MEETING GUIDELINES
Open Mike — The purpose of a Board Meeting is to accomplish the business of the city.
When presenting at a meeting please remember to be respectful, and follow these
guidelines:
• Please address the meeting chair.
• State your name and address for the record.
• Please observe a 4- minute limit.
• The topic must relate to city business.
• Open Mike is for items not on the agenda.
• A spokesperson must represent a group of five or more — groups will have 8 minutes.
• The Presiding Officer may limit duplicative presentations.
• Remember, the meeting is to discuss city business only.
Public Hearing - Held as a separate item of business on the agenda. The public hearing
segment is your opportunity to tell the Board how you feel about issues scheduled to be
heard. Typically, a hearing follows these steps:
• The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and
ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all
meetings.
• Staff will present their report on the proposal.
• Board members will then ask City Staff questions about the proposal.
• The Presiding Officer will then open up the public hearing for anyone present who wishes to
comment on the proposal. This is the time for the public to make comments or ask questions
about the proposal.
Comments should be limited to four (4) minutes unless further time is granted by the
Presiding Officer. All comments should be directed to the Board as a body and not to any
individual Board Member or City Staff Member unless permission is granted by the Presiding
Officer. No person shall be permitted to enter into any discussion, either directly or through a
member of the Board without the permission of the Presiding Officer.
• After everyone in the audience wishing to speak has given his/her comments, the Presiding
Officer shall close the public hearing.
• The Board will then discuss the proposal. No further public comments are allowed.
• The Board will then make a recommendation(s) and/or a decision.
When you are called upon for your comments, please step to the microphone at the
podium and state your name and address for the record.
Occasionally, the Board may continue a hearing to another meeting before taking action.

Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6:31
p.m. on May 9, 2007.

Mr. Rafferty made a MOTION to table the approval of the April 11, 2007 Minutes to the
meeting on June 13, 2007. Motion was supported by Mr. Pogalz. Motion carried 6 - 0.

Staff recommended approval of the variance request.
The applicant, Mr. James Schally, was not present at the meeting.
Board Members discussed the necessity of the roof and the intent of the porch.
Mr. Pogalz made a MOTION to recommend approval of the Variance to the local street
setback to allow for a covered porch addition at 8020 Danube Street. Motion was
supported by Mr. Laden. Motion carried 6 - 0.
B. CONTINUED PUBLIC HEARING for a Conditional Use Permit for earth
material storage at 6644 20th Avenue, Royal Oaks Realty
Mr. Studenski presented the staff report.
Mr. Studenski stated that resident Julie McNeely, 6687 20th Ave., was unable to attend
the meeting but asked staff to forward her comment to the board that she is against the
proj ect.
Staff stated their review was based on the 14 conditions of the Zoning Ordinance for
Earth Moving and Land Reclamation. Staff reminded the board of the petitions against
the project that were submitted at the April meeting.
Mr. Studenski explained that the city had received a review from the Anoka County
Highway Department earlier that day. He clarified that neither the county nor the city
would require the additional 27 feet of right -of -way for this request. He stated that
County comments included: moving the driveway as far to the north as possible, adding a
culvert, and constructing north and south bound turn lanes and a bypass lane. The City
contacted Anoka County after receiving the letter, and was informed by Randy Bettinger
at Anoka County that road improvements will be required regardless of the number of
trucks per day, but the required combination of lanes still needs to be determined. Mr.
Studenski added that drainage calculations would be required to determine how drainage
would affect the county road and that a Haul Permit is required by the county.
Mr. Studenski explained that the deadline for this application is June 6, which requires
action by the P &Z Board at this meeting. He added that the applicant did not see a
rationale to extend the item. Mr. Studenski noted that the Rice Creek Watershed District
does not require a permit, but will monitor the site.
Mr. Studenski stated that the applicant had already addressed a number of issues and
conditions since the previous meeting. Staff explained that the dirt pile had been moved
to a location more than 50 feet away from any existing trees. The applicant submitted a
Storm Water Pollution Prevention Plan (SWPPP), filled the house foundation, abandoned
the septic system, cleared and removed debris and objects from the site, added a fenced
barricade to the driveway entrance, and added a dirt berm to the northern access. Staff
recommended approval of the Conditional Use Permit subject to the 13 conditions listed
in the staff report.

Mr. Nelson referred to Condition No. 12, and asked what would happen if the county
decided to allow a variance that the city did not agree with. Staff replied that the county
will have their own requirements. Mr. Studenski stated that the city could amend the
conditions of approval to address this.
Staff confirmed that the existing stockpile is currently 22 - 24 feet high.
Mr. Pogalz asked why the trips per day were reduced from 50 to 25 trips per day. Staff
said they had reduced the number in response to resident and Planning and Zoning Board
Member concerns.
Mr. Laden pointed out that the ordinance requires that an applicant specify a completion
date, and asked if a completion date had been addressed. Mr. Studenski replied that
development is anticipated on the site in the near future and, due to the limited amount of
activity that will occur, staff had not requested a specific completion date. Staff noted
that the board could recommend a deadline date, but that all CUPs are reviewed annually.
Applicant, Mike Black, Royal Oaks Realty, 1000 County Road E, Suite 150, Shoreview,
MN, reiterated that the zoning ordinance allows this use in any zoning district. He stated
that conditions are required for a CUP in order to make the use compatible with
neighboring properties. Mr. Black described that Royal Oaks Realty is a land
development company, Royal Excavating is their sister company, and Imperial Homes is
the home building company and they all work together. He explained the intent of their
request is to stockpile dirt for their own company and that dirt will not be sold to other
companies. He said they presume that some weeks there may be no trucks accessing the
site, and explained that they will access the stockpile when there is final grade work
being done. He noted that they never intended to be hauling material in and out on a
daily basis, and only when there is a bigger job would they possibly meet the maximum
trips per day. He thanked the board members that were able to visit the site. He stated
that they have tried to meet a number of staff's recommendations since the last P &Z
meeting, and they should not have a problem adhering to staff's conditions of approval.
He stated that he spoke with Randy Bettinger of Anoka County earlier that day regarding
the county review. He was told by Mr. Bettinger that the County is offering comments,
but not necessarily requirements. He said Mr. Bettinger stated that the county does not
require the road improvements. Mr. Black spoke of the possibility of moving the
entrance. He said he is concerned about the road recommendations, but added that Mr.
Bettinger told him that if the city does not require this, then the county does not require it.
He would like an opportunity to discuss the county's recommendations with city staff and
the county.
Mr. Nelson commented that he believes that the term grading means a one -time earth
moving.
Mr. Laden believes the intent of the ordinance is for a temporary use, and that a final
grading plan and a project completion date are required.
Mr. Black stated that the property is guided for medium density residential and that they
hope to develop in two to five years or sooner. He explained that once there is a

