HomeMy WebLinkAbout04/12/1989 P&Z Minutes• • `PLANNING AND ZONING MEETING April 12, 1989 Chairman Charles Prokop called the regular meeting of the Lino Lakes Planning and Zoning Board to order at 7:00 p.m., Wednesday, April 12, 1989. Members present were: Sally Kuether, Alan Irwin, Charles Prokop, Fred Chase, and Elmer Crohn. Also present were: Councilmembers Harold Bisel, 8:07 p.m. -Bill Bohjanen, City Planner, John Miller, and Planning Secretary, Laura Elken. Members Absent: Al Robinson. Chairman Charles Prokop accepted a letter of resignation effective immediately, from Gordon Girtz. He was recently promoted at his place of employment, and found it difficult to address the needs of his home, workplace and outside activities. CONSIDERATION OF MINUTES Mr. Chase moved to accept the minutes of March 8, 1989 as written. Ms. Kuether seconded the motion, and the motion was approved unanimously. REQUEST FROM EL REHBEIN AND SON TO REZONE LAND ON LAKE DRIVEL APPLICATION #88 -36. Mr. Irwin moved to table this request until May, 1989. Mr. Crohn seconded the motion, and the motion was approved unanimously. OPEN MIKE Rocky Girtz from Klosner -Girtz approached the board. He wanted to get a reaction from the Planning and Zoning Board of a request for a Conditional Use Permit. An automotive business wishes to move into his building at the Lino Industrial Park. The company that wants to move into Girtz's building has been in business before, and he did agree to have no outside storage. This was a concern of the P &Z. Mr. Girtz stated that no modifications will be made to the building. The board felt he should proceed with his application for a Conditional Use Permit. Girtz will meet with John Miller to discuss this further. REVIEW OF CONCEPT PLAN FOR LINDA AVENUE EXTENDED IN SECTION 31 IN SOUTHWEST LINO LAKES The development of the Woodridge Estates project has resulted in the extension of sanitary sewer into southwestern Lino • • PLANNING AND ZONING MEETING April 12, 1989 Lakes. Because of the availability of sewer, there has been a considerable amount of interest by other landowners in subdividing their property. Ron Stahlberg, the City Engineer, and John Miller, City Planner followed the street plan adopted by the P &Z board months ago in their discussions with the landowners. Ron Stahlberg has been working with the developers of Rohavic Oaks about resubdivision of some of their larger lots adjacent to Linda Avenue. There has been some concern about the land located west of the present Linda Avenue. Before proceeding with a Preliminary Plat, the property owners are asking the Planning and Zoning Board to review the design. The Planning and Zoning Board received a sketch of the proposed subdivision. The sketch follows the concept plan, but is slightly rectilinear. The landowners feel that it will provide them better use of their land. A 30' setback is platted in for the proposed street. The problem the board saw was that transmission poles may be in the way. In order to miss the poles, the board felt that the proposed street should be moved over 10 feet. There is approximately 33' north of the transmission poles, and 30' south of the transmission poles. Pete Rosenthal addressed the board. He stated that the street shown on the concept plan follows the water works road, and he doesn't want it. Ron Stahlberg stated that a catch basin will be installed for drainage purposes. After further discussion a motion was made. MOTION: Alan Irwin moved to approve a Concept Plan for Linda Avenue Area with the suggestion that the preliminary plat include these concerns: 1. That enough land be dedicated south of the transmission poles to allow for an adequate street width. 2. A road easement be provided for Linda Avenue on the land north of lot 17 3. That enough allowance be made for a future road to be extended southeasterly down the vacated water works right —of —way. 410 Fred Chase seconded the motion, and the motion was approved unanimously. John Miller stated that 75% of the homes have to be developed Page 2 • • PLANNING AND ZONING MEETING April 12, 1989 in Woodridge Estates before Oakwood Lane can be extended. CONCEPT PLAN REVIEW FOR JUSTIN HOME BUILDERS FOR PROPERTY LOCATED BETWEEN ELM STREET AND I -35. APPLICATION #89 -12, #89 -13, AND #89 -14. Dennis Erickson purchased approximately 13.5 acres of land from Robert Tilson. The