City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4- minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice - Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. CONTINUED PUBLIC HEARING for a Preliminary Plat for an eight lot residential subdivision to be called Grandview, 7330 Lake Drive, Royal Oaks Realty Mr. Bengtson presented the staff report. Staff recommended approval of the Preliminary Plat subject to eight conditions as listed in the staff report. Mr. Larry Leibel Sr., 1281 Birch Street, stated that he has been a resident of Lino Lakes for 56 years and a member of the church since he was born. Mr. Leibel stated that the church would like to sell the property in order to pay down their loan, possibly acquire city utilities, offer additional services to the community, encourage new church membership and allow for future success of the church. Mr. Mike Black, Royal Oaks Realty, Applicant, stated that he understands and accepts the conditions of approval. Mr. Hyden made a MOTION to close the Public Hearing at 6:44 p.m. Motion was supported by Mr. Pogalz. Motion carried 4 -0. Mr. Pogalz made a MOTION to recommend approval of the Preliminary Plat for Grandview, 7330 Lake Drive, subject to the following conditions: 1. All lots in the plat must agree to connect to City utilities. The City will not approve the final plat without legally enforceable assurance that all properties will connect. 2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 3. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the site. 4. Park dedication must be paid in accordance with the city's fee schedule. 5. A conservation easement shall be granted over the drainage and utility easement within the lots fronting Marshan Lake. Easement restrictions shall be defined prior to city council approval of the final plat. 6. The Rice Creek Watershed District must review the project prior to building permits being issued by the city for any new construction. 7. A boulevard tree shall be provided for each lot frontage. 8. The existing roadway easement shall be vacated by the City Council prior to the approval of the final plat. Motion was supported by Mr. Root. Motion carried 4 - 0. PUBLIC HEARING for a Conditional Use Permit for a Rural Residential Planned Unit Development to be called Moon Marsh, 8300 East Rondeau Lake Road, Brian Wessel Mr. Smyser presented the staff report. Staff recommended that the board continue the Public Hearing to next month's meeting in order to address a few outstanding issues. Mr. Smyser addressed board questions. He stated that the plan includes an area for a replacement mound in case of failure. He noted that staff will confirm that there is a homeowner's association agreement and a maintenance contract in place. He explained that this was the first shared septic system in the city, but they are becoming more popular in rural areas and the city has expected these systems to occur. Mr. Smyser specified that the 51% open space consists of Outlots C, D and E, but none of the private lots were included in the open space number. He explained the reason for asking the applicant to move the lot line would be to increase protection of the wetland area. He added that the homeowner's association in common will own all outlots, but the city will have a conservation easement over them. Mr. Tralled opened the Public Hearing at 7:13 p.m. Mr. Brian Wessel, 8300 East Rondeau Lake Rd, Applicant, explained that this project has been a culmination of about two years of work with city staff and consultants. He noted it is an important project for the Wessel family, as he and his wife have lived there for 16 years and the land is incredibly beautiful and precious. He said he is aware of the fragility of the environment and that their intent is to conserve and enhance as much natural area as possible. Mr. Wessel noted that his two sons would like to build houses on two of the lots. He stated that they are going to attempt to keep it in the family and want to make sure it is done well. He recognizes it is the first cluster development in the city and that it is in the AUAR area. He added that he is an architect and affordable housing developer and he develops green housing throughout the country, so he is familiar with how to do this well. He explained that for personal and professional reasons this needs to be done as well as he can possibly do it. He is looking to work through every possible scenario so that it is a project he can be proud of. Mr. Wessel stated that his engineers are working with staff to work on water management. He stated that the homes will be no larger than 2500 square feet and will be centered within the pad location. He noted that his son is an award - winning modern residential architect. He added that this is an exciting project and is really pleased that it is moving along. He looks forward to living there next year if all goes well. Mr. Wessel noted that he appreciates staff working with him and hopes this will set a positive trend in quality. Update on Comp Plan Process Mr. Smyser noted that staff would be offering a city tour to the Advisory Panel members instead of the development forum that was previously proposed. Mr. Smyser explained that board members will have an opportunity to get a first hand look at potential development areas along with some of the conflict areas within the city. Several important design elements needed to be fully addressed. Mr. Brian Wessel has submitted a proposal for a rural development called Moon Marsh. The proposal includes four residential lots on 25 acres of property. Mr. and Ms. Wessel currently reside in the existing home on the site. The project would create three more residential lots with a private loop road, a community sewage treatment system, and 12 acres of open space . Though the normal density in rural areas is one lot per ten acres, the zoning ordinance allows for up to eight units on forty acres in a PUD with a common septic system. (This translates to four units on the 25 -acre Wessel site.) This is allowed only in areas outside the growth areas defined in the Comprehensive Plan. The purpose is to provide for some development that preserves open space in areas that will not have municipal utilities. The zoning ordinance defines two types of PUD: rezoning and conditional use permit. A rural residential PUD can be approved as a conditional use permit. The site is within the area analyzed by the I -35E Alternative Urban Areawide Review (AUAR). The AUAR's mitigation plan requires some information and review criteria that are not normally applied to development projects elsewhere in the community. City of Columbus: Rural Residential South regional park reserve Rural Rural East regional park reserve Rural Rural West rural Rural Rural Comprehensive Plan: The Comprehensive Plan guides the project site for Rural land use. The site is outside of both Stage 1 (pre -2010) and Stage 2 (pre -2020) growth areas and is well outside the Metropolitan Urban Service Area (MUSA). The Comprehensive Plan includes a policy stating that "density incentives may be considered in conjunction with a rural cluster subdivision that produces permanent