CALL TO ORDER AND ROLL CALL Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at 6:33 p.m., July 13, 2005. The agenda was approved. III. APPROVAL OF MINUTES: June 8, 2005 Mr. Tralle made a MOTION approve the June 8, 2005 Minutes and was supported by Mr. Pogalz. Motion carried 6 -0. IV. OPEN MIKE Chair Rafferty declared open mike open at 6:34 p.m. There was no one present for Open Mike Mr. Nelson made a MOTION to close Open Mike at 6:35 p.m., and was supported by Mr. Laden. Motion carried 6 -0. V. ACTION ITEMS A. PUBLIC HEARING for a Rezone, Preliminary Plat and MUSA Allocation for Cavegn Subdivision, 7870 Country Lane Chair Rafferty opened the public hearing at 6:36 p.m. DRAFT MINUTES Planning & Zoning Board July 13, 2005 Page 2 Staff stated applicants have requested approval of a single- family residential development entitled Cavegn Estates. The subject property is located adjacent to the southeast corner of Lois Lane and Country Lane and is currently developed with one single - family dwelling. The applicants are proposing to divide the 1.38 acre lot into two buildable lots of 23,560 square feet and 36,564 square feet. The existing single - family dwelling will remain on the smaller lot, and the larger lot will be used for new construction. Staff reviewed their analysis and recommended approval subject to the following conditions: 1. Both lots shall connect to city sanitary sewer and water, assessments for both lots will be recorded with the final plat. 2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 3. Park dedication shall be paid in accordance with City policies. Chair Rafferty asked what the park dedication was. Mr. Smyser replied it was $2,075.00 per lot. Chair Rafferty asked if the original intent of the cul -de -sac bulb was to put in more lots. Mr. Smyser responded that a cul -de -sac was put in prior to the development to the west and before that occurred in the 1990's, Lois Lane did not go through. Mr. Laden asked if the existing sheds would remain. Mr. Bengston replied they would remain. Mr. Laden asked if two accessory structure building were allowed on this type of a lot. Mr. Bengston responded they could add a condition to remove one of the sheds to bring this into compliance. Chair Rafferty invited applicant to make comment. Tony Cavegn, 7870 Country Lane, stated the shed on parcel would stay on parcel A and the sheds on the other parcel B would stay with that lot. Chair Rafferty stated based on the ordinances, they were allowed one home with an attached garage and one accessory building, so there might be some questions on the existing two sheds. He stated it appeared both shed on parcel B would not be able to stay. Mr. Nelson asked if there was any grandfather clause, since it was an existing structure. Chair Rafferty noted the rules change once the lot was divided. Mr. Cavegn noted they would be building on the new parcel B. Chair Rafferty asked if he was aware of the staff conditions and was willing to comply with them. Mr. Cavegn replied he was aware of them and would comply with them. Mr. Bengston stated this would go to Council on July 25. Chair Rafferty invited anyone for or against this proposal to make comment. There were no comments made. Mr. Pogalz made a MOTION to close the public hearing at 6:47 p.m. and was supported by Mr. Laden. Motion carried 6 -0. Mr. Nelson made a MOTION to recommend approval for a rezone, preliminary plat and MUSA Allocation for Cavegn Subdivision, 7870 Country Lane, subject to the conditions as noted in staff's July 13, 2005 report and adding the condition that the sheds comply with City Ordinances and was supported by Mr. Laden. Motion carried 6 -0. B. PUBLIC HEARING to Amend Sign Ordinance text to address temporary signage and additional wall signs Chair Rafferty opened the public hearing at 6:50 p.m. Staff stated signage is always an extremely difficult issue. As with any regulations, there will be those who will not agree with a signage requirement. The goal of signage regulations, like any government regulation, is to balance the private interest and the larger public interest. Signage advertises a business, which is good for the business. Successful business is good for the greater public. However, unregulated signage can become an eyesore and a nuisance, which detracts from the good of the community. The P & Z has been discussing temporary signage for several years. These discussions led to the proposed amendment in the attached draft ordinance. When the P &Z is satisfied with the proposed amendments, the Board's recommendations will be forwarded to the City Council for consideration. The City Council is the only body that can adopt or amend Ordinances. Staff reviewed their analysis and are recommending either approving the sign ordinance amendment and forward it to the City Council or continue the public hearing and provide direction on revising the draft Ordinance. Mr. Nelson inquired about "sandwich board" signs. Mr. Smyser replied he missed that type of signage and would add this to the Ordinance. Mr. Laden asked if sandwich boards under a certain size could be put up without a permit. Mr. Smyser replied he would need to look at that, but generally a sandwich board sign would need a permit. Mr. Hyden asked how far away the sandwich board could be from the business. Mr. Smyser responded that was a good point and he would add language for that. DRAFT MINUTES Planning & Zoning Board July 13, 2005 Page 4 Chair Rafferty stated he liked the idea that the construction sites had a larger sign, but was concerned about more than one sign on a site. He asked if only one sign would be allowed. Mr. Smyser replied as being proposed one sign would be allowed per street front. Mr. Laden asked if internal streets in a project counted. Mr. Smyser noted that was a good point and he would look into that. Chair Rafferty asked if they should regulate signage on construction trailers put on a construction site. Mr. Smyser replied they could add text that names and numbers of subcontractors with signs on their trailers would not be included into the Ordinance as signage. Mr. Laden stated he was concerned that construction signs were appearing to be given preferential treatment. He asked how they could be more inclusive, instead of exclusive. Mr. Smyser responded they could use the same the same requirements as portable signs or other temporary signage. Mr. Nelson noted a construction sign by its nature is temporary. Mr. Hyden agreed that construction sites were different. Mr. Pogalz noted there were several different types of construction sites, where at some point a construction sign would go away and be replaced by a monument sign. Chair Rafferty stated he would like to see one construction sign per street also. Mr. Laden asked why construction signs did not need a permit. Mr. Smyser noted no Cities that he researched required a permit for a construction sign and he did not believe this has ever been an issue in the past. Mr. Laden asked if they discussed as a Board the timeline for the construction signs. He questioned whether construction signs in residential subdivisions should be allowed, especially until 75 percent of the lots were sold. Mr. Smyser responded a lot of times the construction and real estate signs were together. Chair Rafferty stated he liked the Ordinance the way it was written and the amount of money being invested for a project site, the 30 -day after the Certificate of Occupancy was a fair deal. Mr. Laden stated he did not believe construction signs should not be allowed in residential subdivisions until 75 percent of the lots were sold. He stated sometimes it took years before 75 percent of a development was sold. Mr. Smyser asked at what point the construction company would be told they had to remove their signs. Mr. Laden replied he would put a time certain on sign removal, such as six months, 12 months, etc. DRAFT MINUTES • • • Planning & Zoning Board July 13, 2005 Page 5 • Mr. Nelson asked why would a second sign on a building need to be smaller than the first sign. Chair Rafferty stated the definition as written made sense to him. Mr. Tralle stated he had no problem with the two signs being the same size. He stated he also wanted to have signage for only tenants of that building and not a tenant of an adjacent building. Chair Rafferty invited anyone for or against this proposal to make comment. Katie Allen, Allure Salon, Spirit Hills Mall, stated she rented a corner lot, but she was not on a street, so could she put a second sign on the