City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. APROVAL OF AGENDA The Agenda was approved as presented. 3. APPROVAL OF MINUTES: October 9, 2013 Mr. Masonick made a MOTION to approve the October 9. 2013 Meeting Minutes. Motion was supported by Mr. Nelson. Motion carried 4 - 0. (Hyden, Root & Tralle abstained.) 4. OPEN MIKE Chair Tralle declared Open Mike at 6:30 p.m. There was no one present for Open Mike. Mr. Hyden made a MOTION to close Open Mike at 6:31 p.m. Motion was supported by Mr. Evenson. Motion carried 6 - 0. (Tralle abstained.) CONTINUED UBLIC HEARING to consider a rezone of property located at 7880 Sunset Avenue (PID #07- 31 -22 -23 -0004) from R -Rural to PUD- Planned Unit Development and an Amendment to the Development Stage Plan/Preliminary Plat of Century Farm North to expand project boundary and include certain property located at 7880 Sunset Avenue Katie Larsen, City Planner, recommended continuing the Public Hearing as staff is awaiting revised plans from the applicant. Mr. Hyden made a MOTION at 6:32 p.m. to continue the Public Hearing to the next meeting. Motion was supported by Mr. Laden. Motion carried 6 - 0. (Tralle abstained.) B. PUBLIC HEARING to consider rezoning and a PUD Development Stage Plan/Preliminary Plat for a 55 lot residential development to be called Saddle Club, located at 1403 Birch Street, PIN 28- 31 -22 -34 -0001 Katie Larsen, City Planner, presented the staff report. Ms. Larsen explained the history of the site and that a Planned Unit Development would allow flexibility from the normal requirements. Staff stated that the result of this proposed development would be similar to the neighboring Foxborough and Preserve developments. The proposed development will contain four outlots of preserved wetlands. Staff clarified that neighboring property owners on Old Birch Street will not be assessed for utility improvements, however neighboring properties will have utilities available to them if they choose to connect in the future. Connection fees would be due if and when property connects to utilities. Staff explained the proposed trail extensions and tree preservation plans for the site. Staff noted that a traffic study was completed and that modifications along Birch Street and Old Birch Street would be further analyzed. Staff intends for the Environmental Board to review the tree mitigation plan once it is completed. Following discussion by the board, staff noted that the east/west portion of Old Birch Street will be improved and that the city intends to work with property owners to complete the connection to Fox Road as quickly as possible. Board member comments included the following: - Concerned about increased traffic on Birch Street. - Are there traffic calming measures that could be considered, such as medians, etc. DRAFT MINUTES • • • • • • Planning & Zoning Board November 13, 2013 Page 3 The city should consider requiring a turn lane on Birch Street near the church by Old Birch Street Connection to the Foxborough development is important as soon as possible. Exiting Old Birch Street onto Birch Street is very difficult The development should include sidewalks so that pedestrians are not using the street as part of a trail Request that the item come back before the board for additional review Staff noted that they have received comments from residents and issues will be addressed with the applicant and the county. Staff received comments from Anoka County prior to the meeting, but without time for review. Staff stated that safety issues on Birch Street are a top priority. The city will evaluate site lines and consider safety measures such as turn lanes and additional signage of advisory speeds in the area. Applicant, Mike Black, was present on behalf of the developer. Mr. Black noted that they will work with staff to reduce some of the lot sizes in order to expand the outlot area. Mr. Black explained that they have been planning this project for six months and the developer has not come across any issues that they will not be able to address. Mr. Black understands the importance of the city's trail system and is in favor of connecting trails. He expressed concern with trails that go between lots. He believes that the trails as proposed would adequately address the trail connection. Mr. Black pointed out that due to the insignificant amount of traffic that would be at the end of the proposed cul -de -sac, a trail along the road would not be merited. He also did not agree with providing a sidewalk along Pheasant Run, noting that this would be the only development with a sidewalk along that street. Mr. Black stated that they will continue to work with staff to address any other concerns. Chair Tralle declared the Public Hearing open at 7:39 p.m. Linda Dawson. 877 Fox Road, lives at the end of Fox Road. Ms. Dawson stated concern for increased traffic in the area as well as potential impact to trees. She was concerned about the proposed road connection to Foxborough and traffic going to and from Old Birch Street. Ms. Dawson distributed a photo of the trees that currently exist where a future road is proposed. She was also concerned about the environmental impact to the neighborhood. Gary Foster, 882 Old Birch Street, owns four acres adjacent to the proposed development. Mr. Foster stated concern for poor street conditions and increased traffic issues. He was very concerned for the lack of maintenance to Old Birch Street and that no improvements are proposed to that road by the city. Mr. Foster expressed that neighboring property owners should have been previously informed of plans for DRAFT MINUTES Planning & Zoning Board November 13, 2013 Page 4 development. He was concerned about potential increased damage to Old Birch Street, the difficulty to get onto Birch Street, and a decrease in property values. Mr. Foster stated that improvements are needed to reduce accidents on Birch Street, such as turn lanes. He expressed concern that the residents will be charged to fix a road that may be damaged by development. Mr. Foster asked the board to consider the needs of the residents. Joe Fehn, 878 Fox Road, commented that development to this area was denied in the past due to traffic, and now more houses are being