Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. Staff recommended approval of the variance to the side yard setbacks at 8001 Lake Drive. Mr. Grochala noted that bids were opened and the city awarded a contract for the signal project at Lake Dr./Main St. and Birch St. /Ware Rd. Staff explained that on- street parking would be eliminated from the Miller's site as part of the oject. Staff reviewed the scope of the signal project at Lake/M city's police department could assist with traffic contra necessity. Applicant, John Palmer, Encompass Digital Media, stated that the removal of dirt was nearly complete and 2/3 of the berm had been reduced to the desired grade. He noted that the process was delayed because new recipients were needed to take the dirt. They decided against removing the entire berm as originally intended. They also decided against removing an additional berm in an area that attracts deer to their site. Mr. Palmer DRAFT MINUTES • • • Planning & Zoning Board September 12, 2012 Page 3 said that letters were sent to the neighboring property owners regarding the project and • that neighbors were opposed to a solid barrier wall in favor of a more natural type barrier. • • Mr. Palmer addressed questions from board members. He explained that areas of a chain link fence around the perimeter of the property would need to be fixed. An eight -foot fence with a three -strand barbed wire top would be installed in lieu of the barrier wall. He said that security would be increased with the installation of an interior electronic gate with key card access for customers. Respectfully submitted, Dawn Bugge Community Development Assistant DRAFT MINUTES PLANNING & ZONING BOARD AGENDA ITEM 5A • STAFF ORIGINATOR: Breanne Rothstein, City Planner, WSB and Associates MEETING DATE: Public Hearing on November 14, 2012 PROPERTY LOCATION: Northeast corner of Main Street and Lake Drive APPLICANT: Grant Rademacher, owner of Bill's Superette • • REQUEST: Preliminary Plat Review - Bill's Superette Conditional Use Permit for a Motor Fuel Stations Administrative Site Plan Review -G -Will Liquors REVIEW DEADLINE: Application deemed complete — October 18, 2012 60 day review deadline — December 17, 2012 120 day review deadline — February 15, 2013 DESCRIPTION OF REQUEST Grant Rademacher has applied to the city for a preliminary plat review to subdivide the existing lot located on the northeast corner of Main Street and Lake Drive into two lots. The existing lot is 4.65 acres, and is proposed to be divided into a southern lot (2.41 acres) and a northern lot (2.11 acres). Also, the applicant has submitted an application for a conditional use permit to locate a motor fuel station on the southern property. The Bill's Superette motor fuel station is proposed to be 8,460 square feet in size, with a total of 16 fuel pumps. Finally, the city requires an administrative site plan review for the proposed 13,362 square foot G -Will liquor store to be located on the northern parcel. SITE CHARACTERISTICS The subject property is a vacant lot, previously occupied by a single family home. It is relatively flat in elevation and has natural vegetation with mixed species of trees on the property. The site currently has one driveway opening along Lake Drive. The property is surrounded by a single - family neighborhood to the north and east, a motor fuel station and multitenant building to the southwest, a restaurant and auto body shop to the west, and a US Bank to the south. The intersection is currently controlled by a four -way stop control, however, construction to upgrade this to a signalized intersection is currently in progress. COMPLIANCE WITH CITY CODE REQUIREMENTS The city is in receipt of a plan set dated September 7, 2012, revised October 15, 2012 and October 25, 2012. Staff has the comments, as listed below. Land Use /Zoning: The property is guided for commercial in the Comprehensive Plan, and is zoned GB- General Business. The proposed use of the southern lot as a motor fuel station requires the approval of a conditional use permit. The proposed liquor store on the northern lot is a permitted use in the general business zoning district. In accordance with city code, the applicant must prove that all conditions set forth for the motor fuel station land use have been satisfied related to vehicular access, architectural standards, fuel storage systems, drainage, landscaping, and lighting, which will be addressed below in detail. Generally, the application meets the general and specific conditional use permit criteria in city code. Lot Size /Setbacks: The two newly created lots meet the minimum lot size and frontage for the General Business zoning district. The proposed buildings meet all applicable setbacks from property lines, road rights -of -way, and residential areas. Architectural Standards /Height: As part of the conditional use permit application, the applicant must meet specific architectural standards for motor fuel stations and their canopies. Face brick and rock face block are proposed as the predominant materials to be used on the buildings and the canopy regulations are proposed to be met. The height of the buildings meets the city code standard of a maximum of 45 feet. Section 3 of city code also requires thast commercial buildings meet architectural standards relating to harmonious finish treatment. Based on the submitted renderings, the proposed building meets standards for the usage of earth tone with accent colors and limitations on the use of EFIS /stucco and decorative metal. The police department submitted comments recommending the addition of windows on the south and/or east side of both buildings to aid in crime prevention efforts. Utilities: This site is proposed to be serviced