City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and /or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. CALL TO ORDER AND ROLL CALL: Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6:33 p.m., September 13, 2006. II. APPROVAL OF AGENDA The agenda was approved. III. APPROVAL OF MINUTES: August 9, 2006 and July 12, 2006 Mr. Rafferty made a MOTION to approve the August 9, 2006 Minutes and the amended July 12, 2006 minutes and was supported by Mr. Hyden. Motion carried 5 -0. IV. OPEN MIKE Chair Tralle declared Open Mike at 6:35 p.m. There was no one present for Open Mike. Mr. Pogalz made a MOTION to close Open Mike at 6:36 p.m., and was supported by Mr. Rafferty. Motion carried 5 -0. V. ACTION ITEMS DRAFT MINUTES Planning & Zoning Board September 13, 2006 Page 2 A. PUBLIC HEARING for a Rezoning, MUSA Allocation, Variance and Preliminary Plat for Golden Acre Mr. Pogalz made a motion to continue the Public Hearing to the October 11, 2006 meeting. Motion was supported by Mr. Hyden. Motion carried 5 -0. B. PUBLIC HEARING for a Zoning Ordinance Amendment to modify the allowable uses within the NB, Neighborhood Business, and the LB, Limited Business, zoning districts and for a Rezone from LB, Limited Business, to NB, Neighborhood Business, at Lot 1, Block 16, Millers Crossroads, located at the southeast corner of Birch St. and Hodgson Rd Mr. Smyser clarified that a Public Hearing notice was published for this item for the next City Council meeting which will include amendments to the GB, General Business District in addition to the NB and LB Districts. Mr. Smyser presented the staff report and explained that the City Council directed staff to rezone the property. Examining the differences between zoning districts led to staff recommendation to change some of the uses allowed in the business zones. Staff requested that the board take action this evening in order for the item to go to the City Council meeting as published. Mr. Tralle opened the Public Hearing at 6:59 p.m. Mr. Greg Schlink, Bruggeman Properties, owner of Lot 1, Block 16, Millers Crossroads, gave a brief history of the site. Mr. Schlink stated that the Planning & Zoning board recommended approval of a coffee house with a drive - through, but the City Council was prepared to deny the request. Mr. Schlink explained that they withdrew their application instead of receiving a denial. Mr. Schlink distributed a letter, dated September 13, 2006, referred to as Millers Crossroads Shopping Center (Agenda Item V.B.), to board members and city staff to be included as part of the public record. Mr. Schlink told board members that he was informed the issue was a "done deal," therefore he had no further comments but would answer any questions. Board Members questioned the applicant about the changes to the zoning ordinance as presented and asked if the drive - through was the applicant's main concern. Mr. Schlink stated that he thinks a drive - through use on a limited basis is reasonable for this site, adding that the intent is for a small coffee shop. He believes this would not cause a traffic issue or be detrimental to the neighborhood. Mr. Schlink stated that his main concern is the drive - through. He added that they do want the ability to serve beer and wine, provide outdoor seating, and have the potential for a small hospice facility. Mr. Rafferty addressed that staff has added options to the Neighborhood Business district as proposed, and that the City Council would deny a drive - through at this location. Mr. Schlink stated he would like the opportunity to propose a drive - through again in the future, but a rezone to the property would eliminate that option. DRAFT MINUTES • Planning & Zoning, Board September 13, 2006 Page 3 Mr. Rafferty made a motion to close the Public Hearing at 7:09 p.m. and was supported by Mr. Pogalz. Motion carried 5 -0. Mr. Laden stated that he is in favor of a neighborhood business zone to the property. Mr. Laden questioned why a catering business would fit in to a neighborhood zone, as most catering business is taken off site, and opposed a change to catering but agreed with the other proposed changes. Mr. Pogalz asked what the property was zoned when this project was originally proposed. Mr. Smyser replied that the site was originally divided into R -1 and R -3 districts, but the site was guided for commercial. The Council later approved a rezone to LB for the corner. Mr. Smyser stated that when property was rezoned to LB, there was a great amount of discussion between the LB and NB zones at that time. The most recent application included the drive -thru, and City Council stated they would deny the proposal. Mr. Pogalz questioned Council's intent for denial. Mr. Smyser stated that the City Council re- examined zoning of the site, and no longer agreed with the original decision. Mr. Smyser explained that staff generated the additional revisions to the ordinance accordingly. Mr. Pogalz questioned the fairness of the decision. Mr. Smyser pointed out that the applicant withdrew the