development application, the use will stop. He added that they would not go through
with the application if the county required the turn lane changes.
Mr. Laden said he believes that to allow storage means something will be stored and will
stay there.
Mr. Black informed the board that the majority of the dirt came from Centerville and that
only black dirt will be stored on the site.
Mr. Rafferty asked Mr. Black to consider how he would feel if he were a neighbor. Mr.
Black reminded the board that this would be a conditional use in which staff can apply
conditions in order for the property owner to use the property in a certain way. Mr. Black
reiterated that dump trucks will not be accessing the site every day and he feels a cap of
25 trips per day is feasible. He estimated, on average, possibly 10 trips per day once a
week would access the site.
Mr. Nelson suggested limiting the number of trips per day to a monthly threshold instead
of a daily threshold.
Chair Tralle opened the Public Hearing at 7:27 p.m.
Mrs. Patrice Carpenter, 6748 20th Ave., said she stated concerns at the last meeting. She
said the applicant has been a good neighbor and has been making a lot of improvements.
Her concern is that he didn't get permission prior to the stockpile placement and
movement. She is concerned about the issue of the turning lanes and that moving the
driveway north would be a lot closer to her. She said there is a blind hill heading north
on 20th, so if they moved the driveway to the north then turn lanes would be necessary.
She stated there is no need for turn lanes if the driveway stays in its current location. She
understands the site is rural and she is used to dirt, but doesn't know when the dirt will be
flying around. She feels there is no way to vegetate anything with all of the earth
movement. She does not feel the height of the dirt pile makes a difference. She informed
the board that flying dirt is a nuisance. She was relieved to hear the dirt came from
Centerville. She said she would really not like the use here and would have liked it more
if the applicant had asked permission prior to them doing it. Mrs. Carpenter
recommended that the board not approve the request and asked that the pile of dirt be
moved.
John Pignato, 6709 20th Ave. S., stated that there are no turn lanes in Centerville, and that
all kinds of traffic is going there now, just not so many dump trucks. He said they have
been putting up with semi - trucks and earth moving equipment for a long time because of
new businesses in Centerville, noting this is just another straw in the camel's back. He
feels that they will be accessing the site more often than Mr. Black has suggested. He
stated that dirt is blowing and there is mud on the road. He stated that he is against the
application and hopes the board denies it.
Mr. Tralle asked Mr. Black to address some of the concerns.

Mr. Black said that they will Hydro -seed the stockpile to establish vegetation and reseed
as necessary. He added that they have a truck for watering and they will sweep as needed
to clean and maintain the road. He said they do not have a problem with a gravel
driveway as it is almost there by now. He anticipates they will be moving the dirt small
sections at a time. He is willing to create a new driveway to within 30 feet of the property
line if it is required. He added, however, that trees there currently act as a buffer, so if
the drive is relocated north of the trees the buffer will be lost.
Mr. Nelson suggested the possibility of adding a stipulation for use at three to four years
and capping the allowable trips per month. Mr. Black said that sounded reasonable, but
was not sure if the attorney would agree with adding a completion date.
Mr. Black said he understands they are trying to find thresholds of compatibility. He
reiterated that the use is not intended, and was never intended, to be a constant moving
activity, but simply supplemental material available for nearby construction sites as need
be. He asked the board to consider a one year allowance to prove that it will be a
compatible use with the neighborhood.
Mr. Pogalz made a MOTION to close the Public Hearing at 7:47 p.m. Motion was
supported by Mr. Hyden. Motion carried 6 - 0.
Mr. Pogalz reiterated his comments from the last board meeting. He stated that the
property is zoned rural, which allows more flexibility to the property owner. He added
that it could be a lot worse if the property was used for farming. He pointed out the this
sounded like an example of NIMBY — Not In My Back Yard, which means that residents
are okay with things as long as it's not in their back yard. He added that turn lanes sound
okay because the county may require them with development. He suggested they look at
this use as a distribution center somewhat like Schwan's. He feels they are putting good
limits on a use. He noted that normal construction operations happen as areas develop.
He added that the use would go away in a few years as the land would be more valuable
with homes rather than dirt on it. He stated he is in favor of approving the CUP.
Mr. Rafferty made a MOTION to recommend denial of the Conditional Use Permit for
earth material storage at 6644 20th Avenue. Motion was supported by Mr. Laden. The
following role call vote was taken, Nelson: No, Root: Yes, Rafferty: Yes, Hyden: No,
Pogalz: No, Laden: Yes, Tralle: Yes. Motion carried 4 -3.
Mr. Studenski asked for the board's rationale for denial, which he stated is necessary
when an application is forwarded with a recommendation for denial.
Mr. Root stated the use is too intense for the roads and a nuisance for the neighbors. Mr.
Rafferty believes this use is not what the ordinance intended.
Mr. Tralle does not agree that there is no end in site, he is disturbed that they did not ask
permission prior to use, and he does not feel they can monitor the amount of traffic.
Mr. Laden stated it does not meet ordinance requirements without an end date. He
considers it to be an off -site delivery business that would not be allowed in a rural zone.

Mr. Nelson suggested putting a new motion on the table to include a completion date for
the use. Mr. Tralle stated that a motion had already been passed for the application.
The board took a 10- minute recess at 7:57 p.m.
The meeting reconvened at 8:08 p.m.
C. PUBLIC HEARING for a Conditional Use Permit for earth material excavation
and storage at 6497 12th Avenue, A.I.T.
Mr. Studenski presented the staff report. He added that Anoka County does not require
any permits for activity from this site as the site does not directly access onto a county
road. He stated the deadline for this application is June 7, so the City Council would
have to take action at the May 19 meeting. Therefore, the board would have to take
action at this meeting to meet the time frame.
Mr. Studenski described the site layout per the exhibits included in the staff report. He
noted that they will only access the westernmost pile across the ditch if it becomes
necessary to obtain the required amount of fill.
Mr. Studenski said that the Rice Creek Watershed District (RCWD) has not taken action
on the project at this time. He said the applicant does not intend to move any trees on
either site. He explained that the activity going in and out of The Preserve site will be
intense at some time regardless of where the dirt comes from. He added that this is
possibly the shortest truck route possible to the site.
Mr. Studenski reviewed the conditions of approval that staff suggested for this
application. He added that Condition 15 will be changed to read that no permits are
required by Anoka County.
Mr. Studenski stated that the ponds will be monitored to discharge water prior to reaching
the ditch. He does not anticipate issues and added that the city and RCWD will monitor
the flow. Mr. Studenski said that pumps will run continually in order to work effectively.
Board members discussed the possibility of using flags and limiting the speed of trucks in
order to help with traffic flow. Staff stated that traffic activity on Birch St. will be
monitored and that flagging will be required if determined to be necessary for safety.
Board members discussed the proposed ponding areas, including slopes, pond depths and
vegetation. Mr. Studenskin explained that the applicant will vegetate according to city
specifications. He said that one pond will be very shallow and the one to the west of the
house will be 18 -20 feet below the water table. He noted that the smallest pond is the
least desirable and most expensive to excavate, therefore the specific process of
excavation will be determined by the contractor.