by the city sewer and water systems. As city policy, all sewer lines must be extend to the extent of the property, which is proposed by the plans. The existing trunk sanitary sewer and watermain that are being tied into at the southwest corner of the site need to be shown on the utility plans. The City is concerned with the constructability of the trunk sanitary sewer along Lake Drive. The proposed sanitary sewer is approximately 25 feet deep and only 7 feet away from the edge of the existing roadway. The applicant needs to design the sanitary sewer so that an OSHA approved trench can be constructed without impacting the roadway or traffic on Lake Drive. Staff has detailed comments regarding the utility system and asked for revisions to the plan regarding irrigation, which are included in the attached City Engineer's memo. Traffic /Access: The intersection of Lake Drive and Main Street is currently being upgraded to a signal. As the plat is proposed, there is sufficient right -of -way to complete this upgrade. Anoka County Highway Department is requiring the dedication of an additional 15 feet of right -of -way along Main Street. The County has also submitted an advisory comment regarding future median installation by the County at some time in the future, which may restrict these full turning movements. • • • r • • The site proposes to gain access from both Lake Drive and Main Street with full turning movements (left and right exit lanes and one entrance lane) to be shared by both the Bill's Superette gas station and the G -Will liquor store. These driveway cuts exceed city code for driveway width and should be revised to meet the maximum width of 36 feet. The existing driveway on Lake Drive must be shown as being removed. A traffic study has been completed for the site that recommends right turn lanes be installed along Lake Drive and Main Street in order to increase the safety of the intersections. Anoka County Highway Department also discusses right turn lane installation. The Lino Lakes Police Department also recommends turn lanes as part of their review. Off - Street Loading Areas: City Code sets forth standards for loading dock areas, and the proposed plan is satisfactory to city staff and the City Engineer. Parking: The proposed plans indicate a total of 86 stalls of parking for both the Bill's Superette and the G -Will Liquors site. City Code requires one stall per 200 square feet of building area (with a 10 percent credit for unusable floor area), resulting in a total of 99 required stalls. The applicant is proposing "proof -of parking" areas for the deficient 12 stalls. In an effort to reduce impervious surfaces and mitigate storm water runoff, city code allows for "parking deferment" when evidence is provided by the applicant to suggest that the required number of parking stalls are not needed. The applicant has constructed several stores and has provided evidence from these stores that the parking demand is lower than city code requires. Staff is comfortable with the level of parking proposed and allowing a deferment of the remaining 21 stalls. The site plan does not indicate a perimeter curb along the sidewalk/walkway areas adjacent to the building. Staff has requested a perimeter curb in these areas to serve as wheel stops. A raised sidewalk may substitute for this purpose. Surface Water Management /Pollution Prevention: City Code restricts impervious surfaces to no more than 75 percent of the site, which the proposed plan meets. Stormwater is proposed to be routed to an infiltration basin located in the southwest corner of the site. The City Engineer has reviewed the stormwater management plan and has offered detailed comments to the applicant with regard to the system design and requested revisions that should be incorporated into the final plan set. The Rice Creek Watershed District will require a permit for the storm water management on this site, and have submitted several comments regarding this review. An operation, inspection, and maintenance agreement should be completed that indicates the land owner is responsible for the stormwater facilities. Grading /Drainage: For all motor fuel stations, oil /grit separators are required as a mechanism for limiting polluted run -off from entering the storm water system. Staff has requested additional information regarding this system. Staff has provided the applicant with detailed comments regarding the direction and flow of drainage. Applicant is required to provide proof of NPDES permit prior to commencing with grading. To date, staff has not received a final soils report, which will be a requirement for approval. This information will be needed to verify the stormwater plan. Easements: The proposed drainage and utility easement between Lots 1 & 2 is insufficient to provide the necessary space to access and repair the proposed sanitary sewer, watermain and storm sewer in the future. This easement needs to be increased to 20 feet on either side of the property line. A drainage and utility easement needs to be provided along the eastern property line and must be sufficiently wide to accommodate the proposed drainage swale. The proposed drainage and utility easement around the pond must be increased to contain the 10 -day snow melt event water elevation. All of the proposed storm sewer utilities, other than roof leads, must be contained within a drainage and utility easement, including the oil and grit separators. Landscaping /Tree Preservation: City Code and the conditional use permit section for motor fuel stations outlines detailed requirements with regard to landscaping in three different categories: these including standards for canopy cover, foundation landscape, and open areas, and buffering /screening. City