MEETING GUIDELINES
Oven Mike — The purpose of a Board Meeting is to accomplish the business of the city.
When presenting at a meeting please remember to be respectful, and follow these
guidelines:
• Please address the meeting chair.
• State your name and address for the record.
• Please observe a 4- minute limit.
• The topic must relate to city business.
• Open Mike is for items not on the agenda.
• A spokesperson must represent a group of five or more — groups will have 8 minutes.
• The Presiding Officer may limit duplicative presentations.
• Remember, the meeting is to discuss city business only.
Public Hearing - Held as a separate item of business on the agenda. The public hearing
segment is your opportunity to tell the Board how you feel about issues scheduled to be
heard. Typically, a hearing follows these steps:
• The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and
ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all
meetings.
• Staff will present their report on the proposal.
• Board members will then ask City Staff questions about the proposal.
• The Presiding Officer will then open up the public hearing for anyone present who wishes to
comment on the proposal. This is the time for the public to make comments or ask questions
about the proposal.
Comments should be limited to four (4) minutes unless further time is granted by the
Presiding Officer. All comments should be directed to the Board as a body and not to any
individual Board Member or City Staff Member unless permission is granted by the Presiding
Officer. No person shall be permitted to enter into any discussion, either directly or through a
member of the Board without the permission of the Presiding Officer.
• After everyone in the audience wishing to speak has given his/her comments, the Presiding
Officer shall close the public hearing.
• The Board will then discuss the proposal. No further public comments are allowed.
• The Board will then make a recommendation(s) and/or a decision.
When you are called upon for your comments, please step to the microphone at the
podium and state your name and address for the record.
Occasionally, the Board may continue a hearing to another meeting before taking action.
Meeting Etiquette
The Planning & Zoning Board must preserve order and decorum while the meeting
is in session. A resident shall not, by conversation or otherwise, delay or interrupt
the proceedings or the business of the Board, nor disturb any resident or Board
Member while speaking or refuse to obey the orders of the Board.

Vice Chair Hyden called the Lino Lakes Planning and Zoning Board meeting to order at
6:30 p.m. on February 13, 2013.
2. APROVAL OF AGENDA
Mr. Evenson made a MOTION to approve the agenda as printed. Motion was supported
by Mr. Masonick. Motion carried 5 -0.
3. APPROVAL OF MINUTES:
December 12, 2012
Mr. Laden made a MOTION to approve the December 12, 2012 Meeting Minutes.
Motion was supported by Mr. Nelson. Motion carried 5 - 0.

There was no one present for Open Mike.

5. ACTION ITEMS
A. Final Plat for Rademacher Addition
Michael Grochala, Community Development Director, presented the staff report. Mr.
Grochala noted that the plat has been renamed to Forest View Acres Second Addition.
He stated that all of the corrections as listed in the staff report have been completed by
the applicant and shown on the new plat as distributed at the meeting. Staff
recommended approval of the Final Plat for Forest View Acres Second addition based on
the following conditions of approval:
1. The payment in lieu of park dedication shall be $9,722.25 ,The fee shall be credited
back to the developer for trail improvements.
2. Execution of development agreement and stormwatet treatment operation and
maintenance agreement between the developer and the City.
3. The trail easement along Lake Drive must be provided.
Applicant, Grant Rademacher, was present with no' comments regarding the requirements
for final plat.

6. DISCUSSIONlTEMS
A. Sign Regulations
Mr rock ala explained that staff is seeking additional input from the board
regarding sign regulations„ Staff reviewed some alternatives to consider.
oard member comments included the following:
90 -day per year flexible package is a good option. The business owner
ld contact the city to track their days or the city could issue stickers to
etoto`permitted signs.
• Regulations must be enforcable and trackable.
• Banners and sandwich boards should be treated similarly. Allow during
business hours with a maximum time allowed, such as 12 hours per day.
Extend the location to 30 feet from the building rather than 10 feet.
Grant Rademacher, applicant for Bill's Superette, stated that they are interested in a
dynamic display, but their desired signage does not meet the current sign
requirements. Mr. Rademacher is requesting an allowance for a slightly larger sign
to allow for three lines of visual graphics rather than two.

