Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at 6:31
p.m., July 14, 2004.

Mr. Tralle made a MOTION approve the June 9, 2004 Minutes and was supported by Mr.

V. ACTION ITEMS
A. Introduce Paul Bengtson, Associate Planner
Mr. Smyser introduced Paul Bengtson, the new Associate Planner.
The Board welcomed Mr. Bengtson.
B. Final Plat, Elm St. Estates (formerly known as Lakeview Estates), Gerald
Schultz, SE corner of Elm St. and Lakeview Dr.
Staff stated the City Council approved the preliminary plat for Lakeview Estates with
Resolution 03 -120 on September 8, 2003. Apparently, there already is a Lakeview
Estates in Anoka County, so the applicant changed the name to Elm Street Estates.
Under the subdivision ordinance, the final plat needs P & Z review prior to City Council
approval.
Staff stated this project involves an existing residential lot with one existing house (7180
Lakeview Drive) at the corner of Elm Street and Lakeview Drive. The owner split the
property into three lots, which created two new house lots fronting Elm Street. The
installation of city water and sanitary sewer service on Elm St. made this subdivision
possible.
Staff noted the final plat conforms to the approved preliminary plat. There is no
development agreement because there were two public improvements for the plat. The
City Attorney's review of the title commitment is underway and will be fully resolved
prior to City Council approval of the final plat. Conditions of approval will be met with
building permit review of the new houses.
Ms. Lane made a MOTION to recommend approval of the final plat for Elm Street
Estates and was supported by Mr. Pogalz. Motion carried 5 -0.
C. CONTINUED PUBLIC HEARING, for Conditional Use Permit/Planned Unit
Development/Preliminary Plat for Marshan Townhomes 2 "d Addition, a 23 -unit
medium density residential development, NE corner of Lake Drive and Aqua
Lane
Chair Rafferty reopened the public hearing at 6:37 p.m.
Staff stated applicant has requested a conditional use permit for a residential planned unit
development (PUD), and development stage plan (preliminary plat). The subject site is
four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to
the existing Marshan Lake Condominiums. A PUD is required for multi- family
development in a shoreland area. The site was zoned to R -3 earlier this year, making it
consistent with the comprehensive plan.
Staff presented its analysis and recommended approval subject to the following
conditions:

1. Additional right -of -way shall be dedicated to Anoka County to total 60 feet from
centerline for Lake Drive (CSAH 23).
2. Right -of -way access shall be dedicated to Anoka County along CSAH 23 on the
final plat.
3. New plans showing the extended driveways and guest parking stalls shall be
submitted three weeks prior to City Council consideration of the application.
Plans must show landscaping, grading, and any other alterations needed to
accommodate the changes.
4. A new landscaping plan shall be submitted with the following changes three
weeks prior to City Council consideration of the application:
-change black ash to green ash or a native oak species
-change Colorado spruce to white spruce
-change Austrian pine to red or white pine
-change autumn applause to northern pin oak
-three spruce at the Aqua Lane corner shall be relocated and other landscaping
adjusted to accommodate the guest parking stalls.
5. The new plans must include larger individual unit lots to ensure that the eaves and
any building projection meets the property line separation to meet fire protection
requirements in the building code.
6. The City Engineer's comments in the July 9, 2004 memo must be met to his
satisfaction.
7. Park dedication shall be $28,770.
8. Existing buildings on the site shall be removed.
9. The existing well and onsite septic system shall be properly abandoned.
10. Brick veneer base shall be included on all four sides of the buildings.
Mr. Ryden asked if the City favored Option A. Mr. Smyser replied Option A was the
preferred option to go with.
Mr. Root asked if the guest parking would be sufficient. Mr. Smyser replied he believed
it would.
Chair Rafferty inquired if the proposed location of the parking spaces was the best area to
locate them. Mr. Smyser replied the proposed location was the best place for the parking
spaces.

Mr. Pogalz asked if the trees would survive the demolition and/or grading process. Mr.
Smyser replied some of them would survive, with others being somewhat marginal. He
noted they would have to be careful.
Mr. Pogalz expressed concern that they were planning around trees that might not
survive. Mr. Smyser replied the City Forester and Environmental Board recommended
saving those trees.
Chair Rafferty invited the public to make comment.
Jim Crawford, 614 Aqua Circle, President of Marshan Lake Condominium Association,
stated they had three concerns including the guest parking on the west side of the
property, and they might have problems with visitors or residents parking their vehicles
in their guest parking spots, giving them a policing problem. He stated they would have
no control with another association parking in their parking spots. He expressed concern
about vision at the stop sign at Lake Drive. He noted the angle of Lake Drive would
create vision problems. He expressed concern about the stub street on the northern edge
of the property. He asked if they could attach a condition so half of the stub street could
be deeded to his association because they needed to use the stub street. He noted half of
the street could be blocked off to their residents, if there was no agreement.
Mr. Pogalz asked if option 3 might work better for site lines with respect to traffic. Mr.
Crawford replied option 3 was acceptable if they could address guest parking.
Ron Fuchs, representative of applicant, Hokanson Family Partnership, 9174 Isanti Street
N.E., Blaine, stated they would be receptive to redesigning the guest parking spaces.
However, he pointed out the existing Marshan Association could also park in their
spaces, giving them policing issues. With respect to trees, they would attempt to save all
of the trees noted on the plans. He stated they would like to keep the two color schemes
as originally proposed, but they would be receptive to adding a number of different color
configurations. He stated the park had been designed to the City's request. He indicated
with this new proposal, they should receive some park dedication credit back, but they
realized they still needed to pay some park dedication and they were working on this with
staff. He summarized various methods of how they could determine the park dedication
for the Board. Chair Rafferty said he would need to work with staff on the park
dedication.
Mr. Tralle stated in all of the scenarios of the options, only one showed additional
parking — Option A. He noted the Board had made it clear that they wanted guest parking
spaces and they were not shown on the other options. Mr. Fuchs replied that option A
was what they were requesting and it complied with the Ordinance.
Chair Rafferty stated he believed one of the other alternatives might be a better solution.
Mr. Tralle stated the Board had asked for something and they had not come back with
what was requested. He noted that not including what they asked for in alternate 1, 2,
and 3 was a problem. He asked where they were going to put the additional parking with

• those alternates. Mr. Fuchs pointed out where the additional parking could be placed in
those alternatives.

Ms. Lane stated it came down to how strongly they wanted to preserve the trees. She
noted if they used alternative 3, they could not preserve the trees.
Mr. Pogalz stated he agreed with Mr. Tralle. He indicated he was in favor of alternate 3,
because it was the cleanest of the proposals for site lines and it inserted guest parking
throughout the site instead of at one end. He stated he did not believe the trees would
survive the construction anyway in alternate 3.
Mr. Fuchs stated the proposal with the additional parking spaces substantially exceeded
the Code. He requested they consider their preferred option A because it met all of the
City requirements and it provided the separation needed between the two associations.
Mr. Hyden stated he concurred that alternate 3 was the appropriate option to look at.
Mr. Pogalz noted with option 3, he believed there would be less asphalt and therefore less
cost for the development.
Mr. Tralle inquired about the stub street concern raised. Mr. Fuchs stated their proposal
did not access the existing drive and at this time, they did not propose to access that stub
street. He noted they had had no discussions with Marshan Lake Townhomes and how
they desired to deal with this. He stated they were not proposing to block the access.
Chair Rafferty asked if there was any advantage to keeping the road, or would they be
willing to deed it to the other association. Mr. Fuchs stated he did not have an answer to
that question tonight.
Ms. Lane made a MOTION to close the public hearing at 7:37 p.m. and was supported by
Mr. Root. Motion carried 5 -0.
Mr. Pogalz asked what the approval was going to be for, option A or alternate 3. Chair
Rafferty replied he understood this decision was up to the Board.
Chair Rafferty asked if the developer was in agreement with the conditions as outlined by
City staff. Mr. Fuchs replied they were aware of all of the conditions and agreed with
conditions 1 through 6, they did not agree with 7, they agreed with 8 and 9, and condition
10 they had already addressed on the revised plan.
Chair Rafferty asked staff how they should address condition number 7. Mr. Smyser
replied the Board's recommendation was appropriate, but it would be up to the City
Council to make the final decision. He stated it was not unusual, however, to have a
disagreement on park dedication.
Ms. Lane stated with alternate 3, they had not seen a drawing as to where the guest
parking was going to be located and she wanted to see a plan prior to approving the
development.