open space." Another policy is to "promote rural residential clustering as a means of preserving greater amounts of open space or agricultural active lands." To implement these, the zoning ordinance provides for a rural residential PUD with a common septic system. A rural PUD must have at least 50% open space. The proposal includes 51% open space (Outlots C, D, and E). Rural residential PUDs are only allowed in areas such as this that are outside of planned growth areas. This is because growth areas are planned for municipal utilities and should be reserved for urban density growth. Our standard requirement that rural lots must be 10 acres is a way to hold areas for more dense development when utilities are available. In an area where there will be no utilities, even long term, there is no need to protect efficient service provision. The most important issue is ensuring enough land for onsite septic systems. A common treatment area (drainfield) is an option that eliminates the need for primary and secondary drainfield areas on each lot. Growth Management: The Growth Management Policy (Ordinance No. 24 -04) limits the number of dwelling units that can be approved for platting annually. There are fewer than 80 units approved for 2007, leaving about 60+ for this year. The Moon Marsh project would create three new lots. The project includes several nature - friendly design elements, but this is not a "conservation development" as we typically use the term. It does not have a formally adopted stewardship (management) plan. Because we have ample units remaining for 2007 and this project creates only three new lots, there is no need to exempt the project from the annual limit. Zoning: The site is zoned Rural. The normal lot size requirement is 10 acres, and there are shoreland requirements to consider. However, a rural residential PUD with a common septic system can have up to eight units per 40 acres, or four per 20 acres. There is a minimum lot size of 25,000 sf for such a project. • • Moon Marsh page 3 Shoreland: Shoreland overlay zoning covers land within 1000 feet of the Ordinary High Water Level (OHWL) of Rondeau Lake, classified as a "natural environment lake ". A shoreland overlay also applies within 300 feet of Rice Creek, but the creek is about 500 feet to the east. The OHWL for Rondeau Lake has not been determined. Lacking a specific detellnination, examination of the treeline often is used as the alternative method. The treeline is 100 -150 feet west of the road. By this reckoning, the Wessel property is within the shoreland overlay. However, shoreland requirements will have little effect on the site. Since all the proposed home sites are on the eastern part of the property, shoreland setbacks from the OHWL will not affect the proposal. The nearest building site will be more than 400' from the public roadway, well beyond the required 150' setback from the OHWL. There are no lakeshore lots, so visibility from the lake is not an issue. The shoreland ordinance was written well before current community septic systems technology, so lot sizes addressed only individual septic systems and municipal utilities. The current technology treats wastewater better than the typical public treatment plant. We are considering the " sewered" lot size in the shoreland ordinance as the appropriate one. There are no steep slopes on the property, so erosion down a bank into the lake or anywhere else is not a significant issue. In fact, very little site disturbance is proposed on the western part of the site. The ends of the private loop road and some culvert work are the only excavation activities near East Rondeau Lake Road. The site drains into Rice Creek and then to Peltier Lake and the chain of lakes, so water quality issues are pertinent. There are rain gardens designed into the project. The City has requirements for minimizing erosion that apply to all construction projects. In addition, the Rice Creek Watershed District examines and regulates impacts on wetlands and water quality. We forwarded the initial submittal to the MnDNR in January. The proposed density falls easily within the statewide guidelines for development in shoreland areas. This entire parcel is within the shoreland district of Rondeau Lake. 2. The preservation of the open space, the filtration basins, and the curbless road section help lower this project's impact on the landscape. 3. The community septic system is not a concern if it will be monitored and maintained on a regular basis by a responsible party that has experience in the upkeep of similar utilities. Alternative Urban Areawide Review (AUAR): This site is within the area analyzed by the I -35E Corridor AUAR. Development within the area is subject to the mitigation plan adopted with the AUAR. The mitigation plan includes some specific, quantified requirements, but many of the requirements are means of achieving the best results possible, depending on the site. Conservation Development Framework: The Conservation Development Framework provides the foundation for most of the conservation objectives within the AUAR area. Implementation of the Framework will: conserve the most ecologically significant natural resources within the AUAR area (in particular, the "core" and "outlier" habitats); protect ecologically significant natural resources from adjacent land uses by implementing buffering; and connect ecologically significant natural resources via multi- functional greenway corridors. The goals of the Conservation Development Framework will be pursued through a variety of methods. The maps in the AUAR provide summary information and guidance. For example, the Minnesota Land Cover Classification System map (AUAR Fig. 10 -1) shows several cover types. The upland area where the new lots would be are classified as planted or cultivated vegetation, relating to the agriculture that has occurred. The existing driveway and house site show as artificial surfaces and associated areas. The western part, which corresponds to the large Outlot D wetland, is herbaceous and there are small forest areas where the wetlands are in the proposed Outlots E and C. These latter areas hold promise for preservation and merit special attention. The Wetland /Aquatic and Upland Habitats map (AUAR Fig. 10 -2) show the west wetland area as core wetland & aquatic habitat. It is these core areas that we want to preserve. Large core habitat areas can provide habitat for a wide range of wetland - dependent and aquatic species as well as rare natural features. Therefore, the larger wetland area as well as the other outlots will be protected with a conservation easement. This will preserve land adjacent to larger, off -site greenway areas to the east and south, which are part of the regional park. The conservation easement should provide for the possibility of future restoration work. Water quality, stormwater management, erosion and sedimentation: The AUAR includes analyses of surface water runoff issues which lead to requirements for including • Moon Marsh page 5 infiltration elements and other techniques. It also includes estimated stormwater management recommendations for specific development areas. These estimates