In the subsequent months we contracted with professionals to clean up the mold, upgrade our HVAC system and assess the source of the problem. On May 7, 2003, the City Council received the latest report from the Institute for Environmental Assessment (IAE). According to the report, testing done to date has uncovered potential problems with the building envelope and additional testing is recommended for verification. The cost of the testing is estimated to be $8,000. We are requesting authorization to use $8,000 from the Capital Improvement Program Fund (401) to pay for additional testing to the building envelope of the Civic Complex. OPTIONS: 1. Adopt Resolution 03 -69 Authorizing $8,000 in Expenditures from the Capital Improvement Fund (401) for Additional Testing of the Civic Center Building Envelope. 2. This application includes requests for a Special Event Permit and a Cabaret License. The Council has previously received background information on this item and discussed this matter during the April 23 and May 7, 2003 Council work sessions, as there is currently no event of this type in the City. Staff presented a list of recommended conditions the Council may wish to impose if approval of this event is granted. Option #1 • COUNTY OF ANOKA CITY OF LINO LAKES RESOLUTION NO. 03-70 AUTHORIZING SPECIAL EVENT PERMIT AND CABARET LICENSE FOR STREET DANCE AT MILLER'S ON MAIN FOR AUGUST 15 & 16, 2003 WHEREAS, Miller's on Main has requested permission to conduct a Street Dance on August 15 & 16, 2003, and WHEREAS, the Staff has researched the issues raised by allowing an event of this type in the City and recommended that conditions of approval be attached, and WHEREAS, Chad Wagner of Miller's on Main has submitted an application for a Special Event Permit and a Cabaret License for a Street Dance event to be held on August 15 & 16, 2003, and has agreed to address a checklist of concerns prior to the event (Attachment A), and WHEREAS, Chad Wagner of Miller's on Main has expressed a willingness to be bound to the conditions recommended by Staff (Attachment B), and to work with Staff to address additional concerns which may arise; NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Lino Lakes authorizes Staff to grant a Special Event Permit to Miller's on Main for their Street Dance celebration on August 15 & 16, 2003 and a Cabaret License in conjunction with this event. MEETING DATE: May 12, 2003 TOPIC: Resolution No. 03 -71: Approving the Performance Agreement With Living Waters Lutheran Church VOTE REQUIRED: 3/5 BACKGROUND The City Council approved the expansion of Living Waters Lutheran Church on March 10th of this year (Resolution 03 -33). For all commercial and institutional projects, the City requires a performance agreement to ensure that specific site work is completed. The attached performance agreement addresses the site work for the church addition. For the Council's information, Anoka County has agreed that a right turn lane will be created by striping the existing pavement in Birch St. If the church expands further in the future, the County likely will require reconstruction of the pavement for the turn lane. OPTIONS 1. Approve Resolution 03 -71, approving the performance agreement with Living Waters Lutheran Church. 2. Return to staff with direction. RECOMMENDATION Option 1 • • • CITY OF LINO LAKES RESOLUTION NO. 03-71 RESOLUTION APPROVING THE PERFORMANCE AGREEMENT WITH LIVING WATERS LUTHERAN CHURCH WHEREAS, the City Council approved an amendment to a conditional use permit and a site and building plan for Living Waters Lutheran Church with Resolution 03 -33 on March 10, 2003, and; WHEREAS, Section 2, Subd. 6.E.4. of the Lino Lakes Zoning Ordinance requires a performance agreement for all site plans, and Resolution 03 -33 includes such an agreement as a condition of approval, and; NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby approves the Site Improvement Performance Agreement between the City of Lino Lakes and the Living Waters Lutheran Church and authorizes the Mayor and City Clerk to execute such agreement on behalf of the City. WHEREAS, the Developer has received approval of Site Development Plans, hereinafter called the "Plans ", by the City Council of the City on the 10th day of March, 2003, by Resolution No. 03 -33 (Exhibit A) and in accordance with the Plans all of which are made a part hereof by reference. Developer shall dedicate easements to the City for sanitary sewer, water main, and drainage and utility purposes. D. Developer shall enter into an operation and maintenance agreement for stormwater treatment facilities on the site. II. ON- Sl'1E WORK. A. On -Site Work. The On -site Work shall consist of the improvements described in the approved Plans, to include any approved subsequent amendments, and shall be in compliance with all applicable statutes, codes and ordinances of the City. The Work includes all on -site exterior amenities as shown on the approved Plans and as required by the plan approval, such as, but not limited to: landscaping, private driveways, parking areas, storm drainage systems, water mains, sanitary sewers, hydrants, curbing, lighting, fencing, fire lanes, sidewalks, trails, outside trash disposal enclosures, exterior building architectural design and building elements, site grading, tree preservation work and erosion control measures. Living Waters Church Performance Agreement page 2 • • Such improvements shall be completed in accordance with Section IV herein. B. Cost Estimates. The Developer shall provide the City with a written estimate of all applicable costs