Chair Rafferty asked Mr. Hokanson to come forward. He asked him if they could make
alternate 3 work with the additional parking. Mr. Hokanson replied alternate 3 was not a
good alternate. He stated when he was at the meeting last time, he had not received good
direction from the Board. He stated if the Board wanted to change the development,
alternate 1 was the best option. He stated with alternate 1, they could get additional
parking. He noted it was his misunderstanding that they wanted parking shown in
alternates 1, 2, and 3.
Mr. Tralle stated a lot of time was put on a four -color scheme and he appreciated that
they had brought in a four -color scheme proposal tonight. He noted, however, he was not
happy that they had not addressed the guest parking on the alternatives. He asked if they
could table this to the next meeting.
Mr. Hokanson stated he wanted a decision tonight because of the timing. Mr. Smyser
replied the Board still had time if they wanted to continue this to the next meeting.
Chair Rafferty stated if the Board chose an alternate, it might not be the alternate they
want. He noted they could move forward to Council with a negative or positive from the
P &Z Board. He requested they look at alternate 3 and add parking so they could actually
see the plan and asked if they be willing to agree to continuing this to the next meeting.
Mr. Hokanson replied they were not opposed to alternate 3 and they would add parking to
that plan and agree to a tabling.
The Board discussed various options as to how alternate 3 could be reworked that would
address the Board's concerns.
Mr. Pogalz noted he did not care how much parking there was, as long as it was
sufficient. He indicated they had not said the development needed 18 spaces and if less
spaces fit well, they needed to look at that. With respect to the color scheme he wanted
the colors to fit with the rest of the area.
Mr. Tralle stated he would be in agreement if each road had a different color scheme, but
he was opposed to the entire development having one color scheme. Mr. Hyden agreed.
Mr. Hokanson asked for a little more leeway with the color scheme. Chair Rafferty
stated he would look at the color schemes provided to staff and would work with Mr.
Hokanson on this issue.
Mr. Pogalz made a MOTION to table this to the August, 2004 P &Z Board meeting and
was supported by Mr. Tralle. Motion carried 5 -0.
Mr. Pogalz stated he or any other Board member would be willing to meet or talk with
Mr. Hokanson prior to the next meeting if he had any questions about what the Board
was directing.
D. Variance to Side Yard Setback, 6396 Langer Lane, Bacchus Homes

Staff stated on November 13, 2003 the City of Lino Lakes issued a single - family home
new construction building permit to Bacchus Homes, Inc. for 6396 Langer Lane (Lot 22,
Block 2 of Clearwater Creek 5t1 Addition). The survey submitted with the building
permit application on November 5, 2003 indicated the required 5 -foot side setback for the
attached accessory structure (garage) as is required by the City of Lino Lakes Zoning
Ordinance. The permit was issued based on this proof of compliance with the zoning
code requirements.
Staff noted the City of Lino Lakes requires all new construction to submit an "As- Built"
survey verifying that the structures are built to the approved specifications. In the case of
the subject property, the "As- Built" survey indicated that the attached accessory structure
(garage) had actually been built to a 3.9 -foot side setback rather than the 5 -foot side
setback as required by the City of Lino Lakes Zoning Ordinance.
The applicant is now requesting that a variance of 1.1 feet be granted from the ordinance
requirement.
Staff presented their analysis and recommended approving the variance.
Mr. Hyden asked how this happened. Mr. Smyser replied the builder made an error.
Mr. Studenski stated this had happened in the past and the building inspectors had
stepped up their inspections to find these errors in time.
Mr. Hyden made a MOTION to recommend approving the variance to side yard setback,
6396 Langer Lane, Bacchus Homes and was supported by Mr. Pogalz. Motion carried 5-
0.
VI. DISCUSSION ITEMS
A. Temporary Signage, Review of Special Meeting
Staff summarized the special P &Z meeting on June 16 to discuss temporary signage. He
stated the P &Z Board needed to discuss what types of temporary signage they want to
regulate, the definitions of temporary signs, banners, etc., the allowable location(s) for
temporary signage, the allowable size (including if a temporary sign should be included
in the maximum amount of signage allowed), the allowable time limit for temporary
signed (if any), and the enforcement.
Mr. Root stated there was a couple of ways they could look at this, one was the
temporary signs such as realtor signs, garage sales signs, etc. and the temporary signs that
were there for a longer period of time. He agreed signs should not be attached to utility
poles and they should be limited in height. He stated signs that were on -site, should be
limited to a total area limitation, including signs that are permanently affixed or truly
temporary. He stated if a temporary sign was fixed to the building, it should be
considered a permanent sign. He agreed they did not have sufficient staff to monitor
violations, but believed this could be handled on a complaint basis. He noted this was
going to be a tough issue to deal with to balance between the aesthetics and the needs and

desires of the business community and others. He expressed disappointment that they did
not have more businesses attend the meeting to hear more comments.
Mr. Hyden requested getting another copy of the summary sheet of other cities that had
been prepared previously. He said it was tough to control what businesses wanted to do
on their property and they had a right to advertise. However, he believed signs should be
fixed to the property and the number of temporary banners should be limited to a time.
He stated signage in windows was a non -issue because they were attached to the
building. He stated he agreed with the 32 square foot signage. He stated advertising was
a very important aspect for a successful business and it was important to let businesses
advertise. He stated he believed they needed to address signs that were in the right -of-
way, on telephone poles, stop signs, yield signs, and tattered old signs. He stated he did
not want to limit garage sale signs, or make the resident get a permit, but he believed the
size and height of the sign should be limited. He noted ultimately, they wanted
commerce to be successful and the City should invite businesses into the City. He stated
he did not want to see the restrictions get too tight because it was important not to
discourage businesses from coming into the City.
Ms. Lane stated she was not at the special meeting, but she was disappointed that only
two businesses had attended. She stated they should have some representative task force
to look at this though.
Chair Rafferty stated he did not want this to be micromanaged and believed signs of a
permanent basis were to be encouraged. He stated he would also like to receive a copy of
the summary Mr. Smyser had previously prepared.
Mr. Tralle stated he agreed partially with Mr. Hyden. He stated just because a business
owned a property, did not mean they can fill it up with banners. He stated there was an
option to hire a part-time enforcement officer as the City of Ramsey was proposing to do.
Chair Rafferty asked what was staffs recommendation. Mr. Smyser replied they would
have something put together for the Board to discuss at their next meeting.
Chair Rafferty suggested staff and the Board members take pictures of what they liked
and did not like with respect to signage on properties.
B. 2004/2005 City Council Goals
Staff stated in May, 2004 the City Council held a goal setting session to determine the
High Priority Goals for 2004 -2005. The Council at their June 14, 2004 meeting adopted
the seven goals. Each of the goals includes a specific Management Action Plan (MAPs)
for pursing implementation. The MAPs identify specific performance, objectives,
schedules, methodologies, and action plans. They also identify operating and capital
budget requirements. He noted it would be likely the P &Z Board will be heavily
involved in several of the key action steps identified for implementation.

