When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. APPROVAL OF MINUTES: March 13, 2013 Mr. Hyden made a MOTION to approve the March 13, 2013 Meeting Minutes. Motion was supported by Mr. Nelson. Motion carried 5 - 0. (Laden & Tralle abstained.) 6. OPEN MIKE Chair Tralle declared Open Mike at 6:33 p.m. DRAFT MINUTES Planning & Zoning Board April 10, 2013 Page 2 There was no one present for Open Mike. Mr. Hyden made a MOTION to close Open Mike at 6:33 p.m. Motion was supported by Mr. Nelson. Motion carried 6 - 0. (Tralle abstained.) 7. ACTION ITEMS A. PUBLIC HEARING for Preliminary Plat and Final Plat for Main Street Shoppes Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the Preliminary Plat and Final Plat for Main Street Shoppes. Ms. Larsen explained that the city received an application for Site Plan Review from McDonald's. She noted that any future applications for permitted use for this project will be approved by staff. Ms. Larsen explained that future development of OutlotA will require a plat submittal and will be reviewed by the board. Jason Wedel, City Engineer, explained the development process for Otter Lake Road. Staff noted that the original wetland on the site was delineated through the Rice Creek Watershed District Chair Tralle opened the Public Hearing at' 6:45 p.m. 4 Lee Perault, representing the Bernier Family Farm, stated that he sold the property to Mr. Miller and is in support of this project. He noted that development will not occur on the farm property until this development takes place. He believes this project will be good for everyone monetarily, for taxes, and for jobs in this community. He reiterated that he strongly supports this project. Ryden made a MOTION to close the Public Hearing at 6:47 p.m. Motion was supported by Mr. Laden. Motion passed 6 -0. (Tralle abstained.) Mr. Laden made a MOTION to recommend approval of the Preliminary Plat and Final Plat for Main Street Shoppes. Motion was supported by Mr. Hyden. Motion carried 6 -0. (Tralle abstained.) Staff noted that this project will be reviewed by the City Council on May 13. Project applicant, Bruce Miller of MFC Properties, thanked the board for the recommendation to approve. Mr. Miller appreciated the opportunity to speak and stated DRAFT MINUTES • • • Planning & Zoning Board April 10, 2013 Page 3 111/ that he is looking forward to this project. He noted that they are pursuing other users, but have no commitments yet. They do anticipate future development. • • B. Planned Unit Development Final Plan/Final Plat for Lino Lakes Assisted Living Addition Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the PUD Final Plan/Final Plat for Lino Lakes Assisted Living Addition. Staff explained that this project includes a Final Plan/Final Plat, Site Plan Review and a Variance. Ms. Larsen noted that vacation of a drainage and utility easement will be acted on by the council. Ms. Larsen stated that the applicant was not to attend the meeting but extended their excitement for the project. Staff noted that the application meets the seven criteria required to approve a variance. The connection between the buildings will be an enclosed walkway. The proposed additional will concentrate on memory care. Board member comments included the following: • Suggestion that the proposed shakes be expanded to a larger size. • Concern about the individual air conditioning units. (Staff is addressing.) • Concern about approving variances on a lot -by -lot basis. Not the best interest for the Legacy. Staff should consider amending ordinance requirements instead. • The design standards for the Legacy should be re- evaluated to avoid piece meal development. • Would like a 15 -foot setback requirement. • Would like to see additional benches along the pedestrian walkway. Staff noted that the city is working, with Landform to determine how this area can be repositioned to fit the current market. Staff is proposing to come back to the board with a plan later in the year. Staff added that the city is in the process of acquiring land and agreed that the development standards should be re- addressed. Mr. Wedel explained the relocation of the water main for this site. Mr. Nelson made a MOTION to approve the Final Plan/Final Plat for Lino Lakes Assisted Living Addition based on the following conditions: 1. All comments highlighted in red on the Site Plan Review Worksheet, Attachment D, shall be addressed. 2. All comments from City Engineer Letter dated March 21, 2013 shall be addressed. 3. Other comments by staff, Planning & Zoning Board, City Council and /or other agencies shall be addressed. 5. Such documentation shall be issued by the respective agency. 6. Cover /title sheet for plan set shall be provided. 7. Final Plat: a. Highway shall be spelled correctly for Interstate Highway 35W written within right of way. b. Cross Access Easement shall be extinguished c. New drainage and utility easement over relocated watermain shall be shown on final plat or recorded separately. d. One (1) up -to -date (within 3 months). title insurance commitment for the property being subdivided shall be provided. e. Cost estimates for public and private improvements shall be provided. f. A Development Contract shall be drafted by the City and signed by the applicant. 8. Elevations a. Shakes shall be added to northwest elevation similar to southeast elevation. b. Should a decorative louver be incorporated into gable? c. Double doors as shown on southeast elevation shall be constructed to emphasize building entry. d. More detail shall be provided for individual air conditioning units. Units shall be flush mounted, color matched and integrated into the building elevation. 