proposed. He wondered what is being done to improve the traffic situation. He was concerned with safety and traffic in a condensed area and access to Birch Street. Randall Graczyk, 886 Fox Road, wondered why the neighborhoods have to be connected. He commented that it would be safer to have individual developments with less traffic. He does not see the need for the road extension to Fox Road. He agrees that improvements need to be made to Birch Street. Rick Capocasa, 886 Old Birch St, stated concern for traffic. He stated that the intersection at the north end of Old Birch Street is dangerous due to traffic and speed of cars. He pointed out that a light was installed at Birch /Ware to reduce accidents. He added that improvements will need to be made to reduce accidents at the s- curve. Char Foster, 882 Old Birch Street, stated that it would be useful for residents to see the list of engineering concerns. Ms. Foster stated her concerns with traffic, adding that traffic needs to be analyzed and addressed. She would have preferred the opportunity for neighboring residents to discuss the potential development with the developer. Bob Mueller, 882 Fox Road, agreed with traffic concerns on Birch Street, adding that turn lanes are well needed. Mr. Mueller stated concerns with connecting Fox Road to the proposed development. He does not consider the connection to be a benefit to most property owners and would prefer keeping the existing cul -de -sac in Foxoborough, unless the connection is for emergency vehicle purposes. He noted that the property owners in the proposed development may prefer a cul -de -sac as well. Mr. Fehn added that development is increasing in Centerville and the traffic will get worse. Marilyn Anderson, 884 Old Birch St, stated that this property used to be her family farm and she had no objections to the plat. She stated concern that the north -south section of Old Birch Street is decaying. She noted that it is city policy to not spend a lot of money to improve streets. She pointed out that there is going to be an increase in traffic and the street will further decay. She is concerned that the few residents that live on Old Birch Street are going to have to pay for its reconstruction. Ms. Anderson added that she does not foresee the charter being amended. She is concerned with residents paying for improvements to Old Birch Street. DRAFT MINUTES • • • • Planning & Zoning Board November 13, 2013 Page 5 Sharon Gervais, 890 Old Birch St, stated concerns with speed of traffic and increased traffic. She stated that there needs to be a speed limit sign on Old Birch Street as drivers go faster than the speed limit. She said that traffic needs to slow down. She is not in favor of the proposed development. Jason Wedel, City Engineer, acknowledged that there needs to be further analysis of traffic on Old Birch Street. The city will continue to work with Anoka County to analyze site distance and traffic safety for accessing Old Birch Street. The issue is not resolved and will be further addressed. The city will continue to review the best options for the north/south section of Old Birch St. Staff will bring back considerations for the board to review at a future meeting. Chair Tralle addressed the concerns of the residents, including: • The city posted signs alerting residents of the future connection of Fox Road • Interconnection of neighborhoods is necessary for emergency vehicle access • This area is able to develop now due to access to utilities that were not available in the past • The board will do their best to address traffic concerns • An installation of a speed limit sign on Old Birch Street should be feasible • The board is working in favor of the residents and will strive to achieve the best possible outcome for everyone • The engineering report is typical of any development • Staff will make the engineering report accessible to the public via the city website Linda Dawson said that the connection of Fox Road was being proposed sooner than she was expecting. She asked about potential development of neighboring properties. Staff addressed the neighboring properties as shown on the public hearing notice and explained areas of wetlands and areas for potential future development. Ms. Dawson was concerned with the amount of money that goes into developments. She appreciates the conservation wetland developments. She stated issues with taxpayers paying for road improvements. Michael Grochala, Community Development Director, clarified that the developer will be paying for 100% of the costs of the improvements on this project. The developer would pay for all new roads and utilities for this development. The developer would pay a park dedication fee per lot, of which the city would credit back for any park improvements such as trails. Any improvements to Old Birch Street necessitated by this development would be the responsibility of the developer, such as disturbances due to utility extension. Mr. Grochala reiterated that no assessments are being proposed to any of the properties abutting this project. Staff explained how the trunk area fee is collected by the city. DRAFT MINUTES Planning & Zoning Board November 13, 2013 Page 6 Mr. Grochala pointed out that neighborhood meetings are optional as part of a proposed development, but encouraged by staff. Staff agreed to continue to work with the developer to address concerns and bring the item back to the next meeting. Chair Tralle thanked the residents for their participation and invited them back to the next meeting for updates. Mr. Laden made a MOTION to continue the Public Hearing at 8:28 p.m. Motion was supported by Mr. Nelson. Motion carried 6 - 0. Board members encouraged residents to educate themselves with the city charter to learn about the process to improve roads. Staff invited residents to attend an informational meeting at city hall on Monday. November 18, 2013 at 5:30 p.m. to learn about the public improvement process. C. Final Plat for Alino Addition Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the Final Plat for Alino Addition. The developer representative was present for any questions by the board. Mr. Nelson made a MOTION to recommend approval of the Final Plat for Alino Addition based on the following conditions of approval: 1. Comments from the City Engineer Letter dated October 28, 2013 shall be addressed. 