in the AUAR cannot be considered strict requirements because they were broad and based on general soil types and assumptions about impervious areas related to development. However, they do provide some guidance . The most general estimate is that 0 % -5% of the developable area would be needed for stormwater management (AUAR Fig. 17 -3). On a little less general estimate, the Moon Marsh site is labeled development area A -FR, with an estimated need of 0.13 acre (5660 sf) for stormwater management (AUAR Table 17 -5). The specific analysis and design for the project includes 4200 sf as infiltration basins. This falls within the broad estimate range and, considering the scale of the site, is comparable to the less broad estimate. The AUAR requires that runoff rates will be at or below pre - development conditions. This is a standard requirement everywhere in the city, enforced on all projects. The AUAR also requires that runoff volume be no more that 150% of pre - development runoff. Archaeological Survey: A Phase 1 archaeological survey was completed for the site and submitted with the project, as required by the AUAR. Records include an identified site to the east, but only low density artifact scatter was found on the Wessel site. The survey investigator does not recommend further evaluation. Rare Plant Survey: The AUAR mitigation plan states that due to the incidence of rare plant species in nearby wetland habitats, the City will require rare plant surveys and the mapping of rare plant locations prior to disturbance of areas of certain soil characteristics. The project site includes these soils. A rare plant survey is required and was performed on June 26. Several of the higher quality wetland habitats within the site contain suitable habitats for select rare plant species. However, no state - listed or otherwise rare plant species were detected. Planned Unit Development Section 2, Subd. 10. of the zoning ordinance includes the PUD standards. The zoning ordinance provides for two types of PUD. We have used a rezoning PUD on mixed use projects and others with exceptional design issues such as conservation developments in urbanized areas (with city utilities). We also have a provision for a conditional use permit for a PUD. A rural residential PUD is specifically designated for the conditional use permit PUD option. It is important to review the purpose and intent of a PUD. The following passages are taken from the zoning ordinance. Subd. 10. PUD, Planned Unit Development. A. Purpose and Intent. The purpose of this section of the Zoning Ordinance is to provide for the grouping of Tots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. This section is intended to introduce flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. It is • • • Moon Marsh page 6 further intended that planned unit developments are to be characterized by central management, integrated planning and architecture, joint and common use and maintenance of parking, open space and other similar facilities, and harmonious selection and efficient distribution of uses. ... The PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to encourage: 1. A development pattern in harmony with the objectives of the Comprehensive Plan. 2. Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. 3. The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. 4. A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. 5. An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. 6. Promotion of a desirable and creative environment that might be prevented through the strict application of City zoning and subdivision regulations. C. Rural Residential Planned Unit Development Requirements. 1. Purpose. It is the intent of this section to establish special requirements for the granting of a conditional use permit for rural (without City water or sanitary sewer) residential conservation subdivision PUD project in order to promote: a. Preservation of productive land for agricultural use. b. Preservation of wildlife habitat and unique natural resources. c. Reduction of negative impacts on the environment. d. Creation of common open space that provides a unified landscape for the use and enjoyment of the neighborhood community and /or the general public. e. A variety of rural residential lot sizes, configurations, and neighborhoods. Density: Normal density in the Rural land use category is one unit per ten acres. However, the PUD standards allow eight units per forty acres in a subdivision that is served by a community sewer system that is approved by the Minnesota Pollution Control Agency (MPCA). Lots: The lots are clustered to avoid wetland impacts and provide efficient access to the community septic absorption field. The effect is a small neighborhood that is so isolated from the public road it will not even be visible. • • Moon Marsh page 7 There will be easements that extend 10' around the wetlands. The house pads on two lots were revised to provide more use of the yard around the house without encroaching on the easements (L2 B2 and L1 B3). In addition, the western border of Lots 1 & 2, Block 2, were moved eastward to increase the area within the outlot versus land within the lots. Removing this area from individual lot ownership is one way to help protect the wetland. One outstanding issue is the groundwater elevation. Submitted data is somewhat inconsistent. Low floor elevations and stormwater facilities are compared to groundwater level. Floor pads must be four feet above groundwater, and the bottom of ponds and infiltration basins must be above groundwater enough to function properly. Water: Each home will have individual wells for water. The wells must meet minimum separations from septic system facilities. This will be addressed with well permits from the MN Dept. of Health. Sewage Treatment: The development uses a sophisticated sewage treatment system that includes both individual treatment and a community mound. Most treatment will occur within the multiple tank- and - treatment facilities on each lot. This allows for monitoring and maintenance of individual lots without interfering with the elements of the system used by all lots. It also minimizes the treatment that is needed in the common mound absorption field. There is a minimum amount of flow that must occur for the overall system to operate properly. The system designer has proposed dividing the mound system into several zones with valves. In effect, this allows increasing the area of the mound being used as needed. The specific details will need to be determined as part of the final design, which will be required before any site work begins or the final plat is approved. Wetlands and Stormwater Management: The Rice Creek Watershed District (RCWD) has approved the delineation of the wetlands on the site and the mitigation plan. The house pads on two lots were revised to provide more use of the yard around the house without encroaching on the easements (L2 B2 and L1 B3). In addition, the western border of Lots 1 & 2, Block 2, were moved eastward to increase the area within the outlot versus land within the lots. Removing this area from individual lot ownership is one way to help