CALL TO ORDER AND ROLL CALL Chair Schaps called the Lino Lakes Planning and Zoning Board meeting to order at 6:46 p.m., June 9, 2004. II. APPROVAL OF AGENDA Chair Schaps noted they would be taking the action items in the following order: B, C, A. III. APPROVAL OF MINUTES: MAY 12, 2004 Mr. Tralle made a MOTION approve the May 12, 2004 Minutes and was supported by Mr. Rafferty. Motion carried 6 -0 -1 (Ms. Lane abstained). IV. OPEN MIKE Chair Schaps declared open mike open at 6:49 p.m. There was no one present for Open Mike Ms. Lane made a MOTION to close Open Mike at 6:50 p.m., and was supported by Mr. Rafferty. Motion carried 6 -0. V. ACTION ITEMS A. PUBLIC HEARING, for Conditional Use Permit/Planned Unit Development/Preliminary Plat for Marshan Townhomes 2 "d Addition, a 23 -unit DRAFT MINUTES Planning & Zoning Board June 9, 2004 Page 2 medium density residential development, NE corner of Lake Drive and Aqua Lane Chair Schaps opened the public hearing at 7:40 p.m. Staff stated applicant had submitted a request for a conditional use permit for a residential planned unit development (PUD), and development stage plan (preliminary plat). The subject site is four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. A PUD is required for multi- family development in a shoreland area. The applicant withdrew a previous application, so this is considered a new application. No rezoning or comprehensive plan amendment is needed or requested. The site was rezoned to R -3 earlier this year, making it consistent with the comprehensive plan. Staff reviewed their analysis and recommended approval subject to the following conditions: 1. Additional right of way shall be dedicated to Anoka County to total 60 feet from centerline for Lake Drive (CSAH 23). 2. Right of access shall be dedicated to Anoka County along CSAH 23 on the final plat. 3. A new landscaping plan shall be submitted with the following changes three weeks prior to City Council consideration of the application: - change black ash to green ash or a native oak species - change Austrian pine to red or white spruce - change Colorado spruce to white spruce - change autumn applause to northern pin oak -three spruce at the Aqua Lane corner shall be moved east at least 20 feet 4. Exterior building materials must be submitted three weeks prior to City Council consideration of the application. 5. The project must obtain approval by the Rice Creek Watershed District prior to City Council consideration of the application. 6. The City Engineer's comments in the June 4, 2004 memo must be met to his satisfaction. 7. Park dedication be paid. 8. All existing buildings be removed. 9. Septic systems removed and wells capped. 10. Guest parking be installed. Mr. Pogalz asked if both the buildings located on the property would be removed. Mr. Smsyer replied all structures on site would be removed. Mr. Pogalz asked if wells and septic systems would also be removed. Mr. Smyser replied they would be required to be removed and he would add this as a condition of approval. Mr. Pogalz stated there was no guest parking shown and with the narrow road, he believed guest parking should be required. He recommended expanding the roads to 28 feet, or at a minimum guest parking being added. DRAFT MINUTES • • • • Planning & Zoning Board June 9, 2004 Page 3 Mr. Pogalz stated he would like units 1 -4 be a stub street. He suggested the fourth stub street north that was currently in the townhomes that were built would need to slightly skewed to the northeast as the stub street for unit 27. Mr. Smyser replied in an Urban PUD, there was a minimum 50 percent open space and they had just barely enough. He stated if they could not meet those requirement, they might end up losing a unit. Mr. Root agreed they needed guest parking. He requested staff check with the Fire Department and/or Police Department regarding emergency access with the narrow street. Chair Schaps invited applicant to make comment. Chair Schaps asked if applicant agreed to all of the conditions. Ron Fuchs, representative of Hokanson Development, stated they would like further discussion on the park dedication. He stated the Environmental Review Board had requested excess parking areas be removed. He noted there were four parking spaces for each dwelling unit, two inside the garage and two outside the garage. • Chair Schaps stated four parking spaces per unit was not enough. • Mr. Fuchs stated they could evaluate the site where additional spaces could be provided. Chair Schaps stated guest parking was a necessity and he could not recommend approval if it was not provided. Mr. Tralle asked what was the color of the siding on the building. Mr. Fuchs replied it was a taupe color. He reviewed the remaining color scheme for the Board. Mr. Tralle asked if all 23 units would look the same. Mr. Fuchs replied they would. Mr. Tralle stated the same color units would not be acceptable. He recommended at least four different color variations. Mr. Fuchs replied they would take that under advisement and confer with the developer. Mr. Pogalz stated if they went with the same color, it would make sense to go with yellow and green to match the existing area. Mr. Rafferty stated the plan had improved dramatically, but he was concerned about the consistency of the colors. He stated guest parking was a must and impervious surface was a problem and if necessary, they might need to eliminate a unit. He stated he was in favor of rotating 1 and 2. Mr. Root agreed the guest parking was essential. Mr. Fuchs replied they will look into this with staff as well as review the color schemes, but requested a recommendation be forwarded to the City Council regarding this project. DRAFT MINUTES Planning & Zoning Board June 9, 2004 Page 4 Chair Schaps added condition number 11 to read use of a four -color scheme variation in the exterior. Mr. Pogalz noted applicant would not be able to build for a minimum of six months and asked if this would be tabled to their next meeting, how would this impact them. Mr. Fuchs replied it came down to time and money and by delaying it it ultimately delayed the decision. He offered to review all of the conditions with staff and work with them. He indicated by working with staff it would save time. Chair Schaps noted he did not see they were going to lose much by continuing this for one month. Roger Hokanson, developer, stated they could not lose any more units and if they could not redesign it in anyway, he could not develop this. He stated they could not keep spending money on this. He stated he was hoping to get a lot more units when the land was purchased and now that the City had restricted development, they needed the units they were proposing. He stated changing the colors of the buildings were not an issue, but by adding more blacktop he did not think the development would work. He stated if guest parking was held against them, they could not meet the requirements. Mr. Smyser replied he understood it was the Board's opinion that as long as they could add guest parking, they could play with the impervious surface numbers. He stated from a time standpoint, the probably of going to the City Council with a positive recommendation was the important issue. He noted by adding guest parking, did not necessarily mean losing a unit. However, he was comfortable with this being tabled for one month also. Mr. Rafferty stated he did not think it would cost Mr. Hokanson that much money to have this tabled for one month. He noted there was nothing lost or gained by flipping 13, 14 and 15 to the opposite side of the street and by shifting 20 and 21 down would impact this development either. Mr. Hokanson noted the outside units were the most profitable and sold the best. Mr. Rafferty stated there were ways to work with this without eliminating a unit and stated they would have a much better situation at Council if this was continued for one month to work on the Board's suggestions. He stated the refinements requested would assist Council in their decision. Mr. Hokanson stated if he agreed with Mr. Rafferty's suggestions and worked with staff, could this be approved tonight. Mr. Rafferty replied he believed Mr. Hokanson's verbal word was good, but it was the Board's preference to see things in writing. Mr. Hokanson stated if they redrew it per the Board's suggestion and worked with staff on it, why did they have to wait for