City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. A STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: September 9, 2009 TOPIC: PUBLIC HEARING: Conditional Use Permit for a Church at 7868 Lake Drive BACKGROUND We received an application for a conditional use permit for a church on the site of the former Circle -Lex VFW, which constructed the building in 2004. The site has a conditional use permit (CUP) for a private club (Resolution No. 04 -18), but that does not include a church. On August 10, the City Council approved Ordinance No. 04 -09, an amendment to the zoning ordinance that allows public, educational, and religious buildings as conditional uses in the Limited and General Business zones. This ordinance amendment will become effective on September 17, 2009. The VFW approval in 2004 included the building and site improvements. Many of the required improvements were not completed. These were re- examined to determine what should be done as conditions of the church CUP. The plans that were submitted for the new church CUP application are the same plans approved for the VFW in 2004 except for the main floor plan, which has been updated for the church use. The plans compare with the General Business zoning standards as shown in the table below. * variance was granted in 2004 SITE PLAN AND CONDITIONAL USE PERMIT Building: The existing building reflects the design elements of the City Hall, Community State Bank, and other buildings along Lake Drive. These include a peaked, green metal roof, masonry walls, and earthtone colors. The average height of the pitched roof is 22 ft. This is the technical building height, according to the definition in the zoning ordinance (The roof peak is approximately 30 ft. high.) The building footprint is approximately 11,500 sf. The trash enclosure on the east side of the building was constructed of materials to match the principal building. The gates were not installed and this must be done. The building is set back 80' from Lois Lane. The parking is set back 15'. Since the Lois Lane side is the shorter side fronting on a road, it is considered the front for measuring setbacks. This makes the east the side lot line, where the setbacks of 10' and 20' comply with the requirement. However, the following discussion describes variances granted for setbacks from Lake Drive. Setback Variances Granted Previously: Future right of way width recommended for this arterial is 120' total (60' on each side of the centerline). The Lake Drive right of way was not of consistent width along the entire property. The VFW dedicated additional right of way to provide for future needs and make the right of way consistent. In order to fit the proposed building and parking drive, the VFW requested a setback variance. The required setback from an arterial roadway (Lake Drive, CSAH 23) is 40'. The building would be approximately 34' from the new property line. The parking drive would be about 5' from the line instead of the required 15'. Since the full right of way would be in place, it eliminated concern about additional roadway needs, the public costs of condemning land, and possibly demolishing buildings or other facilities. The building is six feet closer than normally required and the parking drive is 9.5' closer than normally required. Another issue here was the 5'+ of land for landscaping between the parking curb and the right of way. It is difficult to provide extensive landscaping and screening in this strip. However, there is little screening along Lake Drive in this commercial area and the project significantly improved the appearance of the site, including landscaping. The setback variances were granted along with the VFW project approval (Resol. 04 -18). These variances continue with the site and building. Lighting: Plans show fixtures in the parking lot on six poles. Three, in the northern parking area, have two fixtures each and have been installed. One single fixture is to be near the Lois Lane driveway, and two others in the southern parking area. The one near the Lois Lane driveway location has been installed, even though the driveway and parking have not. In addition, it is crooked and must be repaired. The submitted photometric plan indicates that lighting meets city standards: no more than 0.4 foot candles at the residential property line to the east, and no more than 1 0 at street right of way lines. The exterior building lighting is included. The submitted fixture cut sheets show 90 degree cut off fixtures in compliance with city requirements. The lighting under the north and south entry canopies is completely recessed. Oddly, the fixtures shown on building elevations and installed on the exterior walls do not match those on the lighting plan in type or number. This did not result in a significant discrepancy, and the existing lights are acceptable. There seems to be another pedestal for a light near the Lake Drive driveway. This is not included on the lighting plan. If a light is to be installed here, it must be determined what type of fixture and a photometric analysis done to ensure it meets city standards. Three flagpoles were installed, and were shown on plans. However, no lighting for the flags was included on the lighting or any other plan. One large lamp was installed to shine up on the flag, and poles for two more are present. Since these lamps were not included in the original approved