City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. SWEARING IN OF BOARD MEMBERS This item was postponed o the April meeting. 4. ELECTION OF CHAIR AND VICE CHAIR This item was postponed to the April meeting. 5. APPROVAL OF MINUTES: February 13, 2013 Mr. Hyden made a MOTION to approve the February 13, 2013 Meeting Minutes. Motion was supported by Mr. Nelson. Motion carried 5 - 0. 6. OPEN MIKE Chair Tralle declared Open Mike at 6:32 p.m. DRAFT MINUTES Planning & Zoning Board March 13, 2013 Page 2 There was no one present for Open Mike. Mr. Hyden made a MOTION to close Open Mike at 6:33 p.m. Motion was supported by Mr. Nelson. Motion carried 5 - 0. 7. ACTION ITEMS Shelves This item was cancelled. B. Planned Unit Development Final Plan/Final Plat for Preserve at Lino Lakes Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the PUD Final Plan/Final Plat for Preserve at Lino Lakes. Staff noted that a fully updated conservation plan will be required with approval of the final plat. Staff added that they are not anticipating any greater impact on traffic than originally anticipated. Mr. Grochala noted that the installation of signals at Birch St. /Ware Rd. is a step in improving traffic o Birch St. Staff confirmed that the proposed trail ill be insta ! by the developer. Brenda Kunkel, Schwieters Investments of Lino Lakes LLC, 13925 Fenway Blvd N, Hugo, stated that they are looking forward working with the city on this project. She noted that the grading work is not yet comp 4 e. Staff addressed that the city will be tracking the grading process. Zentgraf, pr oecc manager for Schwieters, commented that he was part of the evious grading e p s and is familiar with the concerns of residents regarding sw , g in , hours, etc ?: Mr. Nelson made a MOTION to approve the PUD Final Plan/Final Plat for Preserve at Lino Lakes with conditions as listed in the staff report. Motion was supported by Mr. Hyden. Motion carried 5 -0. The board noted that they are pleased to have a new development in the city. This item is proposed for review by the City Council on April 8. 8. DISCUSSION ITEMS A. 2013 Meeting Dates DRAFT MINUTES • • • • • • Planning & Zoning Board March 13, 2013 Page 3 The board members received the list of proposed meeting dates for 2013. Mr. Grochala stated that the city anticipates a busy year with upcoming development projects and ordinance revisions. 9. The proposed preliminary plat is not considered premature and it meets the performance standards of the Subdivision and Zoning Ordinance. COMPREHENSIVE PLAN Resource Management System The Resource Management Plan identifies a proposed north -south trail and greenway system in the subject site area. A trail is being installed as part of the Otter Lake Road extension and the greenway system coincides with the existing wetlands on the north end of the site. Land Use Plan As identified above, the land use is guided for commercial development and is within the 2020 MUSA and lA Utility Staging Area. Economic Development Plan Key goals of the Economic Development Plan are to expand and diversify the city's tax base and promote planned expansion within the City's growth areas and accessibility to public infrastructure. The I -35E Corridor has been identified as a key development area and "gateway" to Lino Lakes. Transportation Plan Per the Transportation Plan, the Otter Lake Road extension is recommended to be classified as an "A" minor expander. This route will serve as the main north -south route in the eastern portion of the city, providing a reliever function to I -35E and is critical to the development of this corridor. Transportation includes all multi -modal systems which accommodate pedestrians, bicycles, roadways and transit. The Park, Greenway & Trail System Plan identifies the need for a proposed north -south City trail which will be installed with the extension of Otter Lake Drive. Planning Districts The project area is located in Planning District 5 and the Peltier, Hardwood Creek and Upper Rice Creek Resource Management Units (RMU). A greenway system is identified on the north end of the subject property. ALTERNATIVE URBAN AREAWIDE REVIEW (AUAR) The subject site is within the I -35E Corridor AUAR and is subject to the AUAR mitigation plan. Overall, the proposed subdivision complies with the AUAR mitigation plan in regards to natural resources, erosion control, surface water runoff, wastewater, cultural resources and farmlands. A major component of the AUAR is traffic and supporting transportation corridors. The extension of Otter Lake Road is identified as an important roadway improvement. RECOMMENDATION Staff recommends the approval of the preliminary and final plat of "Main Street Shoppes" subject to the following conditions: 1. All comments from City Engineer Letters dated March 27, 2013 and March 29, 2013 shall be addressed. 2. All comments from City staff, Planning & Zoning Board, City Council and other agencies shall be addressed. 3. OHWL shall be included for wetlands. 4 110 • • • • • 4. All re- vegetation measures proposed for the subject property must be included on the plan, including seed and mulch types and application rates. 5. Layout of proposed streets showing centerline gradients, section widths, and typical cross sections shall be included. 6. The location of hydrants and valves for all proposed water mains shall be included. 7. Documentation that the applicant has submitted to the Rice Creek Watershed District or the Vadnais Lake Area Water Management Organization, as applicable, a complete application as defined by those agencies. Such documentation shall be issued by the respective agency. 