land is located west of the Catholic Church, south of I -35W, and north of Elm Street. The parcel is triangular in shape, visible from the freeway, and flat. The land is zoned R -1, Single- Family residence. To protect the city's interests and ensure quality development, the applicant and John Miller agreed that the best procedure is to treat the townhouse development as a Planned Unit Development (PUD). The comprehensive plan amendment adopted by the city in 1987 shows this area planned for "Urban Residential" uses. The text of the plan defines this use as "Those areas that have not already been designated for commercial, industrial or multiple - family development are proposed for single- family detached housing..." Jim Held presented the board with a model of proposed town homes he wishes to build. He would like to build a mixture of 2, 4 and 6 unit buildings, with a total of 80 units. Discussion turned to berming along the freeway. The applicant shows several island berms on his concept plan. The berms are located specifically for the residents advantage and privacy. Charles Prokop brought up the possibility of planting a row of trees or dyke to filter out traffic noise, and provide privacy, although the board felt island berms would look more appealing. The board suggested the applicant install more and larger island berms, along with some fencing added. After further discussion a motion was made. MOTION: Fred Chase moved to recommend to city council to rezone Application #89 -12, #89 -13, #89 -14 from R -1, Single - Family to R -3. Alan Irwin seconded the motion, and the motion was approved unanimously. MOTION: Fred Chase moved to recommend to city council rezoning of Application #89 -12, #89 -13, #89 -14 from R -3 to R- 5 (PUD). These rezones were made in order to stay within the Page 3 • • PLANNING AND ZONING MEETING April 12, 1989 requirements of the Lino Lakes City Zoning Ordinance, Sally Kuether seconded the motion, and the motion was approved unanimously. MOTION: Fred Chase moved to recommend to city council approval of a Concept Plan for Justin Home Builders, Application #89 -12, #89 -13, #89 -14, with the recommendations by the City Planner, John Miller as listed below, adding #14 and #15 per the P &Z board's recommendation: 1. Total number of units not to exceed 70. 2. Berm areas to be expanded adjacent to I -35W with the addition of some fencing with added landscaping material. 3. Added berming and landscaping be placed adjacent to Elm Street. 4. Aluminum siding be required for all building exteriors with approximately ten per cent of the total projects facade to be an alternative - creatively applied and maintenance free. 5. "Timberline" brand shingles or an approved equal be used for all roof areas. 6. Addition of an underground watering system for all green areas. 7. Detail for mail boxes and lighting. Hooded lamps required. 8. Design of a more natural or curvilinear ponding area and the addition of landscape material near the pond. 9. Submittal of building and shingles colors. 10. Submittal of window designs and specifications. 11. Submittal of complete landscaping details with common name, sizes, and type of plantings to be used. 12. Removal of all driveways exiting directly onto the street. 13. Submitted at all other information found in the zoning and subdivision ordinances adopted by the city. 14. Submittal of type of street and street width. Alan Irwin seconded the motion, and the motion was approved unanimously. REQUEST FROM ANOKA COUNTY FOR SITE PLAN APPROVAL FOR A STORAGE BUILDING AT CHOMONIX GOLF COURSE. APPLICATION #89- 09. The Anoka County Parks and Recreation Department has constructed a 40 x 96 pole barn on the Chomonix golf course property. The 3840 square foot building was constructed in 1988 without a building permit or a site plan review by the Planning and Zoning Board and City Council. An area of the building measuring 64 x 40 feet is being used as cold storage and an area 32 x 40 feet is heated maintenance. Presently, the Building Official, Pete Kluegel, has the building red - tagged, although it is still used for cold storage. City Administrator, Randy Schumacher; City Planner, John Miller; and City Attorney, Bill Hawkins met with Margaret Langfeld, Tony Palembo, and Dave Torkildson from Anoka County on March 16th. At that time they admitted they had errored. It was agreed to amicably resolve the issue by adding amenities to the building and the area "to minimize the effect of the pole building" (Bill Hawkins words). Attorney Palumbo, representing Anoka County, and Dave Torkildson, Anoka County Director of Parks, addressed the board. Anoka County submitted a landscaping plan and a sketch showing two improvements to the pole barn. 1. Application of a four foot wainscote to the side of the building. 