City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. APPROVAL OF MINUTES: June 14, 2006 Mr. Rafferty made a MOTION to approve the June 14, 2006 Minutes as presented and was supported by Mr. Hyden. Motion carried 5 -0. IV. OPEN MIKE Vice Chair Pogalz declared Open Mike at 6:40 p.m. There was no one present for Open Mike. Mr. Rafferty made a MOTION to close Open Mike at 6:39 p.m., and was supported by Mr. Hyden. Motion carried 5 -0. V. ACTION ITEMS • DRAFT MINUTES Planning & Zoning Board July 12, 2006 Page 2 • A. PUBLIC HEARING for a Conditional Use Permit for a Private Dog Kennel at 575 Ash Street Mr. Bengtson presented the staff report, noting that the applicant currently has three dogs and is proposing to keep those existing dogs on the premise. Mr. Bengtson explained that the city had received three phone calls regarding the public hearing notice, but only one resident continued to voice concern after clarification that the applicant would only have three dogs. Staff recommended approval of the application subject to the conditions listed in the staff report. Vice Chair Pogalz opened the Public Hearing at 6:46. Margo Polta, 575 Ash Street, applicant was present for questions. Mr. Laden made a Motion to close the Public Hearing at 6:49. Motion was supported by Mr. Rafferty. Motion carried 5 -0. Mr. Laden made a MOTION to approve the Conditional Use Permit to allow a Private Dog Kennel at 575 Ash Street subject to the following conditions: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. b. The proposed development application is compatible with present and future land uses of the area. c. The proposed development application conforms to performance standards herein and other applicable City Codes. d. Traffic generated by a proposed development application is within the capabilities of the City. e. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. f. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Motion was supported by Mr. Nelson. Motion carried 5 -0. VI. DISCUSSION ITEMS A. Meeting Rules Mr. Smyser explained that city staff was suggesting that the board accept guidelines specific to the Planning & Zoning Board at this time. Board Members agreed to accept a set of Planning & Zoning Board Meeting Guidelines to be distributed at future meetings in the effort of public awareness. They also suggested adding text to the bottom of the agenda noting that meeting guidelines could be found on the reverse side. DRAFT MINUTES Planning & Zoning Board July 12, 2006 Page 3 Mr. Rafferty made a MOTION to accept the Planning & Zoning Board Meeting Guidelines. Motion was supported by Mr. Hyden. Motion carried 5 -0. Board Members later agreed to add text to meeting agendas requesting that all electronic devices be turned off during the meeting. City staff agreed to add the suggested text to future agendas. B. Comprehensive Plan Update Process Mr. Smyser stated that the process to update the city's Comprehensive Plan has begun. He explained that the process involves various interrelated steps including a city quality of life survey, a visioning process & ultimately the updated Comprehensive Plan. The city intends to start the visioning process in the next few months. He described that the visioning process will lead to a set of goals, which will be used to guide the Comp Plan. A group of people will be selected to serve on the visioning committee and Comp Plan Task Force. Mr. Smyser noted that, by law, the Planning & Zoning Board is the leading body for preparation of the Comp Plan, with the City Council being the final decision maker. Staff added that the City Council's goal is to get the plan to the Metropolitan Council by the end of year 2007. By law, the plan must be completed by the end of 2008. Staff noted that the city charter will be examined as part of the comprehensive plan update process, but any changes to the charter must be approved by the voters with a referendum. VII. Respectfully submitted, Dawn Bugge Community Development Assistant DRAFT MINUTES AGENDA ITEM V.A. • STAFF ORIGINATOR: Paul Bengtson MEETING DATE: August 9, 2006 TOPIC: Golden Acre Rezone From Rural to R -1 Variances for Lot Depth, Lot Width, and Lot Area Preliminary Plat Allocation of 1 Acre of MUSA Reserve BACKGROUND Tim Anderson has requested approval of the Golden Acre plat. Much like Hailey Manor and Cavegn Estates previously, this project involves the redevelopment of an existing residential lot in the Mar Don Acres neighborhood into a total of four residential lots. The proposed plat would accommodate the existing dwelling on lot 1, another buildable lot fronting Lois Lane, and two buildable lots fronting Arlo Lane. To accommodate the development proposal, the following approvals are necessary: 1. Rezoning from R (Rural) to R -1 (Single Family Residential) 2. Preliminary plat 3. Variances Lot depth: 132' instead of 135' (all four lots); Lot width: 77.5 feet instead of 80 (lot 2); Lot area: 10,230 square feet instead of 10,800 square feet (lot 2); and Side Setback: 6.27 feet instead of 10 feet.