corner. Mr. Pogalz replied she could not because Spirit Hills had a signage plan as a part of the project and these Ordinance changes would not void this signage plan. Ms. Allen asked how they could address this with the City. Mr. Bengston replied the owner of Spirit Hills Mall would need to come in and work with staff to potentially change the signage plan. Ms. Allen asked if it was possible Spirit Hills Mall could apply for a permanent sign that was not on the Spirit Hills property. Mr. Smyser replied that is not allowed under the City's Ordinance and the City had made it clear that they did not want any additional billboards. • Mr. Nelson asked if that would include a monument sign. Mr. Smyser stated the City had made it very clear that it did not want any off premises signs. Mr. Laden asked if Ware Road was part of the Spirit Hills development. Mr. Smyser replied he did not believe it was. Ms. Allen stated the problem they had was that unless someone drove down Birch Street, people did not know what was in Spirit Hills Mall. She noted they were unable to advertise on the back of their building either. She stated if the City was not going to allow billboards or signage, then they were stuck with what they had. Mr. Laden noted she had the option of going to the owner of their property and the owner would need to work with City staff on additional signage. Mr. Pogalz made a MOTION to continue the public hearing to the August, 2005 Planning and Zoning meeting and was supported by Mr. Nelson. Motion carried 6 -0. VI. DISCUSSION ITEMS A. Village of Hardwood Creek Development Update (1 -35E Corridor) Staff introduced Greg Hayes of Hardwood Creek LLC. • Greg Hayes, Village of Hardwood Creek LLC, gave a presentation to the Board on the Hardwood Creek project located adjacent to Interstate 35E north of Main Street. DRAFT MINUTES Planning & Zoning Board July 13, 2005 Page 6 Mr. Pogalz stated there needed to be some thought to making the backsides of the building well landscaped and looking nice due to the location of the residential areas. Mr. Hayes responded they were aware of that concern and the backs of the buildings would not be left bare. Mr. Hayes stated they intended to come back on a regular basis and keep the Board informed. He indicated they wanted to break ground in Spring 2006. He stated it would be a five -year build out for the housing and 2 -3 years for the commercial development. Mr. Tralle indicated he was impressed with the frontages of the housing developments so everything did not look the same. Mr. Laden stated his concern with big box retailers was the vast amount of parking that went with it. He asked if anyone has ever explored moving a certain percentage of the parking to the back of the building. Mr. Hayes replied the national retailers wanted a certain percentage of parking in their front or the retailer would not come into the development. He stated the way they dealt with that was to provide green space, plantings, etc. into the parking lot to break the parking area up. Mr. Laden stated he liked what he has seen so far with them attempting to break up the parking. B. Potential Conservation Subdivision Staff stated they have been in discussion with a prospective developer for a site to the south of the D. Erickson 2nd Addition neighborhood, southwest of Birch Park. This is a site with potential for a conservation development. The developer is discussing a restoration plan for the wetland /greenway corridor through the site. It would be another piece in further establishing the greenway corridor that includes part of the Foxborough (Fox Den Acres) project. Recall that this was the first conservation development under the new policy recommended by the Parks, Natural Open Space /Greenway and Trail System Plan. Staff is continuing to discuss the potential of the site. Staff has not received a formal development application. The Environmental Board discussed this site in May and was interested in the possibilities for restoration of natural systems. This information is being presented to the Board for informational purposes. Chair Rafferty left the meeting at 8:41 p.m. and turned the chair over to Mr. Tralle. C. Requiring Sidewalks in Subdivisions Staff stated that members of the P & Z have suggested initiating a discussion about requiring sidewalks in new subdivisions. Sidewalks provide for pedestrian and bicycle use separated from cars in the street. Lino Lakes adopted a new parks and trail plan to DRAFT MINUTES • • • • • • Planning & Zoning Board July 13, 2005 Page 7 facilitate pedestrian and bike usage for both transportation and recreational purposes. Sidewalks along neighborhood streets serve the same purpose and are more easily accessed. There are a number of issues the community would need to consider as part of a sidewalk requirement including: Providing enough space in the right -of -way for sidewalks and boulevard trees; Utilities and access to them for maintenance; Engineering templates; Should street pavement be narrower: No shoulder is needed for people and bikes; impervious surface; should parking be allowed if the streets are narrower? Is right -of -way adequate for sidewalks? Maintenance and reconstruction under the City Charter: Assessments; Shoveling requirement for homeowners. None of these issues are insurmountable in other communities. However, the City Charter is an element unique to Lino Lakes. The purpose of tonight's discussion is to initiate consideration of these issues. Mr. Root stated this was an important issue, but this was not intended to address existing developments or neighborhoods. He indicated as the City grew, it made more sense to require sidewalks in new developments because of the additional traffic, pedestrians, bike riders, etc. and it did not make sent to force people to share space with vehicles. He stated there was a public safety aspect to this. He noted there were other issues, such as the transition between an existing development and a new development and the maintenance of the boulevard between the sidewalk and the street. He noted they also needed to look at trails when sidewalks were not appropriate. He stated the City Charter issue they needed to look at also. He indicated he supported sidewalks in the City and sidewalks would create a better neighborhood, increases safety, and would enhance a neighborhood. Mr. Laden agreed with Mr. Root's comments. He asked what the next step was and asked if they could come up with some kind of a timeline so this would keep progressing. Mr. Smyser stated he would like the Board to leave this in staff's hands right now and they would come back to the Board periodically and give an update. He indicated he did not want to give a specific timeframe for completion, but staff would continue to work on it. He noted this was a new idea for the community and they needed to make sure all of the issues would be addressed. Mr. Nelson stated in general, he did not believe this was a safety issue and he saw this as an unnecessary expense and a detriment to the homeowners who were required to maintain the sidewalks. He believed the residential streets were wide enough to accommodate everything. DRAFT MINUTES Planning & Zoning Board July 13, 2005 Page 8 Mr. Hyden stated he was open- minded to this, but he saw a lot of work and hassle converting the City to sidewalks and he would not want a sidewalk running through his yard; he would like a wider street instead. He noted there would be a greater expense to the City also and he agreed with some of Mr. Nelson's comments. Mr. Smyser noted sidewalks would only be intended for new developments and not the existing neighborhoods, and the issue they would need to deal with was the transitioning of the new developments up to the existing developments. Mr. Laden stated that public safety was one of the motivating factors for why they should put in sidewalks. Mr. Pogalz stated he saw both sides, but like Mr. Haden he was on the fence as to entirely agreeing with this. He indicated he understood the public safety factor, but was concerned about the cost and maintenance factors. He stated he grew up in a neighborhood with sidewalks and generally they were unused. He believed sidewalks were good safety measures, but would they be unused. Chair Tralle asked if the Board wanted to pursue this, or did they want to table or drop it. Mr. Laden stated as long as people were open minded, this should be pursued. Mr. Hyden stated he would be in support of this if it was for commercial developments only, but not