the next meeting. Chair Schaps stated years ago, that would have been the procedure, but now the Board wanted to see the revised plans. Mr. Tralle stated he was not willing to give the plan a "rubber stamp" and he wanted to see the plan again at next month's meeting. DRAFT MINUTES • • • • • • Planning & Zoning Board June 9, 2004 Page 5 Chair Schaps noted the Board was willing to work on the open space requirement if guest parking was accommodated for and he suggested he accept the offer of tabling this to next month's meeting to address the concerns brought up at tonight's meeting. Mr. Hokanson stated he would agree to the tabling. He pointed out that the park fees had been previously paid. Chair Schaps stated they would need to work out park fees with staff. Mr. Pogalz noted four parking spots per home was true in theory, but people also needed their garage for storage, so more than likely, there would not be four spots available for parking. He suggested they remove units 22 and 23 from the existing location, going over to units 1, 2, 3 and 4 and create a separate stub street creating their own area and creating either 3 -two home units or 2 -three home units. He noted this might cost more in asphalt, but what they were saving on the long driveways and the utility cost would also be less. He noted new open space would be created at the southwest corner and additional green space would be created around units 5, 6, 7, and 8. Mr. Hokanson replied by following Mr. Pogalz suggestion, they would lose a lot of existing trees. Mr. Pogalz replied he believed they might lose a couple of trees and asked them to look at this proposal. Jim Crawford, President of Marshan Lake Townhomes, stated he had reviewed and plan. He stated the townhomes that were along Aqua Lane had the rear building facing the street. He stated this plan would not fit into the existing area because their development had the front of their buildings facing Aqua Lane. He noted he did not know if this was a concern, but believed it would look out of place and it would disrupt the continuity of the area. He asked if the volume of the water coming off of this development would have an impact on their pond. He requested this be looked at. Mr. Studenski replied this was incorporated into the development and this would not be a problem. Mr. Crawford expressed concern about this development parking in their existing guest parking. He stated extra parking was critical in a townhome association. Mr. Root asked if he had the opportunity to review the landscaping plan. Mr. Crawford replied he had not seen the landscaping plan. Mr. Root pointed out that there would be landscaping along the back of this development facing the street and suggested he look at these plans. Mr. Rafferty made a MOTION to recommend tabling this issue and continue the public hearing to the July 14, 2004 meeting and was supported by Mr. Tralle. Motion carried 6- 0. B. CONTINUED PUBLIC HEARING, for a Rezoning (from R, Rural to R -1X, Single Family Executive) and Preliminary Plat, as well as MUSA Reserve Allocation, for Junes Addition, located at 599 — 62°' Street DRAFT MINUTES Planning & Zoning Board June 9, 2004 Page 6 Chair Schaps reopened the public hearing at 6:55 p.m. • Dick Thompson, planner for developer, stated applicant is proposing to create three lots from 6.18 acres located north of 62nd Street and west of West Shadow Lake Drive in Lino Lakes. The property currently has a home and barn located on proposed Lot 3. Mr. Junes' property is zoned as Rural and he proposes the property be zoned Residential Exclusive (R -1X). Mr. Junes is requesting that sewer and water be supplied to the proposed Lots 1 and 2. Mr. Thompson noted the creation of these lots involves the disturbance of approximately 9,771 square feet of wetland. Mr. Junes has proposed to fill the wetland and relocate the wetland to the rear portion of Lot 3, where the existing barn is located. The application has sent this permit request to the Rice Creek Watershed District (RCWD). The RCWD initially denied the request for permit based on Minnesota Rules 8420.0548. However, the applicant has since been directed by the RCWD to apply for sequencing flexibility under WACA, which would allow him to relocate the wetland. Staff reviewed their analysis and the engineering recommendations as follows: 1. The Developer is to be aware that the City of Lino Lakes is currently reconstructing 62nd Street. Prior to final approval of the Site Plans, the Grading Plan must show the changes that the street project will cause to each of the proposed three lots. 2. Prior to final City approval of the Site and Grading Plans, the Plans need to show that Lino Lakes City Engineering Standards are being followed. That is, a detail Site and Grading Plan will need to be submitted before final approval is given. 3. Approval of the preliminary plat will be contingent upon the review and consequent approval of the City Engineer. Drainage and utility easements along property lines will be required. Easements over designated wetlands will also be required. 4. Copies to the City of the Rice Creek Watershed District permit approval process. 5. The homes to be constructed must follow City of Lino Lakes design flood elevations. For this location, the design 100 -year flood elevation to be used is 894.2. The emergency overflow elevation to be used is 895.3. Thus, City requirements are as follows: low floor/basement elevation must be two (2) feet above the 100 -year flood elevations, low floor /basement must be one (1) foot above the emergency overflow elevation and the low floor/basement elevation must be four (4) feet above the groundwater or normal ponding elevation. Staff recommended approval of the rezoning from Rural to Residential Executive (R -1X), MUSA capacity be allocated for this parcel, the project shall not be final platted until 2005 to comply with the City's growth management policy, and the preliminary plat be approved subject to the following conditions: DRAFT MINUTES • • Planning & Zoning Board June 9, 2004 Page 7 1. Issuance of the sequencing permit by the RCWD, based on Application No. 03 -090. 2. That relocating the wetland will not adversely affect neighboring properties. 3. That location of proposed driveways be shown. 4. That appropriate park fees are provided. 5. That the City Engineer's recommendations be included in these recommendations. Chair Schaps invited applicant to make comment. Chair Schaps questioned if the Rice Creek Watershed would be approving this and asked if they were approving this too soon. He noted this was a big leap to assume this was going to be approved. Mr. Rafferty asked if this would not be presented until 2005. Mr. Smyser replied that was correct. Mr. Root stated there were a lot of conditions and he believed it put a lot of burdens on the staff to make sure the contingencies were complied with and he believed this was something they should be dealing with. Mr. Pogalz asked if the original request was denied as presented. Mr. Thompson replied that was correct. Mr. Pogalz stated it was his understanding applicant was now proceeding with the Rice Creek Watershed District's suggestions. Mr. Thompson replied he believed that was accurate. Mr. Pogalz asked if this was a good time for the applicant to get a stub now to the utilities. Mr. Thompson replied with the road repair taking place now, this was an appropriate time to obtain a stub. Mr. Pogalz stated he did not want to miss the applicant's to have the opportunity to put in a stub at this time and end up tearing up a newly constructed road in the next couple of year. Tim Macki, applicant's engineer and surveyor, stated they never got denied from the Rice Creek Watershed District initially. He stated they were in discussion with Carl Hammers, which pushed their plans back, and this was tabled by the District pending receipt by the various information they required. Chair Schaps asked where would they be a month from now with respect to Rice Creek Watershed District. Mr. Macki replied he anticipated they would have their permit. DRAFT MINUTES Planning & Zoning Board June 9, 2004 Page 8 Mr. Thompson clarified the Rice Creek Watershed District's initial decision. Mr. Smyser noted it appeared they did get initial approval from the Rice Creek Watershed District. Chair Schaps noted it appeared that items 3A and B had now been satisfied. Marvin