CALL TO ORDER AND ROLL CALL Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at 6:32 III p.m., February 8, 2006. II. APPROVAL OF AGENDA The agenda was approved. III. APPROVAL OF MINUTES: January 11, 2006 Mr. Laden requested a correction to Page 10, paragraph five, changing "Mr. Rafferty and Mr. Hyden voting nay" to "Mr. Rafferty and Mr. Laden voting nay." Mr. Laden requested a correction to Page 11, fifth paragraph under Item D., changing "not less than 50 percent would be without sidewalks" to "not less than 50 percent would require sidewalks." Mr. Tralle made a MOTION to approve the January 11, 2006 Minutes as amended and was supported by Mr. Pogalz. Motion to approve carried 7 -0. IV. OPEN MIKE Chair Rafferty declared Open Mike at 6:35 p.m. There was no one present for Open Mike. DRAFT MINUTES Planning & Zoning Board December 14, 2005 Page 2 Mr. Pogalz made a MOTION to close Open Mike at 6:36 p.m., and was supported by Mr. Laden. Motion carried 7 -0. V. ACTION ITEMS A. Final Plat for Cavegn Estates Mr. Bengtson presented the staff report. Staff recommended approval with no conditions. Mr. Root asked if the applicant is required to pay a fee for the street vacation. Mr. Bengtson replied that there is an application fee and an escrow fee that was paid along with the applicant's preliminary plat application. There were no further questions of staff. Mr. Laden made a MOTION to recommend approval of the Final Plat for Cavegn Estates. Motion was supported by Mr. Hyden. Motion to recommend approval of the Final Plat of Cavegn Estates carried 6 -0. B. Final Plat for Marshan Meadows Mr. Smyser presented the staff report. Staff recommended approval. Mr. Tralle asked if park fees were in place. Mr. Smyser explained that the necessary fees were collected with the developer's agreement. The city had received the required letters of credit and escrow dollars; park dedication fees were collected as cash. Mr. Smyser noted that staff confirms that these fees are completed before the City Council approves the developer's agreement. Mr. Tralle inquired about a potential trail that was initially discussed along the edge of the lake. Mr Smyser replied there is an existing trail easement along the lake on the properties to the south, however the property immediately south does not have a trail easement. Since previous discussions, the city's trail plan was revised to remove a trail along the lake in this area. Because of this, easements on the southern properties will be vacated. Mr. Smyser stated that, instead, the trail plan now calls for a future trail along Lake Drive. Mr. Smyser explained to the board that trails are not shown on final plats; final plats are limited to show only property boundaries, easements & wetlands. Mr. Tralle wondered why the trail wouldn't run along the lake, instead of along a busy road. Mr. Smyser responded that the Park Board decided the trail along the lake was not the best location for a trail. In addition, the proposed lots are not very deep, and a trail along the rear lotlines may have affected the ability to build on the lots. Mr. Smyser DRAFT MINUTES • • Planning & Zoning Board December 14, 2005 Page 3 • noted that the transportation trail proposed for Lake Dr is planned as a commuter bike route. • • Mr. Pogalz questioned the opportunity for future rezone and potential development of the church property to the south. Mr. Smyser stated that the property was previously split into multiple parcels, and a road easement currently exists for future extension of the road that will run through Marshan Meadows. Mr. Smyser noted that the church property is currently zoned R -1, and that MUSA and utilities are currently available; therefore the site will be able to be developed. Mr. Laden asked who will maintain the sidewalk. Mr. Smyser replied that this developer proposed the sidewalk, therefore the homeowner will be expected to shovel it. Maintenance of the sidewalk will be the responsibility of the city. Mr. Smyser explained that maintenance is usually dependent on the funding of a development. Mr. Laden suggested that staff consider addressing this issue for future developments. Mr. Rafferty asked what the wetland vegetation is in this area. Mr. Smyser was unsure of details, but noted that the wetland is delineated. Mr. Rafferty asked if there are any restrictions in place that would prevent the property owner from removing cattails or other vegetation from the lakeshore. Mr. Smyser replied that in order to remove vegetation from below the Ordinary High Water Level (OHWL), the owner would need permission from the DNR. Mr. Smyser added that a permit may or may not be required. Mr. Laden asked if the restrictions end at the OHWL. Mr. Smyser replied that the city requires a drainage and utility easement that extends ten feet beyond the wetland. The wetland area may extend past the OHWL. There were no further questions for staff. The Board recognized that Mr. Greg Schlink, Bruggeman Properties, 3564 Rollingview Drive, was in attendance to answer any questions. There were no questions for Mr. Schlink. The board appreciated Mr. Schlink's attendance. Mr. Pogalz made a MOTION to recommend approval of the Final Plat for Marshan Meadows. Motion was supported by Mr. Nelson. Motion to recommend approval of the Final Plat for Marshan Meadows carried 6 - 0. C. Final Plat for Miller's Crossroads 3rd Addition Mr. Smyser presented the staff report. Staff recommended approval. There were no questions for staff. DRAFT MINUTES Planning & Zoning Board December 14, 2005 Page 4 The board invited the developer Mr. Greg Schlink, Bruggeman Properties, 3564 • Rollingview Drive, for comment. Mr. Pogalz stated that he noticed a Pulte Homes sign at the development, and wondered if the structures would remain consistent throughout the development. Mr. Schlink responded that Bruggeman Homes will continue to build the one -story homes, and that Pulte Homes purchased Bruggeman's plans for the two -story homes in order to build them consistently. Mr. Pogalz asked when the development was proposed to be complete. Mr. Schlink replied that the proposed plat is the last phase, and should be completed by the end of the year. Mr. Laden inquired about the commercial corner. Mr. Schlink replied they are hoping to present a Conditional Use Permit application for the commercial area to the board at the next meeting. There were no further questions. Mr. Nelson made a MOTION to recommend approval of the Final Plat for Miller's