Chair Rafferty called the Lino Lakes Planning and Zoning Board meeting to order at 6:33 p.m., May 10, 2006. II. APPROVAL OF AGENDA Board members agreed to discuss the agenda items in the following order: Item B, Item D, Item C, Item A The agenda was approved. III. APPROVAL OF MINUTES: April 12, 2006 Mr. Tralle made a MOTION to approve the April 12, 2006 Minutes as presented and was supported by Mr. Nelson. Motion carried 5 -0. IV. OPEN MIKE Chair Rafferty declared Open Mike at 6:38 p.m. There was no one present for Open Mike. Elect Chair and Vice -Chair Board Members elected Mr. Paul Tralle as Chair. Board Members elected Mr. Brian Pogalz as vice - chair. B. Final Plat for Pine Glen Mr. Bengtson presented the staff report. Staff recommended approval. Mr. Bengtson clarified for the board that a trail is intended to be constructed in the existing Dupont Ave right -of -way going east/west as a future city project. Mr. Tralle commented that he thought the trail should be included as part of the project. Mr. Pogalz made a MOTION to recommend approval of the Final Plat for Pine Glen. Motion was supported by Mr. Nelson. Motion carried 5 - 0. C. Planned Unit Development Final Plan for Legacy Townhomes Mr. Bengtson noted this item was continued from the April 12, 2006 meeting. He stated that revised architectural plans were included in the staff report. Mr. Bengtson noted that revisions included increased bumpout on ends of buildings as well as the addition of bay windows and gutters along front elevations. Mr. Bengtson stated that city staff had requested a reduction in parking spaces in order to increase the landscape area. Mr. Bengtson noted that the final plat includes three buildings in the first phase. Staff recommended approval with 22 conditions as listed in the staff report. Staff noted that buildings meet build -to line requirements. Frank Janes, Hartford Group, applicant, was present for questions. Board members complemented the developer on the revisions of the project. Mr. Janes had concerns with two conditions, stating that the requirements in conditions 11 and 12 should be part of the homeowner's association requirements. The Board Members and City Staff agreed to the requested modifications. DRAFT MINUTES • • • Planning & Zoning Board May 10, 2006 Page 3 Mr. Laden made a MOTION to recommend approval of the Planned Unit Development Final Plan for Legacy Townhomes, subject to the following conditions: 1. The developer will enter into a development agreement with the city prior to the issuance of any building permits for the site. 2. A minimum 2 inch deep window trim or two inch recess must be provided in accordance with the development standards for the site. 3. All lighting fixtures must be submitted and prove to be in conformance with the requirements of the LLTCDDG. 4. Issues discussed in the S.E.H. engineering review letter must be addressed to the satisfaction of city staff. 5. Operation and maintenance agreements for the site, including provisions for stormwater facilities, must be submitted for review by city staff prior to the issuance of building permits. 6. Homeowner's association documents must be submitted prior to the city releasing the plat for recordation. 7. The applicant shall provide a bicycle parking area sufficient in size to accommodate an appropriate number of bicycles. The type of fixture provided and the location of this parking area must be reviewed and approved by staff prior to the issuance of building permits for the site. 8. All landscaped and sodded areas must be irrigated. 9. All ground mounted utility equipment shall be completely screened from view with appropriate landscaping materials. 10. All roof mounted equipment shall be completely screened from view. This screening shall be constructed of materials consistent with those used for the main building. 11. The mailboxes proposed for the development must be reviewed and approved by staff prior to the issuance of building permits for the site. Such mailboxes shall be screened with complementary materials to those of the main structures. 12. The developer is encouraged to wrap the corners of buildings with the patio areas of the end units. 13. The final plat for the buildings on the east side of the site, which have drives leading to the garages shall include a limited common element for those drives to prohibit other townhome owners from parking within the drive of another townhome. 14. The six parking spaces shown on the site plan closest to Town Center Parkway and Village Drive shall be eliminated and replaced with additional landscaping materials. 15. The appropriate access easements for the ponds will be granted to the city for maintenance purposes. DRAFT MINUTES Planning & Zoning Board May 10, 2006 Page 4 • 16. Sliding windows are prohibited within the Legacy at Wood's Edge project area, all sliding windows will need to be replaced with double hung windows. • • 17. A conservation easement shall be granted to the city as prescribed in the Environmental Board's comments. 18. Signs shall be placed to visually delineate the wetland area. 19. The landscape plan shall be reviewed by the City's Environmental Coordinator for conformance to the Environmental Board's comments prior to installation. 20. Additional landscaping shall be added to the north side of the project to provide a visual and noise barrier between the northernmost building and the freeway. Motion was supported by Mr. Nelson. Motion carried 6 - 0. D. PUBLIC HEARING for Rezone to Planned Unit Development and Development Stage Plan/Preliminary Plat for The Preserve Mr. Smyser presented the staff report. Mr. Smyser reminded the board of the advantages of a conservation development. Staff recommended continuing the Public Hearing to the June P &Z Meeting, in order to address outstanding issues. Mr. Studenski explained that this development would enhance existing wetland areas. Board members had concerns with increased traffic, traffic flow, and the proposed trail. Mr. Smyser explained that the developer will put in the trail as part of the project. Mr. Smyser noted that an area of rare orchids on the site would be preserved as part of the development. Mr. Smyser stated that this area would be visible from the trail, adding that an important part of the city's trail plan is to access natural feature areas. Mr. Smyser clarified that a development shown to the west of the site on a rendition from the applicant did not represent a real proposal. Chair Rafferty declared the Public Hearing open at 7:35 p.m. A letter was submitted by Cindy McDonald, 6566 Black Duck Drive S., as part of the public hearing, and was distributed to board members prior to