City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Mr. Hyden will be sworn in at an alternate date. IV. APPROVAL OF MINUTES: December 9, 2009 Mr. Nelson made a MOTION to approve the December 9, 2009 Minutes. Motion was supported by Mr. Laden. Public Hearing to consider Conditional Use Permit for placement of fill exceeding 1000 cubic yards within a floodplain for replacement of pedestrian bridges in Chomonix Golf Course. City Planner Jeff Smyser presented the staff report. Mr. Smyser noted that access to the bridge site action. Police officers will be directing traffic to assure safety at the • civic center site Anoka Cai® will be responsible for any damage to trails, roads, or parking areas. Staff explained that the banks on the sides of the newly constructed bridges will be raised, reducing the need for the arched design. Ms. Blaska stated that anyone canoeing or kayaking will still be able to portage around the new bridges. She stated that the county hopes to have all hauling completed prior to the start of road restrictions. She noted that the county may stockpile fill within the park land. The county will do their best to post signs alerting the public to closed trails and provide barricades as necessary. Mr. Pogalz made a MOTION to recommend approval of a Conditional Use Permit to allow for placement of fill exceeding 1000 cubic yards within a floodplain for replacement of pedestrian bridges in Chomonix Golf Course based on the following conditions: 1. A grading permit must be obtained prior to demolition of existing bridges and construction of the new bridge abutments. 2. The Conditional Use Permit must be obtained prior to bringing in additional fill and constructing the bridge. 3. The comments made by the City Engineer shall be addressed prior to th consideration of this request. 4. Hours of Operation for this use shall be limited to Monday thru Friday 7:00 AM to 7:00 PM and Saturday from 9:00 AM to 5:00 PM with no work on Sundays or holidays. 5. Permits must be obtained from the Department of Natural Resources, Rice Creek Watershed District and Army Corp of Engineers. Prior to commencement of work. 6. Coordinate all construction activities with the City Staff, City Police Department, County Sheriff and County Park Officials. 7. Anoka County will continue to provide escrow dollars to cover Lino Lakes incurred City Council expenses. Provide ft -built record drawing upon completion. Motion was supported by Mr. Nelson. PUBLIC HEARING to consider Amending the Zoning Ordinance regarding: requirements for outdoor dining and outdoor seating in business zoning districts, and; serving alcoholic beverages and other uses in golf courses in Rural, Rural - Executive and Public /Semi - Public zoning districts. City Planner Jeff Smyser presented the staff report. Staff recommended approval of the Zoning Ordinance Amendment with any revisions decided on by the board. Board members agreed that they did not see a reason to restrict the size of the outdoor • seating area. DRAFT MINUTES Planning & Zoning Board February 10, 2010 Page 4 Board members agreed that establishments should be responsible for regulating the consumption of liquor on their premise, as they are accountable for their liquor license. Mr. Smyser stated that, at the advice of the city attorney, staff has proposed a new definition of "golf course" to entail all potential elements of a typical golf course. He also noted that "Off- Sale" of liquor as an accessory use will be removed from the definition. Staff noted that neighboring cities such as Blaine, Hugo and Shoreview do not have specific requirements for outdoor seating. Staff agreed to discuss with the city clerk and city attorney the possibility of adding a requirement in the liquor code that holds establishments accountable for control of outdoor consumption. Mr. Nelson made a MOTION to amend the pry 3, Subd. 16, B.2 to read: osed text by deleting a portion of Section 2. If alcoholic beverages are served or consumed in the outdoor area, the proper license required by Chapter 700 of City Code must be current. DISCUSSION ITEMS A. 2009 Year End Review DRAFT MINUTES • • • Planning & Zoning Board February 10, 2010 Page 5 • City Planner Jeff Smyser discussed the list of actions taken by the board in 2009. • • B. Annual Meeting with City Council City Planner Jeff Smyser stated that at the Feb. 1St Council Work Session, the council suggested initiating joint annual meetings with all boards. Staff was directed to discuss the options of where and when the meetings would take place with each board. The purpose of the meetings would be to keep the lines of communication open. Mayor Reinert commented that no decision needed to be made at this time. The council thought annual meetings would be a good way to address any specific issues, or simply provide an opportunity for the boards to converse as a team. ` Mr. Reinert said the idea will likely be discussed at the next work session. Staff noted that any meeting