Staff will draft revised ordinance language based on the discussion.
B. Landscaping Regulations
Staff has recognized the need to consider amending the city's landscaping
requirements. Staff discussed the areas that need to be addressed and will bring
language before the board for review at a future meeting.
The board was favorable of suggested changes and recommended that any proposed
landscaping amendments also go to the Environmental Board for comment.
C. 2012 Year End Board Summary
Staff distributed a summary of board actions for the year 201

BACKGROUND
"The Preserve" was submitted to the City in 2006 by Integra Homes as a residential
subdivision. The City Council approved Resolution 06 -137 for a PUD Development
Stage Plan/Preliminary Plat in August 2006. Final plat extensions were approved up to
April 2013. The final plat has been submitted by Schwieters Investments of Lino Lakes,
LLC as "Preserve at Lino Lakes ".
The development is summarized as follows:
1. Density:
Gross Site Area 52.6 acres
Upland Area 15.0 acres
Total Residential Lots 31
Gross Density 0.6 units /acre
Net Density 2.1 units /acre
Outlots A= Future City well site
B, C, D, E, F = Conservation Easements /Wetlands
2. The comprehensive plan guides the buildable area for Low Density Sewered
Residential land use and it is within the Stage 1A Utility Growth Area.
3. Ordinance No. 08 -06 rezoned the site from R -1, Single Family Residential and
Rural to Residential Planned Unit Development.
4. The project is a conservation development. A Restoration and Management Plan
for Conservation Areas has been created specifically for the development and shall
be implemented.
5. A Homeowners Association shall be established which creates a stewardship fund
to implement the Restoration and Management Plan. The fund amount will be
based upon cost estimates determined in the Restoration and Management Plan.
6. The Planning & Zoning Board opened public hearings on the application on May
10, 2006 and closed the hearing on June 14, 2006.
7. Outlot A is being deeded to the City for public utility purposes for a future City
well.
8. Park dedication fees (cash in lieu of land dedication) are calculated at $2,500 per lot
x 31 lots = $77,500. These fees will be allocated to the construction costs of the
required boardwalk and trail.
9. Final Site Development Plans, Sheets C1.01 -L1.01 Revision C, dated 02/11/13,
were submitted with the development application.
The "Preserve at Lino Lakes" is a Planned Unit Development (PUD). A PUD has two
approval stages. The `development stage plan' includes the preliminary plat and
establishes the design, conditions, and other elements for the project. The `final plan'
includes the final plat and other final specifics that must fulfill the conditions attached to
the preliminary stage approval.

ANALYSIS
The submitted final plat is generally consistent with the approved preliminary plat. There
is an existing boardwalk/trail that extends from Trappers Court to Birch Park along the
north end of Outlot D. An easement was purchased by the City from the previous owners
in 2003 but is not identified on the final plat or in the title commitment. If this easement
was not recorded, a new easement shall be drafted by the City and properly recorded.
Attachment D summarizes outstanding issues that need to be resolved prior to Council
approval of the final plat.
RECOMMENDATION
Staff recommends approval of the PUD Final Plan/Final Plat with conditions listed in
Attachment D to be completed prior to City Council approval.

A revised Conservation Easement, Covenants & Restrictions (CECR) shall be
submitted in recordable format which includes the following:
a. Conservation Easement survey map and legal description shall be attached as
Exhibit A and B.
b. Description of the restoration and management plan, its funding and
implementation.
c. Definition of the easement document
d. Definition of The Preserve Conservation Development Restoration and
Management Plan for Conservation Areas
e. Attachment with the easement legal description and figure (as prepared by
MFRA)
f. Definition of "Conservation Area" must include Outlots C and D as well as B,
E, F
g. Must establish the fund for implementing the management plan and specify
the assessment amount for the fund
h. Describe when the assessment will be submitted to the City
i. Statement that the Declarant (developer) is responsible for the management
fund payments for lots owned by the Declarant. (Without this, the fund will
not grow in the first few years and there will not be funds available for
implementation.)
j. A statement that any provision of the Declaration regarding the conservation
easement or implementation of the management plan cannot be amended
without the permission of the City
k. We recommend a `conflicts among documents' statement like in the other
documents

Homeowners Association documents shall be submitted.
a. A homeowners association shall be created.
b. Association documents shall describe the restoration and management plan, its
funding, and its implementation.
c. The association shall be responsible for and shall maintain a stewardship fund
to implement the restoration and management plan for the open space areas
defined by the conservation easement.
d. The stewardship activity shall be in accordance with the conservation
easement and the approved restoration and management plan.
e. The Bylaws must include the following:

a. describe when the assessment will be submitted to the City
b. a statement that any provision of the Bylaws regarding the
conservation easement or implementation of the management plan
cannot be amended without the permission of the City
c. a statement that the HOA cannot dissolve without the permission of
the City and that the City must be notified of any meeting for
discussion of dissolution.
f. The Articles of Incorporation must include the following:

a. revision of Article IV that does not allow the sale of Outlots B, C, D,
E, F (which are covered by the conservation easement)
b. a statement in Article X that the HOA cannot dissolve without the
permission of the City and that the City must be notified of any
meeting for discussion of dissolution.

