APPROVAL OF MINUTES: NOVEMBER 10, 2004 Chair Rafferty requested the following correction: Page 12, 8th paragraph, delete the words "prior to" and insert the word "at ". Mr. Hyden made a MOTION approve the November 10, 2004 Minutes as amended and was supported by Mr. Laden. Motion carried 4 -0. IV. OPEN MIKE Chair Rafferty declared open mike open at 6 :37 p.m. There was no one present for Open Mike Mr. Tralle made a MOTION to close Open Mike at 6:38 p.m., and was supported by Mr. Pogalz. Motion carried 4 -0. V. ACTION ITEMS DRAFT MINUTES Planning & Zoning Board December 8, 2004 Page 2 A. Final Plat for Miller's Crossroads 2 "d Addition, Bruggeman Properties, SE corner of Birch St. and Hodgson Rd. Staff stated the City Council approved the preliminary plat for Miller's Crossroads in September, 2003. The final plat for the first phase was approved by the City Council in February, 2004. The final plat conforms to the approved preliminary plat. The City Attorney reviewed the title commitment with the first final plat. The City Engineer is preparing a development agreement for the second addition. Conditions of approval have been addressed. The project includes a phasing plan in four phases 2003 through 2006. Since the first phase did not occur in 2003, the first two phases were combined in a the first final plat. A trail easement is necessary to include the trails constructed along Birch St. and Hodgson Rd. The trial easement document must be submitted to the City prior to City Council approval of this final plat for the 2nd Addition. Staff was recommending approval. Applicant, Greg Schlink, stated everything was consistent with the plat and he thanked the Planning and Zoning Board for considering this. Mr. Laden asked if banners, streamers, and directional signs were allowed in residential areas. Mr. Smyser replied banners were an on -going discussion and staff would look into this. Mr. Laden noted he was not trying to limit their ability to market their development. Mr. Pogalz made a MOTION to recommend approving the final plat for Miller's Crossroads 2 "d Addition and was supported by Mr. Hyden. Motion carried 4 -0. B. CONTINUED PUBLIC HEARING for a Conditional use Permit and Site Plan Review for Construction of a church, Kingdom Hall of Jehova's Witnesses, 69XX Lake Drive Chair Rafferty reopened the public hearing at 6:45 p.m. Staff stated this item is being continued from the November 10, 2004 Planning and Zoning Board meeting. Staff is working with the applicant to address the concerns raised by the Environmental Board, City staff, and those brought up during the public hearing during the last meeting. At this time, staff has not received revised plans from the applicant and is recommending that this application be continued to the January 12, 2004 meeting to allow enough time for the submittal and review of revised plans. Chair Rafferty noted this would be a continuation to at a minimum the January 12, 2004 meeting. Mr. Tralle asked if they have had a neighborhood meeting. Mr. Bengtson replied he did not know if the neighborhood meeting had been held yet. DRAFT MINUTES • • • • • • Planning & Zoning Board December 8, 2004 Page 3 Mr. Pogalz asked if a church as appropriate in this residential area. Mr. Bengtson replied a church was an appropriate use, but it would be up to the Council and this Board to determine if it was appropriate in a residential area. William Loss, 6956 Lake Drive, stated he would rather see some homes built on those lots because of traffic concerns and no connections to water and sewer. He stated he was not in favor of this development. Carol Stanek, 6970 Lake Drive, stated previously the owner had wanted to get those lots split and the City would not allow that so that was the reason this was being sold as one lot. She stated it was her understanding that the City did not want to run utilities to the residential homes. She wondered why it would be okay to put sewer and water in for a small church, where it would not be okay to do this for two residential homes. She expressed concern about the safety in the parking lot and the lights being on all of the time if there was a safety incident. Mr. Smyser replied there were many areas in the City where utility extensions could be put in, but the assessment that would be put on a residential area was very expensive and many residents did not want to pay for the assessment and the City could not make a resident put in utilities. He stated that was the reason that they did not allow a lot split. He noted the Church would be charged an assessment for utilities and they were a larger user so they were more able to afford the assessment cost. He stated a church was allowed in this area with a Conditional Use Permit. Ms. Stanek noted if utilities were unaffordable as one lot, they would be unaffordable as two lots. Mr. Smyser replied there were two lots out there now and one of those lots were being sold to the church. He noted there was no subdivision. Ms. Stanek asked why was the subdivision not allowed. Mr. Smyser replied it was very difficult to bring utilities to the residential area. Mr. Pogalz asked if the plan was for the Church to put in a septic system and well. Mr. Smyser replied that was correct. Dave Knutson, 38 West Golden Lake Road, Circle Pines, stated he represented the congregation that was purchasing the lot. He stated they were still waiting on the County's review and approval, but he would be getting everything into