PUBLIC HEARING for a Conditional Use Permit to allow a commercial dog kennel at 7933 -24th Avenue Mr. Bengtson presented the staff report. Chair Rafferty opened the Public Hearing at 6:43 p.m. Staff recommended approval subject to the conditions of the staff report. Mr. Bengtson noted that he had distributed city Ordinance No. 03 -96 to board members prior to the start of the meeting. Mr. Rafferty asked the Board to consider tabling this item in order to review the distributed information. Mr. Pogalz asked how the city came upon this request. Mr. Bengtson replied that the Police Department had received calls regarding stray dogs from this property. Mr. Bengtson stated that all ordinances and code sections need to be met in order for approval. He pointed out that basic sanitation standards are in place, but staff is currently working to amend the animal ordinance to better define these requirements. Mr. Nelson pointed out a discrepancy of the number of allowable dogs within the report. Mr. Bengtson stated that we would clarify from the applicant the exact number of dogs they are requesting to be allowed. Mr. Rafferty asked for public comment. The applicant was not in attendance. Staff stated that the applicant had notified staff that she may not be able to attend the meeting due to illness. No one was present to speak on this issue. The board agreed to table the item, but were concerned about citations being issued prior to the item being resolved. Staff stated that they would remain in communication with the police department regarding this issue. Mr. Tralle made a MOTION to continue the Conditional Use Permit to allow a commercial dog kennel at 7933 — 24th Avenue to the April 12, 2006 meeting. Motion was supported by Mr. Hyden. Motion carried 6 -0. DRAFT MINUTES • Planning & Zoning Board March 8, 2006 Page 3 C. PUBLIC HEARING for a Rezone, Perliminary Plat and MUSA Allocation for Pheasant Stroll Estates Mr. Smyser presented the staff report. Mr. Rafferty opened the Public Hearing at 7:04 p.m. Mr. Smyser stated that they have been working with the Anoka County Highway Department and neighboring cities on road alignment issues and infrastructure. Mr. Smyser stated that a letter received by a resident will be included as part of the public record for this meeting, and was distributed to the board. Staff stated that there were a number of outstanding issues with this project, therefore they were recommending continuing the public hearing. Mr. Smyser stated that successful development will require sufficient access and utilities. He added that these discussions are ongoing and progressing, but will need to be resolved prior to plat approval. Staff discussed roadway and utility options that are being considered for the site. Mr. Rafferty asked for public comment on the issue. Mike Black, Royal Oaks Realty, representing the developer on behalf of Brunn Construction, stated that they are a local company that has been building in the area for a long time. He stated that Brunn purchased this property in the summer of 2004, and have been working with staff and neighboring property owners since then to plan this development. He noted that Bob's Auto Ranch is not interested in selling their property at this time. He added that they are retaining an existing log home on the site. They feel that what they are proposing is the best option for this site. They would like two permanent turnarounds, and are trying to help facilitate development to the west. They are trying to avoid a lift station and have tried to address staff's concerns. They are eliminating an offsetting intersection and allowing for future development. They plan to avoid additional offset intersections. Royal Oaks Realty did its own study of this area as to what would make the most sense taking the area into account. They believe the road should line up with Kent St. Their proposal provides for a possibility of future lots on the western border of the site and allows for residential development while aligning the intersection to the south. They believe that this proposal makes as much sense and is as safe as any plans LandForm has proposed. Mr. Black would prefer not to mix uses with the commercial area. Mr. Tralle pointed out that minimizing access points has not been successful in the past. • He is concerned for the city. Mr. Black stated that this plan would allow for either a road extension or no extension. DRAFT MINUTES Planning & Zoning Board March 8, 2006 Page 4 • Mr. Rafferty pointed out that there has been a recommendation by staff to table this item in order to allow for further discussion with staff. He would like this project continued at the next meeting and in the meantime work with staff to address staff concerns. He requested revisions to the roof layout of the proposed town homes and asked for a submittal of colored elevations at a future meeting. Mr. Hyden was concerned about safety when streets are offset. Mr. Hyden made a MOTION to continue the Public Hearing for the Rezone, Preliminary Plat and MUSA Allocation for Pheasant Stroll Estates to the April 12, 2006 meeting. Motion was supported by Mr. Nelson. Motion carried 6 - 0. D. PUBLIC HEARING for a Conditional Use Permit to allow for accessory drive - through and outdoor dining facilities for Miller's Crossroads Shopping Center Mr. Smyser presented the staff report. Chair Rafferty opened the Public Hearing at 8:08 p.m. Mr. Smyser clarified that the Public Hearing is for the drive - through and outdoor dining only, not for building design approvals. Mr. Smyser confirmed that the proposed trash area is enclosed and that the peak parking issue has been resolved since the staff report was written. Staff will require more information about the retaining wall. Mr. Smyser clarified that the outdoor seating will only be accessible from inside the coffee shop, as per CUP requirements. Staff stated that they received two emailed comments that will be part of the public record, as were distributed to the board prior to the mtg. Staff is recommending approval. Robert Bayer, 6490 Hokah Drive, owner of CuppaJo's coffee shop at 6505 Ware Road, stated that he believes the city should help local businesses succeed. He stated