residential areas. Mr. Nelson stated personally he would not be interested in purchasing a home that had a sidewalk in the front yard. Mr. Pogalz stated there was a concern both ways and he believed this might have merit. Chair Tralle stated he was interested in pursuing this for future developments. Mr. Hyden stated if the reason they were going to put in sidewalks was to keep kids off of the streets, he would not be interested in pursing this because kids would still play in the streets. He noted the City had paths and trail ways for pedestrians, bikers, and rollerblading. Mr. Smyser stated he would look into some of the ideas presented tonight and bring this back at the next meeting for further discussion and direction. D. AUAR Update Staff updated the Board on the AUAR. E. Miscellaneous Mr. Hyden stated he attended a League of Minnesota Cities seminar and noted that he learned that when a Board member goes out to sites to look at the area, the League suggested they not talk to the applicant as this might look as favoritism and if the Board member wanted to talk to the applicant, they should do it at the Board meeting. He also DRAFT MINUTES • • • • • Planning & Zoning Board July 13, 2005 Page 9 stated he was given some ideas on written public hearing rules and he believes implementing such rules would be a good idea. He indicated it was important that they did not discuss issues outside of the Board meetings. He asked that these issues be kept in mind. Mr. Laden asked if Board members started an email and Board members started replying, he had been told that those emails would constitute a public meeting and noted they needed to keep that in mind when doing group emails. Mr. Root stated they were only an advisory board, but he agreed with these suggestions. Chair Tralle stated it was difficult not to speak with the applicant when looking at the site when he was trying to determine the issue. Mr. Hyden stated while everyone had good intentions, it gave applicant the opportunity to sway a Board member's vote. He noted the applicant needed to address all of the issues at the board meeting only. He indicated they were opening themselves up to the City getting sued if they spoke with the applicant when looking at the site. Mr. Root asked if they emailed something to staff and staff distributed it to the Board, would that constitute an open meeting. Mr. Smyser stated staff had been advised that anything that went through their computers could technically be public information and he cautioned the Board to be careful in their email correspondence. He stated information was fine, but they needed to be cautious that the information was not conveyed in a certain way. He acknowledged this was a fine line. Mr. Laden stated from the meeting he attended it was suggested that if everyone was emailed, that the email be printed out and brought to the meeting to be made a part of the public record. VII. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: August 10, 2005 TOPIC: PUBLIC HEARING Preliminary Plat Final Plat Rice Lake Professional Center E.G. Rud and Sons Surveying BACKGROUND E.G. Rud and Sons Surveying has requested approval of a Preliminary and Final Plat for property located adjacent to the northeast corner of Lake Drive and Hodgson Road. The applicant has already obtained Site and 4103uilding Plan Review approval administratively on July 18, 2005; executed a performance agreement for the site; and has pulled building permits for construction of a 25,000 square foot multi - tenant building on the site. The applicant is now pursuing a Preliminary and Final Plat to clean up the legal descriptions and easement documentation on the subject property. The subject site was purchased from the City of Lino Lakes earlier this year. ANALYSIS Comprehensive Plan, Land Use and Zoning The table below identifies the existing land use and zoning as well as guided land uses for the area. The appropriate drainage and utility easements are depicted on the plat and title commitments have been forwarded to the city attorney for review. The City Engineer has completed a thorough review of the submitted plans and has deemed them to be acceptable. OPTIONS 1. Approval subject to conditions of approval. 2. Denial of the application. 3. Benton Erickson 6868 West Shadow Lake Drive BACKGROUND The Shoreland Ordinance for the City of Lino Lakes requires a 100 foot setback from the Ordinary High Water Line for any structure that is Unsewered. The applicant is proposing an addition to the existing single family dwelling at 6868 West Shadow Lake Drive that if approved would reduce that setback to 50.6 feet. The Ordinance does allow for a structure to conform to the setbacks of structures on the adjoining lots on both sides of the proposed building site without the approval of a variance, however, in this instance the survey submitted depicts that the setback of the property to the south is Bacchus Variance July 14, 2004 page 2 78.7 feet, and that the property to the north is not developed with a dwelling at this time. The survey does depict the dwelling on the next developed lot to be setback 94.9 feet from the O.H.W.L. DNR Tom Hovey, an Area Hydrologist with the DNR commented that a hardship is not discussed by the applicant in their letter, nor demonstrated on the plans; that alternatives appear to exist that would not require a variance; and that the shoreland management program is intended to eliminate nonconformities, not increase them. Furthermore, if any fill has occurred on this or adjacent properties the DNR needs to review the situation and determine if the fill was permitted and legal. Findings Findings of Fact. In considering all requests for variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. The lot is already developed with a single family dwelling and though it might be more costly, due to the need to remove /renovate /replace existing detached accessory structures and driveways, additions could be made north of the existing home that would not encroach further into the setback from the O.H.W.L. b. That the plight of the landowners is due to physical circumstances unique to his property not created by the land owner. The site does constrain development due to the lack of depth and the setbacks required from the right -of -way and the O.H.W.L. At the shallowest point, the lot depth from the right -of -way to the O.H.W.L is 145 feet. Considering the 30 foot front setback and 100 foot rear setback (from O.H.W.L) the result is a building footprint that is only 15 feet deep. This would not typically be enough footprint depth to build a standard dwelling, however working with the existing setbacks for the dwelling an addition could be added that would not further the encroachment into the O.H.W.L setback. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. As mentioned previously, if money was not an issue, the existing accessory structures and driveways could be removed /replaced /renovated to allow an addition to this structure that would not increase the non - conformity of this site. As the property exists it still can serve as a single family dwelling. 1 • • Bacchus Variance July 14, 2004 page 3 d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. This variance would not only allow this property owner to build far closer to the O.H.W.L than most other riparian lots are allowed, but would also effect the development of the lot to the north which would be able to use the reduced setback of this lot to allow a structure to be built much closer to the lakeshore than would normally be allowed. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the Shoreland Ordinance is to preserve and enhance the quality of surface waters, conserve the economic and natural environmental values of the shorelands, and provide for the wise use of waters and related land resources. The proposed variance would allow a structure and construction of that structure to occur far closer to the lake than is advised and could therefore harm the quality of Lake Reshanau. OPTIONS 1. Recommend approval of the proposed Variance. 2. Recommend denial of the approved Variance. 