of the On -Site Work, itemized by type; the estimates shall be based upon the actual estimates provided by the contractors who are to do the Work. Said cost estimates shall be reviewed by the City, and the City shall establish the actual amount of the financial guarantee. The description and estimated cost of Developer's On -site Work is as follows: Description of Improvements Estimated Costs 1. The activities authorized by site and building plan approval shall be initiated within six (6) months. If such activity is not completed within eighteen (18) months, the City may exercise any remedies as set forth in Section VII., unless an extension is granted by the City. V. GUARANTEE. A. The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Developer's Off -site Work and hereby guarantees the workmanship and materials for a period of one year following the City's final acceptance of the Developer's Off -site Work. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or Irrevocable Letter of Credit, based on one hundred twenty -five (125 %) percent of the total estimated cost of Developer's On -site and Off -site Work. An Irrevocable Letter of Credit shall be for the exclusive use and benefit of the City of Lino Lakes and Living Waters Church Performance Agreement page 3 • • • shall state thereon that the same is issued to guarantee and assure performance by the Developer of all the terms and conditions of this Development Contract and construction of all required improvements in accordance with the ordinances and specifications of the City. The City reserves the right to draw, in whole or in part, on any portion of the Irrevocable Letter of Credit for the purpose of guaranteeing the terms and conditions of this contract. The Irrevocable Letter of Credit shall be automatically extended for additional periods of one year from present or future expiration dates unless thirty (30) days prior to such the City Clerk or Administrator is notified in writing by certified mail that the Letter of Credit will not be renewed. B. The Developer may request reduction of the Letter of Credit, or cash deposit based on prepayment or the value of the completed improvements at the time of the requested reduction. Prior to the final acceptance of the Developer's Improvements the City shall require a Letter of Credit or Cash Escrow to cover the warranty provisions of the agreement. The amount shall be determined by the City Engineer. VI. REIMBURSEMENT OF COSTS. A. The Developer agrees to establish a noninterest bearing escrow account with the City in an amount established by the City Engineer or his designee for the payment of all City fees and costs incurred by the City related to the On -site and Off -site Work, including, but not limited to, the following: 1. Site Plan Review Fee (Existing escrow deficit) $2164.82 2. Administration (Legal, Engineering, Planning, and $2000.00 Contract administration) Total Estimated (Budget) Costs for Escrow Account $4164.82 B. The City shall have a right to reimburse itself from the Escrow. If it appears that the actual costs incurred will exceed the estimate, then Developer and City shall review the costs required to complete the project. In such case, Developer shall deposit additional sums with the City to pay for the agreed upon increase. VII. REMEDIES FOR BREACH A. The City shall give prior notice to the Developer of any default hereunder before proceeding to enforce such financial guarantee or before the City undertakes any work for which the City will be reimbursed through the financial guarantee. If within ten (10) days after such notice to it, the Living Waters Church Performance Agreement page 4 • • • Developer has not notified the City by stating in writing the manner in which the default will be cured and the time within which such default will be cured, the City will proceed with the remedy it deems appropriate. B. At any time after the completion date and any extensions thereof, if any of the work is deemed incomplete, the City may proceed in any one or more of the following ways to enforce the undertakings herein set forth, and to collect any and all expenses incurred by the City in connection therewith, including, but not limited to, engineering, legal, planning and litigation costs and expense. The enumeration of the remedies hereunder shall be in addition to any other remedies available to the City. 1. Specific Performance. The City may in writing direct the surety or the Developer to cause the Work to be undertaken and completed within a specified reasonable time. If the Developer fails to cause the Work to be done and completed in a manner and time acceptable to the City, the City may proceed to bring an action for specific performance to require work to be undertaken. 2. Completion by the City. The City, after notice, may enter the premises and proceed to have the Work done either by contract, by day labor or by regular City forces. The Developer may not question the manner of doing such work or the letting of any such contracts for the doing of any such work. Upon completion of such work, the Developer shall promptly pay the City the full cost thereof as aforesaid. 