The Lino Lakes Lions Club is requesting approval of a 1 to 4 Day Temporary On -Sale Liquor License application. The license is necessary to allow the Lions Club to mix and dispense liquor that will be served with the dinner. The application for the license states that it must be submitted to the city for approval at least 30 days prior to the event, however, time does not allow. I spoke with the Minnesota Department of Public Safety, Alcohol & Gambling Enforcement Division and was informed that it is possible, in this case, to fax the application to their office after city council approval. The department would then review it and upon approval return it, via fax, to our office in time for the event. City policy requires a background investigation each time a permit or license application is received. The Lino Lakes Police Department conducted an investigation and found no reason to deny the application. Attached is a copy of the completed application. The property is situated along Rice Creek and is contained in three parcels owned by St. Paul Regional Water Services. It extends from the Lamprey Pass Wildlife Management Area in northern Columbus Township to the I -35W interstate in northeast Lino Lakes. The County is in the process of applying for funding to assist in the acquisition of the property. Currently, it looks favorable for the county to receive funding from three sources: Minnesota DNR Greenways Program, Metropolitan Parks and Open Space Program, and the Rice Creek Watershed District. These sources would provide the financial resources (about $200,000) to purchase the property. ANALYSIS The property in question is among the most pristine, natural open spaces remaining in the seven county metropolitan area. It has been identified as a major greenway corridor by the Minnesota Department of Natural Resources and is on the county biological survey. Acquisition of the property would complete a protected corridor 25 miles in length extending all the way to the Mississippi River. Approximately 192 acres of the proposed acquisition lie within the City of Lino Lakes. The subject properties Iie within a conceptual greenway corridor identified in the City's Comprehensive Plan. Acquisition of the property would therefore help to implement one component of the City's Plan. Tax impacts to the City are negligible given that the property is currently owned by the City of St. Paul. The City's Environmental Board reviewed the request at it's February 26, 2003 meeting and recommended that the Council pass a resolution in support of the project. • RECOMMENDATION: Staff recommends adoption of Resolution No. 03 -38. The applicant is requesting to construct a building addition to accommodate a new sanctuary. The application indicates that the subject property consists of approximately 9.34 acres. The site is 110 zoned R -1 Single Family Residential. Religious institutions are a conditional use within R -1 Single Family Residential District. The site abuts CSAH 10 to the south, Country Lakes Estates (R -1 Single Family Residential) to the west, Reshanau Lake to the North and residential property zoned R -1, Single Family Residential to the east. The application contemplates bidding will commence during the Winter of 2003 IDwith substantial completion of the building addition by Fall 2003. The subject property is zoned R -1 Single Family Residential. Religious institutions are a permitted conditional use within the R -1, Single Family Residential District provided that: (a) side yards shall not be less than fifty (50) feet; Comment: The proposed building addition shall be located 292 feet from the nearest side yard lot line. (b) adequate screening from abutting residential uses and landscaping is provided in compliance with Section 3, Subd. 4.S. of the Ordinance; Comment: The proposed building addition will be adequately screened from the residence located northeast of the site with landscaping including six (6) spruce trees and two (2) sugar maples. (c) adequate off - street parking and access is provided on the site in compliance with Section 3, Subd. 5 of the Ordinance and that such parking is adequately screened and landscaped from surrounding and abutting residential uses in compliance with Section 3, Subd. 4.S. of the Ordinance; and Comment: The off - street parking area will remain substantially the same. The parking spaces have been reconfigured to incorporate two (2) additional designated disabled parking spaces in accordance with the guidelines established by the Minnesota State Council on Disability, resulting a reduction from 91 to 90 total parking spaces. All off - street parking spaces meet the minimum dimensional requirements of Section 3, Subd. 5 of the Ordinance. A wooded area in the southwest corner of the site provides screening of the parking lot from CSAH 10. (d) adequate off - street loading and service entrances are provided and regulated where applicable by Section 3, Subd 6. of the Ordinance. Comments: Additional loading is not indicated by the plans submitted for the building addition. A conditional use permit for the site was previously approved by the City in April 1993. The current application will expand the existing structure but will not alter the use as previously approved. Adequate parking for the proposed building addition is currently available on site and the proposed building addition meets all relevant setback requirements. The site is located less than 1,000 feet from Reshanau Lake, a Recreational Development Lake, and is therefore subject to the provisions of the Shoreland Management Overlay