Code also requires replacement ratios for trees that must be removed as part of the site grading. After detailed discussions with staff, the plan has been revised to meet the requirements for canopy cover by including four landscaped islands within the parking lot. The foundation landscaping requirements are proposed to be met by the installation of trees and shrubs at one key location per building, which is short of the foundation planting requirements by five trees total. The plan indicates raised planters with annual flowers on approximately 65 feet of the total perimeter to make up for the shortage of foundation plantings. Staff has recommending that these raised planters be installed along both buildings and that they are more clearer marked on this plans. This site requires substantial landscape buffering from the adjacent residential uses. A six foot privacy fence is proposed that is off -set every 75 feet and the planting of shrubs along 50 percent of the fence. Also, a significant number of trees are proposed that would, at full growth, extend over the top of the fence and provide additional screening. Six existing trees are proposed to be preserved that will also contribute to the screening efforts. All other trees on site will be removed as part of the building plans. These trees are mitigated according to city code by the perimeter tree plantings proposed. Lighting: The requirements of the city code and conditional use permit restrict and limit the design, height, and brightness of all lighting on site. According to the submitted plans, the proposed gas station and liquor store meets these requirements for height, maximum foot - candle at right -of -way, and light fixtures. Canopy illumination shall be limited to the hours of 5:00 a.m. to 11:00 p.m. Signage: Per the conditional use permit requirements, signage is limited to either the wall of the building or the canopy and the plans indicate only wall signage. One monument sign per frontage is permitted for motor fuel stations and one per property is allowed for all other businesses. All signage will require separate permitting. Parks /Trails: As part of the preliminary plat review staff has requested (and the plan set indicates) the dedication of a trail easement and construction of trails extending from the intersection along the southernmost property line and north along the westernmost property line. Based on the need for additional right of way, we propose locating the trail within the County right -of -way which will need to be verified with the County. This will be deducted from the park dedication fees owed for the subdivision of the site. The applicant needs to confirm with the power company that the proposed trail easement can be recorded within the easement power line easement. Development Fees: The applicant will be required to pay appropriate park dedication, sewer, water, and surface water trunk and connection charges as part of this subdivision and site plan review. These fees will be calculated at the time of final plat and the drafting of the development agreement. RECOMMENDATION: The Environmental Board met on October 24, 2012, and recommended several changes to the site plan, as outlined in the attached memo. The plan set has been revised to address these comments. Soil borings are still needed to verify the suitability of soils for infiltration. Staff recommends that the Planning Commission recommend approval of the preliminary plat for Bill's Superette, site plan review for Bill's Superette and the G -Will Liquor store, and approval of the conditional use permit to allow for a motor fuel station, subject to the following conditions: 1) Submission of a revised plan set that incorporates the comments from the City Engineer's memo dated November 5, 2012; 2) An oil /grit separator is submitted and meets the approval of the City Engineer; 3) Submission of a soils report, and reviewed by City Engineer; 4) Cross access easements are submitted and approved by city staff to allow both businesses to utilize both accesses; 5) Submission of a revised plan set indicating the installation of right turn lanes into the site from both Main Street and Lake Drive; 6) Submission of a revised plan set that shows the driveway widths to a maximum of 36 feet; 7) The plat shall dedicate an additional 15 feet of right of way along Main Street; 8) Access along Lake Drive and Main Street shall be dedicated on the plat to Anoka County; 9) Obtain all necessary permits from the Rice Creek Watershed District, and provide a copy of that permit to the city; 10) Pond areas must be planted with a native seed mix acceptable to the city and managed for a minimum of three years by an approved city contractor; 11) Sign and enter a maintenance agreement to the city for the maintenance and operation of the storm water infrastructure onsite prior to issuance of a building permit; 12) Revised plans are submitted that indicate the addition of raised landscaping beds on both buildings, and that such beds are clearly marked on the plan set; 13) Submission of colored elevations of the gas canopy and pump islands that meets city code; • 14) Canopy illumination level shown on the photometric plan shall be allowed between 5:00 a.m. and 11:00 p.m. Outside of these hours, the fuel pumps may operate but the canopy light level shall be significantly reduced to approximately 10 percent of full illumination; 15) The public address system shall be limited to an intercom system and shall not play music or advertising; 16) Any video advertising devices integrated into the fuel pumps shall be inaudible from the surrounding properties and rights -of -way; 17) The proposed motor fuel stations meets all noise and lighting ordinance at all times; 18) All outstanding land use or escrows shall be paid in full prior to issuance of a building permit; 19) Title work satisfactory to the City Attorney shall be submitted and reviewed prior to final plat recording; 20) Preliminary plat approval shall be valid for one year from the date of this approval. The plat and associated development agreement shall be recorded within one year of approval. The proposed drainage and utility easement between Lots 1 & 2 is insufficient to provide the necessary space to access and repair the proposed sanitary sewer, watermain and storm sewer in the future. The proposed easement needs to be increased to 20 feet on either side of the property line. 2. The applicant needs to confirm with the power company that the proposed trail easement can be recorded within the easement power line easement. 