3. Return to staff with direction. RECOMMENDATION Staff recommends denial of this Variance request. Lino Lakes, MN. 55014 SUBJECT: VARIANCE We would like to receive a variance to allow an addition on the northwest side of our home. The City Building Department tells us we need a variance because the property is located on Reshanau Lake. Without the variance we would not be able to build the addition, and still have room to use our unattached garage. We only want to build approximately 12 feet to the rear of the house and towards the lake. This layout will allow us to meet the city requirement to have access from the current house, into the addition, and still give us room to enter our unattached garage. Without a variance, the only way to have access into the current house, from the proposed addition, would require tearing off the attached garage and this still wouldn't leave enough room to enter the unattached garage. The proposed addition will fit nicely onto the existing house without being an eye sore. We plan to use the additional space as a parent's apartment. The layout of our existing house would make it impossible to do an addition on the south side of the house and still have easy access from the driveway and garage. If you look at the survey of the property you will see that our house is over 100 feet from the lake. We do have a lower area in the back yard that causes the high water level line to seem closer than on the lots next to us. In past years these lots had fill hauled in that raised them slightly above the high water line. The house was built before the year of the high water flood and has never had any water problems. The planned addition would meet DNR requirements and be outside the minimum established distance needed to build. Also the addition would blend in with the houses on both sides. Benton A. The City Council approved the preliminary plat for the Fox Den Acres planned unit development on January 10, 2005 with Resolution 04 -196. This project is the first to implement the new parks and open space plan through the use of a conservation development. The conservation development approach, while often discussed in Lino Lakes in the past, has not previously been pursued to the extent being seen on this project. The total site is 50 acres and the permanent open space will include 28 acres, about 56 %. The preservation of open space on this site will be an important step in the implementation of the community's greenway vision. An overall conservation plan will lay out what actions must occur to conserve and restore specified natural features of the site. The homeowners association will prepare an annual implementation plan. The City will review each annual implementation plan to make sure it is consistent with the overall conservation plan. The City then will release funds for the activities described in the annual plan. ANALYSIS The final plat itself is consistent with the approved preliminary plat. The City Attorney is reviewing the title commitment and the City Engineer is finalizing the development agreement. The approval of the PUD included a number of conditions to ensure implementation of the conservation development elements. Staff and the developer are making good progress on completion of the overall conservation plan and the legal documents to enforce it. These include the conservation easement conditions and the association declarations and by laws, which will dictate how the City and the association will work together to implement the overall conservation plan. Paul Bengtson August 10, 2005 PUBLIC HEARING Rezoning to R -1 (Single Family Residential) and GB (General Business) Preliminary Plat — Pine Glen MUSA Allocation 23, LLC has requested approval of a 78 -lot single - family residential and 2 lot commercial subdivision entitled Pine Glen. The subject property is located on the east side of Lake Drive approximately 900 feet south of Main Street. The comprehensive plan guides the site for low density sewered residential use and it is currently zoned R -1X (Single Family Executive), R (Rural), and GB (General Business). The applicants request includes a Rezoning to R -1 (Single Family Residential) and GB (General Business); 44.78 acres of MUSA allocation; and a preliminary plat for the 78 residential and 2 commercial lots. The applicant held a neighborhood meeting on Thursday, July 28th, giving notice to neighbors using mailing labels supplied by the City of Lino Lakes Community Development Department. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The site is within the stage 1 (pre -2010) growth area, but would need to be added to the MUSA boundary of the city. Municipal water and sanitary sewer are available in the Lake Drive right -of -way. The proposed design fits within the Low Density range of up to three units per acre. Growth Management: MUSA Reserve: The comprehensive plan and the growth management policy establish a specific number of MUSA acres for residential growth for stage one (prior to year 2010). The proposed phasing plan will require the allocation of 4.08 acres of commercial and approximately 20.7 acres of residential MUSA reserve in year 2006, and approximately 20 acres of MUSA reserve in year 2007. (These numbers will be confirmed prior to the Planning and Zoning Board meeting.) The residential spreadsheet tracking this information is attached to the end of this report, the commercial spreadsheet is too large to attach, but supposing that this development is approved, there will be 68 acres of commercial reserve available. Growth Management, Units /Year: The comprehensive plan and growth management policy establish a specific number of units for residential growth for stage one (prior to year 2010). The proposed phasing plan will require the allocation of 42 lots in year 2006, and 36 in year 2007. The spreadsheet tracking this information is attached to the end of this report. PRELIMINARY PLAT Lots: The proposed subdivision will consist of 78 residential lots, ranging in size from 10,800 square feet to 45,350 square feet. The minimum lot size in the R -1 (Single Family Residential) zoning district is 10,800 square feet of upland area. The upland lot areas of all the lots is required to exceed 10,800 square feet. The upland area of the lots is not depicted and must be confirmed prior to the plat being reviewed by the City Council. The only lot that appears to be close to deficient is Lot 6, Block 5. The proposed subdivision will also consist of 2 commercial lots of 56,398 and 121,505 square feet. The minimum lot size in the GB (General Business) zoning district is 20,000 square feet. • • Pine Glen page 3 Access and Circulation: Access to the site is provided via a public street entering the site east from Lake Drive. The location of the street does not immediately create a direct intersection with a street traveling west of Lake Drive. This is a situation that will need to be remedied in the future. The applicant has shown on the plat a ghost plat indicating that Vicky Lane could be re- routed south to align itself with the proposed Street A of Pine Glen. Though this is probably not the final alignment this road will take, it does demonstrate the intent of the city and the potential to align the intersection. This will need to be enforced on the property adjacent to the west side of Lake Drive at such time that it is developed. Secondary access to the site is provided immediately through the existing Lois Lane. This is intended to provide an immediate secondary access to eliminate the development of an overly long cul -de -sac situation. This is a sound planning fundamental and has been the direction of the Planning and Zoning Board and the City Council. This is clearly designed to be a secondary access point and will allow the current residents of Lois Lane another access as well. Future access points have been planned both to the north through James Street and to the south through the undeveloped right of way of Dupont Avenue. A temporary cul -de -sac will be required on the southern terminus of what is currently labeled Street B, however one will not be needed on the northern terminus of what is currently labeled Street C. The southern access to Dupont Avenue is being planned to allow the property owners to the south the potential to divide their lots in the future. Many things would need to occur in order for this to happen. It would require that utilities be hooked up to the existing homes as well as the future homes; and a street would need to be built at the expense of the property owners completely within the Dupont Avenue right of way or their private property and in accordance with the requirements of the utility line easement. Beyond the typical platting request and a rezoning, there would also need to be a comprehensive plan amendment to allow the area to be sewered and MUSA would need to be allocated. There are numerous issues that would require