(lot 1) 4. Allocation of 1 acre of MUSA reserve • ANALYSIS The following is a summary of the proposal: Gross Site Area 1.11 acres Net Site Area 1 acre Total Lots 14 Gross Density 3.6 units /acre Net Density 4.0 units /acre Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. • Location Existing Land Use Guided Land Use Existing Zoning Site residential Low Density Unsewered Residential Rural North residential Low Density Sewered Residential R -1 South residential Low Density Unsewered Residential Rural East residential Low Density Unsewered Residential Rural West residential Low Density Unsewered Residential Rural Growth Management, MUSA Reserve: The City obtained additional MUSA allocation from the Met Itouncil for all properties fronting on Lois Lane as part of the Hailey Manor project (east of this site) which is to e allocated with the preliminary plat and granted with the final plat. That is, the properties were not to receive MUSA until rezoned and platted. Growth Management, Units/Year: The table attached to this report shows the status of the staging plans for final platting new residential units. The three new units in Golden Acre would fit within the policy of 147 per year and so could be final platted in 2006. Rezoning The site currently is zoned R (Rural). In order for the urban-sized lots to be created, the site must be rezoned to an urban residential zone. As stated in the zoning ordinance: • The Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgment shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The application includes an amendment of the comprehensive plan to change the land use and the MUSA line to accommodate the project. If this amendment is approved, the project would comply with the comprehensive plan. 2. The proposed use is or will be compatible with present and future land uses of the area. Bluebill Ponds to the north and Hailey Manor to the east both are zoned R -1 (Single Family Residential). The R -1 (Single Family Residential) zone allows lots of 10,800 sf, which would accommodate the majority of the Golden Acre lots, and would be consistent with adjacent urbanized development. The rest of the Mar Don Acres neighborhood will remain as larger lots unless further redevelopment occurs. Lot size alone does not create an automatically incompatible situation. 3. The proposed use conforms with all performance standards contained herein (in the ordinance). The new lots will conform to the R -1 standards in the zoning ordinance except for minor deviations in lot depth, lot width, and lot area. This will be resolved with approval of the variances (see below under "Lots "). 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Sanitary sewer and water are available being installed within Lois Lane with stubs set up for the two lots that are proposed. Sanitary sewer and water is already available within Arlo Lane for the site. The utilities are appropriately sized to handle the level of service necessary for the four lots within the proposed Golden Acre plat. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. • The addition of 3 single family homes will not overburden the roadway system. Lois Lane has outlets to the east and west and Country Lane connects to 77th St. to the south. The current rezoning proposal would apply only to the property included in the Golden Acre plat. Future redevelopment of other properties within the area would require a rezoning and platting of such properties. Preliminary Plat "tots: The lots will be 132 feet in depth. The minimum lot depth in an R -1 zone is 135 feet. When the Mar Don Acres lots were platted, they were 294' deep. The 30' easement on the north edge, which now includes Arlo Lane, reduces the depth to 264'. Half of that is 132'. It is impossible to know why the extra six feet was not planned for when Mar Don Acres was platted. However, it is clear that the intent was to plan for a road on the north side, and a 30' easement was platted. The construction of Arlo Lane fulfilled that plan for a street. The City approval of the creation of Arlo Lane was an acknowledgement of the intent to provide the opportunity for the Mar Don Acres lot to subdivide. In order to fulfill this, the lots must be smaller than 135' in depth. The locations of Arlo and Lois Lanes prevent larger lots. It may be possible to add three feet onto one row of lots and make the other row 129', though the value of such a change is questionable. Therefore staff finds the minor deviation of less than 3% to be acceptable. Lot 2 will be 77.5 feet in width and consist of 10,230 square feet. The minimum lot width in an R -1 zone is 80 feet (though lots of 1.5 acres or more are allowed to be re- subdivided at a width of 75 feet) and the minimum lot size is 10,800 square feet. The existing home that will remain on lot 1 is the cause for this deviation. In order to provide an appropriate setback (the applicant has proposed 6.27 feet, which is explained in the Setback section below) the applicant is proposing to reduce the lot width and area of Lot 2 so that the existing dwelling can remain on Lot 1. This is a reduction of 3% and 5% respectively; therefore staff sees this as an acceptable minor deviation of the code requirements. Setbacks: The applicant is proposing to deviate from the 10 foot side setback required for principal buildings in the R -1 zone. Considering the location of the existing dwelling; strict application of the 10 foot setback would limit Lot 2 to a width of 73.5 feet and an area of 9,702 square feet. Therefore the applicant is proposing 6.27 foot side setback, which is slightly greater than the five feet that is required for accessory structure and will therefore maintain a minimum of ten feet separation between the existing dwelling and the home constructed on Lot 2. Considering this structure will exist when Lot 2 is developed, this reduction in setback will not have a negative effect on the surrounding properties. Streets: Arlo Lane, Lois Lane and Country Lane all are existing roads. No additional roads are being proposed. The existing road system can accommodate the traffic generated by the new homes. As part of the final plat, the developer must dedicate the Arlo Lane right of way. This will fulfill the intent of the City when Mar Don Acres was platted. Arlo Lane exists now, and the dedication is more of a formality. Park Dedication: The current subdivision ordinance includes park dedication in the