Mr. Tralle asked if there were any plans for bike trails along Lake Drive. Mr. Grochala
replied there were not plans for an immediate trail, but this was being looked at for the
future.
Chair Rafferty asked what does review the comp plan mean. He expressed concern as to
where it was going. Mr. Grochala replied this has been a hot topic with Council for quite
a few months. He stated it was the Board's responsibility to review comp plan changes
and it was a concern whether or not to involve the P &Z Board or have Council and staff
work on any changes. However, this would limit the public's involvement if they did
that. He stated it was their intent to put a comprehensive list together and present this to
the Board and City Council for their input.
Chair Rafferty stated he was disappointed they had the issue of reinventing the wheel
going on again. He noted the citizen's input should be for 2008 and not revise the current
comp plan. He stated they needed to move forward and not keep going backwards. He
stated staff had done their job in getting the comp plan approved and his comments were
not a reflection on them. He stated he was disappointed as a taxpayer that they were
reinventing the wheel again. He noted the problem was that they could not even get to
the review process with the City Council, the P &Z Board, and staff and that was what
was wrong.
C. Proposed Schwan's Relocation
Staff stated Schwan's had indicated they were interested in relocating their existing
facility on Lake Drive and expanding into a new facility in the Marshan Lake Industrial
Park. He noted Schwan's is seeking guidance as to compliance with the city's existing
ordinance for delivery vehicle parking/exterior storage.
Staff reviewed their code analysis and indicated the issue of parking trucks outdoors in
commercial and industrial areas and the applicability of exterior storage requirements has
been raised several times in the past. The 2003 Zoning Ordinance update did provide
some additional clarification to the issue. However, the discussion and modifications
made related primarily to semi - trucks and trailers. He noted it was staff's opinion that
the proposed Schwan's delivery trucks would not be considered exterior storage.
However, any site development for the proposed use would need to comply with
screening requirements. Schwan's has indicated they are working on a site design that
screens the parking area from I -35W.
Staff stated the City's Economic Development Advisory Committee (EDAC) discussed
the issue at its July 1, 2004 meeting and recommended support for the Schwan's project
in the Marshan Lake Industrial Park with proper screening.
Staff indicated they would like comments from the Board on this issue.
Chair Rafferty asked if they could put in some type of garage structure where it would be
enclosed away from the elements. He stated he liked their concept, but would like to see
some type of a garage structure to enhance the property. He expressed concern about
freestanding garbage structures also.

Mr. Pogalz agreed that landscaping could be sufficient screening. He stated he did not
see any reason they could not work forward with Schwans on this. He stated he did not
want the company to leave the City. He stated the cost to add a garage might be too
excessive.
Mr. Root stated he agreed the trucks could be screened appropriately with landscaping.
He expressed concern about the City being too specific for this business though and they
needed to look at this carefully. He suggested they change the language to make it more
specific.
Chair Rafferty suggested looking into the possibility of putting in a berm for screening
also. He agreed a garage might not be economically feasible.
Mr. Tralle stated this was an industrial park and this type of business belonged in this
area and not where they were presently located. He stated people would have to accept
that they would see part of these businesses. He believed Schwans would be a great
addition to the industrial park and he wanted to keep them in the City.
VII. ADJOURNMENT
Mr. Hyden made a MOTION to adjourn the meeting at 9:45 p.m., and was supported by
Mr. Pogalz. Motion carried 5 -0.

TOPIC: Final Plat: Marshan Estates
BACKGROUND
Marshan Estates is a 5 lot residential subdivision located adjacent to the existing Marshan
Lane. The project also includes six outlots which are intended to be deeded to adjacent
property owners to correct ambiguities in existing property descriptions. The City
Council approved the preliminary plat 04 -32 on March 8, 2004. On July 26th, 2004 the
City Council approved the development agreement for the subdivision and ordered the
extension of sanitary sewer and water infrastructure to service the development.
The final plat conforms to the approved preliminary plat. The title commitment for the
property has been forwarded to the City Attorney for review. As required under the
conditions of preliminary plat approval the developer has provided a 10 foot
pedestrian/bicycle easement along Lot 1, Block 1, adjacent to Lake Drive as well as a 20
foot conservation easement adjacent to County Ditch No. 10. All park dedication,
securities and fees have been submitted. All other conditions of approval will be met
with building permit review of the new houses.
OPTIONS
1. Approve the final plat for Elm Street Estates.
2. Return to staff with direction.

2) Materials and equipment currently being used for
construction on the premises.
c. Within an industrial zoning district, the exterior storage of semi-
trailers accessory to the principal use may be allowed by conditional
use permit according to Section 8, Subd. 1 and Subd. 2. Semi - trailers
connected to semi - tractors queuing for loading or unloading shall be
considered truck parking and be exempt from the outdoor storage
conditional use permit.
Section 8., Subdivision 1.I.5 of the Zoning Ordinance regarding Conditional Use for
Open and Outdoor Storage stipulates the following:
Open and outdoor storage (not outdoor sales lots) as an accessory use provided
that:
a. The storage area is landscaped and screened from view of
neighboring uses, residential zoning districts, and public rights -of-
way per Section 3, Subd. 4.Q of this Ordinance.
b. Storage area is fenced in a manner approved by the City.
c. Storage area is blacktopped or concrete surfaced unless specifically
approved by the City Council.
d. All lighting shall be in compliance with Section 3, Subd. 4.F of
this Ordinance or other lighting standards in place at the time of
project approval.
e. The storage area does not take up parking space or loading space
as required for conformity to this Ordinance and not in front yards.
f. The property shall not abut property zoned for residential, rural, or
business use, including land in a neighboring city. "Abutting"
includes across a street. "Abutting" does not include properties
that touch only corner to corner.
g.
The property shall not abut I -35W or I -35E.
h. The storage area shall not abut a school or a public park.
i. The ratio of storage area to building footprint shall not exceed
3.5:1.

applicability of exterior storage requirements has been raised several times in the past.
The 2003 Zoning Ordinance update did provide some additional clarification to the issue.
However, the discussion and modifications made related primarily to semi - trucks and
trailers.
While the definition of exterior storage includes "vehicles" the exterior storage
requirements in Section 3., Subdivision 4.P.2 states in part that "Semi- trailers connected
to semi - tractors queuing for loading or unloading shall be considered truck parking and
be exempt from the outdoor storage conditional use permit ".
Therefore it is our opinion that the proposed Schwan's delivery trucks would not be
considered exterior storage.
However, any site development for the proposed use would need to comply with
screening requirements. Schwan's has indicated they are working on a site design that
screens the parking area from I -35W.
The City's Economic Development Advisory Committee (EDAC) discussed the issue at
its July 1, 2004 meeting and recommended support for the Schwan's project in the
Marshan Lake Industrial Park with proper screening.
Staff would like comments from the board on this issue. We anticipate the need to
review and revise the ordinance language to avoid any further ambiguity.

TOPIC: Final Plat: Crystal Cove
BACKGROUND
The City Council approved the preliminary plat for Crystal Cove with Resolution 03 -141
on September 8, 2003. This project involves developing Outlot B of Highland Meadows
East, which is on the south side of 79th St. just west of Lake Drive.
The final plat conforms to the approved preliminary plat. The development agreement is
in progress and will be completed prior to City Council review. The City Attorney's
review of the title commitment is underway and will be fully resolved prior to City
Council consideration of the final plat. Conditions of approval will be addressed within
the development agreement.
One additional issue requires resolution. An easement is needed on property to the south
for a utility connection. This easement must be obtained with a deed from the adjacent
property owner. This deed must be submitted for review prior to City Council review.
We normally would require completion of this prior to P & Z review. However, this can
be dealt with before approval by the City Council.

BACKGROUND
Hokanson Development has submitted a request for a conditional use permit for a
residential planned unit development (PUD), and development stage plan (preliminary
plat). The subject site is four acres of property at the northeast corner of Lake Drive and
Aqua Lane, adjacent to the existing Marshan Lake Condominiums. A PUD is required
for multi - family development in a shoreland area. The site was rezoned to R -3 earlier
this year, making it consistent with the comprehensive plan.
The P & Z opened the public hearing at the June 9 meeting, continued it to July and then
closed the hearing. The application then was tabled to the August meeting to allow the
applicant to make design changes.

