ALSO PRESENT Planning Consultant Brixius, Acting City

I. CALL TO ORDER AND ROLL CALL:
II. APPROVAL OF MINUTES: Guy Herr made a MOTION to approve
the minutes of the July 12, 1995 meeting as submitted and
was supported by Tom Mesich. All voted aye. Motion
carried.
III. APPROVAL OF AGENDA: Chair Pro -tem Robinson indicated
there were no changes to the agenda.
IV. OPEN MIKE: Chair Pro -tem declared the Open Mike portion
of the meeting opened at 6:41 p.m.
Ms. Nieves Colon addressed the Planning and Zoning Board
regarding the notice she received regarding stock piling
south of Pineridge. Chair Pro -tem indicated this item is
on the agenda and would be addressed later in the
meeting.
Hearing no further comments under Open Mike, Chair Pro -
tem Robinson closed the Open Mike portion of the meeting
at 6:43 p.m.
V. PLANNING ITEMS:
A. 95 -23 -S, Centennial School District, Minor
Subdivision, Elm Street
Planning Consultant Brixius reviewed the request for a
minor subdivision. Centennial School District #12 is in
the process of preparing a bond issue for construction of
a new school on property owned by the District north of
Elm Street.
Mr. Brixius indicated the property to be subdivided is
Zoned R -1 and indicated as single family residential on
the City's 1990 Land Use Map. The property owned by the
School District is Zoned Public /Semi Public and adjoins
the parcels to be subdivided. He noted at some point in
the future, should the bond issued be approved, the

School District will be required to rezone the newly
acquired parcels and obtain a conditional use permit to
allow construction of the new school.
Mr. Brixius indicated staff recommends approval of the
minor subdivision request with the following conditions:
1. The narrow strip of property to the east on
Parcel B should be added to the parcel directly
south of it to avoid confusion should the piece be
split at a future date. These lots are currently
two separate parcels of record owned by Mr. Leonard
Thoeny.
2. The Park Dedication fee shall be waived on this
minor subdivision.
3. Parcel G is not included in this request as it
is a separate parcel of record and no subdivision
is required.
4. After conveyance of land, the School District
will combine all parcels and supply a revised
survey illustrating one parcel.
Chair Pro -tem Robinson asked about the discrepancy of two
feet in the survey. The applicant indicated he is unsure
how the discrepancy occurred, the stakes have been moved
several times.
Chair Pro -tem inquired if the School District will be
utilizing the strip of narrow land. The applicant
indicated they are in negotiation to acquire the land
east of these parcels. Also the School District is
completing acquisition of land to the north near the
industrial park. Chair Pro -tem Robinson indicated the
desire of the Economic Development Committee is to keep
that area industrial.
Mr. Herr inquired if the School District did not obtain
the land to the east, what would they do. The applicant
indicated he was unsure, but believed no one would want
to live in the middle of the school's property. The
School District would own property to the north, east,
south and west of that parcel.
Chair Pro -tem Robinson reiterated the Board's concern
with the parcels being combined into School District
property, due to no street access. The applicant
indicated it would be the desire of the School District
to combine all the parcels.
Mr. Mesich inquired if rezoning would be necessary.

Mr.Brixius indicated when the plan comes into effect the
land would need to be zoned Public /Semi Public.
Currently the City is only looking for legal description
of the land, if buildings are proposed, then the rezoning
would need to be done.
Rick Gelbmann made a MOTION to approve application 95-23 -
S, Centennial School District, Minor Subdivision, Elm
Street with the four stated conditions and was supported
by Tom Mesich. All voted aye. Motion carried.
B. 95 -24 -C, R. Carlson, Conditional Use Permit for
stockpile of dirt south of Pineridqe II and III.
Planning Consultant Brixius briefly reviewed the staff
report outlining the request for a Conditional Use Permit
under Section 4, Subdivision 33 of the Zoning Ordinance.
Mr. Brixius reported the request is to excavate (deepen),
the rear yard swale in Pineridge II and III to allow
lookout style homes rather than the original full
basement ramblers and stockpile the excavated material to
the south for future use. The amount of material to be
regraded and stockpiled is approximately 7,000 cubic
yards.
• Mr. Brixius indicated staff recommends approval with the

