesota (CEAM)
and the City of Lino Lakes.
5. The Developer shall provide to the City of Lino Lakes a copy of the completed Minnesota
Department of Health (MDH) Permit for watermain installation and MPCA/MCES Sanitary Sewer
Permit, upon completion of the Utility Plans and prior to construction.
6. Information shall be provided on the Plans showing the location of individual services for sanitary
sewer and water, including stationing and elevations.
7. The Developer shall provide a televised inspection tape of all sanitary sewer pipes upon completion
of the roadway and utilities. Any subsequent cleaning of the sewer pipes after construction shall be
the responsibility of the Developer.
8. The number and location of all hydrants and gate valves shall be subject to the review and approval
of the City Fire Chief.
9. Trench and roadway compaction shall meet the requirements of the City of Lino Lakes, including
100% of Standard Proctor Density for the upper three feet directly beneath the roadway, and 95% of
Standard Proctor from utility encasement zone to three feet below the surface. As stated in previous
reviews, it is critical that geotechnical information and direction be followed as construction activities
progresses. It is recommended that a geotechnical investigation be conducted, and that a geotechnical
consultant be utilized throughout construction.
10. The Utility Plan is incomplete with regards to storm sewer information, including pipe sizes,
materials, slopes, structure elevations and inverts, etc.
Details
A Detail Sheet must be provided that includes all applicable City of Lino Lakes standard plates. Additional
information shall also be included on the Utility Plans and/or the Detail Sheet as follows: Gate Valves shall
be Mueller A- 2370 -20 with mechanical joints, meeting AWWA Specifications C500 -61. Valve Boxes shall
be Mueller H -10357 with H -10361 drop lid, and extensions shall be Mueller H- 10363. Hydrants shall be
Waterous Pacer WB -67 with a bury depth of 8' - 6 ". Services shall be Type "K" copper with Mueller H-
15000 corp stop. Curb stop and curb box shall be Mueller H -15154 Mark 2 oraseal, and Mueller H -1300
w/Mpls. Top. Storm sewer details and standard plates (including structures and outlets) shall also be
provided.

Traffic
A Traffic Report for Fox Den Acres has been prepared by TDI, March 2004. Because the majority of
generated traffic is expected to access to and from County Road 10 (Birch Street), the report essentially
addresses expected impacts to Deerwood Lane, and the intersection of Deerwood Lane with County Road
10. However, the report does not address the impact of the smaller percentage of traffic that will utilize other
routes, particularly Fox Road to the newly completed West Shadow Lake Drive and soon to be completed
62nd Street. Although the traffic volumes in this direction are expected to be relatively minor, it is
recommended that the report still address potential impacts.
Regarding the intersection of County Road 10 and Deerwood Lane, the report states that the Level of Service
(LOS) of the Deerwood Lane northbound approach will ultimately (year 2009) operate at a LOS D under the
build scenario. Table 2 in the report states that the same approach lane currently operates at LOS C and will
continue to operate at LOS C under the year 2009 no -build scenario.
As a result, it is recommended that additional work on the Traffic Report be conducted to address the
following:
1. Impact resulting from generated traffic utilizing access to and from the southwest.
• 2. Level of Service changes at the intersection of Deerwood Lane and Birch Street resulting from Fox
Den Acres, and assessment of any specific improvements that may be needed as a result.
Other Issues
In accordance with City requirements, a Landscaping Plan shall be submitted. The Tree Preservation Plan
shall be subject to further review and approval of the City.

