APPROVAL OF MINUTES: JANUARY 12, 2005 Mr. Tralle made a MOTION to approve the January 12, 2005 Minutes and was supported by Mr. Pogalz. Motion carried 3 -0. IV. OPEN MIKE Chair Rafferty declared Open Mike open at 6:34 p.m. There was no one present for Open Mike Mr. Hyden made a MOTION to close Open Mike at 6:35 p.m., and was supported by Mr. Tralle. PUBLIC HEARING for a Preliminary Plat, Angie's Acres, Al Powers, 290 Elm Street Staff stated applicant had requested approval of a single - family residential development entitled Angie's Acres. The subject property is located adjacent to the southeast corner of Elm Street and Rice Lake Lane and is currently developed with one single - family dwelling. The applicant is proposing to divide the 39,600 square foot lot into two buildable lots of 23, 346 square feet and 14,610 square feet; and one 1,644 square foot outlot that will be combined with the property owner to the south. The existing single - family dwelling will remain on the larger lot, and the smaller lot will be used for new construction. Staff reviewed their analysis and recommended approval subject to the following conditions: 1. Both lots shall connect to city sanitary sewer and water, assessments for both lots will be recorded with the final plat. 2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 3. Park dedication shall be paid in accordance with city policies. 4. The outlot will be combined with the southern property at time of recordation. Chair Rafferty opened the public hearing at 6:40 p.m. Chair Rafferty invited applicant to make comment. Chair Rafferty asked if there was an outlot to the south of the property. Al Powers, applicant, replied there was an outlot and it would be quit claimed to the adjoining property. He indicated he had spoken with those property owners and they were in agreement with this proposal. Mr. Root arrived at 6:42 p.m. Chair Rafferty invited anyone for or against this application to make comment. There were no comments made. Mr. Pogalz asked if Mr. Powers agreed to all of staff's recommendations. Mr. Powers replied he was in agreement with them. Mr. Hyden made a MOTION to close the public hearing at 6:43 p.m. and was seconded by Mr. Pogalz. Motion carried 4 -0. Mr. Pogalz made a MOTION to recommend approval for a Preliminary Plat for Angie's Acres, Al Powers, 290 Elm Street subject to the conditions as noted in staff's February 9, 2005 report and was supported by Mr. Tralle. PUBLIC HEARING, for a Preliminary Plat, Marshan Lakeview, James Funkhouser, 595 Marshan Lane Chair Rafferty opened the public hearing at 6:46 p.m. Staff stated applicant had requested approval of a single - family residential development entitled Marshan Lakeview. The subject property is made up of two lots located at the end of Marshan Lane and is currently developed with one single - family dwelling. The applicant is proposing to divide the 121,374 square foot lot into four lots of 35,088 square feet, 11784 square feet, 15,419 square feet and approximately 42,000 square feet. The existing single - family dwelling will remain on the largest lot. Also depicted on the preliminary plat are a couple of outlots that were created as part of the Marshan Estates plat. These outlots will be combined with the adjacent properties as part of his proposed plat. Staff presented their analysis and noted staff had a discussion with the property owner this morning regarding the layout of the development. He noted applicant was not sure of the layout and therefore, staff was requesting the public hearing be opened, comments taken, and the public hearing be continued to the March P &Z meeting. Mr. Laden arrived at 6:54 p.m. Mr. Hyden asked if the street would still go through. Mr. Bengston replied there was an emergency access easement, which was not an official road. Chair Rafferty invited applicant to make comment. Jim Funkhouser, 595 Marshan Lane, stated he was requesting a continuation of the public hearing to address the layout of the development. He noted some large oak trees would be lost with the development as proposed. He indicated he would like time to look at other options in order to save more trees. He stated he wanted a development as sensitive as possible to the trees and the environment. Chair Rafferty asked how long has he lived in the City. Mr. Funkhouser replied he had lived in the City for 36 years. Mr. Funkhouser asked for a two month delay. Mr. Smyser replied the delay could be as long as he wanted, but staff needed the request in writing. Chair Rafferty invited anyone for or against this application to make comment. There were no comments made. • Mr. Tralle made a MOTION to continue the public hearing and was supported by Mr. Pogalz. Motion carried 5 -0. PUBLIC HEARING for Conditional Use Permit Amendment and Site Plan Review to allow for additions to existing building, Molin Concrete, 415 Lilac Street Chair Rafferty opened the public hearing at 6:59 p.m. Staff stated applicant proposes two additions to the existing facility at 415 Lilac Street. One is an outdoor storage bay with an overhead crane, and the other is a 17,500 square foot addition to the precast fabrication area. Staff indicated applicant's property is covered by a conditional use permit for the concrete plant. The northern 20 acres is covered by an interim use permit for outdoor storage. This new application does not involve the storage area. The Conditional Use Permit covers the entire site. Building additions such as those proposed in the application require an amendment to the Conditional Use Permit. Staff noted under the new zoning ordinance, the site plan review is done administratively. However, a Conditional Use Permit amendment is necessary, and a site plan review is part of the CUP review. Staff stated because this application involves the CUP amendment, it is appropriate to review the conditions placed on the site through the last CUP amendment in 2003. Staff presented their analysis and recommended approval of the Conditional Use Permit Amendment and Site Plan Review subject to the following conditions: 1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 2. Exterior lighting fixtures shall be hooded and directed to reflect light away from neighboring residential properties and right of way. The fixtures must be a 90 degree cut off angle. 3. All conditions in Resolution 01 -182 continue to apply. Mr. Hyden asked if a concern over the landscaping should arise, who would bring this concern forward. Mr. Bengston replied if the P &Z felt it was necessary, there could be a condition added, or staff could look at this if there were any concerns brought forward. Mr. Hyden stated he understood it was difficult to get landscaping growing on the berm. He asked if that was no longer a concern. Mr. Bengston replied he understood the landscaping was planted and this was no longer a concern. Chair Rafferty invited anyone for or against this application to make comment. DRAFT MINUTES • • • • • Planning & Zoning Board February 9, 2005 Page 5 Randy Molin, Facilities Manager, stated with respect to landscaping when staff came out in 2003 they were doing some reconstructive planting. He noted they have had success with the plantings on the berm. He indicated they had taken care of the trees on the lot line, but a number of them had died of natural causes. He stated the other trees were looking good and he believed they had done a good job of taking care of the landscaping. He noted the two trees on the berm were 6 foot tall maple trees. He stated there were bushes on the berm also. Chair Rafferty stated he had the opportunity to have a tour of the Molin plant and was impressed with the facilities and appreciated the tour. Mr. Tralle asked if any of the noise levels would be going up. Mr. Molin replied the outdoor cranes have had favorable comments from the neighbors. He indicated the cranes were electric and very quiet. He stated the reason they were adding the third bay was because at busy times during the year they needed to store inventory for upcoming jobs, so they needed to have room for that material. He stated they were not increasing production. Mr. Hyden made a MOTION to close the public hearing at 7:18 p.m. and was supported by Mr. Tralle. Motion carried 5 -0. Mr. Hyden made a MOTION to recommend approval for a Conditional Use Permit Amendment, and Site Plan Review, to allow for additions to existing building, Molin Concrete, 415 Lilac Street and was supported by Mr. Laden. PUBLIC HEARING for Circle Pines Registered Land Survey for Lots 11 and 12, Block 8, and Lots 9 -14, Block 10, Lexington Park Lakeview Chair Rafferty opened the public hearing at 7:21 p.m. Staff stated the City of Circle Pines wished to acquire a small area of land on the south side of North Road. This area is