Crossroads. Motion was supported by Mr. Laden. Motion to recommend approval of the Final Plat for Miller's Crossroads carried 6 — 0. D. PUBLIC HEARING for Amendment to Conditional Use Permit to allow for construction of an additional overhead crane bay at Molin Concrete, 415 Lilac Street Chair Rafferty opened the Public Hearing at 7:05 p.m. Mr. Bengtson presented the staff report. Staff recommended approval with three conditions listed in the staff report. Mr. Laden asked what the dotted lines shown on the plans were. Mr. Bengtson replied that the dotted line noted a previous Thomas St. line that is now vacated. There were no further questions for staff. The board invited Mr. Randy Molin, Molin Concrete, 415 Lilac St, to comment. Mr. Molin stated there was not much response from the neighbors for this project. Mr. Molin explained that the reason they are adding an additional bay is because they added another product line, which has increased productivity. The Board thanked Mr. Molin for his attendance. Mr. Laden made a motion to close the Public Hearing at 7:10 p.m.. Motion was supported by Mr. Tralle. Motion was approved 6 -0. CONTINUED: PUBLIC HEARING to Amend the Planned Unit Development for Legacy at Woods Edge to include signage criteria Chair Rafferty reopened the Public Hearing at 7:10 p.m. Mr. Bengtson presented the staff report, which included a draft of the Signage Criteria for Legacy at Woods Edge. Staff recommended approval. Mr. Laden asked if there was a difference between residential and commercial signage requirements. Mr. Bengtson stated that language could be added to make the distinction more clear. Mr. Laden responded that he was not requesting a language change, but was confirming there was a difference. Mr. Hyden asked if freestanding signs are limited to the YMCA and City Hall. Mr. Bengtson replied that was correct, and the reason was because these structures are set back from the Right -of -Way. Staff does not want to encourage monument signs that might interfere with visibility or accessibility of a site. Mr. Rafferty asked if there would be additional signage requirements in the future. Mr. Bengtson replied that this would be the entire signage ordinance for this development. Mr. Laden asked if there is a permit process to allow for temporary signs. Mr. Bengtson replied that Section 5.3 describes which signs require permits. Mr. Bengtson noted that banners and hand - written signs will be prohibited throughout the development. Mr. Rafferty appreciated staffs efforts to regulate the size of signs. Mr. Rafferty wondered why there was no requirement as to the centering of a building sign. Mr. Bengtson explained that there is a margin requirement on either edge of a building wall face, in order to prevent a sign to be placed all the way to a corner or edge of a building. Mr. Rafferty questioned if the proposed six -inch margin would be enough. Mr. Bengtson responded that the margin requirements could be increased for single tenant buildings. There were no further questions for staff. Mr. Hyden made a motion to close the Public Hearing at 7:22 p.m. Motion was supported by Mr. Tralle. Motion carried 6 -0. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: March 8, 2006 TOPIC: Final Plat Century Farm North 4th Addition BACKGROUND The Century Farms North Development Company has requested approval of a residential development called Century Farm North 4th Addition. The subject property consists of Outlot G of Century Farm North and Outlots A and D of Century Farm North 3' Addition. This plat will create a total of 43 residential lots and 2 large outlots that will eventually become part of the 5th Addition plat. The final plat conforms to the approved preliminary plat layout as approved by the City Council on April 28, 2003. The title commitments have been forwarded to the City Attorney for review. The conditions of the preliminary plat have mostly been addressed through the platting process of the first three phases, and will be enforced in a similar fashion for this addition. Specifically, the townhouse elevations will be held to the same standard developed for the 2nd addition, the height restrictions to protect air space for the air park are in place, and the trails for this portion of the development have already been platted by the 2nd addition. RECOMMENDATION 1. Staff recommends approval of the final plat for Century Farm North 4th Addition. ATTACHMENTS 1. Paul Bengtson March 8, 2006 PUBLIC HEARING: Conditional Use Permit — Dog Kennel 7933 24t" Avenue Linda Ide has requested approval of a Conditional Use Permit to allow a dog kennel at 7933 24th Avenue. This application is required due to the current animal ordinance which limits the number of dogs kept on one property to a maximum of two dogs. The applicant has been cited by the Lino Lakes Police Department for having dogs in excess of the limitations and those citations have directly led to this application being filed. ANALYSIS comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. A Dog Kennel is listed as a conditional use within the Rural Business Reserve zoning district and the conditions included are as follows: a. The applicable provisions of Section 503 of the City Code relating to the keeping of animals are determined to be satisfied. Section 503 of the City Code is attached to this report. The applicant has indicated in their justification letter, • that the minimum animal keeping requirements are being met, therefore this condition is being met. Staff is recommending a condition of approval that the applicant be required to maintain on -going compliance with the Snimal keeping standards of the City Code. Administration As listed in the Zoning Ordinance, the Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes. d. Traffic generated by a proposed development application is within the capabilities of the City. e. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. f. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. With a limitation to the number of animals that can be kept on the site, staff feels that all six on the Conditional Use Permit requirements are being met on the site. RECOMMENDATION Staff recommends approval of the request subject to the following conditions: 1. Ongoing compliance with the City Code relating to the keeping of animals. 