City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. PUBLIC HEARING to consider Amending sections of Chapter 1010 of the City Code relating to the regulation of signs in election years Michael Hyden arrived at 6:36 p.m. City Planner, Jeff Smyser, presented the staff report. Staff recommended approval of the City Code Amendment. Staff addressed questions of the board. Board members suggested that the city consider limiting the size and material of noncommercial signage during non -state election years. It was suggested that staff refer to the existing city requirements for temporary signs. Vice -Chair Pogalz declared the Public Hearing open at 7:10 p.m. There was no one present to speak. Mr. Hyden made a MOTION to Close the Public Hearing at 7:10 p.m. Motion was supported by Mr. Nelson. Motion carried 5 - Mr. Laden made a MOTION to recommend approval of Amending sections of Chapter 1010 of the City Code relating to the regulation of signs in election years, to include a revision to the proposed text that would replace all of the existing paragraphs (13)(a) and (b) and read as follows: (13) Signs in Election Years: In state general election years, the provisions of Minnesota Statute 211B.045, as amended, shall apply. Notwithstanding other provisions of this chapter regulating the allowed size or number of signs, in city election years all temporary noncommercial signs of any size may be posted in any number without a permit from 46 days before the city election until ten days following the city election. Other requirements of this chapter, including those regarding the location of signs, shall continue to apply. Motion was supported by Mr. Evenson. Motion carried 4- 1. (Nelson voting nay.) VI. DISCUSSION ITEMS A. 2010 P &Z Board Action Summary Staff provided a summary of actions taken by the Planning & Zoning Board in 2010. • DRAFT MINUTES Planning & Zoning Board February 9, 2011 Page 3 • Staff agreed to email additional information to board members regarding the types of administrative permits that were issued in 2010. • B. 2011 P &Z Board Meeting Dates Staff provided a lsit of Planning & Zoning Board Meeting dates for 2011. Mr. Smyser noted that all meetings are scheduled to occur on the second Wednesday of each month, with no foreseen conflicts. VII. Respectfully submitted, Dawn Bugge Community Development Assistant Motion was supported DRAFT MINUTES • • AGENDA ITEM V A STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: March 9, 2011 TOPIC: PUBLIC HEARING: Conditional Use Permit Amendment Motor Fuel Station, 7997 Lake Drive BACKGROUND The site at the southwest corner of Lake Drive and Main Street had gas pumps for many years. The canopy, pumps, and underground storage tanks were removed in 2009 and the convenience store space has been vacant since then. The property owner wants to install a new canopy with gas pumps and fuel tanks. The location of the canopy and pumps on the site will differ from the previously approved layout. This requires amending the existing motor fuel station conditional use permit. An amendment to an existing conditional use permit requires the same process as a new one. The proposal includes a new canopy, fuel pumps, and underground storage tanks. This will require excavation and the repaving of the site, which will increase the amount of paved impervious area. The Lake Drive driveway will be moved south and align with the bank driveway on the other side of Lake Drive. There will be no changes to the existing building. ANALYSIS History The site has had motor fuel pumps for decades. A building permit for fuel pumps and storage tanks was issued in 1978. The 1971 zoning ordinance lists motor fuel station as a permitted. The 1982 zoning ordinance lists motor fuel station as a conditional use. Existing uses were considered to have a conditional use permit (CUP) that allowed them to continue as they were at the time. Structural alteration, enlargement, intensification of use required an amendment to the CUP. This was observed when an application in 1999 to increase the number of fuel pumps and enlarge the canopy was processed as an amendment to a CUP. (The application was withdrawn.) In fact, this same approach remains and is required by our current zoning ordinance. We are considering the current application as an amendment to a CUP. This application might have been considered a new CUP, since the pumps have been gone for a while. However, the process and review issues are similar, so the technical distinction is not a concern. Either way, we should establish and document what is acceptable for the motor fuel use on the site. This provides a good public record that benefits both the public and the property owner. The referendum passed and plans are being prepared. Based on preliminary analyses, this site won't be affected except that some additional right of way will be needed along Main Street — perhaps five feet. As proposed on the submitted plans, the canopy setback is 37' and will meet the required 30' setback even if the additional right of way is acquired. However, as discussed below, the canopy location as submitted creates internal circulation concerns and its location may need to be adjusted. The setback will need to be examined as part of the relocation analysis. Conditional Use Permit The new canopy, pumps, signage, site layout, and other elements are discussed below under the respective CUP conditions. There are general criteria for all