City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his /her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and /or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. Paul Bengtson, Associate Planner, presented the staff report. Staff recommended approval of the Zoning Ordinance Amendment with conditions as listed in the staff report. Staff addressed questions of the board, inc . i the reason for a 5- year "urrim use limit, which is to get a business established and e uire the to enclose their storage or move as the business grows. Staff noted that the fired setbacks and conditions are consistent with the Light Industrial ordinance chart at are being considered by the board later in the meeting. Vice Chair Hyden declared the Public Hearing open at 6:43- Attorney Bill Griffith, representing business owner Mark Dietz, addressed the board and noted that product manufacturing occurs inside and staging for delivery occurs outdoors. The company has 22 employees and saw 0 % growth in the past year They are asking for a 10 -year sunset. Mark !' .wner of Lakes Building Components, stated that they agree to the co 't unsure of the company's future growth, therefore requesting an extended term on the interim use time limit. ii Mt. John Freimuth, 7381 Jon enue, stated that he has complained to the city about the diesel forklift that starts as early as 6 a.m. He commented that the city should not be rewarding businesses not doing what they should have done in the first place. Mr. Root made a MOTION to recommend approval of the Interim Use Permit to allow accessory outdoor storage at 7301 Apollo Court based on the following conditions: 1. This interim use permit is effective for five (5) years from the date of approval by the City Council. It shall be reviewed at that time. The City Council can extend it at the Council's discretion. Without such extension the permit shall expire. 3. Prior to commencing construction activity authorized by this interim use permit, a permit or approval must be obtained from the Rice Creek Watershed District. Any conditions or requirements of the Watershed District approval are included by reference as conditions of this interim use permit. 4. Ms. Kendra Lindhal, city consultant from Landform, sai at staff changed an IUP to a CUP in the draft ordinance, recognizing that a business with outdoor storage was unlikely to go away. Staff noted that areas where outdoor storage was allowed did not include freeway frontage for aesthetic reasons, since 35W and 35E were considered gateways to the community. There is only minor distinction between LI and GI, with LI considered to be more professional, high tech, but the limited amount of GI allows somewhere in the city for heavy manufacturing. Motor fuel stations generally prefer high traffic areas. An industrial company is allowed to have a fuel on site to service trucks. PUBLIC HEARING to consider Amending Section 3 of the Zoning Ordinance regarding requirements for Screening, Landscaping and Buffer Yards Paul Bengtson presented the staff report. Staff recommended approval of the Zoning Ordinance Amendment. Board members raised questions about screening requirements and for ways to do tree sampling rather than require a complete survey. Staff answered that the screening requirements mimic current standards, and that more screening/buffer on collector streets at the time of subdivision development would be requiredfsaid the wording could be changed to arterial streets. Staff noted that tree surv�can be waived if considered unnecessary, and is only required in ar ff'' here work is occurring. Motion carried 4 - 0 submitted, Dawn Bugge Community De ment Assistant DRAFT MINUTES • • PLANNING AND ZONING BOARD AGENDA ITEM 6A STAFF ORIGINATOR: Paul Bengtson MEETING DATE: July 11, 2012 TOPIC: Conditional Use Permit Grading and Earth Removal — 6221 Holly Drive VOTE REQUIRED: Simple Majority INTRODUCTION Encompass Digital Media, operators of the satellite farm at 6221 Holly Drive are in the process of securing additional contracts that would necessitate expansion of the facility. While finalizing the details on the expansion plan, they have applied to remove a large portion of a berm on the south side of the site and do some preliminary grading work on the rest of the site. SCHEDULE OF ACTIONS: Planning & Zoning Board July 11, 2012 City Council First Reading (Public Hearing) July 23, 2012 Action Deadline September 1, 2012 (may be extended) BACKGROUND The amount of material proposed for removal from the site is approximately 20,000 cubic yards, with the material being hauled south from the site on Holly Drive and then the majority east on County Road J /Ash Street then out of the city. Less than ten percent of the material would be taken west on County Road J /Ash Street. The grading plan and site plan depict the site layout and the berm area that is proposed to be removed. The plans also depict erosion control measures and proposed grading at completion of the project. A conditional use permit may be issued if all the criteria have been met as defined in the resolution of this report. Section 3, Subdivision 11 of the zoning ordinance for Earth Moving and Land Reclamation provides a list of conditions as a prerequisite that the City may use for granting a permit. Those conditions that the City may deem necessary are as follows: 1. Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. The site is fenced and occupied by the facilities' staff. 2. Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. • There will be no pits and excavation shall be staged to prevent large banks. 3. Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may detelliiine Again, no open pits are proposed for this project /site. 4. Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. There is not excavation below the surrounding grade, and the potential development of the site will not be diminished. 5. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood. and other debris shall be prohibited. All fill used on the site will be inspected to determine that it meets city standards. 6. Require that all decomposable material, or other unsuitable foundation material, be removed from an area before deposition of fill begins. All construction will be done on suitable fill materials. 7. Prepare a site plan showing existing and proposed grade elevations and effect of stoini water drainage on adjacent areas. The submitted plans show the existing and proposed grade elevations as well as drainage directions. 8. Specify a time when the excavation or land reclamation project shall be completed. The project is proposed to be completed within a 3 week period (weather permitting) after approval by the City Council. 9. Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's storm water management and pollution prevention plan. This will be a condition of approval for the request. 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. A Site Performance Agreement shall be required to outline financial securities and an appropriate escrow deposit to cover inspections. • • • • • 11. Implement the tree preservation plan. There is no tree preservation plan for the site as there are not significant trees within the grading area. 12. In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty -five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. The proposed removal will not exceed 25,000 cubic yards and therefore a neighborhood meeting is unnecessary. 13. Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. A Site Performance Agreement shall be required to outline financial securities and an appropriate escrow deposit to cover inspections. 14. Other conditions deemed appropriate to the application by the permitting authority. Any other conditions appropriate for this request will be added to the approval of the conditional use permit. The City has sent a public hearing notice to surrounding home owners to inform them of the proposed Conditional Use Permit, but due to the timelines the applicant is facing, the public hearing will need to be held at the City Council on July 23, 2012. The mailed notice indicated both the City Council and Planning and Zoning Board meetings so that neighbors may attend either or both. Staff recommends that the Planning and Zoning Board allow public comment even without the official public hearing. RECOMMENDATION Staff is recommending approval of the conditional use permit for grading and earth removal with the conditions included in the City Engineer's memorandum. ATTACHMENTS 1. Wedel, City Engineer MEETING DATE: July 11, 2012 TOPIC: Conditional Use Permit Grading and Earth Removal - 6221 Holly Drive VOTE REQUIRED: Simple Majority BACKGROUND Encompass Digital Media is applying for a Conditional Use Permit for earth material excavation on the southern portion of their property located west of Holly Drive and north of County Road J. The amount of material proposed for excavation from the site is approximately 20,000 cubic yards, with all of the excavated material being hauled off to a variety of locations outside of the City limits. A grading plan prepared by ICECOR dated June 28, 2012, identifies the site layout, proposed excavation area, silt fence locations, and existing wetlands has been provided for staff review. SITE PLAN Buildings: A 40' x 50' building, 14 satellite dishes of various size, and several out buildings /sheds exist on the site. The buildings and satellite dishes will not be affected by the site excavation. Traffic: The applicant estimates that it will take approximately 1,200 truck trips to remove the excavated material