the meeting. Jean Riley, 6575 Pheasant Run, expressed concern about the proposed trails that run on roads. She was concerned about increased traffic, noting that the Black Duck Drive and Birch Street intersection is currently a mess. She stated concerns about safety issues with pedestrians crossing the streets in this area as well as increasing traffic through the DRAFT MINUTES Planning & Zoning Board May 10, 2006 Page 5 • neighborhoods. She wondered how pedestrians to the north are supposed to cross Birch Street in order to access the proposed trails. • • Greg Graves, 6532 Kildeer Drive, stated that he recalled when the Saddle Club area was developed there would be no additional accesses allowed off of Birch Street. He stated concern about future road extension and increased traffic He asked what would happen with the temporary culdesac and was concerned about potential damage to the roads during the development process. Michael Prieve, 1047 Aspen Lane, expressed concern about road issues and wondered how this development would connect to the Foxborough development. He suggested that the road eventually connect to 62nd street. He also suggested improving the entire pond instead of only % of the pond as proposed. Shawn McArdle, 6508 Killdeer Drive, stated that when the proposed development to the west was discussed by the city, the Police Chief said that Birch Street could not support any additional traffic. He requested that the Chief of Police be involved and asked if Birch Street could hold this amount of traffic. Kevin Overgaard, 6511 Pheasant Run South, was concerned about daily events and activities at Birch Park that cause overflow parking onto the roads. He was concerned about increased traffic and speed, and the safety of residents accessing the park. He asked if an expansion of the parking lot would be possible. Clydie Douglas, 1100 Trapper's Court, wondered if the development would impact the flood plain for North Trapper's Crossing. She asked what the conservation project would entail, and was concerned about pedestrians in the wetland area as well as potential damage occurring during the restoration. She noted that there has been damage to existing park property, and asked who would be managing activity with increased park use. She added that residents do not always control pet waste. Don Zvareck, 6331 Cripple Creek Court, stated that over the last 1 1/2 to 2 years, there has been excessive water retention in the area to the west of his home. He wondered if this was due to the Foxborough development. He wondered how the area would be affected by this project and wanted to point out possible impact to this area. Tom Weber, 6425 Cassiopeia Court, stated that the wetland area completely floods with rain. He was concerned with increased water retention, stating this is the worst year he has seen. He also wondered what the silver tags on the trees were for. He expressed concern about increased traffic, noting that exiting 12th Avenue west onto Birch Street is almost a blind intersection due to the hill in the area. Steve Pickhartz, 6381 Mineral Point, stated that when trees were removed in his area for a bike path to come in, he was told that the amount of wetlands filled needed to be replaced 2:1. He is wondering why this development is not being required to replace wetland fill 2:1. He agreed that Birch Street traffic is a concern. DRAFT MINUTES Planning & Zoning Board May 10, 2006 Page 6 Brian Boroussa, MFRA Engineering, and Jason Husveth, ecologist, Critical Connections, were present on behalf of the developer. Mr. Husveth responded to public comments. He clarified that the required wetland replacement for this development is 2:1. He added that an additional 39 acres of proposed wetland restoration is above and beyond the required amount. Mr. Husveth explained that the Department of Natural Resources has declared the rare orchids found on this site to be an endangered species, therefore preventing the ability of removal. This restricted the location of a road through this area. Mr. Husveth stated that the tree tags were for inventory purposes, tracking the locations, species and diameters of trees last spring. He added that this information was considered during the planning process in helping to guide the location of roads and trails through this development. Mr. Husveth noted that the amount of upland area being preserved is fairly low, and that 75 percent is wetland. He added that this leaves a very small development window for the placement of houses and roads. He said that about five to ten percent of upland is going to conservation areas. Mr. Husveth explained that water entering the wetland area will be consistent with construction runoff. Mr. Husveth was the ecologist in the Foxborough development, and added that the blockage of flow in that development may be due to beaver dams. He added that an 80 -page stewardship plan for this site is available to anyone interested. Board members suggested that city staff look into the possibility of improving the entire pond on the north end of the site. Mr. Smyser stated that city staff can discuss the possibilities with Mr. Husveth on the potential to improve the whole pond at once. Mr. Husveth added that individual land owners would need to be included in this effort. Mr. Husveth gave a summary of the plans for wetland restoration. He stated that this development will include enhancing the quality of wetlands through aggressive vegetation management, enhancing aesthetics, wildlife value and ecological integrity. Board members were concerned about additional impervious surface, increased runoff and drainage issues. Mr. Husveth responded that they have assessed the amount of runoff and taken additional steps to infiltrate water, slowing the amount of runoff. Mr. Smyser noted that Mr. Husveth has been very helpful working with staff, and that his ecological expertise is appreciated. Mr. Smyser addressed concerns about parkland. He noted that city parks are currently overburdened. He stated that an area has been considered for additional parking. He stated that the road width would allow for pedestrians. Mr. Rafferty requested that staff look into the possibility of decreasing speed limits in residential neighborhoods with new developments. DRAFT MINUTES • Planning & Zoning Board May 10, 2006 Page 7 Mr. Smyser noted that any change in the flood plain would have to be mitigated. He pointed out that areas of standing water are within the wetland area, adding that some residential lots include wetland areas. In regard to the beaver dams, he stated that the county ditch is managed by the Rice Creek Watershed District. Mr. Smyser explained