2. A Development Contract shall be drafted by the City and executed by the City and the owner. 3. A Declaration of Access Control for future right in/right out access shall be drafted by the City and executed by the City and owner. 4. A Reciprocal Access Easement and Maintenance Agreement shall be drafted by the owner and approved by the City. 5. Sheet 1 of the Final Plat shall be revised to include "...hereby dedicate to the public for public use the public way and the drainage and utility easements as shown by this plat" 6. An up -to -date (within 3 months) title insurance commitment for the property being subdivided shall be provided. 7. The legal description on the title commitment does not match the final plat. 8. The legal description on the preliminary plat does not match the final plat. 9. The title commitment only shows Richard Schreier as fee simple owner but the final plat has both his name and Alino, LLC signing 10. This will be the second PUD Amendment to Century Farm North. The applicant is requesting an amendment to the Development Stage Plan/Preliminary Plat of Century Farm North to include a 0.991 acre parcel located 7880 Sunset Avenue owned by Jeff Morell. This parcel is currently zoned R -Rural and requires rezoning to Planned Unit Development in conjunction with Century Farm North. The project also includes the realignment of Robinson Drive. The current PUD/Preliminary Plat as it relates to Century Farm 5t` Addition has 10 detached single family lots and 16 single family lots. The proposed rezoning, PUD amendment and road realignment will create an additional 12 single family lots and convert the 10 detached single family lots to single family lots. A portion of dedicated parkland will need to be vacated to accommodate 3 proposed new lots. The Park Board will review the proposal and make recommendation and the City Council will hold a public hearing. ANALYSIS None. RECOMMENDATION Staff recommends continuing the public hearing from the June 12th Planning and Zoning Board Meeting and requests the applicant resubmit plans addressing all conditions listed in the previous Staff Reports. A preliminary and final plat for Marshan Meadows Second Addition proposing to subdivide the same Lot 1, Block 1, Marshan Meadows into two (2) residential lots was submitted in 2007 by Bruggeman Properties. The City Council approved the preliminary plat (Resolution No. 08 -07) and final plat (Resolution No. 08 -08); however, the final plat was not recorded and has since expired. The residential home on Lot 1, Block 1, Marshan Meadows (7332 Stagecoach Trail) was constructed in 2010. With approval of the new plat, the existing home will become Lot 1, Block 1, Marshan Meadows Second Addition and Lot 2, Block 1, Marshan Meadows Second Addition will be sold for the purpose of constructing a single family home. If the garage door faces the street, the length of the garage wall facing the street shall not be greater than fifty percent (50 %) of the length of the entire front facade of the structure; except on houses that comply with all of the following conditions: 1) The second floor living space extends over the two -car portion of the garage; and 2) The garage doors are decorative and have a strip of windows; and 3) Garages in excess of two stalls shall be broken up so the additional stalls are recessed four feet from the main garage facade; and 4 • • • • 4) Garage width does not exceed 32 feet. 4 All dwellings shall comply with the Design and Construction Standards of Section 3, Subd. 4.B. The subdivision amendment is not considered premature, is consistent with the comprehensive plan and meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The plat creates 1 block with 2 lots. Lot 1, Block 1 has an existing home. Lot 2 is intended to be developed with a single family home. Streets and Alleys Stagecoach Trail is an existing local road and can accommodate 1 additional single family home. Easements Standard drainage and utility easements are proposed around the interior perimeter of lots. A conservation easement currently exists over the wetlands and floodplain area as indicated on the preliminary plat. 5 Storm Water Management and Erosion and Sediment Control Storm water will be managed through the existing Marshan Meadows system. Appropriate soil erosion and sediment controls shall be employed during construction of the single family home. A grading and drainage plan shall be submitted to the City Engineer and Rice Creek Watershed District for review and approval. Utilities Public water, sanitary and storm sewer utilities exist along Stagecoach Trail and are adequate in size for the addition of one (1) single family home. Public Land Dedication The City will require payment in lieu of land dedication for purposes of public land dedication. Since park dedication fees were paid for the existing lot at the time Marshan Meadows was platted, fees will only be required for the newly created lot (Lot 2). 1 lot x $2,500 payment in lieu = TOTAL $2,500 Tree Preservation A tree preservation plan is not required. The buildable area for Lot 2, Block 1 has been rough graded and no significant trees exist. No grading or tree removal should occur beyond the silt fence and construction limits. Landscaping One (1) boulevard tree shall be required on Lot 2, Block 1. Final Plat Staff is recommending the preliminary and final plat be reviewed and approved together. The developer /applicant shall enter into a Development Contract and other documents as the City deems necessary. Comprehensive Plan The proposed addition of one (1) single family lot for Marshan Meadows Second Addition is in compliance with the Comprehensive Plan in terms of Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan. 6 • • • Wetlands Wetland delineation was completed by Kjolhaug Environmental Service in October 2004 and located by Passe Engineering per plans of Marshan Meadows. Per Rice Creek Watershed District letter dated November 7, 2013, a new delineation is not required since no impacts to the wetlands are proposed. Floodplain The FEMA Floodplain Zone AE is located on the