Board members wondered why the ponds did not include a bench for safety reasons. Mr.
Studenski explained that the applicant is not creating any water storage areas and the
ponds will not be designed to be long -term.
Mr. Studenski informed the board that caution signs are typical with development, and
signs will be placed along Birch St. so it is not necessary to include this as a condition.
Applicant, Mr. Brian Bourassa, MFRA Engineering, Plymouth, MN, and Adam Parker,
hydrologist, answered questions for the board. Mr. Bourassa stated that berms around the
dewatering equipment would be a great idea. He explained that the material they are
going after is sandy material for building roads and house pads, and they will need an
estimated 50,000 to 60,000 cubic yards for The Preserve site. Mr. Bourassa said he lives
in the area and is aware that traffic is difficult. He likes the idea of warning signs on
Birch St. and 12th Ave, and is open to staff's recommendations regarding flagging. Mr.
Bourassa showed the board members the location of the temporary storage on the site.
He noted that the Environmental Board had suggested a specific seed mix for vegetation,
and he will work with Marty Asleson at the City. He said he didn't show a bench
because there is no development plan there, but realizes at some time a bench will
probably be required. He noted that the water level in the ponds is estimated to remain
what it is today. He said they do not anticipate accessing the third excavation site. He
described that if they use six to eight 12 -yard trucks to haul the estimated 50,000 cubic
yards of dirt during haul hours, it would take 13 days if everything ran perfectly.
Realistically, they estimate it will take four to six weeks to haul the dirt for The Preserve.
Mr. Parker explained to the board the dewatering process that will be used on the site.
He explained that a number of engineers on staff will help determine the best vegetation
and will follow the city's recommendations. He explained that SWPPPs will limit dust
and keep topsoil in place.
Board members expressed concern about water levels, safety of the excavation site and
street clean-up and maintenance. Mr. Parker remarked that the vegetation used will be
selected to handle the water levels, with only three to four foot fluctuations expected.
Mr. Bourassa added that there will be no discharge from these basins and expects there to
be less water or the same as there is today.
Mr. Bourassa stated that silt or snow fencing will be used for safety. He explained that
they are proposing a rock trench entrance to knock dirt off the wheels, a silt fence to
prevent erosion from the pile, and will comply with requirements regarding street
sweeping.
Mr. Pogalz pointed out that the application is for an expected use of 90,000 cubic yards,
with 50,000 going to The Preserve. He asked if the excess material will be sold to
another developer or development and why they should allow him to take the material off
site. He asked why they couldn't just take the 50,000 to 60,000 for The Preserve. Mr.
Bourassa replied that the purpose is to haul the excess material to a different site.

Mr. Bourassa suggested the board could but a sunset period on when the site needs to be
cleaned up. He went on to say if there is a market for the material, and they think there
is, they propose to sell it.
Mr. Pogalz pointed out that a timeline of four to six weeks is expected for The Preserve,
with an extra four to six weeks to access additional sites. Mr. Bourassa clarified that
additional trucks may be used for the other sites.
Mr. Tralle stated that if they are going to have to put in a bench eventually, then it should
just go in now. He asked what the restoration plan is for the area. Mr. Bourassa replied
that the property owners, the Lamottes, see the ponds as a buffer to the future growth
area.
Mr. Tralle asked what the estimated truck traffic would be on a normal day. Mr.
Bourassa replied that they expected six to eight trucks to haul all day long for roughly
four to five weeks.
Mr. Tralle opened the Public Hearing 9:06 p.m.
Bill Combs, 6496 N. Trappers Crossing, said his property is on the comer lot directly
behind the large stockpile site. He was concerned about safety issues. He said he has
young boys and a dog that play on the Lamotte property and he is not convinced of safety
with the proposed silt and storm fencing. He was concerned about how close to his
property line the pond would be and how big it would get. He was concerned for the
safety of his children and other children.
Mr. Bourassa responded that the start of the grade is maybe 10 -15 feet north of property
line. He anticipated water elevation to be maybe 120 feet north of his back property line.
Joe Knudsen, 6525 White Oak Rd., stated concerns about trucks exiting on 12th Ave. and
asked how close to the road the proposed stockpile would be. He was concerned it would
be near development. Mr. Bourassa explained that the temporary stockpile of sand and
dirt would be stored north of the trees and west of 12th Ave. Mr. Knudsen also expressed
concern about the number of trucks and truckloads that would be used.
Mr. Pogalz estimated that in a ten -hour day, approximately 240 truckloads could be
hauled per day for 28 days.
Mr. Knudsen stated concern for damage that may be done to the road. Mr. Studenski
replied that they applicant would be required to replace any damage in kind with what is
there now.
Tim Renslow, 6586 Pheasant Run South, requested a confirmation of the proposed truck
route. Mr. Bourassa explained the route to be used. Mr. Renslow added his concerns
included dust, noise, and safety for children. He was very concerned that many of the
families in the area have small children that may get hurt.
Mr. Tralle replied that they are not disregarding the issues.

Mr. Renslow added that he is concerned about the condition of Pheasant Run S. Mr.
Tralle responded that they can reduce truck speed and the applicant will clean the roads
on a daily basis.
Mr. Pogalz explained that Pheasant Run S. will see just as much traffic regardless of
where the dirt will come from as it has to come from somewhere. He added it is probably
better that it come from a nearby site as it would happen faster.
Ben Peterson, 6441 Royal Pines Place, stated his property is directly south of the
southern property line. Mr. Peterson requested that they put the snow fence around the
entire property. He asked how many backhoes and diggers would be used and if they
would be using bobcats. He wondered how many water pumps would be used. He
wondered once they start digging dirt out of the ponds, how long will it take to dry until it
can be hauled away. He asked how lon the project would actually last. He stated he has
concerns about traffic, especially on 12 Ave. He noted that the property owner has
planted great trees on the property and wondered if he could line the southern property
line with trees, adding that he would be willing to help out if needed.
Mr. Bourassa believes the operation will consist of one backhoe and one dozer accessing
one pond at a time. He does not anticipate the use of bobcats, but one front endloader
may be used. He estimated that one pump at a time will be used for dewatering. He
stated that they propose to place silt or snow fence around excavation areas as shown on
the plan for safety measures.
Mr. Tralle pointed out there is a wetland area between Mr. Peterson's house and the
excavation area.
Mr. Peterson added that an increase of trucks might add curiosity to kids and he is
concerned about their safety.
Shari Livingston, 6574 Pheasant Run South, and father Larry Stinksy, stated concerns
about the amount of truck traffic on Pheasant Run S. He stated there is a park where the
truck traffic will be going through. He is especially concerned about times when kids are
coming home from school or accessing the park. He added that cars always parked on
the street, making it a hazard. He distibuted photos to the board of standing water in the
drainage ditch behind the house, adding that the photos were taken after one day of heavy
rain.
Rick Reibel, 6535 Pheasant Run South, was concerned about the safety of children. He
doesn't believe the lanes are very wide on the road, and with community sports there are
often kids on the street by the park and riding bikes. He pointed out that their
neighborhood includes diverse neighbors that may have issues with understanding signs.
He was concerned about the environmental impact of the surface water drainage system.
He stated concern about high water levels on Black Duck Drive to the north. He would
like to see an independent report of the environmental water impact table, stating that
they should be able to provide numbers with a hydrologist on board. He is concerned
about cranes and Canadian Geese that nest in the drain field each year. He has concerns

about drinking water, heavy loaders possibly degrading Pheasant Run, vibration, and if
there are contingency plans for operating damages.
Mr. Studenski stated that any activity adversely affecting neighbors is the responsibility
of the applicant. He added that the city will monitor truck traffic, and if issues occur they
will be addressed.
Mr. Hyden reiterated that the RCWD is involved in monitoring this project.
Mr. Parker addressed hydrology questions. He explained that the DNR is the authority
and they will work closely with them. He said that runoff will go through other wetlands
before reaching the ditch.