high levels of cooperation between all of the affected property owners, however the city and the developer did not want to eliminate the opportunity for property owners to pursue division of their properties if they desired to do so in the future. Within the development, the applicant has depicted 28 foot wide streets which do not meet city standards. A condition has been added requiring that the applicant provide 32 foot wide streets that meet all of city standards. Lake Drive will need to be expanded in the future to adequately handle traffic, the timing of this expansion is not known at this time, however the full right of way dedication (60 feet from centerline) is being required at this time to accommodate those improvements. • • • Pine Glen page 4 The City Engineer is still in the process of reviewing the traffic impact analysis that was submitted by the applicant. Those comments should be available at the Planning and Zoning Board meeting on August 10tH Utilities: The City Engineer has completed a thorough review of the submitted plans and his comments are attached. The applicant will be required to satisfy all of these comments prior to approval of any building permits for the site. Appropriate drainage and utility easements are shown on the residential lots; however the commercial lots will also need to include drainage and utility easements prior to the submittal of the final plat for review. The lift station for the project is proposed on lot 30 must be shown within a 50' x 50' utility easement. Grading and Stormwater Management: The city engineer has completed a thorough review of the submitted plans and his comments are attached. The applicant will be required to satisfy all of these comments prior to approval of any building permits for the site. Parks, Open Space: The proposal does not include any land dedication for parkland, only a cash dedication will be required. Park dedication fees are $1,665 per residential unit. The City of Lino Lakes Parks, Natural Open Space /Greenways and Trail System Plan indicates a trail along the Lake Drive frontage that is not currently indicated on the proposed plans. A 15 foot wide trail easement will need to be dedicated to the city prior to any final plat being approved by the City Council. The proposal does include a private trial system running along the south side of the property, which will link the homeowner's on the west side of the site to the greenway /open space on the east side of the project. Staff is recommending that this trail be continued through the commercial portion of the site, as either a trail or a traditional sidewalk that ultimately leads to the commercial structure as well as to the trail required along the Lake Drive frontage The eastern portion of the site is partially indicated as a greenway area on the City of Lino Lakes Parks, Natural Open Space /Greenways and Trail System Plan. It also indicates a potential trail connection to the north to link up to the city park at old city hall. At this time it is difficult to determine the best trail alignment so the city would anticipate working with the homeowner's association to obtain a trail easement in the future. • • • Pine Glen page 5 ENVIRONMENTAL BOARD The Environmental Board reviewed the project on July 27, 2005. The recommendations are attached. A number of the comments have been included as conditions of approval with this staff report. Those comments include a conservation easement over the wetland portion of the site; native seed mix plantings with a three year management contract; a homeowner's association; City boulevard trees; and review of the commercial areas to require conformance with city standards. OPTIONS 1. Recommend approval of the project 2. Recommend denial of the project. 3. Return to staff with direction. RECOMMENDATION Staff recommends approval of this item subject to the attached conditions. CONDITIONS 1. Phase 1 of the project including 42 residential lots can not be final platted until 2006. The final plat for phase 2 of the project including 38 residential lots can not be final platted until 2007. 2. This should be a formal landscape design • It is requested that additional screening be considered on the Northern part of the development between the development and the existing residential area. Screening is also necessary between the commercial area and the residential area of the development. • A conservation easement should be written for all greenway and wetland areas. Lots on the West. side should have this easement in sufficient width to buffer the wetland. • Signs should be placed at all conservation easement /wetland area edges. There should be 1 sign per lot where abutment occurs. • A contract should be acquired with an ecologist, Landscape Company specializing in the establishment and maintenance of native plant establishment. This contract should be approved by the City and extend for at least 3 years to include 1 burn at the end of the contract. • An informational sheet should be distributed to property buyers describing environmental considerations and buffer /conservation areas. • It is suggested that since there will be a homeowners association, there should be some annual dollars allocated to maintain native plant areas, and formal water garden areas. • The Storm water Pollution Prevention Plan (SWPPP) should show all required 50 foot entrances. The SWPPP should reiterate seed areas, type of seed and timing issues. A designated place on the site must be indicated where the SWPPP and site inspection sheets will be available for inspection. Submit the geotechnical report with anticipated high ground water table. Low floor elevations are required to be 4 feet above the high ground water table. 12. Provide test results confirming the infiltration capacity of the proposed infiltration basins. If an infiltration test is not performed, it is recommended that an infiltration value of 0.5 inches per hour (.00069 feet per minute) be used for design as per the RCWD design aide standards for Type A soils. Design the infiltration basin such that the infiltration volume below the outlet, at a minimum, is equal to the runoff volume from a 2.5 -inch storm, and limit the draw -down time to a maximum of two days. 13. The lag/CN method is used to determine the time of concentration based on the hydraulic length and average land slope for an entire watershed. Therefore, it is not recommended that the lag/CN method be used in combination with the TR -55 method for the determination of subcatchment curve numbers. 14. A time of concentration calculation for existing subcatchment 2E -OFF does not appear to be included in the submittal. Please submit time of concentration calculations for subcatchment 2E -OFF. 15. The discussion raised a number of questions. Staff has reviewed the draft ordinance and made revisions (see attached). OPTIONS 1. Approve sign ordinance amendments and forward to City Council. 2. RECOMMENDATION Option 1 • • • CITY OF LINO LAKES DRAFT 8 /4/05 COUNTY OF ANOKA ORDINANCE NO. 05-05 AMENDING ORDINANCE NO. 12 -97 AN ORDINANCE REGULATING SIGNS IN THE CITY OF LINO LAKES, ANOKA COUNTY, MINNESOTA. The City Council of the City of Lino Lakes ordains that Ordinance No. 12 -97 is amended as follows: SECTION I. PURPOSE AND INTENT The purpose of this ordinance is to establish a set of standards for fabrication, erection and use of signs, symbols, markings, or advertising devices within the City. These standards are designed to protect and promote the general welfare, health and safety of persons within the community and to aid and assist in the development and promotion of business and industry by providing regulations which allow and encourage creativity, effectiveness and flexibility in the design and use of such devices. SECTION II. DEFINITIONS: A. Commercial Use: Activity carried out for monetary gain. B. Conditional Use: A land use or development that may not be appropriate generally within a certain district but may be allowed in that district with appropriate restrictions, conditions or limitations as imposed by the City Council. C. Conditional Use Permit: A permit issued by the City Council in accordance with the procedures specified within this Ordinance as a device to enable the City Council to assign conditions to a proposed use or development after consideration of the adjacent land uses and the special characteristics which the proposed use presents. D. Permitted Use: Any use allowed in a zoning district and subject to the restrictions applicable to that zoning district. E. A "Business Sign" is any sign which identifies a business or group of businesses, either retail or wholesale, or any sign which identifies a profession or is used in the identification or promotion of any principal commodity or service, including entertainment, offered or sold upon the premises where such sign is located. H. Related Definitions: 1. Illuminated Sign: A sign which has artificial light source directed upon it or which has an interior light source. See Section IV General Regulations. 