CALL TO ORDER AND ROLL CALL Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at 6:32 p.m., May 11, 2005. II. APPROVAL OF AGENDA Chair Rafferty added the VFW property to the end of the agenda. III. APPROVAL OF MINUTES: April 13, 2005 Chair Rafferty requested the following change: Page 5, third paragraph from the bottom, last sentence to read: He thanked the Board for their work on this development and agreed with Mr. Pogalz comments regarding the screening, but expressed concern that although this was in written form, there were no visual plans and the Board really needed to address it visually and not leave it to the unknown. Mr. Tralle made a MOTION to approve the April 13, 2005 Minutes as amended and was supported by Mr. Laden. Motion carried 6 -0. IV. OPEN MIKE Chair Rafferty declared open mike open at 6:35 p.m. There was no one present for Open Mike • Mr. Pogalz made a MOTION to close Open Mike at 6:36 p.m., and was supported by Mr. Hyden. Motion carried 6 -0. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 2 V. ACTION ITEMS A. Final Plat for Legacy at Woods Edge, Village No. 3, located at the SE intersection of Lake Drive and I -35W Staff stated that the applicant had submitted the final plat for Village No. 3, which encompasses the Legacy at Wood's Edge project area. The submitted plat depicts three lots and five outlots. He indicated the final plat conforms to the preliminary plat layout approved with Resolution 04 -33 by the City Council on March 8, 2004. The title commitment for the property and final plat has been forwarded to the City Attorney for review. As required by the Development Agreement, the village green is being dedicated as public park, and outlot C which includes the wetland area will be deeded over to the City. A trail easement is required on the south side of Lots 1 and 2, but the exact location and size has not yet been determined by the City's consulting engineer for this project. Staff is recommending that the street names be altered prior to the plat being scheduled for the City Council. Particularly, the use of the eastern most segment of Town Center Parkway should be changed to Woods Edge Boulevard, and the existing Woods Edge Boulevard should be changed to Village Drive. Village Green should be eliminated as that section is not a full street but rather the south half of what will be Village Drive divided by the Village Green park which is essentially an enlarged boulevard between two lanes of traffic. Staff was recommending approval subject to the following conditions: 1. The eastern most segment of Town Center Parkway must be renamed Woods Edge Boulevard prior to this item being scheduled by the City Council. 2. Woods Edge Boulevard must be renamed as an extension of Village Drive prior to this item being scheduled for the City Council. 3. Village Green must be renamed as an extension of Village Drive prior to this item being scheduled for the City Council. Chair Rafferty asked if the right angles of the roads being proposed were a benefit or a detriment to this development. Mr. Bengtson replied this did conform to the Master Plan that had been approved and the plans had been reviewed by the Consulting Engineer. Mr. Studenski replied those were the right -of -way areas so it did not imply specifically that the roads would be applied in that way. He stated they would soften the radiuses if necessary, but they felt confident this proposal would work. Mr. Pogalz made a MOTION to recommend approval of the Final Plat for Legacy at Woods Edge, Village No. 3, located at the SE intersection of Lake Drive and I -35W subject to the conditions as noted in staff's May 11, 2005 report and was supported by Mr. Tralle. CONTINUED PUBLIC HEARING for a Conditional Use Permit Amendment to allow for an awning at Rehbein Transit, 6298 Hodgson Road • • Chair Rafferty continued the Public Hearing at 6:43 p.m. Staff stated Rehbein Transportation is proposing an 8 foot x 100 foot awning addition to the north side of the existing facilities at 6298 Hodgson Road. The Rehbein property is covered by a conditional use permit for the existing bus transit center. Building additions much as those proposed in this application require an amendment to the Conditional Use Permit. Construction of the addition was begun prior to the issuance of the appropriate building permits or this application and was stopped by the City's Building Department. No further construction has taken place after the first warning was issued by a building inspector. Under the new zoning ordinances, the site plan review is done administratively. However, a Conditional Use Permit amendment is necessary, and a site plan review is part of the CUP review. Because this application involves the CUP amendment, it is also appropriate to review the conditions placed on the site through the last CUP amendment in 1999. This application was continued at the April 13, 2005 regular meeting so the applicant could be present to answer questions in regards to future plans for the site as well as the intended use of the canopy addition. Staff recommended approval of the CUP subject to the following conditions: 1. Construction must comply with the requirements of the Centennial Fire department, including the connection of the existing buildings to municipal water for fire sprinkling. 2. A performance agreement between the City and the developer must be executed prior to the issuance of any building permits for the subject site. 3. A lighting plan in conformance with the zoning code must be submitted for review and approval by staff prior to the issuance of building permits. 4. The proposed addition is subject to double permit fees as construction was begun prior to the issuance of any building permits. 5. No outdoor storage of materials shall be allowed under the canopy. Mr. Nelson stated he did not believe the applicant was in compliance with the lighting requirements. Mr. Bengtson replied they did not have a lighting plan to review to determine if those lights were a part of the last CUP, or if they were already in existence. Mr. Nelson stated he understood that all lighting needed to be directed downward and this had not been done. Mr. Bengtson replied he was not sure how this was enforced at the time, but they were given a Certificate of Occupancy for the building. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 4 Chair Rafferty noted condition three addressed the lighting. He asked if a lighting plan would be submitted. Mr. Bengtson replied they were only looking at this addition and not the entire site. He stated staff would not typically retroactively review the entire site. Mr. Tralle noted this had been tabled for a month and it gave applicant the opportunity to come into compliance with the conditions, which he did not do. He indicated he was not comfortable approving this because he had not met the conditions of the first CUP, including fire sprinkling. Mr. Bengtson replied that the applicant had indicated there would not be additional lighting with this proposal and they were going to comply with the fire sprinkling requirement. Mr. Tralle noted recommendation three was the same in this request as it was in the previous CUP. Mr. Root stated he had the same concerns previously mentioned. He asked if it was appropriate to review the performance of the current situation versus the requirements of the 1999 CUP to see if there were any violations to the previous conditions before they moved forward. Mr. Bengtson replied the Board could look at the previous situation if they wanted. Mr. Root asked if the Board could add the previous conditions to the proposed new conditions. Mr. Bengtson replied that could be done. Mr. Pogalz asked if the applicant would be reimbursed for any cost associated with obtaining a photometric plan if it was determined the lighting was in compliance. Mr. Bengtson stated that the applicant would not be reimbursed. Chair Rafferty invited applicant to make comment. Reid Rehbein, 6298 Hodgson Road, stated the lighting was already there and he did not see any reason for a lighting plan. Mr. Laden asked if he understood the residents had problems with their lighting. Mr. Rehbein replied they had not had complaints since they had angled the lighting down. He asked if they wanted to change the lighting. Mr. Laden replied the Board wanted to review the lighting. Mr. Tralle stated he understood they had lights going into the residential properties and they needed to bring these lights into compliance. Mr. Rehbein replied he could tear the lights down, but noted he did not know the residents had a problem with the lights. He stated he has not had a complaint in 8 years. Mr. Nelson stated he lived in the neighborhood and there were a lot of complaints that he has heard. He stated he did not believe the lights were aimed downward, but were aimed outward. DRAFT MINUTES • • • • Planning & Zoning Board May 11, 2005 Page 5 Mr. Rehbein stated if the City had received complaints, they were never conveyed to him. He indicated