covered by county road easement for Lake Drive. Over time, the easements in this area became complex. Circle Pines wants to clear up the easement definitions to facilitate their property acquisition efforts. A registered land survey (RLS) is a common means of accomplishing this. The RLS is similar to a plat and must be processed like a plat. The entire area proposed for the RLS is within Lino Lakes, so Lino Lakes must review it. Staff presented their analysis and indicated there were still outstanding issues that called for additional information. Staff recommended opening the public hearing, taking comments, and continuing the public hearing to the March 9 P &Z meeting. Mr. Hyden asked if they needed to find out who the owners are of the tracks. Mr. Smyser replied that was correct that needed to be clarified. Mr. Hyden asked if all of the owners had to be contacted to be made aware of what was going to take place. Mr. Smyser replied that was correct. Mr. Laden asked if Circle Pines was interested in acquiring the area north. Mr. Smyser replied they were not. Mr. Pogalz asked if the land would be purchased from Lino Lakes. Mr. Smyser replied tract C was private ownership and would need to be purchased. With respect to the property along Sunrise Drive, there was a question of ownership, which needed to be clarified. He stated any land owned by Lino Lakes would need to be discussed as to how it would be purchased or traded. Mr. Hyden asked if Circle Pines purchased the property would the municipal boundaries change. Mr. Smyser replied one City could own property in another City, but it did not mean the boundaries changed. Chair Rafferty invited anyone for or against this application to make comment. Jim Keinath, City Administrator Circle Pines, stated the City was interested in acquiring a small area in Lino Lakes to build a police facility. He noted it was approximately 2 acres total. He stated there would be no change to the underlying property and they would meet with the owners to acquire those properties. Dan Lahlum, 6828 Sunrise Drive, asked how large of a parking lot were they intending on putting in. Mr. Keinath replied he believed the total parking lot area was 28 spaces. Mr. Laden made a MOTION to recommend continuing the public hearing to the March 9 P &Z meeting and was supported by Mr. Pogalz. Motion carried 5 -0. F. II • Rrokcrs Inc WITHDRAWN G. Final Plat for Highland Meadows East 2 "d Addition Staff stated TSM Development had requested approval of a single - family residential development called Highland Meadows East 2nd Addition. The subject property is currently Outlot A of Highland Meadows East. This plat will create a total of 19 lots. 18 residential lots, and 1 outlot. Staff indicated the final plat substantially conforms to the approved preliminary plat layout as approved by the City Council on July 26, 2004. Some minor adjustments to the width of the middle units have been done but the minimum setbacks discussed in the Preliminary Plat report are still being met. As required under the conditions of preliminary plat approval, the applicant has obtained a Rice Creek Watershed permit. All other conditions of approval will be met during the building permit review process, or with the agreement between the applicant and the city. Staff recommended approval of the final plat for Highland Meadows East 2nd Addition. Mr. Hyden made a MOTION to recommend approval of final plat for Highland Meadows East 2 "d Addition and was supported by Mr. Pogalz. Motion carried 5 -0. H. Final Plat for Oakwood View Staff stated the Rice Creek Evangelical Covenant Church has requested approval of a single - family residential development called Oakwood View. The subject property is currently one lot with a house of worship constructed on the southern most portion near the Ash Street frontage. This plat will create a total of 12 lots. One for the existing house of worship, one large lot for the future group residence duplex facility, and 10 single - family residential lots. Staff indicated the final plat conforms to the approved preliminary plat layout as approved by the City Council on May 24, 2004. The title commitment for the property and final plat have been forwarded to the City Attorney for review. As required under the conditions of preliminary plat approval, the applicant has submitted a Rice Creek Watershed permit. Another condition of approval required that a shared driveway easement be provided from Ash Street to the property intended for a future group residential duplex facility. The applicant is working on this easement and it will be required to be submitted for review by staff prior to the final plat being scheduled for the City Council. All other conditions of approval will be met with building permit review of the subdivision. A development contract between the applicant and the city is being developed and will address many of the conditions of approval at that time. Staff recommended approval of the final plat for Oakwood View. Mr. Tralle made a MOTION to recommend approval of the final plat for Oakwood View and was supported by Mr. Laden. Motion carried 5 -0. I. Final Plat for Century Farm North 3rd Addition Staff stated appplicant had requested approval of a residential development called Century Farm North 3r Addition. The subject property consists of several outlots platted as part of Century Farm North and Century Farm North 2 "d Addition. This plat will create a total of 59 lots consisting of 18 single - family residential lots, 34 attached single - family residential lots, and 7 outlots. Staff indicted the final plat conforms to the approved preliminary plat layout as approved by the City Council on April 28, 2003. The title commitment and by -laws have been forwarded to the City Attorney for review. DRAFT MINUTES Planning & Zoning Board February 9, 2005 Page 8 Staff noted the conditions of the preliminary plat have mostly been addressed through the platting process of the 1st and 2nd additions, and will be enforced in a similar fashion for this addition. Specifically, the townhouse elevations will be held to the same standard development for the 2nd addition, the height restrictions to protect air space for the air park are in place, and the trails for this portion of the development have already been platted by the 2nd addition. Staff recommended approval of the final plat for Century Farm North 3rd Addition. Mr. Tralle asked if park dedication had been resolved. Mr. Bengston replied park dedication had been resolved. Mr. Hyden made a MOTION to recommend approval of the Final Plat for Century Farm North 3rd Addition and was supported by Mr. Pogalz. Motion carried 5 -0. Chair Rafferty recessed the meeting at 8:00 p.m. and reconvened the meeting at 8:05 p.m. J. Final Plat for Turnberry Crossing (formerly known as Marshan Townhomes 2 "d Addition) Staff stated Hokanson Development has requested approval of a single - family residential development called Turnberry Crossing. The subject property consists of 4.05 acres and will be platted into 23 townhome units and one outlot. Staff indicated the final plat conforms to the approved preliminary plat layout as approved by the City Council on September 13, 2004. The title commitments, final plat, and association by -laws have been forwarded to the City Attorney for review, and are acceptable. Additional right -of -way for Lake Drive is being dedicated as required. The applicant has submitted the revised design to the Rice Creek Watershed District as required by condition number 10 of the Preliminary Plat. The applicant is currently adding a right of access dedication to Anoka County as was required by the Preliminary Plat approval. This revision will be submitted for staff review prior to the items being scheduled for the City Council. All other conditions of approval will be met with building permit review of the subdivision. A development contract between the applicant and the city is being developed and will address many of the conditions of approval at that time. Staff recommended approval of the final plat for Turnberry Crossing. Mr. Root asked if the landscaping issues had been resolved. Mr. Bengston replied all of those issued had been worked out. Mr. Tralle asked if the road to the north was owned half by applicant and half by the townhome association. Mr. Bengston replied the language was still being worked on and this would be done prior to the final plat being approved by City Council. Mr. Tralle asked who would be responsible for the maintenance of the street. DRAFT MINUTES • • • • Planning & Zoning Board February 9, 2005 Page 9 Jay Roos, Hokanson Development Company, stated there was an existing private driveway that was maintained by the existing development. He indicated it was the direction of