Emily, 590 62nd Street, stated he was opposed to the filling in wetlands, but he was not opposed to his neighbors building on their property. He stated they needed to take care of the drainage problems before they take any more wetlands. Chair Schaps noted this had been approved by the Rice Creek Watershed District and this Board were not engineering experts and had to rely on the experts who are saying this would not create any additional drainage problems. Wayne Junes, applicant, presented some photographs to the Board as to what would be removed. He stated he did not believe there would be a drainage issue. Mr. Tralle asked if he was sure there was going to be culverts there. Mr. Junes stated he believed the road development would need to put in culverts. Mr. Smyser replied he did not have the engineering drawings before him, but the street standards was that you could not make water flow off your property to another property and these things were taken into account as the Engineer's reviewed the project. Mr. Rafferty asked where the drainage ditch was located. Mr. Junes pointed out on the map where the ditch was going. Ms. Lane made a MOTION to close the public hearing at 7:26 p.m. and was supported by Mr. Pogalz. Motion carried 6 -0. Mr. Rafferty asked for clarification on items 3A and 3B. Chair Schaps replied the Rice Creek Watershed District had issued a Cap Roc, which was a preliminary approval and there was no need to table this, but it would still remain a condition. Mr. Root asked if the remaining conditions, except for A and B, were not too burdensome on staff that they get completed prior to this going to Council. Mr. Smyser replied most of the conditions were standard conditions, which would not additional burden to staff's time. Mr. Rafferty made a MOTION to recommend rezoning from Rural to Residential Executive (R -1X) approval and was supported by Mr. Hyden. Motion carried 6 -0. Ms. Lane made a MOTION to recommend that MUSA capacity be allocated for this parcel and was supported by Mr. Rafferty. Motion carried 6 -0. Motion carried 6 -0. Mr. Smyser stated this would to go the City Council on July 12, 2004. C. CONTINUED PUBLIC HEARING, for a Rezoning (from R, Rural to R -1X, Single Family Executive) and Preliminary Plat, as well as MUSA Reserve Allocation, for West Shadow Ponds 2°d Addition, located at 607 — 62nd Street Chair Schaps reopened the public hearing at 7:33 p.m. Mr. Thompson stated applicant had submitted an application to subdivide an existing lot into two lots. This will require a rezoning from Rural to R -1X, a preliminary plat, and the allocation of 0.74 acres of MUSA reserve. The site is guided for Low Density Sewered Residential land use and is within the Stage 1 (pre -2010) growth area. Mr. Thompson indicated the project involves filling some wetland to create build able area for one of the proposed lots. Filling a wetland needs approval of the wetland mitigation from the Rice Creek Watershed District. The applicant has revised his proposal to minimize wetland fill to 394 square feet, which qualifies as a de minimus wetland fill. Mr. Thompson noted the notification of a public hearing was published and mailed to surrounding property owners. The Planning and Zoning Commission opened the public hearing and continued it to the June 9, 2004 meeting. Reconstruction of 62nd Street will occur this summer. Sanitary sewer and water will be extended west from the intersection with West Shadow Lake Drive to serve this property. Staff reviewed the engineer's recommendations, which included: 1. The developer is to be aware that the City of Lino Lakes is currently reconstructing 62nd Street. Prior to final approval of the Site Plans, the Grading Plan must show the changes that the street project with cause to each of the proposed lots. 2. Prior to final City approval of the Site and Grading Plans, the Plans needed to show that Lino Lakes City Engineering Standards are being followed. That RCWD approval for the de minimus wetland fill be approved. 3. The easement around the wetland must include additional buffer as proposed by the applicant. Wetland and buffer areas are to be identified with signs saying no fill, cutting, or dumping. Native seed mix from the City's list is to be used in these areas. • 4. The project shall not be final platted until 2005 to comply with the City's growth management policy. 5. The subject property be rezoned rural to residential. 6. That MUSA be allocated for this parcel. 7. The City's engineer's comments must be addressed to his satisfaction. • 8. The park dedication be paid. Mr. Rafferty asked if the driveway would enter 62nd. Mr. Thompson replied that was correct. Chair Schaps invited applicant to make comment. Mr. Matke, representative of applicant, stated the wetland on the east side would preclude and access, so the access would be on 62nd. He requested the driveways be put on the high side of the lot. Mr. Pogalz made a MOTION to recommend closing the public hearing at 7:39 p.m. and was supported by Mr. Rafferty. Motion carried 6 -0. Mr. Tralle made a MOTION to recommend approval of the rezoning from Rural to R -1X and was supported by Mr. Pogalz. Motion carried 6 -0. Mr. Tralle made a MOTION to recommend approval of the MUSA reallocation and was supported by Ms. Lane. Motion carried 6 -0. Mr. Tralle made a MOTION to recommend the preliminary plat subject to the conditions as noted in staff's June 9, 2004 report and the conditions added at tonight's meeting and was supported by Mr. Rafferty. ELECT CHAIR AND VICE -CHAIR FOR REMAINDER OF 2004 • Staff stated due to the resignation of Chair Schaps, the Board needed to elect a new chair and vice -chair for the remainder of 2004. Mr. Pogalz nominated Mr. Rafferty to move from the Vice Chair position to the Chair position. Mr. Hyden nominated Mr. Tralle as Chair. Ms. Lane suggested the person who did not make Chair became the Vice Chair. Mr. Hyden stated the Chair was a lot of work and a lot of commitment. Mr. Rafferty stated the current Chair's position would be difficult to fill. He thanked Chair Schaps for his service and acknowledged this would require a lot of commitment and hoped he could fill the Chair position adequately. Mr. Tralle stated he agreed with Mr. Rafferty. He stated what he brought to the Board was extensive experience in running meetings through his Church and union meetings. A closed ballot was conducted. Chair Schaps announced that Mr. Rafferty was elected as Chair and Mr. Tralle was elected as Vice Chair. Chair Schaps congratulated the new Chair and Vice Chair and wished them luck. Mr. Smyser thanked Chair Schaps for all of his hard work and he was sorry to see him go. He stated he led the Board in a direction that he believed it needed to be lead. Chair Schaps thanked the City for this opportunity. He noted the City was a truly beautiful community. He stated he had the honor to serve with a number of great people in the City including the Mayors, Councils, and staff He stated the City has had great Boardmembers throughout the years and thanked them for their service to the City. He indicated he was leaving the City at a time of great strength. He thanked the citizens for all of their input over the years. He wished everyone luck in the future. VI. DISCUSSION ITEMS A. REMINDER OF SPECIAL MEETING TO DISCUSS SIGNAGE: JUNE 16, 2004. Mr. Smyser reminded the Commission of the June 16, 2004 meting to discuss signage. He stated no action would be taken at that meeting, it would only be a discussion to discuss signage. He indicated the 30 to 40 business owners had been notified of this meeting. B Jeff Smyser July 14, 2004 Final Plat: Elm Street Estates (formerly Lakeview Estates) Elm St. and Lakeview Drive The City Council approved the preliminary plat for Lakeview Estates with Resolution 03- 120 on September 8, 2003. Apparently, there already is a Lakeview Estates in Anoka County, so the applicant changed the name to Elm Street Estates. Under our subdivision ordinance, the final plat needs P & Z review prior to City Council approval. This project involves an existing residential lot with one existing house (7180 Lakeview Drive) at the corner of Elm Street and Lakeview Drive. The owner split the property into three lots, which creates two new house lots fronting on Elm St. The installation of city water and sanitary sewer service in Elm St. made this subdivision