he could take the lights down and place them on the edge of the property facing inward. Mr. Nelson replied he believed that would solve the lighting issue. Mr. Laden asked what was the purpose and intent of the awning. Mr. Rehbein stated they had a smaller awning and they wanted a new awning to cover the drain oil tank and electrical box to protect them from the elements. He stated the new awning would keep the ice and snow off of the tank and electrical box. He indicated there would not be anything stored under the awning except the tank and electrical box. Mr. Pogalz asked what the Fire Department said about not having a concrete containment system on the tank. Mr. Rehbein replied it was a double walled tank and it was in compliance with all of the State Codes, as well as it being on a concrete slab. Mr.. Pogalz asked if he was willing to take down the existing lighting and replace it with new lighting. Mr. Rehbein replied he was willing to do that and it would not be an expensive proposition to do that. Mr. Laden asked if the lights would be shielded. Mr. Rehbein stated he did not know this, but they were rectangular boxes. Mr. Nelson noted there was a light on the south side of the property that was not shielded • that he wanted a shield put on. • Mr. Bengston stated staff would work with applicant to submit a lighting plan that would be in compliance with City standards prior to the City Council meeting. Mr. Laden stated the City Comprehensive Plan stated it was the intent to eventually relocate this business. He asked if Mr. Rehbein had been informed of this. Mr. Rehbein replied he had heard of this proposal, but he did not have any further information and they had no immediate plans to move at this time. Mr. Hyden asked if Mr. Rehbein had any problem with staff's recommendations. Mr. Rebhein replied he had no issues with the conditions and they would meet them, including hooking up the fire sprinkling system. Chair Rafferty invited anyone for or against this CUP to make comments. There were no further comments made. Mr. Laden made a MOTION to close the public hearing at 7:12 p.m. and was supported by Mr. Hyden. Motion carried 6 -0. Mr. Hyden asked if they needed to add a number six addressing the lighting. Mr. Bengtson revised condition number 3 to read: Prior to this item being scheduled for the City Council a lighting plan for the entire site must be submitted for review. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 6 Mr. Root revised condition 2 to read: A performance agreement with appropriate financial sureties between the City and the developer must be executed prior to the issuance of any building permits for the subject site. Mr. Root made a MOTION to recommend approval of a Conditional Use Permit Amendment to allow for an awning at Rehbein Transit, 6298 Hodgson Road, subject to the conditions as noted in staff's May 11, 2005 report and was supported by Mr. Nelson. Motion carried 6 -0. C. PUBLIC HEARING for a PUD Development Stage Plan/Preliminary Plat approval for Settings of Woods Edge, located in the Legacy at Woods Edge, at the SE intersection of Lake Drive and I -35W Staff stated the Community Development Department received an application for a Development Stage Plan/Preliminary Plat for 157 unit condominium (townhome) development in the Legacy of Wood's Edge master plan area south of 35W and east of Lake Drive. This application was added to the agenda at that time so the appropriate public notices could be made in the newspaper as well as to the surrounding property owners. In the time following the notifications, City staff has had more time to review the application materials and it was determined that not only is the application incomplete, there are also significant issues in regards to meeting the development standards for the site. Staff has sent a letter outlining the information that is still needed to complete the application, as well as the large number of issues that still need to be worked out prior to scheduling this item for another Planning and Zoning Board meeting. Therefore, the 120 day review period has not begun and will not be an issue in the ongoing review of the proj ect. As soon as the application is complete and ready for review it will be added to the next available Planning and Zoning board meeting agenda. Staff is therefore, recommending that this item be tabled without opening the public hearing or any discussion before the Board. The Board tabled this item. D. PUBLIC HEARING for an Amendment to Planned Unit Development and Preliminary Plat for Marketplace Third Addition, located at the NE corner of Lake Drive and Apollo Drive Chair Rafferty opened the public hearing at 7:17 p.m. Staff stated Ryan Companies is proposing to amend the existing Planned Unit Development (Planned Development Overlay) for the Marketplace to combine what was originally planned and platted (The Marketplace) as four lots with individual commercial DRAFT MINUTES • • • 4 • Planning & Zoning Board May 11, 2005 Page 7 buildings into two lots. Lot 1 would then be developed with a 14,000 square foot commercial building and Lot 2 would be reserved for two future users. This request requires amending the existing Planned Unit Development to allow different building types and site layouts to be used. The request also requires a new Development Stage Plan/Preliminary Plat and eventually Final Plat to change the lot configuration. The focus of the application will be the building for Lot 1, however, periodically references will be made to the buildings on Lot 2 since they will need to be appropriately addressed in the design standards for their future development. Staff presented their analysis and recommended approval subject to the following conditions: 1. The site plan must be revised to include a landscape /pedestrian circulation island in the middle of the double parking aisle for Lot 1. 2. A minimum of six shade trees must be added to the west side of the building along the street. 3. The architectural design standards approved as a part of this application must be supplied to each incoming tenant upon signature of a lease. 4. A development agreement must be executed between the developer and the City prior to the execution of a final plat for the site. 5. Appropriate drainage and utility easements must be shown on the final plat. 6. All lighting fixtures used on the site must be in conformance with the design standards. 7. The trash enclosure must be large enough to house both trash receptacles and recycling receptacles. 8. The trash enclosure must be constructed with the same materials as the proposed building. 9. The decorative lighting for this site and all other developed sites within the Marketplace must be installed prior to the issuance of a certificate of occupancy for the multi -tenant building on Lot 1. 10. The elevations must be enhanced with a stronger cornice element along the entire roof line. 11. The sunshade device proposed for the building must be similar in style to that of the example submitted for the North Carolina project, but shall be limited to three foot maximum extension from the face of the building. 12. The applicant must submit a revised plan set prior to the scheduling of this item for the City Council that incorporates all of the changes required by these conditions of approval. Mr. Root asked how the sidewalks would connect to the other portions of the site. Mr. Bengtson responded the entire building was surrounded by a sidewalk in addition to adding a sidewalk for the people who parked on the far side of the building. • Mr. Root asked if someone could park in one place and get around without it being dangerous for them. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 8 Mr. Laden noted this site was in the middle of the other retail sites and he believed it was the original intent to connect everything with sidewalks. Mr. Bengston replied staff could work with the applicant to make this a pedestrian friendly site. Mr. Root stated they needed to have pedestrian connections and without that he could not vote in favor of this. Mr. Pogalz stated he would also like a pedestrian walk along the auto service and restaurant portion of the site. Mr. Bengtson stated that the layout would be reviewed when the site plan was presented and pedestrian walkways could be added at that time. Mr. Laden asked what prompted the change in direction from the original site concept. Mr. Bengtson replied he would ask applicant to answer that question. Chair Rafferty invited applicant to make comment. Steve Broyer, Civil Engineer for applicant, stated they agreed with the linking of Kohls to the retail site and he did not believe there would be any issues with that. He stated he also did not have any problems linking the auto service and restaurant to this development. He noted they were relocating the storm sewer, but this would be an issue to be required the six to seven over story trees over the sewer system. He asked if they could have that requirement removed from the conditions. Mr. Tralle noted on the original plan, pedestrians could go building to building and it was more of a better flow. He stated he liked the front of the building, but he did not like the back of the building facing the way it was. He indicated he liked the concept of smaller buildings, rather than one larger strip mall. He stated he did not like this plan. Mr. Laden asked what had changed the concept of this site to this strip mall. Mark Kampmeyer, Ryan Companies, stated the original plan had six buildings, but they had come to the conclusion that there were not enough tenants to fill these buildings, so they reduced the size of the development and were proposing one strip mall. He noted market change was what drove this site plan. He asked if they could have some kind of landscape considerations to hide the back of the building. He stated that he understood their concerns with the building. Mr. Tralle expressed concern that this building was facing backwards and the tenants might have issues with signage. He noted they should not be looking at the back end of buildings when they were on a busy street. Mr. Laden stated he did not have a problem combining the buildings, but they needed to look at a different model for this site. He stated he would like to see store fronts on both sides, such as what they had at The Village in Blaine. He believed this type of a design would work on this site. He noted if they had some type of this design, he would be in favor of this, but as it was being proposed, he could not support it. Mr. Tralle noted even if they had some type of a center area, it would be better than what was being proposed. DRAFT MINUTES • • • • • Planning & Zoning Board May 11, 2005 Page 9 Mr. Kampmeyer noted there had to be a back of the building somewhere, but they could look at options. He noted no matter which way they faced the building someone would have to look at the back of it. Mr. Tralle asked what types of businesses the tenants would be. Mr. Kampmeyer replied hair care, services uses (dental, medical), food services, etc. Chair Rafferty asked them to be creative in their design. He noted Lake Drive was important and the back of the building should not face Lake Drive. Mr. Kampmeyer stated The Blaine Village had a number of big box retailers, so smaller retailers were more willing to fill in the gaps. He noted The Marketplace was quite a bit smaller in scope and its drawing power, so it was difficult to design the same type of buildings as The Blaine Village had because the smaller tenants did not want to pay for the expense of having two storefronts. He indicated they wanted to work with the Board. Mr. Hyden suggested they "fold the building in half' so there were businesses on both sides. He stated they did not want to look at a long back of a building. He noted businesses on both sides would be different, so they would not have two store fronts. He indicated as the mass started accumulating, they would have additional space to add another building. Mr. Laden stated they needed to look at a different model of a strip mall than what was being proposed. He indicated the building was attractive, but a different model was more appropriate to this site. Mr. Hyden understood a business having two storefronts was expensive for a tenant. Mr. Kampmeyer stated all of these ideas were good and he would have his architect investigate these comments and see if they can come up with a better proposal. Mr. Pogalz stated the only function the back of the building served as egress and he believed they could "fold the building" with a center corridor. He stated The Blaine Village worked well because the stores were anchored either on one end or both ends with a restaurant, or other major retail area. He noted by having a restaurant the key tenant at one end, he believed this proposal could work. Chair Rafferty believed Mr. Hyden's suggestion was a good one and there was a lot of merit to that suggestion. He noted the City needed to understand that if they were patient, they would have a much stronger market place. He stated it was important to get the trash facility inside the building and not have it a freestanding structure also. Mr. Laden stated one of the things that made The Blaine Village successful was that it was pedestrian friendly and that element had to be added back to this site plan. Mr. Kampmeyer stated they would look at their plan again and see what options they had. • Mr. Tralle stated he personally liked the building, but not in this location. Chair Rafferty invited anyone for or against the PUD to make comment. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 10 There were no further comments made. Mr. Pogalz stated applicant should look at the whole site also, including the restaurant and auto service site to determine those uses. Mr. Hyden suggested they flip flop the restaurant site and the auto service site. Mr. Laden made a MOTION to continue the public hearing and was supported by Mr. Hyden. Motion carried 6 -0. E. PUBLIC HEARING for a Conditional Use Permit for Northern Lights Car Wash, located at 7990 Lake Drive Staff stated the Community Development Department received an application for a Conditional Use Permit for an automated car wash on the southeast corner of Lake Drive and Main Street. This application was deemed to be complete and was added to this agenda at this time. The public hearing was noticed and printed in the appropriate newspaper outlet and mailings were sent to surrounding property owners. The applicant, Kevin Irlbeck, has now requested that this application be tabled indefinitely to do further study on the feasibility of the project. He has granted the City an indefinite extension of time on the application, so staff is in agreement with the request of the applicant. The applicant will need to inform the City in writing of his decision to either continue with this application or withdraw it from consideration. If he chooses to continue with the request, it will then be added to the next available Planning and Zoning Board agenda. The Board indefinitely tabled this item. F. Final Plat for Angie's Acres, Al Powers, 290 Elm Street Staff stated A and J Properties have requested approval of a single - family residential development entitled Angie's Acres. The subject property is adjacent to the southeast corner of Elm Street and Rice Lake Lane and is currently developed with one single - family dwelling which will remain. The final plat conforms to the preliminary plat layout approved with Resolution 05 -29 by the City Council on March 14, 2005. The title commitment for the property and the final plat has been forwarded to the City Attorney for review and are acceptable. All conditions of approval from the preliminary plat will be met through the Development Agreement and building permit review processes. Mr. Pogalz made a MOTION to recommend approval of Final Plat for Angie's Acres, Al Powers, 290 Elm Street, and was supported by Mr. Tralle. Motion carried 6 -0. DRAFT MINUTES • • • • • • Planning & Zoning Board May 11, 2005 Page 11 VI. DISCUSSION ITEMS A. AUAR Update Staff updated the Board on the AUAR. B. Temporary Signs Staff recommended the Board come to agreement on pennants and miscellaneous signage. Mr. Nelson noted there was at least one business in town that had tattered pennants and it was an eyesore, so he believed they did need to be regulated. Mr. Laden asked if there was a way to not regulate them, but to state the pennants needed to be maintained and in good repair. Mr. Nelson indicated that would be acceptable. Chair Rafferty stated in his personal opinion he would like to see pennants eliminated. Mr. Laden asked if the City wrote an ordinance regulating pennants, would the current businesses using pennants need to comply with the ordinance. Mr. Smyser replied those businesses would need to comply with the ordinance. Mr. Hyden stated he believed there was a conflict between pennants and banners. Mr. Smyser replied it was easy to distinguish between the two visually. Mr. Laden stated in his opinion, the pennants would not have lettering on them. Mr. Hyden asked at what point would as pennant become a sign. Mr. Laden replied if the pennant had lettering on it, it would be a sign. Mr. Pogalz stated it was his understanding from the Board that pennants would be okay as long as they were maintained and had no lettering on them. Mr. Laden agreed if the pennant contained letters, it would be considered a sign and not a pennant. Mr. Tralle asked if they needed to limit the number of pennants allowed. Mr. Laden asked if they could have different regulations in different zones and if so, when would they address this issue. Mr. Smyser replied they could have different regulations in different zones and he had not thought about when or if they should address this issue. He stated he would like the Board to leave this issue to the staff when it came to a final draft. Mr. Laden stated he could go either way on the pennants, but he did see some