2. Motion Sign: A sign which revolves, rotates or moves. 3. Sign Area: The entire area within a single continuous perimeter enclosing the extreme limits of the actual sign surface, but excluding any structural or supporting elements such as uprights, aprons, poles, beams or standards. 4. Sign Height: Height shall be measured from grade to the uppermost points or level of sign surface. 5. Flashing Sign: An illuminated sign on which such illumination is not kept constant in intensity or color at all times, when such sign is in use. See Section IV General Regulations. 6. Direction Signs: A sign erected on private property for the following uses: Church, school, hospital, club, library, civic or other similar types, providing general information about the use or uses such as name and address. 7. Institutional Sign: A permanent sign or bulletin board which identifies the name and other characteristics of a public or private institution on the site where the sign is located. SECTION III. DISTRICT REGULATIONS: A. "R" Rural District and "R -X" Rural Executive Residential District Purpose. These districts are designed and intended to aid in guiding development toward fulfillment of the Comprehensive Plan and to serve the following functions. 1. To preserve productive land for agricultural use. 2. To maintain "open space" within and near to urban areas. 3. To help guide development of urban and rural areas along an orderly design to preserve continuity and efficiency of service. 4. To provide a method by which the urban farm can be guided so as to control urban sprawl and still conserve land in an economic status until such time as the need is present for an amendment to the Comprehensive Plan. 5. To reduce the possibilities of rural - urban conflicts in establishing types and levels of service, methods of financing the services and needs. To maintain an acceptable per capita cost for such services as sanitary sewer, water, police, fire, road maintenance, school transportation, and others as necessary. Rural & Rural Executive Residential Districts: In the Rural District all signs must comply with the following: 1. Residential Identifications: Not more than two (2) square feet of nameplate. 2. Institutional Identifications: Churches, schools, parks, etc. allowed up to thirty -two (32) square feet; not higher than eight (8) feet. F of Ordinance, are prohibited in the Rural(R) & Rural Executive (R -X) Zoning Districts. 4. No Sign shall be closer than ten (10) feet to any property line. 5. Each property with a residence may have one freestanding sign, temporary or permanent, without a permit: maximum size 6 sq ft, at least 10' from property line 'This sign shall not advertise commercial activity that is not allowed or conducted on sane property as sign. There is no time limit for such a sign. B. RESIDENTIAL DISTRICTS a. "R -1" and "R -1X" Single- Family Residential District: Purpose. This district is intended to provide a residential atmosphere for those persons desiring a single - family neighborhood with a suburban density. The area is intended for development of single - family detached homes on lots with public sewer and water. b. "R -2" Two - Family District: Purpose. This district is intended to provide a residential atmosphere for those persons desiring a two - family dwelling with a more urban, but limited, density. Two - family dwellings will not be allowed in areas without sanitary sewer. c. "R -3" Medium Density Residential District: Purpose. The purpose of-the R -3 Medium density Residential District is to provide settings for multiple - family structures up to eight dwelling units per building in areas having good thoroughfare access, are properly located to other uses and are accessible to major activity center, recreation areas and shopping areas. d. "R -4" High Density Residential District: Purpose. The purpose of the R -4 High Density Residential Districts is to provide settings for multiple- family housing in areas having good thoroughfare access, proper relationship to other uses and are accessible to major activity center, recreation areas and shopping areas. e. The purpose of the Manufactured Home Park District is to provide opportunities for manufactured housing in a planned community. This district is intended to provide opportunities for almost all types of manufactured homes including those which may not be able to meet the design standards established in other residential districts. All manufactured Home Parks are required to conform to the provisions of this section and other appropriate sections of the code. f. "R -7" Manufactured Home Subdivision District: Purpose. The purpose of this district is to provide opportunities for manufactured housing for manufactured homes which meet the design criteria established in this subdivision in subdivided developments, in safe, attractive residential neighborhoods with all urban services and desired amenities. R4, R -1X, R -2, R -3, R -4, R -6, R -7 In the multiple and residential districts, the following requirements apply. 1. Residential Identification: One nameplate per residence, not more than two (2) square feet per unit. 2. Institutional Identification Signs: Not more than one sign per street frontage; one identification sign allowed per building; not more than thirty - two (32) square feet; not higher than six (6) feet; 3. Area Identification Signs: Not more than twenty -four (24) square feet; not higher than six (6) feet. 4. Advertising Signs: Advertising signs, as defined by Section II, Subd. There may be some areas which are suitable only for commercial uses of a limited (less intense) nature. This may be due to the close proximity of residential uses. This may include high quality commercial areas such as an "office park" development. Also, the "LB" District can be used as a transitional district or buffer between noncompatible uses such as intense commercial ( "GB ") and residential uses. In the Limited Business District all signs must comply with the foU g:requirements in table in Section IV, paragraphs EE and FF. 1. These areas have the prerequisites for industrial development, but because of proximity to residential areas or the need to protect certain areas or uses from adverse influences, high development standards will be necessary. "LI" uses include service industries and industries which manufacture, fabricate, assemble or store, where the process is not likely to create offensive noise, vibrations, dust, heat, smoke, odor, glare, or other objectionable influences. Generally, these include wholesale, service and light industries which are dependent upon raw materials refined elsewhere. b. "GI" General Industrial District Purpose. These are areas which, because of availability to thoroughfares, suitable topography, and isolation, are appropriate for industrial uses of a more intense nature and ones which may have certain nuisance characteristics. Light and General Industrial Districts In the Light and General Industrial Districts all signs must comply with the fallowing requirements in tables in Section IV, paragraphs EE and FF.. "R -BR" RURAL BUSINESS RESERVE DISTRICT Purpose. This district is intended to preserve a rural very low- density environment until such time as the land is needed for commercial and industrial uses. Residents of this district can expect to fully use the land for farming, grazing, animal husbandry, propagation of nursery stock, gardening, and other traditional rural use. In addition, the district is meant to prevent incursion of those land uses that would adversely affect or diminish the rural character of the land. In particular subdivisions of land for residential purposes as well as commercial and industrial uses without access to suitable infrastructure is not to be permitted. This district is also meant to serve the following functions: - To control and limit urban sprawl. - To conserve land in a viable economic status until such time as the need is present for rezoning to a business use district. - To reduce the possibility of rural -urban conflict in both the use of the land and in the extension of utilities and other infrastructure items. No sign may be closer than five (5) feet to any property line. 1. Residential Identifications: Not more than two (2) square feet of nameplate. 