the Council that the developer would provide an access easement dedicated to Marshan Association. He stated they would maintain fee ownership and would dedicate an easement to the Marshan Association and the maintenance responsibilities would be Marshan Association. He stated the appropriate documents would be drafted by their attorney and would be approved by the City's attorney. He acknowledged that Final Plat approval by the City Council would not occur until these documents had been reviewed and approved. Mr. Tralle asked how many color schemes were being proposed for this development. Mr. Roos replied they had not specified an exact color combination, but it would be a masonry siding with a second siding option being shake siding. Mr. Tralle stated this had been discussed at the previous meeting, but he realized Mr. Roos was not in attendance at that meeting. Mr. Smyser stated the City Council had discussed this and had come to an agreement about this. • Mr. Tralle asked if the park dedication issue had been resolved. Mr. Smyser replied the park dedication had been fully resolved and agreed to by the applicant. Mr. Laden asked how the color scheme was going to be resolved. Mr. Smyser replied he could not remember what the City Council's decision was, but he did recall there was a discussion about colors by the City Council and there was a resolution by the City Council and he would check to see what the condition was prior to final plat approval by the City Council. Mr. Pogalz made a MOTION to recommend approval of the Final Plat for Turnberry Crossing and was supported by Mr. Hyden. Motion carried 5 -0. CONTINUATION OF ITEM A UNDER ACTION ITEMS: A. Elect Chair and Vice Chair for 2005 Staff noted it was necessary to elect a Chair and Vice -Chair of the Planning and Zoning Board for 2005. Mr. Tralle nominated Mr. Rafferty for 2005 Chair. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: March 9, 2005 TOPIC: Preliminary Plat Marshan Lakeview BACKGROUND James Funkhouser has requested approval of a single - family residential development entitled Marshan Lakeview. The subject property is made up of two lots located at the end of Marshan Lane and is currently developed with one single- family dwelling. The applicant is proposing to divide the 121,374 square foot lot into four lots of 35,088 square feet, 11,784 square feet, 15,419 square feet and approximately 42,000 square feet. The existing single- family dwelling will remain on the largest lot. Also depicted on the preliminary plat are a couple of outlots that were created as part of the Marshan Estates plat. These outlots will be combined into the adjacent properties as part of this proposed plat. At the February 9, 2005 meeting the applicant requested that this proposal be continued to a future meeting so that he could thoroughly review the plans and determine if an alternative existed that could potentially save more of the significant trees on the site. Since that time the applicant has decided that this is the best feasible layout and wishes to proceed with the application. Staff has met with the applicant to define a couple of possibilities that would potentially save some significant trees or allow for a greater buffer between the new lots and the main drive for the city's Legacy project which will be a significant traffic generator. Staff feels very comfortable continuing to work with the applicant to clearly define the location of the cul -de -sac bulb and drainage for the lots prior to the City Council reviewing the application. ANALYSIS The following is a summary of the proposal: Site Area 121,374 square feet Upland Area 99,003 square feet Total Lots 4 Density 1.66 units per acre • • • Marshan Lakeview Page 2 Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. Recent amendments to that policy have eliminated the 20 % discretionary flexibility and essentially closed the 2005 lots. This application was not received until after that amendment and therefore cannot be platted until 2006. Attached to this report is the current lot inventory, showing that there are 49 available lots remaining for 2006. The proposed subdivision consists of two existing lots, and therefore is only a net increase of two additional lots. MUSA Reserve: The comprehensive plan and the growth management policy establish a specific number of MUSA acres for residential growth for stage one (prior to year 2010). The subject site is already within the current MUSA boundary. Preliminary Plat Lots: The minimum lot size in the R -1 (Single Family Residential) zoning district is 10,800 square feet of upland. The lots being created by the proposed plat will consist of a minimum of 10,996 square feet of upland (Lot 1, Block 2). Lot 1, Block 1 is sufficient in size to meet the minimum setback requirements for the existing single - family dwelling. Streets: Marshan Lane will be extended to the east and ended with a cul -de -sac. The unusual shape of the cul -de -sac was requested by staff so it would encompass the entire area of an emergency access easement the city already holds on the property. Marshan Lane will continue to be developed to a rural standard, however the full right of way will be dedicated to the city. Marshan Lakeview • Page 3 • • Wetlands: Wetland exists on the southern part of the property, and would be contained within lot 1 of block 2. Appropriate easements containing the wetland areas and a 10 foot buffer are depicted on the proposed plat. Park / Open Space: The proposal does not include any land dedication for parkland, only a cash dedication will be required. Park dedication fees will be calculated as required by city policy. If the property owner were to follow the Environmental Board's recommendation of donating the wetland area at the south end of lot 1, block 2 it would not count as land dedication for parkland. Anoka County has expressed interest in the donation of the land, and if this is going to be donated it must be platted as an outlot so it can be then quit claimed to the County and subsequently combined with the adjacent County parcel. Utilities: Adequate municipal services exist within the Marshan Lane right -of -way, and all properties will be required to connect to municipal services. Grading and Drainage: Easements are required adjacent to property lines (5 feet side -yard and 10 feet front and rear - yards), and are provided. Additional easements are provided over the ponding area on the northeast corner of Lot 1, Block 2. That pond does encroach slightly into the right -of -way, however the City Engineer in his comments states that it is an allowable encroachment as long as it is minimized. The current configuration is acceptable in that regard. The City Engineer has completed a thorough review of the submitted plans, and his memorandum is attached at the end of this report. The applicant will be required to satisfy all of those comments prior to recordation. Environmental Board: The Environmental Board reviewed this proposal at the January 26, 2005 regular meeting. The comments from the board are attached to this staff report and address water run -off, buffering of the wetland, erosion control, soil compaction, saving more trees than proposed, alternatives to the cul -de -sac, and donation of wetland to Anoka County Parks. Review comments are as follows: General Comments 1) Because the property is residential and less than 5 acres, review and approval of the Rice Creek Watershed District (RCWD) would normally not be required. In addition, it does not appear that there will be any filling into delineated wetland areas. However, as previously stated, because the property is located directly adjacent to a DNR protected water (Marshan Lake), a review by RCWD will be necessary. The plan does indicate efforts to attain quality for surface water runoff by proposing a detention area prior to discharging to Marshan Lake. Copies of correspondence with RCWD must be provided. City of Lino Lakes, Minnesota 2) The proposed site development results in grading (disturbing of property) of over 1.0 acre. The development shall therefore be subject to the requirements of NPDES (National Pollution Discharge Elimination System) as most recently adopted by the Minnesota Pollution Control Agency (MPCA) and the City of Lino Lakes. The applicant shall therefore be responsible for retaining and administering a Stormwater Pollution Prevention Plan (SWPPP) in accordance with State of Minnesota law. Grading 1) As noted in the previous review, a drainage concern was expressed with regards to Lots 2 and 3 of Block 1. Although the grading plan does indicate an acceptable routing of runoff, special care must be taken during actual construction and final grading to assure that drainage between the two units is attained. 