appropriate uses for pennants. DRAFT MINUTES Planning & Zoning Board May 11, 2005 Page 12 Mr. Hyden noted many cities simply banned pennants. Chair Rafferty asked for recommendations. He indicated he was not in favor of pennants. Mr. Hyden made a MOTION to prohibit pennants altogether and was supported by Chair Rafferty. Motion carried 4 -3. (Root, Pogalz, and Tralle opposed). Mr. Smyser asked the Board what they wanted to do with respect to miscellaneous signage on commercial businesses. He stated staff recommended prohibiting miscellaneous signed altogether. Mr. Laden agreed these types of signs should be prohibited on commercial businesses. Mr. Nelson asked if this would include the "A" type frame signs. Mr. Smyser replied this would not include those types of signage and they would address those types of signs at a later date. Mr. Laden noted they needed to narrow down the wording on "other non - permanent signs ". Mr. Smyser stated he would work on that wording. Mr. Tralle made a MOTION to prohibit all signage on pylon signs, temporary stakes, and posts and was supported by Mr. Root. Mr. Pogalz stated he believed if they banned pennants then these other small signs also needed to be banned. Mr. Laden noted the distinction in his mind was that pennants did not "speak" because they had no words. He noted his only concern what where they were going with what they were made of because he believed some metal signs, or weather resistant signs could be allowed. Mr. Tralle withdrew his motion and Mr. Root withdrew his second. Mr. Laden made a MOTION to direct staff to write up an ordinance banning these types of signs with more clarification as to definitions and was supported by Mr. Root. Motion carried 6 -0. Mr. Smyser stated at the next meeting they would be discussing real estate and development signs. C. CSAH 49 /County Rd J Study Staff updated the Board on CSAH 49 /County Rd J. D. VFW DRAFT MINUTES • • • • • Planning & Zoning Board May 11, 2005 Page 13 Chair Rafferty noted they had received a letter from Bert and Deb Noren, 785 Lois Lane, regarding some issues they had with the VFW including noise, street parking, garbage, and the proposed helicopter in the north parking lot. Mr. Smyser stated he had spoken with the building official about these concerns. He indicated with respect to the noise by the fans, there was a six -foot privacy fence in place and he did not know what else they could do about that, but he would look into this. With respect to the parking on the street, the issue was that the parking lot on the south side of the building was not finished and this was something they would ask the VFW to finish. With respect to the garbage, they would talk to the VFW about this and all garbage needed to be enclosed. With respect to the helicopter, the VFW had inquired about putting a nonfunctioning helicopter on the site. He stated they had received from the Department of Defense a helicopter, which would be mounted on a pole over the pond. He stated the VFW did not need permission for his helicopter and there were no City regulations not allowing it. He noted the VFW had asked permission for this helicopter, but the City had no regulations to deny it. Chair Rafferty requested all of the Board members view the site prior to the next meeting and come back with their questions and asked staff for a site plan of this site. Mr. Tralle stated the Mueller building was faced backwards also and did not face Lake Drive. He noted Mueller also had a pile of dirt in the City's right -of -way that needed to be removed. He stated at the distribution center there were huge piles of dirt and those needed to be removed. He indicated they needed to address sites such as these to make sure they were cleaned up. VII. BACKGROUND In February of 2003 the City Council adopted Ordinance No. 08 -03, establishing an updated zoning ordinance text and zoning map for the City of Lino Lakes. As part of the update two business districts, the CB, Central Business District, and SC, Shopping Center District were eliminated. All uses previously allowed within these districts were provided for in the GB, General Business District. Therefore it was intended to rezone all CB and SC Districts to GB. Section 7, Subdivision 4 of the ordinance specifically addresses this change with regard to the CB district, however the SC District was erroneously omitted. REQUEST To correct this error staff is recommending amendment of Section 7, Subdivision 4 and 5 of Ordinance 08 -03 to read as follows: Subd. 4 Land formerly within a CB, Central Business District or SC, Shopping Center District is hereby zoned GB, General Business District. Subd. 5 Land formerly within a SC, Shopping Center District that has been rezoned to PDO, Planned Development Overlay prior to adoption of this ordinance shall be subject to the provisions of the PDO ordinance Where provisions are not specified within the PDO ordinance the property shall be governed by the requirements of the GB, General Business District. Both the existing Schwan's facility and the existing two duplexes to the east were considered non - conforming under the SC, Shopping Center designation. The Lino Lakes Market Place and JADT Developments were previously approved as Planned Development Overlays (PDO). The proposed change will clarify what zoning provisions apply to the respective developments if not specifically addressed within the PDO ordinance. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: June 8, 2005 TOPIC: PUBLIC HEARING Amendment to the existing PUD (Planned Unit Development) Marketplace 3rd Addition BACKGROUND Ryan Companies is proposing to amend the existing Planned Unit Development (Planned Development Overlay) for the Marketplace to amend the building layout and types of buildings used on the site. Originally (as can be seen in the exhibits) the site was approved for five multi- tenant buildings. The applicant is now proposing to have three multi -tenant buildings with two single user buildings along Apollo Drive. This is a change from the request that was previously heard by the Planning and Zoning Board. This change was brought about due to the comments made by staff and the Planning and Zoning Board at the May 2005 regular meeting. The applicant attempted to redesign the site to hold one back to back type multi -tenant building, but the circulation and parking would be significantly diminished; and a great deal of utility relocation would need to be undertaken; so staff directed the applicant to abandon the concept. The applicant has settled on a design that is significantly conforming to the original layout of the site (the currently approved layout is included in the exhibits at the end of this report). At this point the only real issues under review are the elevations of the multi -tenant buildings and the designation of the lots adjacent to Apollo Drive as single -use buildings instead of multi - tenant buildings. ANALYSIS Comprehensive Plan, Land Use and Zoning The table below identifies the existing land use and zoning as well as guided land uses for the area. Marketplace 3rd Addition, page 2 The comprehensive plan guides the site for Mixed Use land use. The site is within the stage 1 (pre -2010) owth area and a portion is within the existing MUSA boundary. Public water and sanitary sewer are available within the surrounding street network. Planned Unit Development The revised layout will use the existing lot lines, but slightly change some of the building placements, and designate the two lots adjacent to Apollo Drive for single user buildings. Specifically, the Design Guidelines established for the entire Marketplace development as a part of Ordinance 16 -01 will need to be slightly modified. Setback Standards Within a Planned Unit Development (or Planned Development Overlay) the setbacks are approved as a part of the final development plans. The setbacks proposed are both appropriate for this type of development and in keeping with the rest of the Marketplace development. Lot Sizes Within a Planned Unit Development (or Planned Development Overlay) each lot is designed to accommodate a building pad and sufficient parking to serve the intended use of the lot. The proposed lot areas and widths are in conformance with the GB (General Business) zoning district, and are therefore appropriate. Architectural Design Standards Ordinance 16 -01 which rezoned this site to PDO (Planned Development Overlay), also established the design standards for the buildings on site. The applicant is now proposing what staff feels is a significant improvement to the overall design of the multi -tenant buildings. Staff does have a couple of concerns in regards to the elevations, which are addressed below. The final design for the multi -tenant buildings will need to replace the existing elevations within the design standards. Minimal changes will also need to be made to the text attached to Ordinance 16 -01. None of the changes will be substantive changes, rather just correcting portions that refer