possible. The final plat conforms to the approved preliminary plat. There is no development agreement because there are no public improvements for the plat. The City Attorney's review of the title commitment is underway and will be fully resolved prior to City Council approval of the final plat. BACKGROUND The P & Z opened the public hearing at the June 9 meeting and continued it to July. Hokanson Development has submitted a request for a conditional use permit for a residential planned unit development (PUD), and development stage plan (preliminary plat). The subject site is four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. A PUD is required for multi - family development in a shoreland area. The site was rezoned to R -3 earlier this year, making it consistent with the comprehensive plan. ANALYSIS Land Use, Density, Zoning The table below identifies the existing land use and zoning as well as guided land uses for the area. They were built at a density of 6.4 units /acre, in accordance with the approved site plans. The City began work on a new comprehensive plan in 1996 -97 and approved it in 2002. The entire Marshan Lake Condominiums site and the remaining four -acres now proposed for development is guided Medium Density Residential. This allows a density of 3 -6 units per acre. The project falls within this range. Zoning: The four -acre site recently was rezoned to R -3, Medium Density Residential to make it consistent with the comprehensive plan. The site is within a shoreland overlay district. The specific requirements relative to the proposed project are discussed below under "Preliminary Plat /PUD ". The shoreland ordinance requires a PUD for multifamily development in a shoreland overlay area. Growth Management: The City's growth management policy (Ordinance 01 -03) implements growth policies of the comprehensive plan. It establishes limits on the number of new units to be approved as well on the use of MUSA reserve. The site is within the existing MUSA, so the MUSA reserve limit is not applicable The 147 units per year have been reached for 2004 and the allowable 20% also has been used (see attached table). Only 113 lots have been approved for 2005, so there are lots available. However, the projects listed in the table as "proposed" will push into the 20% for 2005. PRELIMINARY PLAT/PLANNED UNIT DEVELOPMENT Section 2, Subd. 10 of the zoning ordinance discusses the purpose of a planned unit development (PUD). The application should be compared to these purposes in order to justify any flexibility requested by the applicant. Purpose and Intent. The purpose of this section of the Zoning Ordinance is to provide for the grouping of lots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. This section is intended to introduce • • Marshan Townhomes 2 °a Addn. flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. It is further intended that planned unit developments are to be characterized by central management, integrated planning and architecture, joint and common use and maintenance of parking, open space and other similar facilities, and harmonious selection and efficient distribution of uses. A residential conditional use permit PUD may include a variety of residential units, including single family and multifamily units as long as it complies with the density requirements. A non - residential conditional use peluiit PUD may include a variety of commercial and /or industrial uses. A PUD that includes a mix of residential and commercial /industrial uses must utilize the PUD zoning district as described in Sec. 9 Subd. 3 of this ordinance. The PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to encourage: 1. A development pattern in harmony with the objectives of the Comprehensive Plan. 2 Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. 3. The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. 4. A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. 5. An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. 6. Ten buildings are twin homes, the other is a three -unit. They are all two -story structures. Each unit includes 1633 sf. The garages are similar in size to other recently approved PUD projects. The zoning ordinance requirements are as follows (Sec.3, Subd. 4.B.2.b.4)): Exterior Building Finish: The exterior of townhome dwelling units shall include a variation in building materials which are to be distributed throughout the building facades and coordinated into the architectural design of the structure to create an architecturally balanced appearance. In addition, townhome dwelling structures shall comply with the following requirements: a) A minimum of twenty -five (25) percent of the combined area of all building facades of a structure shall have an exterior finish of brick, stucco and /or natural or artificial stone. b) Except for brick, stucco, and /or natural or artificial stone, no single building facade shall have more than seventy -five (75) percent of one type of exterior finish. c) For the purpose of this section, the area of the building facade shall not include area devoted to windows, entrance doors, garage doors, or roof areas. We received building elevations on July 7th. They show a light brown vinyl siding with a darker brown vinyl shake in the gable ends. A dark brown brick veneer base is shown on the front of the buildings, though none on the sides or backs. • The Miller's Crossroads townhomes include stone around all sides of the buildings. The question is whether this project merits the same flexibility. • Judging from the submitted elevations, there is no aesthetic reason not to include a brick base all around the buildings. This would be a gesture to the intent of the architectural requirements. The exteriors of the existing buildings lack such a base, so it isn't necessary to require more extensive architectural treatments on the backs of the structures. The backs will be facing the internal areas of the site. Structure Setbacks: We have been experiencing confusion among builders due to the adoption last year of the International Building Code. Fire protection requirements in the code dictate a minimum structure separation from property lines unless the structure includes specified fire protection elements. To meet the code requirements, the furthest projection must be at least three feet from the property line or special fire protection requirements apply. This would include no openings such as windows or soffit vents. Lino Lakes has made the decision that the building must meet the three -foot separation from the actual property line of the unit rather than outer border of the larger common area property line. The plans show that the unit lot property extends 10 feet around each building except the sunrooms on the rear of the buildings. The individual unit lots must be platted deeper to ensure that this three foot separation is met. This must be shown on the final plat. Streets, Access: The plan shows additional right of way to be dedicated for Lake Drive (CSAH 23). This would meet Anoka County's requirement for 60' from centerline. Access to most buildings would be via private drives off of Aqua Circle. The drives are 24 ft. wide, back of curb to back of curb. The Century Farm North project has the same design for the townhome access drives. The existing Marshan Townhomes have wider access drives: 28' back of curbs. The proposal is acceptable. The plan shows separate driveways onto Aqua Lane for Units 1, 2, 3, and 4. Other options exist. The two twin -home structures could face one another across a shared drive. A driveway exists that serves the existing townhomes on the north side of the site. It was constructed centered on the property line. This driveway could be used by the current proposal with a shared driveway agreement. This was the original intent of this driveway. However, the property to the north now is under separate ownership. There are some trees in the proposed open area that would be lost with either of these options. As long as a large open area is being preserved, it's logical to have it in an area where existing mature trees can be preserved. The main question is whether these trees really can be preserved with the demolition of the existing structures in the immediate proximity to these trees. • At the request of the P & Z, I contacted the Fire and Police Depts. to ask if the length of the driveways