District ( "Shoreland District "). The purpose of the Shoreland District is to provide for the wise subdivision, use and development of shorelands of public waters. The Shoreland District standards are applied in addition to standards set forth in other zoning districts. Access /Site Circulation. Access to the site is provided via an existing driveway along CSAH 10. Preliminary review by the Anoka County Highway Department (ACHD) indicates that turn lanes • Living Waters Lutheran Church Page 3 may be required as a result of the proposed improvements to the site. Any roadway improvements should be subject to comment and recommendation by the City Engineer and the ACHD. City staff is recommending that the site include a separated drop -off area outside of the drive -aisle to prevent vehicle backup upon CSAH 10 and to promote safety and efficient traffic flow throughout the site. In addition, the applicant has agreed to install a striped pedestrian crossing from the designated disabled parking stalls to the sidewalk. Lot Size and Setbacks. All such spaces must be appropriately signed, including designation of one space as "van accessible ". • Living Waters Lutheran Church • Page 5 Landscaping. Section 3, Subd. 4(S) of the Ordinance requires adequate screening from abutting residential uses and landscaping with an emphasis on the boundary or perimeter, the immediate perimeter of the structure and the perimeter of parking and loading areas. The site plan indicates sod surrounding the proposed building addition and planting of three (3) trees, one maple and one evergreen tree east of the proposed building addition and one maple within the courtyard area south of the proposed building addition. The proposed building addition will be adequately screened from the residence located northeast of the site with landscaping including six (6) spruce trees and two (2) sugar maples. Section 2, Subd. 5.D states that only such development as preserves the maximum number of trees may be permitted. The tree preservation plan indicates that two canopy trees (3" maple and 6" maple) and one evergreen tree (4" spruce) will be removed to accommodate the proposed building addition. The applicant is proposing to replace such trees with two - 2%2" maple trees and one spruce tree six (6) feet in height in accordance with the requirements set forth in Section 3, Subd. 4.S.3. In addition, landscaping will include six (6) spruce trees and two (2) sugar maples for screening from the residence located northeast of the site. The Environmental Board has recommended that the sugar maple trees in the plan be changed to red maples or oaks (See Exhibit J). The applicant has agreed to substitute pin oaks for the sugar maples illustrated on the plans. The applicant has also agreed to provide foundation plantings in accordance with the recommendations of the Environmental Board attached hereto as Exhibits J and K. All landscaping shall be in compliance with Section 3, Subd. 4(S) of the Ordinance. CPTED Review. The landscaping indicated on the site plan has been reviewed by the police department and found to be in compliance with CPTED standards. Trash Enclosures. The plans do not illustrate any new or additional refuse areas. The existing refuse area is located within the garage building in accordance with Section 3, Subd. 4.G. of the Ordinance. Signage. The plans do not indicate any new or additional proposed signage. The site plan illustrates a freestanding triangular sign located on the east perimeter of the subject property, north of the entry drive. The location of such sign may be impacted by the addition of turn lanes as determined by the ACHD. Lighting. The applicant is proposing new exterior lighting in the form of wall mounted downlights located at the sanctuary exterior doors. The exterior light fixtures must have a 90 degree cutoff to reduce glare and light pollution. The site plan illustrates a light source located on the east perimeter of the subject property, north of the entry drive. The location of such light source may be impacted by the addition of turn lanes as determined by the ACHD. • Living Waters Lutheran Church Page 6 Utilities. All utilities or construction over existing utility service lines are subject to review and approval by the City Engineer. Grading and Drainage. A grading and drainage plan has been reviewed by the City Engineer (see comments of City Engineer on Memorandum dated January 31, 2003 attached hereto as Exhibit I). The drainage plan must be approved by the Rice Creek Watershed District. Elevations. Pursuant to Section 1102.07, Subd. 2(B), structures must be placed with the lowest floor three (3) feet above the ordinary high water level. The plans indicate that the ordinary high water level for Reshanau Lake is 883.5 feet. The 100 year flood plain lies along the 886 foot contour. The site plan indicates a first floor elevation for the proposed building addition of 896.14 feet. Development Agreement: Prior to the commencement of any site work, the applicant will be required to enter into a development agreement with the City and post all the necessary securities required by it. Conditional Use Permit. As previously indicated, the applicant is requesting approval of a conditional use permit to allow expansion of an existing church structure within the R -1, Single Family Residential District. Religious institutions are conditional uses within the R -1, Single Family Residential District. In considering conditional use permit requests, the Ordinance states that the Planning and Zoning Board shall recommend approval and the City Council shall order the issuance of such permit only if it finds that such use at such location: 1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. Comment: The proposed use is not anticipated to be detrimental or endanger the public. 2. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. Comment: The Comprehensive Plan suggests public /semipublic use of the site. The Comprehensive Plan contemplates churches within the public /semipublic land use designation. Thus, the proposed land use is harmonious with the land use directives of the Comprehensive Plan. 3. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. • Living Waters Lutheran Church • Page 7 Comment: The building design is consistent with material requirements of the Ordinance and therefore will not negatively affect the essential character of the area. In addition, the plans indicate that the building materials for the proposed building addition will match the existing building creating a harmonious exterior appearance. 4. Will be served adequately by essential public facilities and services, including street, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Comment: The site is currently served by essential public facilities and services. The plans do not indicate that the proposed building addition will exceed existing capacity. 5. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. Comment: The building addition is not expected to increase public costs, nor be detrimental to the economic welfare of the community. 6. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. Comment: The use of the subject property as a church has not created any excessive - externalities that are abnormal to the character of the area and there is no reason to anticipate that the proposed building addition will adversely affect the same. 7. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. Comment: As referenced above, the plans appear to indicate a new drop off area located directly in the entrance drive aisle that may cause traffic congestion and vehicle backup upon CSAH 10. City staff recommends providing a separated drop - off area outside of the drive -aisle to prevent vehicle backup upon CSAH 10 and to promote safety and efficient traffic flow throughout the site. In addition, preliminary review by the ACHD indicates that turn lanes may be necessary as a result of the proposed improvements to the site and redesign of the existing church entry drive will be examined. Any roadway improvements should be subject to comment and recommendation by the City Engineer and the ACHD. The applicant must comply with any recommendations of and standards imposed by the ACHD. • Living Waters Lutheran Church • • Page 8 8. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Comment: The proposed building addition should not have a detrimental impact on any features of major importance on the subject property. 9. Will conform to specific standards of this ordinance applicable to the particular use. Comment: The proposed use will, as a condition of approval, meet the applicable requirements of the Ordinance. OPTIONS At their meeting on February 12, 2003, the Planning and Zoning Board considered the site and building plans and conditional use permit application and recommended approval subject to the conditions listed in Resolution 03 -33. In consideration of the request, the following options are available to the City Council: A. Approve the site and building plans /conditional use permit request based upon the findings in Resolution 03 -33 and subject to the conditions in the Resolution. B. Deny the site and building plans /conditional use permit request. C. Table the application and request more information. RECOMMENDATION Staff recommends that the City Council approve the site and building plans /conditional use permit request as outlined in Resolution 03 -33, subject to the conditions in said Resolution (Option A). This water discharges to a ditch that ultimately discharges to a pond in the northeast corner of the property. The Area to the North is designated' as a High - Priority Protection Area in the Lino Lakes Handbook for Conservation Design. Soils in this area are sandy, and pervious. If an infiltration train were designed into the site plan, there appears to be enough separation between the OHW and a .designed rainpondfswail area. The rain pond area must be in an area where the Seasonally high water table is at least 3 feet from the bottom of the pond. Please refer to (Attachment 8). The seasonally high ground -water level should be verified. Peak flow analysis indicates a .23 cfs increase in water volume flow in a two year event, a .32 cfs increase in water volume flow in a 10 year event, and a .36 increase in water volume flow for a 100 year event for the entire site. The basin should be designed if possible to accommodate this extra surface water volume, if not for the entire site. Additional ponding is shown in the turf areas. No surface -water analysis information is available at this time. The soil areas around proposed remaining pervious areas should be protected from compaction during construction. A buffer of native plants incorporated into edges and a surface- water - treatment -train should be planted. Ground story materials should be native in the ponding and drainage areas. All proposed sod areas should have at least 4 inches of topsoil tilled thoroughly into the subsoil as deep as possible. A detailed landscape plan should indicate more foundation plants. Each of the Tots would be accessed from a proposed private roadway lying within a