2) As mentioned in the previous review, the applicant shall ascertain the adequacy of the existing soils for the roadway, utility, and house constructions. No soil or geotechnical report is provided. Although the Resource Inventory Survey identifies fine sands for much of the site, any imported material for the site shall be subject to the approval of the City Engineer. In addition, floor elevations for the proposed housing units must meet the requirements of the City of Lino Lakes as follows: The lowest building opening must be a minimum of 1 -foot higher than detention basin emergency overflow elevation. Basement floor elevations must be at least 4 -feet above the normal water elevation and 2 -feet above the design flood level. The applicant shall be responsible for attaining any permits as required for de- watering. Utilities 1) It is proposed to connect to existing sanitary sewer and water, recently constructed on Marshan Lane. The applicant shall be aware that the sewer is relatively shallow and that low floor elevations and sewer plumbing for the proposed housing units must be designed accordingly. A sewer forcemain service has therefore been proposed for Lot 1. 2) The applicant shall be responsible for the coordination of private utilities (electric, gas, cable, etc. as needed. 3) Individual sanitary sewer and water services for all three units are provided. However, as stated in the previous review, the 6 -inch diameter water main extension shall be revised to 8 -inch diameter in accordance with City standards. The 8X6 reducer proposed at the connection to the existing watermain should be replaced by an 8 -inch gate valve. Insulation must be provided for all sanitary sewer and water (mains and /or services) that will have less than 7.5 feet of cover over the top of the pipe. A detail for the type and installation of insulation must be provided. • • • Marshan Lakeview /Funkhouser Estates City of Lino Lakes, Minnesota Page 3 January 21, 2005 4) Because the utility main extensions will be owned and maintained by the City, as -built records will be required upon completion. This includes plan and profile views of the sanitary sewer and water. 5) The sanitary sewer and services must be placed a minimum distance from existing wells per Minnesota Department of Health requirements. 6) Further construction details and standard plates of the City of Lino Lakes must be provided, including gate valves, hydrant installations, and references to the Standard Utilities Specifications of the City Engineers Association of Minnesota (CEAM). All sanitary sewer services shall be SCH 40 or SDR 26. 7) The applicant will be responsible for obtaining required permits for utility extensions from the Minnesota Department of Health (MDH), the Minnesota Pollution Control Agency (MPCA), and Metropolitan Council Environmental services (MCES). Other Comments 1) The 30 foot street width and 60 foot wide right of ways as shown are acceptable. The right of way has also been expanded as needed to encompass the existing trail easement. Underlying easements and /or dedications no longer needed will require proper legal vacation or elimination by the applicant as part of the platting process as required by the City and Anoka County. 2) A Tree Preservation plan has been provided, and shall be subject to further requirements as may be provided by the City Forester. 3) The new street extension as shown does not conform directly to City standards. However, the street width and pavement section essentially match the existing Marshan Lane, and are therefore acceptable. Some bituminous curbing will be necessary to properly direct drainage to the runoff exit location. Provisions must be also provided for maintaining an access and continuation of the existing trail that runs toward City Hall. 4) The applicant shall be responsible for the verification of any existing well and septic locations on both the subject property and adjoining properties to assure compliance with the State of Minnesota requirements as previously expressed. • Environmental Memo To: Paul Bengtson From: Marty Asleson CC: Jeff Smyser Mike Grochala Date: January 31, 2005 Re: Environmental Board Recommendations /January 26, 2005 • The Environmental Board made the following recommendations at the January 26, • 2005 Environmental Board meeting: Marshan Lakeview Environmental Board recommended approval of Marshan Lakeview including: • Water should be directed from all roofs and impervious areas to open space and pervious areas. • NPDES best management practices should be reviewed and acceptable to the site. • A buffer should be established between the lake and at least 10 feet beyond the delineated wetland boundary. Signage should be placed at this line and there should be education materials given to the new residents concerning the resource issues concerning this buffer. • Any soil disturbance in the 200 -foot from Lake Area must have temporary erosion control or permanent cover within 7 days. The NPDES plan should include how this erosion control will be done, and the permit and inspection reports must be on site at all times. The designated area for these documents should be described on the plan. • Page 1 r • • All soils, especially in pond and infiltration areas should be protected from excessive compaction. Low impact construction equipment should be used and protection fence placed around infiltration areas. No importing or exporting of soils should occur with out City approval. • Make changes to the proposed grade plan to save more trees. Look at directing water from the North between the houses instead of creating a swale (and removing more trees) on the North. Install rain gardens to capture this water in front of the two northern lots. Custom grade the proposed houses to reduce tree losses. • Ask City Engineer to investigate alternative to a cul -de -sac such as a "hammer- head" design. This may save two specimen oaks. Note: The developer is in favor of looking at an alternative design to the street end. This will also reduce impervious surface in a shoreland district. • Donate the area from the South end of lot 1 blk 2, to the wetland delineation area to Anoka County Parks as a permanent protection measure. Owner is in favor of this and Anoka County has been questioned about their interest in accepting this donation. • Work with staff on lessening tree removals and increasing buffers. B Jeff Smyser March 9, 2005 PUBLIC HEARING (continued): Registered Land Survey North Road/Lake Drive Area City of Circle Pines The City of Circle Pines wishes to acquire a small area of land on the south side of North Road. This area is covered by county road easement for Lake Drive. Over time, the easements in this area became complex. Circle Pines wants to clear up the easement definitions to facilitate their property acquisition efforts. A registered land survey (RLS) is a common means of accomplishing this. The RLS is similar to a plat and must be processed like a plat. The entire area proposed for the RLS is within Lino Lakes, so Lino Lakes must review it. The P & Z opened the public hearing at the February 9 meeting and continued it to allow for the gathering of additional information to address some unresolved issues. It since has been turned over to Anoka County. Apparently, the legal descriptions of the easement(s) for the road are complicated and confusing. The RLS is intended to clarify where the easements are in order to facilitate the purchase of some property by Circle Pines. As long as this was occurring, we took the opportunity to clarify some additional issues. The subject area is within the Lexington Park Lake View plat, which was platted in 1946. The roads were dedicated to the public, as is typical when new developments are platted. The ownership of the property would not change with the RLS. It would make it easier to vacate the easement or sell property covered by the easement because the legal description of the easement area would become "Tract x of RLS No. ". Outstanding Issues From February Meeting The P & Z opened the public hearing at the February 9 meeting and continued it to allow for the gathering of additional information to address some unresolved issues. There are a number of things that should be clarified before Lino Lakes approves the RLS. • • RLS, North Road Area page 3 Ownership: The ownership of the underlying parcels was not yet been clearly established. We asked Circle Pines for a title search to resolve this. We need to ensure that the needs and rights of Lino Lakes property owners are adequately considered. The table below lists ownership. Sunrise Drive and North Road were dedicated as part of the 1946 plat. Lino Lakes didn't exist when the plat was recorded. Whether the City or County actually own the roads would need to