in the existing development has created any public safety concerns. The • Marshan Townhomes 2nd Addn. page 6 Police Dept. said there have been no problems from their perspective. The Fire Chief also informed me that there have been no problems. Since the existing townhomes used this design, he had no concern. Though the new proposed driveway is even longer than the existing ones, the Aqua Lane and Lake Drive are close enough to provide access in addition to the driveway itself. For future new development, we probably should consider turnaround areas on drives of this length. Guest Parking: The P & Z desired that guest parking spaces be added, even though this would reduce the open space and increase the impervious surface area. The applicant has submitted a drawing showing 18 guest parking stalls added to the plan. This would require spreading the buildings apart in several places and increasing the length of the access drives. The drive /parking areas would still be 10 feet from the new right of way of Lake Drive. The proposed alternative is workable. Grading and landscaping must be adjusted to accommodate the change. A new set of plans that includes this design must be submitted three weeks prior to city council review. Utilities, Stormwater Management: There is no ponding or treatment included in the proposal. The existing stormwater management design for the area accommodates development on this site. However, stormwater treatment must be provided in accordance with the most recent regulatory requirements. This will be reviewed in greater detail as the project progresses. • The Rice Creek Watershed District requires District review for multi -unit development over 2.5 acres. The Watershed District granted preliminary approval on June 23. Some adjustments to utility connections have been reviewed by the City Engineer since the May 5 submittal. Landscaping: The existing townhomes screen this site from the lake, so screening is not an issue as it might be for lakeshore property. The proposed landscaping is adequate. However, several species should be changed according to the Environmental Board's recommendations, as listed in the conditions of approval. In addition, three spruce trees must be moved out of the line of sight for vehicles at the intersection waiting to turn onto Lake Drive. This can be shown on a new landscaping plan prior to city council approval. Lighting: No street or yard lighting is shown on the plans. There is no reason to provide any such lighting. Park Dedication: The applicant has maintained that land dedicated with the larger development included the dedication for most of the current four -acre site. Staff has researched the file for the Marshan condominiums project. The situation is complicated because there is some, but not complete overlap of the two project areas, the original project was not completely built, and the ordinance requirements for park dedication have changed. • • Marshan Townhomes 2nd Addn. page 7 The 1995 project included 29.9 acres. A total of 139 units were approved for the project. The density then was 139/29.9 = 4.65 u/a. Part of the site included an area of 1.5 acres labeled "future commercial" in which no dwelling units were shown. One 5 -unit building did not get built, as it was on land not ultimately platted as part of the project. Both of these areas are within the four -acre site of the current proposal. At the time, the subdivision ordinance included a progressive scale: the percentage of land for park dedication increased as the density of a project increased. (This was adopted with Ordinance 05 -91.) A density of 3 to 5 units per acre required a park dedication of 12% of the land. Twelve percent of 29.9 acres is 3.6 acres. The developer dedicated a 3.0 acre park and a trail corridor of 0.6 acres, for a total of 3.6 acres. Current park dedication is $1665 per unit when land is not needed. For the 23 units currently proposed, this would total $38,295. The developer maintains that he should not be charged dedication for the 1.5 acres "future commercial" area or for the area where the five units didn't get built. It is reasonable to give credit for the five units that did not get built, and staff recommends doing so. This reduces the dedication by 5 x $1665 = $8,325 . However, it is not appropriate simply to give credit for the 1.5 acres by completely eliminating it from any new dedication. There were no units shown in that area on the 1995 plan. Though the land was included in the calculations for the original project, the additional units were not. Removing the 1.5 acres from consideration for additional dedication would be like not charging park dedication for new units being built in the spaces between the existing buildings. (There are 11 units in that area on the new proposal. Had there been another 11 or 12 units there, it would have raised the density of the 1995 project to 5+ units /acre, which would have required a 14% park dedication (139 + 11 = 150 and 150/29.9 acres = 5.02 u/a). This would have required a dedication of 29.9 acres x 14% = 4.19 acres. Since 3.6 acres was dedicated, there would have been a shortage of 0.59 acres of park dedication.) It is appropriate to get additional park dedication since the additional units generate additional demand for park services. It also is reasonable to consider giving some credit for the past park dedication on the 1995 project. The ordinance at the time included an equation for calculating cash dedication. It used a land value of $10,000 per acre. This seems reasonable. The project density fell into the 12% park dedication category. Applying this to that land value yields $10,000 x 12% = $1200. This is a reasonable credit for the past dedication. Summarized, this all results in the following: • Marshan Townhomes 2nd Addn. page 8 23 new units x $1665 = $38,295 less credit for 5 units: 5 x $1665 = ($8,325) less credit for past dedication on 1.5 acres = ($1,200) total new park dedication $28,770 Staff is recommending a park dedication of $28,770 for the new project. ENVIRONMENTAL BOARD The Environmental Board reviewed the application on May 26th. The comments are attached. Changes to species are included in the conditions of approval. Inspection of imported soils is required by development agreements. Irrigating the sod areas is listed in notes on the landscaping plan. CONDITIONS OF APPROVAL The following conditions should be attached to any approval of the project: lb Additional right of way shall be dedicated to Anoka County to total 60 feet from centerline for Lake Drive (CSAH 23). 2. Right of access shall be dedicated to Anoka County along CSAH 23 on the final plat. 3. New plans showing the extended driveways and guest parking stalls shall be submitted three weeks prior to City Council consideration of the application. Plans must show landscaping, grading, and any other alterations needed to accommodate the changes. 4. A new landscaping plan shall be submitted with the following changes three weeks prior to City Council consideration of the application: - change black ash to green ash or a native oak species - change Colorado spruce to white spruce - change Austrian pine to red or white pine - change autumn applause to northern pin oak - three spruce at the Aqua Lane corner shall be relocated and other landscaping adjusted to accommodate the guest parking stalls 5. The new plans must include larger individual unit lots to ensure that the eaves and any building projection meets the property line separation to meet fire protection requirements in the building code. The plans essentially provide for the construction of 23 townhome units, constructed as (10) X 2 -unit buildings and (1) X 3 -unit building, all located between Lake Drive and Aqua Circle, and north of Aqua Lane. Access to 19 of the units would be from two (2) individual shared private driveways extending from Aqua Circle, with the other 4 units accessing directly to Aqua Circle. Under the revised utility plan, utilities (water and sewer) are proposed to be connected to existing services from Aqua Circle. No access to Lake Drive or work within the Lake Drive right -of -way is proposed. 