3. Deposit of Financial Guarantee. In the event the financial guarantee has been submitted in the form of a Letter of Credit, the City may draw on the Letter of Credit the sum equal to the estimated cost of completing the Work, plus the City's estimated expenses as defined herein, including any other costs, expenses, and damages for which the surety may be liable hereunder, but not exceeding the amount set forth on the Letter of Credit. The money shall be deemed to be held by the City for the purpose of reimbursing the City for any costs incurred in completing the Work as hereinafter specified. Any funds remaining after completion of the project shall be returned to the Developer. VIII. OCCUPATION OF PREMISES The Developer agrees that it will not cause to be occupied any portion of the building or improvements to be constructed upon the premises until completion of the building and site improvements as more fully described in the approved plans and following issuance of a Certificate of Occupancy. INSURANCE Developer or all its subcontractors shall take out and maintain until one (1) year after the City has accepted the private improvements, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of the Developer's Work or the Work of its subcontractors or by one directly or indirectly em ployed by any of them. Limits for bodily injury and death shall be not less than Five Hundred Thousand and no /100 ($500,000.00) Dollars for one person and One Million and no /100 ($1,000,000.00) Dollars for each occurrence; or a combination single limit policy of One Million and no /100 ($1,000,000.00) Dollars or more. The City, its employees, its agents and assigns shall be named as an additional insured on the policy, and the Developer or all its subcontractors shall file with the City a certificate evidencing coverage prior to the City signing the plat. The certificate shall provide that the City must be given ten (10) days advance written notice of the cancellation of the insurance. The certificate may not contain any disclaimer for failure to give the required notice. X. REIMBURSEMENT OF COSTS FOR DEFENSE The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this Agreement, or any portion thereof, including court costs and reasonable engineering and attorneys' fees if the City prevails in such action. XI. VALIDITY If a portion, section, subsection, sentence, clause, paragraph or phrase in this Agreement is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Site Improvement Performance Agreement. XII. GENERAL A. Binding Effect. The terms and provisions hereof shall be binding upon and inure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Property and shall be deemed covenants running with the land. B. Notices. Whenever in this Agreement it shall be required or permitted that notice or demand be given or served by either party to this Agreement to or on the other party, such notice or demand shall be delivered personally or mailed by United States mail to the addresses hereinbefore set forth on Page 1 by certified mail (return receipt requested). Such notice or demand shall be deemed timely given when delivered personally or when Living Waters Church Performance Agreement page 6 • • • deposited in the mail in accordance with the above. The addresses of the parties hereto are as set forth on Page 1 until changed by notice given as above. C. Incorporation by Reference. All plans, special provisions, proposals, specifications and contracts for the improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement by reference as fully as if set out herein in full. D. Hours of Construction Activity. All construction activity shall be limited to the hours set out in City Ordinances as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m. Sunday and Holidays No working hours allowed XIII. VIOLATIONSBUILDING PERMITS In the event that Developer violates any of the covenants and agreements contained in this Site Improvement Performance Agreement and to be performed by the Developer, the City, at its option, in addition to the rights and remedies as set out hereunder may refuse to issue building permits to any property within the development and/or stop building construction within the development until such time as such default has been corrected to the satisfaction of the City. This application will have vehicular approaches to the property that are so designed as not to create traffic congestion or an interference with traffic on surrounding thoroughfares. h. This application will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. i. MEETING DATE: May 12, 2003 TOPIC: Resolution 03 -44: Negative Declaration On The Need For An Environmental Impact Statement Eagle Brook Church VOTE REQUIRED: 3/5 BACKGROUND An Environmental Assessment Worksheet (EAW) prepared for the Eagle Brook Church has undergone public review. The City received comments and staff distributed a draft response document on March 19. The City Council discussed the resolution at the work session on April 9 and decided to hold a public hearing. Resolution 03 -44 was pulled from the April 14 agenda to allow for the public hearing. The City Council conducted a public hearing on April 28. The next step is for the City Council to make a declaration on the need for an Environmental Impact Statement (EIS). For reasons discussed in the response document and summarized in this report, staff is recommending a negative declaration: a decision that an EIS is not justified. The responses in the March 18 draft response document should be revised or corrected as necessary before distribution. Several recommended corrections are listed in Attachment A. An amendment to the response to a Met Council comment (page 9) has been added since the April 28 meeting. Additional revisions may be warranted, as directed by the City Council. The decision resolution and the final response document will be sent to all agencies on the EAW distribution list and to everyone who sent in comments on the EAW. ANALYSIS The main