ALSO PRESENT : Planning .Consultanit K rmis, Planning Coordinator Wyland APPROVAL OF MINUTES: Ed Schones made a motion approving the minutes of the July 13, 1994 meeting as submitted and was supported by Al Robinson. All voted aye. Motion carried. Rick Gelbmann abstained. APPROVAL OF AGENDA: Item VI B pertaining to Behm's Century Farms has been withdrawn. OPEN MIRE: No one was present to address Open Mike. PLANNING ITEMS: A. 94 -21 -V, St. Joseph's Church, Elm Street, Sign Variance Planning Coordinator Wyland reviewed this request which is to allow the construction of an institution identification sign, 96 square feet in area. The Code allows 24 square feet in area, therefore, the variance is for 72 square feet of sign. The staff has recommended denial for the reasons outlined in the staff report dated 9- 12 -94. Fr. John Fitzpatrick was present and indicated that there are 1600 families in the growing Parish, 6,000 individual members. There are 10 - 15 new families per month and the church would like a directional sign, on the freeway, to direct them. The church does not have visibility on a major roadway and has asked the County and State for permission to put up direction signs on Elm Street and Lake Drive - but they have been denied. The proposed sign could be a temporary thing because the church is anticipating expansion that would include a steeple or tower that could provide a visual directional symbol for the church. Dan Lasch was also present and indicated that the sign could be temporary and removed in 5 years. • He also stated that the height would be approximately 13'. Mr. Kirmis advised the Planning & Zoning Board that a Variance is 1 • • • PLANNING & ZONING BOARD MINUTES SEPTEMBER 14, 1994 granted as an ongoing development right and should be based on unique characteristics with no time frame. Al Robinson stated that he felt it was important for the church to have the sign due to their limited visibility. The only visibility the church has is from the freeway. A 24 square foot sign would not work. Tom Mesich agreed with Mr. Robinson and stated that a variance had been granted for a sign to FINA - why not the church. There is a unique circumstance here. Chairman Schaps stated that we should be directed by the Ordinance which calls for a 24 square foot sign. Mr. Schones agreed with Mr. Mesich and Robinson that this particular request did not seem unreasonable. After further discussion Mr. Schones made a MOTION and was supported by Al Robinson to approve the variance as requested with the condition that a sign permit be obtained, the sign be at least 10' from the property line, and the height not exceed 14'. All voted aye. Motion carried. B. 94 -22 -S, Anoka County Detention Center, 4th Ave. & Lilac, Site Plan Review Planning Coordinator Wyland reviewed this request which is a site plan review for the Anoka County Detention Center on 4th Avenue and Lilac. The property currently contains two juvenile detention cottages and a juvenile shelter. The request is to construct a 60 bed medium secure facility to house adult county prisoners serving terms of less than one year. Staff would recommend approval with the following conditions: 1. Proper building permits be obtained prior to construction. 2. Arrangements for sewer and water assessments be made prior to issuance of any building permits. 3. Landscaping be as outlined on the plans. 4. Parking as provided on the plan and ADA approved. 5. Utility services as approved by the City Engineer. A question was asked as to what type of criminal would be housed in the facility. Mr. Jerry Schoma indicated that there are three types. Those awaiting trail are housed in the main jail in Anoka. Those being punished but not "unsafe" will be housed in this proposed facility - they are 65% traffic violators, others are property damage crimes. The third type are federal prisoners who are jailed in Anoka. This particular facility will be between a minimum and maximum security facility. Most offenders will be serving 30 - 60 days. Mr. Schoma further explained that there is no tax revenue generated from this facility. Funding will be coming from the Federal Government via a prisoner exchange program and from the County. Mr. Schones stated that he appreciated the look of the facility - it is not "prison" looking. Mr. Landers then made a MOTION and was supported by Mr. Gelbmann to approve the request with the conditions outlined by the staff. All voted aye. Motion carried. 2 PLANNING & ZONING BOARD MINUTES SEPTEMBER 14, 1994 • C. 94 -23 -P, Boe Ornamental, 484 Lilac Street, Minor Subdivision Planning Coordinator Wyland reviewed this request which involves the subdivision of Lot 3, Block 2, Lino Industrial Park into two parcels which are then to be added to Lots 1 and 2, Block 2, Lino Industrial Park. The staff has recommended approval of this minor subdivision request. • • After some discussion Al Robinson made a MOTION and was supported by Tom Mesich to approve the minor subdivision as submitted with the condition that the newly created lots be added to Lots 1 and 2, Lino Industrial Park. All voted aye. Motion carried. DISCUSSION: A. Accessory Building Ordinance: Mr. Kirmis reviewed a staff report, dated September 1, 1994, concerning Accessory Buildings. A comparison was made between the Lino Lakes ordinance and the ordinances of the City of Hugo, Lake Elmo and Circle Pines. Staff recommendation included three options: 1. No policy change 2. Expansion of the 1 1/4 - 2 1/2 acre standard to include lots 1 to 1 1/4 acre in size. 3. Adoption of a new standard, similar to that employed by Circle Pines as outlined in the staff report. Tom Mesich asked why Hugo, Lake Elmo and Circle Pines were used as comparisons - why not Columbus Township, Blaine, and Forest Lake. He indicated that he would like to see the 1 1/4 limitation dropped down to one (1) acre. Mr. Schones stated that this is a tough question and suggested that we leave the ordinance stand as it is. He indicated that he likes the open spaces, he does not want to have to look at a neighbors 800 square foot storage building. He also suggested tougher enforcement on people with junk vehicles, etc. in their yards. Kathy Nordine stated that in Washington County, when a property is subdivided and their are outbuildings on the site they must be removed as a condition of the subdivision. The City could consider a similar requirement if the concern is for future subdivision of properties with larger outbuildings. She added that the existing ordinance seems to be fairly lenient. Al Robinson stated that this has been an issue for many years. We are between a rock and a hard place and should be able to come up with some type of compromise. Maybe we should look at our neighbors - Circle Pines, Columbus and Forest Lake. Chairman Schaps suggested the Board give this matter some more thought and possible review could be incorporated into the growth study. Mr. Neil Banta was present and advise the Board that Forest Lake 3 • • • PLANNING & ZONING BOARD MINUTES SEPTEMBER 14, 1994 allows two accessory building totalling 1500 square feet. Columbus has no limit other than 1200 sq. ft. on an attached garage. Shoreview allows a total of 1500 square feet. Tom Mesich indicated that he would like some input from the Building Inspector. This item will be continued to the next meeting. ADJOURNMENT: Upon the unanimous consent of the Board the meeting was adjourned at 8:15 p.m. 4