them in the next few days. He stated he had left a message for the Stanek's, but they have not been able to connect yet. He stated they wanted to be as good of a neighbor as they could and the light issue was a concern. He stated the lights would be on a motion sensor and they would not be on all night. Mr. Laden stated one of the concerns was the size of the parking lot. He asked if the parking lot could be reduced. Mr. Knutson replied he understood they had one excess parking space. Mr. Bengtson replied in his report he talked about how the setbacks were not in the ordinance, but the actual parking requirements had to be met whether it was in a DRAFT MINUTES Planning & Zoning Board December 8, 2004 Page 4 residential or commercial area. He stated the only way they would have a smaller parking lot, was by granting of a variance. Mr. Knutson replied the maximum capacity of the building was 170 and there were 59 parking spots. Chair Rafferty asked for clarification on the lights for the next meeting. Mr. Hyden encouraged Mr. Knutson to have the neighborhood meeting. Rosemary Storberg, 6978 Lake Drive, stated she has lived in the City for 25 years. She stated the lot they were taking about was 200 feet wide by 800 feet long. She indicated only half of the lot was buildable and asked if they had contacted the Watershed District. Chair Rafferty replied if the Watershed District said this could not happen, it would not happen. He stated this was being worked on and this development would need to have Watershed District approval. Ms. Storberg expressed concern about the Church using a septic system with 75 people using it. She stated what eventually would happen is that the lake and neighboring properties would be contaminated and then the residents would be forced to put in utilities. Chair Rafferty stated he firmly believed the City Engineer would not allow something to be put in that would not work. Ms. Storberg stated septic systems tended to jam up and that was the reason that Shirley Kayes and the funeral home had to put in sewer. She stated the church could go 300 feet up the road next to the mortuary, which would be a better location for a Church. Chair Rafferty asked if she owned that lot. Ms. Storberg replied she did not. Chair Rafferty stated the City staff would make sure everything worked on this development before it was approved. Ms. Storberg replied she was not against this Church, but it was being put into the wrong location. Chair Rafferty stated there were regulations that allowed a Church in this location. Ms. Storberg asked if they knew that part of that property on Lake Drive was owned by the State and when Mr. Hanson was going to sell the property, they were going to take an extra 25 feet for widening of Lake Drive. Chair Rafferty stated State, County, and Watershed District would all need to be aware of this development and the staff would make sure this was verified. Ms. Storberg stated if the Church was having meetings, there would be noise from people flying their Seaplanes and repairing them at the Sea Base and she wanted the Church to be aware of this noise issue. DRAFT MINUTES • or • • • • Planning & Zoning Board December 8, 2004 Page 5 Mr. Bengtson stated he did not have the plans with him, but he would get Ms. Storberg the information she wants if she would leave a phone number. Ms. Storberg replied they could give her this information at the next meeting. Chair Rafferty stated there were guidelines and things that had to be followed by the City staff and these were the things that staff and the Board had to deal with. Ms. Storberg stated the main concern was contamination from the Church septic system and the residents being forced to hook up to the utilities without being given an option. Mr. Knutson stated this church would not have a daycare or school and the building would probably be used only 5 or 6 hours a week. He stated there would be very light usage of the building. He noted they did not even have garbage removal because someone took the garbage home with them for disposal. Chair Rafferty noted the neighbors were bringing up very valid concerns and those concerns needed to be acknowledged and worked with. Mr. Knutson replied they could not build a church on commercial property and therefore they could not move 300 feet down the road. Ms. Storberg replied the lot could be rezoned. Mr. Pogalz made a MOTION to Continue the public hearing to the January 12, 2004 Planning and Zoning Board Meeting and was supported by Mr. Tralle. Motion carried 4- 0. C. CONTINUED PUBLIC HEARING for a Preliminary Plat for a 5 -lot residential development named Vaughan Addition, Michael Vaughan, 600 Birch Street Chair Rafferty reopened the public hearing at 7:18 p.m. Staff stated applicant had requested approval of a five lot single - family residential subdivision entitled Vaughan Addition. The subject property is located on the south side of Birch Street approximately 2,180 feet east of Ware Road. The comprehensive plan guides the site for low - density sewered residential use and it is zoned R -1. The site is also within the existing MUSA. This item was continued from the November 10, 2004 Planning and Zoning meeting to allow the applicant time to meet with the neighbors and for them to work with staff to examine the possibility of providing a road stub for the future development of the property to the west. Staff presented its analysis and recommended approval subject to the following conditions: 1. Right of access shall be dedicated to Anoka County along Birch Street on the final plat. 2. The project must apply for a permit from the Rice Creek Watershed District prior to final approval by the City Council. 3. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. DRAFT MINUTES Planning & Zoning Board December 8, 2004 Page 6 4. The project must obtain a permit from Anoka county for any work in the Birch Street right -of -way. 5. Prior to approval of the final plat documentation must be submitted depicting conformance to the minimum 50 -foot setback of drainage ponds to existing wells. 6. Park dedication fee shall be paid according to city policy. 7. Existing buildings on the site shall be removed. Mr. Pogalz asked if the 8 lots that were freed up because of the Pheasant Hills Island not taking place. Mr. Smyser replied they still had the right to build Pheasant Hills Island. Mr. Pogalz asked if this went forward would the property to the west be able to put in an access. Mr. Bengtson stated they had to have access to their site and the City would need to provide an access. Mr. Pogalz asked if the City was suggesting two cul -de -sacs. Mr. Bengtson stated he had received comments from Anoka County that they required a right turn access to the cul- de -sac, with this becoming a right -in, right -out only access at some point in the future. Ron Miller, 597 Chippewa Trail, stated they had a meeting on Monday with Mr. Vaughan and they had some major concerns with this proposal. He stated this was a privacy issue with his property because the houses would be too close to his backyard. He expressed concern about overdeveloping this area and with the increase in the traffic. He stated new homes were not selling in the area and to put more in, did not make sense. He presented a Quad Community Press article talking about being stuck in traffic on Birch Street and the homes being too close to Birch. He stated the City should be concerned about their open space. He stated many neighbors felt their voices would not be heard and that was the reason they were not at tonight's meeting. He expressed concern about the City being overdeveloped. Mike Olson, 593 Chippewa Trail, stated he was in attendance at the meeting on Monday night and he was concerned about the lower water table and the drainage. He stated he has had water in his yard before. He expressed concern about contamination of the wells to the south. He asked if there was contamination of the wells because of this development, who would be responsible for it. He stated it would be nice to have four or maybe three houses in this development to preserve some of the woods. He stated he has lived in the City for ten years. Mr. Tralle made a MOTION to close the public hearing at 7:39 p.m. and was supported by Mr. Pogalz. Motion carried 4 -0. Mike Vaughan, 600 Birch Street, stated he had attempted to address the neighborhood's concerns at the neighborhood meeting. He stated he understood their concerns with drainage and they would be putting in water gardens. Mr. Laden stated if it turned out if this piece of property was only suitable for 4 lots, would it still be developed. Mr. Vaughan replied he would like to keep it at five lots, but it would not be feasible at 4 lots. He stated they could put in up to seven lots, but that would be a tight fit. DRAFT MINUTES • • • • • • Planning & Zoning Board December 8, 2004 Page 7 Chair Rafferty asked for an explanation of a rain garden. Mr. Studenski replied a rain garden was not the sole stormwater entity that would address the concerns. He stated there would still be ponding put in. He stated rain gardens were a way of incorporating restoration, plantings, etc. He noted it was not a typical wet pond. Chair Rafferty asked if Mr. Vaughan was in agreement with staff's conditions. Mr. Studenski stated they would be required to meet Anoka County requirements and the County was requiring a turn lane be put in. John Donovan, 7200 Hemlock Lane, Maple Grove, Loucks Associates, applicant's engineer, stated he had received the conditions and they were in agreement with them, as well as the requirement for a turn lane required by Anoka County. He stated rainwater gardens were encouraged by the Rice Creek Watershed District. He stated they would use more of the native grasses in the water garden. Mr. Tralle encouraged him to not use a lower standard native grasses. Mr. Donovan replied he would take Mr. Tralle's advice and they would also work with the Rice Creek Watershed District on this. He stated this would be a nice, visible area, with a variety of native grasses. Chair Rafferty asked if they were trying to save trees. Mr. Bengtson replied there was a tree preservation plan and applicant was using retaining walls to attempt to preserve substantial trees. Chair Rafferty asked what was the majority of the species of trees being preserved. Mr. Donovan replied the majority of the trees would be oak. Chair Rafferty asked if construction got within a certain range of the trees, they would die. Mr. Donovan replied typically if they graded within the canopy of the trees, there was less chance of survival, but it was possible to grade within the canopy and the tree still survive. He stated all of the lots would be custom built and they would preserve as many trees as possible. Mr. Tralle made a MOTION to recommend approving the Preliminary Plat for a 5 -lot residential development named Vaughan Addition, subject