application, therefore an intent was a moot point. Mr. Laden asked if a building was proposed with the original approval. Mr. Laden believes the proposed use seemed appropriate for the site. Mr. Laden addressed that the original proposal did not include a drive - through. Mr. Smyser replied that a proposed building was reviewed and considered with the original approval. Mr. Laden asked staff if a Conditional Use Permit is granted for a coffee shop, at a later time could that use turn into a fast food restaurant or would the applicant have to reapply. Mr. Smyser responded that conditions were proposed for this site to restrict that the use would be limited to a coffee shop as part of City Council discussion. Mr. Smyser explained that a permitted use is a use by right, however a city can legally add stipulations to a Conditional Use Permit. He stated that a Conditional Use Permit gives the city excess regulatory ability, adding that this is an important difference between the two. Upon further discussion, board members and staff agreed that the fact is the applicant withdrew the application, therefore they needed to address the proposals presented before them tonight. • Mr. Smyser reiterated that the city has the right to rezone property. He added that often decisions are made and later determined that a different decision may have been better. Mr. Hyden commented that he understands that the city has the ability to make changes and can, but stated that the developer thought they knew what the rules were, and now the DRAFT MINUTES Planning & Zoning Board September 13, 2006 Page 4 rules are being changed. He stated that he feels bad about the process. Mr. Hyden agreed with the proposed text changes except for the catering issue. He felt that all proposed amendments seem to fit the Neighborhood Business district. Mr. Tralle commented that he also determined that a drive - through was not appropriate for this site after the P &Z Board's recommendation. Mr. Tralle pointed out that many proposals have been made for this property and that the proposed changes will open up opportunities for business. Mr. Laden pointed out that often times the city rezones property without the property owner's approval, and added that there are no guarantees to the zoning of a property. Mr. Rafferty made a motion to recommend approval of the proposed Zoning Ordinance Amendment to modify the allowable uses within the Business zoning districts as proposed with the exception of the change to catering businesses. Motion was seconded by Mr. Hyden. Mr. Pogalz commented that the proposed site is currently being developed and the property owner has something in mind. He believes that the City Council should work with developers that have already been approved. A roll call vote was taken on the motion. Motion was approved 3 -2 with the following votes: Ayes: Rafferty, Hyden and Laden. Nays: Nelson and Pogalz. Mr. Laden made a motion to recommend approval of a Rezone from LB, Limited Business, to NB, Neighborhood Business, at Lot 1, Block 16, Millers Crossroads. Motion was seconded by Mr. Rafferty. Mr. Rafferty commented that it is disappointing when these things happen, but acknowledged that rules can change and the developer removed the option from the table. A roll call vote was taken on the motion. Motion was approved 3 -2 with the following votes: Ayes: Rafferty, Hyden and Laden. Nays: Nelson and Pogalz. Staff stated that these items will go to the City Council meeting on September 25. (Mr. Hyden left at 7:46 p.m.) VI. DISCUSSION ITEMS A. Trash Enclosures/Detached Accessory Structures Mr. Bengtson asked what the board's directive was on this issue. Mr. Laden stated that the suggestion of proposing restrictions regarding this issue had been made to avoid lengthy discussions of this issue in the future. Mr. Rafferty commented that he felt the board could continue to encourage compliance without adopting strict requirements. DRAFT MINUTES Planning & Zoning Board September 13, 2006 Page 5 • Upon further discussion, board members agreed that they would continue to encourage future applicants to take measures to attach trash enclosures to buildings in an appropriate way without placing restrictions in the ordinance. STAFF ORIGINATOR: Paul Bengtson MEETING DATE: October 11, 2006 TOPIC: Golden Acre Rezone From Rural to R -1 Variances for Lot Depth, Lot Width, and Lot Area Preliminary Plat Allocation of 1 Acre of MUSA Reserve BACKGROUND Tim Anderson has requested approval of the Golden Acre plat. Much like Hailey Manor and Cavegn Estates previously, this project involves the redevelopment of an existing residential lot in the Mar Don Acres neighborhood into a total of four residential lots. The proposed plat would accommodate the existing dwelling on lot 1, another buildable lot fronting Lois Lane, and two buildable lots fronting Arlo Lane. To accommodate the development proposal, the following approvals are necessary: 1. Rezoning from R (Rural) to R -1 (Single Family Residential) 2. Preliminary plat 3. Variances Lot depth: 132' instead of 135' (all four lots); Lot width: 77.5 feet instead of 80 (lot 2); Lot area: 10,230 square feet instead of 10,800 square feet (lot 2); and Side Setback: 6.27 feet instead of 10 feet.