2. I am applying for a conditional use permit for a kennel license. I have more dogs than the limit. These dogs are my personal pets. I do not run a business open to the public. I have lived on this property of ten acres for twenty -five years. I have a fenced in yard including gates across the driveway which are closed unless someone comes in or out of the driveway. I also have a fenced in exercise area that is connected to my house measuring 30 X 29 and 5 1/2 feet tall. It also has two swing dog doors with insulated boxes that lead into the attached porch. There are also 2 doors that open with a plastic window into the porch. It has motion flood lights that light up the entire exercise area. It also can be switched from the house to stay on or to stay off when needed. There also is a water facet in the exercise area to water the dogs and clean. The area is grass. Also there is a insulated milk house that has five separated dog boxes in the building that have openings to their own separate dog runs and also a door on each for access from inside the building. The building is 18 feet from the house and 8 feet wide 16.6 long. Each exercise run is cement floor. Each one has a locking gate with a 6 foot tall fence. There are five exercise runs measuring 12 feet long each run. Total of all 5 is 20 feet wide. The flood light from the other exercise pen lights up this area as well. I will be putting in its own separate flood light for that area within 60 days. The dogs spend most of the time in the house with me. I have six dogs that are my pets and belong to me. I sometimes with take care of my family or friends dogs temporarily in on vacation, etc. All dogs are current on vaccinations. It is the intent of this chapter to define guidelines for keeping farm animals on parcels of land within the city less than 10 acres in size; to facilitate distribution of animals within this city in such a manner as to prevent coincident and concurrent high - density populations of both residents and animals within the same geographical area by permitting animals to be kept on smaller parcels of land located in appropriately zoned areas; to minimize the risk of nuisances by limiting the total number of animals per acre and providing animal- specific nuisance guidelines; and to facilitate the enforcement of these regulations by providing for registration of parcels smaller than 10 acres on which the keeping of animals will be permitted. 503.02 Definitions. Subdivision 1. Animals. "Animals" means horses, mules, donkeys, cattle, sheep, swine, rabbits, skunks, foxes, raccoons, mink, and other similar animal beings which are endowed with the power of voluntary motion. Subd. 2. Fowl. "Fowl" means all birds of any kind including poultry, turkeys, chickens, ducks, geese, pigeons, gallinaceous birds, and other similar birds. Subd. 3. Parcel of Land. "Parcel of land" or "parcel" means either: 4110 (1) A piece of contiguous real property under one title; or • (2) A piece of contiguous real property under more than one title, provided the total area is at least 5 acres and no more than one residence or dwelling is constructed on the property. Subd. 4. Animal Unit. "Animal unit" means a unit of measure to compare differences in the production of animal wastes, which has as a standard the amount of waste produced on a regular basis by a slaughter steer or heifer. At Large. An animal shall be deemed to be at large if it is not on the premises of or under direct control of its owner. Subd. 6. Commission. "Commission" means the Lino Lakes Commission for Non - Household Animal Control; created pursuant to 216. 503.03 Animals. • • Subdivision 1. Minimum Acreage. Except as provided by 503.04, no person shall keep or harbor animals, fowl, or bees in the city or permit the same to be done upon premises owned, occupied, or controlled by him, except upon a parcel of land containing 10 acres or more. Subd. 2. Exception. The provisions of Subdivision 1 shall not apply to cats, dogs, fowl, or other similar animals such as skunks, rabbits, raccoons, canaries, chickens, ducks and pigeons when kept as household pets. 503.04 Animals, Small Lots. Subdivision 1. When Permitted. Animals except swine, may be kept on parcels of land containing less than ten acres but containing a minimum of 2.5 acres in areas zoned "R" or "R -X ", and a minimum of five acres in areas zoned "S -R" or "S -RX ". Subd. 2. Registration Required. All parcels upon which animals are kept as permitted by Subdivision 1 shall be registered as provided by 503.05, unless the animal unit density is less than 0.2 per acre. Subd. 3. Maximum Density. The maximum animal unit density for parcels subject to 503.04 shall be 0.5 units per acre. 503.05 Registration. Subdivision 1. Information Required. Persons desiring to register land as required by 503.04 shall submit the following information to the clerk - treasurer: (1) Name and address of applicant; • (2) A certified copy of title or deed to the parcel, or the previous year's tax statement for the parcel, or an original or certified copy of a purchase agreement for the parcel, or a lease agreement for the parcel; provided that any of the above must state the approximate parcel acreage or parcel dimensions such that the parcel acreage and location may be readily determined; (3) A statement of animals to be kept on the parcel, including species, maximum number of each species, age, sex, color, markings, identifying brand or tattoo, or photographs of larger animals; (4) Plans concerning housing, fencing, and waste disposal or removal, including a sketch of proposed fence lines, barns, and other structures relative to property lines and existing structures on all adjacent property. Subd. 2. Inspection. The parcel and any proposed buildings shall be inspected by the city building inspector or his designated representative. Inspection shall be directed specifically toward: (1) Proximity of proposed animal housing areas to residences, dwellings and wells; (2) Adjacent wetlands and waterways; (3) Potential drainage into adjacent wetlands and waterways. Notice of approval shall be forwarded directly to the clerk - treasurer by the building inspector within two weeks after the completed application is received. Re- inspection may be requested by the applicant after completion of all necessary corrections outlined by the building inspector. Subd. 3. Recording. After receipt of the building inspector's approval, the clerk - treasurer will register the hobby farm operator for the number and species of animals requested. The total number of animal units shall not exceed one per acre of the parcel, as the title, deed, tax statement, purchase agreement, or lease agreement for the parcel. Subd. 4. Fees. A one -time hobby farm operator registration origination fee of $5.00 per animal unit or fraction thereof shall be paid to the clerk - treasurer. Subd. 5. Renewal. Each registration shall be renewed annually by remitting an annual fee of $1.00 per animal unit, together with a current list of species and number of animals housed on the parcel, to the clerk - treasurer. 