preliminary plat. The 100 -year regulatory flood elevation on the property is 887.0 feet according to RCWD. No impacts to the floodplain are proposed. Shoreland Management Overlay District Land located within 1,000 feet from the ordinary high water level of a public water is subject to the Shoreland Management Overlay District. The proposed subdivision abuts Marshan Lake which is classified as a Natural Environment Lake. The Shoreland Overlay District regulates lot area, lot width and impervious surface. The proposed subdivision meets those criteria as noted above in the report. The Shoreland Overlay also regulates structure setbacks. A 150 foot setback from the ordinary high water level (OHWL) is required for all principal and accessory structures. This includes decks, patios and sheds. This setback extends into Lot 2 which limits the buildable area of that lot. It is important to note the difference between the following definitions: Buildable Area. The portion of a lot remaining after yards have been provided. Buildable Land, Contiguous. Land area occurring within the property lines of a parcel or lot excluding wetlands and /or water bodies. The buildable area of Lot 2 is approximately 3,000 square feet. The buildable land area is 20,116 square feet. It is also important to note the permitted front setback in the R -2, Two Family Residential District is 25 feet. The zoning ordinance was amended in 2012 (Ord. 03 -12) which decreased the front setback from 30 feet to 25 feet. Variance The Shoreland District references a front setback of 30 feet which was consistent with the underlying zoning district; however, when the R -2 zoning ordinance was amended to 25 feet, the Shoreland District was not amended to reflect the change in the front setback. A variance is required from the Shoreland Overlay District. Criteria and Findings of Fact. No variance shall be granted unless it meets all the criteria of Section 2, Subd. 4.A.1.(a -g). The City shall make findings regarding compliance with these criteria. a. The variance shall be in harmony with the general purposes and intent of the ordinance. The intent of the Shoreland Overlay District in regards to structural setbacks from public street right of way is to be consistent with the underlying zoning ordinance. The variance would allow a 25 foot setbackfrom the public street right of way which is consistent with the R -2, Two Family zoning district. b. The variance shall be consistent with the comprehensive plan. The variance is consistent with the comprehensive plan. The land is guided for Low Density Sewered Residential development and single family homes are allowed. c. There shall be practical difficulties in complying with the ordinance. "Practical difficulties," as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by the ordinance. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. The property owner proposes to use the property in a reasonable manner not permitted by the ordinance. The construction of a single family home in a residential neighborhood is using the property in a reasonable manner. The practical difficulty of the 30 foot Shoreland Overlay district front setback is not consistent with the underlying zoning front setback requirement of 25 feet. The practical difficulty is also compounded by the required Shoreland Overlay District 150 foot setbackfrom the OHWL which limits the buildable area of the lot. d. The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. The Shoreland Overlay District ordinance should have been amended when the Zoning Ordinance was amended in 2012 to reflect setback consistency with the underlying zoning district. e. The variance shall not alter the essential character of the locality. The variance shall not alter the essential character of the locality. The construction of a single family home in a residential neighborhood is consistent with the essential character of the locality. The R -2 Two Family District allows for a 25 foot front setback. 8 • f. A variance shall not be granted for any use that is not allowed under the ordinance for property in the zoning district where the subject site is located. Single family homes are permitted uses in the R -2, Two Family zoning district. g. In accordance with MN Stat. 462.357, Subp. 6, variances shall be granted for earth sheltered construction as defined in MN Stat. 216C.06, Subd. 14, when in harmony with the zoning ordinance. Not applicable. RECOMMENDATION The City Engineer reviewed the plans and has no issues. Staff recommends approval of the preliminary and final plat of Marshan Meadows Second Addition with the following conditions: 1. All comments from the RCWD letter dated November 7, 2013 shall be addressed. 2. A Development Contract shall be drafted by the City, executed by the City and the owner and recorded with Anoka County. 3. An up -to -date (within 3 months) title insurance commitment for the property being subdivided shall be provided. 4. Prior to issuance of a building permit a. The final plat and Development Contract shall be recorded with Anoka County. b. A building permit shall be submitted and approved. c. A grading and drainage plan shall be submitted to the City Engineer and Rice Creek Watershed District for review and approval. 5. One (1) boulevard tree shall be required on Lot 2, Block 1. 6. Revisions to Plan Sheet PP -1 -Cover Sheet a. Zoning shall be revised from R -1 to R -2, Two Family Residential District b. Rear setback shall be revised from 30 feet to 25 feet. 7. Our understanding of the situation is that you have entered in to a purchase agreement to sell the southern lot, recently split, for the purposes of new home construction by the buyer. After reviewing the proposal against RCWD Rules, it appears that a RCWD permit will not be required for this activity. Based on the limited building envelope that is determined by municipal setbacks, construction must be limited to the point where it will not threaten wetland or floodplain areas on the site. Appropriate soil erosion and sediment controls must, of course, be employed during construction to protect these areas. Also, new impervious surface on the site cannot exceed 10,000 square feet. The new owner should notify the RCWD of their intent to construct a new home once a final grading plan is developed. The RCWD would like to confirm at that time that no floodplain or wetland fill will take place. The 100 -year regulatory flood elevation on the property is 887.0 feet (NAVD 88 datum). ANALYSIS Rezoning The property is currently zoned R, Rural and requires rezoning to PUD - Planned Unit Development. The following building design standards shall apply to the single family lots as minimum PUD standards which mirror the R -2 District. 