3. A drainage and utility easement needs to be provided along the easement property line and must we sufficiently wide to accommodate the proposed drainage swale. 4. The proposed drainage and utility easement around the pond must be increased to contain the 10 -day snow melt event water elevation. 5. All of the proposed storm sewer utilities, other than roof leads, must be contained within a drainage and utility easement. This includes the oil and grit separators. 6. The gate valve for the liquor store water service must be contained within a drainage and utility easement. 7. The site accesses should be revised to indicate a maximum driveway width of 36 feet. 8. There appears to be no curbing along the sidewalk adjacent to the building. Please provide evidence that there will curbing along the walkway, or a raised sidewalk could substitute for this purpose. 9. Anoka County is requesting additional right of way along Main Street. Please amend the trail easement to be right -of -way, which can accommodate the trail in this location (per review by the County). Utility Plans 1. There are two existing wells shown on the plans. The applicant needs to identify which well is proposed to be used for irrigation and which well is being sealed. In addition, the applicant needs to demonstrate how the site irrigation will be handled in the future once the existing well fails. This is necessary because the City will not allow the existing well to be re- drilled in the future. At the time of failure, the applicant will need to connect the irrigation to the municipal water supply. 2. The existing trunk sanitary sewer and watermain that are being tied into at the southwest corner of the site need to be shown on the utility plans. 3. The City is concerned with the constructability of the trunk sanitary sewer along Lake Drive. The proposed sanitary sewer is approximately 25 feet deep and only 7 feet away from the edge of the existing roadway. The applicant needs to design the sanitary sewer so that an OSHA approved trench can be constructed without impacting the roadway or traffic on Lake Drive. 4. A temporary hydrant is required at the north end of the trunk watermain along Lake Drive for flushing purposes. 5. The sanitary sewer service for the liquor store cannot connect directly to the sanitary sewer manhole. The service is required to connect to the 8 -inch sewer main with an 8" x 6" wye. 6. Please confirm that there is a minimum of 18 inches of clearance between the liquor store sanitary sewer service and the 8 -inch watermain. 7. The detail plates included in the plans are not the City of Lino Lakes standard detail plates. The City's plates are currently being updated and will be provided to the applicant once they are complete. Grading Plan 1. The City is concerned with the proposed valley gutter that is shown crossing the southerly driveway access onto Main Street. It appears that this could be an issue in the spring with freezing and thawing which could create unsafe driving conditions. The applicant needs to explore alternative methods for conveying storm water across this location. 2. Curb cuts and associated grading must be clearly shown on plans to ensure that runoff is directed to ditch on east side of property. One particular area of concern is the northeast corner where runoff not captured in the ditch could drain onto adjacent parcels. 3. Ditch cross section for the east ditch should be provided to ensure that the ditch has adequate capacity to convey runoff without overtopping into the adjacent parcel. 4. The existing driveway on Lake Drive must be shown as being removed. 5. Applicant is required to provide proof of NPDES permit prior to commencing with grading. Storm Water 1. Soil borings should be completed near the proposed infiltration basin to verify presence of sand soils and groundwater elevations at the proposed facility. 2. The configuration of the drainage system with the SAFL Baffles and Prinsco systems may not be effective. Rather than having parallel lines, it seems that the Prinsco systems could be increased in size and offer greater benefit. 3. Access ports for the Prinsco systems should be indicated on plans. 4. An operation, inspection, and maintenance agreement should be completed that indicates the land owner is responsible for the stormwater facilities. 5. The applicant may wish to specify the invert of the Prinsco system as the inlet pipe invert to avoid confusion during construction. 