503.06 Bees. Bees may be kept on parcels registered pursuant to 503.04 and 503.05. Bees shall be kept in accordance with the state apiary law and other statutes and regulations governing the keeping of bees. Where appropriate, fencing around hives or colonies may be required to minimize attractive nuisance. 503.07 Animal Wastes. • • Subdivision 1. Sanitation. Structures in which animals are housed and land containing animals shall be maintained in a clean and sanitary manner, free of excessive accumulation of animal wastes, and shall not provide an attractive breeding site for flies or cause excessive emission of animal waste odors. Subd. 2. Disposal. Animal wastes shall be disposed of by removal from the premises or by tilling into the soil at regular intervals. The length of intervals and method of disposal shall be determined by the Commission, based on the density of the animal population and availability of open land within the parcel for tillage. 503.08 Prohibitions. • Subdivision 1. Nuisance. No person shall suffer or allow any animal or fowl to disturb the peace and quiet of the city or to otherwise become a public nuisance so as to annoy, injure, or endanger the health, safety, comfort, or repore of the public, or to in any way render the inhabitants of the city or a consider -able number thereof, insecure in life or in use of property. Subd. 2. Trespassing. M.S. 609.605, Subd. 5, prohibiting trespassing while astride, driving, or leading an animal, is hereby adopted by reference. Subd. 3. Running At Large. M.S. 609.605, Subd. 3, is hereby adopted by reference. No person shall permit any animal owned by him to run at large. Subd. 4. Diseased Animals. Animals with contagious disease of any kind shall be securely confined on the premises of their owner or harborer and shall not be permitted to approach within 50 feet of any public roadway or any place where animals belonging to or harbored by another person are confined or kept. 503.09 Enforcement. Subdivision 1. Procedure. Complaints of violations of this chapter may be filed with the police department. The police department may forward complaints to the Commission. Subd. 2. Penalties. In addition to any other penalties provided for violation of this chapter, the council may revoke the registration of any hobby farm operator who is convicted of violating any provision of 503. 503.10 Existing Farms. Hobby farms that were in operation prior to May 26, 1981, shall be exempt from the provisions of 503.01 through 503.06; provided that exemption shall be contingent upon compliance with all of the following provisions: • (1) The operation of the hobby farm as a hobby farm has been and will remain continuous since its origination. (2) Any interruption in operation as a hobby farm shall not exceed twelve calendar months. (3) The acreage designated as the original hobby farm shall remain intact and shall not be reduced by any cause, including sale of inclusive real property or expiration of lease to the property. (4) The hobby farm operation shall not be intensified in terms of either numbers of animals or additional species of animals. (5) The non - conforming parcel shall be registered as pursuant to 503 no later than 5/26/82. C STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: March 8, 2006 TOPIC: PUBLIC HEARING - Rezoning From Rural to R -3 - Preliminary Plat MUSA Reserve Allocation Pheasant Stroll Estates BACKGROUND Brunn Custom Homes has submitted a request for a rezoning and preliminary plat, which requires an allocation of MUSA reserve. The subject site is ten acres of property at the northwest corner of Co. Rd. J (Ash St.) and Ware Road. The application includes platting for 27 townhomes and retaining an existing single family home. The site is within the area of the Hodgson/CR J master planning study. The goal of this study is a document that will guide development of the area. The study is examining infrastructure— roads, water, sanitary sewer —to determine how to provide the infrastructure to support development and redevelopment activity. The overall master plan for the Hodgson/CR J area is still underway so a number of basic infrastructure elements are not yet in place or planned. Staff is recommending continuing the public hearing to allow the applicant to work on further refining the design of the project and coordinate with the infrastructure planning project. The site is not within the current MUSA. The table above identifies the existing land use and zoning as well as guided land uses for the area. The following is a summary of the of the proposal: Gross Site Area 10.0 acres Upland Area 8.2 acres to be confirmed Total Units 28 Gross Density 2.8 units /acre Net Density 3.4 to be confirmed Zoning: A rezoning to R -3 requires that the site be guided for Medium Density, which it is, and which requires 3 -6 units per acre. There is a significant area of wetland on the site, which will be subtracted from the net area. This will raise the density above the 2.8 u/a because net density uses only upland. The MUSA reserve is allocated based on the amount of upland as well. Growth Management: The City's growth management policy (Ordinance 24 -04) implements growth policies of the comprehensive plan. It establishes limits on the number of new units to be approved as well on the use of MUSA reserve. We have nine lots left for year 2006, which means this project could not be final platted until 2007. We have 82 lots left for 2007. The site is not within the MUSA. We have 25.5 acres of MUSA reserve available for year 2006 and 6.8 acres for 2007. If the year 2006 acres are not used, they carry over to following years. PRELIMINARY PLAT/PLANNED UNIT DEVELOPMENT Buildings, Units: The proposal includes 27 townhomes as two -, three -, and four -unit structures. An existing single family home would remain. Streets, Access: A local circulation system of roads and access points is one of the major elements of the 49/J planning study. The attached concept plans show two conceptual options for providing circulation and