protect the wetland. One outstanding issue is the groundwater elevation. Submitted data is somewhat inconsistent. Low floor elevations and stormwater facilities are compared to groundwater level. Floor pads must be four feet above groundwater, and the bottom of ponds and infiltration basins must be above groundwater enough to function properly. Water: Each home will have individual wells for water. The wells must meet minimum separations from septic system facilities. This will be addressed with well permits from the MN Dept. of Health. Sewage Treatment: The development uses a sophisticated sewage treatment system that includes both individual treatment and a community mound. Most treatment will occur within the multiple tank- and - treatment facilities on each lot. This allows for monitoring and maintenance of individual lots without interfering with the elements of the system used by all lots. It also minimizes the treatment that is needed in the common mound absorption field. There is a minimum amount of flow that must occur for the overall system to operate properly. The system designer has proposed dividing the mound system into several zones with valves. In effect, this allows increasing the area of the mound being used as needed. Wetland #4 in the southeast corner of the Moon Marsh site is part of this complex. The proposal would fill 4200 sf of wetland along the roads and mitigate this with 4200 sf of new wetland and 4200 sf of public value credits in the form of infiltration basins. The design and implementation must comply with RCWD requirements. Drainage and utility easements will be established that cover and extend 10' beyond the wetlands, in accordance with City requirements. Conservation easement locations will correspond to these drainage and utility easements. Two infiltration basins are proposed, one on the north side of the site along the road, one on the south side. Floodplain: The FEMA floodplain map shows much of the site within the 100 -year floodplain. The RCWD has determined the 100 -year elevation to be 887.5. Lowest floor elevations are at least two feet above this in accordance with City policy. There will be minor floodplain fill which will be addressed by excavating an area of equal volume to compensate (compensatory storage). Roads, Access, Traffic: The proposal extends the existing driveway on the south part of the site to become a private loop road with another access onto East Rondeau Lake Road. This private road serves all four lots. Because heavy vegetation can block sightlines, a certain area should be cleared where the loop accesses East Rondeau Lake Road. The right of way for the east 33 feet of East Rondeau Lake Road will be dedicated with the plat. The road is an easement now. This will be clarified with the title search that will be necessary for a final plat. The creation of three new residential lots will not create a traffic generation problem. Park Plan and Dedication: The parks plan shows Natural Resource Protection Areas corresponding to the locations of wetlands as revealed by the wetland delineation. These are wetland areas that will be protected by existing wetland law or may be important plant communities. They will be covered by a conservation easement as well as a drainage and utility easement. The Natural Resource Conservation Areas are uplands with features that have high ecological value. These areas should be examined for the potential for protection. The rare plant survey found no rare species in the uplands on the site, and most of these areas have been disturbed by past use. Park dedication will be cash in the amount of $2075 for each of the three new lots, for a total of $6225. • • • Moon Marsh page 9 ENVIRONMENTAL BOARD ACTION The Environmental Board reviewed the project on June 27th. Their comments are attached. Overall, the Environmental Board was positive about the project. OPTIONS 1. Recommend approval of application. 2. Recommend denial of application. RECOMMENDATION Option 1 The following conditions of approval should apply: 1. The onsite sewage treatment system shall comply with all requirements of MN Rules 7080 and all other applicable laws. The final design must be submitted for review and obtain approval prior to site work commencing or final plat approval. 2. A monitoring and maintenance plan for the community sewage treatment system must be prepared and submitted to the City prior to site work commencing or final plat approval. A monitoring and maintenance plan must be kept in place by the property owners at all times and submitted to the City for review upon City request. This requirement shall be recorded against the property. 3. The right of way for the east 33 feet of East Rondeau Lake Road shall be dedicated with the plat. 4. Park dedication shall be paid in accordance with City policy in effect at the time of preliminary plat approval by the City Council. 5. A permit shall be obtained from the Rice Creek Watershed District prior to site work and the project must comply with all permit conditions. 6. Clearing of vegetation for sightline safety at the intersections of the private loop road and East Rondeau Lake Road shall be examined and determined as part of final plans and shall be completed with site work or when the loop road is constructed. Property owners shall ensure the designated area remains clear of vegetation. • • • Moon Marsh page 10 7. A conservation easement covering Outlots C, D, and E shall be dedicated to the City. The conservation easement shall provide for the possibility of future ecological restoration work, to be determined by future agreement between property owners and the City. The easement document shall include the requirement for signs delineating the easement. Specifics conditions of the easement shall be listed in an easement document that is recorded prior to approval of site disturbance or with the final plat, whichever occurs first. 8. Homeowners' association documents shall be submitted for City review prior to final plat approval. The declaration of covenants, restrictions, easements, or other documents must provide for the common ownership, protection, and maintenance of the outlots, private road, community septic system, intersection sight lines, and other elements necessary to the health, safety, and welfare of the general public and the residents of the project. The report goes on to state that `it is unlikely that this investigation has found groundwater at its highest level. Most likely, maximum groundwater on the site is equivalent to the ordinary high water level (not short term flood level) of the vicinity wetland'. A seasonal high water mark has not been identified in the report and will need to be submitted. Based on the groundwater levels determined in the Geotechnical Report, Lots 1 and 2, Block 1, does not meet the City's minimum low floor requirement as stated in comment 1 above. 08/03/07 As per discussions with the City, the low floor elevation has been raised to 892.5 for Lots 1 -2, Block 1, and Lot 1, Block 3. This item has been addressed. 2. The filtration areas may not be feasible due to the presence of mottled soils near the surface which indicates high ground water levels. Groundwater could affect the efficiency of these systems. 