plans, they should not be there. The additional lights raise questions about glare for motorists and effects of skyward lighting on nearby residents. If the church wants these lamps, it must submit a photometric analysis to ensure city standards are met. Even if the standards are met, landscaping around the lights must be installed. If the lamps don't meet city requirements, the existing one must be removed and the wiring for all safely addressed. North Springs Church CUP page 4 Landscaping, Screening: As shown on the landscape plan, a variety of trees, shrubs and ornamental plantings are proposed on site. A new six -foot, cedar privacy fence continued the segment of existing fence and extends along the property lines on the east and north. Only the street side is not fenced. While it may be desirable to have tall screening along the streets, visibility and sight lines is more important. On this site, tall plantings along the roads would create safety issues. The proposed plantings at 4' high are adequate. In addition, if the suggested trail easement is created along Lake Drive, no plantings should be installed there. Native plantings were seeded in the large ponds on the north. The native vegetation is growing. Some clearing of undesirable plants should occur. When the infiltration pond is created at the southwest corner, the City seed schedule should be observed there. As noted in the lighting discussion, if flagpole lighting is desired by the church, there must be plantings around the lamps. The presence of these lamps would necessitate a change from the landscaping shown at that location on the plan. This must be resolved. One of the general criteria for all conditional use permits is that the use "will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors." Though the fencing meets normal screening requirements, after the VFW opened the new heating and ventilation and kitchen fan equipment caused undesirable noise and odor impacts on the neighboring residential lot to the east. This was not foreseen, but it is known now and additional screening and/or other measures should be included to address this problem. Utilities: The site is within the MUSA and is connected to municipal water and sanitary sewer service. The old well and septic system locations are covered by the new building. As a condition of plan approval, utility related actions and comments in the City Engineer's memo must be addressed. Stormwater management: The site has ponds along the northern and eastern borders of the site and in the southwest corner. The larger ponding areas on the north and east have been constructed, but are not completely finished and some maintenance is necessary. The south side of the site has had little work done other than razing of the old building. Much work remains in this area. Drainage and utility easements were created over all ponds. The deed granting such easements was recorded. There also is a stormwater facility maintenance agreement that has been recorded. As a condition of approval, the necessary grading and drainage related modifications and comments must be addressed. State law requires that there must be at least 50' separation between a well and a stormwater pond. This was considered when the original project review. The three residential properties to the east have wells, as does the property abutting the site on the north. The submitted plans show these wells are more than 50' from the ponds. • • • • North Springs Church CUP page 5 Access, Circulation, Parking: Right Of Way As explained above under "variance ", the VFW dedicated additional land to create an even right of way line, a consistent 60' from the centerline. Access, Circulation Access to the site was not well defined before the building was constructed and the site improved. Neither Lake Drive nor Lois Lane have curbs. Access occurred along the property line, but not necessarily at defined driveways. Lake Drive is an arterial, and long term plans include a median. This will restrict access to many properties, as it will eliminate left turns in and out of many driveways. The approved plans include two driveways, one each on Lake Drive and Lois Lane. A full access through a future Lake Drive median may have better probability if the driveway aligns with a public road (79th St.), though this is not assured. The Lake Drive driveway was constructed to roughly align with 79th St. A stop sign for vehicles exiting the parking lot onto Lake Drive was installed as required. The Lois Lane driveway is designed as far back from the Lake Drive intersection as possible while still providing the minimum 10' setback from the side property line. The plan proposes two distinct parking areas. In the northern area, the drive lane that parallels Lake Drive has the potential to connect with a parking area on property to the north when it develops. This will serve as a de facto frontage road. With the likelihood of a median in Lake Drive, access for both sites will be better if they can use one another's driveway. It increases the number of Lake Drive driveways available for each site from one to two, while only building one on each site. This require a cross access easement for both sites. An easement across the VFW /church site (7868 Lake Drive) was recorded. The City needs to ensure a like easement across the abutting property (7910 Lake Drive) when it develops. The northern