Mr. Laden said he was concerned about the truck traffic being allowed next to a city park
during hours when activities are occurring with children and on- street parking. That's
where he sees greatest danger. He proposed limiting or eliminating truck traffic during
evening hours.
Board Members agreed to amend Condition No. 12 to read Monday — Friday 7 a.m. to 5
p.m.
Mr. Rafferty said he is concerned about city streets but is not sure they can contain
people from development that is already approved. Mr. Rafferty suggested adding a
condition to reduce the speed of trucks to 20 mph.
Board Members agreed to add Condition No. 18 to say that trucks will be limited to a
maximum speed of 20 mph.
Board Members agreed to add Condition No. 19 to say that the city will monitor traffic
and define traffic signage to include the necessary use of flagmen and hauling signage at
the contractor's expense.
Mr. Studenski confirmed that neighbors would be notified of work to be done and that a
neighborhood meeting would be held.
After discussion about the silt/snow fencing, Mr. Bourassa agreed to use snow fence
instead of silt fence, and to continue the fence southward until it reaches the wooded area.
Mr. Pogalz specified that the board is considering a CUP for excavation, storage and
transporting of material and asked if anyone could explain the difference between this
application and the Royal Oaks Realty application that was previously denied. Mr.
Studenski stated that both applications consist of on -site material being taken off site, and
the differences include the site of destination, what is to be removed, the time frame and
the restoration plan. Staff reminded the board that with this application, the use will not
continue on indefinitely, they know that this will be a concentrated effort once activity is

• started, and they will not have random material coming in and out for an undetermined

time frame.
Mr. Pogalz stressed that the same restrictions should be applied to this site as were
proposed for the other site. He does not see enough of a difference in applications to vary
the conditions for daily watering, erosion control, fencing, and vegetation within 24
hours. He asked board members for feedback.
Mr. Tralle pointed out that this application is different because the applicant came before
the board legitimately before starting activity, the dirt is being used in Lino Lakes, and
the use has an end date.
Mr. Studenski added that this is a concentrated effort in that when they are doing the
excavation it will be continually hauled off the site.
Mr. Tralle stated that the board will no longer speak of the Royal Oaks Realty request
because that is a separate application that the board already took action on.
Mr. Studenski clarified that there will be a time that the topsoil will be at the storage site,
which will be part of the SWPPP.
Board Members agreed to add Condition No. 20 to say that the stockpile area will be
limited to a maximum height of 25 feet.
Board Members agreed to add Condition No. 21 to say that areas that will not be worked
on within 48 hours are required to be hydro- seeded.
Mr. Nelson pointed out that 50,000 cubic yards of material will remain local, while
40,000 cubic yards will go offsite, which makes the use more like a distribution center
with an excessive number of trucks. He was concerned that the hauling of the extra
50,000 cubic yards will go on for five to seven months in a residential area, while they
were previously concerned about a rural area.
Mr. Laden reiterated the biggest difference is this application has an end date.
Board members pointed out the similarities between this application and the application
that was previously denied under Item 5B, however the majority of board members
agreed that enough differences were merited.
Mr. Laden made a MOTION to recommend approval of the Conditional Use Permit for
earth material excavation and storage at 6497 12th Avenue based on the following
conditions of approval:
1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with
Minnesota Pollution Control Agency (MPCA). The SWPPP must contain
the name and a 24 -hour telephone number of the responsible manager of
the SWPPP. All references to MNDOT seed mix must be changed to the
City native seed mix.

2. Silt fence must be added around the excavation for safety reasons.
3. Properly fence and barricade entrances to prevent the general public from
depositing garbage or refuse.
4. Must provide a tree preservation plan or limit excavation of material to a
minimum of 50 feet from any trees.
4. All truck hauling activity must exit the site on 12th Avenue South and go
north to Birch Street.
5. All City streets where hauling activity occurs will be video taped previous
to excavation commencing at the site. The applicant will be responsible
for repairing any damage to City streets caused by the hauling activity.
6. Previous to any activity on the site the applicant will be required to hold a
neighborhood meeting to notify affected property owners along the haul
route and within one - quarter of a mile of the site.
7. Maximum slope on any excavation shall be a 1 to 1 and in such condition
as not to be dangerous because of sliding or caving side slopes.
8. Only topsoil will be allowed to be brought into the site.
9. A rock trench entrance shall be installed and maintained at all times.
10. Dust and wind erosion must be confined to the site and be controlled by
watering the driveway as necessary.
11. Street sweeping shall occur as necessary.
12. All construction activity shall be limited to the hours set as follows:
Monday through Friday 7:00 a.m. to 5:00 p.m.
Saturday 9:00 a.m. to 5:00 p.m
Sunday and Holidays No working hours allowed
13. Reimburse the City for the cost of periodic inspections by the City for the
purpose of determining that the terms under which the permit has been
issued are being complied with.
14. Post a form of security to the City, conditioned to pay the City the cost and
expense of repairing or cleaning any highways, streets, or other public
ways within the City made necessary by the special burden resulting from
transporting thereon by the applicant material to or from the site, the
amount of such cost to be determined by the Council; and conditioned
further to comply with all the requirements of this Ordinance and the
particular permit, and to save the City free and harmless from all suits or
claims for damages resulting from the negligent excavation, removal,

• storage, or filling of rock, sand, dirt, gravel, clay, or other like material
within the City.
15. No permits are required by Anoka County.
16. Permits from the Rice Creek Watershed District must be submitted to the
City prior to any activity. All activities on the site must comply with the
Rice Creek Watershed District requirements.
17. All excavation, erosion and sedimentation control, final site grading, and
restoration shall be completed by November 1, 2007.
18. Trucks will be limited to a maximum speed of 20 mph.

A. Comprehensive Plan Update
Mr. Smyser summarized that the Comprehensive Plan Advisory Panel met on April 18 to
review the draft goals and strategies. He said that the draft was reviewed by the
Environmental Board and the Park Board, and will go to EDAC at their Thursday
meeting. He said that comments will be brought to the next Advisory Panel Meeting on
May 16 and a draft will go to the first Council Work Session in June. He added that they
are running on the original schedule and asked for comments from the Board.
Mr. Laden said he thought the meeting on April 18 was particularly productive.

over the conservation easement.

Mr. Laden commented that it is exciting that this connection is being made and he
commended Mr. Black on his efforts.

Nickerson recommended approval of the plat stating that they would like to see the road
go through.

A. Summary of MEI Award
Mr. Smyser explained that the City of Lino Lakes received an award on May 17, 2007
from the Minnesota Environmental Initiative for the best environmental project in the
Green Building and Development category for the Lino Lakes I -35E AUAR.
Chair Tralle thanked City Staff for their work on the AUAR and said they should be
proud of it.
Mr. Root suggested the city enter next year for conservation development.
B. Update on Comprehensive Plan
Mr. Smyser explained that on May 16, the Advisory Panel further discussed the goals and
policies. On June 4, the City Council discussed the draft goals and policies at a Work
Session. Mr. Smyser stated that points raised by the City Council included the building
cap, conservation development, monitoring the Comp Plan's process over time, as well as
Council's involvement in the process.
Mr. Smyser noted the next meeting of the Advisory Panel will take place on June 20,
2007. In addition, on July 18, 2007 the city will host a roundtable discussion with
developers. Mr. Smyser summarized additional upcoming meetings.

Preliminary Plat
BACKGROUND
Royal Oaks Realty has requested approval of an 8 lot residential subdivision to be known as
Grandview. The subject site includes the outlot east of Gethsemane Church, and the parcel
occupied by the parsonage house. The parsonage house lot and the previously granted roadway
easement that would connect the Shores of Marshan Lake and Marshan Meadows subdivisions
via Stage Coach Trail will both be slightly altered to allow the development of 8 total lots while
still meeting all zoning ordinance requirements.
The project was brought before the Planning and Zoning Board at the June 13th meeting, with
some discussion and the public hearing opened and continued to the July 11th meeting. The only
modification or correction that needs to be made is the question about the option of placing
docks on Marshan Lake.

