I. Call to Order and Roll Call:
II. Approval of Minutes:
Mr. Gelbmann moved approve of the minutes of the December 9,
1992 meeting and was supported by Mr. Launders. All voted
aye. Motion carried.
III. OPEN MIKE: No one was present to speak at Open Mike.
IV. ACTION ITEMS:
92 -44 -P, Preliminary Plat, Woods of Baldwin Lake, C. Rehbein
Chairman Schaps opened the Public Hearing. Mr. Brixius
explained that this is a request to plat 16 lots on a 10.16
acre parcel of property zoned R -1X. The site is just south of
Baldwin Lake and north of Woodridge Estates. Utilities are
available to serve the property and with some minor
modifications the plat meets the requirements of the
Ordinance. Staff would recommend that the easterly Lot 1 be
dedicated for Park purposes as they have been unsuccessful in
securing park property elsewhere in this vicinity.
Mr. Jeff Knutson was present representing the applicant, Clyde
Rehbein.
Several property owners were present to voice their concerns.
Mr. Dave Jenkins of White Pine Road stated that he objected to
any home being built on Lot 1 and was in favor of the lot
becoming a neighborhood park. He added that Lots 3, 4, and 5
contain very old mature oak trees and that he would not be in
favor of any of these trees being removed.
Mary Johnson of White Pine Road stated that she was
representing 60 residents who had signed a petition calling
for a park in this area. She indicated that they felt the

park on Lot 1 was a good plan. She also expressed concern
about the elevation of the land on Lots 3, 4, and 5 and would
not like to see any clear cutting of the trees.
A resident asked if staff was aware of the current wetland
rules and regulations.
C. Gromek of 145 Woodridge was not in favor of any buildings
on Lot 1 and agreed that a park for this site was a good idea.
Dale Edlund of 139 Woodridge asked what kind of park this
would be and if there would be any trails in the area.
Robert Hanson of 6325 Baldwin expressed concern about the road
cutting through a wetland.
Neil Anderson, 132 Woodridge, asked if Oakwood Street would be
constructed.
Paul Connoy asked if consideration had been given to providing
a park to the south /west of this plat.
Judy Coccia advised the staff and P & Z that the last building
site in this area on White Pine Road was clear cut prior to
construction. She felt the tree preservation program was not
very effective in this case and would hope that better care is
taken in the future.
In response to the above questions, the audience was advised
by Al Brixius that the City does have a tree preservation
program that would help preserve the mature trees. A site
drainage and grading plan will need to be provided and
approved by staff to insure proper grading - this plan would
address the slope off White Pine Road, the wetland, ponding
areas, etc. Mr. Schneider advised the audience that staff
is aware of the wetland rules and regulations which will have
to be adhered to in relation to the plat and that permits will
be required from other agencies having jurisdiction in this
area including the Rice Creek Watershed District and the
DNR /Corp of Engineers. All these items will be addressed
prior to final plat approval. The wetland rules and
regulations do provide for the construction of streets however
and some mitigation may be allowed. The design of the park is
in the hands of the City's Park Board but will most likely be
a low impact, mini park as described by Ms. Johnson. Mr.
Schneider explained that Oakwood Street is planned for
construction as it was when Woodridge Estates was platted.
Mr. Jeff Knuston stated that they would hope to begin
construction in the spring but much work needs to be

accomplished before then - this is merely the preliminary
plat.
Diane Jensen of Oakwood Lane stated that the neighborhood is
interested in working with the Park Board and very interested
in obtaining a neighborhood park in this vicinity.
The audience was advised that this matter must be sent to the
Park Board for their review on February 1, 1993, and will then
be forwarded to the City Council on February 8th.
After some discussion Tom Mesich made a MOTION recommending
approval of the preliminary plat with the conditions outlined
in the Planners Report 1 -5 and Condition 6 recommending that
the City Forester insure tree preservation in this plat and
Condition 7 that the developer obtain necessary permits from
the Rice Creek Watershed District and the DNR /Corp. of
Engineers. Mr. Gelbmann seconded the motion. All voted aye.
Motion carried.
Chairman Schaps encouraged the neighborhood group to continue
working with the Park Board and asked that the neighborhood be
advised, through the park development group, of plans for
developing the park.
92 -52 -CUP, Rehbein Transit, 6298 Hodgson Road
Mary Kay Wyland reviewed this request which is to allow the
stock piling of dirt on General Business & Residential
property at 6298 Hodgson Road. The property owner would like
to stock pile this dirt for approximately three (3) years.
The dirt came from the Co. Rd. J. project, is clean fill (most
of it is peat) and will be sold over the next few years.
There will be no pulverizing of the dirt. Staff has
recommended approval with the conditions outlined in the staff
report.
Mr. Mesich asked why the dirt was already on the site and Mr.
Rehbein explained that he had not realized he needed a permit
since his property is zoned general business. In response to
a question from Mr. Landers, he explained that no more dirt
will be coming in, they may be hauling out on Saturdays, but
not on Sundays. John Grundhoefer of Linda Avenue was present
and was concern if additional dirt were to be brought in. Mr.
Rehbein explained that he will not be bringing in any more.
Mr. Robinson then made a MOTION recommending approval of the
Conditional Use Permit with the following conditions:
1. A grading plan shall be submitted indicating how the