that allowing this coffee shop would have a negative impact on his shop as well as the entire Spirit Hills Center. He believes a traffic study is warranted to allow for a Conditional Use Permit. Mr. Bayer pointed out there are current problems with existing traffic backup on Birch St., as well as trying to exit off of Ware Road onto Birch Street. He added that many accidents have occurred at the intersections of Hokah Dr., Birch St., and Ware Rd. Katie Allen, 3890 88th Court NE expressed concern about traffic. She stated that an additional coffee shop with a drive - through will increase traffic onto Birch St. She requested an improvement to the intersection at Spirit Hills, possibly signals, to decrease traffic problems. She asked that this item be tabled in order to address increasing traffic issues on Birch St. DRAFT MINUTES • • Planning & Zoning Board March 8, 2006 Page 5 Michael Lawrence, 339 Arrowhead Drive, pointed out that access to Miller's Crossroads from Birch St. is a right turn only with no left turn entrance. Traffic going west on Birch St. would have to turn onto Ware Rd. to access the site. He stated that traffic is cutting across his development. He pointed out that this was supposed to be a quiet town home development. He continued that limiting access from Birch St. will increase traffic through the residential area. He does not see the need for an additional coffee shop. He is also concerned about the location of signage for this development. He sees no correct access points for a drive -thru facility. Mr. Lawrence confirmed that he currently lives in the Miller's Crossroads Townhomes. Mr. Greg Schlink, 3564 Rollingview Drive, representing the developer, stated that they have been working with staff for months. He noted that he has clarification on lighting issues presented in staff report. He pointed out that the zoning of the property is consistent with this project. He stated that significant traffic issues were dealt with during preliminary plat discussions. He stated that the proposal is a result of considerable discussions with city staff and the Anoka County Highway Department. He added that trails and sidewalks remain as originally proposed. Peter Hilger, Portfolio Design Services, explained the proposed lighting for the project and asked for comment. He added that the trail /sidewalk will connect to Hodgson Road. It was clarified that the monument sign will be internally lit. Mr. Laden requested that striping be added across the drive - through area. He requested downcast lighting only. He wondered why there was no outdoor seating proposed for the sandwich shop. Mr. Hilger responded that there has been no request by the sandwich shop tenant for outdoor seating at this time. He explained that the issue is tenant driven, and users have not been confirmed. He added that they could come back in future for outdoor seating. Mr. Laden asked how the outdoor seating area will be screened from the drive through and the trash area. Mr. Hilger replied that the trash enclosure is fully enclosed, with a roof and a door. Mr. Hilger described details of the proposed landscaping for this area. Mr. Hilger commented that this will be an attractive outdoor seating area. Mr. Hilger pointed out that interior plans have not been fully developed and the layout may change, but the building plans have been approved. Mr. Rafferty asked for improvements to break the monotony of the building, if possible. Mr. Tralle pointed out that, although the building was approved, the tenant use is now changing. He stated he does not like the drive - through and feels that it will add traffic to the area. He expressed concern that the exit road consists of an angle in excess of 90 degrees. He does not like the location of the garbage and is also concerned about the businesses in Spirit Hills. Mr. Rafferty expressed concern over the unattached trash area. Mr. Hilger responded that the original trash location was not enclosed and was located near the front of the building, whereas a trash enclosure is much preferred to be located in the back of the building. DRAFT MINUTES Planning & Zoning Board March 8, 2006 Page 6 Mr. Hilger offered that they could ease up the degree of the turn out of the drive through area. He pointed out that they have included additional open space and landscaping with this plan. Mr. Root reiterated that this is an allowable use, and the board is not able to choose users. He added that the building was approved and is established, and reiterated that the two items for the CUP are the outdoor seating and drive - through. He noted that he likes the outdoor seating and feels it is a good feature. He has concerns with the drive - through including striping, the degree of the angle to exit, and generating car traffic Mr. Root asked about the future parking area on the south side of the building. Mr. Smyser stated that this parking area would be for employees only. Mr. Root was concerned about the lighting and sound from the menu board. Mr. Smyser pointed out that the nearest town home is almost three feet away, and that the speaker is not large therefore should not be audible to the residential area. Mr. Root asked if the board could separate the approvals for the outdoor seating and the drive - through. Mr. Smyser replied that the board could separate the items. Mr. Smyser noted that traffic was studied as part of the entire Miller's Crossroads project. Mr. Tralle expressed concern that the drive - through would add traffic to the town homes. Mr. Hilger pointed out that the original proposal for platting the site included four buildings, which have been reduced to one building. He added that the County required a right turn only onto Birch St., regardless of the user. He continued that a drive - through has the same issues of access as other users, and that they are now proposing a fraction of what they started with. Mr. Hyden wondered if studies show that a drive - through increases business. Mr. Hilger replied that studies done by ITE, International Traffic Institute, show no data on coffee shops, only fast food facilities. He added that the studies show that the biggest contribution a drive - through provides is a reduction on