08/03/07 This item has been addressed. 3. Identify the location and elevation of the outlet and emergency overflow for all wetlands. Low openings are required to be a minimum of 1 foot above the emergency overflow elevation. Moon Marsh Drainage Calculations Review • City of Lino Lakes, Minnesota August 3, 2007 06/19/07 It appears that the emergency overflow for wetland No. 1, at the north end of the site, is located at the low point of the proposed road at station 19 +00. The new overflow created by the construction of the road appears to be at a higher elevation than the overflow elevation for this wetland under existing conditions. Identify the overland emergency overflow elevation for wetland No. 1 located at the north end of the site on the Plan and ensure that the low opening of the existing home located north of the site is a minimum of 1 foot above the new emergency overflow elevation. Label the emergency overflow elevation for wetland No. 3 and wetland No. 4 on the Grading Plan. 08/03/07 Since the proposed emergency overflow elevation of 889.3 for the north wetland #1 is 0.70 - inches higher than the existing overflow elevation of 888.6 for wetland #1 as labeled on the Grading Plan, verify that the lowest opening of the existing structures located to the north of the site is a minimum of 1 foot above the proposed overflow elevation of north wetland #1. 4. The sum of the total wetland area defined in ponds 10P and 12P of the model should equal the wetland area of the existing wetland defined in pond 11P. For example, the area of the wetland at elevation 888 under existing conditions in pond 11P is 10.1 acres; however, the sum of the area at elevation 888 under proposed conditions for ponds 10P and 11P is 17 acres. 08/03/07 The available storage for existing wetland #1 (pond 11P) is less than the available storage for wetland #1 under proposed conditions (pond 10P and pond 12P) in the model. The available storage for wetland #1 under proposed conditions should be equal to or less than the available storage for wetland #1 under existing conditions. Update the proposed conditions model to reflect actual site conditions. 5. The filtration basin 2P and 4P outlet device routing is not consistent with the outlet structure detail on Sheet 7. The 12 inch horizontal orifice /grate should be routed through a 12 inch diameter outlet, not the 4 inch diameter pipe as currently modeled. In addition, the 4 inch outlet should be a 6 inch outlet at a 0.0% slope, with the length as labeled on the Grading Plan and outlet structure detail. Update for consistency. This development , although not called a "conservation development', should employ the guidelines of the AUAR. 2. A conservation easement containing no -mow , dumping, cutting, building in, or filling in , and naming the City as the easement holder with the right to perform restoration work in the easement. This easement should be written from the wetland edge and cover as much as possible of the area shown in Attachment 10. Signs should be posted on the easement line , describing the easement , every 50 feet. 3. SMA's within the AUAR and therefore in Moon Marsh must have: • No more than 20% of their surface as permanent open water; the remaining surface area of each SMA shall contain mesic prairie or wet prairie communities to maximize the infiltration and water quality treatment capacities of the system • Design high water levels (100 -year) less than or equal to 2.5 feet above the normal water level or lowest outlet invert • Side slopes that are less than or equal to 6:1. horizontal to vertical and 10:1 safety bench at the normal water level per RCWD requirements. • Post development runoff release volumes should be no less than 80% and no greater than 150% of existing conditions runoff volumes. These standards must be verified by our City Engineer 4. RCWD CAPROC Items are addressed including and particularily: Geotechnical soil borings at proposed BMP location in order to determine depth to the water table. This is important in that the designer is calling these infiltration ponds. Infiltration ponds designed into the groundwater are not infiltrating anything other than possible contaminants to the ground water. Adequate separation (3 ") must be shown between the pond bottom and the ordinary high ground water. A number of Wetland, Erosion and sediment control, Administrative, findings and stipulations as outlined in the CAPROC Attachment • • • Page 2 5. there is enough indication that there could be rare plants on part of the property, and the property should be surveyed to verify the presence or absence of rare plants. The area on the Wessel property that would be of concern is indicated on Attachment 10. 6. Suggest placing the buffer of the western most wetland in Conservation easement since this forms part of the City Greenway system (Attachment 11). New wetlands constructed on the site as well as buffer areas should be planted with the City native seed mix. 7. Rain gardens proposed on the site should be designed with a low maintenance (unless there is agreement with new homeowners to manage something different) Maplewood - type of design. Design of these gardens should be submitted to the city as well as a perpetual maintenance plan. All designed ponds and infiltration features must have at least 3 -feet of sand separation between the ordinary high ground water level and the bottom of the structures. 8. Community drainfield should be approved by Anoka County Environmental 9. It is recommended that a temporary sediment pond be constructed to capture surface water runoff during construction. All proposed infiltration, wetland and rain - garden soils must be protected during construction. Suggest construction of new surface water features after major construction is complete. Features should be constructed with low impact/compaction, track -types of equipment and fenced off prior to construction. All soils determined to be more compact after construction than prior to construction in drainage/ surface water infiltration or management area will be loosed to pre - construction conditions. It is also recommended that all new yard soils have top -soil incorporated into the subsoil and tilled as deeply as possible. No soil may be imported or exported with out City approval. 