access for land within the study area. The submitted plan includes a private drive access onto CR J. The City is trying to avoid the creation of individual accesses onto the arterial roads. (Hodgson and CR J are arterials.) A new local street located along the west border of this site would provide a single access for all properties between Ware and Hodgson Roads. It could align with Shoreview's Kent St. on the south. The point is to create one planned access points and eliminate all other driveways onto CR J. • • • Pheasant Stroll Estates page 3 The applicants propose a temporary private access to CR J which then would be removed in the future when the new public street is built. The private drive would connect to the new public street near the northwest corner of the site. Two problems arise with the proposal. First, it would be difficult to get the "temporary" access removed and connect with the new public street. Residents of the townhome neighborhood likely would oppose removing an existing driveway access and connecting to a public street. Once an access exists, and the entire neighborhood is built and populated while that access exists, it is very difficult to remove it. In addition, we have experienced many occasions where residents oppose a new connection to an abutting development after they are accustomed to isolation. The second problem is that the proposed design puts all of a new street entirely on another property. This would mean that the property owner to the west would bear the entire loss of land to the road. It is typical to align roads on property lines, with half the right of way dedicated from development on each side. It is possible that the site could access directly onto Ware Road. However, the questions of connecting to a future public road on the west side, and right of way for this road, are not completely addressed by this option. The proposal does include additional right of way dedication for CR J. It also includes land for the future realignment of Ware Rd. The goal there is for the City to be able to align Ware Rd. with the existing Mackubin St. in Shoreview to create a four -way intersection rather than the existing off set situation. The proposed design does not take into account the larger public interests in access management. Staff does not support the proposed design. Utilities: Municipal utilities comprise the other vital infrastructure element in the 49/J planning study. Water must be looped through the area. Water trunk lines terminate in the southern ends of Ware Rd. on the east side and Woodridge Lane on the west. Long water trunks without looping may not provide adequate pressure. The proposed design of Pheasant Stroll Estates includes a utility corridor connecting to the water and sanitary sewer trunks existing in Ware Road. We do not yet know if the water service is adequate to support this development. A test is scheduled by the Public Works Dept. A sanitary sewer trunk also exists in Ware Road. However, it is very shallow. The 49/J study has taught us that a lift station likely will be needed for the area. Whether this will flow to Ware Road or north to another connection point needs to be determined. Stormwater Management, Wetlands: The north east portion of the site includes 1.8 acres of a larger wetland complex that extends across properties to the north. A mitigation plan will be needed if wetlands are filled. The square buffer easement shown • • Pheasant Stroll Estates page 4 on the plans will need revision. The Rice Creek Watershed District cannot confirm the wetland delineation until spring. The City supports surface filtration and other means of treating runoff, though the proposed design may need some revisions. Landscaping: We require landscaping along collector and arterial roads in new subdivisions to buffer homes form the roads. Park Dedication: Park dedication would be cash: $2075 per new dwelling unit. ENVIRONMENTAL BOARD The Environmental Board reviewed the application on February 22. The comments are attached. As the design evolves, we will examine how to implement appropriate recommendations. OPTIONS 1. Approve rezoning, preliminary plat, and MUSA allocation. 2. Deny rezoning, preliminary plat, and MUSA allocation. 3. Continue public hearing to allow for further discussion on meeting infrastructure needs and other issues. This area on this site has a strong potential for rare plants. A rare plant inventory must be completed. Even if rare plants are not found in the flood plain area of Pheasant Stroll Estates, there is a high probability that the seed bank for these plants exist. • The developer should work with RCWD and the City to reposition ponds and infiltration areas located in the flood plain, or design a creative wetland enhancement project that would satisfy the RCWD on this site. • A Conservation Easement should be placed over the flood plain area of this site and given to the City. • The developer provides evidence that the septic system and fuel tank located on the site are properly disposed of. • A landscape plan should be submitted for screening purposes and escrow dollars should be allocated to provide one tree per frontage of each new • Page 1 • house. The landscape plan should show all seeded areas and the City native • seed mix shown the plant specifications text. • The spillway area located on the plan may be inadequately sized and allow siltation into the wetland. • Water from impervious areas should be directed on to grassy areas instead of down driveways and into storm sewers. • The developer should loosen the soils in graded open space areas to restore infiltration capacity. Top soils should be completely tilled as deeply as possible. • Look at other BMPS such as curb cuts and rain gardens along the street scapes to provide a more integrated approach to surface water treatment train • The Developer has submitted a storm water pollution prevention plan. The plan has most of the issues covered. The "Inspection and Maintenance "notes section" should add that all inspection records and the SWPPP will be maintained on the site in a designated location and available to inspectors at all times. The developer must state where this location will be on the site. Most convenient is a mailbox. The rock entrance described in the SWPPP should be at least 50 feet long. The large scale map was unreadable. In addition, it is suggested that additional stockpile of 1.5 inch rock be maintained on the site to top dress the entrance when rock