be determined, but this is not a vital point for now. The RLS does not have a signature page and the RLS is being proposed by the City of Circle Pines, which is not the property owner of the land in question. The situation is different from a typical plat. Our city attorney discussed this question with the Anoka County Examiner of Titles. The answer is rather surprising. There is no requirement in state statute that a property owner must sign off on or even agree to a registered land survey on his property. While the proposed RLS seems to be splitting property into separate tracts, it is in effect only defining an existing easement by making it a separate tract of land. According to the City Attorney's discussion with the Examiner of Titles, this does not require property owner agreement. Nonetheless, in the interest of fairness, we want the existing owners to be aware of the proposed RLS. Northern Right of Way Line: Several of the attached drawings show the northern road • easement /right of way line running in a southwest to northeast diagonal across the • • • RLS, North Road Area page 4 westernmost area of the RLS. You can see that the line appears in different places on different drawings. We have asked to have this clarified. A revised RLS includes this line and creates separate tracts for property within and without the easement. Needed Right of Way: It is possible that Anoka County may in the future consider vacating areas of the existing easement, which would result in more buildable land on some lots such as Tracts A, L, M, N, and O. We have asked Circle Pines to confer with Anoka County Highway Dept. about the area actually needed for right of way. Maybe this area can be delineated with separate tracts to facilitate future vacations. This information was not available in time for this report. There is no intention to pursue a vacation of the easement, so it is not necessary at this time to address this. The application submitted includes a Rezoning to GB (General Business), a Conditional Use Permit to allow a Planned Unit Development, a Development Stage Plan/Preliminary Plat, and allocation of MUSA reserve. The main occupant of the site will be an 80 room hotel proposed for Lot 1 of the Plat. The development also includes a restaurant pad on lot 5, and retail /commercial pads on lots 2, 3, and 4. Setback Standards The proposed setbacks are more restrictive than the GB (General Business) zoning district, and are therefore acceptable to staff. The proposed lot areas and widths are in conformance with the GB (General Business) zoning district, and are therefore appropriate. • Parking Lot General Business Proposed Arterial Street 15 feet 83 feet Side Yard 10 feet 10 feet Rear Yard 10 feet 10 feet The proposed setbacks for parking are equal to or more restrictive than the GB (General Business) zoning district, and are therefore acceptable to staff. All signage will be required to be setback the typical 10 feet from right -of -way and 5 feet from any side or rear property line. Lot Sizes The Planned Unit Development allows deviation from strict provision of the zoning code related to lot area and width. Each lot is designed to accommodate a building pad and sufficient parking to serve the intended use of the lot. The proposed lot areas and widths are in conformance with the GB (General Business) zoning district, and are therefore appropriate. • Apollo Landing, page 3 •Bui1din Materials/ Elevations The elevation that was submitted with this application is strictly an artist's rendering of what a hotel built to the height standards of the zoning district, and to the commercial design standards of the city zoning code would look like. It is in no way an architectural elevation depicting exactly what will be built on site. The architectural elevations are intellectual property of the different hotel chains and since a specific user has not been tabbed to take the hotel location final architectural elevations are not available at this time. However, as a part of the Planned Unit Development rezoning request, architectural design standards must be established to dictate the aesthetics of the buildings eventually built on this site. The applicant has submitted some very basic architectural design guidelines in line with our minimal design standards from the zoning code. Staff is recommending that very specific architectural design standards be developed for the site, since the user and subsequent building design can not be confirmed at this time. The applicant is currently working with staff to try and develop these standards. Building Height Again, the final occupant of the hotel, and therefore the final design of that building can not be verified at this time. As such it is important that any approval of this project establish a firm height limitation. Staff would recommend the limitation normally associated with the GB (General Business) zoning district. According to the Zoning Ordinance, no building within the GB (General Business) Zoning District may exceed 45 feet in height. Landscaping IIP In accordance with the Screening requirements of the zoning ordinance screening is required along the boundary of the residential property adjacent to this institutional use. Either a green belt with 80% opacity, six feet in height must be provided, or alternatively a solid screening fence six feet in height. The plans as submitted provide a six -foot fence augmented with some additional landscaping. The remainder of the landscaping on site looks rather minimal, but that is based on the lack of definitive users and building size /layout for the site. As each site is designed with the final user the landscaping would be designed to work with the layout. However, again the architectural design standards would be able to spell out the types of allowable plant materials. This would create the cohesiveness desired. Staff would prefer to see further details on the landscaping of the main access drive since that will not change, and the hotel pad site which should only need minor adjustments once a user is found. Staff is asking the applicant to look into the elimination of some parking spaces within the large parking area for lots 2, 3, and 4. This would allow for additional landscaping fingers, which could be clearly defined for landscaping at this time. Green Area The GB (General Business) zoning district requires that impervious surface coverage not exceed 75 %. The submitted plans currently show the property at approximately 70.5% impervious surface coverage, well within the limitations of the zoning district. If parking is eliminated as is mentioned in the parking section of this "'report, the impervious surface coverage would naturally decrease. Originally the applicant was proposing to use some parking spaces for trash enclosures, though staff is recommending that trash storage be seamlessly integrated into the designs of the building. The Environmental Board has suggested the elimination of some parking spaces in favor of increased landscaping, which is a definite possibility. Staff would suggest that the elimination of parking spaces occur in the middle of the sea of parking for lots 2, 3, and 4 to add landscaping fingers and break up the monotonous pavement. The applicant has displayed a willingness to accommodate additional landscape fingers with the understanding that eliminating excess parking will limit the future tenant mix of the center. However, staff is developing an analysis of the peak parking demand for each use on the site to determine the true parking need for the entire site. • Apollo Landing, page 5 Access /Circulation Access to the site is via an entry /exit driveway directly from Apollo Drive. As indicated in the City Engineer's memorandum, approval for this access must be obtained from Anoka County. The applicant has submitted a separate application to Anoka County; however comments have not been made available at the time of this report. Lighting The photometric lighting plan submitted with the application is incomplete; at this point it only depicts the entry drive lighting and the lighting for the hotel property. As the setback for the hotel will be matched by the other buildings on site, it can be deduced that the lighting plan can be made to comply for the entire site. Staff is still asking that the plan be redone to incorporate all of the lighting on site known at this time, such as the parking lot lighting and the lighting on the buildings as shown on the site plan. The applicant has submitted some cut - sheets for lighting fixtures. This is a good start, however staff has requested that the applicant include very specific details about the types of lighting fixtures in the architectural design standards for the site. This will eliminate any questions