Wollan's Park Restoration Update /Jason Husveth DRAFT MINUTES 1 ENVIRONMENTAL BOARD MEETING September 26, 2012 Mr. Jason Husveth from Critical Connections stated he has been working on the Minnesota Wetland Bank Plan application for 18 months. He stated Part A is fairly simple. It includes pages of tables and information to check with and check off. A concept plan of what is being done at the park and with property holders, etc. He stated the most important is a section on the Application for Exceptional Natural Resource Value (ENRV). There is a special provision on page two of the banking application for this. These projects are few and far between. These projects have to meet existing criteria to meet exceptional features. The responsibility is upon us to show this. Part B was submitted a few weeks ago to the state and Department of Natural Resources (DNR). He stated they have asked for the maximum credits which would be 110 credits. There was a questioned as how the City is thinking about managing the property so it does not revert back to a low quality state. It was stated the restoration is modeled after other projects Mr. Husveth has worked on. The model for this project is different in that City crews and City equipment will do much of the work. His company will oversee the project. He stated it is not guaranteed the application will be approved under an ENRV. He will be attending a meeting at Anoka County Technical Evaluation Panel (TEP). There are a few minor things they have been requested and he will negotiate for eligibility. He stated in the future they will be a need to communicate with adjacent property owners. Mr. Asleson stated they may try to acquire a conservation easement. Assuming we receive approval of the application. We want to make sure we are good neighbors and keep property owner's informed. Mr. O'Dea questioned the approval process. Mr. Husveth stated we should have an answer fairly soon. If approved they then would need get all of the paperwork signed. Work would commence in the winter. Ms. O'Dea stated if we take on the responsibility and the fund gets cut, what then? Mr. Asleson stated the City never stops managing parks. He stated looking at long term there is really nothing crucial - left. The heavy work will be done in the first 3 -5 years. After that it will be minimal. Mr. Husveth mentioned if burning is a problem, there are alternatives such as raking. It is more expensive and holds that line until you can get back on track once it is restored. The Board mentioned they would like a site visit before the next Environmental Board meeting on Wednesday, October 24, 2012 at Wollan's Park. B. New Recycling Initiative/Updates and Recycling Expenditures to the End of the Year. Mr. Asleson stated Amy Ulbricht and Amanda Lee from Anoka County Integrated Waste have done quite a bit of calling to Lino Lakes businesses regarding DRAFT MINUTES 2 • • • ENVIRONMENTAL BOARD MEETING September 26, 2012 recycling. They have scheduled a few site visits to promote the recycling initiative program. Mr. Asleson stated he has narrowed down two locations for a recycling can cage enclosure. They are Centennial Fire Station and Lino Park. Both are located on Lake Drive. The first monthly recycle day took place on September 16th, at Lino Park. Freimuth Enterprise reported the following recycle day totals: Scrap Steel and Appliances: 16,840 lbs Tires: 2,820 lbs Electronics: 8,160 lbs Bulbs: 260 Small engine recycler, Larry Schatz, reported the following recycle day totals: Steel: 3,100 lbs Aluminum: 379 lbs There were approximately 25 bikes collected to be rebuilt. Apogee Retail, LLC /collection of household goods reported the following recycle day totals: 667 lbs. It was stated that there were roughly 100 cars that carne through on recycle day. C. Goals Discussion for 2013 Goal discussion postponed until the October meeting. D. Community Garden Update /Grant Submittal Mr. Asleson submitted a grant requesting in the amount of $4,369.40 for the following: 1. Expansion of water supply for 68 new plots. 2. Compost for existing and new plots. 3. Nozzles, hose and fittings. Mr. Asleson stated he would like to have the Quad Press talk to a current community gardener for an article for the paper. DRAFT MINUTES 3 ENVIRONMENTAL BOARD MEETING September 26, 2012 Mr. Asleson stated he would like to have signs made for the Community Garden for 2013. Ms. Andrzejewski stated if we do not receive the grant we could expand the current plots and the plots would still have access to water. E. Fall Arbor Day at Lino Lakes Elementary Mr. Asleson stated Lino Lakes Elementary will be having a fall Arbor Day on Thursday, October 4, 2012. F. Target Corporation Mr. Asleson stated Target will be revamping the plantings in the infiltration ponds on Apollo Drive. He stated he will send out an email with dates for anyone interested in digging up native plants for their gardens. Target is planning on having more formal plantings with native species. He stated there will be 500 cubic yards coming out of the ponds. He stated the grates for sediment traps are cleaned 8 times a year. Infiltration ponds G. Japanese Beatle Mr. Asleson stated Japanese Beatles come out in June and July to eat tree leaves. In August and September they eat the roots of your turf Ms. DeHaven questioned if there is a spray for getting rid of the beetles. Mr. Asleson stated yes, there are chemicals to treat. Mr. Asleson stated they can be easily killed on the trees with an insecticidal soap. Mr. Asleson stated itwould be a good idea to put an article in the spring City newsletter on how to treat -for the beetles. 