I. CALL TO ORDER AND ROLL CALL: Vice Chairman Robinson
called the meeting to order and asked for Roll Call.
II. APPROVAL OF MINUTES: John Landers moved approval of the
minutes of the June 9, 1993 Planning & Zoning Board
meeting and was supported by Tom Mesich. All voted aye.
Motion carried.
III. OPEN MIRE: No one was present to speak under open mike.
IV. ACTION ITEMS:
93 -9 -P, Behm's Century Farms, Subdivision
Mr. Brixius explained that, at the P & Z's direction, he
had prepared Findings of Fact relating to this
subdivision and the Board's recommended denial of the
request. However, staff has received a letter from the
applicant, Mr. Gary Uhde, requesting that the item be
continued until the August 11, 1993 meeting of the Board.
Mr. Brixius recommended that if any items changed from
the original request that a new public hearing including
notification of property owners be held.
Mr. Schones made a motion continuing the public hearing
on the Behm's Century Farms until the August meeting as
requested by the applicant. Mr. Landers seconded the
motion. All voted aye. Motion carried.

93 -5 -P, Oaks of Lino, Aspen Lane Subdivision
Mr. Brixius explained that this case involves a request
to plat 11 R -1, single family lots on 9.32 acres of
property. Several concerns were raised in the Planner's
Report including the provision of sufficient lot area,
width, and depth above the 100 year floodplain elevation.
Additional information is needed from the Developer
concerning these questions, therefore, staff is
recommending that this item be tabled and the Public
Hearing continued until the August 11, 1993 meeting of
the P & Z.
After some discussion, Tom Mesich made a motion
recommending the item be continued to the August meeting
of the P & Z and was supported by Kathy Nordine. All
voted aye. Motion carried.
93 -12 -P, Francis Lichtscheidl, 582 Main Street, Subd.
Mary Kay Wyland reviewed this case which involves a
request to split off a 1.93 acre parcel from the
remaining 37 acres. The property is Zoned R -1 and
located within the MUSA. In 1985 the P & Z and CC
approved a subdivision for this site which split off 5
acres containing the homestead from the balance of the
site. This subdivision, however, was never recorded due
to problems within the family. Now the larger parcel is
for sale and the family wishes the homestead to remain
separate. Staff has advised the applicant to record the
5 acre subdivision previously approved as the 1.93 acre
split is not currently allowed by the ordinance. A 10
acre minimum is required where property is not served by
utilities.
Mr. Lichtscheidl was present and stated that the family
has agreed to the 1.93 acre split which would allow his
sister to remain on the homestead. They could not agree
with the 5 acre split as it would cut into the larger
parcel which they hope to sell for development purposes.
After some discussion, Mr. Robinson suggested that Mr.
Lichtscheidl record the 5 acre split with a separate,
private, agreement for the 3 acres that would go with the
larger parcel and be incorporated into it when that piece
is further subdivided. This arrangement could not be
sanction by the City but it is possible that a private
agreement could be reached with a future purchaser. Mr.
Robinson further explained that the P & Z can only
approve a 10 acre split as the 1.93 is contrary to the

Ordinance requirements. Mr. Schones then made a MOTION
and was supported by Mr. Mesich to deny the request as
submitted and encourage the applicant to record the 5
acre split previously approved. All voted aye. Motion
carried.
93 -13 -ACUP, Northern Instrument, 6680 Hwy 49, Amended
Conditional Use Permit
Mary Kay Wyland reviewed this request which is to
construct a 40 x 74 building addition to enclose the
existing shipping and receiving area. The property is
Zoned GB, General Business, and an Amended Conditional
Use Permit is required according to our Site Plan Review
Ordinance because the proposed exterior is metal clad.
Staff has reviewed this request with the Building
Inspector and Fire Chief and would recommend approval
with the following conditions:
1. Proper building permits be obtained prior to
construction.
2. Permits be obtained from Rice Creek Watershed
District, if necessary.
3. The exterior of the structure blend with the existing
building.
After some discussion Ed Schones made a motion
recommending approval with the conditions indicated above
and was supported by John Landers. All voted aye.
Motion carried.
93 -14 -P, St. Joseph Cemetery, 171 Elm St., Subdivision
Mary Kay Wyland reviewed this request which is to combine
three existing parcels of property containing the St.
Joseph Cemetery, and file a "Hardshell " copy with the
County. The purpose of this subdivision is to allow the
church to officially dedicate the cemetery property.
Staff has reviewed the request and would recommend
approval. Tom Mesich made a motion recommending approval
and was supported by Ed Schones. All voted aye. Motion
carried.
V. DISCUSSION ITEMS:
A. Kathy Nordine asked that the Planning & Zoning Board
consider reviewing the existing parking regulations and
modifying them to restrict parking of vehicles on
residential lots to front yard driveway surfaces or some

similar arrangement. This item will be placed on the
work session agenda.
