HomeMy WebLinkAbout06/10/1987 P&Z Minutes• • • PLANNING & ZONING BOARD June 10, 1987 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order by Chairman Cody at 7:01 P.M., Wednesday, June 10, 1987. Boardmembers present: Irwin, Joyer, Averbeck, Nelson. Mr. McLean joined the meeting at 7:05 P.M. Absent: Prokop. Also present were Mr. Kluegel, Building Official; Mr. Miller, Interim Planner; Mr. Marier, Council Liaison; and Mrs. Foster, Secretary. CONSIDERATION OF MINUTES May 13, 1987 - Mr. Joyer moved to accept the minutes of the 5/13/87 Planning and Zoning Board meeting as presented. Ms. Nelson seconded the motion which carried unanimously. OPEN MIKE (See also additional "Open Mike" later during meeting) Variance Feasibility - Mr. Tom Donlin appeared before the Board stating that he would like to request a variance from the ten acre lot size minimum in his area in order to add land to his parcel from adjoining property owned by his family members. The Board explained that they must follow ordinance and may only grant a variance if the petitioner has met the findings of fact necessary for a variance. Mr. Cody asked Mr. Donlin to get a copy of these findings of fact from Mr. Kluegel and make a formal application if he can make an argument which will meet the findings of fact. BUILDING OFFICIAL'S REPORT Mr. Kluegel reported the following action taken at recent Council meetings: Public Hearing took place regarding Klosner - Goertz request for a conditional use permit for exterior storage at 448 Lilac Street. Council approved the C.U.P. per P & Z recom- mendations. Site and Building Plan to add 48 feet to the previously approved Custom Manufacturing plant site and building plan was approved by Council with the stipulation that all pre- vious conditions be carried out. Site and Building Plan to construct a temporary modular facility on Lino Lakes Correctional Facility was approved with a limit of five years. EJM Pipe Services Site and Building Plan was approved with the stipulations that tree planting be completed by September 1987 and fencing and slatting completed by June, 1987. The final plat for Gary Uhde's development - South Reshanau Lake Shores was approved by Council. Second readings were approved by Council for rezones for both the South Reshanau Lake Shores plat and the D. Erickson Second Addition plat. 4 PLANNING & ZONING June 10, 1987 Page Two JOE HILL - VARIANCE TO GARAGE HEIGHT Mr. Hill stated that he appeared before the City Council regarding his variance request and then redesigned his garage so that he did not need a variance for the square footage of the garage. He does still need to build the height over what is allowed by ordinance. During the conversation, Mr. Hill stated that he felt he could build the floor of the garage down below ground level which would provide the height he needs; in which case there would be no need for a variance. Mr. Hill was directed to discuss these plans with the building official in order to meet other building codes. KEVIN KROELLS - HOUSE MOVE -IN Mr. Kroells appeared before the Board stating that he wishes to move the home which is presently located at the northeast corner of 35W and Lexington Avenue into Lino Lakes. The City of Blaine granted a variance for the home to be built at its present location provided the home be used only as a model. The parcel on which the home is presently located will then be used as commercial property. Mr. Kluegel stated that he has inspected the house and approves the house condition for moving. MOTION: Mr. McLean moved to recommend to Council approval of a house move -in permit for Kevin Kroells, 1494 Selby Ave., St. Paul, MN to move a house presently located at 35W and Lexington Ave. to 7839 Lois Lane, Lino Lakes based on the information provided in the application. Mrs. Averbeck seconded the motion which carried with Mr. Cody abstaining. OPEN MIKE Residential Home /Non- Conforming Use - Steve and Karen O'Connor appeared before the Board asking if the City could rezone their property. They explained that the strip along Lake Drive on which their home is located is zoned commercial and they have learned that they or a prospective buyer would be unable to ac- quire a mortgage for the home because it is a non - conforming use. Several people in the audience said that they also live in this area and have experienced the same problem. Mr. O'Connor stated that a petition has gone to the City Council. Mr. Cody explained the procedure for a rezone and told the O'Connors that they should have the concerned homeowners submit a petition stating what action they desire and contact Mr. Kluegel to be placed on the P & Z agenda. HANSON BLOCK - SITE AND BUILDING PLAN /REZONE /CONDITIONAL USE PERMIT Mr. Lonn Hanson and Mr. Donald Obernolte appeared before the Board representing Hanson Block. This site and building plan was tabled at the May, 1987 meeting and further information was requested. The Board reviewed the City Planner's 6/3/87 memo on this subject point by point. After several alternatives were proposed, the Board felt that the only point on which the Board and the applicant 4 • • • PLANNING & ZONING June 10, 1987 Page Three did not agree was the issue of the size of the trees to be planted along the perimeter of the project. Mr. Schilling, the property owner stated that he felt that the request of the City Planner to plant 5' -6' trees along the peri- meter was impractical and that the cost of approximately "$65,000 was exorbitant. Mr. Schilling said that if the City of Lino Lakes wants an industrial park and wants Mr. Schilling's cooperation on the industrial park they would have to work with this applicant on the tree issue or there may not be an industrial park at all. He stated his opinion that the continuation of the industrial park and the utilities to the area hinge on this project. The Board went on to discuss the rezone and conditional use permit. MOTION: Ms. Nelson moved to recommend to Council approval of a rezone from Light Industrial to General Industrial as requested in application #87 -12, by property owner James Schilling and applicant Lonn Hanson (Hanson Block). This rezone would apply to