parking. Mr. Hyden reiterated that the board will not determine what users can go into a space, and they should focus on the two issues at hand. Linda Fagerland, 181 Egret Lane, asked how the board could approve a coffee shop with one across the street if the gas station was not approved because there was one across the street. Mr. Smyser replied that when Miller's Crossroads was originally considered, the zoning was not yet determined. He explained that since zoning has now been determined for the site, the city cannot refuse a use if it is allowed in that zone and meets requirements. He continued that the city has no legal right to refuse a coffee shop. He added that they have no data to indicate that a drive - through will increase traffic. DRAFT MINUTES • • Planning & Zoning Board March 8, 2006 Page 7 Ms. Allen asked staff if there is a difference between retail and business. Mr. Bayer stated that he has data showing that forty percent of coffee shop business is drive - through business beginning at 5:30 a.m. He continued that traffic studies are needed due to increased traffic in the area. Mr. Lawrence stated that he is generally concerned with the drive - through. He added that if a drive - through business goes out of business, a future user may not need a drive - through, but the road would remain. He stated that people do turn left onto Birch St. from Lakota Trail. He believes that a drive - through will increase traffic. He agreed that the drive - through and the outdoor seating should be separate approvals. Mr. Rafferty pointed out that a lot of studies were involved in the decisions for this development. Mr. Laden expressed concern for future uses, and asked what else would be allowed in a Limited Business District with a CUP for a drive - through. Mr. Smyser replied to Ms. Allen's and the board's questions, explaining that three business zones include retail and non - retail users. Mr. Smyser read the list of allowable uses in the LB zoning district from the city's Zoning Ordinance. Ms. Allen asked specifically if a law firm can open next to a gas station. Mr. Smyser replied probably. Jerry Fagerland, 181 Egret Lane, questioned that if a drive - through would not generate more traffic, why would a business put one in. Mr. Nelson replied that study shows that a drive - through reduces parking, minimizing the number of parking stalls. Mr. Fagerland commented that citizens are concerned about traffic and safety. He stated that he is more likely to go through a drive - through than if he has to get out of his car. He noted that no safety issues had been specifically addressed. Mr. Rafferty remarked that this development has improved traffic flow in the area by adding a signalized intersection. He added that considerable time, dollars and efforts had been put into this development. Mr. Fagerland expressed that existing owners have practical opinions. Mr. Bayer suggested that the board revisit the traffic pattern with this new use. He stated that he is a resident who has difficulty turning left onto Birch St. at any time. He continued that getting to and from his business across the street is difficult, and he is unable to walk across the street. Mr. Rafferty noted that road issues will not get fixed until there is a need for them to get fixed. He added that the board cannot fight development of areas that have a right to be developed. DRAFT MINUTES Planning & Zoning Board March 8, 2006 Page 8 Mr. Fagerland stated that when traffic studies were done, a drive - through use was not included, therefore he would like another traffic study. Mr. Rafferty expressed that he does not think this issue merits an additional traffic study. He pointed out that the majority of traffic will be in the morning, which is not much different from that of a daycare, in regards to a traffic study. He stated that all of the points made tonight were very clear and good comments. He concluded that the Board needs to focus on a recommendation based on information before them tonight. Mr. Hilger requested a condition to decrease the radius of the turn exiting the drive - through. He added that the board could include a condition to increase architectural review. Mr. Hilger requested that the proposal remain as one vote, as the issues are linked by design. Mr. Pogalz made a Motion to close the Public Hearing at 9:48 p.m., and was supported by Mr. Hyden. Motion carried 6 -0. There were no further questions for staff. Mr. Root made a Motion to Recommend Approval of a Conditional Use Permit for outdoor seating with Conditions 1 -4, 6, 8 & 9, removing Conditions 5 & 7, and adding Condition 10, designating a crosswalk connecting the sidewalk that goes East -West from Lakota Trail to the front of the building, and adding Condition 11, adding architectural pylasters. Motion was supported by Mr. Laden. Mr. Nelson commented that he would prefer to vote for both issues at once as they were presented as a whole. Mr. Pogalz agreed and questioned why the issues had been separated. Mr. Root responded that he likes the outdoor seating but does not like the drive - through. The Board requested confirmation that if the existing motion were to fail, would they be able to then vote on both components together. Staff replied yes. Motion failed 3 -4. (Hyden, Nelson, Pogalz and Rafferty voting nay.) Mr. Pogalz made a Motion to Recommend Approval of a Conditional Use Permit to allow for an accessory drive - through and outdoor seating facilities for Miller's Crossroads Shopping Center with Conditions 1 -9, adding Condition 10, requiring a striped crosswalk through the drive - through area, and adding Condition 11, that the radius out of the drive - through area to the parking lot exiting area be reviewed with staff. Motion was supported by Mr. Hyden. Mr. Rafferty noted that he is opposed to free standing trash enclosures. Motion carried 5 -2. (Root and Laden voting nay.) DRAFT MINUTES • • • • • • Planning & Zoning Board March 8, 2006 Page 9 VI. DISCUSSION ITEMS A. GTS Training Staff stated that the city annually budgets for Planning & Zoning Board members to attend workshops offered by Government Training Services. Staff encouraged board members to take advantage of the opportunity. Staff requested that board members review the course descriptions that were included in their packets and to advise staff if they are interested in attending. Mr. Laden stated that he attended classes last year and found them beneficial. VII. ADJOURNMENT Mr. Tralle made a MOTION to adjourn the meeting at 9:58 p.m., and was supported by Mr. Hyden. Motion carried 6 -0. Respectfully submitted, Dawn Bugge Community Development Assistant DRAFT MINUTES AGENDA ITEM V.A. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: April 12, 2006 TOPIC: CONTINUED PUBLIC HEARING: Conditional Use Permit — Dog Kennel 7933 24th Avenue BACKGROUND Linda Ide has requested approval of a Conditional Use Permit to allow a dog kennel at 7933 24th Avenue. This application is required due to the current animal ordinance which limits the number of dogs kept on this property. The dog ordinance of the city code limits the number of dogs on a property to two. This can be increased to four with the approval by the city of a private kennel license. Exceeding the limit of four dogs requires the approval of a Conditional Use Permit. The following history of this issue was documented through reports issued by the Lino Lakes Police •DePartment: April 7, 2005 Issued a warning for unlicensed dogs and operating an unlicensed private kennel. August 24, 2005 Issued a citation for unlicensed dogs and an unlicensed private kennel. September 4, 2005 Issued a `dog at large' citation. I am applying for a conditional use permit for a kennel license. I have more dogs than the limit. These dogs are my personal pets. I do not run a business open to the public. I have lived on this property of ten acres for twenty -five years. I have a fenced in yard including gates across the driveway which are closed unless someone comes in or out of the driveway. I also have a fenced in exercise area that is connected to my house measuring 30 X 29 and 5 '/2 feet tall. It also has two swing dog doors with insulated boxes that lead into the attached porch. There are also 2 doors that open with a plastic window into the porch. It has motion flood lights that light up the entire exercise area. It also can be switched from the house to stay on or to stay off when needed. There also is a water facet in the exercise area to water the dogs and clean. The area is grass. Also there is a insulated milk house that has five separated dog boxes in the building that have openings to their own separate dog runs and also a door on each for access from inside the building. The building is 18 feet from the house and 8 feet wide 16.6 long. Each exercise run is cement floor. Each one has a locking gate with a 6 foot tall fence. There are five exercise runs measuring 12 feet long each run. Total of all 5 is 20 feet wide. The flood light from the other exercise pen lights up this area as well. I will be putting in its own separate flood light for that area within 60 days. The dogs spend most of the time in the house with me. I have six dogs that are my pets and belong to me. I sometimes with take care of my family or friends dogs temporarily in on vacation, etc. All dogs are current on vaccinations. The goal of this study is a document that will guide development of the area. The study is examining infrastructure— roads, water, sanitary sewer —to determine how to provide the infrastructure to support development and redevelopment activity. The overall master plan for the Hodgson/CR J area is still underway so a number of basic infrastructure elements are not yet in place or planned. ANALYSIS Land Use, Density, Zoning Location Existing Land Use Guided Land Use Existing Zoning Site two houses on three lots Medium Density Resid. Rural North rural residential Medium Density Resid. Rural South single family residential (Shoreview) Low Density Resid. (Shoreview) R -1 Residential (Shoreview) East rural residential Low Density Sewered Residential Rural West vacant, auto sales Commercial General Business The site is guided for Medium Density Residential land use and is within the Stage 1 (pre -2010) growth area. The site is not within the current MUSA. The table above identifies the existing land use and zoning as well as guided land uses for the area. • • • Pheasant Stroll Estates page 2 The following is a summary of the of the proposal: Gross Site Area 10.0 acres Upland Area 8.2 acres to be confirmed Total Units 28 Gross Density 2.8 units /acre Net Density 3.4 to be confirmed Zoning: A rezoning to R -3 requires that the site be guided for Medium Density, which it is, and which requires 3 -6 units per acre. There is a significant area of wetland on the site, which will be subtracted from the net area. This will raise the density above the 2.8 u/a because net density uses only upland. The MUSA reserve is allocated based on the amount of upland as well. Growth Management: The City's growth management policy (Ordinance 24 -04) implements growth policies of the comprehensive plan. It establishes limits on the number of new units to be approved as well on the use of MUSA reserve. We have nine lots left for year 2006, which means this project could not be final platted until 2007. We have 82 lots left for 2007. The site is not within the MUSA. We have 25.5 acres of MUSA reserve available for year 2006 and 6.8 acres for 2007. If the year 2006 acres are not used, they carry over to following years. PRELIMINARY PLAT/PLANNED UNIT DEVELOPMENT Buildings, Units: The proposal includes 27 townhomes as two -, three -, and four -unit structures. An existing single family home would remain. Streets, Access: A local circulation system of roads and access points is one of the major elements of the 49/J planning study. Though the study is unfinished, all preliminary concept plans show conceptual options for providing circulation and access for land within the study area. The City is trying to avoid the creation of individual accesses onto the arterial roads. (Hodgson and CR J are arterials.) The City has recognized access management as an important planning consideration. Creating new access points creates new conflict points, decreasing safety and impeding traffic flow on the arterial road. A new local street located along the west border of this