The existing Marshan Lake Condominiums were approved in 1995, with the second
phase approved in 1996. They were built at a density of 6.4 units /acre, in accordance
with the approved site plans. The City began work on a new comprehensive plan in
1996 -97 and approved it in 2002. The entire Marshan Lake Condominiums site and the
remaining four -acres now proposed for development is guided Medium Density
Residential. This allows a density of 3 -6 units per acre. The project falls within this
range.
Zoning: The four -acre site recently was rezoned to R -3, Medium Density
Residential to make it consistent with the comprehensive plan.
The site is within a shoreland overlay district. The specific requirements relative to the
proposed project are discussed below under "Preliminary Plat /PUD ". The shoreland
ordinance requires a PUD for multifamily development in a shoreland overlay area.
Growth Management: The City's growth management policy (Ordinance 01 -03)
implements growth policies of the comprehensive plan. It establishes limits on the
number of new units to be approved as well on the use of MUSA reserve. The site is
within the existing MUSA, so the MUSA reserve limit is not applicable
The 147 units per year have been reached for 2004 and the allowable 20% also has been
used (see attached table). As of the July 26 City Council meeting, 133 lots have been
approved for 2005, so there are lots available. However, this project will push into the
discretionary 20% for 2005. Other projects listed in the table as "proposed" will push
even further into the 20 %.
PRELIMINARY PLAT/PLANNED UNIT DEVELOPMENT
Section 2, Subd. 10 of the zoning ordinance discusses the purpose of a planned unit
development (PUD). The application should be compared to these purposes in order to
justify any flexibility requested by the applicant.
• Purpose and Intent. The purpose of this section of the Zoning Ordinance is to
provide for the grouping of lots or buildings for development as an integrated,

coordinated unit as opposed to traditional parcel by parcel, piecemeal, or
sporadic approach to development. This section is intended to introduce
flexibility of site design and architecture for the conservation of land and open
space through clustering of lots, buildings and activities, which promote the
goals outlined in the Comprehensive Plan or serve another public purpose. It
is further intended that planned unit developments are to be characterized by
central management, integrated planning and architecture, joint and common
use and maintenance of parking, open space and other similar facilities, and
harmonious selection and efficient distribution of uses.
A residential conditional use permit PUD may include a variety of residential
units, including single family and multifamily units as long as it complies with
the density requirements. A non - residential conditional use permit PUD may
include a variety of commercial and /or industrial uses. A PUD that includes a
mix of residential and commercial /industrial uses must utilize the PUD zoning
district as described in Sec. 9 Subd. 3 of this ordinance.
The PUD, by allowing deviation from the strict provisions of this Ordinance
related to setbacks, heights, lot area, width and depths, yards, etc., by
conditional use permit or a mixture of uses by rezoning to a PUD District, is
intended to encourage:
• 1. A development pattern in harmony with the objectives of the
Comprehensive Plan.
2. Innovations in development that address growing demands for all styles of
economic expansion, greater variety in type, design, architectural
standards, and siting of structures through the conservation and more
efficient use of land in such developments.
3. The preservation and enhancement of desirable site characteristics such as
existing vegetation, natural topography and geologic features and the
prevention of soil erosion.
4. A creative use of land and related physical development which allows a
phased and orderly transition of varying land uses in close proximity to
each other.
5. An efficient use of land resulting in smaller networks of utilities and
streets thereby lowering development costs and public investments.
6. Promotion of a desirable and creative environment that might be prevented
through the strict application of City zoning and subdivision regulations.

the north side of the project site and all units front on private access drives. The proposal
still includes eleven buildings. Ten buildings are twin homes, the other is a three -unit.
They are all two -story structures. Each unit includes 1633 sf. The garages are similar in
size to other recently approved PUD projects.

won't meet the open space or impervious surface requirements. The guest parking now is

We received building elevations on July 7th. They show a light brown vinyl siding with a
darker brown vinyl shake in the gable ends. A dark brown brick veneer base is shown on
the front of the buildings, though none on the sides or backs. At the July 14 P & Z
meeting, the applicant agreed to brick around all four sides of the buildings and submitted
revised elevations showing this.
Structure Setbacks: We have been experiencing confusion among builders due to the
adoption last year of the International Building Code. Fire protection requirements in the
code dictate a minimum structure separation from property lines unless the structure
includes specified fire protection elements. To meet the code requirements, the furthest
projection must be at least three feet from the property line or special fire protection
requirements apply. This would include no openings such as windows or soffit vents.
Lino Lakes has made the decision that the building must meet the three -foot separation
from the actual property line of the unit rather than outer border of the larger common
area property line. This includes the sunrooms on the rear of the buildings. The
individual unit lots must be platted deep enough to ensure that this three foot separation is
met. This must be shown on the final plat.
Streets, Access: The plan shows additional right of way to be dedicated for Lake
Drive (CSAH 23). This would meet Anoka County's requirement for 60' from
centerline.
Access to all buildings would be via private drives off of Aqua Circle. The drives are 24
ft. wide, back of curb to back of curb. The Century Farm North project has the same
design for the townhome access drives. The existing Marshan Townhomes have wider
access drives: 28' back of curbs. The proposal is acceptable.
The P & Z recommended a new layout at the July 14 meeting. A new preliminary plat
received July 30 shows that layout.
At the request of the P & Z, I contacted the Fire and Police Depts. to ask if the length of
the driveways in the existing development has created any public safety concerns. The
Police Dept. said there have been no problems from their perspective. The Fire Chief
also informed me that there have been no problems. Since the existing townhomes used
this design, he had no concern. Though the new proposed driveway is even longer than
the existing ones, the Aqua Lane and Lake Drive are close enough to provide access in
addition to the driveway itself. For future new development, we probably should
consider turnaround areas on drives of this length.
Guest Parking: The P & Z desired that guest parking spaces be added, even though
this would reduce the open space and increase the impervious surface area. The applicant
has included guest parking stalls in the revised plans. The drive /parking areas would still
be at least 10 feet from the new right of way of Lake Drive and from Aqua Lane. The
proposed alternative is workable. Grading and landscaping must be adjusted to

accommodate the change. A new set of plans that includes this design must be submitted
three weeks prior to city council review.
Utilities, Stormwater Management: There is no ponding or treatment included in
the proposal. The existing stormwater management design for the area accommodates
development on this site. However, stormwater treatment must be provided in
accordance with the most recent regulatory requirements. This will be reviewed in
greater detail as the project progresses.
The Rice Creek Watershed District requires District review for multi -unit development
over 2.5 acres. The Watershed District granted preliminary approval on June 23.
There was some uncertainty about the existing utility stubs and their adequacy for this
project. On July 29, the applicant and City Engineer determined what exists and what is
needed by excavating on the site. There was not adequate time for the applicant to
prepare a new utility plan. However, we know what is necessary and it should not be
difficult to prepare a plan. Staff is comfortable that this can be accomplished for City
Council review.
Landscaping: The existing townhomes screen this site from the lake, so
screening is not an issue as it might be for lakeshore property. The proposed landscaping
is adequate. Several species were changed according to the Environmental Board's
recommendations. However, Colorado Spruce must be changed as well. This is listed in
the conditions of approval.
Lighting: No street or yard lighting is shown on the plans. There is no reason to
provide any such lighting.
Park Dedication: The following information was discussed at the July 14 meeting
and is reiterated here. The applicant has maintained that land dedicated with the larger
development included the dedication for most of the current four -acre site. Staff has
researched the file for the Marshan condominiums project. The situation is complicated
because there is some, but not complete overlap of the two project areas, the original
project was not completely built, and the ordinance requirements for park dedication have
changed.
The 1995 project included 29.9 acres. A total of 139 units were approved for the project.
The density then was 139/29.9 = 4.65 u/a.
Part of the site included an area of 1.5 acres labeled "future commercial" in which no
dwelling units were shown. One 5 -unit building did not get built, as it was on land not
ultimately platted as part of the project. Both of these areas are within the four -acre site
of the current proposal.
At the time, the subdivision ordinance included a progressive scale: the percentage of
land for park dedication increased as the density of a project increased. (This was

