MEETING GUIDELINES
Open Mike — The purpose of a Board Meeting is to accomplish the business of the city.
When presenting at a meeting please remember to be respectful, and follow these
guidelines:
• Please address the meeting chair.
• State your name and address for the record.
• Please observe a 4- minute limit.
• The topic must relate to city business.
• Open Mike is for items not on the agenda.
• A spokesperson must represent a group of five or more — groups will have 8 minutes.
• The Presiding Officer may limit duplicative presentations.
• Remember, the meeting is to discuss city business only.
Public Hearing - Held as a separate item of business on the agenda. The public hearing
segment is your opportunity to tell the Board how you feel about issues scheduled to be
heard. Typically, a hearing follows these steps:
• The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and
ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all
meetings.
• Staff will present their report on the proposal.
• Board members will then ask City Staff questions about the proposal.
• The Presiding Officer will then open up the public hearing for anyone present who wishes to
comment on the proposal. This is the time for the public to make comments or ask questions
about the proposal.
Comments should be limited to four (4) minutes unless further time is granted by the
Presiding Officer. All comments should be directed to the Board as a body and not to any
individual Board Member or City Staff Member unless permission is granted by the Presiding
Officer. No person shall be permitted to enter into any discussion, either directly or through a
member of the Board without the permission of the Presiding Officer.
• After everyone in the audience wishing to speak has given his /her comments, the Presiding
Officer shall close the public hearing.
• The Board will then discuss the proposal. No further public comments are allowed.
• The Board will then make a recommendation(s) and /or a decision.
When you are called upon for your comments, please step to the microphone at the
podium and state your name and address for the record.
Occasionally, the Board may continue a hearing to another meeting before taking action.
Meeting Etiquette
The Planning & Zoning Board must preserve order and decorum while the meeting
is in session. A resident shall not, by conversation or otherwise, delay or interrupt
the proceedings or the business of the Board, nor disturb any resident or Board
Member while speaking or refuse to obey the orders of the Board.

There was no one present for Open Mike.
Mr. Hyden made a MOTION to close Open Mike at 6:36 p.m. Motion was supported by
Mr. Evenson. Motion carried 6 -0.
VI. ACTION ITEMS
A. Conditional Use Permit to allow for grading and earth removal at 6221 Holly
Drive
Paul Bengtson, Associate Planner, presented the staff report. Staff recommended
approval of the Conditional Use Permit with conditions as listed in the staff report.
Staff addressed questions of the board.
Board members discussed details of the earth moving project including times, trips and
duration of project. It was encouraged that the applicant should hold a neighborhood
meeting with the residents of Trapper's Crossing.
Applicant, John Palmer, Encompass Digital Media, 6221 Holly Drive, was present for
questions.
Resident Mark Payette, 6266 Holly Drive, commented that the satellite farm has been a
good neighbor. He added that the neighboring property owners appreciated receiving a
mailed letter from the applicantwith details of the proposed project.
Mr. Hyden made a MOTION to recommend approval of the Conditional Use Permit to
allow for grading and earth removal at 6221 Holly Drive, including an amendment to add
Condition 13, placing signs to designate truck hauling to the north and south.
Motion was supported by Mr. Masonick. Motion carried 6 - 0.
B. PUBLIC HEARING to consider Amending Section 7 of the Zoning Ordinance
which includes requirements for Business Districts
Paul Bengtson presented the staff report. Staff recommended opening and tabling the
public hearing to discuss at a future date.

INTRODUCTION
As part of the 2030 Comprehensive Plan update process, staff was directed by the City Council
to review the Business Zoning Districts to determine if they were compatible with the
comprehensive plan and if they allowed development in line with the vision, goals, and policies
of the city. Staff had brought a previous version of the Business Districts to the Planning and
Zoning Board but after consulting with the City Attorney felt that additional revisions were
necessary.

BACKGROUND
Staff is proposing two major changes to what the Board-saw previously. First, because of the
similarities between Neighborhood Business and Limited Business and the fact that only a
handful of properties in the city are zoned either designation, staff proposes to eliminate the
Neighborhood Business District. This would also mean rezoning all NB properties to LB.
Secondly, staff is proposing to deal with the existing commercial /industrial properties at the
Orange Street/Lake Drive intersection via interim use permits within the LB district, instead of
creating a new zoning district. LB is the most appropriate zoning district for an area that is in
such close proximity to surrounding single family dwellings, and staff proposes to allow via
interim use permits any use on these sites that are allowed in the GB zoning district. Extension
of utilities to the area will be the event that causes the end of the interim use.

At the July 11, 2012 meeting the Board requested additional information, specifically more
information on the properties in the city that are currently zoned NB and LB and also a
comparison of the uses that are allowed in the three current zoning districts and how NB and LB
differ. Staff has compiled a zoning map and two tables with data on the uses and the existing
properties in the city. They are attached to this report.
The differences between NB and LB are very minor as to the uses allowed in each, the main
difference being how drive - throughs and gas stations are treated.
RECOMMENDATION
Staff is seeking input from the Board prior to making any notices in regards to rezoning that are
necessary to complete this amendment.