to the seven conditions as noted in staff's December 8, 2004 report and adding a condition 8 to read: Installation of a right turn lane. Motion failed for a lack of a second. Mr. Laden made a MOTION to recommend denial based on the belief that the design was not in the best interest of the City at this time. Motion failed for a lack of a second. Mr. Tralle made a MOTION to recommend approving the Preliminary Plat for a 5 -lot residential development named Vaughan Addition, subject to the seven conditions as noted in staff's December 8, 2004 report and was supported by Mr. Hyden. DRAFT MINUTES • • AGENDA ITEM 5A STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: January 12, 2005 TOPIC: PUBLIC HEARING Conditional Use Permit New Brighton Congregation of the Jehovah's Witness BACKGROUND The New Brighton Congregation of the Jehovah's Witness has requested approval of a conditional use permit to allow a church (Kingdom Hall of Jehovah's Witness) on a 4.07 acre lot located on the east side of Lake Drive. The comprehensive plan guides the site for low- density, un- sewered residential use and it is zoned R -1 (Single Family Residential). A site plan review will be completed administratively, but considering its relation to the Conditional Use Permit request; those review comments are addressed in this report. This item was first heard by the Planning & Zoning Board on November 10, 2004 and was continued to the December 8, 2004 meeting. The applicant did not get revised plans submitted or hold a neighborhood 41po it was subsequently continued to the January 12, 2005 meeting. The applicant held a neighborhood meeting on December 21, 2004. ANALYSIS Comprehensive Plan, Land Use and Zoning The table below identifies the existing land use and zoning as well as guided land uses for the area. The site is within the stage 1 (pre -2010) growth area and within the existing MUSA boundary. Public water and sanitary sewer are not available within approximately 700 feet of the subject site. The proposed building clearly meets all of the minimum setback standards for the R -1 (Single Family Residential) zoning district. The parking lot standards listed above are taken from the commercial design guidelines since the R -1 zoning district does not specifically address parking lot setbacks. A monument sign is also indicated on the revised site plan, to be setback the required 10 feet from any property line. Building Materials The building elevations depict a brick veneer exterior with brick soldier course at a 3' -0" height, with a composite shingle roof. A minimal amount of facade articulation is proposed and the only entrances consist of the main door on the south side and a service entrance on the north side. All of the proposed materials are in accordance with the zoning ordinance. OBuilding Height According to the Zoning Ordinance, no building within a R -1 (Single Family Residential) Zoning District may exceed 35 feet in height. At approximately 22 feet in height, the proposed church complies with the Ordinance. Landscaping In accordance with the Screening requirements of the zoning ordinance screening is required along the boundary of the residential property adjacent to this institutional use. Either a green belt with 80% opacity, six feet in height must be provided, or alternatively a solid screening fence six feet in height. The plans as submitted provide a six -foot fence augmented with some additional landscaping. Within the Shorleand ordinance the following is required: Medium density residential, commercial, and industrial structures, parking areas and `other facilities' shall be treated to reduce visibility as viewed from public waters and adjacent shorelands by vegetation, topography, increased setbacks, or color, assuming summer, leaf -on conditions. Vegetative and topographic screening shall be preserved, if existing, or may be required to be provided. The proposed landscaping plan does indicate six Swamp White Oaks to screen the proposed building and parking lot from the lakeshore, but staff is recommending that a row of hedges also be provided on the east side of the parking lot to screen the parking lot and to keep vehicle headlights from shining towards the shore. Staff also recommends that the parking lot lighting standards be painted green to blend with the natural surroundings. The R -1 (Single Family Residential) zoning district requires that impervious surface coverage not exceed 65 %. Access /Circulation Access to the site is via an entry /exit driveway directly from Lake Drive (C.S.AH. 23). As indicated in the City Engineer's memorandum, approval for this access must be obtained from Anoka County. The comments from Anoka County are attached, and as part of the Anoka County permit process, the applicant will need to satisfy all of the comments. Parking Churches are required to provide parking at a rate of one off - street parking space for every three seats. For the purposes of calculating parking spaces, the ordinance requirement is to use the design capacity of the main assembly hall. Lighting The applicant is proposing to have the following lighting: Parking Lot Entry Drive Security Lighting Sign Lighting Two 22 -foot high poles, with two shoebox style fixtures One 22 -foot high pole, with a single shoebox style fixture Motion sensitive lights on the front and rear entrances Two pole mounted floodlights to illuminate the monument sign The pole - mounted fixtures are all shoebox style with