pore space is filled. The City would prefer the Infrasafe Debris Collection Device (or a suitable substitute) for storm sewer inlet protection. These must be used on all constructed and existing storm water inlets. If there are anticipated concerns with soil movement along Ware Road, these devices should be used there. A street sweeping schedule should be submitted that is acceptable to the City on all interior and exterior roads used for the project. • Soils should not be imported or exported from this site without City approval. D Jeff Smyser March 8, 2006 PUBLIC HEARING Conditional Use Permit - Accessory Drive Through Facility and - Restaurant Outdoor Dining Facilities Millers Crossroads Shopping Center The Millers Crossroads development was approved in 2003 with Resolution 03 -142. The project includes one commercial lot at the corner of Birch St. and Hodgson Rd. This lot received approval for a conditional use permit for a daycare business that would have filled part of a commercial building. That business did not materialize and the building was never constructed. The current proposal includes a coffee shop in the east end of the building and a Subway sandwich shop in the west end. The applicant has requested a conditional use permit for an accessory drive through and outdoor seating for the coffee shop. A public hearing is required for a conditional use permit. If these facilities were not requested, the building itself would be reviewed administratively. The proposed building is similar to what was approved in 2003. The parking requirements for restaurant uses is higher than for retail or office uses. Adding two restaurant uses to the site increases parking requirements beyond what the original 2003 review assumed. A variance would be needed to allow fewer parking spaces than the ordinance requires. ANALYSIS The table below identifies the existing land use and zoning as well as guided land uses for the area. Restaurants and retail businesses are permitted uses. An accessory drive through facility is a conditional use, as is outdoor seating for a restaurant. Specific requirements for these are addressed below under the CUP heading. Building: The commercial building exterior includes a stone base, painted "hardi- plank" lap siding, a stucco sign band, vinyl shakes on the gable ends, metal fascia, and aluminum windows and doors. (This is an improvement over the prehung vinyl windows of the 2003 approval.) Decorative painted wood columns support the overhang and add visual interest. The building meets the commercial building materials requirements while the style and colors of the building complement the structures in the residential area of the development. In the 2003 approval, the trash enclosure was attached to the east side of the building at the northeast corner. It would have faced east with access from the entry drive. With the addition of the drive through facility, the trash enclosure has been moved to the south with access from the new drive through lane. While we typically require trash enclosures attached to the building, the possible locations are limited by the two driveways and the large ponding areas on both the east and south. Signage: When a single principle building is devoted to three (3) or more businesses, a comprehensive sign plan for the entire structure shall be submitted and shall be of sufficient scope and detail to permit a determination as to whether or not the plan is consistent with the following regulations. Some revisions have been submitted to the August 2003 sign plan. The EIFS sign band has been changed to stucco, a minor and acceptable change. Signs have been added to the east and west facades. Because the building has more than one street frontage, they may have one additional wall sign beyond the signs for the tenants with individual entrances on the front of the building. If there is to be a second sign on end of the building, it must be for a tenant of building. They do not get a sign on each end of the building. We recommend that the additional sign be allowed on the Hodgson Road side (west elevation). Sign height is measured from grade to the uppermost points or level of sign surface. The height of the monument sign differs between the sign plan information and sheet SP2. This must be corrected/clarified to be consistent. Lighting: Exterior lighting fixtures must be 90 degree cutoff types. The submittal includes several cut sheets for the exterior fixtures. Recessed fixtures are shown in the soffits. The submitted wall fixtures for the back of the building do not meet the requirement and must be changed. The lights over the main site driveway, drive through and parking lot comply with the 90 degree cutoff requirement. However, the lighting plan lists them at 30' high. The street lights on Birch St. and Hodgson Rd. are that high, but in Lakota Trail they may be less than 30'. The parking lot and driveway lights for this commercial site should be no taller than the street lights in Lakota Trail. • • • Millers Crossroads Shopping Center page 3 Parking: The following table lists the ordinance requirements by type of business. The ordinance states that 90% of the gross footprint should be used unless a specific use requirement differs. Lacking data on the interior dining area of the coffee shop, the calculation uses 90% of the gross shop area as listed in the floor plan (sheet A2.1). The building was the same size as the new proposal and the plan provided 65 parking spaces with the potential for 16 more. That approval assumed a daycare and retail use of the building. Two restaurant uses instead of the daycare increases the parking needs. The parking breakdown table shows that the total required is 99 parking spaces. The design supplies 78 spaces to be built. The parking proof of parking shows 14 for a total of 92. This is 93% of the requirement. A total of four handicapped spaces are needed for a parking lot of 76 to 100 spaces, so one more must be added. The city can allow a "parking deferment" under certain conditions: the proof of parking would be the parking deferment. If a problem arises in the future, the city can require the additional parking to be constructed as shown in the proof of parking area. If the additional proof of parking area spaces are constructed, the trash enclosure would need to be moved to allow the access to the new spaces. Under the conditions for a parking deferral, the peak parking must be less than the required parking and there