of the city council, regardless of time or location, will be posted as a council meeting. VIII. STAFF ORIGINATOR: Paul Bengtson MEETING DATE: March 10, 2010 TOPIC: Variance to the number and area of accessory structures allowed 1288 Main Street BACKGROUND Sandy Nordstrom has requested approval of a Variance from the number and area limits for accessory structures in order to build a 42 foot by 88 foot detached accessory structure at 1288 Main Street. The property is located on the south side of Main Street approximately 2,000 feet east of the Interstate 35W overpass, and is currently developed with a dwelling and a horse farm. The applicant has indicated that they have a lease over another parcel consisting of approximately 17 acres. This land is not considered towards the accessory structure number or area calculation as the property isn't under their ownership /control except for the term of the lease. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. That amount may be spread between up to 3 separate structures so long as one of those structures is attached to the dwelling. • The subject site is currently developed with three accessory structures. Setbacks: The Zoning Ordinance requires that accessory structures be five feet from side property lines, thirty feet from rear property lines, forty feet from collector roadways (Main Street), and be placed no closer to the front property line than the main dwelling. The proposed structure would easily exceed all of these requirements. Building Code: The foundation (pony wall) for the proposed structure has been partially constructed. The Building Official has requested additional information from the applicant to prove that the pony wall is constructed in a manner capable of handling the strain of a very large fabric structure. This information will need to be submitted prior to the Building Department issuing a permit for the structure. Other information and documentation may also be necessary and should be discussed directly with the Building Official. Findings: State law requires the following findings to be made in order to grant the approval of a variance. Staff has completed the findings in regards to the submitted request. FINDINGS In considering all requests for Variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. While the zoning ordinance requires an accessory structure for all rural properties, the site already is developed in excess of the maximum accessory structure area of 4,200 square feet and exactly the number of accessory structures allowed on the site. • • • b. That the plight of the landowners is due to physical circumstances unique to his property not created by the landowner. The restriction of the number and area of accessory structures is directly related to property size. The entire property, whether covered by water, easement, or wetland is used to determine the number and area of accessory structures. Therefore there is no physical circumstance unique to this property. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. There is no hardship that staff can identify in this request. The request is based on a desire to overdevelop a site. d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. The city has regularly enforced the accessory structure limitations on property owners, and an approval of this request would confer a special privilege normally denied on other lands. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the accessory structure limitations is to insure that sites are not overdeveloped with outbuildings, and the proposed request would do just that. RECOMMENDATION Staff is recommending denial of the request for a variance based on the attached finding of fact. If the board wishes to recommend approval, the following conditions are recommended: 1. A building permit must be obtained prior to construction of the proposed structure. 2. The structure may only be maintained as long as the additional acreage to the south is leased by the applicant. 3. The tarp material roof can he taken down Seasonally and taken down within a day. We, Sandy Nordstrom and Ken Schienbein train horses for a living. We train family horses, 411 horses and we also train horses for the handicap kids for Freedom Farms. We can not train Horses in the Minnesota winter. We need a roof to cover the corral from the freezing rain And snow. It is impossible and unsafe for us and the horses to be worked on icy ground. Horses Are unpredictable and don't realize they are on ice and can fall and injure themselves and the rider. They need good Sandy ground to be worked in to have good footing. Property Value and Economic times have dropped my property value down, so we can not sell At this time and get the value of the mortgage paid off. As a Real Estate agent that is getting no work And a carpenter that is layed off, Horses are the only way we have been able to make any income. The Minnesota winter has also stopped us from making any income. There is 3 