proposed outlot. BACKGROUND In June of 2001 Mr. Keefe contacted City staff requesting information regarding the potential subdivision of his property. Mr. Keefe was provided with the requirements of the R -X, Rural Executive District. In September of 2001 Mr. Keefe met with the City Council to discuss the potential options for subdividing his property. He expressed at the time, in a letter dated September 19, 2001, that he would like to split off several 2.5 acre parcels from his property due to the economic hardship he was currently experiencing. The council expressed the need for additional information before a decision could be made. City staff prepared a memo to the City Council, dated September 28, 2001, identifying issues with regard to the proposed subdivision and listing options to be explored, including the potential for a clustered development using the Planned Development Overlay District (PDO) requirements. The memo was distributed to Mr. Keefe. On December 10, 2002 the City received an application from Mr. Keefe requesting minor subdivision approval. In a letter, dated December 18, 2002, Mr. Keefe was informed that his application was substantially incomplete and listed information that was necessary to begin review of the request. Mr. Keefe submitted additional information on January 6, 2003. • • • On January 8, 2003, at the regular Planning and Zoning Board meeting, Mr. Keefe's minor subdivision request was added to the board's agenda for discussion. The board requested that staff work with the applicant to resolve issues and, if possible place the item on the January 22, 2003 meeting agenda. Staff met with Mr. Keefe and his surveyor on January 16, 2003 to discuss issues relating to the proposal. The minor subdivision request and associated variances were brought to the Planning and Zoning Board on January 22, 2003. Staff's recommendation was to deny the Minor Subdivision and Variance requests. The Planning and Zoning Board tabled the request and recommended that the applicant proceed with a rezoning to Planned Development Overlay (PDO) to facilitate the development. A request for the rezoning to Planned Development Overlay District and Preliminary Plat approval was brought to the Planning and Zoning Board on February 12, 2003. The Planning and Zoning Board recommend approval with the conditions. The City Council approved the First Reading of Ordinance 05 -03 on February 24, 2003 and passed Resolution No. 03 -28, approving the preliminary plat of Keefe Estates on February 24, 2003 with the following conditions: 1. The proposed private road shall be improved to a minimum width of twenty (20) feet and include a permanent cul -de -sac at its northern terminus. The roadway shall be surfaced with gravel or a suitable material and meet a seven ton road design. The roadway section shall be determined by the City Engineer to insure the adequacy of the roadway to support emergency vehicles. 2. A Homeowners Association shall be established to insure the continued operation and maintenance of the private roadway. The association agreement shall be subject to the review and approval of the City Attorney prior to final plat approval. 3. All wetlands on the subject property shall be delineated and shown on the final plat. 4. Public drainage and utility easement shall be dedicated to the city and cover all wetlands on the subject property. 5. An easement for public trail purposes shall be dedicated to the City extending from Rolling Hills Drive to the north property line of the subject property pending further review by City staff. A payment in lieu of parkland dedication shall be required if it is determined that a trail corridor is not feasible. • • 6. The developer shall place a covenant over Lot 1, Block 1 restricting future subdivision of the lot until such time as public sanitary sewer and water is available to service the site in conformance with the City's Comprehensive Plan. Such covenant shall be subject to review and approval by the City Attomey. 7. The developer shall enter into a development agreement with the City to insure completion of necessary roadway improvements. Such agreement shall be entered into in conjunction with final plat approval. 8. The Rezoning is approved. 9. A private ingress and egress easement be provided over Outlot A in favor of the exception parcel located adjacent to the southwest corner of the plat. OPINION Staff is of the opinion that the proposed rezoning to Planned Development Overlay District and associated subdivision are consistent with the policies and requirements of the Lino Lakes Comprehensive Plan, Zoning Ordinance, and Subdivision Ordinance. The proposed development, subject to the requirements of approval, will allow for the subdivision of the subject property while maintaining rural residential densities, preserving open space, and facilitating the implementation of the City's Park plan. With regards to the rezoning the City's Zoning Ordinance requires that the City Council shall consider possible adverse effects of the proposed amendment. Its judgement shall be based upon, but not limited to, the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. Comment: The proposed rezoning is consistent with the City's Comprehensive Plan. The Plan provides for rural clustered subdivisions. The overall density of the development (1 unit per 12.49 acres) is consistent with the minimum rural development density of 1 per 10 acres as specified in the plan. The proposal also allows for future sewered residential development. 