from their property. The proposed haul route for the excavated materials from the Encompass excavation site is south on Holly Drive and either east or west on County Road J. Per the applicant, the vast majority of the truck trips will go east on County Road J to 35E; however, there will be approximately 20 trips that will travel west on County Road J Grading/Drainage: A grading plan for the earth materials excavation site was provided by the applicant's engineer. The plan identifies the existing and proposed contours for the site, proposed drainage patterns, and locations for silt fence and hay bale check dams for erosion control purposes. The City will conduct regular inspections of the site to ensure that all NPDES General Permit requirements are being met. Encompass Digital Media (6221 Holly Drive) Page 2 of 3 The wetlands on the site have been delineated and are shown on the grading plan submitted by the applicant. Wetlands will not be affected by the excavation or grading. The grading plan and conditional use permit has been submitted to the Rice Creek Watershed District (RCWD) for their review and approval. RECOMMENDATIONS /CONDITIONS OF APPROVAL: 1. The site grading plan must be signed by a licensed Civil Engineer within the state of Minnesota. 2. All material hauling activity will be restricted to south on Holly Drive and either east or west on County Road J. Truck traffic may not travel north Holly Drive. 3. The applicant will be responsible for submitting to the City a fee of $15,000 for the future replacement of Holly Drive. 4. A rock construction entrance shall be maintained at all times. 5. Street sweeping on Holly Drive shall occur as necessary. 6. All construction activity shall be limited to the hours set as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m. Sunday and Holidays No working hours allowed 7. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the conditions of approval are being met. 8. Staff had brought a previous version of the Business Districts to the Planning and Zoning Board but after consulting with the City Attorney felt that additional revisions were necessary. SCHEDULE OF ACTIONS: Planning & Zoning Board (Public Hearing) City Council Work Session City Council First Reading City Council Second Reading Action Deadline July 11, 2012 August 8, 2012 August 13, 2012 August 27, 2012 Staff initiated, no deadlines BACKGROUND Staff is proposing two major changes to what the Board saw previously. First, because of the similarities between Neighborhood Business and Limited Business and the fact that only a handful of properties in the city are zoned either designation, staff proposes to eliminate the Neighborhood Business District. This would also mean rezoning all NB properties to LB. Secondly, staff is proposing to deal with the existing commercial/industrial properties at the Orange Street/Lake Drive intersection via interim use permits within the LB district, instead of creating a new zoning district. LB is the most appropriate zoning district for an area that is in such close proximity to surrounding single family dwellings, and staff proposes to allow via interim use permits any use on these sites that are allowed in the GB zoning district. Extension of utilities to the area will be the event that causes the end of the interim use. RECOMMENDATION Staff is recommending approval of the proposed language. ATTACHMENTS • 1. The stacking lane and its access must be designed to control traffic in a manner to protect the buildings and will not interfere with on- site traffic circulation or access to the required parking space. c. No part of the public street or boulevard may be used for stacking of automobiles. d. The stacking lane, order board intercom, and window placement shall be designed and located in such a manner as to minimize glare to adjacent premises, particularly residential premises, and to maximize maneuverability of vehicles on the site. e. The drive - through window and its stacking lanes shall be screened from view of adjoining residential zoning districts and public street rights -of -way. f A lighting and photometric plan will be required that illustrates the drive- through service lane lighting and shall comply with Section 3, Subd. 4.F of this Ordinance. 2. Motor fuel stations provided that: a. Motor Fuel Facilities. 1) Motor fuel facilities shall be installed in accordance with State and City standards. Additionally, adequate space shall around the pumps. 2) Underground fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading operations which do not conflict with circulation, access and other activities on the site. 3) Fuel pumps shall be installed on pump islands. Pump islands shall be elevated six (6) inches above the traveled surface of the site b. Minimum design standards for the oil /grit separator shall include the following: 1) A minimum of four hundred (400) cubic feet of permanent pool storage capacity per acre of drainage area. 2) A minimum pool depth of four (4) feet. Large, bulk sale propane tanks must meet all applicable building and fire code requirements. 