(lot 1) 4. Allocation of 1 acre of MUSA reserve ANALYSIS The following is a summary of the proposal: Gross Site Area 1.11 acres Net Site Area 1 acre Total Lots 4 Gross Density 3.6 units /acre Net Density 4.0 units /acre Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. Location Existing Land Use Guided Land Use Existing Zoning Site residential Low Density Unsewered Residential Rural North residential Low Density Sewered Residential R -1 South residential Low Density Unsewered Residential Rural East residential Low Density Unsewered Residential Rural West residential Low Density Unsewered Residential Rural Slrowth Management, MUSA Reserve: The City obtained additional MUSA allocation from the Met Council for all properties fronting on Lois Lane as part of the Hailey Manor project (east of this site) which is to be allocated with the preliminary plat and granted with the final plat. That is, the properties were not to receive MUSA until rezoned and platted. Growth Management, Units/Year: The table attached to this report shows the status of the staging plans for final platting new residential units. The three new units in Golden Acre would fit within the policy of 147 per year and so could be final platted in 2006. Rezoning The site currently is zoned R (Rural). In order for the urban-sized lots to be created, the site must be rezoned to an urban residential zone. As stated in the zoning ordinance: The Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgment shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The site is currently guided for Low Density Sewered Residential and the application includes a request to allocate MUSA acreage to accommodate the project and with that approval the project would comply with the comprehensive plan. 2. The proposed use is or will be compatible with present and future land uses of the area. Bluebill Ponds to the north and Hailey Manor to the east both are zoned R -1 (Single Family Residential). The R -1 (Single Family Residential) zone allows lots of 10,800 sf, which would accommodate the majority of the Golden Acre lots, and would be consistent with adjacent urbanized development. The rest of the Mar Don Acres neighborhood will remain as larger lots unless further redevelopment occurs. Lot size alone does not create an automatically incompatible situation. 3. The proposed use conforms with all performance standards contained herein (in the ordinance). The new lots will conform to the R -1 standards in the zoning ordinance except for minor deviations in lot depth, lot width, and lot area. This will be resolved with approval of the variances (see below under "Lots "). 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Sanitary sewer and water are available being installed within Lois Lane with stubs set up for the two lots that are proposed. Sanitary sewer and water is already available within Arlo Lane for the site. The utilities are appropriately sized to handle the level of service necessary for the four lots within the proposed Golden Acre plat. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. The addition of 3 single family homes will not overburden the roadway system. Lois Lane has outlets to the east and west and Country Lane connects to 77th St. to the south. The current rezoning proposal would apply only to the property included in the Golden Acre plat. Future redevelopment of other properties within the area would require a rezoning and platting of such properties. •reliminary Plat Lots: The lots will be 132 feet in depth. The minimum lot depth in an R -1 zone is 135 feet. When the Mar Don Acres lots were platted, they were 294' deep. The 30' easement on the north edge, which now includes Arlo Lane, reduces the depth to 264'. Half of that is 132'. It is impossible to know why the extra six feet was not planned for when Mar Don Acres was platted. However, it is clear that the intent was to plan for a road on the north side, and a 30' easement was platted. The construction of Arlo Lane fulfilled that plan for a street. The City approval of the creation of Arlo Lane was an acknowledgement of the intent to provide the opportunity for the Mar Don Acres lot to subdivide. In order to fulfill this, the lots must be smaller than 135' in depth. The locations of Arlo and Lois Lanes prevent larger lots. It may be possible to add three feet onto one row of lots and make the other row 129', though the value of such a change is questionable. Therefore staff finds the minor deviation of less than 3% to be acceptable. Lot 2 will be 77.5 feet in width and consist of 10,230 square feet. The minimum lot width in an R -1 zone is 80 feet (though lots of 1.5 acres or more are allowed to be re- subdivided at a width of 75 feet) and the minimum lot size is 10,800 square feet. The existing home that will remain on lot 1 is the cause for this deviation. In