site would provide a single access for all properties between Ware and Hodgson Roads. Optimally, it could align with Shoreview's Kent St. on the south. However, that location may be obstructed by a future median in CR J, so the new street could be centered on the existing western property line of the Pheasant Stroll site. The point is to create one planned access points and eliminate all other driveways onto CR J. • Pheasant Stroll Estates page 3 The submitted plan includes a private drive access onto CR J. The applicants propose a temporary private access to CR J which then would be removed in the future when the new public street is built. The private drive would connect to the new public street near the northwest corner of the site. Two problems arise with the proposal. First, it would be difficult to get the "temporary" access removed and connect with the new public street. Residents of the townhome neighborhood likely would oppose removing an existing driveway access and substituting a connection to a public street. Once an access exists, and the entire neighborhood is built and populated while that access exists, it is very difficult to remove it. In addition, we have experienced many occasions where residents oppose a new connection to an abutting development after they are accustomed to isolation. The second problem is that the proposed design puts all of a new street entirely on another property. This would mean that the property owner to the west would bear the entire loss of land to the road. It is typical to align roads on property lines, with half the right of way dedicated from development on each side. It is possible that the site could access directly onto Ware Road. However, this does not resolve the need for a future public road on the west side and right of way for that road. • In short, the proposed design does not take into account the larger public interests in access management. Staff does not support the proposed design. • The proposal does include additional 50 feet of right of way dedication for CR J. However, more right of way is needed: 60 feet from centerline, which is what the Anoka County Highway Dept. would plan for. This would push all the units north ten feet. In addition, the setback from an arterial road is 40 feet, not the proposed 30 feet. Therefore, with the right of way and complete setback, the units would need to move north 20 feet. This has a significant affect on the site layout: it pushes the internal road into Lot 1, and eliminates several units elsewhere in the plan. The proposed plat does include land for the future realignment of Ware Rd. The goal there is for the City to be able to align Ware Rd. with the existing Mackubin St. in Shoreview in the future to create a four -way intersection rather than the existing off set situation. However, a setback of 40 is needed from Ware rather than 30 feet, which would affect the layout by moving units west by 10 feet. Staff discussed the shortcomings of the proposed site design with the applicant. The applicants chose not to provide for a public street for access to Co. Rd. J. Utilities: Municipal utilities comprise the other vital infrastructure element in the 49/J planning study. The proposed design of Pheasant Stroll Estates includes a utility corridor connecting to the water and sanitary sewer trunks existing in Ware Road. The infrastructure plan must be completed to determine how the larger area can be served. Pheasant Stroll Estates page 4 Water must be looped through the area. Water trunk lines terminate in the southern ends of Ware Rd. on the east side and Woodridge Lane on the west. Long water trunks without looping may not provide adequate service. A sanitary sewer trunk also exists in Ware Road. However, it is very shallow. The 49/J study has taught us that a lift station likely will be needed for the area. Whether this will flow to Ware Road or north to another connection point needs to be determined. Stormwater Management, Wetlands: The north east portion of the site includes 1.8 acres of a larger wetland complex that extends across properties to the north. A mitigation plan will be needed if wetlands are filled. The square buffer easement shown on the plans will need revision. The Rice Creek Watershed District cannot confirm the wetland delineation until spring. The City supports surface filtration and other means of treating runoff, though the proposed design may need some revisions. Landscaping: We require landscaping along collector and arterial roads in new subdivisions to buffer homes form the roads. Park Dedication: Park dedication would be cash: $2075 per new dwelling unit. ENVIRONMENTAL BOARD The Environmental Board reviewed the application on February 22. The comments are attached. OPTIONS 1. Approve rezoning, preliminary plat, and MUSA allocation. 2. Deny rezoning, preliminary plat, and MUSA allocation. RECOMMENDATION Option 2 Staff recommends denial of the rezoning, preliminary plat, and MUSA application based on the following findings: 1. The City's Growth Management Policy, Ordinance No. 24 -04, includes a finding that "managing growth through the orderly provision of infrastructure and other means promotes the goals and policies of the comprehensive plan." • • • Pheasant Stroll Estates page 5 2. The City's Growth Management Policy states that "promoting development within the existing MUSA is preferable to expanding the developing area of the City by granting MUSA reserve acres." 3. The proposed project requires approval of a rezoning, preliminary plat, and allocation of MUSA reserve. It currently is not within the MUSA. 4. The City is conducting a planning study for an area that includes the proposed development site. This study will determine how the City will plan for infrastructure to serve the area. This includes transportation, water, and sanitary sewer. The study also will determine future land uses for the area. 5. A local street or frontage road are possibilities for creating access to this site. Section 1007 -4.7 of the subdivision ordinance requires that these possibilities be used rather than an individual driveway. 