adopted with Ordinance 05 -91.) A density of 3 to 5 units per acre required a park
dedication of 12% of the land. Twelve percent of 29.9 acres is 3.6 acres. The developer
dedicated a 3.0 acre park and a trail corridor of 0.6 acres, for a total of 3.6 acres.
Current park dedication is $1665 per unit when land is not needed. For the 23 units
currently proposed, this would total $38,295.
The developer maintains that he should not be charged dedication for the 1.5 acres
"future commercial" area or for the area where the five units didn't get built.
It is reasonable to give credit for the five units that did not get built, and staff
recommends doing so. This reduces the dedication by 5 x $1665 = $8,325 .
However, it is not appropriate simply to give credit for the 1.5 acres by completely
eliminating it from any new dedication. There were no units shown in that area on the
1995 plan. Though the land was included in the calculations for the original project, the
additional units were not. Removing the 1.5 acres from consideration for additional
dedication would be like not charging park dedication for new units being built in the
spaces between the existing buildings.
(There are 11 units in that area on the new proposal. Had there been another 11 or 12
units there, it would have raised the density of the 1995 project to 5+ units /acre, which
would have required a 14% park dedication (139 + 11 = 150 and 150/29.9 acres = 5.02
u/a). This would have required a dedication of 29.9 acres x 14% = 4.19 acres. Since 3.6
acres was dedicated, there would have been a shortage of 0.59 acres of park dedication.)
It is appropriate to get additional park dedication since the additional units generate
additional demand for park services. It also is reasonable to consider giving some credit
for the past park dedication on the 1995 project.
The ordinance at the time included an equation for calculating cash dedication. It used a
land value of $10,000 per acre. This seems reasonable. The project density fell into the
12% park dedication category. Applying this to that land value yields 1.5 acre x $10,000
= $15,000. $15,000 x 12% = $1800. This is a reasonable credit for the past dedication.
Summarized, this all results in the following:
23 new units x $1665 = $38,295
less credit for 5 units: 5 x $1665 = ($8,325)
less credit for past dedication on 1.5 acres = ($1,800)
total new park dedication $28,170
Staff recommends a park dedication of $28,170 for the new project.

ENVIRONMENTAL BOARD
The Environmental Board reviewed the application on May 26th. The comments are
attached. Changes to species that were not done on the July 30 landscaping plan are
included in the conditions of approval. Inspection of imported soils is required by
development agreements. Irrigating the sod areas is listed in notes on the landscaping
plan.
CONDITIONS OF APPROVAL
The following conditions should be attached to any approval of the project:
1. Additional right of way shall be dedicated to Anoka County to total 60 feet from
centerline for Lake Drive (CSAH 23).
2. Right of access shall be dedicated to Anoka County along CSAH 23 on the final
plat.
3. A new landscaping plan shall be submitted with the following changes three
weeks prior to City Council consideration of the application:
- change Colorado spruce to white spruce
4. The final plat must include larger individual unit lots to ensure that the eaves and
any building projection meets the property line separation to meet fire protection
requirements in the building code.
5. A revised preliminary utility plan and preliminary grading must be prepared and
submitted three weeks prior to City Council consideration of the application. The
previous submittals are void due to the revised layout of the project. The City
Engineer's comments in the July 9, 2004 memo and the August 6 memo must be
met to his satisfaction.
6. Park dedication shall be $28,170.
7. Existing buildings on the site shall be removed.
8. The existing well and onsite septic system shall be properly abandoned.
9. Brick veneer base shall be included on all four sides of the buildings.
10. The project shall not be final platted until 2005 to comply with the growth
management policy.

Engineering Reviews for this proposed development were previously prepared and presented in
memorandums dated December 5, 2003, June 4, 2004, and July 9, 2004.
A revised Preliminary Plat and Landscape Plan (both dated July 30, 2004) have since been received. A field
utility locate was also performed on July 30. This review memorandum as presented herein essentially
repeats much of the same information presented in the July 9, 2004 memorandum, along with adjustments as
a result of the revised documents received.
•Comments are as follows:
1. All outstanding and remaining conditions stated in the July 9, 2004 Memorandum must be addressed
and completed. This would include the submittal of a revised utility plan.
2. Per the previous review comments, a revised utility plan must be received.
3. The property is adjacent to the Anoka County Roadway. Therefore, the Preliminary and Final plats will
require the review of the County. An additional dedication of 15 feet to the County right of way is
shown as required. It is not expected that any construction related permits from Anoka County will be
required. However, any side grading into the Anoka County right of way would require a permit.
4. Intersection sight distance requirements provide that no trees or vegetation may be planted within the
County right of way, or at any locations that will restrict corner visibility sight lines. There does appear
to be some plantings proposed within the newly dedicated additional 15 feet, and these should be
eliminated. In addition, a revised utility plan must be submitted to assure that plantings are not placed
over utilities.
5. As stated in the July 9, 2004 review, further approval and/or acknowledgement from the Rice Creek
Watershed District shall be attained as may be required to confirm compliance with the original site
permit.
406. Because the site area exceeds one acre, the development also falls under the new rules requiring an
NPDES permit. The applicant shall be responsible for obtaining this permit. This also includes the
submittal of a Stormwater Pollution Prevention Plan (SWPPP) to the City in accordance with NPDES

requirements. Silt fence and erosion control details are provided on the plans and shall be installed
accordingly.
7. Per the Survey and Existing Conditions Plan previously submitted, several buildings including houses,
barns, sheds, and a garage all exist on the site. Demolition, removal, and grading of the site will therefore
be required. The applicant will be responsible for the complete removal of all buildings, foundations,
underground and above ground items, capping of any existing utility connections and wells, and removal
of any underground, fuel storage or septic systems that may exist. All debris and unsuitable material must
be removed from the site. Any material imported to the site must be approved by the City Engineer.
8. Geotechnical information was previously provided. As previously stated, additional excavation of fine
alluvial silts and replacement with compactable granular material may be required for construction of the
buildings and private drives. Groundwater levels may also necessitate dewatering for the utility
installations. Any imported topsoil, fill material, or granular materials for roadway and building
foundation (material and source) must be approved by the City Engineer.
•
9. The preliminary plat provides for standard drainage and utility easements (10 feet in width) around the
perimeter of the property as required. In addition, 44 foot wide drainage and utility easements covering
the two private driveways are also provided. As previously stated, the driveway easements as shown
shall also be dedicated to include access in addition to the drainage and utility dedication.
10. A revised utility plan must be received for review and approval. A field exploration was conducted on
July 30, 2004 to verify the size and location of the existing utility line extensions to the site. The site
exploration confirms that three sets of sewer and water services ((3) X 4" water services and (3) X
6 "sanitary sewer services) extend from Aqua Circle. As stated in the previous review, the City will not
allow any main line utility extensions from the existing 4" service stubs. The proposed watermain will
therefore be required to connect directly to the existing 12" main, or to a 6" hydrant lead if available
(hydrant would require relocation). The existing 6" stubs can be connected to with 8" lines, provided
that a manhole is installed at the connection point. No sanitary sewer main line cleanouts will be
allowed. All utility extensions and streets /driveways shall be considered private and will not be owned
or maintained by the City of Lino Lakes. This must be detailed in an Agreement between the City and
the Applicant. The utility plan shall also show the specific locations of individual valve boxes and their
service termination points (between street and building). Individual sanitary sewer and water services
must also meet minimum separation distances.