7. ADJOURN It was noted that the next meeting of the Environmental Board will be on Wednesday, October 24, 2012 at 6:30 p.m. There being no further business, Ms. DeHaven moved to adjourn at7:45 p.m. Ms. Andrzejewski seconded the motion. Transcribed by: Lisa Hogstad Community Development Secretary DRAFT MINUTES 4 • Agenda Item 5A • Environmental Board Meeting Date: September 26, 2012 Topic: Bill's Superette Location: NE Corner of Lake Drive and Main Street. Background: This is an environmental review of a land use request submitted on September 10, 2012. The application submitted by Grant Rademacher is a request for site plan approval for preliminary plat and a CUP for a gas station. The parcel is classified as commercial property. Analysis: • Land Cover Bill's Superette sits on a site that is classified as" Oak Woodland- Brushland ". Scattered oaks among Box Elder and Ash are prevalent on the South and West sides of the parcel. The rest of the parcel, except for qualified significant Hackberry and Box elder on the East side of the property, include a mixture of suckering Box elder, Raspberry, Prickly Ash, and Common Buckthorn. • Rare and Unique Resources There are no rare or endangered indicators on the site. NHIS data shows nothing within at least 1/2 mile from this site. • Wetlands There are no wetlands on -the site, therefore no WACA considerations. There is a RCWD catch basin holding area on the very south tip of the site. • Surface Water/Ponds The Rice Creek Watershed District has determined the application to be incomplete. The applicant must meet the District rules C, D, and RMP -3. The rule states that in addition to the BMP's required under the rule, volume control measures are required reducing runoff by at least the volume from 0.5 inches of rainfall over impervious surfaces. Volume reduction under this part of the rule may be achieved only by measures described in the document. Those measures are: Reestablishment of effectively drained wetlands and floodplain meadows, upland restoration conservation, restoration of degraded wetlands, impervious disconnection, soil amendments /tilling. The applicant must meet this requirement. Other requirements are listed in (Attachment 2). • The developer is proposing to place 1 to 2 feet of rock in the basins of these ponds. The rock basin bottom would create a difficult maintenance issue and could very well look unsightly in a number of years when possibly cattails, cottonwoods and Boxelders get rooted in this area. Sedimentation created by rogue plants would create cleanout issues in the future and look unsightly. Recommend not having rock bottoms; however, the developer must sign maintenance agreements with City and Watershed for these ponds, and cleanout would be at his expense. The plan and agreement must address the cleaning out of the forebay and pond areas, and state that the ponds will be cleaned out when they are determined to be 1/3 full. The developer shows pond areas being sodded on top. All sod areas must be irrigated, whether the sod is inside or outside the pond. An oil separator system has been designed into the normal pretreatment ponds. The design includes a clay liner. This design has not been reviewed by the Rice Creek Watershed Board Engineers. The clay liner would create a dead pool area. Since these proposed pools are 4 foot deep it is recommended that the ponds be separated from the general public access. This design for oil separation and stormwater pretreatment has never been incorporated into any city projects. A design such as the oil separator system across the street eliminates pooling on the site and this would be preferable. Recommend a dry forebay system and separate oil separator /grit chamber system. Rice Creek Watershed District also indicated that the chamber type of oil separator /grit chamber would be preferable to a clay lined pond. The developer is proposing a wet seed mix for the forebay areas. A wet seed mix is a term generally associated with native grass and forbes. Native grass and forbes that grow in a wet environment do not grow in an inundated water environment. Therefore the result of this would be cattails and other aggressive rogue plants that would volunteer on the site. The end result in my opinion would be an un -kept appearance. In the past, landscapes with unkept appearances in front of businesses were not desirable. Recommend a dry forebay system and separate chamber -type oil separator system. In addition, the permanent pool forebays could possibl-y be a hazard. If the ponds are to stay in a-perpetual state of pooling, than fencing around the ponds should be installed, or at a m- inimum a bench placed in the grade scheme. No soils should be imported or exported from the site without permission from the City. Any soils brought on to the site must be similar in nature to the surface water /infiltration characteristics of the existing soils or recalculation of runoff rates be resubmitted to the Rice Creek Watershed District for review. • Storm Water Pollution Prevention Plan The Submitted Stormwater Pollution Prevention Plan (SWPPP) is complete except for a couple of things. The SWPPP must identify the project manager responsible for implementing the SWPPP, phone numbers that the City can call for SWPPP action when it is needed, where the SWPPP will be located on site, and where the required inspection sheets will be located on the site. • • Grading Notes The grading notes include good description of proper