6. The applicant is advised that the Prinsco system may be difficult to maintain as currently configured. However, the existing right of way along CSAH 14 adjacent to this site equals 60 feet, which will not be adequate, as 75 feet of right of way will be required for future reconstruction purposes. Consequently, an additional 15 feet of right of way along CSAH 14 adjacent to this site should be dedicated to Anoka County. If the additional right of way cannot be dedicated through the City's site plan process, the setbacks to buildings, structures, etc. should take the future right of way needs along CSAH 14 into consideration. At some point in the future, both CSAH 23 and CSAH 14 will be reconstructed to include raised median channelization, so both access points will become right in/right out (RI/RO) access points when medians are constructed. The right of access along the remaining portions of CSAH 14 and CSAH 23 should be dedicated to Anoka County. It appears that there are sight distance deficiencies for the Intersection Sight Distance Requirements on CSAH 14 and CSAH 23 at the proposed accesses, with the obstruction being bushes. It is anticipated that the bushes will be removed as a part of the site development. Please note no signs or plantings will be permitted within the county right of way. In addition, care should be exercised when locating buildings, structures, plantings, berms, etc. outside of the county right of way, so as not to create any new sight distance obstructions at the access points. Recommendations for substitution species include, but are not limited to Oaks, hackberry, disease resistant American elms such as Princeton, Heritage, Accolade or New Horizon, and Red maple. • Find a lower growing plant to substitute for the Alpine current in the parking lot island. Plants should not exceed 22 inches. • Move trees inside Great River Energy power line easement out to at least 35 feet. Otherwise obtain an encroachment agreement with Great River Energy. • • Demonstrate how future buffer requirements will be addressed in the "phantom" parking • lot areas should the parking spaces be used. • CPTED review must be submitted. • All sod areas must be irrigated. • Developer showed interest in changing the top vegetation to a native fescue instead of recommended Blue Gramma. The County is planting native Blue Grama on the top side of their pond. Staff recommended similar material; however, native fescue would work. • Tree preservation measures must be shown for adjacent property trees that have dripline within the project limits. The tree preservation plan should also have tree identity numbers depicted on the tree preservation map. • SWPPP notes, on the construction details must include the name and phone number of the person responsible on site for SWPPP implementation. However there are some things which may require some more attention or explanation. • Is the "C" store a 24 hour operation? • Will the car wash operate 24 hours a day or have a closing time? Traffic: • The City should consider the results of a traffic study on Lake Drive and on Main Street to determine if the new driveways will cause traffic congestion. A solution would be to add a turn lane on westbound Main Street leading up to the driveway and a passing lane for eastbound Main Street on the south side of the roadway. The same should be considered for the Lake Drive driveway. • Within the lot, we should be aware of the car wash and the issues it will present in the winter. The water which drips from cars as they leave the wash will freeze onto the road. If vehicles cut through the parking lot between the gas pumps and the gas station it could present a slipping hazard to people walking from the pumps to the gas station and a hazard to passing motorists. Natural Surveillance: • There are no windows on the south side or east side of the gas station which will inhibit natural surveillance into and out of the business. By adding a set of windows we could alleviate this. This is particularly a concern for the east side because that is where the trash enclosure is. As it stands now, employees are taking the trash out and are concealed by the tree line and no windows. • For the liquor store, there is only one set of windows on the building, which incorporates the front door. I would recommend adding more windows to increase natural surveillance. • Encourage both the C store and the Liquor store to limit advertisements placed on glass doors and window that block natural surveillance into the businesses. Camera's /Locks • I would like to view a camera /security outline when available • • Locks should be an anti - spreading type and have dead bolt capability. Snow Removal: • Snow removal can be a concern with this type of design. If they are going to pile the snow on -site we should be conscious of where it is being stored. We want to avoid storing the snow in area which will obstruct the view of traffic entering and exiting the complex. Additionally, we want the snow to be stored in an area which does not affect the natural surveillance of the parking lot. Lighting: • I am unable to read the lighting plan for the business complex as it was not included with the full size plan. A white LED shining down on the lot and canopy should be a good option, as long as it does not alter the color of vehicles when viewed through the surveillance cameras. Wail packs are a good option, but care should be used when installing them to not blind passing motorist and hinder natural surveillance. The expressed concerns appear to deal primarily with the length of the time period allowed. The Sign Code currently limits temporary sign displays as follows: One temporary sign permit is allowed per quarter of any calendar year. Permit is good for 17 consecutive days. The time limitations appear to be problematic for institutional uses that have periodic events such as boy scout signups, athletic tryouts, camps etc. Commercial uses that have similar frequent "events" or "specials" have also have similar concerns. REQUESTED BOARD DIRECTION The City Council has requested that the Planning & Zoning Board review these standards and determine if any changes are warranted.