that the city requires repair of any damages to roads that may occur with development. He addressed traffic concerns, stating that the intent is for Pheasant Run South to connect to Old Birch Street. He added that alternative Birch Street connections would help alleviate bottleneck issues and help disperse traffic. He pointed out that one goal of the transportation plan is to connect Pheasant Run South to 62nd Street. Mr. Husveth specified that the culdesac on the northeast corner of the Foxborough development has a sign designating that the street is a future through- street. Mr. Smyser stated that there is a trail stub in Foxborough with the intent to connect to the Saddle Club site when and if the property develops. Mr. Smyser summarized that the city's interconnected transportation system is planned to diffuse traffic congestion. He pointed out that this plan happens in stages with each development. Mr. McArdle reiterated that in the past the city staff stated there was no way to add an outlet onto Old Birch Street and increase traffic. He asked why staff is stating that it can happen now. Mr. Smyser clarified that in the past, staff stated that a proposed road could not connect to Birch Street due the location of a wetland on the property. Mr. Laden encouraged city staff and the developer to attempt to design paths that are separated from the road, as he was concerned with safety issues. He commended the developer for pursuing his land for conservation development. Mr. Rafferty wondered what could have been developed if this proposal was not a conservation development. Mr. Smyser replied that a yield plan for a standard development showed that the number of lots was the same, but the conservation development allows the lots to be less deep with narrower streets. Mr. Smyser stated that staff could reexamine the location of the trail. Mr. Tralle commented that traffic concerns are existent with every development in the city, and that the Planning & Zoning Board does their best to address traffic concerns. He suggested that the parks could add features including bike trails with jumps so that kids don't tear up what's there. Mr. Laden made a MOTION to continue the Public Hearing for the Planned Unit Development and Development Stage Plan/Preliminary Plat for The Preserve to the June P &Z Meeting. DISCUSSION ITEMS A. Rules of Conduct Mr. Smyser reported that enclosed in the staff report was a copy of the rules of conduct that the City Council adopted. Board members agreed that a handout covering general board meeting rules would be beneficial at city board meetings. Mr. Hyden agreed to forward handouts from other municipalities to city staff in order to distribute in a future meeting packet for further discussion. B. Joint Meeting — Nature's Preserve Mr. Smyser stated that no submittals have been received for the proposed Nature's Preserve Development. A joint meeting has been scheduled for all city boards on May 31, 2006 at 6:30 p.m. to comment on development of the proposed site. VII. Respectfully submitted, Dawn Bugge Community Development Assistant DRAFT MINUTES • • • STAFF ORIGINATOR: P & Z MEETING DATE: TOPIC: BACKGROUND AGENDA ITEM V A Jeff Smyser June 14, 2006 CONTINUED PUBLIC HEARING - Rezoning From Rural to R -3 - Preliminary Plat -MUSA Reserve Allocation Pheasant Stroll Estates The P & Z opened this public hearing at the March 8 meeting and continued it to April 12. At the April meeting, we continued it to the June 14 meeting. The project involves a submittal by Brunn Custom Homes for a rezoning and preliminary plat, which requires an allocation of MUSA reserve. The subject site is ten acres of property at the northwest corner of Co. Rd. J (Ash St.) and Ware Road. The application includes platting for 27 townhomes and retaining an existing single family home. The site is within the area of the Hodgson/CR J master planning study. The goal of this study is a document that will guide development of the area. The study is examining infrastructure— roads, water, sanitary sewer —to determine how to provide the infrastructure to support development and redevelopment activity. The overall master plan for the Hodgson/CR J area is still underway so a number of basic infrastructure elements are not yet in place or planned. The proposed project does not include the design elements needed to accommodate infrastructure needs of the City. (Shoreview) R -1 Residential (Shoreview) Rural East rural residential Low Density Sewered Residential West vacant, auto sales Commercial General Business Pheasant Stroll Estates page 2 • The site is guided for Medium Density Residential land use and is within the Stage 1 (pre -2010) growth area. The site is not within the current MUSA. The table above identifies the existing land use and zoning as well as guided land uses for the area. • • The following is a summary of the of the proposal: Gross Site Area 10.0 acres Upland Area 8.2 acres to be confirmed Total Units 28 Gross Density 2.8 units /acre Net Density 3.4 to be confirmed Zoning: A rezoning to R -3 requires that the site be guided for Medium Density, which it is, and which requires 3 -6 units per acre. There is a significant area of wetland on the site, which is to be subtracted from the net area. This would raise the density above the 2.8 u/a because net density uses only upland. The MUSA reserve is allocated based on the amount of upland as well. Growth Management: The City's growth management policy (Ordinance 24 -04) implements growth policies of the comprehensive plan. It establishes limits on the number of new units to be approved as well on the use of MUSA reserve. We have nine lots left for year 2006, which means this project could not be final platted until 2007. We have 82 lots left for 2007. The site is not within the MUSA and would require 8.2 acres. We have 25.5 acres of MUSA reserve available for year 2006 and 6.8 acres for 2007. If the year 2006 acres are not used, they carry over to following years. Rezoning As stated in the zoning ordinance, the Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgment shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The comprehensive plan includes the following policies: Plan transportation facilities to function in a manner compatible with adjacent land use. (page 35) Minimize and limit vehicular access onto all major collector and arterial streets ensuring adequate distance between intersections and utilization of appropriate traffic control methods and devices. (page 36) • • Pheasant Stroll Estates page 3 Land uses in the area need good, safe access to arterial roads. Because of the short distance between Hodgson and Ware Roads, access management is vitally important. One access to CR J, a public street, will provide good access to all properties adjacent to the subject site, and to the site itself. The proposed project does not provide such a street. 