8. Storm Water Pollution Prevention Plan (SWPPP) as required by the Minnesota Pollution Control Agency shall be provided. 9. Parcel areas differ from Preliminary Plat sheet and Site Plan sheet. Please revise. 10. Sheet C1.1 a. Rename to "Certificate of Survey" b. Omit proposed Otter Lake Road and ponding area. c. Clean up text under Zoning and Setbacks. d. Date of plan preparation and dates of all revisions shall be corrected. 11. Sheet C1.2 a. Include proposed access easement as shown on Site Plan. b. Include proposed drainage and utility easement for utilities as shown on Site Plan. c. Include OHWL, ten (10) foot buffer and drainage & utility easement around wetland as shown on Site Plan. 12. Final Plat a. One (1) up -to -date (within 3 months) title insurance commitment for the property being subdivided shall be provided. b. Thirty-two (32) foot wide drainage & utility easement shall be shown on final plat. c. Cost estimates for all improvements shall be provided. 13. A Development Contract shall be drafted by the City and signed by the applicant. a. A Declaration of Access Control for future right in/right out access shall be drafted by the City and signed by the applicant. REQUESTED MOTION Motion to recommend the City Council approve the preliminary and final plat for Main Street Shoppes, subject to the conditions listed in the staff report. Proposed Stormwater Management Summary The applicant proposes to construct a stormwater pond and a wetland treatment system on the northwest corner of the site. These facilities are planned to serve the southern 4.4 acres of the parcel that are adjacent to Main Street. Stormwater runoff from the southern area will drain to the treatment system through storm sewer under the proposed driveway and a temporary ditch on the west side of the property. The use of erosion control devices such as silt fence and rock logs are proposed to minimize erosion and sediment transport during construction. The proposed stormwater treatment facilities do not meet the design requirements of Chapter 1011.09 of the City Code. The applicant has designed the stormwater treatment facilities to meet the requirements of draft rules proposed by Rice Creek Watershed District. These draft rules are less stringent than what is required in the City Code, and therefore, the proposed pond is not large enough to meet City Code requirements. It is important to recognize that the existing City Code was developed, in part, to mirror the Watershed District's rules. In addition, the City Code will likely need to be revised after the District's new rules have been adopted. With this Code revision, it is anticipated that the City Code may continue to mirror the policies that are proposed in the Watershed District's draft rules. In order to address this issue, the City may consider the following options: 1. Require the applicant to increase the pond size so that it meets the current City Code. This would require the applicant to redesign the pond and increase the pond size. The easement area needed may also need to be increased, which could result in less developable space on the northern portion of the site. 2. Due to the anticipated regulatory changes, approval could be granted contingent on the following: a) Rice Creek Watershed District must adopt new rules that support the applicant's proposed design and must issue a permit to the applicant for the proposed plans. b) The City must intend to revise City Code to mirror the rules adopted by the Watershed District. c) A variance or other exception may be required as recommended by the City Attorney. This option would allow the applicant to proceed with the current plan and would recognize the anticipated regulatory changes. However, the approval is dependent on the actions of Rice Creek Watershed District to adopt new rules that support the applicant's design. In addition, the City may need to determine the extent that the proposed rules of the Watershed District are acceptable and determine intended revisions to the City Code. We recommend that the applicant be advised that this may affect how the northern portion of the site may be developed. The applicant may wish to develop a master plan for the site that considers how the northern portion of the site can be developed. 3. Detailed engineering comments should be addressed by the applicant prior to final approval. We have identified several detailed, engineering - related issues that should be addressed prior to final approval. We intend to work directly with the developer's engineer to address these comments. • It is recommended that any approvals issued be contingent on addressing these detailed, engineering comments to the satisfaction of City Staff. The proposed addition is 24 feet in height and the existing building is 44 feet in height. 3.4 Architectural Standards Architectural standards are intended to strengthen the relationship between buildings and the street. Emphasis is placed on building facades, entries and windows. Facades not within Street Setbacks • The primary building entry and windows shall be visible from a street(s). • The main entrance(s) shall open directly onto a publicly - accessible Connecting Walkway. This walkway shall connect directly to the sidewalk or pedestrian walkway of an adjacent street. • Building facades that are visible from the street shall not have a section of blank wall exceeding 30 linear feet without being interrupted by a window, entry, or a section of lattice with vines. Building Entries and Windows Entries. Building massing shall be used to highlight the location of building entries. Primary pedestrian entries shall be clearly expressed and be recessed or framed by a sheltering element such as an awning, arcade, porch, or portico. Greater height may be used to accentuate entries in the form of tower elements, tall openings, or a central mass at an entry plaza. Reveals. Windows and doors must be recessed at least two inches from walls or exterior trim to create shadow for visual interest. 