order to provide an appropriate setback (the applicant has proposed 6.27 feet, which is explained in the Setback section below) the applicant is proposing to reduce the lot width and area of Lot 2 so that the existing dwelling can remain on Lot 1. This is a reduction of 3% and 5% respectively; therefore staff sees this as an acceptable minor deviation of the code requirements. Wetbacks: The applicant is proposing to deviate from the 10 foot side setback required for principal buildings I the R -1 zone. Considering the location of the existing dwelling; strict application of the 10 foot setback would limit Lot 2 to a width of 73.5 feet and an area of 9,702 square feet. Therefore the applicant is proposing a 6.27 foot side setback, which is slightly greater than the five feet that is required for accessory structure and will therefore maintain a minimum of ten feet separation between the existing dwelling and the home constructed on Lot 2. Considering this structure will exist when Lot 2 is developed, this reduction in setback will not have a negative effect on the surrounding properties. Streets: Arlo Lane, Lois Lane and Country Lane all are existing roads. No additional roads are being proposed. The existing road system can accommodate the traffic generated by the new homes. As part of the final plat, the developer must dedicate the Arlo Lane right of way. This will fulfill the intent of the City when Mar Don Acres was platted. Arlo Lane exists now, and the dedication is more of a formality. Park Dedication: The current subdivision ordinance includes park dedication in the amount of $2075 per residential unit, less any land dedication. There is no land dedication needed, as Highland Meadows Park is nearby. The park dedication will be $2,075 x 3 new home lots = $6,225. Utilities: Sanitary sewer and water is already in place in Arlo Lane and is being installed in Lois Lane presently. All of the proposed lots, including the existing home, must connect to utilities. Onsite septic systems must be abandoned according to law. In addition, existing wells likely will have to be capped because of proximity to new sanitary sewer lines. These and other issues discussed in the City Engineer review memo *must be addressed to his satisfaction. Grading: The grading plan has been reviewed by the City Engineer and his comments will need to be addressed to his satisfaction prior to the site being developed. The plan is also subject to review and approval from the Rice Creek Watershed District. ENVIRONMENTAL BOARD The Environmental Board's comments requesting an infiltration area in the form of a rain garden have been addressed on the revised grading plan. The request for tree inventory /preservation plan will be required prior to any construction on the site. RECOMMENDATION Staff is recommending approval of this request, subject to the following conditions: 1. All lots in the plat, including the existing home, must agree to connect to City utilities. The City will not approve the final plat without legally enforceable assurance that all properties will connect and existing onsite septic systems will be appropriately abandoned. 2. Existing wells shall be capped when required by Minnesota Dept. of Health requirements. 3. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 4. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the 410. The north 30 feet shall be dedicated to the City on the final plat for right of way for Arlo Lane. 6. Park dedication must be paid in accordance with the city's fee schedule. 7. A permit from the Rice Creek Watershed District must be issued prior to final plat approval by the City. 8. Infiltration areas proposed on site should have the City native seed specification used. 9. A boulevard tree shall be provided for each lot frontage. 10. A tree inventory and preservation plan must be submitted to the city prior to any construction on the site. As a result, infiltration areas would be required in the front yards in order to reduce the 2 -year discharge by 0.07 cfs. That is an infiltration area must be provided to infiltrate the impervious area from the Mpls -St. Paul median storm (.34 inches) in 72 hours. This area could be in the form of a rain garden between the 4 houses with as much impervious area as possible directed to it. The infiltration area must be protected from compaction before construction begins. The grading plan shows the surface water flowing to the neighbor lot. The grading plan should be changed to reflect on site storage /infiltration of water. The infiltration area should be in the form of a rain garden and the design approved by the City A SWPPP (Storm Water Pollution Prevention Plan) and a MPCA permit are required for this project. The SWPPP must be submitted to the City for approval before any soil disturbance occurs, as well as the MPCA permit. The SWPPP must be located on site (Preferably a mail box) with weekly and post rain fall event inspection reports. The developer did submit an erosion control plan (Attachment 4). The erosion plan should