2. The proposed use is or will be compatible with present and future land uses of the area. The townhomes at the proposed density are consistent with the Medium Density Residential category in the comprehensive plan. 3. The proposed use conforms with all performance standards contained herein. Right of way and setbacks are not adequate in the submitted plans. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Adequate water and sanitary service are available for the site. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. Access management is an important aspect of planning the city. A local street or frontage road are possibilities for creating access to this site. Section 1007 -4.7 of the subdivision ordinance requires that these possibilities be used rather than an individual driveway. The proposal does not provide the right of way for a public street that serves the public need for a safe, planned access on Co. Rd. J serving more than one property. In addition to these factors, the City's Growth Management Policy states that "promoting development within the existing MUSA is preferable to expanding the developing area of the City by granting MUSA reserve acres." Expanding the MUSA before land within the MUSA develops, and before the infrastructure needs have been addressed for the land within the MUSA, is inconsistent with this policy. PRELIMINARY PLAT/PLANNED UNIT DEVELOPMENT Buildings, Units: The proposal includes 27 townhomes as two -, three -, and four -unit structures. An existing single family home would remain. An elevation of the fronts of the units has been provided, but we have no detailed information on materials or • • Pheasant Stroll Estates page 4 percentages of materials. The details of the buildings were not pursued for this report because larger site planning issues pose significant questions that have not been resolved. Streets, Access: A local circulation system of roads and access points is one of the major elements of the 49/J planning study. Though the study is unfinished, all preliminary concept plans show conceptual options for providing circulation and access for land within the study area. The City is avoiding the creation of individual accesses onto the arterial roads. (Hodgson and CR J are arterials.) The City has recognized access management as an important planning consideration. Creating new access points creates new conflict points, decreasing safety and impeding traffic flow on the arterial road. A new local street located along the west border of this site would provide a single access for all properties between Ware and Hodgson Roads. Optimally, it could align with Shoreview's Kent St. on the south. Alternatively, the new street could be centered on the existing western property line of the Pheasant Stroll site. The point is to create one planned access points and eliminate all other driveways onto CR J. The submitted plan includes a private drive access onto CR J. The applicants propose a temporary private access to CR J which then would be removed in the future when the new public street is built. The private drive would connect to the new public street near the northwest corner of the site. Two problems arise with the proposal. First, it would be difficult to get the "temporary" access removed and connect with the new public street. Residents of the townhome neighborhood likely would oppose removing an existing driveway access and substituting a connection to a public street. Once an access exists, and the entire neighborhood is built and populated while that access exists, it is very difficult to remove it. In addition, we have experienced many occasions where residents oppose a new connection to an abutting development after they are accustomed to isolation. The second problem is that the proposed design puts all of a new street entirely on another property. This would mean that the property owner to the west would bear the entire loss of land to the road. It is typical to align roads on property lines, with half the right of way dedicated from development on each side. It is possible that the site could access directly onto Ware Road. However, this does not resolve the need for a future public road on the west side and right of way for that road. In short, the proposed design does not take into account the larger public interests in access management. Staff does not support the proposed design. The proposal does include additional 50 feet of right of way dedication for CR J. However, more right of way is needed: 60 feet from centerline, which is what the Anoka County Highway Dept. would plan for. This would push all the units north ten feet. In addition, the setback from an arterial road is 40 feet, not the proposed 30 feet. Therefore, with the right of way and complete setback, the units would need to move north 20 feet. • • Pheasant Stroll Estates page 5 This has a significant affect on the site layout: it pushes the internal road into Lot 1, and eliminates several units elsewhere in the plan. The proposed plat does include land for the future realignment of Ware Rd. The goal there is for the City to be able to align Ware Rd. with the existing Mackubin St. in Shoreview in the future to create a four -way intersection rather than the existing off set situation. However, a setback of 40 is needed from Ware rather than 30 feet, which would affect the layout by moving units west by 10 feet. Staff discussed the shortcomings of the proposed site design with the applicant. The applicants chose not to provide for a public street for access to Co. Rd. J. Utilities: Municipal utilities comprise the other vital infrastructure element in the 49/J planning study. The proposed design of Pheasant Stroll Estates includes a utility corridor connecting to the water and sanitary sewer trunks existing in Ware Road. The infrastructure plan must be completed to determine how the larger area can be served. Water must be looped through the area. Water trunk lines terminate in the southern ends of Ware Rd. on the east side and Woodridge Lane on the west. Long water trunks without looping may not provide adequate service. The water trunk in Ware Road could provide adequate water service for this proposed development. A sanitary sewer trunk also exists in Ware Road. However, it is very shallow. The 49/J study has taught us that a lift station likely will be needed for the area. Whether this will flow to Ware Road or north to another connection point needs to be determined. Stormwater Management, Wetlands: The north east portion of the site includes 1.8 acres of a larger wetland complex that extends across properties to the north. The Rice Creek Watershed District has confirmed the wetland delineation. The square buffer easement shown on the plans would need revision. The City supports surface filtration and other means of treating runoff, though the proposed design may need some revisions. Landscaping: We require landscaping along collector and arterial roads in new subdivisions to buffer homes form the roads. Park Dedication: Park dedication would be cash: $2075 per new dwelling unit. ENVIRONMENTAL BOARD The Environmental Board reviewed the application on February 22. The comments are attached. Pheasant Stroll Estates page 6 • OPTIONS 1. Approve rezoning, preliminary plat, and MUSA allocation. 