2. The proposed use is or will be compatible with present and future land uses of the area. Comment: The proposed use will be compatible with both present and • future land uses. The proposed subdivision is compatible with existing rural residential uses and does not prevent possible future sewered residential development. 3. The proposed use conforms with all performance standards contained herein. Comment: The proposed subdivision, in conjunction with the conditions of preliminary plat approval, will conform to the performance standards contained with the zoning ordinance. 4. The SSR & W property includes 80+ acres in Section 9. The application is to split off 11 acres from an existing 40 -acres parcel, and combine the new 11- acre piece with a one -acre strip that connects to Main St. SSR & W would then sell the new lot to allow for a new home site. Staff understands that Mr. Brad Racutt wants to buy the property and build a new home. The application raised numerous important issues regarding implementation of the long -range plan for the City, as represented in the comprehensive plan. The City Council discussed this application at its work session on November 20, 2001. Staff prepared an option that included the dedication of a partial right of way. Mr. Racutt rejected the option, and both he and Mr. Morton waived the statutory deadlines for City action on the application. On January 9, 2003, we received a letter that rescinded that waiver and re- started the period allowed for City action. On January 21 we received a request for approval of the minor subdivision with the partial easement. The proposal was again reviewed by the City Council on February 11, 2002. City staff, citing issues raised during the revision of the City's subdivision ordinance and possible public safety issues recommended that the application be denied. The City Council tabled the application and requested that it be sent back to the Planning & Zoning Board for further review. • • SSR & W Minor Subdivision page 2 ANALYSIS The land use and zoning are shown in the following table. The comprehensive plan guides the site for low density sewered residential development. That is, the long -range plan for the site and much of its immediate area is to serve it with utilities to allow for residential development. It is in a stage 2 area, so utilities will not be available until after year 2010. There is a conceptual greenway indicated over much of the area. A greenway is an area that may be appropriate as protected open space because of environmental features. Greenways are conceptual because creating them is opportunity based: short of actually purchasing the land, the City must depend on the development proposals submitted. The long -range plan for a road in the area will, at the appropriate time, need to consider the potential for preserving a greenway. Transportation Plan: Main SL Connection and Access Management Recommendations for Planning District 3 from the 2001 Comprehensive Plan include investigating the possibility of an easterly connection to Main St.. The Transportation Plan recommends this connection in the vicinity of the eastern end of Oak Lane and West Rondeau Lake Rd. An access management study was prepared for Main St. by Anoka County and participating cities including Lino Lakes. The study, completed in 1999, recommends a full access intersection at West Rondeau Lake Rd. Because W. Rondeau Lake Rd. already exists, this is a logical location. A road connecting West Rondeau to Oak Lane would fulfill these needs and should be acquired when property on the south side of Main St. develops in the future. Allowing a lot to be created in the proposed location would create an obstacle to the implementation of the City's transportation plan and the growth staging policies in the comprehensive plan. Adjacent Property Access Until recently, the property at 1196 Main St. accessed Main St. via a driveway in the one -acre, "flagpole" piece. The current residents there have explained to staff that it was their understanding that a public road was to be constructed there. For this reason, they oriented their garage to the east, with their driveway connecting to the long driveway that runs to Main St. The fact that the one -acre piece is 66 feet wide seems to indicate that, sometime in the past, someone planned the strip for a road. We have no information indicating that the City has any rights or ownership in the property now. Therefore, access to the strip is a private issue between the two property owners. It is our understanding that the residents of 1196 Main St. have recently constructed a driveway directly onto Main St. because of disagreements with Mr. Racutt over access issues. There have been several police calls to the location because of the disagreements. These incidents strengthen staff's concern regarding public safety issues of an easement and /or driveway serving the two properties. Zoning, Subdivision Requirements Lot Size: The site is zoned Rural, with a minimum lot size of 10 acres with a minimum of 20% upland. The proposal meets these requirements. Frontage: The City's subdivision ordinance requires all lots to have their full frontage on a publicly dedicated street (Sec. 1001.08 Subd. 6(1)). The intent is to prevent flag lots and provide for safe, efficient access and circulation within the City, including adequate police and fire department access. The need for access and circulation exists not only to a particular piece of property, but for surrounding property as well. The proposed minor subdivision does not satisfactorily address this requirement. The original proposal