must be sufficient property under the same ownership to accommodate the need. (See Section 3, Subd. S.G.) That is, there must be space to build the deferred parking spaces if needed in the future. This is met with the proof of parking. • • Millers Crossroads Shopping Center page 4 However, at the time of this report, we have not received a peak parking analysis to show that the shared parking lot can accommodate the peak demand. If we receive an analysis in time to review it, we can present the findings to the P & Z at the meeting. Stormwater Management: Stormwater flows through a series of ponds. A large outlot, platted as Outlot C of Millers Crossroads, includes the pond to the east of the building and the pond /wetland to the south. These facilities were designed to handle runoff from this commercial site. The drive through will cross this outlot, so an access easement is needed. The easements will grant access to the commercial site across the pond outlot. Utilities: The original Millers Crossroads approval included extensive installation of utilities (water and sanitary sewer). Part of the plan includes extending lines across the commercial site to Hodgson Road. These pipes must be constructed across the site as part of this project. This is to provide the ability to install trunks down the west side of Hodgson to provide service there. An easement must be granted to the City for these utilities. The City Engineer's report is attached. Landscaping: The new plan includes significantly more landscaping than the 2003 plan, including a berm and lilacs to screen the building from residences west of Hodgson Road. A variety of trees, shrubs, and other plantings provide screening and create an aesthetically pleasing site. The outdoor seating area would be surrounded by tree lilacs, roses, perennial flowers, and arborvitae. The drive through would be flanked by dogwood. Pine, spruce, ash, maple, and linden trees would be distributed across the site. CONDITIONAL USE PERMIT FOR DRIVE THROUGH AND OUTDOOR SEATING Drive Through: The original approval of this site included one driveway from Lakota Trail to the parking lot to the front (north) of the building. The proposal includes a second driveway to create a drive through route to a drive up window for the coffee shop. This requires some alterations of the site. As noted above, the trash enclosure is moved to the south to make way for the drive through. The stormwater system originally was designed for the upper pond to discharge into the next one to the south, then to the next one, and so on. The main driveway runs between the first and second ponds. There is a strip of land separating the second and third ponds. The newly proposed drive through lane is to be built over this strip of land. This will require the construction of a retaining wall. We do not have a structural engineer's design for the retaining wall. This is necessary because of its height and because there will be times when its base will be in water. • The drive through will cross the stormwater pond outlot, so an access easement is needed. The easement will grant access to the commercial site across the pond outlot. Though the • • Millers Crossroads Shopping Center page 5 outlot is not yet owned by the City, it ultimately will be deeded to the City, as is often the case with ponding areas. It is important that the City's stormwater management activities and responsibilities are not negatively affected by the access drive. It also is important that the commercial property owner is responsible for maintaining the roadway. We have reviewed draft easement documents. The easement must be expanded to include the retaining wall, the reference to Lot 16, Block 1 should refer to Millers Crossroads (not the 3rd Addn.). We are discussing how to ensure responsibility for maintenance of the road. We also need to have some changes to the document regarding the City warranting rights to the outlot. The easement document(s) will be finalized prior to approval of the CUP by the City Council. The City Engineer's report is attached. Outdoor Seating: The coffee shop is to have an outdoor seating area on the south side of the building. It is approximately 580 sf and could hold six tables. The area is screened with landscaping and accessible only from within the building. • Standards and Requirements for Conditional Use Permits The zoning ordinance includes overall standards that apply to all CUPs. There also are specific requirements for each CUP for a specific use. General Standards: The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: 1) Land Use Plan. 2) Transportation Plan. 3) Utility (Sewer and Water) Plans. 4) Local Water Management Plan. 5) Capital Improvement Plan. 6) Policy Plan. 7) Natural Environment Plan. The proposed CUP is consistent with the comprehensive plan. b. The proposed development application is compatible with present and future land uses of the area. The site is guided for commercial use and a commercial building was reviewed for • the site as part of the original Millers Crossroads project. Millers Crossroads Shopping Center page 6 c. The proposed development application conforms to performance standards herein and other applicable City Codes. The site meets zoning requirements and, with compliance with the conditions of approval, meets all performance standards. d. Traffic generated by a proposed development application is within the capabilities of the City. e. The proposed development shall be served with adequate and safe water supply. f. The proposed development shall be served with an adequate and safe sanitary sewer system. g. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. The site will be served with municipal water and sanitary sewer service. Traffic generation was reviewed with the Millers Crossroads development and road improvements have been made to accommodate the development. No capital improvements by the City are necessary. h. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. i. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. The uses will not create any negative impacts on surrounding property or natural or cultural resources. Conditions specific to Accessory drive - through facilities: a. Not less than one hundred twenty (120) feet of segregated automobile stacking must be provided for the single service lane. Where multiple service lanes are provided, the minimum automobile stacking may be reduced to sixty (60) feet per lane. b. The stacking lane and its access must be designed to control traffic in a manner to protect the buildings and will not interfere with on -site traffic circulation or access to the required parking space. c. No part of the public street or boulevard may be used for stacking of automobiles. The design provides over 120 feet of stacking. The design provides a separate drive through that does not interfere with the parking lot circulation or access and does not stack out onto a public street. • • Millers Crossroads Shopping Center page 7 d. The stacking lane, order board intercom, and window placement shall be designed and located in such a manner as to minimize glare to adjacent premises, particularly residential premises, and to maximize maneuverability of vehicles on the site. e. The drive - through window and its stacking lanes shall be screened from view of adjoining residential zoning districts and public street rights -of -way. f A lighting and photometric plan will be required that illustrates the drive - through service lane lighting and shall comply with Section 3, Subd. 4.F of this Ordinance. The lighting and site designs meet the lighting requirements and provide screening for the drive through facilities. The nearest residential structure is over 200' away from the drive through window. Conditions Specific To Accessory Restaurants With Accessory Outdoor Dining Facilities a. The applicant submit a site plan and other pertinent information demonstrating the location and type of all tables, refuse receptacles, and wait stations. b. Access to the dining area be provided only via the principal building if the dining area is full service restaurant, including table waiting service. c. The size of the dining area is restricted to thirty (30) percent of the total customer floor area within the principal structure. d. The dining area is screened from view from adjacent residential uses in accordance with Section 3, Subd. 4.Q of this Ordinance. e. All lighting be hooded and directed away from adjacent residential uses in accordance with Section 3, Subd. 4.F of this Ordinance. f. The applicant demonstrates that pedestrian circulation is not disrupted as a result of the outdoor dining area by providing the following: 1) Outdoor dining area shall be segregated from through pedestrian circulation by means of fencing, bollards, ropes, plantings, or other methods, and shall be subject to review and approval by the City Council. 2) Minimum clear passage zone for pedestrians at the perimeter of the restaurant shall be at least five (5) feet without interference from parked motor vehicles, bollards, trees, tree gates, curbs, stairways, trash receptacles, street lights, parking meters, or the like. 3) Overstory canopy of trees, umbrellas or other structures extending into the pedestrian clear passage zone or pedestrian aisle shall have a minimum clearance of seven (7) feet above sidewalk. • Millers Crossroads Shopping Center page 8 g. The dining area is surfaced with concrete, bituminous or decorative pavers or may consist of a deck with wood or other flooring material that provides a clean, attractive, and functional surface. h. A minimum width of thirty -six (36) inches shall be provided within aisles of the outdoor dining area. i. Storage of furniture shall not be permitted outdoors between November 1 and March 31. Outdoor furniture that is immovable or permanently fixed or attached to the sidewalk shall not be subject to the storage prohibition of this section. However, any immovable or permanently fixed or attached furniture must be approved as part of the administrative permit application. Additional off - street parking shall be required pursuant to the requirements set forth in Section 3, Subd. 5 of this Ordinance based on the additional seating area provided by the outdoor dining area. J. k. Refuse containers are provided for self - service outdoor dining areas. Such containers shall be placed in a manner which does not disrupt pedestrian circulation, and must be designed to prevent spillage and blowing litter. All these requirements have been met. The parking question has yet to be resolved 110 regarding the peak parking demand. CONDITIONS OF APPROVAL 1. The lighting fixtures for the south wall must be 90 degree cutoff fixtures so they cast light downward, not upward. New fixtures must be submitted prior to city council review of the conditional use permit. 2. If parking, circulation, or traffic generation create problems in the future, the City may require that additional parking be constructed, as shown on the plan as "proof of parking ", which would require moving the trash enclosure. Additional requirements may be imposed to resolve such issues. A performance or development agreement shall be prepared, and recorded against the property, that requires the property owner to install such parking as directed by the City. 3. Handicapped parking spaces must be provided to comply with applicable state law. 4. Water and sanitary sewer utilities must be constructed across this site in accordance with the Millers Crossroads utility plan approval. An easement must be granted to the City for these utilities. • Millers Crossroads Shopping Center page 9 5. The permanent access easement and temporary construction easement shall be fully reviewed by City staff and will be finalized prior to approval of the CUP by the City Council. 6. An engineered retaining wall plan and cross section of the wall and the street for the drive through must be supplied and obtain City Engineer approval prior to City Council review. 7. Responsibility for maintaining the retaining wall and road shall be ensured through legal documentation. 8. The sign plan shall be revised and resubmitted prior to City Council review. One sign is allowed on either the east or west elevation. The monument sign elevation on sheet SP2 or the information in the sign plan submittal for the monument sign shall be clarified regarding sign height. 9. Parking lot lights shall be no taller than street lights in Lakota Trail. OPTIONS 1. Approve the conditional use permit for the drive through facility and the outdoor • seating with the listed conditions. 2. Return to staff with direction. Additional information must be supplied to address the parking issue. In order to justify a reduced number of parking spaces, a shared parking, peak demand analysis would be needed. RECOMMENDATION Option 2 unless additional information is submitted in time for staff to review it to address parking issues.