amount of $2075 per residential unit, less any land dedication. There is no land dedication needed, as Highland Meadows Park is nearby. The park dedication will be $2,075 x 3 new home lots = $6,225. Utilities: Sanitary sewer and water is already in place in Arlo Lane and is being installed in Lois Lane presently. All of the proposed lots, including the existing home, must connect to utilities. Onsite septic systems must be abandoned according to law. In addition, existing wells likely will have to be capped because of proximity to new sanitary sewer lines. These and other issues discussed in the City Engineer review memo must be addressed to his satisfaction. dGrading and Stormwater Management: The grading plan submitted was not accompanied by the required rainage calculations, therefore the engineering of the site could not be completely reviewed and as a result staff is recommending continuing this item to the September 13th Planning and Zoning Board regular meeting. The plan is also subject to review and approval from the Rice Creek Watershed District. ENVIRONMENTAL BOARD Ike Environmental Board's comments requesting an infiltration area in the form of a rain garden; requiring a storm water pollution prevention plan and Minnesota Pollution Control Agency permit; and requesting the submittal of a tree inventory /preservation plan will all be addressed with the developer prior to this item being brought forth to the September 13th regular meeting for the board's consideration. RECOMMENDATION Staff is recommending continuation based on the lack of sufficient engineering data to completely review the project. The following conditions are likely to be brought forward in September with staff s recommendation. 1. All lots in the plat, including the existing home, must agree to connect to City utilities. The City will not approve the final plat without legally enforceable assurance that all properties will connect and existing onsite septic systems will be appropriately abandoned. 2. Existing wells shall be capped when required by Minnesota Dept. of Health requirements. 3. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 4. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the site. The north 30 feet shall be dedicated to the City on the final plat for right of way for Arlo Lane. • 6. Park dedication must be paid in accordance with the city's fee schedule. 7. A permit from the Rice Creek Watershed District must be issued prior to final plat approval by the City. 8. Infiltration areas proposed on site should have the City native seed specification used. 9. A boulevard tree shall be provided for each lot frontage. An Employee Owned Company Promoting Affirmative Action and Equal Opportunity • • Environmental Memo To: Paul Bengtson From: Marty Asieson Date: August 3, 2006 Re: August 2 Environmental Board Recommendations The following recommendations were made concerning Golden Acre: Although the site is not large enough for the RCWD to review, recommend following standard guidelines for addition of impervious. That is an infiltration area must be provided to infiltrate the impervious area from the Mpls -St. Paul median storm (.34 inches) in 72 hours. This area could be in the form of a rain garden between the 4 houses with as much impervious area as possible directed to it. The infiltration area must be protected from compaction before construction begins. The grading plan shows the surface water flowing to the neighbor lot. The grading plan should be changed to reflect on site storage /infiltration of water. The infiltration area should be in the form of a rain garden and the design approved by the City A SWPPP (Storm Water Pollution Prevention Plan) and a MPCA permit are required for this project. The SWPPP must be submitted to the City for approval before any soil disturbance occurs, as well as the MPCA permit. The SWPPP must be located on site (Preferably a mail box) with weekly and post rain fall event inspection reports. The developer did submit an erosion control plan (Attachment 4). The erosion plan should be made more comprehensive to address pollution issues such as concrete truck cleaning and litter containment. The plan needs to show a concrete truck wash site that is protected by containment barriers. All wash out must be removed from the site after construction. The plan signature is the responsible person that will inspect and correct deficiencies. The name and 24 hour phone number of this person must be added to the plan. Location of the required rock entrance must be shown on the plan. • Page 1 • • • Storm sewer catch basins need to be protected with an Infrashield type of device. Silt fabric will not be allowed. The SWPPP needs to be very site specific. With out revision, the project should not be allowed to move forward. An inventory of significant trees should be submitted with s tree preservation plan. A site plan and building elevations are included with this memorandum for your information. The Planning and Zoning Board may recall that the applicant originally requested and then later withdrew a Preliminary Plat application to combine Lots 2 and 3 of the JADT Addition. They chose to retain the flexibility to either expand their operations to Lot 2 in the future (with the approval of a Preliminary and Final Plat) or to develop Lot 2 with a completely separate use. Upon withdrawal of the Preliminary Plat the remaining request for Site Plan Review was reviewed administratively as is allowed under the Zoning Ordinance. Staff is working with the developer to complete the Site Performance Agreement for development of the site; but building permit applications have not been submitted, nor has the developer indicated an anticipated construction schedule.
