HomeMy WebLinkAbout04/27/1988 P&Z MinutesPLANNING AND ZONING APRIL 27, 1988 SECOND MEETING ROLL CALL: Vice Chairperson Cheryl Nelson called to order the Lino Lakes special Planning and Zoning meeting at 7:00 p.m. Wednesday, April 27, 1988. Board members present: Vice Chairperson Cheryl Nelson, Arlene Averbeck, Elmer Crohn, Charles Prokop and Alan Irwin. Also present were John Miller - City Planner, Ron Stahlberg - City Engineer, Harold Bisel - Liaison, and Connie Husby - Secretary. Absent: Jeff Joyer, and Chairman Dave Cody. MOTION: Prokop moved that any P & Z member who was not in attendance at the regular scheduled meeting for the month of April but was present today be given the same consideration as if they were in attendance at the April meeting for purposes of the quarterly stipend. Crohn seconded the motion and the motion was carried unanimously. REPLATTING OF PARTS OF ULMERS RICE LAKE ADDITION, APPLICATION 88 -12. VARIANCES FOR LOT DIMENSIONS. Jack Menkveld of North Suburban Development Inc. has a purchase agreement to buy part of Ulmers Rice Lake Addition and Ulmers Rice Lake 3rd Addition. These earlier plats divided land into one acre parcels. Menkveld wishes to extend sewer to the area and resubdivide the land in normal city sized lots. The land is in the City's R -1 Single Family Residential District. The minimum lot size is 80 X 135 feet. Let the records reflect that Jeff Joyer joined the P & Z meeting at 7:10 p.m. THERE WERE A FEW RESIDENTS HERE TO DISCUSS THIS RE- PLATTING: GARY DAHL - 216 Ulmers Drive - Property backs up to plat. Gary is concerned because 1/3 of his yard is where drainage is expected to go. Gary mentioned plans to move the drainage to Rice Lake Chain. JOHN FITZPATRICK - 7109 Rice Lake Drive - John's concern was the price of the homes going into the area and how it will affect the value and re -sale of their homes already existing. John was very disappointed regarding the size of PAGE 1 • • PLANNING AND ZONING APRIL 27, 1988 the homes going in. He also had a concern about 2nd Avenue and how far the road will be going. Ron Stahlberg said there is an existing 30 foot easement but they're not going to use it. Regarding watershed questions, Ron said there will be a comprehensive drainage plan for the area. JOHN FITZPARTICK - 7109 Rice Lake Drive - John's question was if he doesn't hook up to water will there be a lien against his property at the time of the sale of his home. Ron Stahlberg explained this would be a very good question for our Attorney Bill Hawkins to answer. Ron said a drain field has to be on your own property. TIM PRINZ - 7125 Rice Lake Drive, and KEN HAFNER - Counselor Realty. - Tim was interested in when their property would be assessed for the streets that aren't in yet. John Miller said he and Ron Stahlberg met with the people that could sub - divide their property. They gave them the opportunity to become involved in the re-- platting. Prokop referred to a letter that Miller wrote to Stahlberg about the new standards on lot depths. A problem exists with lot sizes in Blocks 1, 2, 3, 4, 6, 7, 8 & 9. They are wider than 80 feet in many cases. Mr. Menkfeld would need a variance for the minimum lot size. Irwin discussed the plat not meeting our new ordinance and how it definitely needs a variance. Irwin was disappointed in the boring plat. He would like to see curves in the streets and perhaps a cul -de -sac. KEN HAFNER - Counselor Realty - Ken said we're new to this kind of development. We need to make sure we attract the buyer. He thinks we're making a big mistake to accept this proposal of Menkfeld's plat. John Miller recommended that the Planning and Zoning committee really take time to think about what Alan Irwin said and that they have authority to tell Mr. Menkfeld to re- design his plat. MOTION: Prokop made a motion that the petition for the preliminary plat review application 88 -12 dated 4/5/88 by Mr. Menkfeld - North Suburban Development be denied on the • • • PLANNING AND ZONING APRIL 27, 1988 grounds that Blocks 1, 3, 4, 6, 7, & 8 of the plat that's presented do not meet the minimum lot requirements for depth. Also, the plat would require six variances. Prokop suggests to recommend that if Menkfeld replats to meet the minimums, and if it means an open space area or curved roads be included this is something the petitioner would have to deal with - some of the economic considerations as they present themselves to him. Also, three lots should be reconfigured into two lots in Block 2, in a manner simular to what is done in block 5. The plan of long rectangular blocks and identical type lots does not promote the goals of the comprehensive plan, that being of encouraging variety and more desireable type homes. Irwin seconded the motion and this motion was carried with Cheryl Nelson abstaining. REQUEST FROM PAUL K. MILLER FOR A MINOR SUBDIVISION FOR LAND LOCATED NEAR 2209 PHELPS ROAD. REQUEST FROM PAUL K. MILLER FOR A VARIANCE FROM THE PUBLIC ROAD FRONTAGE REQUIREMENT. Paul Miller at Acton Construction wishes to sell approximately 5.85 acres to Gene Orfei and Orfei Contracting Incorporated. The land is partially located within Acton's present storage yard and partially across the creek that traverses this property. Phelps Road extends east from County Road 84, 848 feet and dead -ends at the Acton property. If the lot split were approved as originally requested there would be - 1.) No access to the Orfei property on a public street and 2) there would be a cul -de -sac longer than the 500 feet. Both conditions are not permitted by the Lino Lakes Code. From the time of Miller's original request (remember attorney Alan Tschida and Gene Orfei appeared at the Planning and Zoning Boards open mike in March), there has been a considerable amount of discussion regarding these problems. Originally, John Miller asked for a street extension to the Orfei property and an easement through the remainder of the Acton property to the property line on the east. This would eventually assure access from County Road 84 to Elmcrest on the City's east boundary. Miller (Acton) had problems with this. Presently fuel tanks are located underground where the extension of Phelps Road would normally be required. Miller states the cost of removing them would be cost prohibitive. In addition Miller states there is a need to control access to the storage yard. If there were an extension of the road, he argues, PAGE 3 PLANNING AND ZONING APRIL 27, 1988 his equipment would be subject to theft and vandalism. Miller's attorney, Alan Tschida, submitted copies of state statutes prohibiting the fencing or gating of public ways. Finally, Miller (Acton) submitted a proposal for dedication of a 20 foot wide easement extending the 180 feet from the end of Phelps Road to the end of Orfei's land. He promises an easement for the remaining 40 feet within 20 years. His drawing indicates that future extension of Phelps Road would be determined by development on the east. There was discussion regarding the matter and a motion was made. MOTION: Irwin moved to table this due to the request of the applicant. The concensus of the board was that the findings of fact could not be met. Averbeck seconded the motion and the motion was carried unanimously. Prokop moved to table agenda item #4 for the request of Gene Orfei for a site plan. Averbeck seconded the motion and the motion was carried unanimously. OLD BUSINESS: Vice Chairperson Cheryl Nelson raised the question regarding having Planning and Zoning meetings twice a month. The Board replied it should be a staff decision and if there are 7 or more items on the agenda it would be left up to the City Planner to arrange for a second meeting. RON STAHLBERG: Ron gave the P & Z members a sneak preview of sewer & water in the City of Lino Lakes. MOTION: Prokop moved to adjourn the meeting. Averbeck seconded the motion and the motion was carried unanimously. The meeting adjourned at 9:30 p.m. PAGE 4