6. Access management is an important aspect of planning the city. The proposal does not provide the right of way for a needed public street needed to create a public accessing Co. Rd. J that would serve the public need for a safe, planned access serving more than one property. 7. Right of way for Co. Rd. J is needed to total 60 feet from centerline. The project plan proposes only 50 feet. 8. The minimum setback from arterial and collector roads is 40 feet. Co. Rd. J is an arterial road, Ware Rd. is a collector. The proposal provides setbacks of 30 feet. 9. The additional 20 feet -10 feet of right of way and 10 feet of setback — affects the site such that the proposed layout is not feasible. 10. STAFF ORIGINATOR: Paul Bengtson MEETING DATE: April 12, 2006 TOPIC: PUBLIC HEARING: Amendment to the Apollo Landing Hotel Final Plan and Conditional Use Permit Apollo Landing BACKGROUND Equinox Development was previously approved by the City Council (in the form of a PUD Final Plan) for a hotel that is proposed for lot 1 of the plat. The final plan application included the final building plans for the hotel as well as the final plat for the site. The developer is now requesting to add an additional floor of rooms increasing the total to 113 rooms. This will mean a five story structure with a height of 46 feet. These heights are simply the roof deck height. Parapets will extend beyond that height, previously the parapet would have met the ordinance limit, while the current proposal will extend the parapets to 4.5 feet and 7 feet. Because the original approval tied the height of the buildings in Apollo Landing back to the zoning ordinance; and because Section 3 Subdivision 4 Letter C which is titled `Height' requires a Conditional Use Permit to exceed the height standards of the zoning district provisions, this request is considered an amendment to the existing conditional use permit for the planned unit development on the site and an amendment to the planned unit development final plan for the hotel itself. ANALYSIS This site is located within the GB (General Business) zoning district. This district limits building heights to 45 feet. Within Section 3 Subdivision 4 of the ordinance the following subsection applies to building height: • C. Height. 1. Exceptions. The building height limits established herein for districts shall not apply to the following: a. Farm structures. b. Church spires not exceeding 60 feet in height. c. Belfries not exceeding 60 feet in height. d. Cupolas not exceeding 60 feet in height. e. Windmills. f. Solar energy devices. g. Chimneys and smokestacks. h. Flag poles mounted on a building. • Apollo Landing, page 2 Non - commercial television and radio antennae, and satellite dishes. j. Parapet walls extending not more than four (4) feet above the limiting height of the building. k. Elevator penthouses. Cooling towers /water towers. m. Lighting structures for public outdoor recreational fields not exceeding eighty (80) feet in height. n. Lighting structures for public hockey rinks not exceeding sixty (60) feet in height. 2. Conditional Use Permit. Building heights in excess of those standards contained in the district provisions and any other sections of this Chapter may be allowed through a conditional use permit, provided that: a. Demonstrated need is established for the increase in height and said increase will not violate the intent and character of the zoning district in which the structure is located. The applicant is proposing a building that will be 46 feet in height with 7 feet of parapets extending above. That means an overall height of 53 feet. Anyone building within the same district would be allowed a 45 foot building with 4 feet of parapet or a 49 foot overall height. This means the increase is only 3 feet overall or roughly an 8% increase. Considering that the increased parapet height attempts to not only provide screening of rooftop equipment but also add architectural detail; it is a rather minor increase. If for example they followed the height guidelines and built a four story structure with a 45 foot height, but had an elevator penthouse that extended another 8 feet for an overall height of 55 feet, it would be allowed by the ordinance. Therefore staff doesn't feel that this increase would violate the intent and character of the GB (General Business) zoning district. b. The site is capable of accommodating the increased structure size. The site appears to be capable of accommodating the increase in size, since it will not cause an increase in the building footprint the only concern in that regard would be the parking for the site. The revised shared parking analysis is attached to this report and shows that with the slight revision to the site plan to include more parking as part of this first phase of development, the site will still function with a sizable surplus. c. The potential increased intensity and size of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. The current roadway and city utility systems will be adequate to serve the additional rooms. d. Public utilities and services are adequate. Apollo Landing, page 3 • The current roadway and city utility systems will be adequate to serve the additional rooms. e. For each additional story over the district limitation or for each additional ten (10) feet above the maximum allowed per district, front and side yard setback requirements shall be increased by ten (10) percent. The standard setback for the GB (General Business) zoning district is 30 feet and this project exceeds that by well over the 10% (3 feet) that this requirement ensures. f. The construction does not limit solar access to abutting and /or neighboring properties. A shadow study shall be required illustrating shadow encroachment on adjoining properties. g. • There has been no shadow study done because of how minor the encroachment would be at only 8% or 53 feet. The provisions of Section 2, Subd. 2. of this Ordinance are considered and satisfactorily met. Section 2, Subdivision 2 of the ordinance lists the following findings: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes. d. Traffic generated by a proposed development application is within the capabilities of the City when: 1) If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 2) If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3) If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. • • Apollo Landing, page 4 4) The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5) Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. 