2. Deny rezoning, preliminary plat, and MUSA allocation. • • RECOMMENDATION Option 2 Staff recommends denial of the rezoning, preliminary plat, and MUSA application based on the following findings: 1. The City's comprehensive plan includes the following policies: Plan transportation facilities to function in a manner compatible with adjacent land use. (page 35) Minimize and limit vehicular access onto all major collector and arterial streets ensuring adequate distance between intersections and utilization of appropriate traffic control methods and devices. (page 36) Land uses in the area need good, safe access to arterial roads. Because of the short distance between Hodgson and Ware Roads, access management is vitally important. One access to CR J, a public street, will provide good access to all properties adjacent to the subject site, and to the site itself. The proposed project does not provide for such a street. 2. The City's Growth Management Policy, Ordinance No. 24 -04, includes a finding that "managing growth through the orderly provision of infrastructure and other means promotes the goals and policies of the comprehensive plan." 3. The City's Growth Management Policy states that "promoting development within the existing MUSA is preferable to expanding the developing area of the City by granting MUSA reserve acres." 4. The proposed project requires approval of a rezoning, preliminary plat, and allocation of MUSA reserve. The site currently is not within the MUSA. 5. The City is conducting a planning study for an area that includes the proposed development site. This study will determine how the City will plan for infrastructure to serve the area. This includes transportation, water, and sanitary sewer. The study also will determine future land uses for the area. 6. A local street or frontage road are possibilities for creating access to this site. Access management is an important aspect of planning the city. The proposal does not provide the right of way for a public street that serves the public need for a safe, planned access on Co. Rd. J serving more than one property. 8. Right of way for Co. Rd. J is needed to total 60 feet from centerline. The project plan proposes only 50 feet. 9. Co. Rd. J is an arterial road, Ware Rd. is a collector. The minimum setback from arterial and collector roads is 40 feet. The proposal provides setbacks of only 30 feet. 10. If the street will be City owned and maintained, then the curb cut for the infiltration area is not allowed. Consider installing slot drains in the curb. 4: Please justify the existing conditions curve number for the pervious areas. The wooded areas do not appear to be included in the calculation. 5. The existing wetland 4 invert elevation indicated in the HydroCAD model appears to be off by a factor of 100. 6. Provide adequate inlet capacity for CB -1 and CB -2 in order to maintain the equivalent of one 12 foot lane in the event that the low point becomes flooded. 7. The pond outlets pipes will need to be designed so that pipe full velocities are between 4 and 6 fps. 8. City of Lino Lakes standard details for catch basins and catch basin/manholes call for a minimum cover of 4 feet from top of pipe to gutter, unless a perforated drain is added. The minimum cover for a manhole with a perforated drain is 2' -6" from top of pipe to gutter. • 9. Include a `rip rap at RCP outlet' detail in the plans. Integra Homes has requested approval of single family residential development called The Preserve. The comprehensive plan guides the site for low density residential use. The northern part of the site is within the existing MUSA and zoned R -1, but the southern part will need MUSA and rezoning. The Preserve project is the City's next opportunity to implement the Parks, Natural Open Space /Greenway and Trail System Plan through the use of a conservation development. Staff have worked with the developer to pursuit our public values and conservation development goals. The project includes restoration and preservation of quality wetlands and upland areas, and fills in one more piece of the greenway vision. A planned unit development (PUD) is being used on this project because standard zoning requirements do not accommodate the natural features and the restoration plan. As with the Foxborough (Fox Den Acres) project, the discussions have centered on the question "what is the best design ?" rather than "does this meet all the mathematical zoning requirements ?" The project will require some MUSA, rezoning to planned unit development, and the approval of a PUD development stage plan/preliminary plat. ANALYSIS The site consists of two parcels, both under the same ownership The southern parcel, which is all wetland except along the edge of Holly Drive, will not be developed. All proposed development is on the northern parcel. The northern parcel currently is split by the MUSA and zoning line. • • The Preserve page 2 Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The northern part of this northern parcel, approximately 850 feet or 2/3, is within the existing MUSA and currently is zoned R -1. Two public streets and municipal water and sanitary sewer are stubbed to the site. This site has been guided and zoned for development for many years prior to the current comprehensive plan adopted in 2002: as far back as the 1987 comprehensive plan. The following is a summary of the of the proposal's density: Gross Site Area 52.6 acres Upland Area 15.0 acres Total Lots 31 Gross Density 0.6 units /acre Net Density 2.1 units /acre The proposed density complies with Low Density Sewered Residential: up to 3 units /acre. The project requires 3.25 acres of MUSA to include the area not currently within the MUSA: Block 4, most of Block 5, and part of the road. The project also requires rezoning to planned unit development. Growth