11 As previously stated, all utility work shall be performed in accordance with the City of Lino Lakes, City
Engineers Association of Minnesota (CEAM) Specifications, and City of Lino Lakes building permit
requirements. Water pipe and appurtenances shall meet the requirements of the City of Lino Lakes, and
as follows: Hydrants - Waterous Pacer WB -67; Valves - Mueller A2370 -20 or equal. DIP pipe shall be
Class 52. All sanitary sewer service pipes shall be SDR 26 or Schedule 40. The location and number of
hydrants will be subject to the review of the City Fire Chief. Safety and traffic control during
construction must be provided in accordance with the State of Minnesota Manual of Uniform Traffic
Control Devices (MUTCD).

12. All grassed or swaled drainage ways must have a minimum slope of 2 %.
13. Proposed storm sewer shall be adjusted to extend to the foot of the south driveway to pick up drainage, as
previously expressed.
14. The applicant shall be responsible for obtaining permits from the Minnesota Department of Health and
the Minnesota Pollution Control Agency for the water and sanitary sewer installations as required.
15. All street restoration shall be performed in accordance with the requirements of the City of Lino Lakes.
16. The lighting layout, number of lights, and type of fixture is subject to the approval of the City of Lino
Lakes.

Fox Den Acres
BACKGROUND
Royal Oaks Realty has requested approval of single family residential development called Fox
Den Acres. This is a new submittal of a plan that is different from the previous design reviewed
several months ago. The comprehensive plan guides the site for low density residential use and
it is zoned R -1. The site is in the existing MUSA.
A public hearing is required for a preliminary plat. Unfortunately, staff neglected to publish a
public hearing notice for this meeting. This was an accidental oversight by City staff, for which
we apologize. We will publish the public hearing notice for the September meeting.
We typically do not recommend approval until we receive the preliminary approval by the Rice
Creek Watershed District. We have not received Watershed approval for this project. In
addition, there are some design issues that must be addressed. Therefore, staff would be
recommending continuing the project to the September meeting.
The City soon will approve a new "Parks, Natural Open Space /Greenways and Trails System
Plan." Creating greenways is the first priority of the plan. This will require the use of a variety
of strategies, the most important of which is greater reliance on a conservation development
approach to land development.
The comprehensive plan envisions a conceptual greenway along this south and east edge of this
site. This project could be a good example of conservation development with some minor,
though important revisions. This will require the cooperation of the City, the developer, and the
Rice Creek Watershed District. Staff is discussing with the Watershed District how best to
pursuit a conservation development on this project. The developer is not yet convinced that such
an approach is advantageous or worthwhile.

The majority of the site, the 40 -acre square, is guided for Low Density Sewered Residential land
use (up to three units per acre), is within the stage 1 growth area (pre2010), is in the MUSA, and
is zoned R -1. Although the proposed plat extends beyond the 40 acres, the areas outside of the
40 acres would be used only for stormwater ponding and open space.
The following is a summary of the of the proposal's density:

Growth Management:
MUSA Reserve: The comprehensive plan and the growth management policy establish a
specific number of MUSA acres for residential growth for stage one (prior to year 2010). The
area of the site to be built on is within the current MUSA. No MUSA reserve is needed.
Growth Management, Units /Year: The comprehensive plan and the growth management
policy establish a specific number of dwelling units of residential growth for stage one (prior to
year 2010). The goal is 147 per year. The City Council has the flexibility to exceed the limit by
20% (29 units) in a year without amending the comprehensive plan.
The goal for 2004 has been exceeded and the additional 20% also has been used. This means
that additional new development cannot be final platted in 2004. This applies to this project.
As seen in the table at the end of this report, 133 lots have been approved for year 2005. No
more than 43 lots could be allowed for year 2005 if other applications proceed. The "proposed"

projects are listed roughly in order of application. However, they do not have a right to develop
in 2005 until they receive preliminary plat approval.
Lots: Minimum lot width is 80', minimum lot depth is 135'. All lots meet these requirements.
The minimum lot size in an R -1 zone is 10,800 sf, and this must be contiguous land. There are
several lots with non - contiguous upland areas. It is not clear that these lots would meet the area
requirement without the non - contiguous portion. This must be clarified for Lot 5, Block 1 and
Lot 4, Block 2.
In addition, several lots have house pads squeezed in very carefully. In and of itself, this is not a
problem. However, there are many wetland areas that require drainage and utility easements
around them. The subdivision ordinance requires an easement that extends at least ten feet
beyond a delineated wetland. Several house pads would be within the easement if the easement
were enlarged to meet this requirement. This must be re- examined by the developer on the plans
and the easements enlarged in several areas. For example, Lots 3 and 5, Block 1; Lot 4, Block
2; and Lot 6, Block 4.
As explained below, it would be possible to retain some greenway along the outer edges of this
site and make progress on the creation of a greenway corridor. This may require flexibility on
lot sizes. If the gain to the environment is worth it, lots that are somewhat smaller than the
minimum requirements would be justified flexibility.
Streets, Access, Parking: Fox Road is the only access point for this site. Extending Fox Rd.
as proposed would exceed the maximum cul de sac length of 500' unless a future
outlet /connection is included. Wetland extends to the east and south for more than 1000', so a
road cannot go in those directions. There is no possible additional connection on the west
because the existing homes of Reshanau Lake Estates South 4th Addn. (Hindsight shows that
Deerwood Lane should have been designed to provide a connection to the east at its southern end
instead of curving west into a cul de sac. This is no longer an option, however.)
The 500' radio tower on the north is likely to stay. The proposed road stub to the north of the
plat avoids the tower property. Land to the north of the stub does have on it several
communication facilities such as satellite dishes and the like, but nothing so imposing as the tall
tower. It is possible that a road could extend to the north where pictured if these facilities were
removed in the future. That area includes upland, though it is impossible to know how much
without a delination of that property. A "ghost plat" of the area shows it will be possible to fit in
a road and some lots.
Fox Road leads to Deerwood Lane and West Shadow Lake Drive. Both lead to Birch St.
Deerwood is a local street, West Shadow Lake Drive is a collector which runs from Birch St. to
6211d St., both of which are collectors.
The street names on the plat likely will be changed. Emergency service personnel have
expressed concern on other projects that have similar street names. It makes it difficult to locate
properties in an urgent situation.

Traffic: The developer submitted a traffic study with the previous application for 64 lots.
The original study did not reconize the completion of West Shadow Lake Drive through to 62nd
St. or the reconstruction of 62nn St. The amended study takes into account the current and
planned roadways. The result is that the Birch St. approach and intersection will continue to
operate at a level of service C. With fewer lots, there will be less traffic generated by the project.
Parks, Open Space: The proposal includes 10.98 acres of "green corridor" (Outlot A).
The 1992 park plan does not anticipate a park in this location. The City soon will approve a new
"Parks, Natural Open Space /Greenways and Trails System Plan." Creating greenways is the first
priority of the plan. This will require the use of a variety of strategies, the most important of
which is greater reliance on a conservation development approach to land development. The
draft new open space plan does envision a greenway across part of the site, and leading to Birch
Park to the east. A greenway is a corridor of protected open space managed for conservation and
recreational purposes. The comprehensive plan includes a greenway map (see attached detail).
The City has no automatic ownership rights within areas envisioned as greenways. Greenway
corridors on the map are conceptual and are to be refined through the development review
process.
It would be possible to retain some greenway along the outer edges of this site and make
progress on the creation of a greenway corridor. The proposed plan offers Outlot A. This area
does not offer as much toward preservation open space as would be possible with some creativity
and design flexibility. Staff would prefer pursuing such possibilities. Our park plan consultant
has been communicating with the developer on these possibilities.
The Park Board discussed the project at its May 3rd meeting and recommended only a cash
dedication. The subdivision ordinance includes park dedication requirements. Park dedication is
$1665 per residential unit. The Park Board's view was that the proposed park is marginal land
and can't be used for active park purposes.
Utilities: Sanitary sewer and water service will connect to existing facilities in Fox Road.
Both are adequate to serve the project.
Grading and Stormwater Management: Stogy nwater ponds will be created in several
locations on the site. Some revisions to house pad elevation will be necessary to meet minimum
elevation above groundwater.
The subdivision ordinance requires an easement that extends at least ten feet beyond a delineated
wetland. This must be corrected. Easements also must be platted along all the external property
lines.
The project requires the approval of the Rice Creek Watershed District. This has not been
obtained.