construction, sequencing and protection of infiltration pond areas. Procedures outlined in the grading notes include protection of pond areas and tree areas. • Tree Preservation All of the existing onsite trees will be removed for construction. Tree preservation for adjacent trees is discussed in the grading plan. Adjacent trees or trees left on the east side of the project must have fencing placed at the dripline. Lighting Submitted photo - metrics conform to city code. Lighting fixtures are downward focused, lower intensity, flush mounted, cut -off style lights and conform to our ordinance. Canopy fixtures are recessed into the canopy. • Landscape Plan Attachment 1 is the new landscape requirements in our zoning code. The landscape plan is adequate for: 1. Boulevard trees: Hackberry is a very good choice for canopy and tolerance of city conditions including salt. 2. Buffer to residential: The developer is intending to construct a fence with 50% shrub screening on the east side. Fence must be on the business side and the landscape plants on the residential property side. Shrub coverage is complimented with a staggered row of Sugar Maple and Boulevard Lindens on the North and East sides. Sugar Maples and Boulevard Lindens are not a good choice for sand plane soils and unless irrigated will not stand on their own. Oaks would be a better choice and the red or northern pin oak will give brilliant fall color if that's what was desired with Sugar Maples. Some of the disease resistant elms are working very well in sandy soils in Lino Lakes. These include the Princeton, Heritage, Accolade and New Horizon Elms. These woiilrl be good substitutes. Red Maple would be a good choice for substitutions. Recommend substituting better adapted species for this site. 3. Buffer on parking lots: Between a parking lot and public right of way, landscape materials are required continuously at 30 inches of height. All plantings must be triangular spacing. The developer has demonstrated this. 4. Open area landscape standards: The requirement is for 1 canopy tree per 2000 square feet. Since the project has 64,000 square feet there is a requirement for an additional 32 trees and 96 shrubs. The plan indicates over 32 trees and 96 shrubs. 5. Foundation landscape standards call for 1 large tree and 3 large shrubs on the rear and side of each building; and 2 large trees and 6 large shrubs on • the front and street sides of buildings. The plans show that this standard is met within 15 feet of the building. 6. Shrub and tree islands show alpine current in the island on the corner of the liquor store. This would create a visibility issue for parking cars. Recommend a plant material that is more prostrate with a mature height no higher than 22 inches. 7. A "CPTED" Crime Prevention through Environmental Design analysis must be submitted. 8. Great River Energy must be contacted for tree plantings in the proximity of the transmission lines along Main Street. Options: 1. Tree Preservation Plan • • • 2. Commercial, Industrial and Public /Semi - Public Zoning Districts. a. Exterior Storage. Exterior storage shall be governed by the respective zoning district in which such use is located. b. Screening. All exterior storage shall be screened so as not to be visible from adjoining properties and public streets except for the following: 1) Merchandise being displayed for sale in accordance with zoning district requirements. 2) Materials and equipment currently being used for construction on the premises. c. Within an industrial zoning district, the exterior storage of semi- trailers accessory to the principal use may be allowed by conditional use permit according to Section 8, Subd. 1 and Subd. 2. Semi - trailers connected to semi - tractors queuing for loading or unloading shall be considered truck parking and be exempt from the outdoor storage conditional use permit. 3. All Zoning Districts. a. Excepting temporary construction trailers and facilities operated by public service agencies (i.e., bookmobile, bloodmobiles, etc.) as allowed by the City Council, no recreational vehicle may be used for office, business, industrial manufacturing, testing, or storage of items in conjunction with a business, commercial or industrial enterprise. b. The City Council may order the owner of any property to cease - or modify open storage uses including existing uses, provided it is found that such use constitutes a threat to the public health, safety, convenience, or general welfare. Q Required Screening, Landscaping, and Buffer Yards. 1. Purpose. To establish landscaping and tree preservation standards to promote high quality site development, compatibility of uses, biodiversity, tree preservation, and to enhance the health, safety and general welfare of the residents of the community. a. Definitions. For the purpose of the Landscaping, Screening and • Tree Preservation Standards, the following definitions shall apply: Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3 -33 Basic Use Area. Area dedicated to site's use, including buildings, parking, loading, driveways, streets, outbuildings, trash enclosures, utilities, landscaping, and grading necessary for the construction of the above uses. Surface water detention ponds are not part of the basic use area. Biodiversity. The variety, distribution and abundance of living organisms in an ecosystem. Damage. Action or inaction which does not follow good arboriculture practices. Damage may include damage inflicted upon roots by machinery, changing the natural grade above the root system or around the