submitted by SSR & W was to dedicate additional right -of- way for Dupont Avenue along the southern edge of the property to provide road frontage rather than along the eastern edge. Staff determined that this was not a viable option given the following: • SSR & W Minor Subdivision page 4 1. Dupont Avenue is another half right of way easement. An existing electric power transmission line easement follows the Dupont Ave. alignment. It would be difficult to convert this location to a road. 2. Dedication of additional right -of -way for Dupont Avenue only would be inconsistent with the City's Transportation Plan which identifies the Main Street to Oak Lane corridor for future circulation needs. • SSR & W Minor Subdivision page 5 PLANNING & ZONING BOARD RECOMMENDATION The P & Z considered the application on November 14, 2001. The P & Z agreed that a road easement along the eastern edge of the property is appropriate but that it be 33 feet instead of the full 66 feet. The other 33 feet would be acquired when and if property to the east develops. OPINION Staff originally recommended dedication of a sixty -six foot wide right -of -way running north -south from Main Street to the existing unimproved Duffee Drive right -of -way. Dedication of this right -of -way was intended to satisfy three issues as follows: 1. It would satisfy the ordinance requirement regarding full frontage on a publicly dedicated street. 2. It would allow for the future implementation of the City's transportation plan that includes a proposed southerly extension of Rondeau Road to Oak Lane. 3. It would address access issues with the property immediately to the west . of the subject property that, at the time, shared a driveway across the applicants property. This recommendation was not supported by the applicant's lot purchaser (Mr. Racutt), the Planning and Zoning Board, nor the City Council. Following further discussions with Mr. Racutt, staff proposed the following: 1. dedication of a 33 foot wide strip of right -of -way along the east side of the property, to satisfy the frontage on a public street requirement and to conform, in part to the City's Transportation Plan. 2. a dedication of 50 feet of right -way parallel to Main Street to provide access to the adjacent residential property to the west, avoiding a new access point onto Main Street and providing Mr. Racutt with a buffer from that property. This option was subsequently rejected by Mr. Racutt and a decision was again postponed. Staff's last recommendation, presented to the Council on February 11, 2003, was to deny the request based on potential legal issues with public right -of -way only open to specific individuals and possible public safety issues. The City Council requested that the application be brought back to the Planning & Zoning Board. However, following additional discussions with the Public • • SSR & W Minor Subdivision page 6 Safety department and the City Attorney staff is requesting council action on the application. By accepting an easement for public right -of -way purposes the City is reserving its right to construct public improvements over, under or across a certain parcel of land. The city is not obligated to open an easement to the public. Nor is it obligated to construct a road or other public improvements within the easement. At the same time the City cannot limit the use of an easement owned by the City to specific persons and exclude others. However, it is important to note that in the case of an easement grant the City does not own the property. The City is only reserving the right to use it for a specific purpose. The owner of the property may continue to use the property provided that such use, within the easement area, does not interfere with (physically or financially) the City's ability to use it for its intended purpose. In regards to this specific property an existing driveway is located within the proposed 33 foot easement area. As such, the use of that driveway to access a housing site would not interfere with the City's ability to construct improvements in the future. Additionally, since the property to the west now has a separate access to Main Street there is no longer an issue with regards to the City limiting the use of the easement to a specific person or persons. The property owner is simply using the existing driveway on his /her property. Additionally, the Public Safety department has indicated that the proposed public roadway extending into the property and /or its use as a private driveway does not create a unique situation for them. RECOMMENDATION It is staff's recommendation that the proposed minor subdivision be approved with the following conditions: 1. A street, drainage and utility easement shall be dedicated to the City. The easement shall include the eastern 33 feet of the subject properties from Main Street to the existing Duffee Drive. 