issues raised by the EAW or in comments on the EAW relate to the following: heron rookery wetlands traffic and roadways wastewater stormwater management visual issues Minnesota Rule 4410.1700, Subpart 7 lists the criteria to be considered to determine if a project has the potential for significant environmental effects —that is, if an EIS is warranted. Eagle Brook Church May 12, 2003 page 2 4410/700 DECISION ON NEED FOR EIS. Subpart 1. Standard for decision on need for EIS. An EIS shall be ordered for projects that have the potential for significant environmental effects. Subp. 7. Criteria. In deciding whether a project has the potential for significant environmental effects, the following factors shall be considered: A. type, extent, and reversibility of environmental effects; B. cumulative potential effects of related or anticipated future projects; C. the extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority; and D. the extent to which environmental effects can be anticipated and controlled as a result of other available environmental studies undertaken by public agencies or the project proposer, including other EISs. Heron Rookery: The heron rookery on the island in Peltier Lake is a wonderful and important natural resource. While unusual activity is believed to affect the rookery by disturbing the birds, it is impossible to say specifically what has caused the abandonment of nests in recent years. The church building site itself is over 2500 feet from the rookery island. The property on which the church is proposed borders the lake, but the western portion of the property will be left largely undisturbed. The closest construction work would be about 2000 feet from the island. This would include a new stormwater pond, grading, and the onsite septic system. The heavily wooded area along the lake and the wetland within the woods will not be disturbed. The church has expressed interest in participating in a cooperative effort to continue providing nesting forage on the church property. The Minnesota Dept. of Natural Resources stated in its letter that "Based on the DNR's perspective, this project does not require preparation of an Environmental Impact Statement (EIS)." A follow up letter clarifies that the DNR does not say that the project will not result in negative effects: there could be some unforeseen or uncertain outcomes. The scientific literature is not definitive and the DNR believes that the preparation of an EIS would not yield a significant amount of useful information. The DNR is the agency with the greatest expertise on the herons and the rookery. Since the DNR does not believe the project warrants an EIS, there's no reason to require an EIS based on potential impacts on the rookery. Traffic and Roadways: The traffic generated by the proposed church would be greatest on Sundays, with other large events occurring irregularly. The peak generation would be 2240 trips (1120 in, 1120 out). During the week, traffic would be much less. If the site were to develop with single family residential homes, a quick, conservative estimate of traffic generated would be 1300 trips per weekday. The total traffic generation would be higher with residential development. • • • Eagle Brook Church May 12, 2003 page 3 This is not to discount residents' concern over additional traffic. However, additional traffic will occur with or without the church. In fact, the existing transportation infrastructure is inadequate to handle the development planned by the communities of Lino Lakes, Hugo, and Columbus Twp., not to mention possible development in Centerville. Recent discussion of a professional sports stadium and related development in the immediate vicinity represents an extreme case of major infrastructure reconstruction. Clearly, the road capacity issue cannot be resolved by Eagle Brook Church. One of the purposes of an EAW is to identify possible mitigation measures. At a minimum, the City of Lino Lakes, Anoka County, and the Minnesota Dept. of Transportation all must cooperate to address the problem. This also should include Columbus Twp., Hugo, Centerville, and Washington County because they will affect and be affected by the transportation infrastructure in the immediate vicinity of the proposed project. All of these jurisdictions are discussing how to address the roadway issues that are known to all of them and highlighted by this EAW. The proposed church project does not create this problem of inadequate infrastructure. The church project is simply the first one to confront the problem. The next development project will face the exact same traffic issues, but on a day -to -day basis during the week. Such impacts likely would be greater than the traffic generated by the proposed church. The church has proposed the temporary mitigative measure of traffic control personnel at the affected locations: Main St. and 20`h Ave., the freeway ramps, and the entrance to the site. As part of redesigning the site plans, the City and Anoka County will work with the project proposer to examine access options such as access roads rather than just driveways onto 20`h Ave. The solution lies in a cooperative study of the land use in the area and the transportation infrastructure needed to support it. The problem can be corrected through cooperative infrastructure improvements by the numerous regulatory authorities involved in planning the infrastructure. Stormwater Management: Water quality questions are best addressed through the design of stormwater facilities. In the case of the proposed church, the design incorporates