2. It is not expected that any construction related permits from Anoka County will be required. However, any side grading into the Anoka County right of way would require a permit. Because the property is adjacent to the County Roadway, the Preliminary and Final plats will require the review of the County. An additional dedication of 15 feet to the County right of way is shown as required by Anoka County. The applicant shall also be aware of intersection sight distance requirements, and that no trees or vegetation may be planted within the County right of way, or at locations that will restrict comer visibility sight lines. This would also include signs, berming, or other surface features. The final Landscaping Plan shall therefore be subject to further review and approval of the City and County as needed. 3 For drainage of the site, the Plan utilizes an existing storm sewer and ponding system to the east of the property. Drainage calculations were previously submitted for the December 5 review. Stormwater pond calculations dated May 6, 2004 have also been provided and reviewed. This site was previously reviewed by the Rice Creek Watershed district as part of a much larger developed area that includes the existing property to the east. The proposed site development (high density residential) is consistent with the property use considered in the previous original drainage design for the larger area. The proposed new construction therefore appears to fit and conform with the original submittal. However, approval and/or acknowledgement from the Rice Creek Watershed District will be needed to confirm compliance with the original permit. 4. Because the site area exceeds one acre, the development also falls under the new rules requiring an NPDES permit. The applicant shall be responsible for obtaining this permit. This also includes the submittal of a Stormwater Pollution Prevention Plan (SWPPP) to the City in accordance with NPDES requirements. Silt fence and erosion control details are provided on the plans and shall be installed accordingly. 5. Per the Survey and Existing Conditions Plan, several buildings including houses, barns, sheds, and a garage all exist on the site. Demolition, removal, and grading of the site will therefore be required. The applicant will be responsible for the complete removal of all buildings, foundations, underground and above ground items, capping of any existing utility connections and wells, and removal of any underground, fuel storage or septic systems that may exist. All debris and unsuitable material must be removed from the site. Any material imported to the site must be approved by the City Engineer. The borings and associated report cover a larger area that extends beyond this proposed development. However, the same general comments apply and can be summarized as follows: Additional excavation of fine alluvial silts and replacement with compactable granular material may be required for construction of the buildings and private drives. Groundwater levels may also necessitate dewatering for the utility installations. Any imported topsoil, fill material, or granular materials for roadway and building foundation (material and source) must be approved by the City Engineer. 7. The plans provide building elevations. The lowest floor elevations must meet City of Lino Lakes requirements with regards to separation from adjacent high water elevations and groundwater levels. Based upon the geotechnical information provided, the elevations are acceptable. 8. The preliminary plat provides for standard drainage and utility easements (10 feet in width) around the perimeter of the property as required. In addition, 44 foot wide drainage and utility easements covering the two private driveways are also provided. It is recommended that the driveway easements as shown also be dedicated as access easements in addition to the drainage and utility dedication. 9. All utility work shall be performed in accordance with the City of Lino Lakes, City Engineers Association of Minnesota (CEAM) Specifications, and City of Lino Lakes building permit requirements. Water pipe and appurtenances shall meet the requirements of the City of Lino Lakes, and as follows: Hydrants - Waterous Pacer WB -67; Valves - Mueller A2370 -20 or equal. DIP pipe shall be Class 52. All sanitary sewer service pipes shall be SDR 26 or Schedule 40. The location and number of hydrants will be subject to the review of the City Fire Chief. Safety and traffic control during construction must be provided in accordance with the State of Minnesota Manual of Uniform Traffic Control Devices (MUTCD). 10. Revisions have been made to the Utility Plan (Sheet 6 of 11) as follows: A. The watermain loop through the site has been sized up from 6 -inch diameter to 8 -inch diameter per City of Lino Lakes requirements. B. The revised Utility Plan provides for revisions to main and service connections that result in fewer excavations into the existing street (Aqua Circle). This is accomplished by utilizing more of the existing services, and by extending water and sewer mains parallel to Aqua Circle within the boulevard to serve the northerly 4 properties. This normally would not be a concern except that the 8 -inch watermain loop would now connect to 4 -inch lines at each end, and the 8 -inch sanitary sewer mains would connect to existing 6 -inch services. Standard practice generally discourages larger diameter pipes feeding into smaller diameter pipes. In addition, the condition and grades of these existing services would require verification of their adequacy at the time excavations are made. The City will not allow any main line utility extensions from the existing 4" service stubs. The existing 6" stubs can be connected to with 8" lines. The sanitary sewer extensions must have a manhole as the connection. No sanitary sewer main line cleanouts will be allowed. All utility extensions and streets /driveways proposed are considered private and will not be owned or maintained by the City of Lino Lakes. This must be detailed in an Agreement between the City and the Applicant. It is also recommended that the utility plan show the specific locations of individual valve boxes and their service termination points (between street and building). Individual sanitary sewer and water services must also meet minimum separation distances. 12. All grassed or swaled drainage ways must have a minimum slope of 2 %. 13. It is recommended that the proposed storm sewer be extended to the foot of the south driveway to pick up drainage, similar to that proposed for the north driveway. 14. The applicant shall be responsible for obtaining permits from the Minnesota Department of Health and the Minnesota Pollution Control Agency for the water and sanitary sewer installations as required. 15. The objective of the proposed color pallets and building materials is to attain a compatible and appealing development that blends in well with surrounding area. Typical building makeup includes a brown hue stone veneer base, in conjunction with vinyl siding and shakes on gable ends. The usage and placement of the stone base is similar to most ,single family designs, i.e. no stone is proposed on the rear facade. All garage doors, doors, fascia, soffit, windows and transoms will he white in color with white accent trine. The roof will be composition asphalt shingles in a shade of brown, incorporating) a minimum 18" overhang. As discussed at the June 9`b meeting, it seems as though there was a degree of uncertainty of what was desired of this project as two differing approaches for color schemes were discussed by the Commission. One was a desire to have tip to four color schemes, while the other was to have one color scheme. We would prefer to have one color schema for the eleven structures, as this will create a more cohesive and knitted neighborhood. We understand that the Comrtiission would like to choose color(s) and a color pallet will be available for the Planning Commission. 