A. Purpose. The LB, Limited Business District, is to provide for the establishment

meters or less in diameter, short-wave dispatching antennas, or those
necessary for the operation of electronic equipment including radio
receivers, ham radio transmitters and television receivers as regulated by
Section 3, Subd. 14 of this Ordinance.

H. Conditional Uses. Subject to applicable provisions of this Ordinance, the
following are conditional uses in the LB District: These uses require a conditional
use permit based on the criteria and procedures outlined in Section 2, Subd. 2. of
this Ordinance.
1. Accessory drive - through facilities provided that:
a. Not less than one hundred twenty (120) feet of segregated
automobile stacking must be provided for the single service lane.
Where multiple service lanes are provided, the minimum automobile
stacking may be reduced to sixty (60) feet per lane.
The stacking lane and its access must be designed to control traffic
in a manner to protect the buildings and will not interfere with on-
site traffic circulation or access to the required parking space.
c. No part of the public street or boulevard may be used for stacking of
automobiles.
d. The stacking lane, order board intercom, and window placement
shall be designed and located in such a manner as to minimize

drive - through service lane lighting and shall comply with Section 3,
Subd. 4.F of this Ordinance.

c. Adequate off - street parking is provided in a location separated from
any outdoor play area(s).
d. Adequate off - street loading spaces in compliance with Section 3,
Subd. 6 of this Ordinance.
3. Motor fuel stations provided that:
a. Motor Fuel Facilities.
1) Motor fuel facilities shall be installed in accordance with
State and City standards. Additionally, adequate space shall
be provided to access fuel pumps and allow maneuverability
around the pumps.
2) Underground fuel storage tanks are to be positioned to allow
adequate access by motor fuel transports and unloading
operations which do not conflict with circulation, access and
other activities on the site.
3) Fuel pumps shall be installed on pump islands. Pump
islands shall be elevated six (6) inches above the traveled
surface of the site
b. Architectural Standards.
1) As a part of the conditional use permit application, a color
illustration of all building elevations shall be submitted.
2) The architectural appearance, scale, and functional plan of
the building(s) and canopy shall be complementary and
compatible with each other and the existing buildings in the
neighborhood setting.
3) All sides of the principal and accessory structures are to
have essentially the same or a coordinated harmonious

residential use or from the public right -of -way and shall be in
compliance with Section 3, Subd. 4.F of this Ordinance. A
comprehensive lighting plan shall be submitted as part of the
conditional use permit application, and shall be subject to the

b) The canopy fascia shall not be illuminated on any side
that faces abutting land zoned residential or guided
residential by the comprehensive plan but this does
not include residential and across a street.
2) Perimeter Lighting. Lighting at the periphery of the site and
building shall be directed downward, and individual lights
shall not exceed fifteen (15) foot candles at ground level.
3) Illumination. Maximum site illumination shall not exceed
four - tenths (0.4) foot candle at ground level when measured
at any boundary line with an adjoining residential (zoned or
guided) property or any public property.

adequate turning radius and vertical clearance for a semi - trailer
truck. Designated loading areas must be exclusive of off- street

1) Vehicular access points shall create a minimum of conflict
with through traffic movement and shall comply with Section
3, Subd. 5 of this Ordinance.

Noise. Public address system shall not be audible at any property
line. Play of music or advertisement from the public address
system is prohibited. Noise control shall be required as regulated in

ki. Outside Storage, Sales and Service. No outside storage or sales
shall be allowed, except as follows:
1) Public phones may be located on site as long as they do not
interrupt on -site traffic circulation, and are not located in a
yard abutting residentially zoned property.
2) Propane sales of twenty (20) pound capacity tanks may be
located outside provided the propane tanks are secured in a
locker and meets all State Uniform Building and Fire Codes.
Large, bulk sale propane tanks must meet all applicable
building and fire code requirements.
3) A compressed air service area may be located on site as
long as it does not interrupt on -site traffic circulation.
4) Accessory outdoor services, sales, or rental as regulated by
Section 7, Subd. 2.G.5 of this Ordinance.
ij. Litter Control. The operation shall be responsible for litter control
on the subject property, which is to occur on a daily basis. Trash
receptacles shall be provided at a convenient location on site to
facilitate litter control.
mk. Additional Stipulations may be added to address issues particular to
the site in order to protect public health, safety, and welfare. All
conditions pertaining to a specific site are subject to change when

A. Purpose. There are areas containing a wide variety of business uses including
retail, service, and semi - industrial uses. As such, they may contain businesses
which tend to serve other business and industry as well as those catering to
shoppers' needs.
No new land shall be zoned GB, General Business unless the site is within the
Commercial and use category according to the Comprehensive Plan argrur or °eaa --vies
within the City's MUSA and sanitary sewer and municipal water is available.
Lot and Yard Requirements.
1. Minimum Lot Size.