CUPs and specific conditions that apply to motor fuel stations. General CUP Criteria: Section 2, Subd. 2.B.7. of the zoning ordinance lists the general criteria that apply to all CUPs. The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: Land Use Plan, Transportation Plan, Utility (Sewer and Water) Plans, Local Water Management Plan, Capital Improvement Plan, Policy Plan, Natural Environment Plan. • The site is guided and zoned for commercial uses. b. The proposed development application is compatible with present and future land uses of the area. • The site is guided and zoned for commercial uses, but we must be aware that it abuts a residential area on the west. The review for compliance with code requirements and compatibility with other land uses is underway but not completed as yet due to incomplete information. c. The proposed development application conforms to performance standards herein and other applicable City Codes. • The site is guided and zoned for commercial uses. Traffic generated by a proposed development application is within the capabilities of the City when (specific levels of service listed in the ordinance are met): • The site operated as a motor fuel station for several decades without traffic generation problems. The new pumps will not change traffic generation. The Lake Drive /Main Street intersection will be improved and the intersection will be signalized in year 2012. The proposed motor fuel use will not interfere with those plans. Access is always an important issue. The site's driveway on Lake Drive is being moved to the south. This benefits public safety by reducing conflicts with traffic from Main Street turning right onto Lake Drive. e. The proposed development shall be served with adequate and safe water supply. f. The proposed development shall be served with an adequate and safe sanitary sewer system. • The site is connected to municipal water and sanitary sewer. The septic tank and drainfield shown on the plans are not used. The tank was properly abandoned. g. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. • Improvements are planned for the Lake Drive /Main Street intersection following the November 2010 referendum to provide funding for the improvements. The proposed motor fuel use did not create the need for those improvements and will not interfere with those plans. h. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. • The site operated as a motor fuel station for several decades. Lighting and noise should be considered, including hours of operation. (See canopy discussions below.) 1. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. • No such features exist on or near the site. Motor Fuel CUP Conditions: Section 7, Subd. 3.H. of the zoning ordinance lists the conditional uses in the General Business zone. Specific conditions for a motor fuel station follow, along with discussion of how the project application compares to them 7. Motor fuel stations provided that: a. Motor Fuel Facilities. Motor fuel facilities shall be installed in accordance with State and City standards. Additionally, adequate space shall be provided to access fuel pumps and allow maneuverability around the pumps. Underground fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading operations which do not conflict with circulation, access and other activities on the site. Fuel pumps shall be installed on pump islands. • • • • • • The circulation of vehicles around the gas pumps is an issue. A previous sketch demonstrated conflict with the parking stalls on the front of the main building, and the layout in the submittal has not changed. An option may be shifting canopy and pumps slightly to the east to allow more room to exit the pump islands. Alternatively, the three pumps could be aligned in one line. It may be necessary to eliminate one set of pumps. The circulation on the submitted plan is problematic and should be redesigned. b. Architectural Standards. 1) As a part of the conditional use permit application, a color illustration of all building elevations shall be submitted. 2) The architectural appearance, scale, and functional plan of the building(s) and canopy shall be complementary and compatible with each other and the existing buildings in the neighborhood setting. 3) All sides of the principal and accessory structures are to have essentially the same or a coordinated harmonious finish treatment pursuant to Section 3, Subd. 4. B of this Ordinance. 4) Exterior wall treatments like brick, stone (natural or artificial), decorative concrete block and stucco shall be used. 5) Earth tone colors of exterior materials including the canopy columns shall be required. "Earth tone colors" shall be defined as any various soft colors like those found in nature in soil, vegetation, etc., such colors are limited to brown, black, gray, tan, beige, brick red, soft green, soft blue, or white. 6) Ten (10) percent of the building facade may contain contrasting colors. Contrasting colors shall be those colors not defined as earth tones. The canopy may have contrasting color bands or accent lines not to exceed an accumulative width of four (4) inches. The color bands shall not be illuminated. • Section 3, Subd. 4.B establishes architectural standards for commercial buildings, including building materials and colors. These are reiterated the motor fuel station requirements, though canopies are a little different. See the canopy discussion below. c. Canopy. A protective canopy structure may be located over the pump island(s), as an accessory structure. The canopy shall meet the following performance standards: 1) The edge of the canopy shall be thirty (30) feet or more from the front and /or side lot line, provided that adequate visibility both on -site and off -site is maintained. 