applicant intends to maintain stable slopes that will not
erode from wind and water. This plan shall also show
plantings with rye grass or similar material to protect
the surface. A final planting plan shall be included
that shows how the site will be restored when stock piles
are depleted.
2. The fill shall be allowed to remain on site until
January of 1997 at which time the permit shall become
null and void unless an extension of time has be
requested by the applicant.
3. Other erosion controls may be imposed if upon spring
inspection of the site a determination is made that they
are necessary.
4. Proper permits must be obtained from the MnDOT.
5. No additional fill will be allowed on the site.
Mr. Landers seconded the motion. All voted aye. Motion
carried.
92- 53 -ACUP, NSP, Old Birch Street by Radio Tower(s)
Mary Kay Wyland reviewed this request which is to construct a
16 x 16 communication building, LP tank, and generator on the
property currently containing the 500' radio tower. An
amended conditional use permit is required as there is an
existing permit on the site. Staff would recommend approval
with the conditions outlined in the staff report.
Three representatives were present from NSP including Ron
Obermueller, Dave Schwartz, and Mike Marzatell. They
explained that the proposed building is approximately 300'
from Birch Street and is one of eight sites being used for 2-
way radio communication. The 6' fence surrounding the site is
planned to be topped with three strands of barbed wire. Mr.
Brixius explained that barbed wire is not a permitted use in
a residential district. In regard to the exterior of the
building - Mr. Obermueller stated that they could use a brick
fascia for aesthetics if necessary.
Mr. Gelbmann made a MOTION recommending approval of the
request with the following conditions:
1. Proper building permits be obtained prior to
construction.
2. Exterior be brick.

3. Conditions and /or restrictions of original permit
issued in 1973 be adhered to in addition to those
outlined here.
4. An 8' cyclone fence be installed around the facility.
Mr. Mesich seconded the motion. All voted aye. Motion
carried.
92 -54 -P, Glen Rehbein, 7317 & 7319 Lake Drive, Subdivision
Mary Kay Wyland reviewed this request which is to split a one
acre parcel from the remaining 4.81 acre parcel. The property
is zoned Light Industrial and the smaller parcel is intended
to be sold to D and E Sales, the current occupant. Staff
would recommend approval of the request with the conditions
outlined in the staff report.
There was some discussion by the Planning & Zoning Board
concerning condition No. 3 stating that the property owner
would waive any rights to petition against the extension of
utilities. Mr. Schneider explained that this was standard
procedure when unserved property is subdivided and necessary
due to the limitations of the City Charter. The P and Z
wanted to know if the future property owner agreed with this
condition. After some discussion Mary Kay was asked to
contact B and E Sales, explain the condition, and obtain their
response.
Mr. Landers made a MOTION recommending approval of the
subdivision with the following conditions:
1. Parcel A contain a minimum of 1 acre in size and 150'
of lot frontage on Lake Drive.
2. Additional right of way as required by MNDOT be
dedicated.
3. Property owner(s) and subsequent property owners sign
a petition waiving their right to petition against the
extension of utilities to serve these properties. (if
the property owner objects to this requirement the P & Z
would table the request until their February 10th meeting
- if the property owners have no objections to this
requirement then it will be forwarded to the City
Council)
Mr. Mesich seconded the motion. All voted aye. Motion
carried. NOTE: Mary Kay Wyland contacted the potential
property owners following the meeting and they indicated that

they did not object to Condition No. 3.
ORDINANCE NO. AMENDMENT TO VARIOUS SECTIONS OF THE CITY CODE
PERTAINING TO THE DEFINITION AND REGULATION OF PRIVATE STREETS
Planning Consultant Brixius asked if the Public Hearing on
this item could be continued until the next meeting of the P
& Z. Mr. Robinson made a MOTION to continue the Public
Hearing and was supported by Mr. Mesich. All voted aye.
Motion carried.
ORDINANCE NO. AMENDMENT TO SECTION 1001.09 OF THE CITY CODE
PERTAINING TO PLAT STAGING
Chairman Schaps opened the public hearing on this Ordinance
amendment. There were no comments from the public. The
hearing was closed. Mr. Mesich made a MOTION and was
supported by Mr. Robinson to adopt the Ordinance as proposed.
All voted aye. Motion carried.
V. DISCUSSION ITEMS:
A. Handicapped Parking - update
Mr. Brixius explained that the City Council will be holding a
work session to discuss the new handicapped rules for 1983.
It was the general consensus from Staff that the City should
take the lead in applying these new rules.
B. Private Park - update
Mr. Brixius explained that he is working on an amendment to
the base zoning districts that would address private parks.
He should have something for the P & Z by the next meeting.