10. . The proposal includes creating four commercial lots on a portion of 28 acres of property. The remaining 19 acres has not been laid out. However, because of stormwater and transportation planning needs, the use of the entire site must be considered. We have not received complete information on this application, but discussing the project in the concept plan phase of the PUD process allows for public consideration without the need for formal recommendations. While this is a concept review, this report presents details of many elements of the project in order to assist the discussion and support the goal of providing substantive guidance for the developer. The zoning ordinance defines two types of PUD: rezoning and conditional use permit. A commercial PUD can be approved as a conditional use permit. The site is within the area analyzed by the I -35E Alternative Urban Areawide Review (AUAR). The AUAR's mitigation plan requires some information and review criteria that typically are not applied to development projects elsewhere in the community. Main Street Village page 3 • The Wetland/Aquatic and Upland Habitats map (AUAR Fig. 10 -2) does not show any core or outlier habitat areas that we want to preserve. • • Water quality, stormwater management, erosion and sedimentation: The AUAR includes analyses of surface water runoff issues which lead to requirements for including infiltration elements and other techniques. It also includes estimated stormwater management recommendations for specific development areas. These estimates in the AUAR cannot be considered strict requirements. However, they do provide guidance for mitigation. The mitigation plan establishes sizing criteria for stormwater management areas that are designed to support wetland complexes or large infiltrating surfaces with native plant populations. The approach is that these areas would be designed consistent with strict criteria for maximum filtration and /or infiltration of stormwater. The site is labeled development area Y -TD in the AUAR. The most general estimate suggests that 16 % -20% of the developable area would be needed for stormwater management (AUAR Fig. 17 -3). A somewhat more refined estimate suggests a need of 5 acres for stormwater management (AUAR Table 17 -5). These estimates are calculated for the entire 28 -acre site and are high compared to standard development practices. The submitted project only includes about a third of the total site (less than 9 of the 28 acres), so it is difficult to compare against the AUAR. Nonetheless, we can see that stormwater treatment is a challenging issues and it is important to consider the entire site rather than individual pieces. The AUAR requires that runoff rates will be at or below pre- development conditions. This is a standard requirement everywhere in the city, enforced on all projects. The AUAR also requires that runoff volume be no more that 150% of pre - development runoff. This is being reviewed. Archaeological Survey: A Phase 1 cultural resources survey was completed for the site and submitted with the project, as required by the AUAR. The farmstead site was found to be not eligible for historic listing. The survey investigators recommend that no further cultural resources work is necessary. AUAR Fee and Environmental Review: The City Council adopted a fee for new development within the AUAR area. This fee was based on the cost of the AUAR and calculated by anticipating that growth will occur first in the Stage 1 and 2 growth areas. The fee is $269 per acre, and 28.3 acres x $269 results in a fee of $7612. The fee goes toward the costs of preparing the AUAR and is justified because no environmental review is needed for projects within the AUAR area as long as the projects are consistent with the development assumptions in the AUAR. If the AUAR had not been prepared, the standard environmental review rules would apply. The submittal includes about 37,000 sf. A retail commercial project of 200,000 sf or more would require an EAW. It is possible though unlikely that development of the full site would cross that threshold. However, the City would have the ability to require an EAW if there may be the potential for significant environmental effect. Main Street Village page 4 Planned Unit Development Section 2, Subd. 10. of the zoning ordinance includes the PUD standards. The zoning ordinance provides for two types of PUD. We have used a rezoning PUD on mixed use projects and others with exceptional design issues such as conservation developments in urbanized areas (with city utilities). We also have a provision for a conditional use permit for a PUD. A commercial residential PUD is allowable under this option. It is important to review the purpose and intent of a PUD. Subd. 10. PUD, Planned Unit Development. A. Purpose and Intent. The purpose of this section of the Zoning Ordinance is to provide for the grouping of lots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. This section is intended to introduce flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. It is further intended that planned unit developments are to be characterized by central management, integrated planning and architecture, joint and common use and maintenance of parking, open space and other similar facilities, and harmonious selection and efficient distribution of uses. ... The PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to encourage: 1. A development pattern in harmony with the objectives of the Comprehensive Plan. 2. Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. 3. The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. 4. A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. 5. An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. Promotion of a desirable and creative environment that might be prevented through the strict application of City zoning and subdivision regulations. E. Commercial or Industrial Planned Unit Development, CUP Requirements. 1. Purpose. Since this will be the main access to the retail center in the future, it is vital to know if this `road' can be constructed. The wetland impacts and mitigation are an integral part of this question. A new mitigation plan is under review by the RCWD. However, there is an even more recent submittal of an amendment to the delineation of the large, southern wetland. This may affect the mitigation plan. Main Street Village page 6 This report discusses the AUAR requirements for stormwater management in a previous section. Staff met with the developer's team on July 31 to discuss these. Roads, Access, Traffic, Circulation: The site ultimately will have four access points: a right -in only slip lane from Main St.; the existing access on Otter Lake Road north of the bank; a new access on Otter Lake Road north of the water tower; and the service road along I- 35E. • The "slip lane" into the site from Main St. was negotiated with the Anoka County Highway Dept. as part of the CSAH 14/8 improvement project and the I -35E interchange project. This access will allow vehicles to leave Main St. to enter the site, but not exit the site onto Main St. It will not pose a safety problem on Main St., but there are some issues to consider. The plan shows this slip lane at 17' wide. We typically require road pavement to be at least 20' wide to provide for emergency vehicles. Though this access road may or may not be considered an "internal" road in the PUD, it is very different from a lane or alley providing rear access to the garages of townhomes where only the 20' is needed. This width must be corrected. After the initial S- curve, there are two driveway intersection points before this entry road meets the road north of the bank. The first driveways are placed near the end of the second curve. The second driveway intersection is about 85' further south, and the road intersection is about 60' past the driveway. A fast food drive through, gas station, and car wash have important circulation needs in addition to normal