in regards to the lighting, and keep a uniform look to the site no matter when each lot is developed. Signage As the applicant is proposing multi- tenant buildings, and the architectural design standards for the site are •esigned to create a cohesive design throughout the entire commercial center, city staff has asked the applicant to create a sign plan for the entire site that will clearly define the types, location, and allotment of signs within the center. This plan has yet to be submitted at this time. Trash / Mechanical Equipment The site plans submitted with this application do not clearly depict a location for trash enclosures, or the location of mechanical equipment. However, in meetings held between city staff and the developer, the developer agreed to include specific language within the architectural design standards that would address both issues. Trash enclosures will be required to be built into the buildings with roll up (garage) doors for access. This will eliminate the need for the accessory trash enclosures that detract from the aesthetics of the entire site. Mechanical equipment will need to be completely screened from the view of the right of way and the neighboring properties. The six foot high fence proposed around the majority of the property should do this rather effectively, with the exception of the view from Apollo Drive. All mechanical equipment and utility boxes located on the ground should be placed to be visible only from within the center, or should be effectively screened by either screen walls or appropriate landscaping materials. All roof mounted mechanical equipment should be architecturally screened by the roof structure or parapet walls. This will need to be included in the architectural design standards developed for the site. • Apollo Landing, page 6 U� Water and Sanitary sewer service are available within the Apollo Drive right -of -way. The submitted utility plans depict an existing tie in to the Apollo Drive trunk that ends at the corner of the neighboring property to the east. Further staff investigation is underway to either confirm or deny its existence. If it does not exist the Developer will have to adjust the layout of the utilities to keep them entirely on his own property, unless appropriate easements are granted by the neighboring property owner. Stormwater management The City Engineer has reviewed the submitted grading and drainage plan, and his memorandum is attached to this report. The plan is subject to review and approval from the Rice Creek Watershed District. The city hasn't received any comments from the Rice Creek Watershed District at this point. ENVIRONMENTAL BOARD The Environmental Board reviewed this application at the February 23, 2005 regular meeting. There recommendations were numerous and are attached to this report. OPTIONS Ili1. It is not the intent to allow for reductions or waivers to standard zoning requirements solely for the purpose of increasing overall density or allowing development that otherwise could not be approved The PUD process encourages the following: 1. Flexibility in land development and redevelopment in order to utilize new techniques of building, design, construction and land development. Approval of this development will allow for the redevelopment of a single family farmstead with restricted access into a viable commercial development with a combined access. 2. Energy conservation through the use of more efficient building designs' and siting and the clustering of buildings and land uses. The existing pond was constructed to manage stormwater runoff from a total of 15.2 acres of drainage area including part of Apollo Drive and the easterly part of this site. Future expansion of this pond will manage runoff from an additional 12.0 acres of drainage area from the northwest, including the westerly part of this site. The sizing of this pond was computed by the City's consultant SEH in 1998. This sizing anticipated that projects in the ultimate drainage area would be developed with up to 75% impervious area. In this project, the storm water pond will be enlarged to full design capacity, as sized by SEH. It will then be able to manage stormwater runoff of a total of 27.2 acres of drainage area, including the entire area of this site, under ultimate development conditions. This includes the five buildings, their associated parking lots, and the main access drive through the site. UTILITY DESIGN Watermain and sanitary sewer lines are being extended from Apollo Drive into the site and have been sized to conform to the City of Lino Lakes standards. Three fire hydrants will be dispersed throughout the site to provide proper fire protection for all of the proposed buildings. Small utilities (gas, electric, phone and cable) will be extended into the site via joint trenching and coordinated with the various small utility vendors. LANDSCAPING AND AESTHETICS Entry into the site will be facilitated by a large Pylon sign at the entrance, listing the businesses within. Upon tuming into the site, a user will be visually lead down the tree -lined main drive 41/ to the 4 -story hotel at the temiinus. Off to the left will be a restaurant overlooking the pond. while off to the right will be a cluster of 3 office/commerciaUretail /specialty_ school/service buildings. General site landscaping will include screening at property lines with plantings and fencing for security and privacy separation. Individual buildings and their respective parking areas will be landscaped on an individual basis with sprinkled planting beds. BUILDING DESIGN STANDARDS The design features of the individual buildings will include a select variety of design materials which will feature of a combination of natural earth tones with appropriate accent colors, together in a very distinct handsome architectural style that is in scale with the site and the surrounding land uses. An Apollo Landing Architectural Review Committee will be established and will be empowered with a review authority through restrictive covenants on the individi La1 properties to insure compliance with the proposed commercial neighborhood architectural design theme. All proposed buildings will be required to create a pedestrian friendly streetscape image. Limitations will be created for detached accessory structures. • Building massing for all individual buildings and for the arrangement on the site will combine with landscape elements to highlight entry and sequence. Each building's exterior elevation will work within the time honored aesthetic vocabulary of 3 part composition. A base, middle, and top will each be articulated to give clarity to the buildings as well as tie all elements of the site together in a simple cohesive composition. In addition, each building will have 3- dimensional offsets in order to break down its massing. Color and texture will be used to denote these differences. The proposed development would essentially consist of five separate buildings of varied types of use (hotel, restaurant, office /retail, office /commercial) on an 8.1 acre site. The following documents have been received: 1. Full -size and Half -size plan Sheets (7 sheets), prepared by Mattke Surveying and Engineering, Inc., all received by the City of Lino Lakes February 7, 2005. 2. Letter from Mattke Surveying and Engineering, Inc. to the City of Lino Lakes, dated December 4, 2004. 3. Letter from Mattke Surveying and Engineering, Inc. to the Rice Creek Watershed District, dated February 4, 2005. 4. Drainage Calculations dated February 2, 2005. 5. Traffic Study dated February 4, 2005, prepared by Bonestroo, Rosene, Anderlik, and Associates 6. Geotechnical Report dated January 31, 2005, prepared by Stork Twin City Testing Corporation. Executive Summary Following is a general summary of the main items and issues that must be addressed. Further explanation of these items and additional items to be addressed are provided in the remainder of this review memorandum. 1. Drainage Calculations have been received and reviewed, but are not complete. Original drainage calculations performed for Apollo Drive Phase II (by S.E.H., Inc., May 1999) have also been obtained. The applicant must provide the full calculations as explained detailed further in this memorandum. The Traffic Study has been reviewed and comments are provided within this memorandum. Generally, the data and conclusions provided in the report are not complete and the applicant has been requested to re -work the study. 