A quit claim deed for conveyance of Outlot A to the City in recordable format shall
be submitted by the developer.
5.
A listing of the total area of each lot measured in gross square feet per lot, net square
feet per lot, area per block and total area of the plat.

The "Preserve of Lino Lakes" development has protection areas for Tubercled Rein -
orchid, an endangered species, and Scirpus clintonii, a special concern bulrush.
Scirpus clintonii is soon to be placed on the endangered list. These areas are to be set
aside and protected from construction damage.
a. Orange fencing with appropriate signage must be placed at the boundaries of
these areas.
b. Signage must state no equipment or disturbances of any kind allowed in the
protection areas.
c. Attention to these areas must be discussed at preconstruction meetings, and
sufficient notice to appropriate city staff given of the commencement of
grading operations.
16.
The final plat and related documents must be recorded with Anoka County within 90 days of approval
or the final plat will become null and void.
17. After recording, (1) copy showing evidence of recording shall be submitted back to the City.
ENGINEERING, PUBLIC WORKS, & FIELD VERIFICATION
18. The drainage and utility easement on Outlot A should be removed from the final plat.
19.
A temporary cul de sac easement on Pheasant Run is required.
20.
Cost estimate for all improvements shall be submitted.

A Development Contract will be drafted by the City and signed by the developer.

The following site review is based on these submittals:
1. Final Site Development Plans for The Preserve prepared by MFRA:
C.1.01 — L.1.01 Dated February 11, 2013
Retaining Wall Cross - Section Comments:
1. Engineering calculations and fencing must be provided for all retaining walls greater than 4'
in height.
2. A standard detail for retaining walls 4' or greater must be provided with fencing shown.
3. Provide stationing for all retaining wall and guard rail termini and offsets from centerline.
4. All retaining walls must be within easements and outside City right -of -way.
Street and Trail Comments:
1. A 20' minimum must be provided for all intersection radii, including the throats of cul -de-
sacs.
2. Spot elevations must be provided for the proposed concrete curb within the cul -de -sacs to
confirm that a minimum grade of 0.5% is maintained.
3. The bituminous specified for the streets and trails is no longer up to date. The City
specifications for streets is Type SP 12.5 Wearing Course Mix (3, C) SPWEB340C and for
trails is Type SP 12.5 Wearing Course Mix (2, C) SPWEB240C — Trail.
4. Killdeer Drive is not centered within the right -of -way at the north end where it connects to
the existing roadway. Either the street alignment or the right -of -way need to be adjusted
accordingly.
5. The trail detail on sheet C4.01 does not match the City Standard Plate shown on C9.02.
Please remove the detail on sheet C4.01.
6. Details for the construction of the boardwalk need to be included in the plans.
Sanitary Sewer and Watermain Comments:
1. Indicate the type of casing pipe to be installed for both the watermain and the forcemain.
2. The length of the watermain needs to be indicated on the plans.

3. The stations of the sanitary sewer manholes need to be shown in the profiles.
4. The proposed storm sewer needs to be shown in the profile as a hidden line type.
5. The watermain needs to be labeled as Class 52.
6. The watermain between the Killdeer Drive cul -de -sac and the Pheasant Run cul -de -sac needs
to be realigned to more closely follow the proposed boardwalk.
7. The plans need to include the note that Gopher One locates have been performed and
included in the plans.
Storm Sewer and Drainage Comments:
1. A copy of the drainage calculations needs to be submitted for review.
2. Confirmation that the RCWD permit for this site is still in effect must be provided.
3. Low floors must be 4' above the highest anticipated water table which is identified as
mottled soils or the seasonally high water mark.
4. FES E invert elevation is below the proposed grade at its current location.
5. Emergency overflows for the low points of Pheasant Run South at station 0 +50 and Killdeer
Drive at station 3 +50 must be shown on the grading plan.
Grading Comments:
1. The grading plan needs to show both the proposed and existing contours.
2. The location of the soil borings should be shown on the plan.
3. The drainage swale behind Lots 1 -6, Block 6 is not contained within the drainage and utility
easement. Either the swale needs to be shifted to the west or the easement needs to be
expanded.