Management: As a conservation development, this project is not subject to the annual growth limits on the number of units, as stated in Ordinance 24 -04. Most of the site's developable land is already within the current MUSA, though 3.25 acres is needed. We have ample MUSA reserve to accommodate this small amount. Conservation Development: Ordinance 24 -04 amends the growth management policy to encourage conservation development by allowing a conservation development project to exceed • • • The Preserve page 3 the annual growth limits if it results in public values above those achievable under conventional development. The public values in the ordinance include but are not limited to the following: a. Preserving more natural open space than required under current ordinances and development policies The site includes over 37 acres of wetland, about 71% of the total property. Only 5930 sf of wetland fill is proposed. The proposal includes a conservation plan that will restore and enhance large areas of the wetlands and other open space.. b. Reducing the extent of impervious surfaces and size of the development footprint Compared to standard development, road pavement will be narrower and front setbacks reduced. This allows for house pads to be farther from wetlands. c. Restoring /enhancing ecological systems on the site as part of the development process The project design and a management plan include: • preserving and protecting wet prairie remnants • restoring native vegetation of wetlands • removing invasive vegetation and invasive species • re- introducing diverse, native species to wetlands • minimizing impacts to wetlands and significant trees (as identified in tree inventory) • tree replacement to compensate for loss of hardwoods • upland buffers: removing invasive species and planting native species • serious effort to avoid significant natural features such as rare plant populations, rare natural community remnants when designing lots and pads d. Protecting off -site ecological systems through increased buffering The wetlands form a large buffer from lands to the east and south The restoration and management plan for this project includes removing invasive species and planting and management of native species. e. Ensuring long -term natural resource stewardship through an endowment program sponsored by the developer The project includes a stewardship plan that includes an endowment. The financial details have yet to be finalized. f. Providing public park and trail opportunities consistent with or in excess of the System Plan The project includes a trail within the open space areas and along the road to provide access to Birch Park. g. Managing stormwater (flow rates and quality) using natural infiltration and ecologically - based approaches The project includes natural infiltration as part of the design. The `treatment train' approach includes swales, rain gardens, and infiltration ponds. This will improve The Preserve page 4 water quality on and off site. In addition, improving the wetlands through restoration of native vegetation will contribute to better water quality. h. Preserving the open space aesthetic to which community residences have become accustomed The project design minimizes impacts on wetlands and actually improves the wetlands, which will be protected with a management plan. i. Maintaining natural buffer between established and new developments. The large wetlands along the eastern part of the site will remain as and open space buffer for existing development. In addition to the specific activities described in the restoration and management plan, this site is a piece of a greenway system. This greenway is envisioned for a wetland complex that continues south and west for over a mile, and east for a similar distance. These wetlands are part of a large watershed along County Ditch 25, which drains a significant portion of south central Lino Lakes. It is the same complex that covers parts of the Foxborough project, which incorporated many conservation development elements to restore and conserve the wetlands. This ditch and wetland system has been identified as a high value ecological area. The Foxborough project was the first conservation development project because it was designed to accommodate and enhance this ecological system. The Integra development can be the next piece in this larger picture. PLANNED UNIT DEVELOPMENT, PRELIMINARY PLAT PUD: Conservation development design considers the conservation goals more important than mathematical standards found in a zoning ordinance. A planned development provides the flexibility needed in order to implement conservation development. Section 2, Subd. 10.A. of the zoning ordinance discusses the purpose of a planned unit development (PUD). In addition, Subd. 10.D. lists the purposes of an urban PUD. The application should be compared to these purposes. Purpose and Intent. The purpose of this section of the Zoning Ordinance is to provide for the grouping of lots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. This section is intended to introduce flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. It is further intended that planned unit developments are to be characterized by central management, integrated planning and architecture, joint and common use and maintenance of parking, open space and other similar facilities, and harmonious selection and efficient distribution of uses. The PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to encourage: • • • The Preserve page 5 1. A development pattern in harmony with the objectives of the Comprehensive Plan. 2. Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. 3. The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. 4. A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. 5. An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. 