Lots: The lots will vary in depth from 135 feet to 260 feet (along the shoreline), and the widths
will range from 80 feet to 86 feet. The lots located along Marshan Lake exceed the shoreland
ordinance required 20,000 square feet of upland, and the western lots all exceed the 10,800
square foot R -1 requirement. The parsonage lot will be reduced in size to allow the other three
lots west of the proposed street to meet all subdivision standards.
Setbacks: The submitted plans depict all required setbacks, including the 150 foot setback from
the Ordinary High Water Line as required by the Shoreland Ordinance. This setback is measured
to any improvement attached to the single family dwelling, including decks and/or patios. This
means that the northeast lot (indicated as Lot 1, Block 2) will be very limited in that regard.
Impervious Surface Coverage: The lots will all be required to comply with the 30%
Impervious Surface Coverage requirement of the Shoreland Ordinance as they develop.
Streets: Stage Coach Trail will extend from the southern border to the northern border
connecting The Shores of Marshan Lake and Marshan Meadows. The alignment of the street is
proposed to vary slightly from the current easement granted by the church. This was
necessitated by the requirement to provide 20,000 square feet of upland for each lot along the
shoreline and will allow a seamless connection with the existing rights of way on either side of
the project. This proposal will require the approval of an easement vacation that will need to
accompany the final plat to the City Council.
•
Conservation Easement: A Conservation Easement was supplied by the developer for
Marshan Meadows and it is the city's intention to have this continued along the rest of Marshan
Lake with any new development. Several rare species may exist in the area: Forsters' tern, a
water nesting bird, and Blanding's turtle; which are on the threatened and endangered species
lists. The conservation easement coincides with the drainage and utility easements required by
the subdivision ordinance, both being 10 feet beyond the wetland edge. The conservation
easement will include additional restrictions such as no mowing or dumping of clippings. There
should also be a special packet of educational information supplied to homeowners and
monuments at the easement boundary of all lake lots.
At last months meeting it was stated by staff that the conservation easement would prohibit
docks on the lake, which was incorrect. The documents do not specifically prohibit docks, but
the likelihood of any docks being constructed is pretty minimal. This is a very shallow body of
water so the use of motorized boats is nearly impossible, and the distance that the docks would
have to extend would make them quite cost prohibitive. The changes in water levels would also
require the deck of the dock to be elevated to the extent that wildlife would be able to cross
under and possibly even use any docks as part of their habitat.
Park Dedication: The current subdivision ordinance includes park dedication in the amount
of $2075 per residential unit, less any land dedication. There is no land dedication needed, as
Marshan Park is nearby.
411 Utilities: Sanitary sewer and water are stubbed to the property line on both the north and
the south. The appropriate easements are platted for the connection of the church to the
services that will be constructed as part of this plat. These and other issues discussed in the City
Engineer review memo must be addressed to his satisfaction.
Grading: The grading plan has been reviewed by the City Engineer and his comments will
need to be addressed to his satisfaction prior to the site being developed.
Environmental Board
The Environmental Board reviewed the application on May 30th, there recommendations are
attached.

RECOMMENDATION
Staff is recommending approval of this request, subject to the following conditions:
1. All lots in the plat must agree to connect to City utilities. The City will not approve the final
plat without legally enforceable assurance that all properties will connect.
2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction.
3. A development agreement between the city and the developer must be executed prior to the
issuance of any building permits for the site.
4. Park dedication must be paid in accordance with the city's fee schedule.
5. A conservation easement shall be granted over the drainage and utility easement within the
lots fronting Marshan Lake. Easement restrictions shall be defined prior to city council
approval of the final plat.
6. The Rice Creek Watershed District must review the project prior to building permits being
issued by the city for any new construction.
7. A boulevard tree shall be provided for each lot frontage.
• 8. The existing roadway easement shall be vacated by the City Council prior to the approval of
the final plat.

17. To provide a well aerated, highly porous surface, it is recommended that the soils of the Infiltration
Basin floor be loosened to a depth of at least 12 inches prior to planting.
18. It is hi • hly recommended that plants be used over seed in the Infiltration Basin. Fluctuating water
levels following seeding can cause seed to float and be transported downstream of the Infiltration
Basin. In addition, it may take up to two growing seasons to establish the function and aesthetic value
of mature vegetation using seeds.

The following recommendations were made concerning Grandview.
1. Sizing must be verified for volume storage, runoff rate and infiltration requirements
on proposed infiltration and storage ponds.
2. All infiltration areas must be protected from construction as part of the Storm Water
Pollution Prevention Plan.
3. All infiltration, pond, and disturbed wetland areas must be planted with the City native
seed mix and managed by a company listed with the Minnesota DNR as recommended
for such work for a period of at least 3 years.
4. Plan should show access for pond and infiltration area maintenance.
5. Suggest that all houses direct runoff from impervious to pervious grass areas through
the use of downspouts.
6. A temporary sediment pond should be installed somewhere on the site that will accept
construction water from storm events.
7. Developer shall prepare brochure for new home owners. The brochure should discuss
the importance of water treatment and that some areas may be a bit wet after a storm.
Other information should include Shoreland Overlay district restrictions on vegetation
removal. City will review and approve document before being given to homeowner.
8. The developer has submitted a Storm Water Pollution Prevention Plan (SWPPP). The
SWPPP must be approved and implemented prior to the commencement of a grading
permit. A number of modifications to the SWPPP have been identified and will need to
be incorporated into the final plan as identified in the attached SWPPP memo.
9. Developer should check with the Minnesota DNR on how to develop with National
Heritage concerns in the area.

10. Because of the rare features concerns and the shoreland overlay district, a
conservation easement should be drafted that is contiguous with that of Marshan
Meadows. Literature shall be given to new residents notifying them of the easement and
the reasons for it. Literature will be reviewed and approved by the City. Conservation
easement signs should be placed along the easement line with at least one sign per
frontage of easement. The sign should state that "no cutting, planting, filling or
excavating should occur within the easement."
11. No soils should be imported or exported without city approval.
12. Verify delineation.

GENERAL EROSION AND SEDIMENT CONTROL
INSPECTIONS AND MAINTENANCE
1. The Permtttee(s) (either the owner or operator) must routinely inspect the
construction site once every seven (7) days during Dative construction and within

Mr. Brian Wessel has submitted a proposal for a rural development called Moon Marsh.
The proposal includes four residential lots on 25 acres of property. Mr. and Ms. Wessel
currently reside in the existing home on the site. The project would create three more
residential lots with a private loop road, a community sewage treatment system, and 12
acres of open space . Though the normal density in rural areas is one lot per ten acres,
the zoning ordinance allows for up to eight units on forty acres in a PUD with a common
septic system. (This translates to four units on the 25 -acre Wessel site.) This is allowed
only in areas outside the growth areas defined in the Comprehensive Plan. The purpose
is to provide for some development that preserves open space in areas that will not have
municipal utilities.
The zoning ordinance defines two types of PUD: rezoning and conditional use permit. A
rural residential PUD can be approved as a conditional use permit.
The site is within the area analyzed by the I -35E Alternative Urban Areawide Review
(AUAR). The AUAR's mitigation plan requires some information and review criteria
that are not normally applied to development projects elsewhere in the community.