downcast lighting, in conformance to City standards. The submitted lighting plan does not include the security or sign lighting. These items must be included on a revised lighting plan and must meet city requirements of a maximum of four - tenths foot candles on adjacent residential property. The revised lighting plan will also need to meet the one -foot candle limit for adjacent public streets as measured from the right-of-way line. Currently as proposed the lighting htin in front of the p' Y p' p g g proposed building would exceed the standard. These revisions must be submitted to staff for review prior to this item being heard at a City Council meeting. The lighting regulations of the zoning ordinance do not completely address an institutional use such as a church within in a residentially zoned property, as such staff is recommending some conditions for this project that are similar to the code requirements for commercial buildings regarding hours of use. Those conditions require parking lot lighting to be turned off one (1) hour after the last service or meeting, except for approved security lighting; and sign lighting shall be turned off after 12:00 AM and sunrise. Kingdom Hall, page 4 •inae The applicant has included graphics for a proposed four foot high by 10 -foot wide monument sign. The proposed sign meets the requirements of the zoning ordinance. The applicant is also proposing exterior lighting of the sign with two pole- mounted floodlights. This is discussed in further detail within the lighting section of this report. Trash / Mechanical Equipment The applicant stated at the December 8, 2004 meeting that the church intends to take all trash off site in personal vehicles. This is acceptable, however staff has included a condition that if should this change in the future, any trash storage will be required to be done within the proposed building, accessory shed, or some other city approved storage area. The revised plans clearly depict the location of the air conditioning units, just east of the proposed building on a concrete pad. Utilities Water and Sanitary sewer service are not immediately available. Previously the utility plans depicted a septic system on the rear of the property beyond the parking area, at the request of staff and the Environmental Board, the applicant has submitted revised plans depicting a drainage field on the north side of the property. The location of the septic system exceeds the 50 -foot minimum setback from existing wells. The City Engineer has thoroughly reviewed the submitted plans, and his comments are attached. he Centennial Fire District has informed the applicant that an automatic fire sprinkler system will be required for the proposed building. An automatic fire sprinkler system will require additional water supply over and above a residential well. The applicant has discussed the possibility of getting a variance from the Fire Department over this requirement, however the Centennial Fire District has stated in will not support any such variance application. Staff is recommending a condition that the applicant addresses the fire sprinkler system requirement of the Centennial Fire District prior to this item being heard by the City Council. Stormwater management The City Engineer has reviewed the submitted grading and drainage plan. As a condition of plan approval, the grading and drainage related modifications and comments, as set forth in the City Engineer's memo should to be incorporated into the plans. The location of the drainage ponds exceeds the minimum 50 -foot setback from existing wells. The plan is subject to review and approval from the Rice Creek Watershed District. Kingdom Hall, page 5 ONVIRONMENTAL BOARD The Environmental Board reviewed the project on October 27, 2004. The recommendations include limitations on site lighting and associated noise; potential relocation of the septic system; adequate screening of shoreland and adjacent residences; and instituting a rain garden area for water treatment. A memorandum of the Board's recommendations is attached to this report. These comments are incorporated into this review and will be conditioned or added to the development agreement when appropriate. The board also requested to see the application and staff report again at a future meeting (January 26, 2005) to clarify some of their outstanding issues prior to City Council approval. CONDITIONAL USE PERMIT Chapter 2 of the Zoning Ordinance includes the following standards for review of a Conditional Use Permit: 7. Standards. The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: r a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: 1) Land Use Plan. 2) Transportation Plan. 3) Utility (Sewer and Water) Plans. 4) Local Water Management Plan. 5) Capital Improvement Plan. 6) Policy Plan. 7) Natural Environment Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes. d. Traffic generated by a proposed development application is within the capabilities of the City when: 1) If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. • • Kingdom Hall, page 6 2) If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3) If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. 4) The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5) Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. 6) The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer - financed improvements to correct any street deficiencies. 