1. The minimum footprint, less garage area, for a single family dwelling unit shall be as follows: 3 Bedroom Rambler 2 Bedroom Rambler 1 -1/2 Story Split Foyer/Entry Split Level - 3 level minimum Two Story 1,050 square feet 1,010 square feet 980 square feet 980 square feet 980 square feet 850 square feet 2. All single family dwellings shall have a double garage and shall comply with the following: a. Compliance with the Building Type and Construction Standards of Section 3. Subdivision 4.B, and b. All garages, except side or rear loaded garages, shall not protrude forward of the front wall of the house, unless the house includes a front porch that is unenclosed, a minimum of 8 feet in depth, and extends across 100 percent of the front facade of the house. The garage shall then not protrude forward of the front porch, and c. If the garage door faces the street, the length of the garage wall facing the street shall not be greater than fifty percent (50 %) of the length of the entire front facade of the structure; except on houses that comply with all of the following conditions: 1) The second floor living space extends over the two -car portion of the garage; and 2) The garage doors are decorative and have a strip of windows; and 3) Garages in excess of two stalls shall be broken up so the additional stalls are recessed four feet from the main garage facade; and 4) Garage width does not exceed 32 feet. Staff would like to have further conversations with the developer regarding the garage and porch designs. The following are suggested PUD flexibilities: 1. Front porches may be 6 feet in depth vs. 8 feet. 2. The garage may protrude forward of the porch. How far forward needs to be determined. 3. The length of the garage may exceed 50% of the length of the entire front facade of the structure. 4. Garage side elevations should have windows. 5. All garage doors shall be decorative and have a strip of windows. 6. Garages in excess of two stalls may be broken up so the additional stalls are recessed one (1) foot from the main facade vs. four (4) feet. 7. Stone or brick should be incorporated into the garage elevation. The proposed rezoning and PUD is not considered premature and meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The preliminary plat creates 13 blocks with 222 lots and 7 outlots. The outlots are protected wetland /conservation areas, stormwater management ponds, and future residential development. Outlots A, B, D and G will be deeded to the City. The lots vary in width, depth and lot size as allowed per the PUD flexibility. Streets and Alleys CSAH 54 (20th Avenue S) is an "A" Minor Arterial- Reliever and Cedar Street W is a local road. The Comprehensive Plan identifies the need for a minor collector road extending north -south through the development. Street A is consistent with the access spacing proposed in the I35E Alternative Urban Areawide Review (AUAR) and Anoka County Highway Department Access Spacing Guidelines. The local roads within the development will have 50 and 60 foot right of way widths and 28 and 32 foot wide paved road surface. Temporary cul de sacs shall be required at the end of future street connections. Easements Drainage and utility easements at least 10 feet wide are provided along all lot lines. Drainage and utility easements shall also be dedicated over stormwater drainage ponds and wetlands. A conservation easement is proposed over Outlot G. A private power line easement extends across the northwest corner of the site. Please note that accessory structures are not allowed in easements areas. Storm Water Management and Erosion and Sediment Control According to the Stormwater Management Plan as prepared by Carlson McCain, the site has three cachment basins and stormwater currently drains south and east to an existing ditch that outlets under I35E, to the west to 20th Avenue South ditch or to the north to Cedar Street ditch. To manage stormwater from the site, five (5) stormwater ponds and two (2) biofiltration basins /ponds will be constructed. The basins will generally outlet to the wetland and ditch complexes in the south and north portions of the site. To address volume reduction, the site will utilize biofiltration as well as a water reuse system for the irrigation needs of a portion of the site (parkland). The stormwater management plan shall be reviewed by the City Engineer, Environmental Coordinator and Rice Creek Watershed District for compliance. Utilities Public water, sanitary and storm sewer utilities will be installed with the development. The site is located in Sanitary Sewer District 3 (Sub- district 3C) and is served by a MCES Interceptor 76 -51, a 24 -inch gravity sewer in Cedar Street The gravity sewer main is located approximately 400 feet to the east of the north boundary of the development and is adequate in size for development of the site. The trunk sanitary sewer main will extend from the existing MCES interceptor south on Street C into the development. The site is served by a 16 inch trunk watermain located along CSAH 54 (20th Avenue) and Cedar Street. An 8 inch trunk watermain will extend from Cedar Street south along Street C into the development and loop along Street A to the existing watermain on 20t Avenue South. Public Land Dedication The City will require combined land dedication and cash in lieu of land. The proposal dedicates 5.04 acres of parkland. A trail is also proposed which extends from the southeast through the wetland and park to the north to Cedar Street West. The construction costs of the trail will be credited from the total payment in lieu. The park will be deeded to the City. The Park Board will review the proposed plans in January 2014 and will provide further analysis of the public land dedication and trail system. Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. The applicant has submitted a Tree Preservation Plan which identifies significant trees that will be saved and removed. The Plan shall be revised to comply with Section 3, Required Screening, Landscaping and Buffer Yards of the zoning ordinance. The Environmental Board will review the proposed plans in January 2014 and provide comment the tree preservation plan. Landscaping Boulevard trees are required at the rate of one (1) tree per lot frontage for single family and two family lots. Open areas shall be landscaped in accordance with City standards. . Landscape screening and buffers shall be installed along 20th Avenue and I -35E in accordance with City standards. Noise mitigation techniques along I -35E near the multi- family complex shall be required at the time of development. 8 • • The Plans shall be revised to comply with Section 3, Required Screening, Landscaping and Buffer Yards of the zoning ordinance. The Environmental Board will review the proposed plans in January 2014 and provide comment the landscaping plan. Comprehensive Plan Resource Management System The Resource Management System Plan identifies the following needs in the area: • Future neighborhood park • Designated bike route along CSAH 54 (20th Avenue) • Trails • Greenway system The development addresses the elements of a neighborhood park, trails and greenway system. A preliminary survey finds no threatened or endangered species on the property or in the immediate vicinity. The greenway system extends along the southeast quadrant of the site which coincides with the existing floodplain, drainage ditch and wetland areas and will be protected with dedicated easements. Land Use Plan As identified above, the land use is guided for medium density residential development and is within the 1A and 1B Utility Staging Areas. The proposed project will also require a City Council resolution to amend the five (5 ) year Utility Staging Area boundaries since the site spans two different areas (1A and 1B . Housing Plan ) Key goals of the Housing Plan are to ensure housing development is compatible with existing and adjacent land uses, improve availability of affordable and life -cycle housin and enhance opportunities for senior housing. Future land use for adjacent parcels is g guided for residential development. The mix of housing densities provides for life -cycle housing. The multi - family residential complex is proposed for senior housing. Transportation Plan The local roads within the development will have 50 and 60 foot right of way widths and 28 and 32 foot wide paved road surface. 9 • A key goal of the Transportation Plan is to promote alternative transportation such as bicycling, walking, transit and rail. The Comprehensive Plan proposes a designated bike route and trail along 20th Avenue South as well as a trail connecting the greenway. Right of way is being dedicated along 20th Avenue South (CSAH 54) to accommodate future bike routes and trails. An eight (8) foot wide bituminous trail is proposed throughout the development which extends from the southeast around the wetland and park, along Street C and I then north around the wetland to Cedar Street West. A five (5) foot wide concrete sidewalk will be installed along Streets A, B, and C. A Traffic Impact Study was prepared by Westwood Professional Services (November 2013) on behalf of the developer to analyze traffic impacts to and from 20th Avenue South (CSAH 54) and Cedar Street West. Conclusions from the study include 186 total AM Peak hour trips and 242 total PM Peak hour trips and all development intersections will operate at a Level of Service A (LOS A) in the 2019 No -build and 2019 Build conditions. Recommendations include turn lanes and modified traffic control at Street A and 20th Avenue South. In 2011, Anoka County and the City partnered on the CSAH 34 (Birch Street) Corridor Study. The study noted a traffic control signal at the intersection of CSAH 34 (Birch Street) and CSAH 54 (20th Avenue) may be warranted in the future. Anoka County Highway Department is in receipt of the plans and will provide additional comments on the development. Planning Districts The development is located in Planning District 3 and is guided for medium density residential development. This area was included in the I -35E AUAR Study. Alternative Urban Areawide Review (AUAR) The site is within the 2005 I -35E Corridor AUAR and is subject to the AUAR mitigation plan. The proposed development is consistent with development Scenario 1 for medium density residential. Wetlands A Wetland Delineation Report was completed by Kjolhaug Environmental Services Company, Inc. in December 3, 2013. Eight (8) wetlands were delineated within the site. The Grading Plan indicates 11,364 square feet of wetland fill and 81,292 square feet of wetland mitigation proposed on the site. These numbers must be verified by Rice Creek Watershed District (RCWD) which is responsible for permitting under the Wetland Conservation Act (WCA). Wetland fill and mitigation requirements will be subject to review and approval of the RCWD and the Environmental Board. • • • Potential wetlands impacts shall also be analyzed in regards to the proposed future south extensions of Street B and Street E. Mapping data from RCWD indicates wetlands in the locations of both extensions. Floodplain The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates the southeast quadrant of the site is located within a designated Zone A flood plain district. Per the Stormwater Management Plan, the 100 -year flood elevation is 909.7 which according the RCWD, this would also be the 100 -year regulatory flood elevation. With the exception of the ditch, the site is above this elevation and no floodplain fill is proposed for this project. A Letter of Map Revision (LOMR) will need to be obtained from the Federal Emergency Management Agency (FEMA) to verify the floodplain is not impacted by development. Per the Floodplain Ordinance, a Conditional Use Permit is required for any floodplain fill. The low floor freeboard shall be 2 feet above the floodplain elevation. The proposed lowest floor elevations appear to meet this standard. Growth Management Policy Per the Comprehensive Plan (page 3 -27), an annual average of 230 units per year over each 5 year phasing period not to exceed 345 units in any 1 year is allowed. At the end of the 5 year phasing period unallocated units will be averaged out over the next 5 years. A phasing plan shall be required to insure consistency with this requirement. Final Plat A land use application for PUD Final Plan/Final Plat of NorthPointe shall be required. At such time, the developer shall enter into a Development Contract and other documents as the City deems necessary. The following are preliminary comments: 1. All comments from the City Engineer letter dated December 4, 2013 shall be addressed. 