3. The utility plan provided is not considered to be complete for construction purposes at this time. However, the utility plan as presented in concept is acceptable, and the comments provided herein are based upon the extent of plans completed to date. For example, storm sewer pipe sizes and structure invert and rim elevations are not provided. Standard utility plates, details, construction notes, provisions for erosion control, etc. must all eventually be provided as well. 4. The applicant has provided copies of correspondence to the Rice Creek Watershed District (RCWD). The applicant shall be responsible for assuring compliance with the RCWD accordingly. 5. The proposed site development is located adjacent to two County roadways. The plat and site plan will therefore require the review and approval of Anoka County, both for the plat itself and with regards to driveway and site access. It is likely that the County will have comments with regards to right of way dedication and access from Apollo Drive. 6. Drainage and utility easements must be provided on the Preliminary Plat as described herein. Drainage 1. The first floor elevations shown for the proposed buildings would appear to be acceptable based on the information provided. However, because actual building plans are not provided, it is not known if there are proposed to be basements, lower openings, etc. In accordance with City standards, the lowest floor elevation must meet the City's minimum requirement of 2 feet above the 100 year flood level, 4 feet above normal water elevations and groundwater, and at least one foot over the emergency overflow elevation. The actual overflow location and elevation for Pond 1 must be provided on the plan. 2. The full Hydro -Cad calculations must be provided by the applicant so that they can be verified further against the previous design parameters provided in the S.E.H. calculations. At this time, only portions have been provided. Support computations are also needed for the stage- discharge used in the Hydro -Cad model 3. Floor and /or any low opening elevations for the existing building directly to the west must be verified against the 100 -year and overflow elevations. Based on the information provided, it would appear that the 100 -year elevation of the pond may be higher than the building's low floor. 4. Per correspondence provided with RCWD, the applicant is incorporating the use of infiltration basins on the site prior to discharge to the pond. This will aid in providing effective stormwater management and water quality, as discharge from the pond into the storm sewer system running • south down Apollo Drive (as shown) shall be limited to the originally designed system limits. The plans must ultimately receive final approval of the Rice Creek Watershed District. • Apollo Landing /Equinox Page 3 March 4, 2005 City of Lino Lakes, Minnesota 5. Long term maintenance responsibilities for the pond and infiltration areas must be eventually be clearly assigned in an Agreement between the City and applicant/future property owner. 6. An NPDES Phase II permit shall be required. All requirements of the Permit, including the submittal of a Storm Water Pollution Prevention Plan (SWPPP) to the City, shall be completed prior to engaging in grading activities. Utilities 1. An internal sanitary sewer main is intended to serve the properties and connect to an existing 6 -inch service at Apollo Drive. The existing 6 -inch PVC connects to an existing 21 -inch trunk main running down Apollo Drive. The existing manhole and service at the property line should be inspected to verify the condition and elevation of the existing facilities, and that sufficient elevation difference above the 21 -inch main exists. This may be critical since the flow directions of the trunk main and the service appear to be in opposite directions. The sewer main itself must be at least 8 -inch diameter in accordance with City standards. 2. It is proposed to connect a water main to the existing 12 -inch diameter main on Apollo Drive. No size for the main is shown, and it must be a minimum of 8 -inch diameter. Provisions must be included in the plans for wet tapping to the 12 -inch main and for the connection near the center of Apollo Drive. A permit from the County and establishment of traffic and safety control measures during construction, and repair of the street will be required in accordance with County standards. 3. Individual sewer and water services are not shown on the plan. All trenches (including services) shall be backfilled and compacted and meet 100% maximum Standard Proctor Density in the upper 3 -feet from finished road elevation, and 95% maximum Standard Proctor Density below the upper 3 -feet. 4. A minimum of two feet of cover over storm sewer pipe is desired. 5. Utility easements must be dedicated for the water and sanitary sewer mains extending into the property. 6. An extension from the proposed sewer main to the neighboring property (west) may be considered as feasible. Other 1. Long term maintenance responsibilities for the development area, including the detention areas must be addressed appropriately in an agreement between the Developer and the City. 2. Apollo Drive and Lilac Drive are under the jurisdiction of Anoka County. The plat and site plans will therefore require the review and approval of Anoka County, both for the plat itself and with regards to driveway and site access. It is likely that the County will have comments with regards to right of way dedication and access from Apollo Drive. Typically, the County has requested right of way dedication of up to 60 feet from the center of a roadway, and it is likely that an Agreement with the County will be needed. 3. The proposed driveway entrance will also require a permit from the County. The County may have additional comments with regards to the driveway location, width, turning lanes, etc. 4. Drainage and utility easements must be provided around all detention and infiltration areas. In addition, the drive easement should also be designated as a drainage and utility easement. Platted drainage and utility easements adjacent to property lines (10 feet) must also be provided per City requirements. 5. A proposed site landscaping plan has been provided. Screening from adjacent properties is proposed by the use of a Wood Privacy Fence, subject to approval by the City. The Landscape Plan should either include or refer to the Grading Plan the proper establishment around the ponds and infiltration areas. 6. Soil borings generally indicate a soil profile of topsoil underlain by coarse alluvium. For the building foundation and roadway and parking area subgrades, varying amounts of engineering fill and granular material will be required. Recommendations as provided in the Geotechnical Report must be provided throughout construction. 7. In addition to trees and vegetation, the existing site contains various remains of structures and facilities from previous site use (foundations, silos, etc.). All above and below ground abandoned facilities must be removed from site and disposed properly. The removal of any septic, well or other such facilities shall be also subject to the rules and regulations of the State of Minnesota and /or Anoka County as required. 8. A Traffic Study has been reviewed as referenced above. The review found several concerns regarding project trip generation and the level of service analysis which will need to be addressed prior to final review and concurrence with the BRAA finding of no significant traffic impacts. Comments on the study are as follows: 1. Projected Trip Generation • Table 5 of the traffic study memorandum displays projected trips to be generated by the proposed development. There are shown to be about 35% reductions in total a.m. and p.m. peak hour trips generated due to pass -by and multi -use trips; however, the underlying assumptions for these reductions are not provided, nor are there any data that demonstrate what pass -by or multi -use trips were added to turn movements at specific intersections. Similarly, there is no accounting for the diverted trips that would be attracted from I -35W to the new businesses at the development site. These details must be provided before the review of this study can be completed. • 'Apollo Landing /Equinox Page 5 March 4, 2005 City of Lino Lakes, Minnesota • • New project trips shown in the last row of Table 5 are not consistent with intersection movement totals on Figure 5 (Year 2007 With Apollo Landing Development) and Figure 4 (Year 2007 Without Apollo Landing Development) for the a.m. and p.m. peak hours. The new trips shown on Table 5 should equal the difference between the turn movement volumes from Figure 5 and Figure 4 for the affected movements. These numbers should be consistent to ensure the appropriate turn volumes were used in the level of service analyses. • A comparison of turn volumes from Figures 4 and 5 indicates a reduction of 70 p.m. peak southbound right turns at CSAH 23 /CR 12 under the "With- Project" scenario. This is most likely an error, as