Comprehensive Plan: The Comprehensive Plan guides the project site for Rural
land use. The site is outside of both Stage 1 (pre -2010) and Stage 2 (pre -2020) growth
areas and is well outside the Metropolitan Urban Service Area (MUSA). The
Comprehensive Plan includes a policy stating that "density incentives may be considered
in conjunction with a rural cluster subdivision that produces permanent open space."
Another policy is to "promote rural residential clustering as a means of preserving greater
amounts of open space or agricultural active lands." To implement these, the zoning
ordinance provides for a rural residential PUD with a common septic system. A rural
PUD must have at least 50% open space. The proposal includes 51% open space (Outlots
C, D, and E).
Rural residential PUDs are only allowed in areas such as this that are outside of planned
growth areas. This is because growth areas are planned for municipal utilities and should
be reserved for urban density growth. Rural lots of 10 acres are a way to hold areas for
more dense development when utilities are available. In an area where there will be no
utilities, even long term, there is no need to protect efficient service provision. The most
important issue is ensuring enough land for onsite septic systems. A common treatment
area ( drainfield) is an option that eliminates the need for primary and secondary
drainfield areas on each lot.
Growth Management: The Growth Management Policy (Ordinance No. 24 -04)
limits the number of dwelling units that can be approved for platting annually. There are
fewer than 80 units approved for 2007, leaving about 60+ for this year. The Moon Marsh
project would create three new lots. The project includes several nature- friendly design
elements, but this is not a "conservation development" as we typically use the term. It
does not have a formally adopted stewardship (management) plan. Because we have
ample units remaining for 2007 and this project creates only three new lots, there is no
need to exempt the project from the annual limit.
Zoning: The site is zoned Rural. The normal lot size requirement is 10 acres, and
there are shoreland requirements to consider. However, a rural residential PUD with a
common septic system can have up to eight units per 40 acres, or four per 20 acres.
There is a minimum lot size of 25,000 sf for such a project.

Shoreland: Shoreland overlay zoning covers land within 1000 feet of the Ordinary
High Water Level (OHWL) of Rondeau Lake, classified as a "natural environment lake ".
A shoreland overlay also applies within 300 feet of Rice Creek, but the creek is about 500
feet to the east. The OHWL for Rondeau Lake has not been determined. Lacking a
specific determination, examination of the treeline often is used as the alternative method.
The treeline is 100 -150 feet west of the road. By this reckoning, the Wessel property is
within the shoreland overlay.
However, shoreland requirements will have little effect on the site. Since all the
proposed home sites are on the eastern part of the property, shoreland setbacks from the
OHWL will not affect the proposal. The nearest building site will be more than 400'
from the public roadway, well beyond the required 150' setback from the OHWL. There
are no lakeshore lots, so visibility from the lake is not an issue. The shoreland ordinance
was written well before current community septic systems technology, so lot sizes
addressed only individual septic systems and municipal utilities. The current technology
treats wastewater better than the typical public treatment plant. We are considering the
"sewered" lot size in the shoreland ordinance as the appropriate one.
There are no steep slopes on the property, so erosion down a bank into the lake or
anywhere else is not a significant issue. In fact, very little site disturbance is proposed on
the western part of the site. The ends of the private loop road and some culvert work are
the only excavation activities near East Rondeau Lake Road.
The site drains into Rice Creek and then to Peltier Lake and the chain of lakes, so water
quality issues are pertinent. There are rain gardens designed into the project. The City
has requirements for minimizing erosion that apply to all construction projects. In
addition, the Rice Creek Watershed District examines and regulates impacts on wetlands
and water quality.
We forwarded the initial submittal to the MnDNR in January. An e -mail from MnDNR
states they have no concerns and have the following comments:

in shoreland areas. This entire parcel is within the shoreland district of Rondeau
Lake.
2. The preservation of the open space, the filtration basins, and the curbless road
section help lower this project's impact on the landscape.
3. The community septic system is not a concern if it will be monitored and
maintained on a regular basis by a responsible party that has experience in the
upkeep of similar utilities.
Alternative Urban Areawide Review (AUAR): This site is within the area analyzed
by the I -35E Corridor AUAR. Development within the area is subject to the mitigation
plan adopted with the AUAR. The mitigation includes some specific, quantified
requirements, but many of the requirements are means of achieving the best results
possible, depending on the site.
Conservation Development Framework: The Conservation Development Framework
provides the foundation for most of the conservation objectives within the AUAR area.
Implementation of the Framework will: conserve the most ecologically significant
natural resources within the AUAR area (in particular, the "core" and "outlier" habitats);
protect ecologically significant natural resources from adjacent land uses by
implementing buffering; and connect ecologically significant natural resources via multi-
functional greenway corridors. The goals of the Conservation Development Framework
will be pursued through a variety of methods.
The maps in the AUAR provide summary information and guidance. For example, the
Minnesota Land Cover Classification System map (AUAR Fig. 10 -1) shows several
cover types. The upland area where the new lots would be are classified as planted or
cultivated vegetation, relating to the agriculture that has occurred. The existing driveway
and house site show as artificial surfaces and associated areas. The western part, which
corresponds to the large Outlot D wetland, is herbaceous and there are small forest areas
where the wetlands are in the proposed Outlots E and C. These latter areas hold promise
for preservation and merit special attention.
The Wetland/Aquatic and Upland Habitats map (AUAR Fig. 10 -2) show the west
wetland area as core wetland 7 aquatic habitat. It is these core areas that we want to
preserve. Large core habitat areas can provide habitat for a wide range of wetland -
dependent and aquatic species as well as rare natural features. Therefore, the larger
wetland area as well as the other outlots will be protected with a conservation easement.
This will preserve land adjacent to larger, off -site greenway areas to the east and south,
which are part of the regional park. The conservation easement should provide for the
possibility of future restoration work.
Water quality, stormwater management, erosion and sedimentation: The AUAR
includes analyses of surface water runoff issues which lead to requirements for including

infiltration elements and other techniques. It also includes estimated stormwater
management recommendations for specific development areas. These estimates in the
AUAR cannot be considered strict requirements because they were broad and based on
general soil types and assumptions about impervious areas related to development.
However, they do provide some guidance . The most general estimate is that 0 % -5% of
the developable area would be needed for stormwater management (AUAR Fig. 17 -3).
On a little less general estimate, the Moon Marsh site is labeled development area A -FR,
with an estimated need of 0.13 acre (5660 sf) for stormwater management (AUAR Table
17 -5). The specific analysis and design for the project includes 4200 sf as infiltration
basins. This falls within the broad estimate range and considering the scale of the site, is
comparable to the less broad estimate.
The AUAR requires that runoff rates will be at or below pre - development conditions.
This is a standard requirement everywhere in the city, enforced on all projects. The
AUAR also requires that runoff volume be no more that 150% of pre - development runoff.
This is being reviewed. The groundwater elevation will determine how the proposed
infiltration basins will function, which may affect the runoff volume. This will be
analyzed as the project is reviewed further.
Archaeological Survey: A Phase 1 archaeological survey was completed for
the site and submitted with the project, as required by the AUAR. Records include an
identified site to the east, but only low density artifact scatter was found on the Wessel
site. The survey investigator does not recommend further evaluation.
Rare Plant Survey: The AUAR mitigation plan states that due to the incidence of rare
plant species in nearby wetland habitats, the City will require rare plant surveys and the
mapping of rare plant locations prior to disturbance of areas of certain soil characteristics.
The project site includes these soils. A rare plant survey is required and was performed
on June 26. Several of the higher quality wetland habitats within the site contain suitable
habitats for select rare plant species. However, no state- listed or otherwise rare plant
species were detected.
Planned Unit Development
Section 2, Subd. 10. of the zoning ordinance includes the PUD standards. The zoning
ordinance provides for two types of PUD. We have used a rezoning PUD on mixed use
projects and others with exceptional design issues such as conservation developments in
urbanized areas (with city utilities). We also have a provision for a conditional use
permit for a PUD. A rural residential PUD is specifically designated for the conditional
use permit PUD option.
It is important to review the purpose and intent of a PUD.
Subd. 10. PUD, Planned Unit Development.
A. Purpose and intent. The purpose of this section of the Zoning Ordinance is to provide for
the grouping of lots or buildings for development as an integrated, coordinated unit as
opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development.