6. Promotion of a desirable and creative environment that might be prevented through the strict application of City zoning and subdivision regulations. Urban PUD Purposes: a. Preservation of wildlife habitat and unique natural resources. b. Reduction of negative impacts on the environment. c. Creation of common open space that provides a unified landscape for the use and enjoyment of the neighborhood community and /or the general public. d. A variety of urban residential lot sizes, configurations, and neighborhoods. Lots: The submittal includes 31 lots. In order to preserve as much open space as possible, lot dimensions have been adjusted. In much of the plat, the open space behind the lots extends for several hundred feet. The feeling of openness is greater, though the actual lot line depths will be less than a standard plat. Another means of increasing the common open space is the use of decreased setbacks. The front setbacks for most lots will be 25 feet from the right of way rather than the normal 30 feet. (Remember that the right of way included more land than the actual paved street.) Rear setbacks may also be reduced in order to retain conservation areas behind some lots. We did examine a `yield plan' that shows how the site could be developed under standard zoning. The number of lots hasn't been affected by using conservation development. The lot lines, conservation easements, drainage and utility easements, and other features may need to be adjusted in specific locations. These will be addressed prior to city council review. Some of the lots may end up with relatively small back yard areas. Streets, Access: The comprehensive plan for the community includes this site as an area to be developed. Two roads — Kildeer Drive and Pheasant Run —are stubbed to it in previous developments. Municipal water and sewer are stubbed in both streets. The proposed project • • • The Preserve page 6 would extend both of these roads to serve the two separate areas of the site. Pheasant Run would be planned to extend into the land to the west when that develops, creating an access to Old Birch St. Goals and policies of the comprehensive plan include a street system that connects rather than isolates neighborhoods. This serves to create a better sense of community and provides multiple access routes for emergency services. The long range vision includes connections through to Old Birch St. and to the Foxborough project to the southwest. This, in turn, provides local access to West Shadow Lake Drive and 62nd St., two local collectors. As currently proposed, the project would add 13 new homes on Kildeer Drive and 18 new homes on Pheasant Run. This will not overburden the roadways. When and if Pheasant Run extends west to the adjacent property, traffic generated by new development will go both directions. The right of way width for the internal streets is 50 feet. This is less than the normal 60 feet. The pavement width also is reduced to 28 feet rather than the standard 36 (face of curb to face of curb). These are two more ways of increasing the open space in the project: narrowing the rights of way allows for more open space behind the lots. The narrower pavement reduces impervious surface. The PUD standards specifically allow the pavement to be reduced in this way. Parking will be allowed on one side of the street only to ensure access by emergency vehicles. The plans include a temporary cul de sac at the western end of the Pheasant Run extension: on the abutting property. The developer is discussing an easement with that property owner to allow this. If those discussions are not successful, the cul de sac can be constructed on Lot 2, Block 5. When the property to the west is developed, the street would be extended, the cul de sac removed and vacated, and Lot 2 could be sold and built on. This will have to be decided before approval of the preliminary plat. The Kildeer Drive extension will curve a little to the west to provide for more useable land for lots on the east side of the road. These lots have the large pond to the east. Wet prairie restoration will occur on the west side of the pond and the area will be within a conservation easement. The lot lines, easements, and right of way are undergoing revisions and may change slightly before city council approval. Utilities: City water and sanitary sewer service will connect to existing facilities to the north. One "arm" of the project will connect to Kildeer Drive facilities, the other arm will connect to those in Pheasant Run. A water loop will connect the two, though the specific location of this loop has yet to be finalized. One extremely important aspect of this project is that the City needs a new well. The plat includes that site as Outlot A. This well site adjoins the existing Birch Park, the site listed for the well in the City's comprehensive water system plan. Outlot A would be deeded to the City as part of this project. • • • The Preserve page 7 Lots on the south part of the development will need to have `grinder pumps' for sanitary sewer. These are individual pumps in each house that pump wastewater to the sanitary sewer line in the street. This is necessary because of the shallow depth of the sewer line. Grading and Stormwater Management: The design includes infiltration methods that will help filter water prior to running into ponds or wetlands. No increase in runoff rate is allowed. This is a standard requirement for all development which is enforced both the Rice Creek Watershed District and the City. The Watershed granted its preliminary approval in September 2005. Any changes to the plan must be acceptable to the Watershed District. Improving water quality is an important conservation development goal. The use of rain gardens and other methods for infiltration in this project will promote that goal. It is true that each project makes up a relatively small area of the city. As each development project occurs, using natural methods of managing stormwater will result in better water quality than standard methods using only pipes and ponds. In addition, the restoration activities involved in conservation developments such as this one actually will improve the quality of the wetlands and result in water quality improvements. Parks, Open Space: The comprehensive plan broadly envisions a conceptual greenway in the area of this site. The City's "Parks, Natural Open Space /Greenways and Trails System Plan" further describes the area for conservation planning. Creating greenways to implement the concept presented in the comprehensive plan is the first priority of the parks and open space plan. This will require the use of a variety of strategies, the most important of which is greater reliance on a conservation development approach to land development. The preservation of open space on this site will be an important step in the implementation of the greenway vision. This is along the edge of a high value natural feature area that includes a major drainage through the southern part of Lino Lakes. A city trail would be created as part of the plat. The open space areas would be owned by the homeowners association and maintained as perpetual open space through a conservation easement over the area. A public trail easement also would wend through the open space area. The specific terms of the management plan implementation will require detailed legal agreements, which will be worked out prior to final platting. Some questions arose at the May meeting regarding