2. Institutional Identifications: Churches, schools, parks, etc. allowed up to thirty -two (32) square feet; not higher than eight (8) feet. 3. Advertising Signs: Allowed by Interim Use Permit; forty (40) feet maximum height above grade; must comply with General Regulations. Section IV. a. Must not be within seven hundred fifty (750) radius feet of an existing residential structure or other advertising structure in a non - freeway area. b. Must not be closer than seven hundred fifty (750) radius feet of another advertising structure. Shall not be closer than twelve hundred (1200) feet to another such advertising structure on the same side of an interstate freeway. For the purpose of this Ordinance, a back -to -back or V -type sign shall be considered as one structure. c. Must not be closer than twelve hundred (1200) feet from any adjoining zoning district. d. Maximum size of sign shall not exceed Six Hundred Seventy Five (675) square feet. e. The site on which the sign is located shall comply with all area and width requirements of the base zoning district. f. There is no time limit for such a sign. SECTION IV. GENERAL REGULATIONS APPLICABLE TO ALL DISTRICTS A. Advertising signs in districts where permitted, must comply with the following: 1. Shall only be fabricated of and erected on steel and built to a minimum of thirty (30) pounds per square foot windload factor. 2. Shall not be longer than sixty (60) feet. 3. Shall have a maximum square footage restriction of seven hundred fifty (750) square feet. B. All signs shall be constructed in conformance with the provisions of the Uniform Sign Code published by the International Conference of Building Officials, which is hereby adopted by reference and made a part of this Ordinance. C. No sign shall be permitted within public road right -of -way or be affixed to public structures or public utility poles or boxes or other public equipment except for traffic control signs, public utility signs. or signs for public parks, governmental buildings, or other such public facilities. A special exception may be granted by the City Council if road improvements or other public projects includes the elimination of an access to a private property. In such cases. a sign giving directions to the new access may be allowed in the right of way. D. No sign shall be painted on, attached to, or affixed to any trees, rocks or other similar organic or inorganic natural matter. E. portable sign permit. Signs in windows in the interior of buildings are allowed without permits except that flashing signs are not allowed. No signs shall be attached to the exterior of windows. F. Illuminated signs are permitted only in limited and general business, shopping • center, central business and light and general districts. H. Signs shall not be painted directly to any exterior building surface, but shall be on a separate frame except for temporary display windows. Sign letters /symbols may be directly attached to a wall by adhesive or mechanical fasteners. ' • I. No sign shall be installed, which by reason of position, shape or color would conflict with proper function or interpretation of any traffic sign or signal. J. There shall be no use of revolving beacons, flashing signs, zip flashers or similar lighted devices. K. No sign shall be permitted to obstruct any window, door, fire escape, stairway or opening other access of any building or structure. L. Campaign Signs. a. State General Election years: In a state general election year, the size and duration of campaign sign display shall comply with the provisions of Minnesota Statute 211.B.045 as amended. These signs shall be confined within private property provided that the property owner's permission has been obtained. b. Other Election Years: In years when no state general election is to take place, signs announcing candidates seeking public political office and other data pertinent thereto shall be permitted up to a total area of eight (8) square feet in size and dimensions not greater than two (2) feet by four (4) feet. These signs shall be confined within private property, provided that the property owner's permission has been obtained. A maximum of two (2) signs per candidate is allowed on any residential lot within the Single Family (R -1) and Single - Family Executive (R -1X) zoning classifications. In all other zoning classifications, signs are limited to two (2) per candidate every two hundred (200) feet of road frontage. No more than two (2) signs per candidate shall be placed in front of the polling places. Campaign signs may be displayed twenty -five (25) days prior and five (5) days after the election for which they are intended. Notwithstanding any provision contained in this Ordinance, the City, upon three (3) days notice, may remove any campaign sign in violation of this Ordinance. The sign enforcement authorities for the City of Lino Lakes are authorized to request enforcement of campaign sign violations through agencies and individuals not employed by the City of Lino Lakes M. The surface of all signs must be repainted at least once every two (2) years or whenever necessary as determined by inspection by Zoning Official to prevent the sign surface from becoming unkempt in appearance. When any sign is removed, the Zoning Official shall be notified and the entire surrounding area shall be cleared of all debris and unsightly projections and protrusions. N. Signs which become unsafe or unkempt in appearance shall be repaired or removed by the licensee upon notification by the Zoning Official. O. The source of light for any sign must be indirect or diffused and shall not be directed into any adjoining residential district. P. Q. R. Real estate development signs or construction site signs may be erected in compliance with the requirements of the temporary sign table, Section IV, paragraph EE. - _ • - - - ! ... are not mare than fifteen (15) feet above grade, and not within one hundred (100) feet- et-an- existing residential structure. Temporary signs advertising buildings or land for rent or for sale in all districts may be erected in compliance with the requirements of the temporary sign table. W. Sign permits are required for all signs unless specifically stated otherwise. Sign permit fees shall be as specified in the city fee schedule.All signs including temporary and portable over six (6) square feet in size shall require -a sign permit. Portable Sign: A sign designed to be movable from one location to another. Portable signs shall be used a maxim a year for a total of fifteen (15) days per time. For the purpose of this Ordinance, maximum square footage of a sign shall be computed on the basis of one (1) face of any multi -faced sign. Z. The permit owner shall be responsible for all of the requirements of this Ordinance, including the liability for expense of removal and maintenance incurred by the City. AA. Multi - Occupancy Business and Industrial Buildings: When a single principle building is devoted to three (3) or more businesses, or industrial uses, a comprehensive sign plan for the entire structure shall be submitted and shall be of sufficient scope and detail to permit a determination as to whether or not the plan is consistent with the following regulations. The plan shall be subject to the approval of the City Council. No permit shall be issued for an individual use except upon a determination that it is consistent with the approved comprehensive sign plan. 1. The maximum individual tenant sign sizes for multiple occupancy structures and individual uses which may display signs shall not exceed the maximum provisions for single occupancy structures in the same zoning district. 2. Multiple occupancy structures may display an area identification sign consistent with the applicable district provisions. Individual freestanding signs identifying the tenants' business shall not be displayed. Twenty Five Percent (25 %) of the area identification sign must identify the entire site, the balance of the sign may be used for individual tenant identification. 