trunk, destruction of the natural shape or any action which causes infection, infestation or decay. DBH. Diameter at breast height, typically measured at 4' -6' above the ground. Detention Area. Area of a detention pond from the normal water level and up the side slopes to 10' offset from the high water level. Disturbance. Any construction, development, removals, earth movement, clearing or other similar activity. Drip Line. Imaginary line on the ground that is extended straight downward from the outermost edge of the canopy. Foundation Landscape Zone. Within 15' of the building. Invasive Species. A plant non - native to the local ecosystem which exhibits, or has the potential to exhibit, uncontrolled growth and invasion or alteration of the natural functions of any native habitat. Large Shrub. Large shrubs have a mature height over 6'. Large Tree. Over story deciduous trees with a mature height of at least 40'. Medium Shrub. Medium shrubs have a mature height of 3' -6'. Medium Tree. Deciduous trees with a mature height over 18' and up to 39'. Removal. Actual removal or effective removal through actions resulting in the death of a tree. Root Protection Zone. A protected area around an existing tree established by offsetting the drip line 5' away from the tree center. Screen. A barrier that hinders sight and, potentially, access. Small Shrub. Small shrubs have a mature height of less than 3'. Small shrubs are interchangeable with perennials, ornamental grasses and groundcovers to fulfill landscape standards. Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3 -34 • • • • • Small Tree. Understory deciduous trees with a mature height of 18' and under. Tree. Any self supporting woody plant, growing up the earth with one trunk of at least 3" dbh, or a multi- stemmed trunk system with a definitely formed crown. Undesirable Tree. Trees that are dead, diseased, structurally weak, invasive or trees that are hazardous to people, infrastructure or buildings. 2. Landscaping Standards. New residential platted subdivisions, mixed use, commercial, institutional and industrial uses shall be subject to the landscaping standards unless specifically excepted. The landscape standards have been divided into five categories: Canopy Cover, Foundation Landscape, Open Areas Landscape, Buffer and Screen, and Boulevard Trees. Projects shall comply with the applicable requirements of all five categories. 3. Canopy Cover Standards. The purpose of this requirement is to mitigate the effects of vehicular hardscape by establishing tree canopy cover to intercept rainfall, protect pavement from sun deterioration, reduce the heat island affect, and improve aesthetics. Vehicular hardscape areas includes loading drives, parking lots, driveways, drop -offs and other areas covered with a hard surface intended for vehicles. Canopy cover requirements do not apply to single family residential development, nor to multi - family residential development without surface parking other than individual unit driveways. a. The required minimum canopy coverage for all uses is 40 %. b. The following equation shall be used to calculate required canopy coverage: Vehicular Hardscape (Square Feet) x Canopy Cover Percent = Required Minimum Canopy Cover (Square Feet) The total of the assigned canopy coverage values for all the trees in or near the vehicular hardscape must be equal or greater than the required minimum. Pervious pavements are considered 50% hardscape. c. The assigned canopy coverage value of each tree is based on planting location, tree size and anticipated tree canopy size 15 years after planting. Existing trees may be used to fulfill canopy coverage, as described in Section 3.Subd. 4.Q.8, when the drip line has proximity to the edge of the hardscape; therefore, existing trees do not need to be within less than 7' feet of the vehicular hardscape edge. (l Trees surrounded by hardscape on 3 sides are valued at 100% Canopy. Trees with access to planting soil outside of the island are required to meet soil volume requirements for a shared bed. 4. Foundation Landscape Standards. The purpose of these standards is to soften and enhance building architecture, define access points, add color and seasonal interest, and to blend buildings in with the natural Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3 -36 • • • environment. Foundation Landscaping Standards do not apply to single family residential development. a. The City may allow flexible planting locations where service areas or other constraints make the standards difficult to meet. d. Existing trees may be used to fulfill the Foundation Landscape Standards as described in Section 3 Subd.4.Q.8. e. Smaller landscape materials may be substituted at the following rates: 1 Large Tree = 1.5 Medium or 2 Small Trees 3 Large Shrubs = 5 Medium or 10 Small Shrubs The design of landscaping for ground areas under the building roof overhang must take into account the potential effects of runoff from the roof edge. 5. Open Areas Landscape Standards: The purpose of these standards is to provide general site beautification and high aesthetic quality with a mix of plant materials in open areas. Open areas include disturbed site areas, such as cul de sac islands, boulevard medians, storm water management areas, common areas in multifamily sites that are not for recreation facilities, and disturbed areas that are not located within the foundation landscape zone, vehicular hardscape area or the building footprint. Open Area landscaping standards do not apply to single family residential Tots. Open areas