to the old building designations (A -F) and then designating which sections will apply to each of the new building lots. Building Materials/ Elevations The elevations attached to this report are a result of ongoing discussions between staff and the applicant. Improvements were made to the previously approved design, including more brick and variation to the facade accomplished by stepping out the ends of the buildings. However, staff is recommending conditions of approval that require the cornice be EIFS or better with flashing used only to maintain the integrity of the cornice, not as an architectural element. Building Height The scale of the submitted elevations is not known; however it is a single story building and therefore would not exceed the maximum height allowed within the zoning district. Marketplace 3rd Addition, page 3 andsca in Staff is recommending a condition that all lawn areas be sodded, and all plantings be irrigated. The remaining landscaping will be in conformance with the previously approved landscape plans. However, a condition is being added that the landscaping for the single user buildings will need to be addressed at time of Site Development Plan Review. Access /Circulation Access to the entire site is provided via five shared driveways from the internal street system of the larger Marketplace development. The layout is significantly conforming with the previously approved layout of the site, with the exception of the two lots adjacent to Apollo Drive. The layout of those lots will be subject to review during the Site Plan Review process for each building. The pedestrian circulation of the site was also a major concern of the board at the last meeting. The applicant has brought back the previously approved layout which includes all of the pedestrian linkage the board was encouraging. Lighting As the site is surrounded by similar commercial uses and the streets are private, the photometric lighting plan submitted with the application meets all of the city requirements. The lighting fixtures will be conditioned to match the existing fixtures within the Marketplace development. •Additionally, decorative street lighting required as part of the original approval for Marketplace must be installed for this site and all other developed sites within the project. As the applicant for this property is the Marketplace 3rd Addition, page 4 aster developer for the entire site, a condition is being added requiring the installation of the necessary blighting. Signage The signage for the multi- tenant building will still be the same as was previously required. The two buildings on Apollo Drive will need to follow the single user signage criteria. The ordinance will need to be edited to remove references to the old building designations (A,B,C,D, and E) however the standards will not change. Trash / Mechanical Equipment Each building on site will be required to have a trash enclosure, and they are depicted on the site plan for Retail C and Retail D. All mechanical equipment will need to screened architecturally or with appropriate landscape materials. Utilities & Stormwater The utilities and grading for this site were completed during earlier phases of the Marketplace. Therefore, even though the City Engineer has not completed a review of the new plans, there should not be any major issues related to the layout. Further review of the site by the City Engineer will be completed prior to the item being heard by the City Council. •ENVIRONMENTAL BOARD The Environmental Board reviewed this application at the April 2005 regular meeting. There recommendations were numerous and are attached to this report. The comments of the Environmental Board were based on a different site design, therefore many of them no longer apply. However, comments regarding the trash enclosure have been incorporated into the staff recommended conditions. • *OPTIONS 1. Approve the project subject to conditions. 2. Deny the project. 3. Return to Staff with direction. RECOMMENDATION Staff recommends approval subject to the following conditions: • • Marketplace 3rd Addition, page 5 1. The architectural design standards approved as a part of this application must be supplied to each incoming tenant upon signature of a lease. 2. A development agreement must be executed between the developer and the city prior to the issuance of building permits for the site. 3. All lighting fixtures used on the site must be in conformance with the design standards. 4. The trash enclosure must be large enough to house both trash receptacles and recycling receptacles. 5. The trash enclosure must be constructed with the same materials as the proposed building. 6. The decorative lighting for this site and all other developed sites within the Marketplace must be installed prior to the issuance of a certificate of occupancy for any buildings on this site. 7. The cornice for the building must be constructed of EIFS and metal should only be used as flashing to prevent damage of the cornice materials. ATTACHMENTS 1. Marketplace 3rd Addition Plan Set received May 27, 2005. • • • Recommendations Of the April, 2005 Environmental Board Lino Lakes Market Place 3rd Addition The Environmental Board made the following recommendations: • Minimum parking stalls per ordinance should be designed. Recommend additional desirable parking to be pervious type. • Plant shade trees on the West side of the building along the street. • Trash and Recycling enclosures should be accessible by industry standards and adequate enough to include both trash and recycling needs. • There should be no importing of soils without City approval. • Exterior safety signing should be shielded. • All soils on sodded areas should be tilled as deeply as possible. All top soils should be incorporated into the sub soils. • Under the Erosion Control Notes of the plan, language should include that all NPDES requirements will be met. In relationship to this, a detailed Storm Water Pollution Prevention Plan must be on site, as well as inspection reports for weekly, and post rainfall events. Location of this report and the inspection reports should be indicated on the Construction Plans. The notes should also indicate methodology for storm sewer inlet protection. Their Storm Water Pollution Prevention Plan should indicate that when silt fences are 1/3 full, that they would be cleaned out or reinstalled. Entrance points to the site should be designated and designed with a 50 foot rock entrance. • As with Kohl's and Target, a written BMP statement and plan of action should be submitted and approved by the City. This plan should at least include a schedule for periodic impervious sweeping, trash and litter pick -up, replacement of dead or dying landscape materials, deicing salt storage on site. This should be a part of the development agreement. This area should be encouraged to participate with Kohl's and target on future site maintenance. • • CITY OF LINO LAKES ORDINANCE NO. 02 -05 AN ORDINANCE AMENDING THE PLANNED DEVELOPMENT OVERLAY FOR THE MARKETPLACE AS CREATED BY ORIDINANCE 16 -01. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: SECTION I. FINDINGS The City Council makes the following findings regarding the application for amending the Planned Development Overlay for the property described below, based on the factors listed in Section 2, Subd.lE of the Lino Lakes zoning ordinance: 1. This application did not include proposed text, and was therefore determined to be an incomplete application at this time. However, staff has discussed the proposal to allow additional wall signage and has determined that it would potentially support some amendments to the current allowances in certain situations. Therefore staff is willing to work on drafting some text changes to encompass the purpose intended by the submitted application, with the direction of the Planning and Zoning Board. Staff is seeking the direction of the Planning and Zoning Board in regards to the following: • • Should corner lots be allowed to have additional signage to address both street frontages? • Should double fronted lots be allowed to have additional signage to address both street frontages? • Should multi- tenant buildings be allowed to have additional signage when located on a corner or double fronted lot? I -35E Corridor Draft AUAR June 2, 2005 • Executive Summary • • The I -35E Corridor Draft AUAR has been prepared for the City of Lino Lakes (city) in accordance with Minnesota Rules Chapter 4410. This AUAR process was prompted by the fact that large portions of the AUAR area are facing development pressure, that the city has a strong commitment to conserving natural resources and that the city wants to balance development with natural resource conservation. The city determined that undergoing the AUAR process would provide the city with an invaluable tool as they plan for and manage growth within the northeastern portion of the city (Figure 5 -1). The AUAR follows the format of an Environmental Assessment Worksheet (EAW) and provides a level of analysis commensurate with an Environmental Impact Statement (EIS). The large geographic scope of the AUAR area (over 4,500 acres) allows for a comprehensive analysis of the cumulative impacts of development within the AUAR area (Figure 5 -2). Mn Rules state that, "the Responsible Governmental Unit (RGU) may specify more than one scenario of anticipated development provided that at least one scenario is consistent with the adopted comprehensive plan. At least one scenario must be consistent with any known development plans of property owners within the area," (Mn Rules. Chapter 4410.3 610 subp.3). This Draft AUAR includes a review of three development scenarios. 