The proposal calls for an expenditure of approximately $8,550, which would come from the general fund budget. As you know, it has been several years since the City updated the copy of its City Code, and therefore most of the current versions are significantly out of date. The City Code codification project has undergone considerable iterations over the years. Some significant new ordinances have been added, and some sections have undergone a complete overhaul. It is important to reflect these Code changes in an updated published volume. The proposal calls for an electronic copy of the Code as well. Bear in mind that the publication of the Code only means that the Code will look different and be produced in a neat, readable format. This is an important step in updating the Code, but updating individual ordinances within the Code will be an ongoing project. The Code has been reviewed by the League of Minnesota Cities for content and several changes will be recommended in order to eliminate some provisions which are outdated or inconsisent with current state law. THE CODIFIER SHALL: (1) Examine the City's prior code of ordinances and all ordinances or resolutions provided by the City which have been passed since the last codification, and determine which materials are to be codified. Incorporate suggestions as made by the League of Minnesota's attorney in the Legal /Editorial Reports of 2/21/03 and 3/8/03. (2) Classify all materials into titles, chapters, and sections, according to subject matter. (3) Simplify language where appropriate to effect uniformity of style and to convert to gender neutral language wherever possible. (4) Organize the code in an easy to use manual which utilizes a numbering system that allows for the easy insertion of future ordinances. (5) (a) Prepare title, chapter, and section headings. (b) Prepare a legislative history for each section, citing the ordinance number and date of passage, as indicated on copies of ordinances supplied to the Codifier. • (c) Prepare a table of contents and sectional analysis for each chapter. (d) Prepare an index (which will be created after the first draft of the Code is submitted). (6) Within four months of the execution of this contract, submit to the city a draft of the code. (7) When the City either returns to the Codifier the draft and /or any additional comments about the draft, it shall be deemed authorization by the City to the Codifier to finish editing and publish the code in final form. Any further changes, additions, or deletions shall be made in the future supplements to the code in accordance with paragraph III (3) of this Agreement. (8) Within two months of receipt of authorization as indicated in paragraph (9), the Codifier will deliver 20 printed copies of the code meeting the following specifications: (a) Type to be single or dual column, at the option of the City. (b) Page size to be 81/2" x 11 ". (c) All copies to be in hard leather -like covered, 3 -ring, loose leaf binders. All binders shall have the City's name stamped in gold and shall contain divider tabs. Page 1 of 5 • (9) Deliver to the City a sample ordinance that can be used to adopt the new code. In addition, upon request, the Codifier will provide a copy of the completed code on computer disk in WordPerfect or Microsoft Word compatible at no additional charge. II. (2) After receipt of the draft described in paragraph I (6), the City shall have 60 days to review the draft and return it to the Codifier. MEETING DATE: November 10, 2003 TOPIC: Resolution 03 -204 Approving Distribution of the Environmental Assessment Worksheet for the Legacy at Woods Edge (Village) Project ACTION REQUIRED: 3/5 vote BACKGROUND The Hartford Group, in conjunction with the City of Lino Lakes, is proposing to develop the City's "Village" Master Plan. The "Legacy at Woods Edge" project is a mixed use development, located in the southeast quadrant of I -35W and Lake Drive (County State Aid Highway 23). The project includes up to approximately 350,000 square feet of retail, service and office uses and 450 multi - family residential units. Also incorporated into the site development is the YMCA. The development, as proposed, does require the preparation of an Environmental Assessment Worksheet (EAW). Rules written by the Minnesota Environmental Quality Board describe the requirements for the environmental review. These rules were written to implement MN Statute 116D, the Minnesota Environmental Policy Act. Environmental review starts with an environmental assessment worksheet (EAW). An EAW is defined as a brief document which is designed to set out the basic facts necessary to determine whether an environmental impact statement (EIS) is necessary. The EAW form was created by the Minnesota Environmental Quality Board (EQB). It is a list of questions that must be completed based on the project specifics. Approving the EAW for distribution does not mean that the City is approving the project. On the contrary, once the EAW process has been initiated, the project cannot be started and no governmental entity can make a final decision on the project until the environmental review process is completed. After the public comment period, the City decides if it has enough information to determine if the project will cause significant environmental effects. If it will not cause such effects, the City makes a "negative declaration" meaning that an Environmental Impact Statement (EIS) is not necessary. If the review process reveals, in the judgement of the City, that the project will cause significant environmental effects, the City makes a "positive declaration" meaning an EIS is necessary. It should be noted that the EAW process does not replace nor eliminate the need for the required review and approval of detailed plans, for a specific project, in accordance with City, County, Watershed District, or State requirements. An EAW is defined as "a brief document which is designed to set out the basic facts necessary to determine whether an EIS is required for a proposed action ". The City retained the services of Short, Elliott, Hendrickson, Inc., (SEH) to prepare the EAW. The City's Environmental Board will be reviewing the document on November 6, 2003. The Environmental Board's recommendation along with any proposed modifications will be distributed to the Council prior to the November 10th council meeting. MEETING DATE: November 10, 2003 TOPIC: PUBLIC HEARING: First Reading, Ordinance No. 22 -03 Vacating Existing Easement Ravens Hollow VOTE REQUIRED: 4/5 BACKGROUND The City Council approved the Ravens Hollow preliminary plat with Resolution 03 -134 on August 25, 2003. There is an easement existing within the area of the plat that should be vacated for the project to proceed as approved by the City. The easement to be vacated is an ingress and egress easement in the north central area of the plat. This was created at the time of the Fox Trace development to provide access to Linda Lane for the lot in the central part of what is now the Ravens Hollow site. There used to be a 66' road easement along the northern edge of the plat, which aligned with 62nd St. The northern 33' was vacated for the Fox Trace development. When that occurred, the central lot south of the easement was landlocked because the remaining 33' is not wide enough to accommodate a road. The ingress and egress easement was created to provide access. Since the property is being developed as part of the Ravens Hollow plat, the easement is no longer needed. A different 33' easement that remains along the northern border of the site should be platted as park on the final plat and dedicated to the City. Since a City trail is already located there, it is logical to make the easement into park land. Since the City then will own the land, there will be no reason to vacate the City easement. However, to ensure that the final plat does dedicate that northern 33', staff is recommending a condition of approval: 1. Ordinance 22 -03 vacating the easement should not be recorded at Anoka County until the final plat is approved with the park dedication. OPTIONS. 1. The City Council approved the preliminary plat for Ravens Hollow with Resolution 03 -134 on August 25, 2003. 2. An easement exists within the area of the plat that is described as follows: A perpetual easement for ingress and egress across that part of Lot 8, Auditor's Subdivision No. 107, Anoka County, Minnesota described as follows: Beginning at a point on the north line of said Lot 8, distant 324 feet west from the Northeast corner of said Lot 8; thence southerly at a right angle to said North line 120 feet, thence westerly at a right angle 100 feet; thence northwesterly to a point on the South line of the North 95 feet of said Lot 8 distant 660.3 feet East of the West line of said Lot 8; thence northerly and parallel to said West line 95 feet to the North line of said Lot 8; thence East to the point of beginning. 3. This easements should be vacated for the project to proceed as approved by the City. 4. The City Council held a public hearing on the vacation on November 10, 2003.