This section is intended to introduce flexibility of site design and architecture for the
conservation of land and open space through clustering of Tots, buildings and activities, which
promote the goals outlined in the Comprehensive Plan or serve another public purpose. It is
further intended that planned unit developments are to be characterized by central
management, integrated planning and architecture, joint and common use and maintenance
of parking, open space and other similar facilities, and harmonious selection and efficient
distribution of uses. ...
The PUD, by allowing deviation from the strict provisions of this Ordinance related to
setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a
mixture of uses by rezoning to a PUD District, is intended to encourage:
1. A development pattern in harmony with the objectives of the Comprehensive Plan.
2. Innovations in development that address growing demands for all styles of economic
expansion, greater variety in type, design, architectural standards, and siting of structures
through the conservation and more efficient use of land in such developments.
3. The preservation and enhancement of desirable site characteristics such as existing
vegetation, natural topography and geologic features and the prevention of soil erosion.
4. A creative use of land and related physical development which allows a phased and
orderly transition of varying land uses in close proximity to each other.
5. An efficient use of land resulting in smaller networks of utilities and streets thereby
lowering development costs and public investments.
6. Promotion of a desirable and creative environment that might be prevented through the
strict application of City zoning and subdivision regulations.
C. Rural Residential Planned Unit Development Requirements.
1. Purpose. It is the intent of this section to establish special requirements for the granting
of a conditional use permit for rural (without City water or sanitary sewer) residential
conservation subdivision PUD project in order to promote:
a. Preservation of productive land for agricultural use.
b. Preservation of wildlife habitat and unique natural resources.
c. Reduction of negative impacts on the environment
d. Creation of common open space that provides a unified landscape for the use and
enjoyment of the neighborhood community and/or the general public.
e. A variety of rural residential lot sizes, configurations, and neighborhoods.
Density: Normal density in the Rural land use category is one unit per ten acres.
However, the PUD standards allow eight units per forty acres in a subdivision that is
served by a community sewer system that is approved by the Minnesota Pollution
Control Agency (MPCA).

Lots: The lots are clustered to avoid wetland impacts and provide efficient access to the
community septic absorption field. The effect is a small neighborhood that is so isolated
from the public road it will not even be visible.
With the 10' easement around the wetlands, the house pads on a couple lots are within
about 11' of the easement. It likely is possible to move the pad on L B3 to the
northwest to provide more use of the yard around the house without encroaching on the
easement.
Similarly, the pad on L2 B2 could move slightly to the south. While retaining the
windrow of trees is desirable, many of the trees will be lost anyway when the septic tanks
are installed on the south side of the lot. The pad locations should be re- examined and, if
possible, moved to allow more distance from the easements. The new pad locations must
be shown on plans prior to construction.
One outstanding issue is the groundwater elevation. Submitted data is somewhat
inconsistent. Low floor elevations and stormwater facilities are compared to groundwater
level. Floor pads must be four feet above groundwater, and the bottom of ponds and
infiltration basins must be above groundwater enough to function properly. While we
can agree on a `worst case scenario' elevation to determine house pad elevations, this
level needs to be compared to the submitted grading plan and analyzed for stormwater
management purposes (see below).
Water: Each home will have individual wells for water. The wells must meet
minimum separations from septic system facilities. This will be addressed with well
permits from the MN Dept. of Health.
Sewage Treatment: The development uses a sophisticated sewage treatment system
that includes both individual treatment and a community mound. Most treatment will
occur within the multiple tank- and - treatment facilities on each lot. This allows for
monitoring and maintenance of individual lots without interfering with the elements of
the system used by all lots. It also minimizes the treatment that is needed in the common
mound absorption field.

There is a minimum amount of flow that must occur for the overall system to operate
properly. We will need to require pumping of individual tanks if only one home is built
at first. The details will need to be determined.
Wetlands and Stormwater Management: The Rice Creek Watershed District
(RCWD) has approved the delineation of the wetlands on the site and the mitigation plan.
The wetland complex to the east of the site, which corresponds with Rick Creek, is DNR
protected wetland 740W. Wetland #4 in the southeast corner of the Moon Marsh site is
part of this complex.
The proposal would fill 4200 sf of wetland along the roads and mitigate this with 4200 sf
of new wetland and 4200 sf of public value credits in the form of infiltration basins. The
design and implementation must comply with RCWD requirements.
Two infiltration basins are proposed, one on the north side of the site along the road, one
on the south side. These are being reviewed to determine if the soils and basin designs
will function properly. The groundwater depth is relevant to this analysis.
Drainage and utility easements will be established that cover and extend 10' beyond the
wetlands, in accordance with City requirements. Conservation easement locations will
correspond to these drainage and utility easements.
F000dplain: The FEMA floodplain map shows much of the site within the 100 -year
floodplain. The RCWD has determined the 100 -year elevation to be 887.5. Lowest floor
elevations are at least two feet above this in accordance with City policy. There will be
minor floodplain fill which will be addressed by excavating an area of equal volume to
compensate (compensatory storage).
Roads, Access, Traffic: The proposal extends the existing driveway on the south
part of the site to become a private loop road with another access onto East Rondeau
Lake Road. This private road serves all four lots. Because heavy vegetation can block
sightlines, a certain area should be cleared where the loop accesses East Rondeau Lake
Road.
The right of way for the east 33 feet of East Rondeau Lake Road will be dedicated with
the plat. The road is an easement now. This will be clarified with the title search that
will be necessary for a final plat.
The creation of three new residential lots will not create a traffic generation problem.
Park Plan and Dedication: The parks plan shows Natural Resource Protection Areas
corresponding to the locations of wetlands as revealed by the wetland delineation.. These
are wetland areas that will be protected by existing wetland law or may be important
plant communities. They will be covered by a conservation easement as well as a
drainage and utility easement.