7) The LOS requirements in paragraphs a. to d. above do not apply to the I -35W /Lake Drive or I -35E /Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. 8) The City does not relinquish any rights of local determination. 9) The proposed development shall be served with adequate and safe water supply. 10) The proposed development shall be served with an adequate and safe sanitary sewer system. 11) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. e. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. • f. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Kingdom Hall, page 7 ublic, Educational, and Religious Buildings Standards The R -1 (Single Family Residential) zoning district includes the following as a Conditional Use within the district: Public, Educational, and Religious Buildings. Public or semi - public recreational buildings and neighborhood or community centers; limited to nursery, elementary, junior high and senior high schools; and religious institutions such as churches, chapels, temples, mosque, and synagogues provided that: a. Sideyards shall not be less than fifty (50) feet. b. Adequate screening from abutting residential uses and landscaping is provided in compliance with Section 3, Subd. 4.Q of this Ordinance. c. Adequate off - street parking and access is provided on the site or on lots directly abutting directly across a public street or alley to the principal use in compliance with Section 3, Subd. 5 of this Ordinance and that such parking is adequately screened and landscaped from surrounding and abutting residential uses and landscaping is provided in compliance with Section 3, Subd. 4.Q of this Ordinance OPTIONS 1. Approve the project. 411 2. Deny the project. 3. Return to Staff with direction. RECOMMENDATION Staff recommends approval of the project subject to the following conditions of approval: 1. The applicant must obtain a permit from the Rice Creek Watershed District prior to City Council approval. 2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 3. The project must obtain a permit from Anoka County for any work in the Lake Drive right -of -way. 4. The applicant must submit revised building elevations depicting additional windows prior to this item being heard at a City Council meeting. 5. The use of outdoor lighting for parking lots shall be turned off one (1) hour after closing, except for approved security lighting. 6. All illuminated on- premise signs shall be turned off between 12:00 AM and sunrise. 7. The lighting plan must be revised to indicate the security and sign lighting, and to meet the foot candle limitations of the zoning ordinance prior to this item being heard by the City Council. 8. Engineering Review Comments: Easement Issues: • The submitted easements are to be described by their function or type. Show and/or label the easement(s) on the grading, site, drainage, and erosion control plans. • As a minimum, a ten (10) -foot wide easement (D & U) parallel and along the Lake Drive right - of -way will be required. Also, a five (5) foot wide easement will (D & U) along the side lot lines of the parcel will be required. 2. Provide the Lino Lakes City Engineer with a copy of the requirements with approvals from the Anoka County Highway Access Permit process for driveway access onto a County road. The City will need to review the Anoka County requirements and may have further requirements. 3. Stormwater System Issues: The stormwater drainage calculations are generally the same documents that were previously reviewed as part of a Lino Lakes engineering review(s) from November 1 and 4, 2004. In general, the plans with the revised stormwater system do not coincide with the HydroCAD storm modeling report. The flood/peak elevations in the HydroCAD report do not match the pond elevations as shown on the plans. Storm piping is calculated in the HydroCAD model, but none is shown on the plans. That is, the plans and the HydroCAD calculations must be reconciled using the following requirements: a. The drainage divide area map for existing and proposed conditions must be labeled to coincide with the HydroCAD storm modeling calculations for the 2 -Year, 10 -Year, and 100 -Year design rainfall events. 411 b. While using NRCS type "A" soils for the pre - development (existing) conditions is acceptable, it is required that NRSC type `B" soils are used for the proposed development conditions. Make sure the storm drainage calculations take into account and calculate all the proposed rain garden stormwater capacity by infiltration rate analysis. d. Show elevations and/or plan detail(s) of the proposed stormwater riprap system between the parking lot curb line to the stormwater pond labeled as "Water Quality Pond" located at the east side of the proposed parking lot. Also, show elevations and/or plan detail(s) for the overflow riprap structure from the proposed rainwater garden to the east and the Rice Lake watershed. f. It is recommended that the proposed wood skimmer structure between the "water quality pond" and the infiltration rainwater garden be modified to a manhole and piping alternative system. Kenneth Muehlstedt 2221 Reiling Road BACKGROUND According to city records, a building permit was issued for a 26 -foot by 30 -foot (780 square foot) detached accessory structure (garage) for the subject property on April 21, 1987. At some point the property owner built a 10 -foot by 30 -foot (300 square foot) addition to the rear of the garage without obtaining the proper building permits from