parking area was largely completed, though the final wear course of asphalt was not installed. Unfortunately, because all the site work was not completed and the site has not been maintained, several spots have washed away under corners of the paved areas. This has created a potentially dangerous situation. These must be repaired and the work completed as part of the church project. On the south and west parts of the site, the parking lot was not constructed. In fact, the foundation of the old building has not been removed. This area must be finished according to the plans. The VFW had an agreement with the neighbor on the east side to allow access through the site to allow the neighbor to get his recreational vehicles in and out of his back yard. There is an unpaved driveway and curb cut from the parking lot to the neighbor's rear yard, and a gate in his fence. This arrangement is a private agreement between the two property owners. The City has no objection to this arrangement, but it is possible that some revision will be needed to ensure proper drainage Trail As described previously, there is only about 5' between the parking lane curb and the right of way on Lake Drive. This is a small area for landscaping to grow. North Springs Church CUP page 6 The City's trail plan includes a trail corridor along the full length of Lake Drive. This strip might best be used as part of the corridor. If the church is agreeable, a deed for a trail easement would serve as a piece of this trail corridor. This strip the could be seeded with grass rather than the plantings shown on the landscaping plan. This would avoid the waste of landscaping when the trail is constructed. Parking For churches, the zoning code requires one parking space for each three seats based on the design capacity of the main assembly hall. Facilities provided in conjunction with the church use shall be subject to additional requirements which are imposed by this Ordinance. That is, classrooms and offices require additional parking. A school would require one stall per classroom and this has been applied to other churches. An office building requires one stall for every 200 sf of office space. However, three of the four offices are less than 200 sf each. If one employee is in each office, that would be four employees. Some parking could occur on 79th St. However, off-street parking must be provided according to the zoning code requirements. A submitted seating plan shows 242 seats in the assembly area. Assuming this is the seating capacity, the following would apply, and the parking on the site is adequate. Zoning Ord. Req. This could include traffic control personnel. If needed, the Chief of Police may call a review meeting of representatives from law enforcement officers, the church, and the neighborhood to review traffic issues and ascertain the need for providing traffic control. This provision has been applied when another church was built in Lino Lakes. Signage Signage is govemed by the City's sign ordinance and permits are required for all signs. If a ground sign is desired by the church, its location must be identified on a plan to ensure it is not interfering with sight lines, drainage, or other needs. All signs will be reviewed with the sign permit applications. Conditional Use Permit There are general criteria for all CUPs and specific conditions that apply to public, educational and religious buildings. • • • • • North Springs Church CUP page 7 General Criteria: The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: Land Use Plan, Transportation Plan, Utility (Sewer and Water) Plans, Local Water Management Plan, Capital Improvement Plan, Policy Plan, Natural Environment Plan. • The site is guided and zoned for commercial development, with the infrastructure in place for activity of such intensity. The site was approved for a use that included large numbers of people assembling in the building. The use as a church will not create incompatibilities as long as the church complies with the performance standards and conditions of approval. b. The proposed development application is compatible with present and future land uses of the are& • The site has been guided and zoned for commercial activity. The proposed development application conforms to performance standards herein and other applicable City Codes. • If the conditions of approval are followed, performance standards will be met. d. Traffic generated by a proposed development application is within the capabilities of the City when (specific levels of service listed in the ordinance are met): • The traffic generated by a church in the building will be somewhat greater than that of the old, smaller VFW, and certainly more than a vacant building. However, it not expected to create ongoing traffic problems. The Apollo Drive, Marketplace Drive, and Main St. intersections with Lake Drive are signalized intersections, though the Main street signal functions as a stop sign. If, in the future, traffic becomes an issue, the City can revisit the CUP and consider adding additional conditions such as traffic control personnel for large events. e. The proposed development shall be served with adequate and safe water supply. f. The proposed development shall be served with an adequate and safe sanitary sewer system. • The building is connected to city water and sanitary sewer. g. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. • There will be no city capital expenditures for this project. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. • The proposed use of the site will not create detrimental impacts as long as the use complies with the performance standards and conditions of approval, including addressing noise and odor impacts on the neighboring property. i. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. • No such features exist on the site. Specific CUP Conditions: Public, educational and religious buildings are allowed as conditional uses in the GB zone provided that: a. Screening from residential uses and landscaping is provided in compliance with requirements for business or industrial uses in Section 3, Subd. 4.Q of this Ordinance. • The fence that was constructed and the landscaping provides screening that meets most requirements. A possible exception is the flagpole lighting area. This will resolved as a condition of approval. b. Adequate off - street parking and access is provided 011 the site or on lots directly abutting directly across a public street or alley to the principal use in compliance with Section 3, Subd. 5. of this Ordinance • As submitted, the site plans will accommodate parking needs. If parking or traffic generation create problems in the future, the City may revisit the CUP and consider adding additional conditions to resolve such issues. c. Parking is screened and landscaped in compliance with requirements for business or industrial uses in Section 3, Subd. 4.Q of this Ordinance • The fence that was constructed and the landscaping provides screening that meets most requirements. A possible exception is the flagpole lighting area. This will resolved as a condition of approval. d. Adequate off - street loading and service entrances are provided and regulated where applicable by Section 3, Subd. 6. of this Ordinance • No formal loading berth is needed for this project. Any receipt or distribution of materials or merchandise can be accommodated in the off - street parking areas. Expiration of Old CUP: The zoning ordinance states that a CUP expires if the use ceases for more than one year. The VFW has been out of business longer than that. An official action is preferable to remove the private club CUP from the site. This should be • North Springs Church CUP page 9 • included in action on this new application and is included in the conditions of approval. However, the setback variances for the building and the parking lane continue to apply. • • CONDITIONS OF APPROVAL The project approval should be subject to the following conditions: 1. Issues listed in the August 31, 2009 memo by the City Engineer must be resolved to his satisfaction. 2. All necessary permits shall be obtained by the applicant from Anoka County for work in the Lake Drive (CSAH 23) right of way. 3. The church shall enter into a site performance agreement for exterior work on the site prior to commencing the work or obtaining a certificate of occupancy. This shall include financial securities according to current City requirements. 4. Parking lot lighting must be completed as shown on submitted plan and fixture cut sheets. The pedestal for a light near the Lake Drive driveway is not included on the lighting plan. If a light is to be installed here, it must be determined what type of fixture and a photometric study done to ensure it meets city standards. 5. Parking lot lighting shall be turned off no later than two hours after services or other events at night, but no later than 10 p.m. This does not apply to special holiday or other special events. 6. If the installed flagpole lighting is to remain or be expanded, a photometric analysis must be submitted that demonstrates it meets city standards. Landscaping around the flagpoles must be revised on a new plan for the area if lighting is to be there. 7. Signage is governed by the City's sign ordinance and permits are required for all signs. The location of any ground sign must be identified on a plan. 8. If parking or traffic generation create safety problems in the future, the City may revisit the CUP and consider adding additional conditions to resolve such issues such as traffic control personnel or other measures. The City may call a review meeting of representatives from law enforcement officers, the church, and the neighborhood to review traffic issues and ascertain the need for providing traffic control. This condition is in lieu of requiring a traffic study for the church use. 9. The parking, landscaping, and any other exterior work shall be completed in accordance with the plans. 10. Final site grading and erosion control must be completed in accordance with the approved plans. This includes removal of the old building foundation/slab, re- shooting elevations, grading the rest of the south end of the site and the county roadway ditch to the design criteria, and finishing grading of the rest of the site. North Springs Church CUP page 10 11. The south parking lot curbing and drainage improvements must be completed according to plans. 12. The south parking lot sub -base and first lift of asphalt must be completed according to plans. 13. In the area of the existing access to the back yard of the property to the east, any alterations necessary to ensure proper drainage and other compliance with plans must be made as directed by the City Engineer. 14. The final lift of asphalt must be completed over the entire site according to plans. 