2) The canopy shall not exceed eighteen (18) feet in height and must provide fourteen (14) feet of clearance to accommodate a semi - trailer truck passing underneath. 3) The canopy fascia shall not exceed three (3) feet in vertical height. • The application meets these requirements. 4) Canopy lighting shall consist of canister spotlights recessed into the canopy. No portion of the light source or fixture may extend below the ceiling of the canopy. Total canopy illumination may not exceed one hundred fifteen (115) foot candles below the canopy at ground level. • We did not receive cut sheets of the proposed canopy lighting as required for all site plans. This is an incomplete item. We need to ensure the fixtures are recessed. The submitted photometric plan shows that canopy illumination directly below the canopy meets the requirement. However, the photometric plan does not extend beyond the canopy. There are requirements for the property boundaries, and we cannot determine compliance with the information submitted. This is another incomplete item. Specific requirements are listed below in g., "exterior lighting ": illumination shall not exceed four - tenths (.4) foot candle at ground level when measured at any boundary line with an adjoining residential property or any public property. Because of the bright lighting below a canopy, the city should consider the impacts of operation and lighting of the site: is a 24 -hour site intended? 5) The architectural design, colors, and character of the canopy shall be consistent with the principal building on the site. • We received an elevation of a canopy. The canopy material is a brown metal. The principal building is brown masonry with a green metal Mansard roof. On recent motor fuel canopies that have been approved by the city, one was EFIS and one was metal. Both have brick around the supporting columns. Staff would recommend brick around the columns of this new proposal. The property owner has not determined what gas company will have the contract for the site, so the canopy design is not yet known. This makes it difficult to review the proposal and make recommendations. 6) Signage may be allowed on a detached canopy in lieu of wall signage on the principal structure, provided that: a) The individual canopy sign does not exceed more than twenty (20) percent of the canopy facade facing a public right -of -way. • There currently is no signage on the convenience store part of the building because the store space has been vacant. Canopy signage must be included in the total amount of wall signage allowed, which the canopy design and signage linked design elements. The sign ordinance requires a comprehensive sign plan whenever a single principal building has three or more businesses. Without an overall signage plan, we cannot determine compliance. This is an incomplete item. 7) Canopy posts /sign posts shall not obstruct traffic or the safe operation of the gas pumps. • The canopy posts are not problems, the canopy location overall is an issue. d. Pump Islands. Pump islands shall comply with the following performance standards: 1) Pump islands shall be elevated six (6) inches above the traveled surface of the site. 2) All pump islands shall be set at least thirty (30) feet back from any property line. Additionally, the setback between the pump islands curb face must be at least twenty -four (24) feet. • The pump islands are properly elevated and set back from property lines. However, the islands are barely 20 feet apart. This must be changed. A related question is the number of underground tanks. Typically, more than two • • • • • types of fuel are offered. The tanks may be internally designed to hold more than one type of fuel. If another tank is needed, it should be addressed now with the site design. e. Dust Control and Drainage. The entire site other than taken up by a building, structure, or plantings shall be surfaced with asphalt, concrete, cobblestone, or paving brick. Plans for surfacing and drainage shall be subject to approval of the City Engineer. Drainage from all fueling areas shall be directed to an oil /grit separator. Minimum design standards for the oil /grit separator shall include the following: 1) A minimum of four hundred (400) cubic feet of permanent pool storage capacity per acre of drainage area. 2) A minimum pool depth of four (4) feet. 3) A minimum oil containment capacity of eight hundred (800) gallons. 4) Minimum maintenance /inspection of two (2) times per year and /or after measurable spill events. A measurable spill shall be defined by the Minnesota Pollution Control Agency (MPCA). Any measurable spill event must be reported to the MPCA. • The submitted plans do not include an oil /grit separator. This is an incomplete item. The City Engineer has reviewed the submitted information, including stormwater management elements. (See attached memo.) Some data needs to be submitted or clarified, such as infoimation regarding a Rice Creek Watershed District review. • A related question is underground tanks. We assume they will be deep enough underground so as not to affect the infiltration pond design, but we need to ascertain this. f. Landscaping. 