9. Site Plan- a. New concrete sidewalk along northwest side shall be extended and connect to existing sidewalk. b. Parking stall calculations shall be shown on sheet. c. ` Driveway setback shall be 5 feet from side yard. d. Variance required for 19 foot front yard setback. e. Snow removal /piling shall not occur within required parking stalls. Height of future canopies shall be provided. Landscape .Plan a. Foundation planting shall be required. See Site Plan Review Worksheet. b. Planting bed around foundation perimeter shall be installed. c. Contingent upon 21st Avenue N being extended, the proposed preliminary plat is not considered premature and it meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The preliminary plat identifies the creation of Lot 1 and Lot 2, Block 1, Alino Addition. Lot 1, Block 1 is the proposed site of the Metro Transit Park and Ride. Lot 2, Block 1 has no immediate plans for development, grading, utility extensions, roadways etc. and shall be renamed Outlot A until future development is proposed. Streets and Alleys The development of the site is contingent upon the extension of 21st Avenue N. The extension shall run the full length of the plat from CSAH 14 to the northern boundary. The street shall be designed to City standards as a minor collector. The subject site will be accessed by internal private drives and roadways. See Comprehensive Plan - Transportation section below. Easements The standard drainage and utility easements are proposed around the interior perimeter of Lot 1, Block 1 and storm water ponding areas as required. A twenty -five (25) foot easement is provided around the wetland boundary. A drainage and utility easement wide enough for the access and maintenance of the public utilities in the private access drive shall be provided. The width of the easement shall be determined by the City Engineer. Storm Water Management and Erosion and Sediment Control A storm water management area/pond is proposed in the southeast quadrant of Lot 1, Block 1. The stormwater management plan and SWPPP shall be reviewed by the City Engineer, Environmental Coordinator and Rice Creek Watershed District for compliance. Utilities Public water, sanitary and storm sewer utilities shall be installed in conjunction with the construction of 21st Avenue N. Public water and sanitary utilities shall also be extended under the private access drive to serve the subject site and shall be protected by an easement. Future development of Outlot A shall require the extension of either public or private utilities. COMPREHENSIVE PLAN Resource Management System The Resource Management Plan identifies a proposed north -south trail and greenway system in the subject site area. A trail /sidewalk is being installed as part of the 21st Avenue N extension and the greenway system runs along the eastern property line and I- 35E. Land Use Plan As identified above, the land use is guided for commercial development and is within the 2020 MUSA and 1A Utility Staging Area. Economic Development Plan Key goals of the Economic Development Plan are to expand and diversify the city's tax base and promote planned expansion within the City's growth areas and accessibility to public infrastructure. The I -35E Corridor has been identified as a key development area and "gateway" to Lino Lakes. 4 • • • • Transportation Plan Per the Transportation Plan, the 21st Avenue N extension is classified as a minor collector. This route will serve as the main north -south route running parallel between I -35E and CSAH 54 and is critical to the development of this corridor. Future construction of 21st Avenue N shall extend north and connect to CAH 54 just south of 80th Street E. 21St Avenue N shall be extended the full length of the property. A private drive will provide access to the proposed Metro Transit Park and Ride facility. Future development of Lot 2, Block 1 (to be renamed Outlot A) will require a full access intersection at this private drive. A right in/right out may be allowed south of this intersection upon development. Transportation includes all multi -modal systems which accommodate pedestrians, bicycles, roadways and transit. The Park, Greenway & Trail System Plan identifies the need for a proposed north -south City trail which will be installed with the extension of 21St Avenue N. Planning Districts The project area is located in Planning District 3 and the Clearwater Creek Resource Management Units (RMU). A greenway system is identified on the east side of the subject property. This system was the original drainage way along the freeway and was removed as part of the I -35E interchange reconstruction. ALTERNATIVE URBAN AREAWIDE REVIEW (AUAR) The subject site is within the I -35E Corridor AUAR and is subject to the AUAR mitigation plan. Overall, the proposed subdivision complies with the AUAR mitigation plan in regards to natural resources, erosion control, surface water runoff, wastewater, cultural resources and farmlands. A major component of the AUAR is traffic and supporting transportation corridors. The reconstruction of the I -35E interchange has provided additional roadway capacity along the CSAH 14 corridor. The project also included transit accommodations along the southbound ramp to facilitate bus service to this area. No additional traffic study is necessary at the time; however, future development may require further analysis. The extension of 21st Avenue N is identified as an important roadway improvement. RECOMMENDATION Staff recommends the approval of the preliminary plat of "Alino Addition" subject to the following conditions: 1. All comments from City Engineer Letter (to be provided) shall be addressed. 2. All comments from City staff, Planning & Zoning Board, City Council and other agencies shall be addressed. 3. Documentation that the applicant has submitted to the Rice Creek Watershed District a complete application as defined by those agencies. 