landscaping shall meet the following standards. a. Planting shall be located above the normal water level in detention areas. The City may require specific tree species in locations where water levels vary. d. Existing trees may be used to fulfil! Open Areas Landscape Standards as described in Section 3, Subdivision 4.Q.9. e. Smaller landscape materials may be substituted at the following rates: 1 Large Tree = 1.5 Medium or 2 Small Trees 3 Large Shrubs = 5 Medium or 10 Small Shrubs f. Areas that are included in a project- specific natural resource management plan that addresses vegetation are not subject to the open areas landscaping standards. All lot areas not used for off - street parking, off - street loading, sidewalks, driveways, building sites or other requirements shall be landscaped with grass, shrubs, trees or other acceptable vegetation or treatment as required by this chapter prior to issuance of a certificate of occupancy. Exceptions to this requirement are listed in Section 3, Subdivision 4.Q.14. 6. Buffer and Screen Standards: The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. The location of buffers and screens are listed below, while the width of the buffer yard can be found in the respective zoning districts. Buffers and screens shall meet the following standards. g. a. Buffer and Screen Standards: The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. The location of buffers and screens are listed below, while the width of the buffer yard can be found in the respective zoning districts. Buffers and screens shall meet the following standards. g. a. Small shrubs shall be a planted at a maximum interval of 3' on center; medium shrubs shall be planted at a maximum interval of 4' on center; and large shrubs shall be planted at a maximum interval of 6' on center unless; otherwise authorized by the City. c. A wall or fence intended to provide a continuous year round screen shall block visibility completely. d. In addition to the shrub cover required in the table above, all screens shall be planted with large trees every 50 LF, medium trees every 35 LF, or small trees every 25 LF or some combination thereof, along the length of the screen. e. Existing vegetative screens should be left in place unless composed of invasive species or otherwise directed by the City. Existing screens may be enhanced with new plantings to comply with the standards. f. Berms shall be irrigated, have maximum side slopes of 3:1, and have no Tess than four (4) inches of topsoil. g. Permanent walls and fences shall be offset by a minimum of 2' at intervals of 75' maximum length for stability and visual relief. See illustration. h. Approved permanent wall /fence materials shall include wood, metal, masonry, concrete stone, or other prefabricated and /or sustainable materials. Non- decorative concrete block is prohibited for screening walls: rock face block or other decorative material is required for masonry walls. Chain link fences with slats are prohibited for screening walls. i. Maintenance of the required buffer strip planting and /or fence shall be the responsibility of the individual property owners or, if applicable, the homeowners association. 7 Boulevard Tree Standards: a. Boulevard trees are required at the rate of one tree per 70 linear feet of road frontage where property fronts any public road. The City shall collect a standard fee per tree based on the estimated market rate cost to purchase and install trees within the development site. General Landscaping Standards: a. Desirable existing trees may be used to fulfill Canopy Cover, Foundation Landscape and Open Areas Landscape standards if applicable by placement. An existing tree is considered to be removed if the tree trunk is damaged or if more than 30% of the drip line area is disturbed during the construction process. f. The City may allow flexibility in landscape standards if there are conflicts with solar power, wind power, water harvesting, food production or other innovative measures proposed for the site. The landscape plan shall be compared to all applicable CPTED (Crime Prevention Through Environmental Design) standards and reviewed by the police department. h. Trees and shrubs shall not be planted in the right of way without City authorization and shall not be planted in easements without authorization from the holder of the easement. g. Tree Preservation and Mitigation Standards: The purpose of these standards is to protect valuable trees and stands of vegetation, while not interfering with landowners' reasonable use and development of property. The goal is to minimize unnecessary Toss of habitat, biodiversity and forest resources and to replace removed trees in areas where tree cover is most critical. Unless specifically excepted, tree preservation and mitigation standards apply to all plats, site plans, conditional use permits, interim use permits, grading, building, and other activity that requires a city permit or approval. a. Tree preservation and mitigation standards are described in the following table: b. Trees with thirty percent (30 %) of the roots damaged are considered to be removed and must be mitigated for at the applicable rates. d. Undesirable trees are not subject to the Tree Preservation and Mitigation Standards. e. On existing Tots with existing buildings where no building or development activity that requires a permit or approval from the City is occurring, the removal of trees is not subject to tree preservation and mitigation standards. f. Replacement trees shall be planted on site. g. The applicant may request to pay a fee per tree in lieu of some or all of the trees required for mitigation. At the City's discretion, the City may accept the fee for planting trees within the general area of the development project. The City shall maintain a standard fee per tree based on the estimated market rate cost to purchase and install trees. 