the city. The city received, as part of a building permit application for the adjacent property to the west, a certificate of survey from Kurth Surveying, that depicted the addition as being within the five foot setback area as required in the R -X (Rural Executive) zoning district. On April 23, 2004 the City of Lino Lake's Building Department contacted the resident at 2221 Reiling Road in regards to the certificate of survey submitted for the construction of a single family dwelling at 2215 Reiling Road. This survey depicted a portion of the existing detached accessory structure (garage) setback 1.2 feet from the side property line. The resident was informed that the structure would either need to be made to meet the 5.0 feet setback, and if it were to remain in any way, the resident would need to obtain a building permit. The City of Lino Lake's Building Department again contacted the resident at 2221 Reiling Road on September 17, 2004 to reiterate the options for the existing detached accessory structure (garage). Specifically, a variance to allow a 1.2 -foot side setback where 5 feet is required is now being requested by the property owner post construction. Whether this item is approved or denied, ultimately all building codes will need to be met, specifically the requirement that any part of the structure that lies within three feet of the property line will need to be one -hour fire rated construction. Since the structure was built without a permit the building department has not completed any of the required inspections to determine if it was constructed in such a manner to meet building codes. Staff is recommending that no matter what the decision of this board or the City Council, a very specific procedure and timeline should be established in the resolution for this action. FINDINGS In considering all requests for Variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. The site is ample enough in size to allow a detached accessory structure (garage) within the code requirements. b. That the plight of the landowners is due to physical circumstances unique to his property not created by the landowner. • Muehlstedt Variance January 12, 2005 page 3 The landowner clearly created this plight by building a garage addition, without a building permit, that does not meet the setback requirements. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. The property can certainly be put to a reasonable use without the garage addition, or by eliminating that portion of the garage addition that does not meet the setback requirement. d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. No other properties in this district would typically be allowed to encroach this far into a required setback. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The requested variance would clearly contradict the setback standards for this • zoning district. • OPTIONS 1. Recommend denial of the proposed Variance. 2. Recommend approval of the proposed Variance. 3. Return to staff with direction. RECOMMENDATION Staff recommends the following: 1. Denial of the Variance request based on the above findings of fact. 2. Within 30 days of the City Council's final action the property owner is required to apply for a building permit for any portion of the un- permitted structure that is to remain. This permit application will need to include a survey of the subject property along with any other documentation required by the Building Department. 3. Any portion of the un- permitted structure that is to remain must comply with all building code requirements. 4. Within 90 days of the City Council's final action the un- permitted structure must be brought into conformance with the setback requirements. The goal is to prepare amendments to the existing sign ordinance. At the November meeting, the P & Z agreed on specific requirements for portable signs and banners (see attached). These will be incorporated into a ordinance amendment. No signs are to be allowed in road rights of way. Because traffic signs, lamp posts, and the like are in the right of way, signs would not be allowed to be attached to such things. Stringers/Pennants: A common attention - getting device is the string of small flags or other elements that flap or flutter in a wind. This is a form of signage that may or may not include words conveying a message. The current sign ordinance addresses them as follows: "Banners, ballons, stringers are prohibited unless approved in conjunction with a portable sign permit." (Section IV.E) The ordinance does not include a definition of "stringers ". We suggest that we include a definition as follows: Pennant or Stringer: Any lightweight plastic, fabric, or other material whether or not containing a message of any kind, suspended from a rope, wire, or string, usually in series, designed to move in the wind. The next question is how to regulate them. Should we • allow them with a portable sign permit, or • prohibit them completely? Window Signs: While one might hold the opinion that excessive window signage is unattractive, we suggest that signage inside a building should not be regulated by the sign ordinance. • • • Result of P & Z Discussion of November 2004 BANNER Definition A temporary sign made of cloth, flexible plastic, or other fabric Maximum Size: 32 square feet Attachment: All four corners must be attached to the principal building on site Permit: Portable Sign and Banner permits are held to the following standards: 1.