1. Scenario One is consistent with the adopted plans of the city and allows for an additional 2,237 housing units, 2,985,733 ft2 of commercial uses, and 11,175,035 ft2 of industrial uses (see Figure 6- 2). 2. Scenario Two is based on known development plans of property owners within the AUAR area and has a commercial and industrial emphasis (see Figure 6 -3). Scenario Two allows for an additional 5,715 housing units, 5,617,890 ft2 of commercial uses, and 9,570,045 ft2 of industrial uses. 3. Scenario Three has a residential emphasis and allows for an additional 8,659 housing units, 4,141,554 ft2 of commercial uses, and 5,829,722 ft2 of industrial uses (see Figure 6 -4). AUAR PROCESS SUMMARY This AUAR process is unique in that it includes strong public participation and agency participation component throughout the process, rather than only involving the public and reviewing agencies after the Draft AUAR is completed, which is the standard process required by Minnesota Rules. To ensure very strong and timely communication and the participation of numerous key stakeholder groups throughout the planning process, an Advisory Panel was selected to serve as the primary working group during the course of the research, planning and environmental review process. The Advisory Panel includes property and business owners within the AUAR area as well as members of the city's Planning and Zoning Board, Environmental Board, and Economic Development Advisory Committee. All information, work products, findings and recommendations developed by the AUAR consultant team were presented to the Advisory Panel for its review and comment. Also, this information was made available to the general public on the city's website vii • • • I -35E Corridor Draft AUAR June 2, 2005 Advisory Panel A series of Advisory Panel workshops were held to present research related to the AUAR and to assist in the creation of the development scenarios that are reviewed in this Draft AUAR document. Several Advisory Panel workshops were held for the purposes of presenting the development scenarios, receiving comments on the scenarios, and reviewing the revised development scenarios. The purpose of the first work session, held January 19, 2005, was to introduce the City Council to the AUAR process and review the relevant background research. The City Council held two work sessions to review the draft development scenarios on March 29 and April 6, 2005. Agencies To engage reviewing agencies early in the AUAR process, a series of agency meetings were held to present background research, to solicit initial comments on the research, and to help the AUAR team scope out the level of detail needed in the AUAR analysis. Valuable information was gained from agency staff that was incorporated into the AUAR analysis. Staff from the following agencies attended some or all of the meetings: Department of Natural Resources, Department of Transportation, Metropolitan Council, Anoka County, Washington County, US Army Corps of Engineers, US Fish and Wildlife Service, Anoka Conservation District, Rice Creek Watershed District, and Environmental Quality Board. The purpose of the public open house was to give the general public the opportunity to review and submit comments on the background research and the draft development scenarios. MAJOR ISSUES AND PROPOSED MITIGATION SUMMARY The potential impacts and major issues identified in this Draft AUAR are summarized in the following section. The major issues include traffic, ecologically sensitive resources, storm water management, regional sanitary sewer infrastructure capacity, and cultural resources. The discussion of each issue also includes a discussion of the proposed mitigation measures that address the identified impacts and issues. A summary of potential impacts and the proposed mitigation strategies are included in the Draft Mitigation Plan Outline. The final Mitigation Plan will be completed after the agencies and the public have had the opportunity to comment on the Draft AUAR during the 30 -day comment period. The final Mitigation Plan will become a component of the action plan to ensure that the city avoid, minimize, or mitigate significant environmental impacts from the development of the AUAR area Traffic A detailed traffic impact analysis has been prepared to fully investigate the effects of the proposed land use scenarios on the local and regional roadway systems (see Item 21. Traffic). The traffic analysis focused on the operation of the primary roadways and their intersections during the p.m. peak period, which is typically the time when the most severe traffic congestion is incurred. Evaluating the development scenarios involved the complex process of developing and distributing background and development scenario related traffic through the areas roadway network. The network includes a system of frontage roadways that will assist in the circulation of traffic through the area. This roadway system, which was presented to the City and Anoka County early in the AUAR process, was used as a guideline in determining where to put the various developments. The key guidelines included: • Limit access to CSAH 14 and 80th Street between CSAH 21 and Elmcrest Avenue North • Limit access and preserve mobility on CSAH 14, CSAH 21, and 80th Street (assuming future interchange) • Signalized (primary) intersections at 1/2 mile spacing • Collector (secondary) intersections at 1/4 mile spacing • Enhance existing street network to serve local trips (e.g., upgrade Elmcrest Avenue North) • Develop frontage/backage road system to provide property access • Consolidate existing access as opportunities arise • Consider I -35E park and ride location • Provide bicycle /pedestrian trail connectivity In general, the overall land use /development scenarios resulted in significant increases in traffic to /from the AUAR area. The major problems with the intersection were southbound left -turns and westbound left - turns. The lane geometry that was assumed was single left -turns on all approaches. The results indicate that given the expected development in the AUAR area that several of the approaches would require dual left- turn lanes to adequately accommodate study area traffic. The redesigned interchange at CSAH 14 and I- 35E overall functioned satisfactory during the p.m. peak hour for the 2030 land use scenarios. The northern section of the AUAR area, along 80th Street and the bypass, also showed high traffic volumes and intersections projected to operate over - capacity under the assumed lane geometry. ix • • • I -35E Corridor Draft AUAR June 2, 2005 Table 21 -5 displays the overall Level of Service (LOS) for all of the analyzed intersections for the development scenarios for 2030 build -out and post 2030 build -out conditions. Table 21 -6 displays the LOS for each of the turning movements for the 2030 build -out conditions. The intersection traffic volumes for the full development of the scenarios (post 2030) resulted in severe congestion for virtually all turning movements and therefore are not shown in the table. The proposed developments will increase traffic on roadways within, and adjacent to the AUAR area. Mitigation will include adding traffic signals and turn lanes and widening roads as necessary during the various stages of development (see Figures 25 -8 through Figure 25 -12). In general, Scenario One had the least impact on traffic congestion with two intersections performing at LOS F, without mitigation. Scenario Two had four intersections and Scenario Three had six intersections operating at LOS F, respectively. With reasonable mitigation measures all the intersections in Scenarios One and Two were able to operate at LOS E or worse. Even with reasonable mitigation measures, Scenario Three, which has a residential emphasis, still had intersections performing at LOS F. These include the east ramps at the proposed Northerly Bypass/I -35W interchange, and the intersection of CSAH 14 and Otter Lake Road. To mitigate the impact of the additional traffic on the regional system I -35W and I -35E would need to be reconstructed to provide a six -lane cross - section. It should be noted that it was determined that an expansion will be necessary even without the development scenarios used in this analysis. As the interstates serve a much larger area, the projected