15. Topsoil, landscaping, and seeding of all disturbed areas must be completed according to plans. 16. The height of any plantings near the driveway must not interfere with sight lines when fully grown. 17. The City native seed schedule shall be used in infiltration and ponding areas. 18. The gate must be installed on the trash enclosure. 19. The HVAC and fans on the east side of the building have created significant nuisance issues for the neighboring property. Additional screening must be added along the east side of the building to remedy this problem. 20. Section 2, Subd. 2.B.11. of the zoning code states that "A conditional use specified in the permit expires if, for any reason, the authorized use ceases for more than one (1) year." The VFW has ceased operating for more than one year. The conditional use permit for a private club, approved with Resolution No. 04 -18, is hereby recognized as expired. 21. The setback variances granted with Resolution No. 04 -18 continue to be in effect. 22. All permits and approvals required to comply with life safety requirements such as the building and fire codes must be obtained. 23. If a trail easement is deeded to the City along the 5 +' between the Lake Drive right of way and the parking curb, the plantings shown there on the landscaping plan need not be installed. OPTIONS 1. A salt tolerant sod or seed should be specified in the plant list for seeded or sodded areas. 4. Curb -drop areas on the NE corner and North of the site are undermined and must be repaired. 5. No soil should be imported or exported from the site without City staff approval 6. An erosion control plan should be submitted. A site for erosion control plan /SWPPP access and erosion inspection logs should be shown on the site plan. 7. A concrete washout area must be shown on the map 8. If the flag pole is to remain in the plan, than additional large growing shade trees should be added in the plan to screen residents to the east and the south. 9. If City proposed trail is not installed along Lake Drive, add landscaping materials that would not interfere with visibility. 10. Surface water grading should accommodate keeping the water on the site, particularly along the Noren property. On the North side of this property the driveway access should be lowered or a culvert installed to allow for the movement of water. 11. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: September 9, 2009 TOPIC: PUBLIC HEARING: Zoning Ordinance Amendment Amending the Zoning Ordinance requirements for Home Occupations /Home Extended Businesses, Residential Parking, and Exterior Storage. BACKGROUND As a part of the 2030 Comprehensive Plan Update, staff identified some issues with the Home Occupation standards and what level of business should be allowed in residential neighborhoods. Additionally, the issue of residential parking and storage is intertwined with Home Occupations. Staff gets a number of calls every month about the rules associated with the various vehicles a site may have stored /parked. The Planning and Zoning Board had some very useful discussion about these issues at both the July and August meetings, and as a result staff has brought the following forward for further review and discussion. HOME OCCUPATION ANALYSIS Based on the Board's previous comments, staff has created a three tiered system that requires actual Permits only if the business has some visible external effects such as employees or customers. The third tier then allows larger properties, Rural Properties, and those that front onto a major roadway to have additional allowances. Additionally, staff has tried to address some of the Board's concerns raised at the last meeting. The draft language is again attached to this report, and staff would like to receive any additional comments prior to finalizing the language. PARKING ANALYSIS Staff has created a worksheet to try and address all of the issues and arrange them in a user friendly format. Issues or new text are underlined throughout, and much text is direct from the existing ordinance. The major issues to discuss would be screening of rear yard parking, clarifying the definition of a Recreational Vehicle, and identifying any subsequent standards that might be needed for Utility Trailers. EXTERIOR STORAGE ANALYSIS Staff is proposing to remove RV/Trailer storage from this section and place it within the new residential parking section of the ordinance, and to add refuse and recyclable materials to the list as a reference to the appropriate section regarding these items that can be stored outside. Along with those determinations, staff would also like to ask the Board to review the list of exceptions and to consider if any other items should be included. Draft language is attached for review. PROCESS The Public Hearing for this item was properly noticed, opened at the July meeting, and continued to this meeting for further discussion. Following a recommendation by the P & Z Board, staff will present the proposed amendment to the City Council. An ordinance requires two readings (and votes) by the City Council. Upon adoption, it then is published in the newspaper and becomes effective after thirty days have passed. RECOMMENDATION Based on input by the Board at this meeting, final language for Home Occupations, Parking, and Exterior Storage will be prepared for the October meeting. Draft