The Natural Resource Conservation Areas are uplands with features that have high
ecological value. These areas should be examined for the potential for protection. The
rare plant survey found no rare species in the uplands on the site, and most of these areas
have been disturbed by past use.
Park dedication will be cash in the amount of $2075 for each of the three new lots, for a
total of $6225.
ENVIRONMENTAL BOARD ACTION
The Environmental Board reviewed the project on June 27th. Their comments are
attached. Overall, the Environmental Board was positive about the project.
OPTIONS
1. Open public hearing, take comment, continue public hearing to August 8th.
2. Recommend approval of application.
3. Recommend denial of application.
RECOMMENDATION
Option 1: continue public hearing to allow for submittal of additional information.
Outstanding issues include:
• Function of infiltration basins relative to groundwater elevation.
• Runoff rates and volume based on function of infiltration basins.
• Low floor elevations relative to ground water elevation, and grading plan revisions.
• Minimum flow for community sewage absorption system.
• Location of house pads relative to easements and other features.
• Other issues raised by engineering review.
The following conditions of approval should apply when the project is approved:
1. The onsite sewage treatment system shall comply with all requirements of MN Rules
7080 and all other applicable laws.
2. A monitoring and maintenance plan for the community sewage treatment system
must be prepared and submitted to the City before site work commences or prior to

final plat approval, whichever comes first. In addition, there must be an arrangement
for pumping the tank until the required minimal flow for the overall system is
achieved.
3. The right of way for the east 33 feet of East Rondeau Lake Road shall be dedicated
with the plat.
4. Park dedication shall be paid in accordance with City policy in effect at the time of
preliminary plat approval by the City Council.
5. A permit shall be obtained from the Rice Creek Watershed District prior to site work
and the project must comply with all permit conditions.
6. A conservation easement covering Outlots C, D, and E shall be dedicated to the City.
The conservation easement shall provide for the possibility of future ecological
restoration work, to be determined by future agreement between property owners and
the City. Specifics conditions of the easement shall be listed in an easement document
and reviewed prior to approval of the final plat.
7. Homeowners' association documents shall be submitted for City review prior to final
plat approval. The declaration of covenants, restrictions, easements, or other
documents must provide for the common ownership, protection, and maintenance of
the outlots, private road, community septic system, and other elements necessary to
the health, safety, and welfare of the general public and the residents of the project.
Homeowners' association documents must include recognition of the conservation
easement.

The following are significant issues that must be addressed prior to preliminary plat approval:
1. Submit a geotechnical report summarizing the seasonal high water mark which is identified as the
mottled soils or highest anticipated waxer table. The lowest floor elevation is required to be 4 feet
above the seasonal high waxer mark. It appears from the percolation report that mottled soils have
been encountered in the test area between 12" to 20" below the ground surface.
06/19/07 The Geotechnical Report indicates that groundwater was found in the vicinity of 886± to
888.5 ±. The report goes on to state that `it is unlikely that this investigation has found
groundwater at its highest leveL Most likely, maximum groundwater on the site is equivalent
to the ordinary high water level (not short term flood level) of the vicinity wetland'. A
seasonal high water mark has not been identified in the report and will need to be submitted.
Based on the groundwater levels determined in the Geotechnical Report, Lots 1 and 2, Block
1, does not meet the City's minimum low floor requirement as stated in comment 1 above.
2. The filtration areas may not be feasible due to the presence of mottled soils near the surface which
indicates high ground water levels. Groundwater could affect the efficiency of these systems.
3. Submit existing and proposed watershed maps and label each subwatershed so that the map
corresponds with the HydroCAD model.

4. Identify the location and elevation of the outlet and emergency overflow for all wetlands. Low
openings are required to be a minimum of 1 foot above the emergency overflow elevation.
06/19/07 It appears that the emergency overflow for wetland No. 1, at the north end of the site, is
located at the low point of the proposed road at station 19+00. The new overflow created by
the construction of the road appears to be at a higher elevation than the overflow elevation

Label the emergency overflow elevation for wetland No. 3 and wetland No. 4 on the Grading
Plan.
5. Supply design computations for the proposed culverts connecting the wetlands at the north and
south end of the site. Show that the proposed high water levels of the existing wetlands are equal to
existing high water levels.

6. The sum of the total wetland area defined in ponds 1013 and 12P of the model should equal the
wetland area of the existing wetland defined in pond 11P. For example, the area of the

sum of the area at elevation 888 under proposed conditions for ponds 10P and 11P is 17 acres.
7. The filtration basin 2P and 4P outlet device routing is not consistent with the outlet structure
detail on Sheet 7. The 12 inch horizontal orifice/grate should be routed through a 12 inch
diameter outlet, not the 4 inch diameter pipe as currently modeled. In addition, the 4 inch
outlet should be a 6 inch outlet at a 0.0% slope, with the length as labeled on the Grading
Plan and outlet structure detail. Update for consistency. Runoff rates will be checked when
the revised model is submitted for review.
8. Identify the HWL and location and elevation of the emergency overflow for all culverts on
the Plan. Low floors are required to be 2 feet above the 100 -year elevation of all culverts.
The following are minor plan, calculations, and drafting corrections that must be addressed prior to
final approval:
1. The low opening of Lot 1, Block 3 is required to be 1 foot above the emergency overflow of filtration
basin 2.

The Environmental Board made the following recommendations conceming the
Moon Marsh application at the June 27, 2007 Environmental Board Meeting:
1. This development , although not called a "conservation development', should employ the
guidelines of the AUAR.
2. A conservation easement containing no-mow , dumping, cutting, building in, or filling in ,
and naming the City as the easement holder with the right to perform restoration work in
the easement. This easement should be written from the wetland edge and cover as much
as possible of the area shown in Attachment 10. Signs should be posted on the easement
line , describing the easement , every 50 feet
3. SMA's within the AUAR and therefore in Moon Marsh must have:
• No more than 20% of their surface as permanent open water, the remaining surface
area of each SMA shall contain mesic prairie or wet prairie communities to maximize the
infiltration and water quality treatment capacities of the system
• Design high water levels (100 -year) less than or equal to 2.5 feet above the normal
water level or lowest outlet invert
• Side slopes that are less than or equal to 6:1. horizontal to vertical and 10:1 safety
bench at the normal water level per RCWD requirements.
• Post development runoff release volumes should be no less than 80% and no greater
than 150% of existing conditions runoff volumes. These standards must be verified by
our City Engineer
4. RCWD CAPROC Items are addressed including and particularity: Geotechnical soil
borings at proposed BMP location in order to determine depth to the water table. This is
important in that the designer is calling these infiltration ponds. Infiltration ponds designed
into the groundwater are not infiltrating anything other than possible contaminants to the
ground water. Adequate separation (3 ") must be shown between the pond bottom and the
ordinary high ground water.

5. there is enough indication that there could be rare plants on part of the property, and the
property should be surveyed to verify the presence or absence of rare plants. The area on
the Wessel property that would be of concern is indicated on Attachment 10.
6. Suggest placing the buffer of the westem most wetland in Conservation easement since
this forms part of the City Greenway system (Attachment 11). New wetlands constructed
on the site as well as buffer areas should be planted with the City native seed mix.
7. Rain gardens proposed on the site should be designed with a low maintenance (unless
there is agreement with new homeowners to manage something different) Maplewood -
type of design. Design of these gardens should be submitted to the city as well as a
perpetual maintenance plan. All designed ponds and infiltration features must have at
least 3 -feet of sand separation between the ordinary high ground water level and the
bottom of the structures.
8. Community drainfield should be approved by Anoka County Environmental
9. It is recommended that a temporary sediment pond be constructed to capture surface
water runoff during construction. All proposed infiltration, wetland and rain- garden soils
must be protected during construction. Suggest construction of new surface water
features after major construction is complete. Features should be constructed with low
impact/compaction, track -types of equipment and fenced off prior to construction. All soils
determined to be more compact after construction than prior to construction in drainage/
surface water infiltration or management area will be loosed to pre - construction conditions.
It is also recommended that all new yard soils have top -soil incorporated into the subsoil
and tilled as deeply as possible. No soil may be imported or exported with out City
approval.
10. . Recommended changes to the SWPPP are submitted to the City Engineer to make
changes to the documents submitted. Changes should include City native seed mix in all
final grade stabilization, and installed by a DNR listed contractor.