be made more comprehensive to address pollution issues such as concrete truck cleaning and litter containment. The plan needs to show a concrete truck wash site that is protected by containment barriers. All wash out must be removed from the site after construction. The plan signature is the responsible person that will inspect and correct deficiencies. The name and 24 hour phone number of this person must be added to the plan. ANALYSIS Building Plans 410\ typical final plan application consists of the building plans for the units and the final plat of a portion of the townhome property. However, this is the second phase of the project and therefore the building plans approved for the first phase will be continued in this part of the project. This will clearly be included within the development agreement for the site. Final Plat The final plat for the second addition is substantially conforming to that shown during the first addition, the only difference being the dedication of a drainage and utility easement over the entirety of the lots surrounding the townhomes. This is a cleaner process for defining the easements and was suggested by staff prior to application. The applicant is vacating the drainage and utility easements recorded on Outlot B of the Village No. 3 plat, which will go through a first reading at the November 13th City Council meeting and will then have a second reading prior to this item on the November 27th City Council. RECOMMENDATION Staff recommends approval of the project, subject to the following conditions: 1. The developer will enter into a development agreement with the city prior to the issuance of any building permits for the site. This agreement shall clearly require that the conditions of Resolution 06 -119 still apply to this site. 2. The attached location map designates the sites as parcels 1— 4, and 16 on Peltier Lake and parcels 6, 14, and 15 on Centerville Lake, and these designations will be used throughout this report to differentiate the sites. The city granted similar variances for other St. Paul Regional Water Service's parcels in 2004. The intention of the application is to allow the shoreland parcels to be divided in the future (via minor subdivision) and sold to adjacent property owners for combination into existing parcels. STAFF ORIGINATOR: Paul Bengtson MEETING DATE: October 11, 2006 TOPIC: Discussion Only Fran's Estate Variances for Lot Area and Front Setback Preliminary Plat BACKGROUND Fran Tourville has requested approval of the Fran's Estate plat. This project involves the division of an existing undeveloped parcel into two buildable lots. To accommodate this development proposal the applicant has requested a Preliminary Plat; and Variances for Lot Area (9,728 and 10,634 square feet instead of 10,800 square feet), and the reduction of the front setback from 40 feet to 25 feet. During the review of this application staff has identified many issues that make it impossible for staff to offer a recommendation at this time, therefore the public hearing required by state law for all preliminary plats was not scheduled for this meeting. However, staff scheduled this item for the October meeting so that discussion could 41,e held and staff could get the board's input on several of the issues. ANALYSIS The following is a summary of the proposal: Site Area 1.89 acres Total Lots 2 Density 1.06 units per acre Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The new unit created by Fran's Estate would fit within the policy of 147 per year and so could be final platted in 2006. preliminary Plat Lots: The lots meet requirements for lot depth, lot width, and road frontage, but fall short of the 10,800 square feet of upland required for R -1 lots. Lot 1 is 166 square feet under the requirement and Lot 2 is 1,072 square feet under the requirement. This would result in a deviation of approximately 2% and 10% respectively. During staff s review of the application it was difficult to establish findings (as required by state law) to support such a reduction. State law requires the following finings to be made in order to grant the approval of a variance. Staff has completed the findings based on the initial submittal as follows: FINDINGS In considering all requests for Variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. This parcel could easily be developed with one single family dwelling at this time. • b. That the plight of the landowners is due to physical circumstances unique to his property not created by the landowner. The plight in this instance is the lack of enough upland to create two buildable lots, therefore the landowner is creating this situation by trying to divide a lot and create two lots that do not meet the minimum requirements of the zoning ordinance. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. This property could have a reasonable use of a building site for one single family dwelling. d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. This variance could easily set a precedent for future applicants to request reductions in upland area requirements. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the ordinance would clearly be violated by allowing a lot to be created with less buildable area than is required. Setbacks: The applicant is proposing to deviate from the 40 foot front setback required for principal buildings in the R -1 zone along collector or arterial roadways. Birch Street is a County State Aid Highway and therefore qualifies as an arterial roadway. They are proposing 25 foot front setbacks for both of the new dwellings. Section 3 of the zoning ordinance allows the following: • Front Setbacks. Where principal buildings on adjoining Tots existed at the time of adoption of this Ordinance have a lesser setback from that required, the required front yard setback of a new structure shall not be less than the average front yard of the adjacent buildings on each side lot for four hundred (400) feet and in no case shall be less than twenty (20) feet. The submitted plat depicts the setbacks for the adjacent properties at 13.1 feet (to the existing right of way line) and 28.1 feet. Staff's interpretation of this ordinance is that because these setbacks are side /corner setbacks rather than front yard setbacks; that this provision would not apply to these lots. The proposed reduction of 37% would result in single family dwellings being built a mere 25 feet from the property line. While at the current width, this would mean a separation from Birch Street of over 50 feet; when/if Anoka County expands Birch Street the separation would be reduced to as little as 35 feet, and the road could be developed as a four lane divided highway. Furthermore, this would require the realignment of the city trail provided within the right of way to be placed right on the property line a mere 25 feet from the dwelling. Another issue surrounding the reduction of front setbacks is the size of the building pads provided on the submitted plans. The pad for Lot 1 is 65 feet wide and 55 feet deep. The pad for Lot 2 is 65 feet wide and 49 feet deep. These pads seem rather excessive for single family dwellings, in particular on lots that do not meet upland area requirements. If these pads were reduced in depth, then the setback could be increased. Again, with the setback variance the state mandated findings must be made. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. This property would be able to be developed with one single family dwelling that would meet the 40 foot required setback. • d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. This variance could easily set a precedent for future applicants to request reductions in setbacks when lot depths are impacted by wetlands and when upland lot areas are minimized. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the ordinance would clearly be violated by allowing reduced setbacks along a major arterial roadway. Streets: Birch Street is an existing road and no additional roads are being proposed. The existing road system can accommodate the traffic generated by the new homes, and the right of way is already dedicated to the required width of 60 feet from center line. Birch Street is a County State Aid Highway and acts as a major east to west arterial for the entire city. As such, the number of accesses for private drives and city streets should be minimized. In this case the proposal would require adding two driveway accesses. The subdivision ordinance requires that the following alternatives be addressed (in order) to limit accesses on arterial roadways: • New commercial, industrial, and multiple family lots fronting on an arterial or major collector street shall be designed to minimize the number of direct access points through the following methods listed in preferential order. If the highest preference is not possible, the next preference shall be utilized until an access method is possible. a. Access from a local street. b. Frontage road serving multiple properties. c. Frontage driveway or connected parking lot with cross easements serving multiple properties. d. Shared driveways. e. One driveway access, no closer than two hundred (200) feet to another driveway and that meets the City's minimum spacing standards from a street intersection. All driveways shall be reviewed for consistency with the access management guidelines of the Lino Lakes Transportation Plan. Staff therefore would require that the drives be consolidated into a shared drive should this application be approved. This would require the city to approve a variance to the driveway setback, but staff would readily support that type of request to limit the number of accesses for the site. . Landscaping: When abutting an arterial, residential developments are required to provide a `buffer MI/yard'. The zoning ordinance has very specific standards for buffer yards. The applicant will need to submit a landscaping plan that clearly meets these requirements. Park Dedication: The current subdivision ordinance includes park dedication in the amount of $2075 per residential