1) At least twenty -five (25) percent of the lot, parcel or tract of land used exclusively for the gas sales facility shall remain as a grass plot, including trees, shrubbery, plantings or fencing and shall be landscaped. Required minimum green area should be emphasized in the front and side yards abutting streets or residential property. 2) At the boundaries of the lot, the following landscape area shall be required: a) From side and rear property lines, an area of not less than ten (10) feet wide shall be landscaped in compliance with Section 3, Subd. 4.Q of this Ordinance. b) From all road rights -of -way, an area of not less than fifteen (15) feet wide shall be landscaped in compliance with Section 3, Subd. 4. Q of this Ordinance. c) Where lots abut residentially zoned property, a buffer yard of not less than twenty (20) feet wide shall be landscaped and screened in accordance with Section 3, Subd. 4. Q of this Ordinance. d) The property owner shall be responsible for maintenance of all landscaping, including within the boulevard. • The building has existed and functioned for several decades. However, additional landscaping is appropriate with a new application and a landscape plan has been submitted. The City Forester has reviewed the plan and made some suggestions. The landscaping should be re- examined in cooperation with the City Forester. There may be sight line issues for driveway locations, and native plantings are the typical requirement for stormwater facilities. g. Exterior Lighting. The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right - of -way and shall be in compliance with Section 3, Subd. 4.F of this Ordinance. A comprehensive lighting plan shall be submitted as part of the conditional use permit application, and shall be subject to the following performance standards: 1) Canopy Lighting. Canopy lighting shall only be permitted under the canopy structure, and shall consist of canister spotlights recessed into the canopy. No portion of the light source or fixture may extend below the ceiling of the canopy. Total canopy illumination below the canopy may not exceed one hundred fifteen (115) foot candles at ground level. 2) Perimeter Lighting. Lighting at the periphery of the site and building shall be directed downward, and individual lights shall not exceed fifteen (15) foot candles at ground level. 3) Illumination. Maximum site illumination shall not exceed four - tenths (.4) foot candle at ground level when measured at any boundary line with an adjoining residential property or any public property. • These items are discussed under the canopy section (c.4) above). 4) Access. Vehicular access points shall create a minimum of conflict with through traffic movement and shall comply with Section 3, Subd. 5 of this Ordinance. h. Circulation and Loading. The site design must accommodate adequate turning radius and vertical clearance for a semi - trailer truck. Designated loading areas must be exclusive of off - street parking stalls and drive aisles. A site plan must be provided to illustrate adequate turning radius, using appropriate engineering templates. • Truck circulation is vital to safe and efficient movement on the site. The truck turning radii were not submitted. This is an incomplete item. The turning radii for gas pump circulation should be examined as well, as discussed above under 7.a. i. Parking. 1) Parking spaces shall be calculated solely based upon the use(s) and the square footage of the principal building(s). • The zoning ordinance lists the minimum number of parking stalls for different uses. The ordinance does have a separate parking requirement for motor fuel stations but the convenience store must be calculated as retail, which is a higher requirement. Either way, "parking at fuel pumps shall not be allowed to satisfy the parking requirements." Q of this Ordinance. • The new landscaping provides screening of the northwest parking area. The southern area abuts commercial property. Noise. Public address system shall not be audible at any property line. Play of music or advertisement from the public address system is prohibited. Noise control shall be required as regulated in Section 3, Subd. 4.J of this Ordinance. • Because residential property abuts the site, this requirement is an important consideration, especially if 24 -hour operation is intended. k. Outside Storage, Sales and Service. No outside storage or sales shall be allowed, except as follows: 1) Public phones may be located on site as long as they do not interrupt on -site traffic circulation, and are not located in a yard abutting residentially zoned property. 2) Propane sales of twenty (20) pound capacity tanks may be located outside provided the propane tanks are secured in a locker and meets all State Uniform Building and Fire Codes. Large, bulk sale propane tanks must meet all applicable building and fire code requirements. 3) A compressed air service area may be located on site as long as it does not interrupt on -site traffic circulation. 4) Accessory outdoor services, sales, or rental as regulated by Section 7, Subd. 3. G. 6 of this Ordinance. • These are ongoing operation issues that will apply. 