6) The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer - financed improvements to correct any street deficiencies. 7) The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I- 35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. 8) The City does not relinquish any rights of local determination. 9) The proposed development shall be served with adequate and safe water supply. 10) The proposed development shall be served with an adequate and safe sanitary sewer system. 11) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. e. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. f. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Staff feels that none of the findings made for the original approval of the site have been affected negatively by this request. Apollo Landing, page 5 litECOMMENDATION Staff recommends approval subject to the following conditions: 1. The project is still subject to the requirements of the Conditional Use Permit / Planned Unit Development — Development Stage Plan of Resolution 05 -63 and the Planned Unit Development — Final Plan of Resolution 05 -143. 2. All parking shown on the site plan must be provided prior to the issuance of a certificate of occupancy for the building. 3. Future applications for the development of the remaining outlot will need to incorporate the changes made to the site plan as part of this approval. • .ATTACHMENTS 1. Shared Parking Analysis 2. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: April 12, 2006 TOPIC: Planned Unit Development - Final Plan Legacy Townhomes Legacy at Woods Edge BACKGROUND Hartford Group Inc. has applied for a Planned Unit Development final plan for a portion of the townhome property within the Legacy at Wood's Edge project located on the southeast quadrant of Interstate 35W and Lake Drive. The final plan consists of the building plans for the units and the final plat of a portion of the townhome property. NALYSIS Governing Plans This site is located within the Legacy at Woods Edge project and is therefore subject to the Lino Lakes Town Center Design & Development Guide that was adopted by Ordinance 04 -04 as part of the original Planned Unit Development for the site. The proposed layout is significantly conforming to the original Legacy at Wood's Edge layout that is included in the Development Guide. Some changes that have occurred through the grading and street projects the city has undertaken have included the moving of the `Woods Edge' street west to allow homes to be built on the east side of the site. Also, changes have arising due to the fact that previous plans only depicted back to back type of units with tuck under parking. The applicant is now proposing a different product for a portion of the site. The proposed townhomes are located in a Residential Land Use Area and will be located within a portion of Lot 15 (according to the land use plan of the Lino Lakes Town Center Design & Development Guide). The Regulating plan of the development guide includes the required street framework, which is currently under construction as part of the city's improvements in the area. This will include the pedestrian streetscape as part of a future phase of construction. The plan also indicates that there is a 50% build -to line requirement for this portion of the site; but no `Required Building Entries' nor any `Gateways' are indicated for the portion of the residential site currently proposed for development. SJensity and Diversity The standards require between 10 and 24 units per acre, not to exceed 190 units. The current proposal includes 98 units within 14 buildings. This would occur on 9.42 acres for a density of 10.4 units per acre. The future development of the corner parcel should only increase that density figure. Structure Setbacks Side Setbacks (excluding Street - Facing Sides) [1, 3] Street- facing Front and Side Setbacks [1, 2] Rear Setbacks RESIDENCE SETBACKS Attached residences with individual unit entrances 10' min. -15' max., or 5' if garage is alley- loaded. 15' min. from centerline of alley, or 15' min. from rear property line when no alley 5' on each side of structure, 0' between attached units in one structure, GARAGE SETBACKS Garages or parking lots for duplexes, townhomes, or other attached units with individual unit entrances Ieach Min. 1'from dwelling facade for every 2' of garage facade width. [4] No garage shall comprise more than 50 percent of the width of the total street- facing frontage for unit. 12' min. from centerline of alley, or 3' min. from rear property line if no alley 5' on each side of separate garage structures, 0' between attached garages in one structure Legacy Townhomes, page 2 es mentioned previously, the district boundaries have seen minor adjustment due to the continuing road project, more detailed evaluation of the site, and the change in townhome product type. The standards require that a variety of housing types is provided within the residential area, for the entire townhome development the applicant is proposing a seven -plex townhome with two distinct facade treatments; and in the future the portion of the site adjacent to the traffic circle will provide a distinctly different type of building likely to include underground parking. Building Massing and Placement The grading plan shows that the developer has minimized grade changes to limit the use of retaining walls as much as possible. For the majority of the buildings all grade changes will be done with sloping. All retaining walls used are below the five foot requirement. The buildings measure no greater than 39 feet in height from any grade level and entries for each unit are accessible to either open space or public street. The buildings are sited 15 feet from right of ways with patio /yard areas in front of each unit to maintain the street presence and create the transition zone between private spaces of the homes and the public spaces. The parking for each unit is provided with depressed grade parking on the