unit, less any land dedication. There is no land dedication needed, as Shenandoah Park is nearby. The park dedication will be $2,075 x 2 new home lots = $6,225. �tilities: Sanitary sewer and water is already in place in Birch Street. Both of the proposed lots must connect to utilities. Onsite septic systems must be abandoned according to law. In addition, any existing wells likely will have to be capped because of proximity to new sanitary sewer lines. The property to the east is connected to the sewer line near the northeast corner of the subject site. The utility plan needs to be revised to indicate the location of this connection to verify that it lies within drainage and utility easements and that it will not conflict with the infiltration area indicated on the submitted plans. These and other issues discussed in the City Engineer review memo must be addressed to his satisfaction. Grading & Drainage: The grading and drainage plans have been reviewed by the City Engineer and his comments will need to be addressed to his satisfaction prior to the site being developed. Specifically the engineer requested additional drainage information from the applicant to confirm that the drainage calculations where accurate. This information was received by the engineering department, but a review of that information could not be completed prior to this packet being distributed. Therefore that is an outstanding issue that prevents the city engineer from giving a recommendation at this time. The plan is also subject to review and approval from the Rice Creek Watershed District. Staff has received a copy of the CAPROC (Conditional Approval Pending Receipt Of Changes) from RCWD ENVIRONMENTAL BOARD The Environmental Board's did not review this application due to its relatively small scope. • R• ECOMMENDATION This item can not be acted upon due to the fact that a Public Hearing must be held. This hearing will be scheduled for the November 8, 2006 meeting. Because of the following issues, staff has not determined what recommendation will be made at that meeting: 1. Engineering comments must be satisfied. 2. Landscaping plan must be submitted depicting conformance with buffer yard requirements. 3. All plans must be revised to depict a shared driveway. 4. All plans must be revised to depict a 10 foot easement buffer surrounding all wetlands. 5. All plans must be revised to depict a reduced building pad allowing a greater front setback. In addition to those issues, the following conditions would be recommended for any approval action for this proposal: 1. Existing onsite septic systems will be appropriately abandoned. Ilk. Existing wells shall be capped when required by Minnesota Dept. of Health requirements. 3. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 4. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the site. 5. Park dedication must be paid in accordance with the city's fee schedule. 6. A permit from the Rice Creek Watershed District must be issued prior to final plat approval by the City. 7. Infiltration areas proposed on site should have the City native seed specification used. 8. A boulevard tree shall be provided for each lot frontage. 9. A 10 foot drainage and utility easement must be provided to buffer all delineated wetlands. 10. The drive accesses must be consolidated into a shared drive, with the approval of a variance to driveway setbacks. 11. Lakewood Apartments is a mixed use building consisting of first floor commercial with apartments also on a portion of the first floor, and the floors above. •Iartford Group Inc. has requested to make some changes to the Lakewood Apartments project to address some issues that have come up while creating construction documents for the project. They are proposing the following changes: • Alter the elevations by removing the balconies and `balconettes' in favor of slider windows. • Eliminate the 2 inch `reveal' trim required surrounding all windows. • Add a third color to the palette • A revised central element to address the condition of approval requiring such. They have submitted revised elevations, revised renderings of the elevation, and some documentation on the proposed removal of the 2 inch reveals for windows on the project. ANALYSIS Balconies: While staff is disappointed to lose the balcony elements which we had hoped would create visual interest and some opportunity to further portray activity. We recognize that these opportunities are probably equaled if not outweighed by the potential for negative impacts on the visual appearance of the building. The balconies would allow residents of the apartment building to store or display materials on the balconies that might detract from the overall aesthetic appearance being created within the Legacy at Woods Edge project area. Balconies are not required by the design standards so the removal of them could be approved without any need to revise the standards. • Lakewood Apartments, page 2 Oeveals/Recesses: The removal of the 2 inch reveals surrounding the windows has raised a greater