3) A compressed air service area may be located on site as long as it does not interrupt on -site traffic circulation. 4) Accessory outdoor services, sales, or rental as regulated by Section 7, Subd. 2.G.5 of this Ordinance. Ij. Litter Control. The operation shall be responsible for litter control on the subject property, which is to occur on a daily basis. Trash receptacles shall be provided at a convenient location on site to facilitate litter control. n k. Not Tess than one hundred twenty (120) feet of segregated automobile stacking must be provided for the single service lane. The drive - through window and its stacking lanes shall be screened from view of adjoining residential zoning districts and public street rights -of -way. f A lighting and photometric plan will be required that illustrates the drive - through service lane lighting and shall comply with Section 3, Subd. 4.F of this Ordinance. 3. Fences, as regulated by Section 3, Subd. 4.R of this Ordinance. 4. Off - street loading as regulated by Section 3, Subd. 6 of this Ordinance. 5. Off - street parking as regulated by Section 3, Subd. 5 of this Ordinance. The entire area other than occupied by buildings or structures or planting shall be surfaced with bituminous or concrete which will control dust and drainage. The entire area shall have a perimeter curb barrier, a storm water drainage system and is subject to the approval of the City Engineer. c. All buildings shall provide an interior location for trash handling or an enclosed trash receptacle area in conformance with the following: 1) Exterior wall treatment shall be similar and /or complement the principal building. 2) The enclosed trash receptacle area shall be located in the rear or in a side yard which is not abutting a street. 3) The trash enclosure must be in an accessible location for pick up hauling vehicles. 4) The trash enclosure must be fully screened from view of adjacent properties. All painting must be conducted in an approved paint booth. Al! paint booths and all other activities of the operation shall thoroughly control the emission of fumes, dust or other particulated matter so that the use shall be in compliance with the State of Minnesota Pollution Control Standards, Minnesota Regulation APC 1 -15, as amended. e. The emission of odor by a use shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota regulations APC, as amended. f. All flammable materials, including liquids and rags, shall conform with the applicable provisions of the Minnesota Uniform Fire Code. Lino Lakes Zoning Ordinance Amended per Ord. Bus garage provided that: a. When abutting a residential use or residential district, the property shall be screened and landscaped in accordance with Section 3, Subd. 4.Q of this Ordinance. b. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. c. The entire area other than occupied by the building or planting shall be surfaced with blacktop or concrete which will control dust and drainage which is subject to the approval of the City Engineer. d. The entire area shall have a drainage system which is subject to the approval of the City Engineer. e. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. f Provisions are made to control and reduce noise. g. An internal site pedestrian circulation system shall be defined and appropriate provisions made to protect such areas from encroachments by parked cars or moving vehicles. h. Motor fuel activities associated with the bus service shall be installed in accordance with State and City standards. Additionally, adequate space shall be provided to access gas pumps and allow maneuverability around the pumps. Underground fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading operations do not conflict with circulation, access and other activities on the site. Commercial car washes (drive - through, mechanical and self - service) provided that: a. The site is serviced by municipal sanitary sewer. b. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. c. Magazining or stacking space is constructed to accommodate that number of vehicles which can be washed during a maximum thirty (30) minute period and shall be subject to the approval of the City Engineer. d. At the boundaries of a residential district, a strip of not Tess than five (5) feet shall be landscaped and screened in compliance with Section 3, Subd. 4.Q of this Ordinance. e. Parking or car magazine storage space shall be screened from view of abutting residential districts in compliance with Section 3, Subd. 4.Q of this Ordinance. f. The entire area other than occupied by the building or plantings shall be surfaced with material which will control dust and drainage which is subject to the approval of the City Engineer. 