4 • • • Base and Top Treatments Building facades must have three recognizable elements: a base, middle, and top. A two foot high brick base wraps around the perimeter of the building and EIFS makes up the middle element. Building materials include brick, EIFS and asphalt shingles. The clerestory provides natural lighting and a break in the roof line. Overall, the addition strikes a balance between the intent of the Development Guide and matching the existing the building. Staff is recommending the entry way onto Town Center Parkway include double doors, increased landscaping along the sidewalk and benches. The elevation plans show a double door entry; however, the floor plan shows a single door entry. Shakes shall be included in the gables along the northwest elevation similar to those shown on the southeast elevation. The Site Plan Review Worksheet, Attachment D, provides additional site plan review and comments. VARIANCE This parcel is located within the 50% build -to line which requires at least 50% of the • block length must contain building fronts, parks or plazas within 5 feet of the right of way. No variance shall be granted unless it meets all the criteria in paragraphs a. through f. or unless paragraph g. applies. The City shall make findings regarding compliance with these criteria. a. The variance shall be in harmony with the general purposes and intent of the ordinance. The general purpose and intent of the Lino Lakes Town Center Design & Development Guide is to provide for the orderly and integrated development of a high - quality Town Center which includes a mix of shops, offices, housing and open space. The build -to line requires building fronts close to the edge of the street to enhance continuity, attractiveness and intimacy of pedestrian spaces. The addition is 19 feet from the property line which matches the setback of the existing building. Additional landscaping and foundation plantings will add to the attractiveness of the pedestrian spaces. b. The variance shall be consistent with the comprehensive plan. The variance is consistent with the comprehensive plan. The land is guided for mixed use /commercial development and an assisted - living facility is allowed. c. There shall be practical difficulties in complying with the ordinance. "Practical difficulties," as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by the ordinance. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. Matching the setback of the existing building constitutes use of the property in a reasonable manner. Requiring the minimum 5 foot setback would create an "unbalanced" look and feel of the addition in comparison to the existing building. d. The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. The plight of the landowner is created by the ordinance not the landowner himself. e. The variance shall not alter the essential character of the locality. The variance shall not alter the essential character of the locality. The addition will match with the existing building setback and exterior building materials. f. A variance shall not be granted for any use that is not allowed under the ordinance for property in the zoning district where the subject site is located. Assisted living facilities are permitted uses in the commercial and mixed use districts of the Development Guide land use plan. g. In accordance with MN Stat. 462.357, Subp. 6, variances shall be granted for earth sheltered construction as defined in MN Stat. 216C.06, Subd. 14, when in harmony with the zoning ordinance. Before any further development, please address the following issues: Water Resources: It appears that a part of the site runoff may discharge downslope to the I -35W right -of- way via the low area at the proposed dumpster, which would be unacceptable. Please provide a narrative regarding the ownership and outlet of the existing stormwater pond east of the site to which the proposed stormsewer discharges. If the existing stormwater pond is owned by MnDOT, provide drainage model documentation that demonstrates no increase in peak flow for the 10 -year and 100 -year events discharged to the stormwater pond. Noise: MnDOT's policy is to assist local governments in promoting compatibility between land use and highways. Review Submittal Options: Mn/DOT's goal is to complete the review of plans within 30 days. Submittals sent in electronically can usually be turned around faster. There are four submittal options. Please submit either: 1. One (1) electronic pdf. version of the plans. Mn/DOT can accept the plans via e -mail at metrodevreviews .dot(a?state.mn.us provided that each separate e- mail is under 20 megabytes. 2. Three (3) sets of full size plans. Although submitting seven sets of full size plans will expedite the review process. Plans can be sent to: Mn/DOT — Metro District Planning Section Development Reviews Coordinator 1500 West County Road B -2 Roseville, MN 55113 3. One (1) compact disk. 4. Plans can also be submitted to Mn/DOT's External FTP Site. Please send files to: ftp: / /ftp2. dot. state. mn. us / pub /incoming/MetroWatersEdge (Planning; Internet Explorer doesn't work using ftp so please use an FTP Client or your Windows Explorer (My Computer). Also, please send a note to metrodevreviews.dot@state.mn.us indicating that the plans have been submitted on the FTP site.