2. A revised survey showing the street, drainage and utility easement and a deed for the easement shall be submitted and reviewed by the City before the City certifies this resolution or any deed or document approving the minor subdivision. The revised survey shall not include additional easement for Dupont Ave. right of way. • 3. Currently, parking is mostly non - existent on EIm Street. A significant amount of the homes front the side streets and the school and church have their own parking lots. A narrower street will be more desirable regarding traffic speeds on the road. This has been discussed at the neighborhood meetings and the residents are in agreement to not allow street parking. The street design is the city's standard width of 32 -feet. As part of the street reconstruction, State Aid must receive a resolution from the City for a No Parking Restriction on EIm Street. MEETING DATE: March 10, 2003 TOPIC: Second Reading: Ordinance No. 08 -03 Amended Zoning Ordinance VOTE REQUIRED: Simple Majority BACKGROUND The revisions to the zoning ordinance resulted from the efforts of the Development Regulations Task Force, city staff, and our planning consultant. The ordinance includes numerous clarifications, codifications of past amendments, expanded requirements, and completely new elements intended to implement the comprehensive plan. The Planning & Zoning Board held a public hearing on the zoning ordinance on January 22 and February 12, 2003. The December 20, 2002 draft was the public hearing draft. Important changes include: • The site and building plan review process will be entirely an administrative function rather than going through P & Z and City Council review. If there is a variance request or appeal of the administrative decision by the applicant, it would be brought though P & Z and Council. This is similar to making minor subdivisions an administrative review. • Planned unit developments normally will be addressed with conditional use permits. A new set of requirements for a PUD is at Section 2, Subd. 10, page 2 -39. The ordinance provides for rural clusters as well as urban residential PUDs. Any mixed -use development will require a PUD rezoning, per Sec. 9, Subd. 3. • Reduced number of categories for accessory building size maximums and increase in the amount of accessory space for small lots (less than 1 1/4 acre). The former maximum was 1120 sf, it has been raised to 1200. • Landscaping requirements have been clarified and updated. Tree preservation requirements for commercial and residential building have been added. • • • • The Central Business District will become General Business, and the CB zone deleted from the ordinance. The Shopping Center district will be deleted, and shopping centers will be conditional uses in the business districts. • A new single family residential zone has been created: R -EC, Single Family Estate Conservation. This allows for "clustering" in a single family zone, but requires that any space saved by using smaller lots must become open space. (Sec. 2, Subd. 3, p.6 -12) The City Council approved the First Reading on February 24, 2003. An updated copy of the proposed ordinance was prepared for the council on February 28, 2003. In addition to housekeeping changes the updated ordinance included the following revisions: • Requirements for traffic impacts on streets adopted for subdivisions were added for conditional use permits (page 2 -6) and site plan reviews (page 2- 29). • Community Development Dept. will provide reports to the City Council regarding site plan reviews (p 2 -28). • Attached garage size maximums: whichever is greater of 1120 sf or house footprint (pp 3 -23 through 3 -28). • Confusing passage on screening of commercial vehicles deleted (p 3 -37). • A single - family lot in a residential zoning district shall not have more than one driveway accessing a public street (p 3 -60). • Sec. 3 Subd. 13, existing farms are permitted uses, retained (p 3 -86). • For cell tower applications, the search radius for other structures will be two miles instead of one mile (p 3 -91). • The concept plan for a planned unit development (PUD) will be voluntary to avoid deadline problems. Various statements have been deleted, starting on page 50. • The NB district is to be retained, not deleted (p 4 -1). • Corrected lot width minimum in R -EC district (p 6 -11). • Requirements added for R -2, R -3, R -4 districts to require that they occur only in the appropriate land use category according to the comprehensive plan, and that city sewer and water must be available (pp 6 -17, 6 -23, and 6 -29). • Clubs and lodges have been deleted from the R -4 conditional uses (p 6 -33). There is a minimal amount of land in the city designated for high density residential use. • Motor fuel stations have been deleted from the NB district (p 7 -4). • Bulk propane sales have been added to motor fuel stations in the LB, GB, LI, and GI districts (pp 7 -22, 7 -41, 8 -12, 8 -34). • Lighted canopy fascia will be allowed at motor fuel stations. Prohibiting this was intended for only the NB district and should not have been included in the LB, GB, LI, and GI districts (pp 7 -19, 7 -21, 7 -38, 7 -40, 8 -9, 8 -11, 8 -31, 8 -33). • • • Outdoor sales Tots are distinguished from outdoor storage (pp 7 -43, 8 -14, 8- 36). • Mini - storage facilities will not be allowed in the LI district (p 8 -6), only in the GI. • Rural cluster deleted from R -BR zone, since it's intended for future industrial development (p 9 -11). • Billboards (advertising signs) removed as interim use from R -BR (p 9 -14). OUTSTANDING ISSUES 1. Should tree service businesses be allowed in the Rural zoning district as a conditional use? The ordinance as it is written allows contractor shops and offices, without outdoor storage of equipment or materials, as conditional uses in the GB district (p 3 -36). The ordinance allows them in the LI and GI districts (pp 8 -3 and 8 -20) as permitted uses without outdoor storage of equipment or materials: such outdoor storage would require a CUP (pp 8 -14, 8 -36). Therefore, a tree service, landscaping, or other similar use is provided for in the new ordinance: in the industrial zones. The City of Hugo allows contractor yards in industrial zones and in a commercial zone that is for land without city sewer and water. Outdoor storage requires a CUP in commercial and industrial zones. Staff is currently surveying additional cities with regard to their requirements and will present this information to the council. 