9. The entire area shall have a drainage system which is subject to the approval of the City. h. All lighting shall be hooded and so directed that the light source is not visible from the public right -of -way or from an abutting residence and shall be in compliance with Section 3, Subd. 4.F of this Ordinance. J. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. Provisions are made to control and reduce noise. 4. Commercial day care facilities provided that: Lino Lakes Zoning Ordinance Amended per Ord. All requirements of the Minnesota Department of Health and Human Services, as may be amended, are satisfactorily met and the structure and operation is licensed accordingly. b. Screening is provided along all shared property lines. Such required fencing and screening shall be in compliance with the applicable provisions of Section 3, Subd. 4.SQ. of this Ordinance. c. Adequate off - street parking is provided in a location separated from any outdoor play area(s). d. Adequate off - street loading spaces in compliance with Section 3, Subd. 6 of this Ordinance. 5. Contractor shops and offices provided that: a. All outside storage is prohibited. The storage of contractor equipment and materials must be completely inside. b. When abutting a residential land use, a buffer area with screening and landscaping in compliance with Section 3, Subd. 4.Q of this Ordinance is provided. 6. Hospitals provided that: a. Side yards are double the minimum requirements established for this district and are screened in compliance with Section 3, Subd. 4.Q of this Ordinance. b. The site shall be served by an arterial or collector street of sufficient capacity to accommodate traffic which will be generated. c. All State Statutes and regulations governing such use are strictly adhered to and all required operating permits are secured. d. Adequate off- street loading space is provided in compliance with Section 3, Subd. 6 of this Ordinance. 7 Motor fuel stations provided that: a. Motor Fuel Facilities. 1) Motor fuel facilities shall be installed in accordance with State and City standards. Lino Lakes Zoning Ordinance Amended per Ord. Pump islands shall be elevated six (6) inches above the traveled surface of the site. b. Architectural Standards. 1) As a part of the conditional use permit application, a color illustration of all building elevations shall be submitted. 2) The architectural appearance, scale, and functional plan of the building(s) and canopy shall be complementary and compatible with each other and the existing buildings in the neighborhood setting. 3) All sides of the principal and accessory structures are to have essentially the same or a coordinated harmonious finish treatment pursuant to Section 3, Subd. 4.B of this Ordinance. 4) The canopy may have contrasting color bands or accent lines not to exceed an accumulative width of four (4) inches. The color bands shall not be illuminated. 5) Canopy. A protective canopy structure may be located over the pump island(s), as an accessory structure. a) The edge of the canopy shall comply with district setbacks and adequate visibility both on -site and off - site shall be maintained. b) The canopy shall not exceed eighteen (18) feet in height and must provide fourteen (14) feet of clearance to accommodate a semi - trailer truck passing underneath. c) The canopy fascia shall not exceed three (3) feet in vertical height. No. 21 -03, 04 -05, 09 -06, 11 -08, 04 -09, 01 -10, 04 -10, 02 -11 & 03 -11 7 -27 Business Districts d) The architectural design, colors, and character of the canopy shall be consistent with the principal building on the site. e) Signage is allowed on a detached canopy fascia in lieu of wall signage on the principal structure, provided that the individual canopy sign does not exceed more than twenty (20) percent of the canopy fascia facing a public right -of -way. f) Canopy columns and signs shall not obstruct traffic or the safe operation of the gas pumps. q) Canopy column exteriors shall consist of one or more of the following materials for at least one -half of the height of the column: brick, stone (natural or artificial), decorative concrete block, EFIS, stucco. Similar materials may be allowed at the City's discretion. c. Dust Control and Drainage. The entire site other than taken up by a building, structure, or plantings shall be surfaced with asphalt, concrete, cobblestone, or paving brick. Plans for surfacing and drainage shall be subject to approval of the City Engineer. Drainage from all fueling areas shall be directed to an oil /grit separator. Minimum design standards for the oil /grit separator shall include the following: 1) A minimum of four hundred (400) cubic feet of permanent pool storage capacity per acre of drainage area. 2) A minimum pool depth of four (4) feet. 3) A minimum oil containment capacity of eight hundred (800) gallons. 