Approval of Minutes: Al Robinson moved and was supported by Rick Gelbmann to approve the minutes of the October 14, 1992 meeting as submitted. All voted aye. Motion carried. III. Open Mike: No one was present to speak at Open Mike. IV. ACTION ITEMS: 92 -46 -Z, Roy Mastel, Rezoning Mary Kay Wyland reviewed the staff report which indicated that this item had been reviewed at the October 14, 1992 meeting of the P and Z and also at a P & Z Work Session on November 4th, 1992. The Staff Report reviewed the criteria involved in the request and advised that this is a policy matter to be determined by the P & Z and the City Council. Conditions were suggested should the item be approved. Mr. Bob Erickson of 345 Lilac Lane was present and asked what spot zoning was. Mr. Brixius, Planning Consultant, explained. Mr. Erickson then stated he failed to see why spot zoning was a criteria in this case. He felt the rezoning of the Molin site would jeopardize his property. He will have problems selling his house in the future and the value will be reduced if this rezoning is allowed. Chairman Schaps explained that the property surrounding his is already zoned General and Light Industrial. Mr. Erickson added that the trees are not a sufficient buffer. III PLANNING & ZONING BOARD 2 NOVEMBER 12, 1992 Mr. Tom Christianson, 339 Lilac Lane, stated he agreed 100% with Mr. Erickson. He asked why there could not be some type of conditional zoning of the site. Mr. Brixius explained that a conditional use was not an option. Brad Lindgren, 388 Thomas, asked why there could not be some type of permit issued rather than a rezoning. Mr. Brixius explained that Mr. Mastels' use of the property is not an allowable conditional use in a residential district. The property is screened and buffered by the ditch and residential use would not seem to be a good use of the corner piece of property. Mr. Tom Meisch stated that he agreed with Mr. Brixius, and added that an office building on this corner property may be more appealing to look at than Molin Concrete. Mr. Gelbmann explained that any construction on the site would require site plan review before the P & Z and City Council. After some discussion Al Robinson moved approval of Option 1 approving the rezoning of the south 175' of Parcel 15 and Parcel 16 (Molin Property), Section 7 -31- 22-44 from R1 Residential to LI Light Industrial with the condition that a 40' wide landscaping buffer of evergreens (Spruce) 8' tall and 10' on center be provided between the new commercial property and the residential area to the west. John Landers seconded the motion. All voted aye. Motion carried. 92 -48 -P & 92 -49 -CUP Living Waters Church, Birch Street Planning Consultant Brixius reviewed this request which is for a simple subdivision and a Conditional Use Permit to allow construction of a Church in a Residential District. Numerous concerns were outlined in both the report from the Consultant and the Engineer's Report. The general staff consensus was that the use was appropriate for the site, however, final engineering and construction plans need to be developed and reviewed before the conditional use permit can be granted. The applicant was present and indicated that the conditions listed in the staff report were not a problem and that they were willing to work with staff on resolving the issues raised. They understood that the plans submitted were preliminary and that more details would be necessary. The church has also agreed to • PLANNING & ZONING BOARD 3 NOVEMBER 12, 1992 • • dedicate a trail along Birch Street and work with the staff concerning a trail along the lake shore. One concern expressed by the applicant involved moving the east property line so it is perpendicular with the roadway. If this is done, acerage will be reduced and could cause a problem for the site. The church requested action on the subdivision so that they can purchase the property and then develop the final construction plans for later review. Chairman Schaps asked if permission was needed from the Rice Creek Watershed District and /or the Corp. of Engineers. Mr. Brixius stated that the proposed construction meets the requirements of our Shoreland Management Act and would therefore not require review from the Watershed or Corp. However, no drainage plans or grading plans have been reviewed to date and those may need approval from the Watershed or Corp. Mr. Schneider, City Engineer, explained that this property is on the route of a trunk sewer line to the Black Duck pumping station. There also has been interest in development of the property to the west of the proposed church site which would provide for better extension of the overall sewer system in the area. Timing is the key here, the extension of utilities to serve the church would be best accommodated along with development to the west - however, we do not know for certain when this will take place. It is possible the sewer to the east could be used on a temporary basis - either way - utilities are available but the best way to extend them has yet to be determined. Mr. Brixius explained that the P & Z could table the request, or to accommodate the applicant, could approve the subdivision with the condition that final plans be submitted for the conditional use permit. Mr. Schneider stated that since this is a church, and not a developer, the Council may agree with this arrangement. Mr. Robinson stated that if all conditions listed in the staff report are met - he has no problems with the request. Mr. Brixius added that the staff's idea of compliance may differ from the applicant's, however, the use is appropriate for the site. After some discussion Tom Mesich made a motion recommending approval of the subdivision with the following conditions: 1. Submitted lot lines are acceptable • PLANNING & ZONING BOARD 4 NOVEMBER 12, 1992 • 2. 10' drainage & utility easements be provided as required by code. 3. Anoka County be consulted regarding dedication of R -O -W for Birch Street. 4. Subdivision not be recorded until the church has closed on the purchase of the site. Al Robinson seconded the motion. On roll call, all voted aye. Motion carried to approve subdivision with conditions. Rick Gelbman then moved to continue public hearing on conditional use permit until the March meeting of the Planning & Zoning Board at which time the applicant will provide detailed site /building /grading /utility plans. Al Robinson seconded the motion. All voted aye. V. DISCUSSION ITEMS: A. Preliminary Plat Staging: Mr. Brixius reviewed the purpose of the proposed ordinance amendment. Mainly, providing a time frame for development of multi - phased plats to avoid problem with regard to planning, MUSA allocations, transportation planning, and future changes in city development if these phases are allowed to stand undeveloped for long periods of time. The general consensus of the P & Z was to prepare an ordinance for adoption. B. Private Streets: Mr. Brixius explained that this proposed ordinance is intended to correct inconsistencies in the existing ordinance relating to private streets. There was some discussion regarding the cost of maintaining streets and what the definition of a private street was. Mr. Brixius was asked to prepare a definition of public streets and private streets to be incorporated into the ordinance. C. Other: John Landers asked if there were any stipulations on where handicapped parking needs to be located in relation to a building. Mr. Brixius explained that it was his understanding that a certain number of spaces are to be located nearest the entrance. VI. ADJOURNMENT: Upon the unanimous consent of the Board the meeting was adjourned at 8:20 P.M.