retail parking. These needs must be met with safe access and circulation. Staff suggests that the roadway between the two east driveways be narrowed to 20' like the slip lane itself and kept as one -way to the south. This will keep the traffic on the slip lane from Main St. flowing in one direction as far as the two southern driveways, allowing ample stacking distance before meeting vehicles traveling north. Other possibilities include the following: • The northern driveway on the east (Block 1) be converted to right -out only that would allow vehicles to exit the parking lot but not enter. • The northern driveway on the west be revised to right -in only. The southern driveway on the east (Block 1) definitely should be adjusted slightly align centerlines with the driveway on the west. • The existing bank access will become right - in/right -out in the foreseeable future. Otter Lake Road will be reconstructed in this area in order to accommodate future traffic, and at that time a median will be created. It is possible that Anoka County could require that the existing access be converted to right - in/out when development occurs. Either way, the second Otter Lake Road access is a key element as it will be the primary access to the development area. • • Main Street Village page 7 The southern driveways from the gas station and the large retail site should be moved west approximately 70' to avoid conflicts with the intersection of the slip lane road. This new driveway location will allow for ample access to the gas pumps and the convenience store and shouldn't cause parking or circulation problems on the south side lot. • The PUD requirement is for an internal road to be a minimum of 26' (Sec 2, Subd.10, B.6). This road narrows to a pavement width of 25' on the plan and must be corrected. This will be an important circulation route for the development area, providing access to the larger development area. • This means we must know that the second access can be constructed. We do not yet have sufficient geotechnical information (soil borings) to be confident that this `road' can be built. This is the reason the application is still incomplete. The specific timing of the construction of the second access in relation to the phasing of development on the site will need to be established if the project is to be approved. However, it is vital to know up front if the soils will support the access route. Lino Lakes has a joint powers agreement with Anoka County that limits the number of accesses that will be allowed on Otter Lake Road (Co. Rd. 84) between Main Street. and Cedar Street. We can have a total of six driveways and three roads. There are five driveways now and two roads. We would prefer to use the allocation wisely. We have suggested that the new southern access on this development site be planned along the property line with the City's water tower. This would allow the elimination of the existing water tower driveway onto Otter Lake Road: the water tower driveway would be on the new access `road'. This would save a driveway access and possibly provide a little more usable land for the development site. A traffic study was prepared for the development. The study considers the existing proposal (phase one) and future development on the site. The study assumes the existing bank road will be a full access point with phase one of the development, but be converted to right - in/right -out only with full development. As to the southern access, it will function properly with a stop sign with full development but will require a traffic signal by 2030 because of the increasing background traffic. The intersection of Otter Lake Road and Main St. will function well until 2030. The AUAR's traffic analysis also recognized that this intersection will fail at that time. This is an important transportation planning issue that will require the attention of both County and City. It likely will require further improvements such as additional lanes on Main St. The plan includes an addition five feet of right of way dedicated for Otter Lake Road as well as a triangle for future needs at the Main St. intersection. However, this is shown only on the northern portion of the site. The dedication must be shown on the southern part as well. • The internal road leading to Otter Lake Road must be 26' in width. It is 30'+ on the east, but only 25' on the west end. Main Street Village , page 8 Vehicle circulation merits re- examination in certain areas such as the car wash exit. It may be best to revise the exit driveway to allow both car wash stalls to exit through the same driveway. •Parking: The site plans show the lot layouts and parking. Some of the parking stalls shown on the plans may not be fully useable. For example, we require stacking for ten cars for a car wash and the stalls on the north of the gas station will not be useable if there are cars stacked for the car wash. In front of the large retail on Lot 2 Block 1, at least the two southernmost stalls should be eliminated as they are too close to the driveway. That driveway design should be re- examined. The large retail building has a patio in back, useable for three or four of the leaseable areas. The alternative parking analysis above assumed three of the spaces (3900 sf) are used for a restaurant. The parking requirement doubles for restaurant use and triples for a fast food business. The result would be a failure to meet the parking requirement. The zoning ordinance does allow for a reduction in the number of required parking stalls if the applicant demonstrates through a peak parking analysis that the peak demand is less than the normally required number of stalls. The restaurant building footprint is 4281 sf with the trash area and cold storage connected to the end of the building. While we recognize that a franchise typically has some established building designs from which they select, we wonder about the north end of the building. It is shown as the "front" entrance, has a door, though there is no access to the door: it is all sodded on the north of the building, and the drive - through lane immediately next to the door location. Perhaps the entrance can be extended and the door open to the west. A sidewalk to this door should be added. The building and site layout should be re- examined in relation to one another. The commercial building architectural standards in the zoning ordinance prohibit EIFS from being closer than three feet to the ground, and EIFS must not comprise more than 30% of the front of a building. This must be corrected. Changing the lower 3' will reduce the percentage of EIFS on the north (front) facade. In addition, the south wall does not include any differentiation of base - middle -top other than the cornice along the top of the cold storage and trash areas, which only extend across part of the building on that side. A few minor revisions will ensure the attractive features apply on the entire building. •Lot 1, Block 2, Kwik Trip With Car Wash (sheet A5 and others): Both buildings have red brick walls with tan brick courses for visual variety. The store has a wide stucco band as well. The store is 21' high with 31' peaks. The