Justin's Preserve
BACKGROUND
The City Council approved the preliminary plat for Justin's Preserve on March 8, 2004. The
applicants have requested approval of the final plat.
The submitted final plat conforms to the approved preliminary plat. There is no development
agreement needed for this project as there are no improvements requiring City involvement. The
applicant is assembling information to fulfill the conditions of approval as discussed below.
1. Lot 1 shall connect to city sanitary sewer and water.
This will happen when the new lot draws a building permit.
2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction.
Several issues remain to be resolved including approval by the Rice Creek Watershed
District and additional engineering data regarding high water level of the wetlands.
3. Park dedication of $1,665 shall be paid.
This has been paid.
4. Prior to approval of the final plat by City Council, the applicant shall submit proof that the
powerline easement has been confined.
We received a copy of the partial release of easement. This document should be recorded
with the final plat by the applicant.
5. Approval by the Rice Creek Watershed District must be obtained prior to final plat approval
by the City Council.
We have not received word that the RCWD has approved the revised version of the plat.
Additional title information is pending as well. The inclusion in the plat of the neighboring
property requires title information for that property as well.
These issues can be resolved and staff will ensure they are resolved prior to consideration of the
final plat by the City Council.

BACKGROUND
The City Council approved the preliminary plat for Eagle Brook Addition on March 22, 2004
with Resolution 04 -17. The Church has submitted a final plat.
The final plat conforms with the approved preliminary plat. The City Attorney has reviewed the
title commitment. Staff is preparing a development agreement which will include financial
securities. The financial securities will include the cost of a turn lane on the northbound exit
ramp off of I -35E as well as street lights at the site driveways. A revised right of way deed for
the exception piece will be submitted prior to City Council consideration of the final plat. A
number of other conditions of approval will be addressed in the development agreement, and
some must be met prior to issuance of a building permit.

TOPIC: Recommendation to City Council Regarding Master
Planning of 360 Acres West of I -35E and North of Main St.
BACKGROUND
There was a meeting of all advisory boards and the City Council on April 29 to hear a proposal
to master plan an area abutting 35E. John Fegis of Benchmark Community Builder
Collaborative would like to conduct a master planning process for 360 acres on the west side of
the freeway, north of Main St. The planning would be a collaborative effort with the City. This
would involve revisiting the comprehensive plan guidance for development in that area as well
as other policies. Clearly, this is a serious undertaking.
The question before the P & Z is whether or not to proceed with the master planning. Staff is
requesting recommendations from all the advisory boards to forward to the City Council.

TOPIC: Discussion: Special Meeting on Temporary Signage
BACKGROUND
Because of lengthy agendas for the past several months, the P & Z has not had the opportunity to
discuss the temporary signage issue to any great extent. Discussions of the issue began at the
June 2003 meeting, and was tabled repeatedly. The last time we discussed this at all, the P & Z
decided to have a special meeting devoted solely to the topic. Last month, staff suggested June
16, 2004 and asked the board members to check their calendars.
We would like P & Z to confirm this date so staff can send out notices to business owners.
Recall that we sent a letter in October. A copy is attached. We will use the same letter with new
dates. We will add some businesses to the list, since a few opened since the last letter.
We are not attempting to mail a letter to every single business in the city. As noted in the fourth
paragraph of the letter, we tried to select representative businesses, and invited them to inform
any other business owner who might be interested.
The ultimate goal is to prepare amendments to the sign ordinance that will address temporary
signage. We remind the P & Z members that signage is a difficult issue to capture and the effort
likely will take some time.

The City of Lino Lakes is examining its sign ordinance regarding temporary signage. This stems
from concern over the appearance and excessive use of temporary signs. Several business
owners have requested that they be allowed to use temporary signage more than is allowed by
the current ordinance. Temporary signage includes all signs that are not permanently constructed

The Planning & Zoning Board will be discussing the issue at its next meeting on November 12,
2003. The Board invites business owners to the meeting with the goal of hearing their
perspective on the use of temporary signs. This will be an informal discussion. This will not be
a formal public hearing and no formal action will be taken.
The discussion likely will lead to the preparation of a draft amendment to the sign ordinance. A
formal public hearing will be conducted once a draft is prepared. After a public hearing, the
ordinance amendment would be considered by the City Council. The schedule for this has not
yet been determined.
This invitation is being sent to businesses we believe are representative of the types of business
that have or are likely to use temporary signage. There is no intention to exclude any businesses.