4. Revisions to Preliminary Plat: a. Lot 2, Block 1 shall be renamed Outlot A. b. Provide drainage and utility easement over public utilities located in private drive of sufficient width as determined by the City Engineer. c. Provide drainage and utility easement over storm water ponds. 5. Preliminary Plat approval is contingent upon Joint Powers Agreement being established with City of Centerville regarding right of way and utilities. 6. 21st Avenue N shall be extended the full length of the property from CSAH 14 to the northern boundary. 7. A Petition and Waiver Agreement regarding public improvement construction and assessments shall be drafted by the City and signed by the owner or a Development Contract regarding public road and utility improvements shall be drafted by the City and signed by the owner. 8. Final plat approval requirements: a. A Development Contract shall be drafted by the City and signed by the owner. b. A Declaration of Access Control for future right in/right out access shall be drafted by the City and signed by the owner. c. A Declaration for Maintenance of Stormwater Facilities shall be drafted by the City and signed by the owner and Rice Creek Watershed District. d. A Reciprocal Access Easement and Maintenance Agreement shall be drafted by the City and signed by the owner. REQUESTED MOTION Motion to recommend the City Council approve the preliminary plat for Alino Addition, subject to the conditions listed in the staff report. Preliminary Plat for Alino Addition prepared by SRF Consulting Group dated April 9, 2013. 2. Construction Plans for Metro Transit prepared by EVS received on April 17, 2013. Preliminary Plat Comments: 1. It should be noted that the design for 21st Avenue has not yet been initiated. The design of 21St Avenue will likely necessitate easements for storm water ponding, pedestrian trails, and other design features on Lot 2 Block 1. The property owner will need to agree to provide these easements once they are identified. 2. The proposed right of way dedication for the extension of 21st Avenue must be increased to 60 feet in width from the intersection with CSAH 14 north through the proposed full access intersection. This is necessary to accommodate the 21st Avenue improvements. North of the full access intersection the right of way can be reduced to 40 feet. 3. It should be noted that there will only be allowed one full access intersection with 21st Avenue for the entire site. Therefore, the proposed full access will need to serve not only the Metro Transit facility but the remainder of the site. A second right - in/right -out access maybe allowed to the south in the future when the balance of the site develops. 4. The location of the proposed full access intersection with 21st Avenue does conform with the City's access spacing guidelines. However, the proposed location will result in wetland impacts when the private roadway is extended east in the future to serve the balance of the property. The property owner will need to obtain the necessary approvals from all governmental agencies with jurisdiction over that wetland prior to any impacts. 5. The drainage and utility easements shown on Lot 1, Block 1 will need to include the proposed storm water pond. 6. The applicant will need to provide evidence of approval from the Technical Evaluation Panel for the wetland delineation that was completed per the report dated April 2012 prepared by SRF. Confirmation is needed to ensure that the proposed drainage and utility easement is sufficient. The drainage and utility easement shown for the lateral sanitary sewer and watermain connections with 21st Avenue is inadequate. The easement needs to be 40 feet in width, centered on the proposed sanitary sewer. 8. The drainage and utility easements around the perimeter of Lot 1 Block 1 exceed the City's requirements. The easement along 21st Avenue can be reduced to 10 feet and the easement along the north property line can be reduced to 5 feet. 9. The plat needs to be revised to included Lot 1 Block 1 for the Metro Transit site and the remainder of the property should be shown as an outlot, not Lot 2 Block 1. Construction Plan Comments: It should be noted that due to the lack of construction plans for 21st Avenue, a significant portion of the submitted construction plans for Metro Transit cannot be reviewed. However, some general comments are provided below. 1. The City details need to be modified so that they are legible. 2. The sanitary sewer, watermain, and storm sewer cannot be reviewed until the 21st Avenue design has been completed. 3. The proposed watermain must be 8" DIP Class 52. 4. Fire hydrant must be a Waterous WB -67. 5. The proposed sanitary sewer must be 8" PVC SDR 35. 6. The proposed sanitary sewer service must be 4" PVC Schedule 40. 7. Sanitary sewer services must utilize a wye connection and not connect directly to the manhole as currently shown. 8. There needs to be a minimum of 18" separation between sewer and watermain crossings. The detail in the plans only shows 10 ". 9. Drainage calculations will need to be provided. 10. The storm sewer manhole detail provide must be replaced with the City standard detail. 11. Permits will be needed from RCWD, MDH, MPCA- sanitary sewer, MPCA — NPDES. 12. The plans need to show the proposed bituminous trail along the east side of 21st Avenue. 13. The grading plan needs to include labels for the existing contours. The proposed contours also just end in several locations without tying into any existing contours so that will need to be addressed. 14. The parking lot is proposed to be very flat and we have concerns with the grades and lack of storm sewer, including a low point where no storm sewer is proposed. This is a not complete list of all of the items that will need to be addressed on the construction plans and additional comments will be likely once complete plans are submitted for review.