color of the metal peaks is not shown on the plans. The trash enclosure is attached to the car wash. The store has base - middle -top features in varying degrees on different walls. •Lot 2, Block 2, Retail (sheet Al): The large retail building has 4" precolored block, rock face block in two colors, and EIFS of several colors. It includes the base - middle -top design elements, though the west elevation color scheme was not submitted. This building is 22' high with arched features several feet higher. The plans show a patio behind this building, with no explanation. There also is a drive - through window on the north elevation. If this is intended for fast food or restaurant use, the parking requirement increases. The circulation of the site does not work for a drive through on that wall. Both a drive through and outdoor seating need a conditional use permit (CUP). These issues need to be clarified and addressed. The trash enclosure must be attached to the building. The drive lane behind could curve around it. Signage: The submittal included signage specifications. We commend the early consideration of signage as part of the project design. There are several elements of this signage plan that will need to be amended to comply with the City's sign ordinance. Staff will confer with the applicants on these items. We also will need to establish the locations of monument and /or pylon signs, and show them on the revised plans. • • • • • • Main Street Village page 11 Park Plan and Park Dedication: The parks plan shows Natural Resource Protection Areas corresponding to the locations of wetlands as revealed by the wetland delineation. These are wetland areas that will be protected by existing wetland law. As noted above, the wetland mitigation plan is being reviewed by the Rice Creek Watershed District. The protected wetlands will be covered by a drainage and utility easement. The park plan shows a transportation trail along Otter Lake Road. We are looking into the possibility of having this constructed with the project. Park dedication will be cash in the amount of $2175 per acre of commercial development. Dedication cash typically is credited for the trail construction. ENVIRONMENTAL BOARD ACTION Stormwater management was the focus of the Environmental Board discussion on July 25. This included the importance of the design of the stormwater facilities, such as infiltration and filtration features. In addition, the AUAR requirement for volume control must be addressed in the project design. There also was consideration of revising the landscape plan to substitute some tree species and ensure plantings in infiltration areas are appropriate. RECOMMENDATION No formal action required for concept review. Staff and applicant are seeking comments to guide project/plan revisions. The following should be addressed with plan revisions: 1. Private roadways within the project shall have an improved surface of 26 feet unless safe access and circulation dictate otherwise. 2. Examine the option of combining the southern access with the water tower access to avoid creating an additional access onto Otter Lake Road. 3. Right of way dedication for Otter Lake Road must be shown on the plans on the southern part of the site. 4. A peak parking analysis must be submitted to demonstrate that the peak demand is less than the normally required number of parking stalls. This study must address possible restaurant/fast food uses in this building. 5. Lot size data must be resubmitted to reflect the Otter Lake Road right of way dedication. Main Street Village page 12 6. Comment from ACHD on right of way or other issues? 7. Stormwater management in light of the goals and requirements of the AUAR mitigation plan. 8. The wetland impacts and mitigation must be determined. Ultimately, a permit must be obtained from the Rice Creek Watershed District prior to site work and the project must comply with all permit conditions. 9. Snow storage or removal from the site must be addressed. 10. Landscaping plan revisions should address the recommendations of the City Forester and Environmental Board. 11. Several site circulation issues must be addressed on revised plans, including but not necessarily limited to: access locations and directions along the slip lane entrance from Main St.; car wash stacking and parking areas; drive through window on the large retail building; driveway locations. 12. Consider breaking up the east and west elevations of the retail building on L 1 B1 with a horizontal band to change the color or material and establish a visual base - middle -top on those walls. 13. The trash enclosure for the retail building on L1 B1 must be attached to the building and shown as attached on the building elevation or plan. 14. The McDonald's north building door, site layout, and drive through circulation should be re- examined in relation to one another. 15. The commercial building architectural standards in the zoning ordinance prohibit EIFS from being closer than three feet to the ground. This must be corrected on the McDonald's building. 16. The south facade of McDonald's should be re- examined for the possibility of incorporating a base - middle -top appearance. 17. The reductions seem too high. The report should be revised to show more realistic trip reduction assumptions. 2. The entrance north of the Bank will initially operate at a level of service B. It is unknown how long before Phase II would construct a new intersection south of the Bank; therefore, the level of service at the north intersection will gradually decrease over time. A limit to the length of time this north intersection can remain full access should be incorporated into the development agreement. 3. The future access road runs through the wetland. This impact needs to be minimized as much as possible. A mitigation plan is included in the submittal, and should be reviewed and approved before Phase I can proceed. The City may wish to require that the wetland filling and mitigation occur as part of the Phase I improvements, so that future rule changes do not affect the Developer's ability to construct this intersection. 4. Soil information is required for the future access road to Otter Lake Road. 5. See attached drainage review, dated July 17, 2007. Items to be addressed prior to final approval: 1. Regional ponding was done for some of the Phase I area. We will need to review the computations to insure that the drainage system is sized to handle this development. 2. Trunk sewer and watermain within the development will be public. Easements will be required over these utilities. There is a fire loop around the buildings and the hydrants appear to be spaced 110 appropriately. 3. A 15 foot wide trail easement is required on the west side of Otter Lake Road. The trail should be built as part of Phase I from the intersection at CSAH 14, to the south end of Phase II. The developer should consider some of the following ideas: 1. Build a round -a -bout at the intersection northwest of the Bank 2. Have the drive -thru at the McDonalds exit behind the retail building onto the slip ramp driveway. 3. Restrict some of the driveway movements within the Phase I development. 4.