Lots 11, 12, 13, 14, 15, 16 and 17 of Lino Industrial Park and is based on the findings of the City Planner in his 6/3/87 memo on this subject: 1) The land is near a second concrete manu- facturing plant, 2) The land is near a second general industrial zone, 3) The land is away from any single family residential dis- trict, 4) Excellent highway access. No need to traverse residential neighborhoods, 5) Rezoning would allow for development of long vacant land) 6) Rezoning would not be contrary to recommendations of the comprehensive plan amendment. Mr. Joyer seconded the motion which carried with Mr. Cody abstaining. MOTION: Mr. McLean moved to recommend to Council approval of a conditional use permit as requested in application #87 -13, by property owner James Schilling and applicant Lonn Hanson (Hanson Block), to operate a concrete block factory at the location de- scribed within the application. The basis for this approval would be that the standards required in Section 5, Subd. 5 (2)(A - I) appear to have been met, and the City Planner, in his 6/3/87 memo on this subject recommends the C.U.P. with the following conditions: 1) The plant facility, storage area, and landscaping and all other physical aspects of the operation are to be constructed as shown on the site plan as submitted to the City of Lino Lakes and as amended by the City, 2) Outside storage of finished products should not be more than 12 feet high, 3) An agreement to construct necessary infrastructure (streets and utilities) items is reached with the City of Lino Lakes, 4) Completion of the garage by 12/31/89, 5) Continued removal of broken blocks with no on -site storage of this material, 6) Approval of the site plan by the RCWD and approval of an access permit by the MNDOT, 7) Other conditions as may be requested by the City Engineer (see TKDA's 6/5/87 memo on this subject) or the Building Official, 8) Review of operations after one year and annually thereafter. Mrs. Averbeck seconded the motion which carried with Mr. Cody abstaining. PLANNING & ZONING BOARD June 10, 1987 Page Four MOTION: Mrs. Averbeck moved to recommend to Council approval of the site and building plan, application #87 -14 by property owner James Schilling and applicant Lonn Hanson (Hanson Block), as outlined in the application with the addition of the follow- ing modifications: 1) Trees on the berm are to be balled and burlapped spruce planted in two rows 8 feet apart. The trees are to be planted 8 feet on center. The inside row is to be 5 feet to six feet high when planted and the outside row is to be 3 feet to 4 feet high when planted, 2) Grassed areas near and adjacent to the building including the area over the temporary drainfield are to be sodded? 3) Additional Hubbel lights are to be placed north of the northeast corner of the building to illuminate the drive -over hopper, and near the west side of the building to illuminate the parking lot. The west and south sides of the building are to be illuminated with flood lights arranged so that no glare is apparent; power lines to be underground rather than above ground. This recommendation is made on the basis that the application appears to meet the requirements of Section 5, Subd. 4 of the Zoning Ordinance. Mr. McLean seconded the motion which carried with Mr. Joyer voting no and Mr. Cody abstaining. Mr. Cody thanked Mr. Hanson and Mr. Obernolte for their professional presentation. ZONING AMENDMENTS -- (Durable /Dustless Surface, Off- Street Parking, Semi - Trailer Parking) The Board discussed the zoning amendments before them. Some additions and corrections were suggested. The Board directed Mr. Miller to revise the zoning amendments proposed for "Durable and Dustless Surface Definition ", "Design Requirements for Off - Street Parking ", "Requirements for Motor Vehicle Parking in Residential Areas" (particularly parking of semi - trailers); and gave direction as to what specifics they wanted addressed. (Amendment to PSP District) MOTION: Ms :. Nelson moved to recommend to Council approval of amendment to the zoning ordinance which has been proposed as a "housekeeping" change allowing county and state facilities to be permitted uses in the PSP district. (See proposed ordinance below.) Mr. McLean seconded the motion which carried unanimou §ly. CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA Ordinance No. SAN ORDINANCE AMENDING THE CITY CODE, APPENDIX B, ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING THE "PSP" PUBLIC AND SEMI- PUBLIC DISTRICT TO INCLUDE COUNTY AND STATE FACILITIES. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: • • • PLANNING & ZONING BOARD June 10, 1987 Page Five I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minne- sota passed by the City Council on May 24, 1983, is hereby amended by adding the following: AMENDMENT: Section 6 District Provisions, Subdivision 18 "PSP" Public and Semi - Public District is amended to read as follows: (6) Permitted Uses. (F) All public buildings for county and state government including correctional facilities. II. Save as above amended, said Ordinance No. 2 shall stand as ini- tially passed and as previously amended. This Ordinance shall be in full force and effect from and after its passage and publication according to City Charter. Passed by the City Council this day of , 1987. Benjamin G. Anderson, Clerk- Treasurer (One Acre Lots as Sewer Becomes Available) Due to the late hour and the length of time expected to consider the subject of "Subdividing One Acre Lots as Sewer Becomes Available ", the Board decided to table this issue until the next P 6 Z meeting. OLD BUSINESS Mr. McLean and Mr. Marier reported the status of the comprehensive plan amendment review by the Metro Council and informed the Board that the City and Metro Council will meet again on 6/17/87. NEW BUSINESS Mr. McLean asked Mr. Kluegel to inform the Public Works Department that the sign along the road when entering the City of Lino Lakes near County Rd. J and Otter Lake Road still reads "Village of Lino Lakes" and Mr. McLean would like to have it changed and updated to "City of Lino Lakes ". The meeting adjourned by unanimous decision at 10:09 P.M.