numerous elements known as best management practices, or BMPs. These include rain gardens, overland runoff, and swales, as well as native plantings around wetlands and on a large area (40+ acres) of the site intended for prairie grasses. The existing woodlands along the lake will remain undisturbed. The original plan was to leave the existing "ditch" underground. The EAW analysis resulted in a probable redesign to bring the ditch to the surface —to "daylight" it and realign it to improve the ability to maintain flow through the site. This likely will be an • • • Eagle Brook Church May 12, 2003 page 4 improvement over the existing situation, and would be done according to the requirements of the Rice Creek Watershed District. The Watershed states that is has no significant concerns about stormwater management. The grading plan and stormwater management design are subject to review by the Watershed and the City. Thus, the public regulatory agencies with jurisdiction over stormwater management, including the ditch, will address possible impact questions. Wetlands: The several existing wetlands on the site would experience no permanent impacts. The Rice Creek Watershed District, the regulatory agency with jurisdiction over wetlands, states that is has no significant concerns about wetland impacts. The grading plan and stormwater management design will indicate possible wetland impacts. These are subject to review by the Watershed and the City. Thus, the public regulatory agency with jurisdiction over the wetlands will address possible impact questions. Visual: Several comment letters included concerns about the visual impact of lighting and of a tall church spire. The City restricts lighting with provisions in the new zoning ordinance. Lighting must use 90 degree cutoff fixtures (e.g., shoebox type). All applications must include a photometric plan showing the lighting brightness across the property. Lighting can be no greater than 0.4 foot candles at a property line shared with a residential property. The limit is 1.0 foot candles at a road centerline. The other visual issue raised is the proposed 80 ft. spire. As can be seen in the building elevation attached to the response document, the "spire" is a decorative element rising 20 ft. above the pier, which is the tallest part of the actual building (60 ft.). The spire is not a belfry or tower like many churches have. Though the final design is unfinished, the spire may be a cross or simply a lighted element. As with any site and building plan, the specific architectural elements would be examined as part of the review. It is typical for applicants to work out these details in cooperation with the City prior to final approval. Because a church requires a conditional use permit, there would be a public hearing with final approval by the city council. The new zoning ordinance revisions include a change relative to the issue. Previously, the ordinance granted a blanket exemption from height requirements for church spires. The new ordinance exempts church spires up to 60 feet. The possibility of exceeding this remains in the ordinance, through the granting of a conditional use permit. Therefore, the regulatory authority of the City will be used to address the visual impact questions. SUMMARY • • Eagle Brook Church May 12, 2003 page 5 The EAW analyses and the public comments do not raise the potential for significant environmental effects. Possible impacts are not extensive or irreversible, and they can be addressed through ongoing public regulatory authority of various jurisdictions including the City of Lino Lakes, the Rice Creek Watershed District, Anoka County, the Minnesota Dept. of Transportation, and others. Therefore, an EIS is not warranted. OPTIONS 1. Approve Resolution 03 -44 making a negative declaration on the need for an EIS. 2. Return to staff with direction. RECOMMENDATION Open public hearing, take comment, close hearing. If no new substantive information is offered, staff recommends Option 1: approve Resolution 03 -44 • • Eagle Brook Church May 12, 2003 page 6 ATTACHMENT A Corrections to the Draft Response Document Dated March 18, 2003 Recommended corrections to the draft response document are listed below. Page 9: The response to the first comment from the Metropolitan Council should be amended to read as follows: City Response: Minnesota Statutes 473.515, Subd. 3 gives the Met Council the authority to require connection to a public sewer system "wherever reasonable opportunity therefor is provided." The Met Council has rules for the Metropolitan Disposal System. Article III, Sec. 301.01 states a property served by a private sewage system shall connect to a public sewer within 24 months after such a sewer connection is available. In the event that public sewer is available in the project area, it would be best for the church to connect. At this time, there are no proposals to extend public sewer or water to the area. It is always a good idea for any property owner to consider such a future connection when designing a site. The City supports designing for a future connection and will consider this in the review of any application. The City may require a condition of approval, as part of the conditional use permit, that the church connect to a public sewer within 24 months of the public system becoming available. Page 10: The response to the third comment from the Metropolitan Council should be amended to read as follows: City Response: The environment can often benefit from ecological restoration. Ecological restoration may be feasible within the area of the