following conditions:
1. Side slopes shall not be steeper than a 3:1
slope.
2. Height of the stockpile shall not exceed 6
feet.
3. Side slopes shall be seeded and mulched to
prevent erosion.
4. Stockpile shall be monitored by owner and kept
free of weeds.
Chair Pro -tem Robinson inquired as to how far it would be
from the rear lots to the stockpile. Mr. Brixius
indicated it would be slightly over 100 feet.
Chair Pro -tem Robinson inquired as to how long the
stockpile would be there. Mr. Ted Matke, the applicant,
indicated it would be there for approximately two years,
or until the MUSA line changes.
Chair Pro -tem Robinson inquired what the stockpile would
be used for. Mr. Makte indicated it would be used for
top soil.

• Mr. Mesich inquired as to the current land use. Mr. Maki
indicated the land is unused farm land.

Mr. Herr expressed concern with condition number four, he
wondered how the stockpile would be kept weed free.
Acting City Engineer Powell indicated the condition is in
place to prevent the stockpile from becoming unsightly.
Mr. Brixius indicated this would assure incoming
residents they would not have an unsightly view.
Chair Pro -tem Robinson OPENED the Public Hearing at 7:06
p.m.
Ms. Colon indicated she had received a notice in regard
to this Conditional Use Permit. She indicated she had no
immediate concerns, if the stockpile would be seeded and
cared for. She also noted if it is for the use of the
development she is not opposed.
Ms. Colon expressed concern with any health hazards the
stockpile would propose for the area children, she
suggested there be some restrictions to prevent this.
Ms. Colon encouraged the City to assure that if the
conditions of the Conditional Use Permit are not followed
that there be enforcement by the City. Ms. Neuvez was
concerned with the effect the stockpile would have on the
market value of her home and the surrounding homes.
Chair Pro -tem Robinson CLOSED the Public Hearing at 7:10
p.m.
Acting City Engineer Powell noted he had received a
letter from a resident indicating the hours of operation
had not been observed, the workers were operating outside
the hours of 7:00 a.m. and 7:00 p.m.
Chair Pro -tem Robinson indicated this concern could be
addressed in an additional condition.
Chair Pro -tem Robinson inquired as to when the applicant
would like to start. Mr. Matke indicated as soon as they
have Council approval they will begin, since the seeding
season is coming to an end.
Mr. Mesich inquired if the land had been delineated for
wetlands. Mr. Matke indicated the land had been
delineated and the stockpile will not be near the
wetlands.
Mr. Mesich also expressed concern for condition number
four. Mr. Powell indicated perhaps the condition could
be reworded to state, "vegetation consistent with

surrounding vegetation ".
Rick Gelbmann made a MOTION to approve Application 95-24 -
C, R. Carlson, Conditional Use Permit for stockpile of
dirt south of Pineridge II and III with the following
conditions:
1. Side slopes shall not be steeper than a 3:1
slope.
2. Height of the stockpile shall not exceed 6
feet.
3. Side slopes shall be seeded an mulched to
prevent erosion.
4. Stockpile shall be monitored by owner and
vegetation kept consistent with surrounding
vegetation.
5. Hours of operation 7:00 a.m. to 7:00 p.m.
Monday through Friday, 8:00 a.m. to 5:00 p.m.
Saturdays, with no work on Sundays, be adhere to.
Tom Mesich seconded the motion. All voted aye. Motion
carried.
VI. DISCUSSION: A work session was set for September 1, 1995
at 7:00 a.m. Chair Pro -tem Robinson requested a reminder
notice be sent to the Commissioners.
Chair Pro -tem Robinson indicated he had seen a stockpile
on the corner of Hodgson Road and Birch. Mr. Powell
indicated he has been investigating the issue and has
contacted the Forest Lake Contracting regarding a
Conditional Use Permit. He noted he also contacted Ms.
Wyland regarding the issue.
VII. ADJOURNMENT: Tom Mesich made a MOTION to adjourn the
meeting 7:20 p.m. and was supported by Rick Gelbmann.
All voted aye. Motion carried.