first floor rear of each building unit •th landscaping in between each garage and for some driveways for additional parking. The setbacks for this type of product are as follows: Table 7. Residence and Garage Setbacks (measured from lot line unless otherwise noted) NOTES: [1] Projections. Bay windows, fireplace elements, and balconies may extend into the front setback up to four feet, for a width not more than 10 feet. The maximum extension of a projection into a side yard is 3 feet. [2] Depressed Parking. Where a high water table prevents depressed parking, at -grade structured parking must be placed at the rear of the structure with residential uses lining the front facade to finished grade. Legacy Townhomes, page 3 • Staff believes that all of these setbacks are bein g met, though the intention of some is a bit lost due to notations 3 and 4 being absent from the approved guidelines. Specifically, it is staff's belief that the setback of the garage from dwelling facade is only applicable to garages that are on the front facade. Architectural Standards The Lino Lakes Town Center Design and Development Guidelines (LLTCDDG) typically require a base, middle, and top approach to the commercial architecture within the Legacy at Woods Edge project. However, it does not require this within the residential architectural standards. So that approach will not be followed. All units include windows within the doors, as well as surrounding the doorway for transparency and daylighting. All doors (including the garage doors) are also panelized for further detail. Windows for the units cover well over 25% of the front facades and on the main living floor of each unit the windows are within the parlors and dining rooms. Staff has recommended a condition that will address the need for a recess of at least two inches for all windows and doors. During discussion with the Planning and Zoning Board members who attended the informal Architectural Review Committee meeting for this project, the question of if the project meets the requirement that `the front facade of all residential buildings must be articulated with porches, bay windows, or balconies'. While staff had initially thought the provision of stoops and patio /green area for each unit provided enough visual interest, the results of that meeting were that the developer would be asked to pursue the inclusion of box bay windows for *its and also to provide a greater step back than the 8 inches currently provided. The developer has provided a great deal of variation in the roof forms of the buildings including the changes in heights and the addition of gabled dormers. The applicant is proposing to use hardi -board horizontal lap- siding, which is a recommended product for this project. Staff has encouraged the developer to pursue additional materials such as brick and stucco for greater variation. The side elevations are quite stark in comparison to the front facade and do not currently address the requirements of the guidelines that side elevations at corners have the same detail of the front elevation. Nor does it provide in anyway the wrapping of patio or porch elements that the guideline recommends. For the patio areas that are provided at the front of the units the applicant is proposing a decorative wrought iron fencing that will be repeated on any retaining walls that might be necessary for grade changes. Parking Requirements The standards require two parking spaces per unit, which will be accommodated within the garages for each unit. The guidelines do not require guest parking because of the on -site parking on the street frontages. However, because of the location of some of the units the applicant has proposed to provide an additional 32 parking stalls which staff would like to see reduced by six so that the parking closest to Town Center Parkway •nd Village Drive is eliminated in favor of additional green space and landscaping. Open Space and Landscaping Chapter 4 of the guidelines does not address landscaping, therefore staff will use some of the Chapter 3.6 standards to guide the landscaping of the site. We will work with the developer prior to the next meeting to Legacy Townhomes, page 4 make sure appropriate materials and design are implemented. Specifically staff has a desire to further the screening along the freeway to reduce the visibility and noise for the northern most townhome building. Additionally, staff would like to take the spaces that are reclaimed by eliminating the six parking spaces indicated above and create nice landscape /plaza amenities. The guidelines required 10% of the residential site to be developed as public accessible open space. The plans appear to be providing this with the central park element and the large swath of open space adjacent to the wetlands that is accessible via the street on the back side of the townhomes. Staff will be asking the developer to submit a plan that indicates the percentage of land area these amenities and any others that are added make up. Lighting Chapter 4 of the guidelines does not include lighting standards, but the photometric lighting plan submitted with the application is in conformance with the minimum standards of Chapter 3.7 of the guidelines. The lighting proposed for the townhome area is the standard lighting that is being used throughout the Legacy project area. Engineering Due to the submittal of revised engineering, the city's consulting engineer on the Legacy project (Short Elliot Hendrickson) was not able to complete a thorough review with comments. This is one of the main reasons staff recommending a continuation of this item to the May meeting. Final Plat Planned Unit Development - Final Plan applications include a final plat for the site; however, Hartford has not submitted a final plat document that could be reviewed by city staff This is one of the main reasons staff is recommending a continuation of this item. ENVIRONMENTAL BOARD The Environmental Board reviewed this application at the March 29th regular meeting. Their comments were not available when this report was written, but will be included at the May 10th meeting. RECOMMENDATION tff recommends continuing this item to the May 10`h regular meeting.