site, and may proposed for greenway by the City's comprehensive plan. Such restoration is a possibility on any property, should the property owner desire it. The City would encourage the removal of exotic species if a property owner wishes to undergo such an endeavor. A trail connection to the regional park reserve has been considered, but a trail on the subject property would not be useful unless it connected through other properties. The City will re- examine the possibility. Page 14: The response to a comment on Item 7, regarding the spire height, should be corrected to include the revised zoning requirements. Water use and wastewater assumptions in the EAW are taken from the preliminary design report. Flow estimates in the report are based on the average daily and peak flows at the current facility. The weekend church service averages 1400 attendees. The average wastewater flow was about 1400 gallons per day, based on metered flows obtained from White Bear Township. This works out to an average of a gallon per day per attendee. The new church, with the possible expansion, would have 2800 seats, which would generate about 2800 gpd. An estimate of peak attendance used a 150% multiplier. This resulted in 4200 gpd peak flow: 2800 x 150% = 4200. (This is explained in the attached information on the proposed onsite septic system.) If a church connects to a public sewer system, it is charged one SAC (sewer access charge) unit for every 275 seats. On this project, this would calculate out to 10 SAC units: 2800/275 = 10.18. Each SAC unit represents 274 gpd of wastewater flow, so 10 SAC units represents 2740 gallons per day. City of Lino Lakes, Minnesota Century Farms Lift Station May 7, 2003 Page 3 Recommended Modifications to Century Farms North Subdivision Development Plans It is recommended that the 140 -foot forcemain, as shown on the existing development plans, be removed and replaced with an extended 15 -inch gravity sanitary sewer. The extended 15 -inch sanitary sewer would extend to the new Manhole No. 16 location as shown on Exhibit "A ". Replacing the longer forcemain with an extended gravity sewer and a short forcemain section has the following benefits: • One short 8 -inch forcemain can be provided in Phase 1 of the lift station construction to serve both the short (2003 to 2007) and long term (Ultimate) service conditions. No future modifications to the 8 -inch forcemain (from the valve MH only) will be necessary when the Ultimate Developed area is on -line. For the short term, the velocities in the forcemain will be below 2 -feet per second. This is not of a concern since the forcemain is so short. • Reduce the pumping head required, thereby reducing pumping costs and energy usage for both the short and long term conditions. Phase 1- Recommended Immediate Needs for Century Farms Lift Station To provide a smooth transition from the Short Term Service Conditions to the Ultimate Service Conditions, it is recommended that the initial construction of the Century Farms Lift Station include the following amenities (See Exhibit "A "): 1. Furnish and install a 10 foot diameter precast concrete structure for containing a duplex submersible pump system, while providing room for a third pump to be installed sometime in the future. Depth of the structure will be approximately 32 -feet deep. 2. For the short term conditions install a 6 -foot diameter precast concrete barrel section inside the 10 -foot structure. The 6 -foot structure will make it feasible to maintain a minimum pump cycle time of 6 starts per hour. 3. Furnish and install a 10 -foot diameter precast concrete valve manhole. The valve manhole will contain two 4 -inch to 6 -inch discharge pipes (with check and plug valves) leading from the lift station. The two discharge pipes will be connected together into a new 8 -inch forcemain that will discharge into the extended gravity system via Manhole No. 16. Provide a blinded tee connection inside the valve manhole for the future connection of a third discharge line leading from a third new submersible pump. 4. Furnish and install two (2) submersible pumps, each having a minimum peak capacity of 180 gpm (at approx. 20.5 feet of head). Each selected pump shall have the capability of having its impeller replaced with a larger one to increase the pumping capacity of the system (without getting a new pump). 5. To more efficiently pump the low sanitary flows during the development of the Century Farms Subdivision, one of the submersible pumps will most likely be a variable speed submersible pump. Projected Future Lift Station Modifications As housing development progresses past the 2007 service conditions, the Century Farm Lift Station will require the following general modifications: 1. As the number of housing units in the service area approaches 400 to 500, increase the pumping capacity of the lift station. This may be accomplished by replacing the existing pump impellers with larger ones. The amount of increased pumping capacity depends upon the specific pump type that is originally selected. 