growth of the entire Twin Cities region should warrant expansion by the year 2030. Figures 21 -8, 21 -9, and 21 -10 display the intersection LOS for each of the scenarios and also display the mitigation measures that were identified to address the deficiencies. Ecologically Sensitive Resources The AUAR area contains a wealth of ecologically sensitive resources including high quality natural and semi - natural areas, wildlife corridors, two rare animals, the Peltier Lake Island Heron Rookery, two rare plant communities, and portions of the Rice Creek Chain of Lakes Regional Park. Mitigating impacts to ecologically sensitive resources is discussed throughout the Draft AUAR. The Conservation Design Framework (Figure 10 -3 and described under Item 10) is designed to conserve wildlife habitat and natural plant communities, and will provide an invaluable tool for conservation of wildlife and rare features within the AUAR area. Most importantly, the Conservation Design Framework protects the existing significant fish, wildlife, and ecological sensitive resources in the northwest portion of the AUAR, and goes beyond to identify and protect the most significant outlier habitats, buffering them, and connecting them with greenway corridors. In brief, conservation design principles behind the Framework include: • protect streams, lakes, and groundwater by purifying, filtering, and infiltrating surface runoff to the maximum extent possible • preserve, restore, and enhance existing natural and semi - natural areas and wildlife habitat • create wildlife opportunities by restoring and managing wildlife habitat • establish wide buffers and connections around and between core and outlier habitats The greenway corridors are designed to connect the larger and higher quality natural areas. These corridors will provide three main services: 1) stormwater collection and conveyance, 2) ecological corridors for wildlife movement and native plant dispersal, and 3) recreational trails for people. Certain greenway corridors may warrant design for specific wildlife species, may provide certain stormwater management opportunities, or may need to accommodate different types of trails or passive recreational uses. Design I -35E Corridor Draft AUAR June 2, 2005 • considerations may include corridor width, appropriate vegetation structure, human access and use, and whether or not it is appropriate for a corridor to cross a particular type of roadway. • • New developments represent opportunities to plan and carry out ecological restoration and management. Ecological restoration, enhancement, and /or expansion will help mitigate potential impacts on wildlife and rare features, and if these activities are planned, scheduled, and carried out at the recommended broad scale, will likely result in a net increase in conservation and ecological benefits within the AUAR area compared with existing conditions. Various tools exist or can be developed to ensure the protection and stewardship of the preserved, restored, and enhanced natural resources in the AUAR area. These tools can be used to establish a consistent set of standards for treating the open space across different areas as they are developed. For example, the buffers shown on the Conservation Design Framework (Figure 10 -3) are conceptual and will allow the city the flexibility to consider several land protection and preservation tools in these areas. The variety of tools listed throughout this Draft AUAR will enable public and private sectors to cooperate in creating this network over time in a realistic market and regulatory context. Stormwater Management Effective stormwater management and planning within the AUAR area is a challenging pursuit, but one that is critical to prudent and environmentally sound development. The AUAR process presents an opportunity for logical and innovative stormwater management that integrates traditional stormwater detention and water quality requirements with environmental restoration and conservation objectives. This ideal can be implemented on both a regional and site scale to minimize the impact of development on runoff rates and volumes, water quality, and the region's aquatic resources. The stormwater analysis is fully discussed under Item 17 and Appendix D contains the Hydrologic Analysis The majority of the AUAR area faces many obstacles to effective stormwater management. In many cases agricultural ditch and tile networks have significantly altered drainage basins and changed sub - watershed divides. The drainage capacity of these existing tile networks will be insufficient to convey stormwater runoff from further residential, commercial, or industrial development. The recommendations made within this AUAR document are intended to improve post - development runoff water quality; attenuate runoff release rates below stream and drainage infrastructure capacities for both frequent and occasional rainfall events; and enhance groundwater recharge as the AUAR area is developed. Stormwater management areas (SMAs) will play a critical role in mitigating potential impacts from stormwater following development of the AUAR area. Appropriate design, construction, and maintenance of these areas will enable development to occur without compromising the integrity of the region's aquatic resources. The stormwater management approach outlined in this Draft AUAR provides adequate detention of runoff for post - development conditions. It also provides a framework for water quality enhancement and increased groundwater recharge. The stormwater detention facility design will provide hydraulic properties appropriate for native plant species to thrive. All of these factors will help mitigate potential water quality problems associated with development in the AUAR area. The most effective approach to addressing stormwater issues is by implementing an integrated system of stormwater management elements. The Conservation Design Framework provides an appropriate layout for the regional implementation of an integrated system (see Figure 10 -3). Within the greenway corridors shown in the Framework, bio- swales, wet prairie, and wetlands can be oriented in series to effectively retard runoff rates, reduce stormwater volume, and enhance water quality. Runoff rates and volumes are decreased due to increased infiltration, evapotranspiration, and increased friction imparted on the flow. These decreased rates also reduce the ability of runoff to generate and carry sediment and associated pollutants. xi • • I -35E Corridor Draft AUAR June 2, 2005 The runoff volume into the receiving waters will likely increase with development due to the increased impervious area constructed in the AUAR area. However, with the stormwater management requirements outlined in this document, the peak runoff release rates will be decreased from storms of 1 -, 10 -, and 100 - year recurrence intervals. The recommended large area stormwater management elements will result in relatively small water level fluctuations, provide area to enhance the groundwater recharge necessary to provide base flow to the receiving streams, and provide the detention time necessary to cleanse the runoff of contaminants and meter the increased runoff volume to an amount within the receiving streams ecological carrying capacity. Regional Sanitary Sewer Infrastructure Capacity The city has met with Metropolitan Council Environmental Services (MCES) staff on several occasions from 2003 through Spring 2005 to discuss existing and future MCES service to Lino Lakes. The MCES is in the process of updating their comprehensive planning for the "Northeast Region," which includes Lino Lakes, Centerville, North Oaks, Forest Lake, Hugo, White Bear Lake, and White Bear Township. They anticipate the need to provide additional capacity in the Forest Lake Interceptor and downstream facilities to serve the future needs of those communities. Currently, MCES is engaged in plans to construct additional capacity support for the Forest Lake Interceptor. Following a series of meetings in early 2005, MCES agreed to construct an additional interceptor to serve the easterly portion of Lino Lakes. The MCES intends to construct this pipe in 2006, in conjunction with a planned county highway improvement project. The new interceptor should be designed to convey the excess flow not accommodated by the existing Centerville Interceptor. Assuming the existing interceptor can handle 1.7 MGD, the new pipe should be designed to convey flows ranging from 1.3 MGD for Scenario One to 2.5 MGD for Scenario Three (see full discussion under Item 18). Design of the new interceptor is now in progress. Lino Lakes provided flow estimates, based on the Comprehensive Sanitary Sewer Plan Scenario, to MCES in March 2005 (see Item 18 for additional information). MCES has directed the designers to provide capacity in the new interceptor for 2.0 MGD average daily flow. Discussions are currently underway between Lino Lakes and MCES regarding the capacity to be provided in the new