3. Except as provided in this ordinance, individual tenants of multiple occupancy structures shall not display separate wall signs unless the tenants' business has an exclusive exterior entrance. The number of signs shall be limited to one (1) per entrance, and each sign shall be limited to the maximum wall size sign permitted in the district, the total of which shall not exceed the square footage allowed. The signs shall be located only on exterior walls which are directly related to the use being identified. 4. In any multiple occupancy structure qualifying as a mall type shopping center, directory signs shall be permitted for each common public entrance. Each directory sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty (50) feet of the common public entrance being served. The size of individual business identification signing within the directory shall be established during the site plan review process. GRANDFATHER CLAUSE: All signs located within the City of Lino Lakes prior to the adoption of this Ordinance, may continue to exist as to size, illumination and present location, provided the sign does not violate any provisions of the Lino lakes City Code up to the date this Ordinance is passed and adopted. A permit is required for each existing sign, as applicable under this Ordinance. CC. Any signs not specifically allowed by this ordinance are prohibited. DD. Any violation of this Ordinance shall constitute a misdemeanor. The existing text imposes only minimal restrictions on building materials for commercial, industrial, and institutional buildings. The community standards regarding the quality of buildings have changed over time. Specifically, metal - skinned buildings that are or resemble pole barns no longer are acceptable. This type of construction is appropriate for agricultural uses or storage in rural areas. It is not acceptable for new commercial, industrial, or institutional structures. The attached draft ordinance proposes new language to clarify the requirements. In addition, new language has been added to address institutional uses in all locations. Churches and schools are allowed by conditional use in rural and residential zones, so the ordinance should cover those situations. OPTIONS 1. Approve the proposed amendments to the zoning ordinance. 2. Return to staff with direction RECOMMENDATION Option 1 • CITY OF LINO LAKES draft 8 /10 /05 ORDINANCE NO. 07 -05 AN ORDINANCE AMENDING THE ZONING ORDINANCE REGARDING EXTERIOR BUILDING MATERIALS FOR COMMERCIAL, INDUSTRIAL, AND INSTITUTIONAL STRUCTURES The City Council of the City of Lino Lakes hereby ordains Section 1 Findings The City Council makes the following findings: 1. The zoning ordinance includes requirements for the type of exterior building materials for commercial, industrial, and institutional buildings. 2. It is appropriate that these requirements be updated to reflect changes in the community and the market. 3. The requirements should address institutional buildings such as religious and • education facilities in all areas in which they are allowed by the zoning ordinance. • Section 2 Ordinance Amendment Section 3, Subd. 4.B.4. of the zoning ordinance (Ordinance No. 08 -03, as amended) is amended as follows: SECTION 3. GENERAL PROVISIONS Subd. 4. General Building and Use Provisions. B. Building Type and Construction. 4. Commercial, Industrial, and Institutional. All buildings erected on land within commercial, industrial and public and semi - public zoning districts, and all institutional buildings (such as public, education, and religious buildings) in residential and rural zoning districts shall conform with the following: a. All sides of the principal and accessory structures are to have essentially the same or a coordinated harmonious finish treatment pursuant to Section 3, Subd. 4.B of this Ordinance. • b. Exterior wall surfaces may be a combination of materials including brick, stucco, EFIS (exterior finish insulation system), textured, colored or decoratively finished pre -cast concrete panel, decorative or poured -in- place concrete panel, architecturacancrete -fleck textured concrete masonry units, cast -in- place- eencr - -ete, natural stone, manufactured stone, transparent, tinted or low - reflective glass, or decorative metal cladding panels. Decorative metal cladding refers to decorative, metal cladding systems such as copper, zinc, titanium, stainless steel and painted steel components fixed to the outside of the primary wall system. Earth tone colors of exterior materials shall be required. "Earth tone colors" shall be defined as any various soft colors like those found in nature in soil, vegetation, etc. Such colors are limited to various shades or tints of brown, black, gray, tan, beige, brick red, soft green, soft blue, or white. e. Ten (10) percent of the building facade may contain contrasting colors. Contrasting colors shall be those colors not defined as earth tones. f. All mechanical equipment, such as air-cenditionin-g- handling units located anywhere on the property, including rooftop equipment, ete -shall be screened andIer -- painted to match-the-building exterior. from view from adjacent streets, public rights of way, and adjacent properties. Don't lose sight of the issue at hand during a heated debate. Avoid grandstanding -- reasonable arguments clearly backed up by careful homework mayy win a debate rather than making other commissioners uncomfortable with hyperbole. Conflicts can be an opportunity for new insights, learning, and individual and organization growth. Disagreements can illuminate a topic in helpful ways and can present solutions to problems that previously had not been seen. The successful resolution of conflict can bind people together in powerful ways. IV. Respect the Will of the Majority Live with the results of a vote on an issue. Debate may be lively and heated, but once a decision is made and a vote taken, it is important to recognize this decision as the intent of the majority of the commission and take no actions to undermine this decision. Move on, without rancor. V. Respect the Rights of the Minority Be sensitive to the feelings and concerns of those who do not agree with the majority. Respect their rights of conscience. VI_ Treat Everyone with Respect Do not publicly embarrass or humiliate fellow commissioners, citizens, or staff. While disagreements ace expected and acceptable, always maintain an atmosphere of good will and respect, no -'natter who is speaking. Focus on ideas and suggestions instead of questioning people's motives, intelligence or integrity. Share Information Always share relevant information with fellow commissioners and staff, so that everyone has the same information. Staff members also must make certain that information is shared with all commissioners in a timely manner. VIII. Make Decisions in the Open Create an environment in which the City's business is conducted in the open and in which debate is encouraged and valued. Adhere not only to the letter, but also to the spirit of the Open Meetings law. Avoid speaking for the Commission as a group outside of Commission meetings. IX. Nurture the Value of the Individual; Recognize the Strength of the Team Individual commissioners have differing strengths, interests, and abilities. Take advantage of these differences when discussing issues --not everyone can be an expert on every issue. Learn what perspectives individuals bring to discussions. However, never lose sight of the fact that the Commission's legal and political strength comes from working as a team. Constituents expect their elected and appointed officials to learn to work together and with citizens to further the best interests of the City as a whole. X. Trust Your Judgment; Make Tough Decisions Commissioners are appointed to make informed decisions and recommendations. Seek many opinions on an issue. Ten calls on a particular issue may not represent the feelings of all residents. Find out who is impacted by decisions. Trust your judgments to decide what is best for the City as a whole, while protecting the rights of individual citizens. XI. Avoid "Meeting Night" Tunnel Vision Resist the temptations to form a perception about how the City functions based on what happens on Commission meeting evenings. Problems are resolved, projects are planned, citizens receive service, and decisions are made throughout the week. Keep what happens at - Commission meetings within the context of the operation of the entire City. XII. This Too Shall Pass Controversial issues may cause sleepless nights_ However, there will always be another issue looming on the horizon that may be just as controversial. Over time, it will be difficult to remember what was controversial a mere three months earlier.