2. As the number of housing units approaches the Ultimate Service Conditions, increase the pumping capacity of the lift station to a peak capacity of 1,000 gpm. This will be accomplished by adding a third submersible pump creating a tri-plex system. The other two pumps may also have to be modified so that if any one of the three pumps fail, the two remaining pumps can maintain a peak capacity of 1,000 gpm. Other lift station modifications for the Ultimate Service Condition include: Setup a temporary bypass prior to beginning the lift station modification work. • With the addition of the third pump, replace the existing pump controls and floats with new systems. • Remove the existing 6 -foot diameter barrel section from the bottom of the 10 -foot diameter lift station structure. • Add a third discharge pipe from the lift station to the 10 foot diameter valve manhole. • Add a new third set of check and plug valves inside the existing valve manhole. The intent is to avoid disturbance of existing residences from construction noise during certain hours. In development agreements on new developments, we have been including a limitation on construction hours that is more restrictive than the City Code. As long as we are putting the stricter hours into the contracts, it makes sense to amend the City Code to be consistent with the practice. The restrictions would not apply to a homeowner doing work on his own home. It is not uncommon to work on a deck or a remodeling project on Sunday or evenings during the week. The intent is to limit activity that would generate more noise than a single homeowner on a home project. Note that this exception does not include building a new house. The construction of a new home is a large project that would generate significant construction noise. The following table summarizes the existing and proposed restrictions. VOTE REQUIRED: 3/5 BACKGROUND: The City of Lino Lakes is currently enforcing the 1997 State Building Code and fee schedule. The state has recently adopted a new state building code. To keep current with the latest revision of the state building code as required, it becomes necessary for the city council to adopt this ordinance. The City Council approved the First Reading of the Ordinance on April 14, 2003. The Second Reading was held on April 28, 2003 and subsequently tabled due to concerns over requirements for sprinkling aircraft hangers. The State Building Code contains some optional chapters that cities may adopt. These chapters include: Chapter 1306, Special Fire Protection Systems Chapter 1335 Floodproofing Regulations Chapter 1306 Chapter 1306 establishes additional requirements for fire sprinkler systems. The new Chapter does lower the square footage thresholds requiring sprinkler systems for several commercial, industrial and institutional type uses. A comparison of requirements of the old and new code, prepared by Centennial Fire Department, is attached. One notable change does require sprinkling of aircraft hangers exceeding 2,000 square feet. This requirement would apply to any hangers constructed in the Lino Airpark or at Surfside. Residential Aircraft Hangars are defined in the Building Code as an accessory building less than 2,000 square feet and 20 feet in height, constructed on a one or two family residential property where aircraft are stored. Such use is considered as a residential accessory use incidental to the dwelling. Aircraft hangars exceeding 2,000 square feet are categorized as a S -1, moderate - hazard storage occupancy. The S -1 category includes uses that due to the size of building and storage characteristics create a greater potential for fire. While the proposed sprinkling requirements • • would have a financial impact on the construction of aircraft hangers it should be noted that the type and size of aircraft that can use the Lino Airpark runway can be accommodated within a 2,000 square foot structure. The Joint Powers Agreement that created the Centennial Fire District requires member cities to adopt the 1306 amendment. The purpose for adopting Chapter 1306 is to provide a higher degree of life safety in our buildings and to hold fire protection costs down in the future. However, there are some options within 1306 that the city may choose. Chapter 1306.0020 requires the adoption of either Subpart 2 or Subpart 3 which determines whether or not existing buildings gets sprinkled when an addition is made. Subpart 2 requires that existing buildings must be sprinkled when an addition is made. Subpart 3 requires that only new buildings or additions to buildings must be sprinkled. The City currently requires that existing buildings be sprinkled when an addition is made. Both City Staff and Centennial Fire District recommend adopting Subpart 2. Chapter 1306.0030 requires the adoption of Option E(1) or E(2) relating to residential occupancies including apartments and townhomes. Option E(1) requires sprinkling of multiple unit residential structures, including attached townhomes, if they are either three (3) or more stories in height or the gross floor area (including garage and basement) exceeds 8,500 square feet. Option E(2) requires sprinkling if the structure is over three (3) stories in height or contains more than 16 dwelling units. Centennial Fire District would prefer the adoption of E(1) because there would be substantially less damage in case of fire to one of these units. City staff is in agreement with Centennial Fire District on this issue. Chapter 1335, Floodproofing Regulations The floodproofing regulations apply to construction, alteration, and repair of any building or parts of a building or structure in a flood hazard area of the city as defined by the Federal Emergency Management Agency (FEMA). The regulations are currently enforced by the city. Staff recommends adoption of Chapter 1335. RECOMMENDATIONS: Staff recommends approval of 2nd Reading of Ordinance No. 10 -03 adopting the 2003 State Building Code and City Fee Schedule, including the following Optional Chapters: Chapter 1306, Special Fire Protection Systems including Option 1306.0020, Subpart 2, and