this turn movement would be expected to increase with the addition of project - generated trips. • The peak hour trips projected for the hotel are slightly lower than would be predicted using the Institute for Transportation Engineers Trip Generation handbook for an 80 -room hotel. The correct totals should be 45 a.m. peak hour trips and 49 p.m. peak hour trips. • The peak trip generator for a.m. peak hour is the 100% office scenario. This office -only scenario should be analyzed for the a.m. peak hour to establish a "worst- case" analysis during the morning peak. • 2. Future With- Project Levels of Service • Table 6 in the traffic study memorandum should include intersection approach levels of service. • The level of service analysis for with- project conditions shown in Table 6 indicates when compared to the without - project levels of service in Table 3, indicates that some turn movement LOS is estimated to improve under the with - project scenario. Specifically, at CR 23 /CR 12 in the p.m. peak hour, the northbound right turn is projected to improve from LOS B to LOS A, the southbound and eastbound left turns are shown to improve from LOS D to LOS C, and the eastbound right turn would improve from LOS C to LOS B. In addition, the northbound through and southbound left movements at CR12 /CR 153 are shown to improve from LOS A to LOS B in the p.m. peak hour. These results are not consistent with what would be expected under a with - project scenario with the addition of project trips and turn movements to the system. The size and varied uses of the site suggest that at peak periods, a fair amount of traffic will be present internally. Although, there appears to be good circulation within the site itself, the presence of a single access point may cause periodic congestion at the entrance, depending on the types of businesses established. • • • Recommendations Of the February 23, 2005 Environmental Board Apollo Landing /Equinox Development/Environmental Site Plan Review The February 23, 2005 Lino Lakes Environmental Board made the following recommendations concerning Apollo Landing: Motion to approve the rezoning of the land with the condition of the Environmental Board future review of PUD and review each PUD phase level by O'Connell, 2nd by Baumann. All were in favor. Marshan Meadows, Bruggeman Properties, 7364 Lake Drive, Preliminary Plat Review. The February 23, 2005 Environmental Board made the following recommendations concerning Marshan Meadows: • Surface Water Plan should show access for pond and infiltration area maintenance. • Surface Water volume calculations for pond and infiltration areas should be verified for adequacy. • Investigate removing storm pipe going into the lake and replace with a swale /rain swale design. • Direct all water from impervious areas to pervious. • Plan must address the 200 -foot area along the lake in terms of NPDES requirements that slopes be stabilized within 7 days in disturbance areas. • A temporary sediment pond diverting water on the SE side of the project would address BMP concerns for containing eroded materials. • A Conservation Easement should be described, for the Shoreland impact zone and the surface water treatment areas. • Signage should be placed at the easement areas describing wetland conservation, no mow, no dumping areas, as well as important natural considerations such as nesting water birds and Blandings Turtle. • An information brochure should be published and given to all property owners describing the Classification and nature of Marshan Lake and that appropriate boating should be confined to non - motorized uses. It should also describe rare species habitat considerations for the area, and conservation easement requirements. • Ponding and infiltration areas should be planted with the City native seed mix. Planting soils should not be incorporated into these areas in order to preserve areas that turtles might still nest. • Curbing in the project should be designed so that turtles can cross roads. (The Lino Lakes Blandings Turtle Modal shows this area as a possible breeding site.) • • • • Transitional native seed mix should be used for 8 -10 feet from all sodded areas. A seed such as Blue gramma should be used for this. • Developer should submit a detailed NPDES plan for using BMP's on this site. For example, the rock entrance should say, "at least 50 feet of rock entrance shall be placed." The developer should indicate where on site the NPDS plan and inspection reports would be located on site. The title commitment for the property and final plat have been forwarded to the City Attorney for review. As required under the conditions of preliminary plat approval, the applicant has submitted a Rice Creek Watershed permit. Another condition of approval requires that right of access be granted to Anoka County. This is not currently shown on the final plat; but will be required prior to the item being scheduled for the City Council. B • STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: March9�, 2005 TOPIC: Temporary Signage BACKGROUND The P & Z has been discussing the issue of temporary signage since January 2003. The purpose is to prepare an amendment to the sign ordinance to clearly address the issues involved. We have made progress by agreeing on how to regulate portable signs and banners. Several other temporary signage issues still remain before we prepare an ordinance amendment. DISCUSSION Portable Signs and Banners: The P & Z agreed on requirements for portable signs and banners. Those requirements will be incorporated into a sign ordinance amendment. Window Signs: The P & Z agreed that window signs inside the building will not be regulated except that flashing window signs are not to be allowed. Stringers: At the January meeting, we discussed "stringers ", also known as pennants or other names. These are the small flags or garland type devices in long strings. The most common location for these is car lots. I suggest the following definition: Pennants or Stringers: Any lightweight plastic, fabric, or other material, whether or not containing a message of any kind, suspended from a rope, wire, or string, usually in series, designed to move in the wind. The P & Z considered how to regulate these, with three options being offered: 1. Pennants are to be regulated with a temporary permit with the same requirements as banners and portable signs for duration and number of occurrences. (Measuring the square footage would be impossible for some strings.) 2. Pennants are to be allowed without regulation: they are not significant enough to worry about. • • Temporary Signage page 2 3. Pennants are to be prohibited altogether. Rows of flapping pennants contribute to streetscape clutter and do not communicate any essential message other than "look at me ". We need to come to an agreement on pennants. Miscellaneous Cardboard and Other Non - permanent Signs: Several businesses use non - permanent signs made of cardboard and other inexpensive material. These signs commonly advertise prices of goods such as cigarettes, soft drinks, and the like. The signs often are attached to permanent fixtures such as pylon signs, or to temporary stakes or posts. These signs often are left on the property for lengthy periods of time. When multiple signs are used, the property looks cluttered and unsightly. There are several options for addressing these non - permanent signs: 1. Prohibit them completely. The reasoning here would be that these inexpensive signs often are used in such number as to create an eyesore. There are options for posting temporary prices, sales, etc., in the form of temporary sign permits for banners or portable signs. 2. Allow them without regulation. • The reasoning here would be that these signs, while there may be many of them on a site, are small and do not constitute enough of a visual blight to worry about. • 3. Regulate the amount of such signage on a property. Theoretically, this could done be by total square footage or by the number of such signs. However, the difficulty in enforcing such requirements is obvious — imagine measuring the size of all such signs on a property and calculating the total. The next day, three of the six cardboard signs may change. Counting the number of them is the other option, but the same difficulties arise. Staff would recommend either banning these signs or allowing them without permits. Enforcement: We intend to prepare an ordinance amendment that addresses all the temporary signage issues as agreed upon by the P& Z. In response to the request from the P & Z, the Building Official has been instructed to enforce the existing ordinance in the interim. Another set of letters went out recently. RECOMMENDATION Arrive at agreement on: (a) pennants, and; (b) miscellaneous signs.