2. Access: Our initial plan raised a concern by the Planning Commission about the width of the twenty -four feet (24') private drives. As the design complies with the zoning ordinance and that the City has previously allowed other developments with similar width drives and length (i.c. Miller Crossing and Century Farms), we are confident that this width is not so unique. As our interests arc completely aligned with the City, the private drives do not exceed the niaximum drive length, and that we have limited the amount of private drives and further provided a fire hydrant nt (ht.: end of the southern most private drive. Ilence, wc: feel the design protects the public interests and with the additional parking spaces provided, emergency access is better than a plan just meeting the code. 3. Park l?cciieattlone We have requested support for previous assessments that we have contributed since we believe they should mostly cover park dedication needs (Lino Lakes Marshan Leke Condos Summary of Financial Requirements — dated January 30, 1996). As noted, a majority of the current site was also part of the initial Marshan T.ake Condominiums project totaling 30.25 acres. During the initial review of Marshan Lalcc Condominiums, over three acres of land along with a trail corridor were dedicated as part of Marshan Lake Condominiums as live acres of public parklands were designated by the Comprehensive l'Jan for this part of Lino 1.akes. Along with the three acres for a public park, a 20' wide public trail corridor adjacent to Marshan Lake was also dedicated/built (Shores of Marshan 11 mono — dated June 9, 1995 — Marty Asleson). As over 10 percent of lands were previously dedieated fur public park and trail purposes, no additional lands /cash should be required for that part dedicated. However, Jiokanson did not own a small portion of the underlying lot (47,485 square feet) and we feel only this portion is subject to the current park dedication component. 5. Change::: rt .,eosin,: We understand that the City is encouraged to maximize density within the MU A. Our plan meets density on this site and we believe that the City is better off with the proposed density on this particular site for this reason. Marshan will serve to diversify the lifestyles and housing opportunities available in this quadrant of the city - - creating a neighborhood that is responsive to the needs of residents and the larger community. 6. Included with this request are four plans discussed below; Option A With Exlra Parking is our preferred plan with 23 units, with the addition of eighteen additional guest parking spaces in conjunction with the existing ninety two (23 units X 4 pnrking - 92) for a total of 110 parking spaces (4.78 parking spaces per unit). With tltc additional parking spaces, approximately thirty four percent of the site is iinperviotis; thereby, complying with the maximum 35% impervious requirement. This concept does not conflict with our desire to preserve the trees currently existing on the site. The project's layout has been designed to provide an intimate setting that is intensely landscaped, places parking sway from adjacent public streets, maintains vegetation, and provides open space opportunities that the Environmental Review Board so desired. The proposed plan mats all current land use codes by orienting buildings to the internal private drive or to the abutting public street. All of these buildings have entrances that face directly onto public streets or private drives. The preferred plan with varying the setbacks and drive locations creates variety in the stree seape. All building setbacks are behind the standard utility easements; therefore, they do not adversely impact the public interests. The intent of the plan was to provide separation between this development and existing Marshan Lake, while also complimenting certain aspects of existing Marshan, i.e. the plan replicates the placement of dwellings with drive access onto Aqua Circle. The proposed plan promotes variety in housing layout as the majority or homes will face private and public ways, while some will back greenbelts, a preferred living condition for some people. The private drives provide. sufficient access to the attached single- family homes. All units are within 150 feet of a public street, and have adequate access to those streets. While accessing the built private drive does meet technical requirements, it does provide an additional need for this association to coordinate with the existing Marshan condoriniurns. Further, there is no appreciable gain with impervious arca and the layout destroys wooded areas of this site that are worth preserving. • Alternate Two is a plan that combines the three sets of duplexes into two triplexes. While maintaining the density of the proposal, the units created create two additional internal unit` that are not as desirable as corner units with no appreciable gain in pervious arca. Further, open space between structures is compromised with this design. • Alternate 'Three is a plan that provides an additional private drive into the subject site; providing rtoccrss for four units. This plan also maintains the density of the proposal; however, the layout destroys wooded areas of this site, reduces the amount of open space, increases impervious and does not create a harmonious development as initially proposed. Our preferred plan Option A exceeds the intent of the land use code and is preferable, emphasizing that it is also a plan that m cts all thc requirements of node. The resulting land use pattern will provide a moderately dense community buffering and enhancing the adjacent single family residential, multi-family residential and commercial uses along Lake Drive and Aqua Lane. Curt and Kelly Monson — Bacchus Homes, Inc. 6396 Langer Lane BACKGROUND November 13, 2003 the City of Lino Lakes issued a single - family home — new construction building permit to Bacchus Homes, Inc. for 6396 Langer Lane (Lot 22 Block 2 of Clearwater Creek 5th Addition). The survey submitted with the building permit application on November 5, 2003 indicated the required 5 -foot side setback for the attached accessory structure (garage) as is required by the City of Lino Lakes Zoning Ordinance. The permit was issued based on this proof of compliance with the zoning code requirements. The City of Lino Lakes requires all new construction to submit an "As- Built" survey verifying that the structures are built to the approved specifications. In the case of the subject property, the "As- Built" survey indicated that the attached accessory structure (garage) had actually been built to a 3.9 -foot side setback rather than the 5 -foot side setback as required by the City of Lino Lakes Zoning Ordinance. A STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: July 14, 2004 TOPIC: Discussion: Temporary Signage BACKGROUND Recall that the P & Z held a special meeting on June 16th to discuss temporary signage. We sent letters to 40+ businesses inviting them to the meeting. The letter encouraged them to pass the invitation to others as well. Representatives of two business attended along with three real estate agents. The real estate people were concerned about the potential for prohibiting "for sale" and "open house" signs along roads. The current ordinance exempts such signs from regulation. Up until then, the discussion never included changing the ordinance to regulate real estate signs of this type. Staff would recommend we not pursue this. Such signs are in place for a matter of hours or days, are very small, and only rarely are there enough of them in one location as to constitute an eyesore. They should not be in a road right of way, however. The two business owners raised certain issues, which are listed below as bullet points. I have added some brief comments for each. • Temporary signs are important for grand openings and special sales. Temporary signs are very effective. A real estate representative stated that signs produce better results than other forms of advertising. There is no doubt that signage is important and necessary. We need to address how much signage, where, and for how long? • Signs are not the only thing that affect appearance of a business. There is no doubt that the general appearance of a business involves many things, only one of which is signage. This does not dilute the importance of signage. • The current ordinance does not define "banner ". Clearly, the existing sign ordinance does not address the issues in a satisfactory manner. That is why this issue is being discussed. Definitions can and should be amended. Banners are a form of temporary signage and should be included in the definition of temporary signs. • Please remember that we are not limiting the discussion to banners only. We are considering all types of temporary signage. It is possible that certain requirements would apply to banners specifically. • The current ordinance does not address window signage. If the P & Z desires to address window signs, that