concern about the unwillingness of contractors to warranty some of the elements involved in that type of construction and the possibility that it can not be accomplished when the hardi -board siding product is used. The current requirements of the standards are as follows: (There are two different citations -one for commercial and one for residential) Reveals. Windows and doors must be recessed at least two inches from walls or exterior trim to create shadow for visual interest. Recesses. Any decision to allow Hartford to not meet this requirement will more than likely trigger the need to revise this section of the design standards for the Legacy project. Color Palette: The third color being added to the palette does help to further accentuate the `bay' approach which is intended to create the look of multiple buildings built with zero lot lines. Staff supports the use of this third color. Central Element: The central element of the building has been differentiated from the other elements of the building and therefore staff feels this proposal meets the intent of the condition of approval recommended by staff and approved by the City Council. • ACTION Staff needs a recommendation from the board to forward to the City Council. Additionally, direction on whether the board would support amending the development standards is needed. Any amendment to the development standards will require a public hearing and will therefore need to follow on an upcoming agenda if that is the direction given by the board. ATTACHMENTS 1. Lakewoods Apartments Rendering, submitted October 5, 2006 • • CITY OF LINO LAKES RESOLUTION NO. 05 -161 RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT — FINAL PLAN FOR THE LAKEWOOD APARTMENTS WHEREAS, the City has received an application for a planned unit development — final plan approval for property currently described to -wit: Outlot A, THE VILLAGE NO. 3, Anoka County, Minnesota. ;and WHEREAS, the City has approved a final plat entitled THE VILLAGE NO. 4, which will create the parcel on which the Lakewood Apartments is proposed to be constructed. This parcel will be described as: Lot 1, Block 1, THE VILLAGE NO. 4 ; and WHEREAS, the planned unit development — final plan approval request is based on the following submittals: 1. Lakewood Apartments Plan Set received September 27, 2005. 2. Village No. 4 Final Plat received September 7, 2005 ; and WHEREAS, at their meeting on October 12, 2005, the Planning & Zoning Board recommended approval of the planned unit development — final plan subject to the conditions listed in the meeting minutes; and WHEREAS, the proposed planned unit development — final plan meets the requirements of the City's zoning ordinance, subdivision ordinance, and the Lino Lakes Town Center Design and Development Guide subject to certain conditions of approval. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the planned unit development — final plan for the Lakewood Apartments subject to the following conditions: 1. A site performance agreement between the city and the developer must be completed prior to the issuance of building permits. 2. Issues discussed in the S.E.H. engineering review memo must be addressed to the • satisfaction of city staff. 3. Operation and maintenance agreements for the site, including provisions for stormwater facilities, must be submitted for review by city staff prior to the issuance of building permits. • Speiser Acres Page 2 4. All parking lot lighting fixtures and poles shall be painted to complement the city's decorative street lighting; shall be mounted to round lighting poles measuring no more than twenty feet in height; shall be mounted to a concrete base no higher than twenty -four inches above the surrounding grade; and shall be located within landscape planter islands. 5. A revised lighting plan indicating the above required fixture changes, and the relocation of the luminaire near the north entrance drive further east to avoid a conflict with the garage opening must be submitted prior to the issuance of building permits for the site. 6. The final plat for the project (Village No. 4) must be approved prior to City Council approval of this building. 7. The developer must work with staff to identify the most appropriate location for bicycle parking within this block of the development. 8. A full recycling plan must be submitted for staff review prior to this item being heard by the City Council. • 9. A minimum 2 inch deep window trim must be provided in accordance with the development standards for the site. 10. The developer is required to add an additional architectural element to the central portion of the building to further strengthen the presence of the corner. 11. All units within the residential portion of the building are required to be supplied with uniform internal window treatments that will complement the architecture of the building. 12. The landscape plan shall be revised to indicate four shrubs per tree within the north planter island (adjacent to the Interstate 35W right -of -way). 13.