4) Minimum maintenance /inspection of two (2) times per year and /or after measurable spill events. A measurable spill shall be defined by the Minnesota Pollution Control Agency (MPCA). Any measurable spill event must be reported to the MPCA. d. Landscaping. Lino Lakes Zoning Ordinance Amended per Ord. No. 21 -03, 04 -05, 09 -06, 11 -08, 04 -09, 01 -10, 04 -10, 02 -11 & 03 -11 7 -28 Business Districts • • • 1) From side and rear property lines, an area of not less than ten (10) feet wide shall be landscaped in compliance with Section 3, Subdivision 4.Qof this Ordinance. 2) From all road rights -of -way, an area of not less than fifteen (15) feet wide shall be landscaped in compliance with Section 3. Subdivision 4.0 of this Ordinance. 3) Where lots abut a property guided by the comprehensive plan for residential development. a buffer yard of not Tess than twenty (20) feet wide shall be landscaped and screened in accordance with Section 3. Subdivison 4.0 of this Ordinance. 4) The property owner shall be responsible for maintenance of all landscaping, including within the boulevard. e. Exterior Lighting. The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right -of -way and shall be in compliance with Section 3, Subd. 4.F of this Ordinance. A comprehensive lighting plan shall be submitted as part of the conditional use permit application, and shall be subject to the following performance standards: 1) Canopy Lighting. a) Canopy lighting under the canopy structure shall consist of canister lights recessed into the canopy. No portion of the light source or fixture may extend below the ceiling of the canopy. Total canopy illumination below the canopy may not exceed one hundred fifteen (115) foot candles at ground level. b) The canopy fascia shall not be illuminated on any side that faces abutting land zoned residential or guided residential by the comprehensive plan but this does not include residential land across a street. 2) Perimeter Lighting. Lighting at the periphery of the site and building shall be directed downward, and individual fights shall not exceed fifteen (15) foot candles at ground level. 3) Illumination. Maximum site illumination shall not exceed four - tenths (0.4) foot candle at ground level when measured Lino Lakes Zoning Ordinance Amended per Ord. Circulation and Loading. The site design must accommodate adequate turning radius and vertical clearance for a semi - trailer truck. Designated loading areas must be exclusive of off - street parking stalls and drive aisles. A site plan must be provided to illustrate adequate turning radius, using appropriate engineering templates. 1) Vehicular access points shall create a minimum of conflict with through traffic movement and shall comply with Section 3, Subd. 5 of this Ordinance. 2) All fuel pump islands shall comply with property line setbacks. 3) Adequate space shall be provided to access fuel pumps and allow maneuverability around the pumps. The separation between pump island curb faces shall be at least twenty -four (24) feet. Pump island curb faces and parking stalls also shall be separated by at least twenty -four (24) feet. Parking. 1) Parking spaces shall be calculated solely based upon the use(s) and the square footage of the principal building(s). 2) Parking spaces shall be screened from abutting residential properties in compliance with Section 3, Subd. 4.S of this Ordinance. h. Noise. Public address system shall not be audible at any property line. Noise control shall be required as regulated in Section 3, Subd. 4.J of this Ordinance. Outside Storage, Sales and Service. No outside storage or sales shall be allowed, except as follows: 1) Public phones may be located on site as long as they do not interrupt on -site traffic circulation, and are not located in a yard abutting residentially zoned property. 2) Propane sales of twenty (20) pound capacity tanks may be located outside provided the propane tanks are secured in a Lino Lakes Zoning Ordinance Amended per Ord. Litter Control. The operation shall be responsible for litter control on the subject property, which is to occur on a daily basis. Trash receptacles shall be provided at a convenient location on site to facilitate litter control. k. Additional Stipulations may be added to address issues particular to the site in order to protect public health, safety, and welfare. All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation to a formal request finds that the general welfare and public betterment can be served as well or better by modifying or expanding the conditions set forth herein. a. The facilities shall maintain a fifty (50) foot setback from residential districts. d. The facilities shall be screened from adjoining properties or public rights -of -way. e. The City may set limits on the hours of operation to avoid nuisance issues. 