is possible. • If real estate agents can put up a sign without a permit, why not others? Such signs are in place for a matter of hours or days, are very small, and only rarely are there enough of them in one location as to constitute an eyesore. • Tobacco companies require certain signage by contract. We will need to learn more about such contractual requirements to see just what they require. Staff has initiated some research into this question. Issues to Discuss Scope: Just what types of temporary signage do we want to regulate? Definitions: temporary signs, banners and other types Allowable location(s) for temporary signage Allowable size: total area and, if temporary signs should be included in the maximum amount of signage allowed Allowable time limit, if any, for temporary signs Enforcement: It is unlikely that 100% enforcement will occur, but that should not stop the City from having the tools to prevent and resolve unsightly situations when possible. Ultimately, the goal is to prepare amendments to the existing sign ordinance . We are not considering a total revamp of the sign ordinance: a fare more extensive project. For now, we are looking at issues relevant to temporary signage. Staff has no specific ordinance recommendations at this time. The council at their June 14, 2004 meeting adopted the seven goals. Each of the goals includes a specific Management Action Plan (MAPs) for pursuing implementation. The MAPs identify specific performance, objectives, schedules, methodologies, and action plans. The also identify operating and capital budget requirements. The goals and their respective MAPs are attached. Implementation of six of the goals falls within the responsibility of the Community Development Department. Building: The initial building size will be 10- 15,000 sq. ft., with expansion capacity up to 17- 20,000 sq. ft. Approximately 1/4 of the facility will be office, and the remainder will be warehouse /storage, including a freezer component. The facility will have two dock doors and four overhead drive -in doors. An above ground 18,000 - gallon propane storage tank will be located on site. Delivery Trucks: The site will need to accommodate approximately 14 — 40 Home Service Delivery Trucks when fully developed. These vehicles have 2 axels are approximately 18 -22 feet in length. Cab and box are permanently attached. Site Activity: • This facility is a distribution depot serving the north metro area. From this location Schwans will deliver products to residential customers. Products are delivered by semi trailer, stored then loaded on Home Service Delivery Trucks. • Product deliveries to the Home Service Facility are made by one semi trailer truck 2 -3 times per week. These vehicles typically make deliveries in the evening hours. • When on site, the semi tractors and trailers are backed up to the loading dock or staged for unloading which takes between 3 and 4 hours. When unloading is complete the semi tractor and trailer leave the site. S: \Planning & Zoning Board \Packets\Packets - 2004\July 14, 2004 \Item 6C - Schwan's Relocation.doc • Home Service Delivery Trucks are loaded inside the overhead drive -in doors each day, Sunday — Thursday, between midnight and 6:00 AM. When loaded with product for the next day's delivery, the Home Service Delivery Trucks are parked on the site and plugged in to maintain appropriate refrigeration levels. Home deliveries take place between 7:30 AM and 9:30 PM. The majority of trucks are parked on site over the weekend, with a small number of home deliveries made on Saturday. • Trucks on site are either being unloaded, loaded, refueled or staged for departure on delivery routes. Schwan's is seeking guidance as to compliance with the city's existing ordinance for delivery vehicle parking /exterior storage. Code Analysis Warehousing and distribution facilities are a permitted use in the LI, Light Industrial District and subject to administrative review and approval. However, the exterior parking of delivery trucks has raised the question of whether this should be considered Exterior Storage. While exterior storage is a permitted Conditional Use within the LI, Light Industrial District, certain requirements would preclude exterior storage on the proposed Schwan's site. Specifically the ordinance stipulates that the property cannot abut I -35W or I -35E. Section 1., Subdivision 2.B of the Zoning Ordinance defines Exterior Storage /Storage Yards as follows: An outside area where equipment, vehicles, trailers, or material relating to the principal use of a parcel of land is stored. This includes semi - trucks and trailers. The stored items are not for sale or display but are used in the everyday operation of the principal use. Also referred to as "outdoor storage." Outdoor sales lots are not outdoor storage but are distinct uses regulated by this ordinance. Section 3., Subdivision 4.P.2 of the Zoning Ordinance regarding Exterior Storage in Commercial, Industrial and Public /semi - public Zoning Districts stipulates the following: a. Exterior Storage. Exterior storage shall be governed by the respective zoning district in which such use is located. b. Screening. All exterior storage shall be screened so as not to be visible from adjoining properties and public streets except for the following: 1) Merchandise being displayed for sale in accordance with zoning district requirements. Within an industrial zoning district, the exterior storage of semi- trailers accessory to the principal use may be allowed by conditional use permit according to Section 8, Subd. 1 and Subd. 2. Semi - trailers connected to semi - tractors queuing for loading or unloading shall be considered truck parking and be exempt from the outdoor storage conditional use permit. Section 8., Subdivision 1.I.5 of the Zoning Ordinance regarding Conditional Use for Open and Outdoor Storage stipulates the following: Open and outdoor storage (not outdoor sales lots) as an accessory use provided that: a. The storage area is landscaped and screened from view of neighboring uses, residential zoning districts, and public rights -of- way per Section 3, Subd. 4.Q of this Ordinance. b. Storage area is fenced in a manner approved by the City. c. Storage area is blacktopped or concrete surfaced unless specifically approved by the City Council. d. All lighting shall be in compliance with Section 3, Subd. 4.F of this Ordinance or other lighting standards in place at the time of project approval. e. The storage area does not take up parking space or loading space as required for conformity to this Ordinance and not in front yards. f. The property shall not abut property zoned for residential, rural, or business use, including land in a neighboring city. "Abutting" includes across a street. "Abutting" does not include properties that touch only corner to corner. g. The property shall not abut I -35W or I -35E. h. The storage area shall not abut a school or a public park. i. The ratio of storage area to building footprint shall not exceed 3.5:1. The issue of parking trucks outdoors in commercial and industrial areas and the applicability of exterior storage requirements has been raised several times in the past. The 2003 Zoning Ordinance update did provide some additional clarification to the issue. However, the discussion and modifications made related primarily to semi - trucks and trailers. While the definition of exterior storage includes "vehicles" the exterior storage requirements in Section 3., Subdivision 4.P.2 states in part that "Semi- trailers connected to semi - tractors queuing for loading or unloading shall be considered truck parking and be exempt from the outdoor storage conditional use permit ". Therefore it is our opinion that the proposed Schwan's delivery trucks would not be considered exterior storage. However, any site development for the proposed use would need to comply with screening requirements. Schwan's has indicated they are working on a site design that screens the parking area from I -35W. The City's Economic Development Advisory Committee (EDAC) discussed the issue at its July 1, 2004 meeting and recommended support for the Schwan's project in the Marshan Lake Industrial Park with proper screening. Staff would like comments from the board on this issue. We anticipate the need to review and revise the ordinance language to avoid any further ambiguity. Attachment 1.