interceptor. Assuming capacity remains at 2.0 MGD, the existing and new interceptors will have adequate capacity for projected development through at least 2030 under any of the three AUAR Scenarios. However, ultimate development as projected by Scenarios Two and Three could eventually exceed capacity. If the city chooses to amend its Comprehensive Plan to accommodate components of Scenarios Two or Three, then a subsequent revision to the Comprehensive Sanitary Sewer Plan will be required. The Comprehensive Planning process, including review by the Metropolitan Council, is the appropriate process to resolve any potential sewer capacity issues. Cultural Resources Ten precontact archaeological sites have been recorded in the north and western portions of the AUAR area, and numerous others have been documented in proximity to it (see Table 25 -1). For the most part, sites are located in proximity to water: Centerville Lake, George Watch Lake, Peltier Lake, Rondeau Lake, Clearwater Creek, Hardwood Creek, and Rice Creek. The undisturbed landforms adjacent to these bodies of water have the greatest potential for containing intact archaeological sites. Several sites have been identified on slight rises within the wetlands surrounding Rice Creek; therefore, those wetlands, and the northern portion of Peltier Lake, have high potential to contain intact archaeological resources. Further, those undisturbed areas adjacent to known sites are also considered to have high archaeological potential. Because of the high level of archaeological sites in the AUAR area, appropriate levels of historical and archaeological surveys in areas identified as having high potential for containing cultural resources will occur prior to future development. This is intended to mitigate any intentional or unintentional damage to, xii I -35E Corridor Draft AUAR June 2, 2005 • or destruction of, important archaeological sites and historic properties without due process and consideration. • • The 106 Group created a map that shows areas with a high potential for archaeological sites. Given the sensitive nature of this information, this map cannot be included in the AUAR document, nor can it be made available to the public. The city will have this map on file and consult it when development applications are submitted for review. If a development application falls within an area that is considered to have a high potential for archaeological sites, the city will require that the following steps and procedures involved in the identification and analysis of any archaeological sites is followed prior to development: • Conduct a Phase I archaeological survey within the area of potential effect (APE). The objective of the archaeological fieldwork is to determine if there are archaeological sites in the areas identified as having high potential for such, and define the extent of those sites that may be impacted by development plans. • Conduct a Phase II archaeological survey. If archaeological resources are uncovered within the APE that may be eligible for listing on the National Register of Historic Places (NRHP) a Phase II survey should be conducted. The objective of the investigation is to determine whether archaeological resources are eligible for listing on the NRHP. • Plan for avoidance or conduct Phase III data recovery. If a significant archaeological site is identified that will be impacted by development, avoidance is recommended. If this is not possible, then a data recovery of the site should occur. • If human remains are recovered at any time during archaeological investigation or development, all activities must stop and consultation initiated with the Office of the State Archaeologist and Minnesota Indian Affairs Council. MITIGATION PLAN A draft mitigation plan outline is included with this Draft AUAR. The draft mitigation plan outline is submitted as part of the Draft AUAR to provide reviewers, regulators and prospective tenants or purchasers of land with an understanding of the actions necessary to protect the environment and limit potential impacts by proposed development projects. Although mitigation strategies are discussed throughout the Draft AUAR document, this draft mitigation plan includes a summary of the potential impacts and proposed mitigation strategies to assist in the review of the Draft AUAR document. A comprehensive Mitigation Plan will be completed after agencies and the public have had the opportunity to comment on the Draft AUAR during the 30 -day comment period. The final Mitigation Plan will become a component of the action plan to ensure that the city avoid, minimize, or mitigate significant environmental impacts from the development of the AUAR area • • AGENDA ITEM VI. C STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: June 8, 2005 TOPIC: Temporary Signage BACKGROUND The P & Z has made some decisions and given direction for drafting ordinance changes for several types of temporary signage, including banners, portable signs, window signs, pennants, and other miscellaneous temporary signs. Real estate signs are another aspect of the discussion on temporary signage. Last month's packet included parts of ordinances from several cities showing how they regulate signs for the sale and development of real estate. This report offers suggestions for addressing real estate signs and then lists decisions made by the P & Z on other sign types. When we draft the ordinance amendments, we will include graphics wherever possible to define and illustrate the ordinance provisions. ANALYSIS Lino Lakes currently allows real estate development and construction signs without a permit, though there are size requirements. The existing ordinance reads as follows: Section IV, par. P.: Real estate development signs or construction site signs may be erected providing they do not exceed one hundred square feet of area, are not more than fifteen feet above grade, and not within one hundred feet of an existing residential structure. Section IV, par. R.: Temporary real estate signs advertising the sale of individual residences shall not require a permit if they are under six square feet. Section IV, par. S: Temporary signs advertising building or land for rent or for sale in all districts may be placed on such property providing such signs are not closer than ten feet to any property line and do not exceed forty square feet in industrial areas and fifteen square feet in other areas. • • • One option for existing neighborhoods is to allow each residential property one free standing sign. This could be a "for sale" sign, a home occupation sign (which must be a permitted activity), or a "yard sale" sign. The sign could not be used to advertise a commercial businesses on another property. The sign size maximum would be six square feet. We offer for discussion the following provisions which would replace the conditions in the existing ordinance. One portable sign or banner is allowed per permit 2. One permit is allowed per quarter of any calendar year 3. Permit is good for 17 consecutive days 4. Permit period always begins on a Friday 5. Double permit fees will be assessed if the permit is pulled after the sign is placed 6. The City has the right to remove the sign at the end of the permit period and collect the cost of removal from the permit holder and /or property owner. Fee: $25 per permit. PORTABLE SIGNS Definition A temporary sign designed to be moved from one location to another Maximum Size: 32 square feet Setback: Five feet from any property line Permit Conditions: 1. One portable sign or banner is allowed per permit 2. One permit is allowed per quarter of any calendar year 3. Permit is good for 17 consecutive days 4. Permit period always begins on a Friday 5. Double permit fees will be assessed if the permit is pulled after the sign is placed 6. The City has the right to remove the sign at the end of the permit period and collect the cost of removal from the permit holder and /or property owner. • Fee: $25 per permit. • • • Result of P & Z Discussion of May 11, 2005 PENNANTS Definition Any lightweight plastic, fabric, or other material, whether or not containing a message of any kind, suspended from a rope, wire, or string, usually in series, designed to move in the wind. PENNANTS TO BE PROHIBITED OTHER TEMPORARY SIGNAGE TO BE PROHIBITED. These include temporary signs that commonly are seen attached to poles, other signs, gas pumps, or stuck in lawns. Staff will work on ordinance language to clarify these. The simplest way probably will be to state that temporary signs other than those specifically listed in the ordinance will be prohibited. Note: This prohibition is not intended to include sandwich boards placed in front of shops. Sandwich boards can be addressed as portable signs or the ordinance can specifically refer to the portable sign requirements for sandwich boards. WINDOW SIGNS Window signs on the inside of the building will not be regulated. (Signs on the outside of windows will not be allowed except with a banner permit.)