pedestrians in the roadway and use of the park. Discussion with the Director of Public Services yielded useful information on these issues. There is one small baseball field in Birch Park. Programming there includes T -ball lessons and Little League practice. It is unlikely that more than 30 cars would be drawn to the park for these activities. There are 18 parking spaces in the parking lot, including one handicapped space. The parking lot will be re- striped in the near future. Each lot will have a rain garden, which prevents a trail from being constructed along the fronts of the lots. In addition, creating additional off - street trail segments will cost additional money. The boardwalks in this project will use up the park dedication for the project. In fact, the cost of the • • • The Preserve page 8 boardwalks likely will exceed the normal park dedication fees. The City does not have the additional funds to construct additional trails. Staff does not anticipate a safety problem based on the limited activity programmed at the park. REZONING TO PLANNED UNIT DEVELOPMENT Rezoning: Our ordinance includes two ways to use a PUD. One is a conditional use permit for a PUD, the other is a PUD rezoning. The conditional use permit option is not allowed in a single family zoning district, so a rezoning to PUD is needed for a conservation development. As stated in Section 2, Subdivision 1 of the zoning ordinance (the rezoning section), the Planning and Zoning Board shall consider possible adverse effects of the proposed zoning amendment. Its judgment shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The comprehensive plan guides the site for Low Density Sewered Residential land use. The site is within the Stage 1 (pre -2010) growth area. The comprehensive plan supports the greenway concept. The project implements the Parks, Natural Open Space /Greenways and Trails System Plan by creating a conservation development to provide an important segment of a larger greenway. 2. The proposed use is or will be compatible with present and future land uses of the area. Single family residential development exists to the north, and development of this site would be an extension of that neighborhood. and east. Land to the west is guided for future development. Development cannot occur to the south due to extensive wetlands. 3. The proposed use conforms with all performance standards contained herein. By its very nature, a conservation development PUD creates a design tailored to the site itself. Specific performance standards are listed in the ordinance, but many are created with the project approval. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Utilities are immediately available on abutting property, as are the stubbed roads. Municipal water and sanitary sewer are available to the site and sufficient capacity exists. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. The existing roads have the capacity for the additional development. • • The Preserve page 9 ENVIRONMENTAL BOARD The Environmental Board reviewed the project at its April 29 meeting. Generally, the Board recommends pursuing the conservation development approach on this site. Most of the specific recommendations have been part of the planning of the project since the start. Other specifics will be examined for feasibility as the project review continues. The Environmental Board recommendations are attached. OPTIONS 1. Approve the Rezone to Planned Unit Development, the Development Stage Plan/Preliminary Plat, and the Allocation of MUSA Reserve with the conditions of approval listed below. 2. Deny the application. RECOMMENDATION Option 1 CONDITIONS OF APPROVAL 1. Some lots will have restricted back yards due to easements or other features of the development plat. The developer, builders, and future property owners should be aware of this. House structures shall only be built within the building pads on the approved plans. 2. Some lot lines, easements, and other features will require adjustments prior to city council review of the project. 3. Streets shall be 28' face of curb to face of curb and parking shall be prohibited on one side of the street only. 4. Park dedication shall be cash with credit for construction of trails. 5. A restoration and management plan shall be included in the city council approval of the proj ect. 6. A conservation easement area shall be shown on the plans and dedicated to the City. The easement document shall describe the restoration and management plan and its funding. The easement document shall be reviewed by the City prior to dedication of the easement and prior to final plat approval. • • • The Preserve page 10 7. A homeowners association shall be created. Association documents shall describe the restoration and management plan, its funding, and its implementation. The association shall maintain a stewardship fund to implement the restoration and management plan for the open space areas defined by the conservation easement. The stewardship activity shall be in accordance with the conservation easement and the approved restoration and management plan. The purpose of the rules would be to establish protocol for conducting meetings. If printed and available with meeting agendas, the rules also would help the public understand how the P & Z conducts its business at the meetings. I have attached a hard copy of the city council "Council Meeting Procedures" currently on the Lino Lakes website. I've also attached Hugo's pamphlet. Mike Hyden has provided information from two other communities. Shoreview has a pamphlet. Roseville includes some information at the top of the meeting agenda. These refer to city council meetings, but meeting protocol can be universal, with any appropriate adjustments made for the P & Z. For example, the P & Z has a chair rather than a mayor running the meeting, and P & Z does not have old business versus new business on the agenda. The mayor and council members have a single vote. Council motions require a majority vote for passage. The Agenda After roll call and setting the agenda, the city council will consider items such as awards, proclamations, special recognitions etc. The Consent Agenda Routine administrative items are placed on the consent agenda. These items are not discussed, and may be approved in their entirety pursuant to the recommendations on staff reports. A council member or citizen may ask that an item be pulled from the consent agenda for discussion. Items pulled will receive separate action. All items not removed from the consent agenda will be approved by a single motion. Open Mike Open Mike gives members of the audience and opportunity to speak before the council.