1. Litter Control. The operation shall be responsible for litter control on the subject property, which is to occur on a daily basis. Trash receptacles shall be provided at a convenient location on site to facilitate litter control. • These are ongoing operation issues that will apply. m. Additional Stipulations. All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation to a formal request finds that the general welfare and public betterment can be served as well or better by modifying or expanding the conditions set forth herein. Unresolved Issues Based on the analysis above, the following items should be resolved prior to a recommendation of approval by the P & Z Board: 1. Canopy location and site circulation for both customer vehicles and semi - trucks 2. Hours of operation: canopy lighting and public address system 3. Canopy lighting fixtures must be recessed 4. Illumination at property lines 5. Canopy design: materials 6. Site signage including canopy 7. Fuel pump island separation 8. Clarification of depth and number of underground tanks 9. Drainage design 10. Rice Creek Watershed District review status 11. Landscaping species 12. Public address system usage OPTIONS 1. Recommend approval of the amendment to the conditional use permit for a motor fuel station, with the conditions listed. 2. Continue the public hearing to the April meeting due to incomplete information. 3. Recommend denial of the application. RECOMMENDATION Option 2: continue the public hearing to April. Staff will work with the applicant to acquire needed information and complete the review. Minimum setback from the right of way lines for structures is 40 feet for both Lake Drive and Main Street. The proposed canopy encroaches into the 40 foot setback along Lake Drive and Main Street. 2. The new entrance radius to Lake Drive must be labeled. 3. Adequate gasoline spill prevention and isolation devices must be installed on site. 4. An Anoka County Right of Way Permit must be obtained and a copy of that permit must be submitted to the City prior to construction commencing. 5. Vehicle turning movements must be reviewed for final design. Grading, Drainage and Erosion Control Plan: 1. The pipe at the north entrance off Main Street has invert shots that indicate it to be a non- function pipe. Grading and drainage must be restored around this pipe or the pipe must be removed. 2. Rip Rap should be installed at all proposed downstream flared end sections to provide for erosion control. 3. The storage tanks for the gasoline are within the proposed infiltration pond area. The applicant must show the depth of the storage tanks and address and cover issues if they exist. The grading and drainage plan must address how drainage works with the existing storm sewer in the northwest and south east corner of the properties. StormWater Drainage Report: 1. On site soil types must be addressed and calculations shown to address the infiltration rate of the soils to ensure a functioning infiltration basin and correct infiltration basin sizing. 2. The pipe at the north entrance along Main Street should be included in drainage calculations. 3. Rainfall rates for the 2 -year storm should be approximately 2.8 inches over a 24 hour period. 4. Maximum allowable pipe flow is 3 feet per second this rate is exceeded during a 100 year storm event in the 18" pipe downstream of the infiltration basin. 5. Drainage easements must be placed over all storm sewer and infiltration basins. 6. Some drainage on the north side west of the entrance off Main Street appears to flow north to the pipe in the Main Street ditch. Existing drainage area 2 and proposed drainage area 3 should be reviewed and corrected if necessary. 7. Applicant should review the volume control requirements of the Rice Creek Watershed District Rule C for the infiltration basin design. 8. Applicant must obtain a Rice Creek Watershed District permit and submit to the City prior to construction. Landscape Plan: 1. One or two trees appear to be planted within the infiltration basin. An appropriate species for this location should be planted. • • • • • Environmental Memo To: Jeff Smyser From: Marty Asleson Date: March 1, 2011 Re: Gas Station Review /Main and Lake Drive The following preliminary thoughts and suggestions are listed here in a preliminary review of the proposed gas /convenience store on Lake and Main. It has not been determined yet if the RCWD rules will kick in at this point. If they do, storm water treatment will become more specific. Grading, Drainage and Erosion Control • Infiltration areas must be protected from compaction during construction. Creating a rain garden on the back side of the building would capture water off the rooftop. A treatment train might be established with this pond if stormwater from the north of Main street comes on to the property at the NW corner. Lighting Plan- • Lights must meet our code. Flush mounted, downward focused. Landscaping • Plant larger shade trees on alignment with streets. Plant alternating Hackberry/Northern Pin oak (or oak substitute). Screen on the NW corner • Page 1 looks good. Specs call for over seed and restore lawn as necessary in the infiltration basin area. The generally accepted landscape for infiltration areas is not lawn but the use of native plants. Native plants would mean any formal planting that includes all layers of native plant material. Traffic visibility should not be compromised in this design. All plants should be certified potted nursery stock. Plan must be approved by the City of Lino Lakes. A short term (3 years) and long term maintenance plan should be submitted to ensure plant establishment and function preservation.