10. Landscaping Guidelines and Technical Specifications: The selection, installation and maintenance of all planting materials shall be in accordance with the City's Landscaping Guidelines and Technical Specifications Manual. 11. Tree Survey: a. A tree survey is required for all property that contains a deciduous tree greater than 6' dbh or an evergreen tree greater than 12' tall. b. The tree survey shall be the basis for the tree preservation plan, tree mitigation standards, and the use of existing trees to fulfill landscape standards. c. The tree survey shall provide the following information: 1) In the basic use area and other areas-where tree removal is proposed, for all deciduous trees over 6" dbh and all evergreen trees greater than 12' tall: a) tree species b) size c) location d) drip line e) tree condition 2) the location of the combined drip lines of all tree stands designated for preservation on the development property Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3 -43 3) on adjacent properties, the drip line of deciduous trees over 6" dbh and evergreen trees greater than 12' tall where the drip line is within 5' of the development property. d. For a new plat or new Planned Unit Development, the tree survey shall be one plan sheet and the tree preservation plan shall be a separate plan sheet. e. For a building permit for a new structure on an existing lot, the tree survey and preservation information may be included on the lot survey typically required for a building permit instead of on a separate document. For a building permit for an addition to an existing structure, the tree survey information may be provided in an informal medium that sufficiently conveys the information. f At the City's discretion, the tree survey requirement may be waived under the following circumstances: 1) Deciduous trees greater than 6" dbh or evergreen trees greater than 12' tall will not be removed and are not likely to be impacted by construction. 2) Deciduous trees greater than 6" dbh or evergreen trees greater than 12' tall will only be removed within the basic use area and the basic use area is not an ESA. 12. Tree Preservation Plan: a. A tree preservation plan shall be required for all soil disturbance activities where Tree Preservation and Mitigation Standards apply. A tree preservation plan shows how the Tree Preservation and Mitigation Standards will be met and how preserved trees will be protected during construction and other potentially harmful activities. b. The tree preservation plan shall be based on the tree survey. c. If a tree survey shows that no desirable deciduous trees over 6" dbh or evergreen trees greater than 12' in height on the development property or adjacent properties are near the construction area, the City may waive the tree preservation plan requirement. d. A tree plan shall identify: 1) The basic use area. 2) The disturbance area. 3) Tree size (dbh), species, condition, location, and root protection zone (5' out from the drip line) for all deciduous trees over 6" dbh or evergreen trees greater than 12' tall to be preserved, or; Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3-44 • • • The combined root protection zone of all stands of trees designated for preservation, whichever is applicable. 4) Location and type of tree protection fence. 5) Staging areas. 6) Temporary construction access routes when temporary site access is necessary within root protection zone of any tree or tree stand designated for preservation. a) Temporary access shall be routed in a manner that is least disruptive to the tree or tree stand per the approval of the City Forester.. b) Temporary access roads shall not exceed twenty -five (25) feet in width and shall be delineated by snow fencing or safety fencing. c) An eight (8) inch deep cover of wood chip mulch shall be placed over the temporary access road to cushion the root protection zones from compaction. 7) Concrete washout areas. 8) Existing and proposed grading. 9) The plan shall show directional felling and trenching to separate root systems prior to bulldozing trees or stumps if necessary to avoid damage to adjacent trees. 10) Coordination of utility planning so that utilities are installed in a manner that protects trees intended to be saved. a) Trees to be preserved shall be tagged in the field and keyed to the tree preservation plan. The City may inspect the trees to verify compliance with the preservation plan at any time during construction. b) If a natural resource management plan has been approved for the site, the tree preservation plan shall be in accordance with said plan. c) See City Code Chapter 1011, Stormwater and Erosion and Sediment Control, for other construction related requirements. e. The following shall occur prior to soil disturbance: 1) The tree preservation plan shall be approved by the City. Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3 -45 2) Fencing and all tree protection measures shall be installed and inspected by the City. 3) Erosion control measures shall be installed and inspected by the City. 4) All required financial securities have been submitted. 5) Any required development agreement has been approved. 