Exterior Storage Language • • • • Attachment 1 DRAFT HOME OCCUPATION STANDARDS Subd. 8. Home Occupation Permits. A. Purpose. The purpose of this section is to provide a means by which home occupations can be conducted as an accessory use to a residential dwelling unit, as a use that is clearly incidental and secondary to a residential use on the same premises, without jeopardizing the health, safety and general welfare of the surrounding neighborhood or the inhabitants of the home occupation site, and without jeopardizing the residential character of the neighborhood. B. Application. Subject to the non - conforming use provision of this section, all occupations conducted in the home shall comply with the provisions of this section, with the exception of the following: 1) Permitted agricultural /farm related uses in the R and R -X Districts (and when found to be in conformance with all other provisions of this Ordinance) need not meet the provisions of this subdivision. 2) The limited seasonal sale of products grown solely on the site by the residents of the homestead shall be exempt from the provisions of this subdivision. 3) Daycare when licensed by the state and /or county 4) Any other use listed as a Permitted, Conditional, or Interim use within the corresponding zoning district. 5) Any use allowed by an existing Conditional or Interim Use Permit. C. Procedure. A permit shall be required for any Home Occupation B or C, in accordance with the following procedure: 1. Application for a Home Occupation permit B or C shall be filed by the property owner or designated agent with the Zoning Administrator on forms to be provided by the City. 2. Application for a Home Occupation permit B or C shall be accompanied by a non - refundable fee as established by City Council ordinance. • 3. The Zoning Administrator shall review the application and shall determine whether the proposal is in compliance with all applicable evaluation criteria, codes, ordinances, and applicable performance standards set forth in the Ordinance. The Zoning Administrator shall notify the applicant, in writing, of any incomplete application within fifteen (15) business days of the date of submission. D. Violations. After two (2) founded nuisances, or code violation complaints have been made and verified with written notices to the home occupation, a public hearing may be called to consider additional conditions, limitations, or revocation of the home occupation within sixty (60) days of the last complaint. E. Expiration. Upon issuance, a Home Occupation permit shall continue to be valid unless one or all of the following occur: 1. The business owner relocates to another residential address; permits are not transferable to another person or property. 2. The type of businesses occurring on the site changes significantly. 3. If the permit is revoked by the City per section D above. F Requirements - General Provisions. All home occupations shall comply with the following general provisions and according to definition, the applicable requirement provisions. 1. General Provisions. a. Any home occupation shall be clearly incidental and secondary to the residential use of the premises, and shall not change the residential character thereof. b. All home occupations must comply with all provisions of the City Nuisance Ordinance and shall result in no incompatibility or disturbance to the surrounding residential uses. c. No home occupation shall require internal or external alterations or involve construction features not customarily found in residential dwellings except where required to comply with local and state fire and police recommendations. d. In no case shall the permitted home occupation cause to create the need for an additional driveway access to the property. e. Personal vehicles not exceeding a gross weight rating of eleven thousand seventy -five (11,075) pounds used in the home occupation may be parked on the site. • • • f. Any vehicle with a gross weight rating in excess of eleven thousand seventy -five (11,075) pounds is subject to Section 3, Subdivision. 5.K of this Ordinance. g. The home occupation shall meet all applicable fire and building codes. h. All signage for the business must comply with the city sign code. i. When applicable, all state licensing requirements are satisfactorily met. J. The applicant shall demonstrate, in a manner found acceptable to the City Engineer that such use is within the capabilities of the property's sewage treatment system or the city's utility system. k. There shall be no use or outdoor storage of any toxic chemicals or hazardous materials of any type or in any amount not normally found in a residential structure. 