2. The council requested further discussion on Motor Vehicle Parking in Residential and Rural Zoning Districts (Page 3 -73). CLARIFICATIONS 1. Domes: There was a question about whether or not to allow tennis domes, golf domes, and the like. Such uses should be considered a recreational business, a commercial use. Recreational businesses are allowed in the GB and LI districts. A dome would need a conditional use permit because of the height, as regulated by Sec. 3, Subd. 4.C. on pages 3 -16 to 3 -17. In addition to those requirements, the standard CUP requirements would apply (p 3 -6). Staff has spoken with the community development director in White Bear Lake about the tennis dome there. Some people didn't like to see the glowing dome at night. However, it did not cast light on other properties and there were no noise or traffic issues. The issue of whether or not it needed a sprinkler system was difficult. This is a building code issue to be determined by the building officials and fire chief. • • 2. Gymnasiums, Dance Schools: We have been asked where these fit in. They would be considered recreational businesses, which are allowed in the GB and LI zones. 3. Pole Buildings: The confusing passage regarding the expansion of pole buildings has been completely deleted (p 3 -15). Commercial /industrial buildings must now meet the requirements on page 3 -14. 4. Exterior Storage on Residential Lot: The exterior storage of personal property ( "stuff") is indeed adequately addressed in the ordinance, on page 3- 36. Little has changed from the existing ordinance. This item has been discussed this with the City Attorney, and it is staff's opinion that this passage covers the issue. OPTIONS 1. Distributing educational materials and performing outreach to inform citizens about the impacts polluted storm water runoff discharges can have on water quality. Public Participation /Involvement. Providing opportunities for citizens to participate in program development and implementation, including effectively publicizing public hearings and /or encouraging citizen representation on a storm water management panel. Illicit Discharge Detection and Elimination. Developing and implementing a plan to detect and eliminate illicit discharges to the storm sewer system (includes developing a system map and informing the community about hazards associated with illegal discharges and improper disposal of waste). Construction Site Runoff Control. Developing, implementing, and enforcing an erosion and sediment control program for construction activities that disturb 1 or more acres of land (controls could include silt fences and temporary storm water detention ponds. Post Construction Runoff Control. Developing, implementing, and enforcing a program to address discharges of post- construction storm water runoff from new development and redevelopment areas. Applicable controls could include preventative actions such as protecting sensitive areas (e.g. wetlands) or the use of structural BMP's such as grassed swales or porous pavement. Pollution Prevention /Good Housekeeping. Developing and implementing a program with the goal of preventing or reducing pollutant runoff from municipal • • • operations. The program must include municipal staff training on pollution prevention measures and techniques (e.g., regular street sweeping, reduction in the use of pesticides or street salt, or frequent catch -basin cleaning). Implementation of the plan requires issuance of permits, inspections of construction sites, inspections of the Municipal Storm water conveyance system and annual reporting. As such, the City is in need of a system that allows for the efficient tracking of its NPDES compliance measures. City staff has had the opportunity to preview computer software designed for the purpose of meeting the NPDES requirements. The League of Minnesota Cities (LMC) has negotiated a contract with the software vendor, on behalf of the municipalities involved, to provide the ASIST Software to municipalities at a cost of $3,495.00. The original price for the product was approximately $6,000.00 The LMC has indicated however that all requests for the software must be submitted by March 14, 2003 to receive the reduced price. Staff is in the process of determining alternatives to purchasing new software. However, given the deadline, Staff is requesting authorization to purchase the software if no satisfactory alternative is identified. The software purchase would be funded from the City's Surface Water Management Fund. It should be noted that the City previously authorized a $5,000.00 expenditure for participation in the LMC's NPDES Guide Plan development. Of this initial amount $2,000.00 was remitted to the City due to higher than expected municipal participation. COUNCIL ACTION Motion to authorize acquisition of ASIST Software in the amount of $3,495.00. Staff has required adding programming to booster station controls and adding booster pump disconnects and 120 VAC to the flowmeter. The Change Order addresses the change in quantities and bid items associated with the booster station. It is staffs recommendation to approve Change Order No. 1, which results in a total project cost increase of $1,245.00. The total contract amount including Change Order No. 1 is $10,844.00 below the engineer's estimate of $126,500.00. OPTIONS: 1. Return to staff for further review. 2.