13. Tree Preservation during Construction: Trees that are to be preserved must be protected by the following methods unless otherwise approved by the City. a. Tree protection fencing shall be installed and maintained 5' out from the identified drip line of the trees (Root Protection Zone) prior to soil disturbance. Fencing shall be a minimum of 4' high and of a highly visible material, such as snow fence or polyethylene laminar safety netting, and must be standing throughout the construction process. Cut roots with clean, pruning cuts at the fence line prior to fence installation to avoid later tearing of the roots. Signage shall be installed to instruct workers to stay out of the Root Protection Zone. b. Areas where development must encroach upon the root protection zone must be identified on the tree preservation plan in which case the fencing shall be installed at that edge. c. No actions that may harm the health of the tree, including but not limited to construction, traffic, compaction, storage of equipment or materials including soil, grading, or concrete washout areas may occur in the Root Protection Zone. d. Trees damaged by construction, or with more than thirty percent of the roots disturbed, shall be counted as removed and mitigated at applicable rates. e. Tree protection measures shall remain in place until all grading and construction activity is terminated. 14. Final Inspection: Prior to the issuance of a certificate of occupancy, the project developer, builder, or representative shall certify in writing to the City that all elements of the tree preservation plan and landscaping plan were completed. These must be confirmed by the City. However, the City may issue a certificate of occupancy prior to completion of landscaping in the following situations: Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3-46 • • • a. If winter weather will prevent healthy planting practices, a security shall be posted to ensure the remaining planting is accomplished and all planting must be installed by the fifteenth of June the following spring. b. A certificate of occupancy may be issued by the City on residential lots prior to lawn seeding or sod, provided an escrow security is submitted sufficient to ensure that the work will be completed and the date of completion is specified. 15. Non- Compliance: If the City finds that the property is not in compliance with the approved landscaping plan or tree preservation plan, it shall inform the property owner or, if applicable, the homeowners association, regarding the non - compliance and describe, in writing, the steps needed to bring the property into compliance within a reasonable timeframe, not to exceed sixty (60) calendar days. 16. Performance Security: The City may require performance security to ensure conformance with the requirements of this chapter. a. The performance security shall extend for two (2) years from the date of planting. The form of the security (cash, letter of credit, or other form) shall be determined by the City. b. If after notification of non - compliance the property owner or, if applicable, the homeowners association fails to achieve the compliance within sixty (60) calendar days, the City may exercise its authority to use the performance security to address compliance. R. Fences and Walls. Fences and walls shall be permitted in all required yards subject to the following: 1. Permit Required. It is unlawful for any person hereafter to construct or cause to be constructed or erected within the platted areas of the City, any fence or wall without first making an application for and securing a permit. 2. Certificate of Survey. An application for a fence or wall permit shall be accompanied by a current certificate of survey providing exact lot dimensions, the location of existing buildings, structures, and easements on the lot, and the location of the proposed fence. At the discretion of the City, a final plat detail of the lot with the required information shown may suffice if no certificate of survey is available. Applicant shall be required to physically identify the property corners for City inspection. Lino Lakes Zoning Ordinance Amended General Provisions Updated August 2012 3-47 3. Location. All fences or walls shall be located entirely within the private property of the person, firm, or corporation constructing or causing the construction of such fence. a. No fence or wall shall be permitted on public rights -of -way. b. Traffic visibility requirements set forth in Section 3, Subd. 3.E.1.c. of this Ordinance shall be satisfactorily met. c. No fence or wall shall obstruct natural drainage. d. Fences or walls may be constructed within public and private utility and drainage easements provided that: 1) No fence or wall shall be located within a drainage or utility easement without written permission of the Zoning Administrator and the filing of an encroachment agreement. 2) Removal of a fence or wall or a portion thereof for the purpose of utilizing the easement shall be at the property owner's expense. 