1. No motor vehicle repair, paint or body work; commercial preparation of food for service on the premise; business related to or involving explosives, ammunition or weapons; or ambulance or related emergency services shall be permitted as a Home Occupation. m. No retail of anything produced off -site. G. Requirements — Home Occupation Permit A. All residential dwelling units are eligible for a Home Occupation Permit A, and must comply with the following provisions specific to the Home Occupation Permit A. 1. Requirements. a. Permitted home occupation shall be confined to the private dwelling unit, and shall not be conducted in any accessory structure on the premise, including an attached garage. b. No customers or employees who do not reside at the dwelling may be permitted on the property. c. If the home occupation will require a delivery service, such as UPS, no more than six delivery/pickup trips per week shall be permitted. d. The home occupation may not occupy more than 10% of the structure. e. No exterior evidence of the presence of the home occupation on the premises, except any signage allowed by the sign code. f. All off - street parking generated by the home occupation shall be confined to the driveway. g. The number of on -site parking spaces shall not be reduced to Tess than two. H. Requirements — Home Occupation Permit B. All residential dwelling units are eligible for a Home Occupation Permit B, and must comply with the following provisions specific to the Home Occupation Permit B. 1. Requirements. a. Permitted home occupation may be conducted in an accessory structure provided that it can comply with life safety requirements. b. A limit of two customers or employees who do not reside at the dwelling may be permitted on the property at one time. c. Areas accessible to customers or employees shall comply with all applicable life safety codes. d. Vehicle trips for the property, including those generated by the business, shall not exceed 30 in any twenty four hour period. e. If the home occupation will require a delivery service, such as UPS, no more than six delivery/pickup trips per week shall be permitted. f. The home occupation may not occupy more than 10% of the dwelling. g. No exterior evidence of the presence of the home occupation on the premises, except any signage allowed by the sign code. h. All off- street parking generated by the home occupation shall be provided on a hard surface in or adjacent to the driveway. • • • • i. The number of on -site parking spaces shall not be reduced to less than two. j. Personal Service Businesses shall be limited to allow the servicing a single customer at a time. I. Requirements — Home Occupation Permit C. All properties developed with a dwelling, that are either over 1 acre in size; zoned Rural, Rural Business Reserve, or Rural Executive; or front on an arterial roadway are eligible for a Home Occupation Permit C, and must comply with the following provisions specific to the Home Occupation Permit C. 1. Requirements. a. Permitted home occupation may be conducted in an accessory structure provided that it can comply with life safety requirements. b. The maximum number of employees and customers visiting the site at any one time will be determined by the availability of parking on the site. • c. Areas accessible to customers or employees shall comply with all applicable life safety codes. d. Vehicle trips for the property, including those generated by the business, shall not exceed 30 in any twenty four hour period. e. If the home occupation will require a delivery service, such as UPS, no more than six delivery/pickup trips per week shall be permitted. f. The home occupation may not occupy more than 10% of the dwelling. g. No exterior evidence of the presence of the home occupation on the premises, except any signage allowed by the sign code. h. All off- street parking generated by the home occupation shall be provided on a hard surface in or adjacent to the driveway. i. The number of on -site parking spaces shall not be reduced to Tess than two. j. Personal Service Businesses shall be limited to allow the servicing of only two customers at a time. J. Additional Limitations and /or Restrictions. 1. So as to maintain compatibility and protect the health, safety and general welfare of the public, the City may impose additional limitations or requirements as it deems necessary. 2. The City may impose the posting of a security in order to insure compliance with any condition imposed. K. Inspection. The City of Lino Lakes hereby reserves the right, upon approval of any home occupation permit, to inspect the premises in which the occupation is being conducted to insure compliance with the provisions of this section or any conditions additionally imposed. L. Penalty. Violation of the home occupation zoning performance standards shall be subject to the enforcement and penalty provisions of Section 2, Subd. 9 of this Ordinance. • • • Attachment 2 Parking Regulations K. Motor Vehicle Parking in Residential and Rural Zoning Districts. 1. Passenger motor vehicles, including cars, pickup trucks, vans, and motorcycles may be parked on a residential or rural property provided that: a. They are parked on an appropriate surface. Appropriate surface shall include asphalt, concrete, and decorative pavers. Appropriate surface may also include crushed stone, when approved by the city engineer, on properties over one acre in size. b. They are operable and appropriately licensed at all times they are parked outside of an accessory structure. c. They are setback a minimum of five feet from side and rear property lines, except in cases where a shared driveway has been approved by the city engineer. d. When parked in the front yard or corner side yard of a property, they are parked on a designated driveway or parking area. 2. Recreational Vehicles, as defined by Section 1, Subd. 2 of this Ordinance may be parked or stored on a residential site provided that: a. The vehicles are registered to or rented by a resident of the dwelling on such site, provided that: 1. The vehicles have affixed thereto current registration or license plates as required by law. 2. The vehicles are stored no closer than five (5) feet from side and rear lot lines. 