b. The entire area other than occupied by buildings or structures or
planting shall be surfaced with bituminous or concrete which will
control dust and drainage. The entire area shall have a perimeter
curb barrier, a storm water drainage system and is subject to the
approval of the City Engineer.
c. All buildings shall provide an interior location for trash handling or
an enclosed trash receptacle area in conformance with the
following:
1) Exterior wall treatment shall be similar and /or complement
the principal building.
2) The enclosed trash receptacle area shall be located in the
rear or in a side yard which is not abutting a street.
3) The trash enclosure must be in an accessible location for
pick up hauling vehicles.
4) The trash enclosure must be fully screened from view of
adjacent properties.
d. Ail painting must be conducted in an approved paint booth. Ali
paint booths and all other activities of the operation shall thoroughly
control the emission of fumes, dust or other particulated matter so
that the use shall be in compliance with the State of Minnesota
Pollution Control Standards, Minnesota Regulation APC 1 -15, as
amended.
e. The emission of odor by a use shall be in compliance with and
regulated by the State of Minnesota Pollution Control Standards,
Minnesota regulations APC, as amended.
f All flammable materials, including liquids and rags, shall conform

e. Vehicular access points shall be limited, shall create a minimum of
conflict with through traffic movement and shall be subject to the
approval of the City Engineer.
f. Provisions are made to control and reduce noise.
g.
An internal site pedestrian circulation system shall be defined and
appropriate provisions made to protect such areas from
encroachments by parked cars or moving vehicles.
h. Motor fuel activities associated with the bus service shall be
installed in accordance with State and City standards. Additionally,
adequate space shall be provided to access gas pumps and allow
maneuverability around the pumps. Underground fuel storage
tanks are to be positioned to allow adequate access by motor fuel
transports and unloading operations do not conflict with circulation,
access and other activities on the site. Fuel pumps shall be

capacity to accommodate traffic which will be generated.
c. Ali State Statutes and regulations governing such use are strictly
adhered to and all required operating permits are secured.
d. Adequate off - street loading space is provided in compliance with
Section 3, Subd. 6 of this Ordinance.
7 Motor fuel stations provided that:

surface of the site.
b. Architectural Standards.
1) As a part of the conditional use permit application, a color
illustration of all building elevations shall be submitted.
2) The architectural appearance, scale, and functional plan of
the building(s) and canopy shall be complementary and
compatible with each other and the existing buildings in the
neighborhood setting.
3) All sides of the principal and accessory structures are to
have essentially the same or a coordinated harmonious
finish treatment pursuant to Section 3, Subd. 4.B of this
Ordinance.
4) The canopy may have contrasting color bands or accent
lines not to exceed an accumulative width of four (4) inches.

5) Canopy. A protective canopy structure may be located over
the pump island(s), as an accessory structure.

setbacks and adequate visibility both on -site and off-

height and must provide fourteen (14) feet of
clearance to accommodate a semi - trailer truck

canopy shall be consistent with the principal building
on the site.
e) Signage is allowed on a detached canopy fascia in
lieu of wall signage on the principal structure,
provided that the individual canopy sign does not
exceed more than twenty (20) percent of the canopy
fascia facing a public right -of -way.
f) Canopy columns and signs shall not obstruct traffic or
the safe operation of the gas pumps.
q) Canopy column exteriors shall consist of one or more
of the following materials for at least one -haft of the
height of the column: brick, stone (natural or
artificial), decorative concrete block, EFTS, stucco.
Similar materials may be allowed at the City's
discretion.
c. Dust Control and Drainage. The entire site other than taken up by
a building, structure, or plantings shall be surfaced with asphalt,
concrete, cobblestone, or paving brick. Plans for surfacing and
drainage shall be subject to approval of the City Engineer.
Drainage from all fueling areas shall be directed to an oil /grit
separator. Minimum design standards for the oil /grit separator shall
include the following:
1) A minimum of four hundred (400) cubic feet of permanent
pool storage capacity per acre of drainage area.
2) A minimum pool depth of four (4) feet.
3) A minimum oil containment capacity of eight hundred (800)
gallons.
4) Minimum maintenance /inspection of two (2) times per year
and /or after measurable spill events. A measurable spill
shall be defined by the Minnesota Pollution Control Agency
(MPCA). Any measurable spill event must be reported to the
MPCA.

2) An indoor exercise area shall be provided to accommodate
the periodic exercising of animals boarded at the kennel. No
outdoor exercising of animals shall be permitted.
3) A ventilation system shall be designed so that no odors or
organisms will spread between wards or to the outside air
and will be capable of completely exchanging internal air at a
rate of at least twice per hour. Air temperature must be
maintained between 60 and 75 degrees Fahrenheit.
4) A room separate from the kennel area shall be provided of
sufficient size to adequately separate animals that are sick
or injured from healthy animals.
5) Indoor animal kennel floors and walls shall be made of non-
porous materials or sealed concrete to make it non - porous.
6) Animal wastes shall be flushed down an existing sanitary
sewer system or enclosed in a container of sufficient
construction to eliminate odors and organisms and shall be
properly disposed of at least once a day.
d. The appropriate license is obtained from the City and the conditions
of Chapter 503 relating to the keeping of animals are satisfactorily
met.