2. Construction of a portico over both of eight foot sidewall doors. John Miller, the City Planner recommended approval of the site and building plan with the following requirements: 1. Completion of the landscaping plan as submitted by Anoka County. 2. Both ends and the side of the building facing the Page 5 • PLANNING AND ZONING MEETING 'April 12, 1989 parking lot should be faced with cedar siding. 3. Construction of a two -foot eave on the parking lot side and ends of the structure. 4. Expansion of the berms between the parking lot and the storage building (final elevations to be approved by the city planner). 5. Building permit fees be increased in accordance with state guidelines for after - the -fact permits. 6. The county grant easements for drainage from the West Shadow Lake Drive area west into park property and from the Robertson Construction land north into park property. (actions protecting the quality of Reshanau Lake). 7. The county grant easements for sewer and water utilities and trail on the north end of Reshanau Lake. (Actions allowing better access to the golf course for local residents). 8. The county agree to accept utilities for the goundskeeper's house and city water as a back -up utility for the golf course. Mr. Torkildson did not agree with Mr. Millers recommendation for cedar siding. He felt that recommendation #3 was "literally impossible ". He stated that he has no planned berms, and felt that once the black top was installed, there may be a drainage problem. He stated that he did wish to make the building as aesthetically pleasing as possible. Torkildson stated that he would want to be hooked up to utilities once that became available. Torkildson is hoping to install waines coating to the front of the building, and also install canopy's over the two eight foot doors. Torkildson would like another month to review this and present the board with his recommendation. Mr. Palumbo asked that the red tag be lifted so the county could at least use the building for its intended purpose. Chomonix Golf Course opened April 14th, and it would cause a problem if they could not use the building. Harold Bisel felt that if a resident of Lino Lakes had a building red tagged it would not be lifted, and he felt Anoka County should not be set apart from the residents. Page 6 • • PLANNING AND ZONING MEETING April 12, 1989 Harold Bisel stated that Anoka County Parks have abused every government action in this instance. He went on to say that the City of Lino Lakes had no input as to how or what type of building they were to install. Mr. Bisel stated "This violates every law the city has on the books, we cannot be above the laws we write ". "We are setting a precedence here ". MOTION: Charles Prokop moved to table the request from Anoka County for Site Plan Approval for a Storage Building at Chomonix Golf Course, Application #89 -09, so that the City of Lino Lakes and the Anoka County Attorney can work out a reasonable solution to the problem and incorporate it into a complete site plan. The P &Z board recommended leaving the building red tagged until this is resolved. Elmer Crohn seconded the motion, and the motion was approved unanimously. ESTABLISH MEETING DATE FOR JOINT PLANNING AND ZONING BOARD AND ECONOMIC DEVELOPMENT COMMITTEE MEETING. John Miller would like to hold a meeting with the Planning and Zoning Board, and the Economic Development Committee to discuss policies and procedures. The board decided to meet either the last week in April, or the first week in May. Mr. Miller will send out a notice to the effect. OLD BUSINESS There was no Old Business NEW BUSINESS MOTION: Alan Irwin moved to recommend to city council to initiate zoning in park property to be P.S.P. (Public -Semi- Public) . Sally Kuether seconded the motion, and the motion was approved unanimously. Mr. Chase moved to adjourn the meeting. Seconded by Ms. Kuether, meeting adjourned at 9:32 p.m.
