When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. STAFF ORIGINATOR: Paul Bengtson MEETING DATE: May 9, 2007 TOPIC: Variance Local Street Setback To allow a Porch Addition BACKGROUND Jim Schally has requested approval of a Variance from the Local Street Setback (30 feet) to allow a covered porch addition that would be 25.5 feet from Apollo Drive. The proposed porch addition is part of a larger project that involved the removal of the detached garage and remodel of the existing structure. The rest of the project met all setback requirements and was therefore approved by the Buidling Department. The porch is the only thing that will encroach, a total of 4.5 feet into the Danube Street setback. The site is located north of Main Street and east of Lake Drive within the Pine Haven subdivision. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. Setbacks: The lot is zoned R (Rural) and is required to adhere to the following setbacks established in the Zoning Ordinance: From Streets: Local Street Collector or Arterial Street Side Yard: Principal Building Accessory Building Thirty (30) Feet Forty (40) Feet Ten (10) Feet Five (5) Feet Rear Yard: Principal Building Accessory Building Thirty (30) Feet Five (30) Feet • • • The Zoning Ordinance also allows encroachments into setbacks for certain types of construction. The encroachment section allows the following: Permitted Yard Encroachments. The following shall not be considered as encroachments on setback requirements subject to other conditions provided herein: a. All Yards. 2) Posts, flues, belt course, bay windows, leaders, sills, pilaster, eaves, gutters, awnings, open terraces, open canopies, chimneys, ornamental features, open fire escapes extending from the principal structure, provided they do not project more than three (3) feet into a required setback. 3) Uncovered porches, decks, balconies, stoops, or similar features provided: a. The decking shall not extend above the height of the floor of the ground floor level of the principal structure though railings may be higher, and b. They shall not extend to a distance less than five (5) feet from any side or rear lot line, and c. They shall not extend to a distance less than twenty (20) feet of any lot line abutting a street, and d. They shall not extend to a distance less than one (1) foot from any existing or proposed access drive, and e. No encroachment shall be permitted in existing or required drainage and utility easements. Because the proposed porch addition includes a roof structure and support posts, requirement 2 above does not allow it to encroach into a setback by more than 3 feet. If uncovered, the porch could encroach up to 10 feet as shown under number 3.c. above. The variance is essentially for the 1.5 feet of additional encroachment that would be required for the proposed improvement. As such, staff considers the encroachment to be a 1.5 foot encroachment of the 27 feet (considering the 3 foot allowance from number 2 above) meaning the encroachment would be roughly 5 percent. Additionally, the existing detached garage that was being removed for the project was encroaching into the front setback and therefore the project is eliminating an existing non- conformity. • Findings: State law requires the following finings to be made in order to grant the approval of a variance. Staff has completed the findings in regards to the upland lot area reduction based on the revised submittal: FINDINGS In considering all requests for Variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. The property is currently developed with a single family home that can easily be put to a reasonable use without the addition of a porch covered with a roof structure. b. That the plight of the landowners is due to physical circumstances unique to his property not created by the landowner. The existing structures lack of a significant entry feature and the placement of the existing home only 15 inches from the front setback are physical circumstances that were not created by the current landowner. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. The request made by the property owner has nothing to do with economic considerations; the placement of the home on the lot when it was constructed simply prohibits the addition of the proposed covered porch under the strict enforcement of the zoning ordinance. d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. Allowing a 1.5 foot variance to the 27 foot setback (based on the 3 foot encroachment allowed) is very minor in scope at roughly 5% and would not confer onto the applicant any special privilege. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the setbacks required by the ordinance is to allow separation between roadways and homes and to increase visibility at intersections. Allowing a 1.5 foot encroachment that is only 10 feet in width would not violate that spirit or intent. Studenski, City Engineer P & Z MEETING DATE: May 9, 2007 TOPIC: Public Hearing (continued): Conditional Use Permit Royal Oaks Realty — Material Storage • • BACKGROUND The Royal Oaks Realty — Material Storage Conditional Use Permit was presented at the April 116 Planning and Zoning Board meeting and was tabled due to the applicant's absence. Royal Oaks Realty is applying for an after the fact Conditional Use Permit for a earth material storage stockpile near the northeast comer of the intersection of Birch Street (CSAH 154) and 20th Avenue South (CSAH 54). The site consists of a 9.3 acre parcel located on the east side of 20th Avenue South approximately 250 feet north of the intersection of Birch Street and 20th Avenue South, as shown on the attached Exhibit A. On August 3, 2006, City staff witnessed a substantial amount of fill material on this property. A cease and desist order was sent on August 4, 2006 notifying the owner that the activity was in violation of Section 3, Subdivision 12 of the Lino Lakes Zoning Ordinance Specifically, when five thousand (5,000) or more cubic yards of material is to be removed from or deposited on any lot or parcel, a Conditional Use Permit shall be required. The zoning ordinance for Earth Moving and Land Reclamation does provide a list of conditions as a prerequisite for granting a permit. The conditions are as follows: 1. Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. 2. Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. 3. Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may determine. 4. Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. 5. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. 6. Require that all decomposable material, or other unsuitable foundation material, be removed from an area before deposition of fill begins. • Royal Oaks Realty CUP — Materials Storage Page 2 of 6 • • 7. Prepare a site plan showing existing and proposed grade elevations and effect of storm water drainage on adjacent areas. 8. Specify a time when the excavation or land reclamation project shall be completed. 9. Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's storm water management and pollution prevention plan. 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Implement the tree preservation plan. 12. In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty -five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. 13. Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. 14. Other conditions deemed appropriate to the application by the permitting authority. After receiving the cease and desist order, the property owner contacted the City and stated they had quit hauling and that a Conditional Use Permit would be pursued before any additional material was hauled into the site. The required silt fence was installed within a couple days of the contact with the property owner. The property is owned by The Sanctuary LLC, Marcel Eibensteiner is the president of that partnership. Royal Excavating will operate the earth material storage yard with the permission of The Sanctuary LLC. • Royal Oaks Realty CUP — Materials Storage Page 3 of 6 • • The content of this earth material storage stockpile is intended to be topsoil or "black dirt". The attached site plan (Exhibit B) estimates the current size of the stockpile to be 5,605 cubic yards. The Applicant intends to use the material on an "as needed" basis on various constructions sites in the general vicinity. Dump trucks would be used to deliver earth materials from the site and haul clean fill back into the site. The amount of earth material on the site would not exceed 15,000 cubic yards. The City has sent a notice to the surrounding home owners to inform them of the proposed Conditional Use Permit and invited anyone interested to provide comment. These same homeowners were also notified by the city of the public hearing in regards to this request. Attached Exhibit C shows residences neighboring the earth material storage site. A petition was received on April 9, 2007 from a neighboring resident, as shown on attached Exhibit F. The City has forwarded this Conditional Use Permit to Anoka County Highway Department. Anoka County has informed the City that they will require a Haul Permit and a Driveway Access permit to be submitted by the property owner, before any further activity can commence on the site. Anoka County is reviewing the proposal and will respond to the City related to their requirements. The deadline for the Conditional Use Permit in which the City must take action remains June 6, 2007. This date requires the City Council to take action at their May 29 meeting. A request to extend the deadline was not acceptable to the applicant. A gravel driveway provides access to all the structures. Traffic: 20th Avenue is a County Road and Anoka County has jurisdiction over the road. Traffic control will be addressed in the Anoka County haul permit. The road was designed for a 9 -ton load limit. Anoka County had previously posted it at a 7 -ton load limit keeping heavier traffic off the road. Anoka County changed the load limit a couple of years ago to the designed 9 -ton posting to allow heavier traffic to access the surrounding businesses. Grading/Drainage: Attached is a site plan for the earth materials storage site, which details the current stockpile. Silt fence has been installed and the stockpile will be subject to regular NPDES inspections conducted by City staff. Rice Creek Watershed District (RCWD) has reviewed the site and confirmed that the property doesn't have any wetlands and is outside of the floodplain. The stockpile is partially vegetated and will require additional stabilization. RCWD does not require a formal permit for this activity. They will monitor the site for erosion and sediment control. Tree Preservation Plan: A tree preservation plan is not required since the materials storage pile has been moved more than 50 feet from the existing trees. Recommendations: Conditions met by the applicant since the April 11, 2007 Planning and Zoning Board Meeting 1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with Minnesota Pollution Control Agency (MPCA) requirements has been prepared by the applicant. 2. The house foundation has been properly removed from the site. 3. The existing septic system has been abandoned according to City requirements. • Royal Oaks Realty CUP — Materials Storage Page 5 of 6 4. The site has been cleared of debris and other objects to provide a safe situation for the proposed material hauling operation. 5. The site has fence and barricaded entrances to prevent the general public from depositing garbage or refuse. Staff recommends approval of the conditional use permit subject to the following conditions of which some have been adjusted in response to the April 11 planning and zoning meeting: 1. Maximum slope on the pile shall be a 1 to 1 and in such condition as not to be dangerous because of sliding or caving banks. 2. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. 3. A maximum amount of 7,000 cubic yards of material will be allowed on the site at any time. A permanent berm located around the stockpiled earth material will be required. 4. The maximum height of the stockpile material shall be 25 feet from grade. 5. The maximum number of trips per day shall be limited to the lowest figure, either 25 trips per day (one trip is into and out of the site) or the allowable number from the Anoka County Highway Department. 6. A rock trench entrance shall be installed and maintained at all times. 7. Dust and wind erosion must be confined to the site and be controlled by watering the driveway as necessary. 8. Materials hauled in must have vegetation applied within 48 hours of its arrival. 9. All construction activity shall be limited to the hours set as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m Sunday and Holidays No working hours allowed 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. Permits from the Anoka County Highway Department must be submitted to the City prior to any activity. All activities on the site must comply with the Anoka County permit requirements. 13. The CUP will be reviewed annually. If the site is not kept in compliance with the conditions set forth, the permit may be revoked by the City Council. Studenski, City Engineer P & Z MEETING DATE: May 9, 2007 TOPIC: Public Hearing: Conditional Use Permit AIT — Earth Material Excavation (6497 12th Avenue South) • BACKGROUND AIT is applying for a Conditional Use Permit for earth material excavation near the southwest corner of the intersection of Birch Street (CSAH 34) and 12th Avenue South. The site consists of a 35.4 acre parcel (6510 12th Avenue South) and a 10.34 parcel (6497 12th Avenue South) located on the west side of 12th Avenue South and the south side of Birch Street, as shown on the attached Exhibit A. The amount of material proposed for excavation from the site is approximately 90,000 cubic yards, with the majority of the excavated material being hauled to and deposited on the The Preserve development (Integra Homes Site). The remaining balance of the material will be hauled to construction sites outside the City of Lino Lakes. The grading plan for the site dated October 13, 2006, displaying the site layout, proposed excavation areas, silt fence locations, and existing wetlands is shown on the attached Exhibit B. Section 3, Subdivision 12 of the zoning ordinance for Earth Moving and Land Reclamation provides a list of conditions as a prerequisite for granting a permit. Those conditions are as follows: 1. Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. 2. Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. 3. Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may determine. 4. Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. 5. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. 6. Require that all decomposable material, or other unsuitable foundation material, • be removed from an area before deposition of fill begins. 7. Prepare a site plan showing existing and proposed grade elevations and effect of storm water drainage on adjacent areas. AIT CUP — Materials Storage (6497 12th Avenue South) Page 2 of 6 8. Specify a time when the excavation or land reclamation project shall be completed. 9. Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's storm water management and pollution prevention plan. 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Implement the tree preservation plan. 12. In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty -five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. 13. Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. 14. Other conditions deemed appropriate to the application by the permitting authority. The Preserve preliminary plat, Resolution 06 -137 was approved at the August 28, 2006 City Council Meeting. The preliminary plat for the preserve is shown on the attached Exhibit C. The properties at 6510 12th Avenue South and 6497 12th Avenue South are owned by Alwin and Agnes LaMotte. An application for Grading Permit that names AIT as the general contract has been submitted to the City by Alwin and Agnes LaMotte. The City has sent a public hearing notice to the surrounding home owners to inform them of the proposed Conditional Use Permit and has invited anyone wishing to be heard regarding this item to attend the public hearing. Attached Exhibit C shows residences neighboring the earth material storage site. AIT CUP — Materials Storage (6497 12th Avenue South) Page 3 of 6 This Conditional Use Permit has been forwarded to the Anoka County Highway Department. Anoka County will require a haul permit due to the proposed haul route using Birch Street. Anoka County is reviewing the proposal and will respond to the City related to their requirements. The Conditional Use Permit was submitted to the City on April 9, 2007. The deadline for the Conditional Use Permit in which the City must take action is June 7, 2007. This date requires the Planning and Zoning Board to take action at the May 9 meeting and the City Council to take action at their May 29 meeting. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. Also, attached are Exhibits D and E that show the Existing Zoning and Guided Land Use respectively. Traffic: The proposed haul route for the excavated materials from the AIT excavation site to The Preserve follows 12th Avenue South to Birch Street and onto Pheasant Run South to The Preserve. The remainder of the material will be hauled on 12th Avenue South to Birch Street and to locations outside the City Limits. AIT CUP — Materials Storage (6497 12th Avenue South) Page 4 of 6 12th Avenue South and Holly Drive are under the jurisdiction of the City. Birch Street is an Anoka County State Aid Highway. Anoka County will require a haul permit to be obtained by AIT, which will address the trips per day, traffic control and any other County requirements. The City requirements for the use of the streets can be found in the recommendations. Grading/Drainage: Attached Exhibit B is a grading plan for the earth materials excavation site, which details the proposed excavation on the site. An Erosion and Sedimentation Control Plan along with a Storm Water Pollution Prevention Plan (SWPPP) have been submitted to the city, which address requirements under the National Pollution Discharge Elimination Systems (NPDES) General Permit for the site. The City will conduct regular inspections of the site to ensure that all NPDES General Permit requirements are being met. The wetlands on the site have been delineated and are shown on the attached Exhibit B and C. Wetlands will not be affected by the excavation or grading. Excavation will occur below the water table. Attached is a memorandum dated April 23, 2007 addressing any impacts and concerns The grading plan and conditional use permit has been submitted to the Rice Creek Watershed District (RCWD) for there review and approval. Tree Preservation Plan: The applicant shall provide a tree preservation plan. The tree preservation plan shall be completed in accordance with the City Tree Preservation Policy. A tree preservation plan will not be required if the excavation materials are moved at least 50 feet from the existing trees. Recommendations: 1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with Minnesota Pollution Control Agency (MPCA). The SWPPP must contain the name and a 24 -hour telephone number of the responsible manager of the SWPPP. All references to MNDOT seed mix must be changed to the City native seed mix. 2. Silt fence must be added around the excavation for safety reasons. 3. Properly fence and barricade entrances to prevent the general public from depositing garbage or refuse. 4. Must provide a tree preservation plan or limit excavation of material to a minimum of 50 feet from any trees. • AIT CUP — Materials Storage (6497 12th Avenue South) Page 5 of 6 4. All truck hauling activity must exit the site on 12th Avenue South and go north to Birch Street. 5. All City streets where hauling activity occurs will be video taped previous to excavation commencing at the site. The applicant will be responsible for repairing any damage to City streets caused by the hauling activity. 6. Previous to any activity on the site the applicant will be required to hold a neighborhood meeting to notify affected property owners along the haul route and within one - quarter of a mile of the site. 7. Maximum slope on any excavation shall be a 1 to 1 and in such condition as not to be dangerous because of sliding or caving side slopes. 8. Only topsoil will be allowed to be brought into the site. 9. A rock trench entrance shall be installed and maintained at all times. 10. Dust and wind erosion must be confined to the site and be controlled by watering the driveway as necessary. 11. Street sweeping shall occur as necessary. 12. All construction activity shall be limited to the hours set as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m Sunday and Holidays No working hours allowed 13. SUBJECT: Grading Pond Evaluation Lamotte Property Grading Lino Lakes, MN MFRA #16379 This memo will summarize and evaluate the anticipated effects of excavating three ponds in previous upland areas for the Lamotte Property in Lino Lakes, MN. These ponds are located within the vicinity of Anoka County Ditch 25. ALTERATIONS TO EXISTING DRAINAGE AREAS The attached sketch delineates the drainage area to each of the ponds. As shown in the sketch, each pond's drainage area is relatively isolated to immediate upstream areas. The construction of the ponds will not greatly alter existing drainage patterns. The outlet of Pond C would be the wetland located to the south. That wetland is not directly connected to ACD 25 and appears to drain to Cedar Lake Watershed before reaching ACD 25. PONDS AFFECT ON NEARBY WETLANDS The attached soil borings show the underlying soil types are shown to have the greatest effect on groundwater elevations. Soil Boring #2 (located in Area of Pond B) shows the groundwater elevation is most likely the result of artesian pressure. For the other ponds, the groundwater elevations tend to be located slightly above clay lens layers. • The large Anoka County Ditch wetland contains areas of peat extending to over 14' below the surface. Soil borings adjacent to the one taken in the ACD #25 ( #2 and #3a) wetland show groundwater elevations to be below observed groundwater elevations in ACD #25. Those borings do not contain peat which indicate those upland areas are not directly feeding the ACD #25 wetland, and that ACD #25 wetland characteristics are mainly as a result of the peat deposits - abi -lity -te -hold water: -Given the ACD #25-wetland- type {Type If), the wetland -can function without baseflow and by definition, can have occasional dry periods. The groundwater tables for all other areas not located in peat appear to be dictated by clay layer locations and possibly artesian pressure from lower groundwater aquifers. Given the watershed, which is relatively flat and serves large floodplain areas, groundwater and surface water could easily enter the ACD 25 watershed area due to backflows from downstream watersheds, or lateral groundwater movement from upstream surface watersheds. ANTICIPATED NWL OF PONDS The anticipated NWL or Ordinary High Water Level for each of the ponds are shown in the attached sketch. The elevations are estimated based on soil boring readings. Mottling of soil above the groundwater elevations do exist