recommendations
BACKGROUND
The Foxborough Development was approved on August 22, 2006. Foxborough is a
conservation development that set up a stewardship fund for implementing the
management plan for conservation easement areas set aside within the geographic
limits of the development. Covenants and restrictions have been written subjecting all
those who purchase property in Foxborough to a Homeowners Association with
conservation easement use restrictions, yearly management work plan approvals by the
City, and annual fees for the maintenance of conservation areas.
The Conservation Fund for Foxborough consists of a $100,000 endowment Fund
established by the developer, and annual fees of $100 per lot. Yearly interest from the
$100,000 endowment plus the $100 per lot Homeowners Association fee establishes
the amount of money available to manage conservation easement areas in Foxborough.
There are 57 lots in Foxborough. The annual contribution by the Homeowners
Association is $5700 plus interest accrued. The Homeowners Association is
responsible for collecting the funds and the City maintains the collected funds in a
designated account. The Developer acts as the Homeowners Association at this time.
The dues, together with the interest from the endowment fund, establish an available
balance of slightly more than $11,400 for 2012 and 2013. Work was not done in 2012.
As part of Foxborough approvals, a Restoration and Management Plan was required
that laid out work schedules for the conservation areas. Each year the Homeowners
Association must hire an ecologist to make recommendations concerning the
management of the Foxborough conservation areas relative to the monies available.
The proposed work plan for 2013 is attached for your review and recommendations.
RECOMMENDATION
Staff recommends approval of the Foxborough Conservation Development Restoration
and Management Plan as submitted on May 29, 2013 by Critical Connections on behalf
of Mr. Marcel Eibensteiner of Royal Oaks Realty.

Restoration and Management Implementation for 2013
Dear Mr. Asleson and Mr. Eibensteiner:
At the request of the Foxborough Homeowner's Association and Royal Oaks Realty
(ROR), Critical Connections Ecological Services, Inc (CCES) has prepared the following
proposed scope of work for continued ecological restoration and management of
Foxborough conservation outlots for 2013. Proposed tasks and priorities were
developed from CCES's past experience implementing restoration and management
tasks at Foxborough (2005- 2011), conversations and site visits with City staff, and in
accordance with the Foxborough Restoration and Management Plan (CCES, August
2005). The proposed restoration and management tasks will be implemented from June
through December 2013. The proposed scope of work and prioritization of tasks are
based on available funding within the Foxborough Conservation Fund. The City of Lino
Lakes has informed CCES that available funding for restoration and management
services for 2013 is approximately $11,400.
The following proposed tasks, timelines, costs, and priorities constitute the proposed
scope of work for 2013 within Foxborough's conservation outlots.
2013 Proposed Restoration and Management Tasks:
Task 1: Continued Management and Removal of Buckthorn
CCES will directly supervise subcontractor restoration crews to manage and treat
remaining areas of buckthorn located in the northern part of the property in Outlots B
and E. Areas remain within these two outlots where buckthorn is present in high
densities. Initial removal took place in 2011 but did not remove and treat all areas of
buckthorn. CCES will also spot treat areas that were initially treated with herbicide in
2009 -2011 that may require some follow -up herbicide application. Follow -up treatment
areas include along the trail corridor and within the aspen and oak woodlands located
throughout Outlots A and C.

Restoration crews will treat all cut buckthorn with a Glyphosate based herbicide in two ways
throughout the conservation outlots. The first method for buckthorn treatment will involve a
foliar application of herbicide in areas with lower stem densities of buckthorn. Once the
herbicide treatment is complete the stems will be left standing to decompose naturally. The
second method for buckthorn treatment involves the cutting and treating of the cut stump with
herbicide. This method will be used in areas where higher stem densities of buckthorn occur
such as in the northwest corner of Foxborough in Outlot E.

Task 2: Prescribed Burn of Selected Habitats within Conservation Outlots
CCES will perform a fall prescribed burn within up to 10 acres of the Foxborough conservation
outlots. Prescribed burning will focus on habitats that were not burned previously and /or have
the greatest ecological need for a prescribed burn. CCES will prepare a burning permit
application, obtain the permits, and prepare all burn units for prescribed burning (i.e. create
burn breaks and isolate burn units). The burn will be implemented in September to November
2013 depending on optimum time for conducting the burn. If the burn cannot be implement in
the fall of 2013 (due to weather constraints), CCES will implement the burn in the spring of
2014.

Task 3: Additional Native Seeding
CCES will develop specifications and order native seed mixes for inter - seeding into wetland and
upland areas needing additional native seed. Priority areas to be targeted for re- seeding and
inter - seeding in 2013 are bare soil areas within stormwater management wetlands and along
the edges of established trails. All species will be native and appropriate to the existing and
prescribed native habitats being seeding. Seed will be ordered in June and dispersed in late
June to July.

Task 4: Project Management and Reporting
CCES will manage the implementation of proposed tasks for 2013. Jason Husveth (CCES's
Principal Ecologist) will report to and coordinate with City staff, the Lino Lakes Environmental
Board, and the Foxborough Homeowners Association to inform these constituents of work
completed. CCES has budgeted four (6) hours of Mr. Husveth's time to perform this task.