2. All comments from Anoka County Highway Department (to be provided) shall be addressed. 3. All comments from MNDOT letter dated December 4, 2013 shall be addressed. 4. A Lot Summary Excel spreadsheet providing gross area, unbuildable area (wetlands, utility transmission easements, etc.) and net area per lot, block and outlot shall be provided. 5. A Phasing Plan for development shall be included in the plan set. 6. The 1982 FEMA FIRM Zone A floodplain shall be shown on the plan set. 7. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA). Verification that the floodplain is not impacted by development is required prior to approval of the Development Stage Plan/Preliminary Plat. 8. Temporary cul de sacs shall be required where a street is terminated pending future extension. 9. Drainage and utility easements shall be dedicated over stormwater drainage areas. 10. Drainage and utility easements or conservation easements shall be dedicated over wetland buffer areas. 11. Potential wetlands impacts shall be analyzed in regards to the proposed future south extensions of Street B and Street E. 12. On corner lots, 20 foot "side" setbacks shall not be allowed on parcels that abut an interior lot. Full front setback shall be required. 13. Will a Homeowners Association be established for any portion of the development, in particular, the 50 foot wide lots? 14. Regarding the 85 unit multi - family senior complex: a. It shall be demonstrated the facility is viable in terms of parking stalls, setbacks, landscaping, buffers, etc. b. Underground parking shall be required for 50% of the units. 15. A Stormwater Pollution Prevention Plan (SWPPP) shall be submitted. 16. Sheet 4, Preliminary Plat: a. Wetlands shall not encroach into lots. b. A minimum 10 foot buffer shall be established between the rear lot line and wetland boundary. 17. Sheet 8, Preliminary Plat: a. The 50.0 foot strip of land per Book 54 of Deeds shall be incorporated into the plat and proper right of way for Street C dedicated. b. Outlots E and F shall be combined into one (1) outlot. c. To provide for an 80 foot right of way along Cedar Street, seven (7) more feet shall be dedicated. • d. Street C shall be aligned with the easement north of Cedar Street. e. The applicant is to submit an infrastructure improvement phasing plan, and the wetland delineation report and approvals. 2. Obtain permits for the project: RCWD, NPDES (multiple phases), MCES, MPCA, MDH, Anoka County, Xcel Energy. 3. Remove lots from the Xcel easement. 4. In final design use the City's standard specifications and detail plates for construction. 5. The City's Comprehensive Plan designates a neighborhood park in the proposed development area and this should be added to the plan. Street and Trail Comments: 1. Roadway C is to match a future connection along the Centerville/ Lino Lakes boarder to match the 40' water / sewer easement to the north. The City's Comprehensive Plan shows Birch Street extending through site to the north and connecting with CSAH 14. The proposed roadway system has Birch as T- intersection and should be considered as a through road. 2. Cedar Street will need to be overlaid as part of this development. 3. Turn lanes at Cedar Street are also required per Anoka County. Maintenance of the center median at CSAH 54 and Street A will be required from the neighborhood. Documentation confirming Homeowners Association maintenance of this median will be required. 5. The City's Comprehensive Plan shows a trail going through the site from Birch to the north. The plans should extend trail to the west along Streets E and B. 6. The proposed street stubs to the south property line for both Street B and Street E appear to be directed into wetlands. Additional information must be submitted regarding these alignments. Sanitary Sewer and Watermain Comments: 1. The City's Sanitary Sewer Plan shows drainage areas 3D and 3G leading to the area thus a stub needs to be extended in Street A at CSAH 54. The areas require potential lift stations and these stubs need to be as deep as possible. The new sanitary sewer main from the connection to the Met Council main in Cedar Street south and west to the stub on Street A at CSAH 54 will need to be 10- inches in diameter and installed at minimum grade. 2. Per the Street comment of realigning the connection to Cedar Street to match the existing easement on the north side of Cedar Street, the sanitary sewer will also need to be realigned. This may allow for a connection to the existing manhole in this location rather than constructing a new manhole over the existing Met Council main. 3. Additional analysis will be needed to confirm the necessity of the lift station. If necessary, we will need to determine what the ultimate service area is for it so that it can be sized accordingly. 4. All watermain shall be DIP Class 52. 5. Include the proposed drainage and utility easements on the utility plans so that we can confirm all of the utilities are contained within the necessary easements. Storm Sewer and Drainage Comments: Prior to plat approval, the following items must be addressed: 1. Low floors must be 4' above the highest anticipated water table which is identified as mottled soils or the seasonally high water mark. Please design accordingly. 2. The applicant must quantify the water quality benefits provided by the proposed ponds (based on Rice Creek Watershed District Rules) and include this information in the stormwater management plan for the development. 