9. Motor Vehicle Sales Lot provided that: a. Outside sales areas are fenced or screened from view of neighboring residential uses or an abutting residential district in compliance with Section 3, Subd. 4.Q of this Ordinance. b. For automobile sales activities, a minimum of three hundred eighty (380) square feet of sales area per vehicle is provided exclusive of required parking areas. Minimum sales area for all other motor vehicles will be determined by the City Council during the review of the conditional use permit. f. A perimeter curb is provided around the sales /parking lot. g. All lighting shall be hooded and so directed that the light source is not visible from the public right -of -way or from an abutting residence and shall be in compliance with Section 3, Subd. 4.F of this Ordinance. h. Vehicles for sale shall be displayed in an orderly manner. 10. Planned unit development — commercial including shopping centers regulated by Section 2, Subd. 10 of this Ordinance. • 11. Private lodges and clubs provided that: a. Screening from residential uses and landscaping is provided in compliance with requirements for business or industrial uses in Section 3, Subd. 4.Q of this Ordinance b. The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right -of -way and shall be in compliance with Section 3, Subd. 4.F of this Ordinance. b. At the boundaries of a residential district, a strip of not less than five (5) feet shall be landscaped and screened in compliance with Section 3, Subd. 4.Q of this Ordinance. c. Vehicular access points shall create a minimum of conflict with through traffic movement and shall comply with Section 3, Subd. 5. of this Ordinance and shall be subject to the approval of the City Engineer. d. Provisions are made to control and reduce noise. e. No outside storage, repair or sales except in compliance with Section 7, Subd. 3.G.6 or Scction 7, Subd. 3.H.9 of this Ordinance shall be allowed. f. Veterinary Hospitals provided that: a. All areas in which animals are confined are located indoors and are properly soundproofed from adjacent properties. b. Animal carcasses are properly disposed of in a manner not utilizing on -site garbage facilities or incineration and the carcasses are properly refrigerated during periods prior to disposal. c. An indoor animal kennel is permitted as a use accessory to the veterinary hospital provided that: 1) The number of animals boarded shall not exceed twenty (20). 2) An indoor exercise area shall be provided to accommodate the periodic exercising of animals boarded at the kennel. No outdoor exercising of animals shall be permitted. 3) A ventilation system shall be designed so that no odors or organisms will spread between wards or to the outside air and will be capable of completely exchanging internal air at a rate of at least twice per hour. Air temperature must be maintained between 60 and 75 degrees Fahrenheit. 4) A room separate from the kennel area shall be provided of sufficient size to adequately separate animals that are sick or injured from healthy animals. 5) indoor animal kennel floors and walls shall be made of non- porous materials or sealed concrete to make it non - porous. 6) Animal wastes shall be flushed down an existing sanitary sewer system or enclosed in a container of sufficient construction to eliminate odors and organisms and shall be properly disposed of at least once a day. d. The appropriate license is obtained from the City and the conditions of Chapter 503 relating to the keeping of animals are satisfactorily met. Lino Lakes Zoning Ordinance Amended per Ord. Subject to applicable provisions of this Ordinance, the following uses are allowed by administrative permit, as may be approved by the Zoning Administrator: 1. Personal wireless service antennas as secondary uses as regulated by Section 3, Subd. 14 of this Ordinance. 2. Home Occupation Level B as regulated by Section 3, Subdivision 8 of this Ordinance. Accessory outdoor dining or seating facilities intended for consumption of food or beverages purchased on site, provided that requirements of Section 3, Subd. 16 are met. This administrative permit may be incorporated into another approval such as but not limited to a site plan, planned unit development, or building permit. 4. Open Air Markets. 5. Transient Merchants. J. Interim Uses. Subject to applicable provisions of this Ordinance, the following are interim uses in the GB District and are governed by Section 2, Subd. 3. of this Ordinance: 1. None.