Existing City Easement: The project also proposes the partial vacation of an existing
ponding and flowage easement held by the City. This easement covers most of the land to the
east and south of the site, which comprises a large wetland area. The easement area to be
vacated is on Lots 3 -6, Block 4. The City looks carefully at requests to vacate such easements.
We require that the applicant prove that the easement is not necessary and that the vacation will
have no negative effect. If a revised project design incorporates more greenway preservation,
this easement vacation may not be necessary.
ENVIRONMENTAL BOARD
The Environmental Board reviewed this application on July 28. Recommendations are attached.
The recommendations include pursuing a conservation development, with design flexibility, to
facilitate a greenway corridor along the south and east sides of the site.
OPTIONS.
1. Approve the preliminary plat
• 2. Deny the preliminary plat.
3. Table the item.
RECOMMENDATION
Option 3, and the following issues must be addressed:
A conservation development approach that results in higher quality wetland areas and adequate
greenway buffers around them would be the preferred approach. This would be consistent with
the draft open space plan, the comprehensive plan, and the 1999 handbook for environmental
planning. If this is not going to happen, the project still must address the following:
Minimum lot areas must include contiguous land.
Easements around wetlands must extend ten feet beyond the delineated wetland.
House pads must not be in easements.
Stormwater ponds design and other engineering issues must be revisited.

General
1. The proposed project area is located south of Birch Street and east of Deerwood Lane, at the east
termination point of Fox Road. The total property area is 50 acres. It is proposed to install streets,
sanitary sewer, water, and storm sewer to serve 56 single family residential units. This is a revision
from the 64 units originally proposed. This reduction appears to be from the elimination of units
previously located in Parcel B which is located outside of the MUSA service area.

2. As a result of the plan revision, the site layout, grading, stormwater routing, and utilities have been
adjusted in some locations. Revised drainage calculations have also been submitted.
3. Of the 50 acres, approximately 75% is upland or developable, while the remainder is pockets of
wetlands scattered throughout the property or portions of DNR Wetland No. 565P, which borders the
south and east edge of the properties. According to the information provided, the Ordinary High
Water Level of the wetland is 893.0, and the Flood Zone limits have been indicated on the survey in
accordance with the local Flood Insurance Rate Map, dated May 17, 1982. A ponding and flowage
easement in favor of the City of Lino Lakes (Document No. 595478), corresponding roughly to the
Flood Zone limits, is also indicated on the Plan. A Letter of Map Amendment (LOMA) will
ultimately be required to perform the improvements as proposed.
4. A Resource Inventory Survey has also been prepared for this site. The site is generally undulating
with mixtures of wooded areas, pasture, and wetlands. According to records of a Soil Survey by the
USDA Soil Conservation service, the soils are generally fine sands and fine sandy loarns with the
exception of areas of muck in the vicinity of the lower flood plain areas. A Geotechnical Report as
referenced above has also been provided and provides the following observations of note:

Glacial outwash deposits of fine sand dominate the area.
In the lowland areas, a black organic topsoil has developed, varying in thickness from 1 to
3.25 feet at the test pits. The total thickness of organic topsoil in the lowland areas was not
explored. This should especially be taken into consideration where utilities and roadways
traverse through lowland areas.
c) The majority of test pits and test borings exhibited soil mottling which was used to assist in
determining seasonal high ground water levels.
Grading and Drainage
1. A General Stormwater Discharge Permit, Minnesota Pollution Control Agency (MPCA), will be
required in accordance with the most current requirements of NPDES Phase II and State of
Minnesota regulations. All NPDES regulations and requirements in accordance with the MPCA shall
be adhered to, including submittal to the City of a Stormwater Pollution Prevention Plan (SWPPP).
2. Sedimentation and Erosion Control must be enforced at all times during the course of all grading and
utility work. This includes the establishment of silt fence around all graded and disturbed areas, and
the sweeping of streets on a regular basis, and as directed by the City. As per RCWD requirements,
the grading plan must also be revised to specify inlet protection for the proposed catch basins.
In the event the Contractor does not maintain erosion control as required, any costs incurred by the
City as a result will be withheld from escrows or other monies due. It is strongly suggested that a note
be added to all construction plan sheets (including grading, streets, and utilities) reminding the
Contractor to address erosion control requirements.

3. The Grading Plan indicates that wetlands shall be replaced at a 2:1 ratio per requirements of the
Wetland Conservation Act. The Plans also must be approved by the Rice Creek Watershed District
(RCWD). A permit application has been submitted to RCWD (Permit No. 04 -039, dated March 12,
2004). RCWD has determined the application to be Incomplete, pending the receipt of several
additional items. All requirements of the RCWD must be met.
4. Minimum grades and slopes must be provided and shown on the Plans as follows: 0.5% for streets
(including curb and gutter), and 2.0% for turfed/non -paved areas including all swales and slopes. It
would appear that in some locations, the street is less than 0.5% grade.
5. Proposed house pad information, including floor elevations are provided on the Plans, including
the City's requirements for floor elevations. The minimum lowest floor must be the greater of 2
feet above the HWL, 4 feet above the NWL, 4 feet above the groundwater elevation, and 1-foot
above the emergency overflow. Emergency overflows are shown for the majority of site's
landlocked low areas. However, the emergency overflow location and elevations must also be
clearly shown for all detention areas, including newly constructed infiltration basins and
stormwater detention ponds.
A table providing minimum basement elevations for all properties has been provided. The grading
plan also provides a house pad detail that explains the housing style and proposed finish grade
elevations. It should be noted that the detail specifies that for Walkout homes the finished
basement floor is to be 0.3 above the elevation provided on the grading plan. The table figures do
not reflect this for many of the properties, and should be adjusted accordingly.
At least some of the proposed units do not appear to meet the minimum 4 feet separation from the
NWL and groundwater elevations, based upon the mottling information provided. These include
Lot 3, Block 5; Lot 3, Block 3 and Lots 18 and 19 Block 3. It is strongly recommended that all
house pad elevations again be reviewed and adjusted accordingly.
The Grading Plans shall also specify that all house pads on filled areas shall be designed by a
registered Professional Engineer (per geotechnical recommendations) and approved by the City of
Lino Lakes.
6. A Certified As -built Survey shall be provided by the Developer's Engineer upon completion of
grading, certifying that all grading complies with the Grading Plan. This Certification shall be
required prior to the issuance of any building permits. Final certification that the grading meets City
requirements for adequate drainage and minimum slopes will be required prior to the issuing of
building permits. Percent grades shall be shown on the Plan.
7. Revised drainage calculations and drainage area maps have been received and reviewed.
Comments are as follows:
a) As stated in the previous review, the discharge rates from the proposed 2 -,10 -, and 100 -
year design rainfall events cannot exceed the existing discharge rates. The two year design
as submitted does not meet this requirement. It is recommended that a discharge rate
comparison table be prepared and provided, showing the revised discharge rate
calculations.