3. Calculations for the water reuse system must be provided for review and approval. In general, calculations must consider irrigation demand, reservoir capacity, and stormwater runoff supply and must address how these components are interrelated to provide volume control consistent with RCWD Rules. 4. Calculations for the 10 -day, 100 -year snowmelt event must be provided that demonstrate no increase in peak discharge rates from the existing conditions. Prior to construction, the following items must be addressed: 5. Responsibilities for maintaining stormwater management facilities must be formally documented in an agreement and provided to the City prior to construction. All necessary permits must be obtained from others including Rice Creek Watershed District, MPCA, Department of Health, and the County prior to construction. 7. Utility plans and storm sewer design must be provided for review and approval prior to construction. 8. Erosion and sediment control plan and Storm Water Pollution Prevention Plan must be submitted for review and approval prior to construction. 9. The City will enforce the wetland buffer area to ensure sod/lawn areas do not seasonally flood. This creates problems for the City in the future as people believe they have additional yard to maintain. Traffic Impact Study Comments: 1. The Traffic Study looked at the 4 primary intersections along the 20th Ave corridor plus the future site driveways. However, there are several driveways accessing 20th Avenue adjacent to the site. How are these driveways impacted especially by the turning traffic into or out of the site? 2. For the intersection of 20th Avenue and Main Street was the intersection coordination signal timing for the other Main Street intersections between 20th Avenue and I -35E used for the operational analysis? 3. Although the analysis does not show any issues for the northbound 20th Avenue approach to Main Street, it appears that the approach queues in the build condition may back up and block intersections. This should be verified. 4. The roadway improvements section indicates that there are no issues at the 20th Avenue and Main Street intersection. However, the conclusion indicates that the WB left turn lane may need to be lengthened. Can this be accomplished with the new intersection improvements at the 21St Avenue intersection? 5. The analysis results show that for the Build condition the queue lengths and some of the movement Levels of Service are better than the 2019 No- Build. Why did this occur? Were improvements assumed? 6. The Traffic Study indicates that the County conducted a study that identified opportunities for 20th Avenue at Birch Street. Were these improvements considered or at least accommodated with the proposed development (i.e. right of way). 7. The analysis indicates a sight line issue at the 20th Avenue and CR J intersection. The addition of the Northpointe site traffic will only make this condition worse, therefore improvements should be considered with the initial construction of the development. As indicated in the Traffic Study, an all -way stop at the intersection would improve the approach delays and safety. A further analysis to determine if Stop Sign warrants are met should be conducted. This should be coordinated with the County. Grading Comments: 1. It appears that the rear lots for Lots 1 -4 Block 10, Lots 1 -9 Block 12, and Lots 1 -6 Block 13 discharge directly onto the adjacent property. 2. All street low points will need to identify an emergency overflow. 3. The easterly terminus of Street H will need storm sewer to contain the storm water runoff on site. 4. At the northeast corner of the project there are two locations where the existing 922 contour terminates at the property line and doesn't tie into the proposed contours. Cedar St. Lino Lakes, Anoka County Control Section 0282 Dear Ms. Bugge: The Minnesota Department of Transportation (MnDOT) has reviewed the Northpointe plat in compliance with Minnesota Statute 505.03, subdivision 2, Plats. Before any further development, please address the following issues: Noise: MnDOT's policy is to assist local governments in promoting compatibility between land use and highways. Residential uses located adjacent to highways often result in complaints about traffic noise. Traffic noise from this highway could exceed noise standards established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states that municipalities having the authority to regulate land use shall take all reasonable measures to prevent the establishment of land use activities, listed in the MPCA's Noise Area Classification (NAC), anywhere that the establishment of the land use would result in immediate violations of established State noise standards. MnDOT policy regarding development adjacent to existing highways prohibits the expenditure of highway funds for noise mitigation measures in such developed areas. The project proposer is required to assess the existing noise situation and take the action deemed necessary to minimize the impact to the proposed development from any highway noise. Water Resources: The project does not appear to adversely affect MnDOT right -of -way. However, the project area does outlet to an intermittent stream and wetland area that crosses I -35E right -of -way from the south end of the project and potentially to the I -35E ditch on the north end of the project. Therefore, a MnDOT drainage permit is required. The applicant will need to submit plans with hydraulic calculations showing that flows to MnDOT right -of -way remain the same or are reduced when comparing the existing to the proposed conditions. Drainage area maps with flow arrows for the drainage areas that affect MnDOT right -of -way should be included. The maps labeling should relate to the submitted calculations. The current plan also shows proposed lots and a cul -de -sac on the north end of the property adjacent to I -35E. It does not appear that this will be built with the current project. This area will not be included as part of the drainage permit approval, unless plans and calculations for this proposed developed area are included in the permit submittal. If not included at this time, as this area is planned for development, a separate additional drainage permit will be required.