Option 1306.0030, E -1. The code enforcement agency of this municipality is called The City of Lino Lakes. • This code shall be enforced by the Minnesota Certified Building Official designated by this Municipality to administer the code (Minnesota statute 16B.65) subdivision 1. Section 2. Permits and Fees. The issuance of permits and the collection of fees shall be as authorized in Minnesota Statutes, 16B.62, subdivision 1. Permit fees shall be assessed for work governed by this code in accordance with the fee schedule adopted by the municipality in Exhibit "A ". During the first part of 2003, a new Building Code and Fire Code will be adopted by the State of Minnesota. At that time the cities will also be adopting the same codes. There are some optional amendments that can be adopted with the Building Code. One of the options is numbered 1306 which sets up additional fire sprinkler requirements. This amendment will have to adopted with the Building Code. The three cities that make up the Centennial Fire District have all adopted the 1306 amendment to the Building Code in the past. This amendment provides for automatic fire sprinklers in more buildings than the standard Building Code does. The 1306 amendment also requires that existing buildings be sprinlded whenever an addition is made to the building that triggers a sprinkler system. The Joint Powers Agreement that created the Centennial Fire District requires that each of the member cities adopt the 1306 amendment in order to provide a higher degree of life safety in our buildings and to hold fire protection costs down in the future. However there are some options within the 1306 amendment that are the city's choice. The first option is weather or not the existing building gets sprinkled when an addition is made. The 1306 amendment that we presently have requires the existing building to be sprinlded when an addition is made. The Centennial Fire District would like to keep this option as it has worked well for us in the past. The second option has to do with apartments and townhomes. One choice is to sprinkle them when they are 3 or more stories in height or when there are 16 units or more. The other choice is to require sprinkler system whenever they are 3 or more stories in height or when the total building is more than 8,500 sq. ft. in size. The Centennial Fire District would prefer to have the more stringent option because we feel there would be substantially less damage in case of a fire in one of these units. The project is anticipated to include approximately 400 housing units and 200,000 sq. ft. of commercial uses. Under state statutes, this size and type of development requires that an Environmental Assessment Worksheet (EAW) be completed by the city as the "responsible government unit" (RGU). This review looks at how a proposed project could potentially effect the environment and ways to avoid or minimize the impacts before the project is built. The review process includes a multi - agency analysis of the proposed project's environmental effects and a public comment process. SEH has submitted a proposal and timetable for the completion of this EAW. Because traffic impacts from the proposed project will be significant on Lake Drive, SEH will also be completing a separate traffic impact analysis. The developers will be required to submit an escrow of 110 percent of the cost of the EAW and will be sharing the cost of the traffic analysis with developers Lakes Business Park on Lake Drive. Studenski, City Engineer COUNCIL MEETING DATE: May 12, 2003 TOPIC: Resolution No. 03 -67, Authorizing Acquisition of Right -of- Way /Easements, Elm Street Reconstruction Project VOTE REQUIRED: Simple Majority BACKGROUND: Due to the deteriorating condition of Elm Street between Sunset Road and Grey Heron Drive, the City Council authorized the preparation of plans and specifications for the Elm Street Reconstruction project. As part of this project, acquisition of additional right -of -way and drainage /utility easements is necessary for the completion of the street and storm sewer construction. City Staff is requesting authorization for payment of acquisition up to and equal to the amount detailed in the attached appraisal dated April 22, 2003 for a total amount of $153,415.00. OPTIONS: 1. Adopt Resolution 03 -67, Authorizing Acquisition of Right -of- Way /Easements, Elm Street Reconstruction Project. 2. Not Adopt Resolution No. 03 -67. 3. Return to staff for further review. RECOMMENDATION: Option No. 1 - Staff recommends that Resolution No. 03 -67 be adopted. • CITY OF LINO LAKES RESOLUTION NO. 03 -67 RESOLUTION AUTHORIZING ACQUISITION OF RIGHT -OF- WAY /EASEMENTS - ELM STREET RECONSTRUCTION PROJECT. WHEREAS, pursuant to resolutions of the Council adopted May 14, 2001, a study has been prepared by the City Engineer, with reference to the improvement of Elm Street Reconstruction by constructing Street, storm sewer, sanitary sewer and watermain extensions, and WHEREAS, pursuant to resolutions of the Council adopted October 28, 2002, authorizing the preparation of plans and specifications for the Reconstruction of Elm Street, and WHEREAS, the improvement consisting of construction of storm sewer and street improvements is herein determined necessary to provide for safety of the public, and WHEREAS, permanent easements and fee simple interests over certain lands are required to provide for said construction, and WHEREAS, Lino Lakes has authority to acquire right -of -way for said improvements pursuant to Minnesota Statutes. • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1.