4. Construction and Maintenance. a. Every fence or wall shall be constructed in a professional and substantial manner and of substantial material reasonably suitable for the purpose for which the fence is proposed to be used. The materials and design shall also be compatible with other structures in the area in which the fence or wall is located and shall not cause blight or a negative impact. b. Every fence or wall shall be maintained in a condition of reasonable repair and shall not be allowed to become and remain in a condition of disrepair or danger, or constitute a nuisance, public or private. Any such fence or wall which is or has become dangerous to the public safety, health or welfare is a public nuisance, and the City shall commence proper proceedings for the abatement thereof. c. All posts or similar supporting instruments used in the construction of fences shall be faced inward toward the property being fenced. That side of the fence or wall considered to be the face shall be oriented toward abutting property. d. Chain link fences shall have round steel parts and braces. e. Solid walls and retaining walls (such as masonry construction) in excess of forty -two (42) inches in height shall be prohibited. When utilized, tiered retaining walls shall be separated by a horizontal landing not less than three (3) feet in width. 5. Access. All fences or walls shall be provided with a gate which affords reasonable and convenient access for public safety. 6. Residential District Fences or Walls. All residential district fences or walls shall be placed within the property being fenced. a. Fences or walls may be located in any yard up to a height of four (4) feet. b. Except as prohibited by Subd. 4.R.6.c below, a fence or wall up to six (6) feet high may be erected from a line extended from the front facade of the principal building to the side lot lines, and then along the side lot lines and the rear lot line (see Diagram 6.b). c. Description — The project is classified as a new development of a 3.65± acre vacant lot (0± acres impervious surface), located in the northeast quadrant of CSAH 14 and CSAH 23 in Lino Lakes. The project proposes to construct a gas station and liquor store and associated parking, which will add 3.04± acres of impervious surface. The majority of the discharge to the CSAH 14 right - of -way and then east and enters a private drainage system and eventually enters George Watch Lake. The applicant has submitted a $3,500 application fee, which corresponds to 2.5 -5 acres of new impervious surface. 2. Stormwater — The proposed project is located within the RMP -3 Rule area. Thus RMP -3 Section 8 replaces Rule C.5 for water quality and volume control. The first requirement is to retain the volume of run -off from the 2.3 -inch 24 -hour storm. The basins were sized to retain and treat the 2.8 -inch event via infiltration, which is adequate to meet the first requirement, provided that applicant submits soil borings and demonstrates compliance with the Rules per discussion in the ensuing paragraph. The applicant must submit soil borings at the location of the infiltration features to establish the feasibility of infiltration, including showing 3 -foot of separation from the seasonal groundwater. Additionally, soil borings showing a field classification of SM must undergo additional sieve and hydrometer analysis per District Design Infiltration Rate Guidance Worksheet. Ultimately the basin must draw down within 48 -hour following the storm event. The site is not located in a DWSMA or wellhead protection area; however applicant must address pre- treatment to prevent hydrocarbons from infiltrating in the pre- treatment area. For the second component, the applicant must treat an additional 0.5 -inch (5,518 cubic feet) of volume via one of the volume reduction methods listed in the table in RMP -2 Section 8(c). The applicant must address this requirement. Rule C.6 Rate control The issues listed under Recommendation 2 above must be addressed to show compliance. if rate is increased at a key point, then it must be iimited and cause no adverse downgradient impact. Other Rules Generally the project appears to comply with the remaining storrrrwater rules, however applicant must verify after reviewing soil borings and any redesign of the site. 3. Wetlands — There are no wetlands located within the project area. 4. Floodplain — The site is not in a regulatory floodplairr. 5. Erosion Control — Proposed erosion control methods include silt fence, rock construction entrances, inlet protection, bio -rolls and rip rap. An NPDES permit is required for the project. A SWPP Plan has been submitted for the project. The information listed under the Erosion and Sedimentation Control Recommendations needs to be submitted. Otherwise, the project complies with RCWD Rule D requirements. 6. Documenting Easements and Maintenance Obligations — Applicant needs to provide drainage and flowage easements (if required by the City), draft maintenance declaration, and receipt showing recordation once approved. If necessary, submit a summary of significant findings resulting from the review in writing to the Community Development Director. • Promote conservation development within the City incorporating the Open Space/Trail Plan and Handbook for Environmental Planning and Conservation Development within the scope of the new Resource Management Plan, and the Resources Management Plan RMP -3 • To meet or exceed our City recycling goal of 50 (1777 tons) percent or greater of our Municipal solid waste. Find innovative ways to promote and 1 encourage recycling as a city. Inventory city facilities for recycling and look into ways for school facilities to reduce waste and increase recycling. • Maintain the Community Garden site and establish a preparatory gardening g roup. • Implement the Lino Lakes Preparedness Plan for EAB as needed. • Work on Wollan's Park Wetland Banking. • Continue to monitor the Heron rookery and water quality in the northern one third of Peltier Lake and to support the protection of resources in that area. • Update Surface Water Management Plan.