for Borings 1 and 2 which indicate the NWL could be higher than what is currently shown. We expect the NWL of Pond C will remain relatively consistent given the presence of sandy soil above the NWL. Pond B has more clay concentration, however we feel the soil will allow effective transmission of water as to keep NWLJOHW at or near the 881.5 elevation because there is sufficient larger particle size material. DEWATERING Ponds A and B dewatering outlets will be placed at a location upstream of the main ACD #25 channel within the outer wetland area so that direct discharge into the main ACD #25 channel will not occur. Pond C dewatering outlet will be to the southern wetland located adjacent to the pond. FLOODPLAIN ALTERATION Pond A will provide an additional 1.73 Ac -ft of floodplain storage. Pond B will create an additional 14.25 Ac -ft of floodplain storage. The additional storage is taken from the pond overflow to the 892.1 flood elevation. Pond C should not add additional storage due to the permanent inundation of the surface from the bottom to the 100 -year flood elevation. STAFF ORIGINATOR: Paul Bengtson P & Z MEETING DATE: May 9, 2007 TOPIC: Public Hearing: Conditional Use Permit Amendment Molin Concrete Office Building and Campus Addition BACKGROUND Molin Concrete is proposing a 7,785 square foot office building and some minor facade improvements to the existing office building to create a more cohesive appearance to their facilities at 415 Lilac Street. The improvements to the site include two phases. The first phase being that of the office building and the associated site work, and the second phase being the wetland mitigation/enhancement area that was included as part of their application to the Rice Creek Watershed District for the future addition to the manufacturing building. The First Phase is the only part of the application that the city is being asked to review. The Second Phase is simply shown to clarify the earlier plans which included all of the improvements. Phase Two will require a separate application for a Conditional Use Permit Amendment. The Molin property is covered by a conditional use permit for the concrete plant. The northern 20 acres is covered by an interim use permit for outdoor storage. This new application does not involve the storage area. The Conditional Use Permit covers the entire site. Building additions such as those proposed in this application require an amendment to the Conditional Use Permit. Because this application involves the CUP amendment, it is appropriate to review the conditions placed on the site through the last CUP amendment in 2006. The City amended the CUP in 2003 with Resolution 03 -73, in February 2005 with Resolution 05 -13, and again in February 2006 with Resolution 06 -32. Molin Concrete has sent a notice to the surrounding home owners to inform them of the proposed expansion and invited anyone interested to provide comment. These same homeowners were also noticed by the city of the public hearing in regards to this request. • • • Molin Amendment Page 2 of 3 ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The office building will occupy the space between the existing office building and the existing maintenance building. It will be single story with a trellis attaching the new office building to the existing to create a cohesive appearance to the site. The building materials meet all of the city requirements and the design appropriately addresses the base /middle /top approach required by the zoning ordinance. Lighting: The lighting attached to the building will be required to meet all city standards for downcast, shielded lighting. A lighting plan will be required prior to the issuance of building permits that will confirm compliance. Grading/Drainage, Utilities: A grading and utility plan was submitted with this application, and was thoroughly reviewed by the City Engineer. A memorandum is attached to this report that outlines all of the City Engineer's comments. The applicant has also submitted their plans to the Rice Creek Watershed District for review and will be required to obtain any necessary permits. The wetland mitigation and enhancement proposed on the site plan is not meant to be a part of this request. It was shown on the plans by the applicant to depict the ultimate plans for the site. A condition of approval clearly indicates that Phase Two will require a separate conditional use permit amendment most likely to coincide with the expansion of the manufacturing building. Landscaping: With each addition to the site the largest concern has been the exterior landscaping on the site, which continually is inspected by city staff for compliance. The City Forester visited the site on April 5, 2007 and met with the applicant to address any landscaping concerns that existed. This office building proposal will require some changes to the landscaping plan to account for some building plantings, but no major changes to the exterior landscaping plan are being proposed. • Molin Amendment Page 3 of 3 • • RECOMMENDATION Staff recommends approval subject to the following conditions: 1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 2. All conditions of the previous amendments shall continue to apply. 3. A Performance Agreement between the applicant and city must be executed prior to the issuance of building permits for the site. 4. A photometric lighting plan in conformance with the standards of the zoning code must be submitted prior to the issuance of building permits. All lighting fixtures will be downcast shielded as required by the zoning code. 5. Trash enclosures must incorporate the same materials used in the construction of the main building. 6. The applicant shall obtain the necessary Rice Creek Watershed District permits. 7. The improvements are limited to those areas depicted as Phase One.