oil pipelines that runs in the middle of the property and the wetlands that limit the use of the land. Another reason for a temporary roof is to be able to take it with us when the house is Sold in 5 years. I can't sell until the market turns around and property values go back up. And in 5 years my daughter will graduate from high schooL We can certainly agree to stipulations on the variance. If the property sells it is taken Down and the variance will not continue with the new owners. We also have leased 17 acres that is attached to the property for the last 10yrs and plan On keeping a lease on that property to let the horses graze on. I think a lot of people enjoy seeing the horses at our home, it keeps a little of country In Lino Lakes. We would like to keep it a working hobby farm all year round. STK# DIMENSIONS PB03154R4 42' W x 17' 3" H x 72' L • • AGENDA ITEM VII B STAFF ORIGINATOR: Jeff Smyser P & Z MEETING DATE: March 10, 2010 TOPIC: PUBLIC HEARING Planned Unit Development Amendment: Amending Town Center Design & Development Guide Regarding Outdoor Dining /Seating BACKGROUND The mixed use area of the Lino Lakes Town Center, currently called Legacy at Woods Edge, was rezoned to planned unit development by Ordinance No. 04 -04. That ordinance also stated that development of the property shall be subject to the Lino Lakes Town Center Design & Development Guide as well as the provisions of the Lino Lakes Zoning Ordinance and all other applicable chapters of City Code. Lino Lakes Town Center Design & Development Guide (Development Guide) creates land uses and their locations. It also creates regulations for those land uses. These regulations govern building placement, architectural standards, parking, and other aspects of development that commonly are regulated by zoning standards. In effect, the Development Guide is a set of special zoning standards that apply only in mixed use area of the town center. As time goes on, we learn that individual elements of the standards warrant amendment. We recently amended the outdoor dining /seating requirements in the Zoning Ordinance. That amendment includes changing outdoor dining/seating from a conditional use permit to an administrative permit. The proposal tonight is the same change in the Town Center Development Guide. ANALYSIS Chapter 3 of the Development Guide includes standards for the Commercial, Mixed Use, and Civic districts. The standards include Table 1, listing allowable uses. Currently, the commercial and Mixed Use districts allow outdoor seating associated with eating places /restaurants /private clubs and lodges as a conditional use. That is, a conditional use permit (CUP) is required. As we noted when amending the Zoning Ordinance, the category of conditional uses is intended for non - standard, atypical uses or elements. The zoning ordinance states: "Certain uses, while generally not suitable in a particular zoning district, may under some circumstances be suitable. When such circumstances exist, a conditional use permit may be granted." (Section 2, Subd. 2.A.) Legacy PUD Amendment: Outdoor Seating • page 2 There is no reason to consider outdoor seating "generally not suitable" in a business zone that allows restaurants as permitted uses. As long as standards are established that ensure that the seating will not pose a threat to public health, safety, and welfare, outdoor seating is a benefit to both the public and the individual business. In addition, a CUP adds time and expense for a business while adding no benefit to the public that can't be provided through an administrative review. As noted when amending the zoning ordinance, outdoor seating can be desirable for uses other than just restaurants. The proposed amendments address this in the Development Guide, also. Amendments to Development Guide The Development Guide lists allowable uses in Table 1. This table, found in Section 3.1 of the document, is relatively straightforward, listing uses and designating them as permitted, conditional, or accessory uses. Sections of text where amendments are proposed are outlined with heavy, dashed lines to help locate them. Deletions are shown in strikethrough text, additions are underlined. The proposal changes outdoor seating to an accessory use for restaurants and adds it to food stores and convenient stores. Amendments to footnotes of the table are proposed as well. Some are clarifications, but the main revision incorporates by reference the section of the zoning ordinance that we recently amended, with two differences specified for the Town Center. The Development Guide lists conditional use permit requirements in its Appendix A. The requirements for outdoor seating would be deleted because outdoor seating would become an accessory use rather than a conditional use. This parallels the amendment to the zoning ordinance. RECOMMENDATION Staff recommends approving the amendment to the Lino Lakes Town Center Design and Development Guide as shown in the attachment.