3. The vehicles located within front yard areas are • confined to designated driveways or parking areas surfaced in compliance with ABOVE of this Ordinance. b. All front yard storage comply with the following setbacks from street curb and pavement lines: Street Classification Minimum setback from curb /pavement line Major Arterial 30 feet Minor Arterial 30 feet Collector 20 feet Local 15 feet c. No vehicle shall be parked in a manner that blocks a city or county park or trail. d. The vehicles are not connected to any water or sewage disposal system on the residential property where the same is so parked or stored. e. A recreational vehicle shall not be utilized for storage of goods, materials or equipment other than those items considered to be part of the unit or essential for its immediate use. 3. Utility trailers as defined by Section 1, Subd. 2 of this Ordinance may be parked or stored on a residential site provided that: a. Setback b. Surface c. Screening d. Closed trailers allowed in front, open indoors or in the rear only? 4. Motor Vehicles exceeding a gross weight rating of 11,075 pounds. a. No motor vehicle (except those meeting the definition of a Recreational Vehicle) exceeding a gross weight rating of eleven thousand seventy -five (11,075) pounds shall be parked or stored, indoors or outdoors, in a residential zoning district or on a lot of less than two and one -half (2 1/2) acres in a rural zoning district, except when loading, unloading, or • • • • • rendering a service unless an administrative permit that complies with the following requirements is obtained from the Community Development Department. 1. The vehicle shall not be parked or stored for more than seventy -two (72) hours within a seven (7) day period excluding legal holidays. 2. The vehicle shall be parked or stored behind the front of the dwelling. 3. No more than one permit shall be granted per residence. 4. Neither the truck engine nor any other motorized component shall be left running while the vehicle is parked or stored. 5. There shall be a minimum of one hundred fifty (150) feet from the vehicle to the nearest lot line. 6. The vehicle and trailer shall remain connected. 7 All parking permits shall be reviewed and renewed on 1 July of each year at a fee established by the City Council.lf at any time the conditions or requirements of permit approval are violated, the permit may be revoked. b. On lots 2 1/2 acres to 10 acres in rural zoning districts, no more than two (2) commercial motor vehicle exceeding a gross weight rating of eleven thousand seventy -five (11,075) pounds shall be parked or stored, indoors or outdoors. Vehicles parked or stored shall meet the following requirements: a. Neither the truck engine nor any other motorized component shall be left running while the vehicle is parked or stored. b. There shall be a minimum of one hundred fifty (150) feet from the vehicle to the nearest lot line. c. The vehicle and trailer shall remain connected. Attachment 3 DRAFT EXTERIOR STORAGE STANDARDS P. Exterior Storage. 1. Rural and Residential Zoning Districts. a. Exceptions. All personal property in a rural or residential zoning district and /or on properties ten (10) acres in size or Tess shall be stored within a building or fully screened so as not to be visible from adjoining properties and public streets, except for the following: 1) Laundry drying. 2) Non - vehicular recreational equipment. 3) Home heating fuel tanks. 4) Stacked firewood. 5) Construction and landscaping materials or equipment currently (within a period of twelve (12) months) being used on the premises. 6) Agricultural equipment and materials, if these are used or intended for use on the premises. 7) Off- street parking of licensed passenger automobiles and pick up trucks in designated driveway or parking area, surfaced in compliance with Section 3, Subd. 5.C.8.i of this Ordinance. 8) Licensed motor vehicles per Sec. 3 Subd. 5.K. 9) Refuse and Recyclable Materials per Sec 3.Subd 4.E. All exterior storage shall be screened so as not to be visible from adjoining properties and public streets except for the following: 1) Merchandise being displayed for sale in accordance with zoning district requirements. 2) Materials and equipment currently being used for construction on the premises. c. Within an industrial zoning district, the exterior storage of semi - trailers accessory to the principal use may be allowed by conditional use permit according to Section 8, Subd. 1 and Subd. 2. Semi - trailers connected to semi - tractors queuing for loading or unloading shall be considered truck parking and be exempt from the outdoor storage conditional use permit. 3. All Zoning Districts. a. Excepting temporary construction trailers and facilities operated by public service agencies (i.e., bookmobile, bloodmobiles, etc.) as allowed by the City Council, no recreational vehicle may be used for office, business, industrial manufacturing, testing, or storage of items in conjunction with a business, commercial or industrial enterprise. b. The City Council may order the owner of any property to cease or modify open storage uses including existing uses, provided it is found that such use constitutes a threat to the public health, safety, convenience, or general welfare.