8. The outlet structures for Pond 4 and Pond 5 will require adjustment. The Pond 4 structure is not
buildable based upon the elevations provided. For Pond 5, the cover over the outlet pipe is 2
inches. A 6 -inch minimum cover is required per City requirements.
Streets and Trails
1. Access to this property is proposed from only one location, from Fox Road just east of its intersection
with Deerwood Lane. This essentially results in a very large "cul -de -sac" or single point access for
the entire Development. The extension of Fox Road through the property considers further extension
to the north in the future. However, it is unknown at this time when and if such a second access into
the site would happen. Traffic levels of service, safety, and impacts to existing streets and
intersections shall be addressed to the City's satisfaction. Comments regarding the Traffic Study are
provided further in this report.
2. The City's Comprehensive Plan provides for a regional trail linkage between Reshanau Lake Estates
and Birch Park in this area. It is recommended that provisions for the trail link be investigated further
as part of this Development.
3. The street layout as proposed on the Preliminary Plat appears to attempt to limit impacts to existing
wetlands. However, some filling of wetlands is proposed, and mitigation will be required. As
previously mentioned, the Plans shall be subject to the review and approval of the Rice Creek
Watershed District in accordance with the Wetland Conservation Act.
4. Prior to any grading or construction, the street and trail plans shall be further detailed for construction
purposes as required by the City of Lino Lakes. This would include typical street sections, pavement
sections required, street widths, radii, type of curb, etc. As mentioned in comments under Utilities, a
Detail Sheet that includes all applicable City standard plates and additional requirements of the City
must be provided.
5. The cul -de -sac at the north end of the subdivision on Fox Road is not the full size per City
engineering standard requirements(92' diameter). However, it is recognized that this cul -de -sac may
be considered temporary, pending extension of Fox Road to the north at a later date. The cul -de -sac
as proposed may therefore be considered acceptable.
6. At least some of the street horizontal curves do not meet the maximum 30 mph speed limit for
residential streets. This is more of a concern where a street is a through street or carries higher
volumes of traffic. It is recommended that streets be signed (curves, advisory speed, etc.) as may be
needed, consistent with City of Lino Lakes practices.
7. At some locations, the 0.5% minimum street grade does not appear to be attained.
Utility Plan
1. It is proposed to connect sanitary sewer to an existing 10 -inch sanitary sewer stub that extends
easterly from the intersection of Fox Road and Deerwood Drive. As stated on the plan, it is
recommended that the location and elevation of the stub be field verified. The rim elevation for MH
18 appears to be incorrect.

2. It is proposed to connect 8 -inch watermain pipe from an existing stub extending from the intersection
of Deerwood Drive and Fox Road. It is recommended that the size and location of the stub be
verified.
3. Adequate water pressure and circulation into the proposed Development shall be verified by the
Developer, as there is no loop or secondary feed available to serve the Development. A Fire Flow
Analysis has therefore been provided. The Analysis has been reviewed, and the distribution system
proposed is adequate. However, the 6 -inch diameter mains serving the cul -de -sacs must be sized to
8- inches per City requirements.
4. The utility plan as submitted shall be considered preliminary for review and not considered a final
document for construction purposes. Final utility plans shall include the following:
a. Plan and Profile sheets for all sanitary sewer, water, and storm sewer.
b. Notes addressing private utilities, and erosion and sedimentation control must be provided on
the Utility Plan.
c. A note shall be provided on the Utility Plan stating that utility installations shall meet the
requirements of the Standard Specifications of the City Engineers Association of Minnesota
(CEAM) and the City of Lino Lakes.
d. Information shall be provided on the Plans showing the location of individual services for
sanitary sewer and water, including stationing and elevations.
5. The geotechnical report provided is not specific with regards to addressing the installation of
utilities and the streets. It would appear that the soils are generally capable of supporting the
proposed infrastructure with some corrections needed in some areas, particularly at low areas
where wetlands are intended to be filled, and wet and substandard material may be encountered.
The geotechnical report should address this further. In addition, substantial dewatering for
utilities may also be necessary in many locations, depending upon the seasonal level of
groundwater.
6. The Developer shall provide to the City of Lino Lakes a copy of the completed Minnesota
Department of Health (MDH) Permit for watermain installation and MPCA/MCES Sanitary Sewer
Permit, upon completion of the Utility Plans and prior to construction.
7. The Developer shall provide a televised inspection tape of all sanitary sewer pipes upon completion
of the roadway and utilities. Any subsequent cleaning of the sewer pipes after construction shall be
the responsibility of the Developer.
8. The number and location of all hydrants and gate valves shall be subject to the review and approval
of the City Fire Chief.
Trench and roadway compaction shall meet the requirements of the City of Lino Lakes, including
100% of Standard Proctor Density for the upper three feet directly beneath the roadway, and 95% of
Standard Proctor from utility encasement zone to three feet below the surface. As stated in previous
reviews, it is critical that geotechnical information and direction be followed as construction activities

progresses. It is recommended that a geotechnical investigation be conducted, and that a geotechnical
consultant be utilized throughout construction.
10. The Utility Plan is incomplete with regards to storm sewer information, including pipe sizes,
materials, slopes, structure elevations and inverts, etc.
11. The inverts at Manhole (in and out), appear to be 0.10 feet too low, and should be re- checked.
Details
A Detail Sheet must be provided that includes all applicable City of Lino Lakes standard plates. Additional
information shall also be included on the Utility Plans and/or the Detail Sheet as follows: Gate Valves shall
be Mueller A- 2370 -20 with mechanical joints, meeting AWWA Specifications C500 -61. Valve Boxes shall
be Mueller H -10357 with H -10361 drop lid, and extensions shall be Mueller H- 10363. Hydrants shall be
Waterous Pacer WB -67 with a bury depth of 8' - 6 ". Services shall be Type "K" copper with Mueller H-
15000 corp stop. Curb stop and curb box shall be Mueller H -15154 Mark 2 oraseal, and Mueller H -1300
w/Mpls. Top. Storm sewer details and standard plates (including structures and outlets) shall also be
provided.
Traffic
A Traffic Report for Fox Den Acres has been prepared by TDI, March 2004. The Report was subsequently

amended in a TDI Memorandum dated April 14, 2004. The Report was also revised in a Memorandum
dated July 29, 2004 to reflect the reduction in the proposed number of residential units from 64 to 56. The
report essentially addresses expected impacts to Deerwood Lane, the intersection of Deerwood Lane with
County Road 10, and impacts to newly constructed West Shadow Lake Drive and 62nd Street.
Regarding the intersection of County Road 10 and Deerwood Lane, the report states that the Level of Service
(LOS) of the Deerwood Lane northbound approach currently operates at LOS C and will continue to operate
at LOS C under the year 2009 no -build scenario.
In summary, the expected traffic impact on access points and the surrounding neighborhood streets is
expected to be minimal as a result of added traffic generated by Fox Den Acres.
Other Issues
In accordance with City requirements, a Landscaping Plan shall be submitted. The Tree Preservation Plan
shall be subject to further review and approval of the City.

The Environmental Board met on July 28, 2004 and made the following
recommendations:
Fox Den Acres
Carried forward from March 28th Environmental Board review
• That the development be considered as a PUD and /or Conservation
Development that would allow for a variety in lot sizes and street widths.
• Suggest that the developer work with the Saddle Club site, or look at purchasing
the Saddle Club site, for developing with the Fox Den Acres site so that the two
sites could be developed concurrently.
• That the proposed NURP and infiltration ponds be evaluated for adequate
separation and infiltration to the seasonally high water table.
• That the developer works with staff to identify trees that can be saved in buffer
areas, and designated clear areas.
• That the development should allow for the creation of a greenway corridor from
the southwest, and East Side of the development proposal.
• That no soils should be imported or exported without city approval.
• Soil protection areas should be designated and fenced off.
•
• • Rock entrances should have additional stockpile of rock on hand to top dress
entrances when initial rock entrance fills.
• Storm water from roofs and back yards should follow some sort of a designed
treatment train before water flows into existing wetlands.
• The developer should be required to use the City native seed mix, in NUPR and
infiltration pond, restoration work. That the seeding of these areas be
accomplished with the services of an approved contractor that is knowledgeable
in native plant restoration. That the developer be required to hire such a native
plant contractor to manage the restoration areas for a minimum of three years.
From the July 28th Environmental Board Meeting
Recommend conditional approval with the following conditions:
• A willingness of the developer to work with the City on investigating the
conservation development approach as an alternative approach to the
Preliminary Plat.
• Recommend the services of Jeff Schoenbauer of Brauer and Associates to assist
the city with this alternative approach.
• Rice Creek Watershed approval.
• Add a buffer area along the west sides of the property.

second by Smith. All were in favor.
