HomeMy WebLinkAbout07/08/1987 P&Z Minutes1 • • • PLANNING & ZONING BOARD July 8, 1987 Chairman Cody called to order the regular meeting of the Lino Lakes Planning and Zoning Board at 7:03 P.M., Wednesday, July 8, 1987. Boardmembers present: Prokop, Nelson, McLean, Joyer, Irwin, Averbeck. Boardmembers absent: None. Also present were: Building Official, Mr. Kluegel and Secretary, Mrs. Foster. Interim City Planner, Mr. Miller joined the meeting later. CONSIDERATION OF MINUTES - June 10, 1987 Mr. McLean moved to accept the minutes of the 6/10/87 P & Z meeting as presented. Mrs. Averbeck seconded the motion which carried with Mr. Prokop abstaining. OPEN MIKE No one was schedule or appeared before the Board. BUILDING OFFICIAL'S REPORT Mr. Kluegel reported the following action taken at recent City Council meetings relative to P & Z issues: House move -in permit for Kevin Kroells was approved per P & Z recommendations. Public Hearing for Hanson Block application was set. The amendment to include County and State facilities in the PSP district was approved. City Planner was directed to write a letter relative to the situation explained by Judy Domning at the 4/87 P & Z meeting regarding her non - conforming use home on Birch Street, detail- ing to her mortgage company what has transpired with this property. Mr. Kluegel also reported that the Council will further consider a joint Lino Lakes /White Bear Township position of Planner /Economic Development Specialist at their next meeting. Mr. McLean stated that he felt that most planners have additional training in land- scaping, etc. rather than economic development and that the Council may be limiting applicants by requiring economic development back- ground. ROBERT RUD - VARIANCE Mr. Rud and Mr. Kluegel explained that due to the Main Street Im- provement Project, Mr. Rud will be giving up a portion of his front yard to the County as street easement. The present septic system on the Rud property is located in the front yard: with the new street easement, the drainfield will no longer meet the required setbacks. The last pipe of the drainfield will be right on the line rather than 10 feet from the line as required by ordinance. • • • PLANNING & ZONING BOARD July 8,.1987 Page Two Moving the septic system would also require moving the well on the property. Anoka County and the City Planner recommended approval. Mr. Rud showed concern that with the granting of this variance, he may run into problems if and when he tries to sell his property; otherwise, he is agreeable to leaving the septic system as is and receiving the variance. Members of the Board agreed that they did not wish to cause selling problems for Mr. Rud. They felt that the variance would probably not cause selling problems; the problem recently experienced with mortgage companies has been in dealing with a non - conforming use rather than a property with a variance. Boardmembers felt that the City Attorney should review the situ- ation before granting the variance for Mr. Rud's protection. MOTION: Mr. McLean moved to recommend to Council approval of a variance for Robert A. Rud, 1182 Main Street, Lino Lakes, applica- tion #87 -19 allowing the septic system on the property described within the application to remain as is at a setback less than the 10 feet required by ordinance. This application appears to have met the requirements of Section 5, Subd. 7 (Variances). The P & Z Board further recommends that the City Attorney research this situ- ation to assure that granting this variance will not create any difficulty in selling the property or securing a mortgage. Mr. Prokop seconded the motion which carried unanimously. FRED TUMA - HOUSE MOVE -IN PERMIT Mr. Tuma and Mr. Kluegel explained that this application requests approval to move a house to 423 Sherwood Lane. Mr. Kluegel felt that the condition of the house was good. The professional opinion within the application indicated that due to the water table, a mound system septic be installed. Mr. Tuma stated that the home will either be erected as a slab on grade without basement or the basement will be on grade with fill placed around the basement. Mr. Kluegel agreed with these plans and the mound system septic. MOTION: Mr. McLean moved to recommend to Council approval of a house move -in permit for Fred Tuma, application dated 6/16/87, to move a house to 423 Sherwood Lane with the provision that the septic system be installed as recommended in the application and the house erected with sufficient elevation as described this evening to the Building Official's satisfaction. Mrs. Averbeck seconded the motion which carried unanimously. ORDINANCE AMENDMENTS The Board discussed several ordinance amendments. The action taken on these amendments follows, the actual amendments are attached to these minutes. • PLANNING & ZONING BOARD July 8, 1987 Page Three MOTION: Mr. Prokop moved to recommend to Council adoption of Ordinance No. 04 -87 "AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B , ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING DESIGN REQUIREMENTS FOR OFF STREET AREAS" as it appears within this evening's minutes. Motion seconded by Mr. Joyer and carried unanimously. MOTION: Mr. Prokop moved to recommend to Council adoption of Ordinance No. 06 -87 "AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B , ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING EXTERIOR STORAGE REQUIREMENTS" as it appears within this evening's minutes. Motion seconded by Mr. McLean and carried unanimously. MOTION: Mr. Prokop moved to recommend to Council adoption of Ordinance No. 14 -87 "AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B , ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING EXTERIOR STORAGE REQUIREMENTS" as it appears within this evening's minutes. Motion seconded by Mrs. Averbeck and carried unanimously. MOTION: Mr. McLean moved to recommend to Council adoption of Ordinance No. 15 -87 "AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B , ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING THE DEFI- NITION SECTION TO INCLUDE OUTDOOR STORAGE /STORAGE YARDS" as it appears within this evening's minutes. Motion seconded by Ms. Nelson and carried unanimously. MOTION: Mr. Prokop moved to recommend to Council adoption of Ordinance No. 16 -87 "AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B , ZONING ORDINANCE OF THE CITY OF LINO LAKES BY MAKING OUTSIDE STORAGE A CONDITIONAL USE IN THE GENERAL INDUSTRIAL DISTRICT" as it appears within this evening's minutes. Motion seconded by Ms. Nelson and carried unanimously. Subdividing One -Acre Lots as Sewer Becomes Available - The Board discussed Mr. Miller's 6/3/87 memo on this subject, in which several options were explained in dealing with subdividing one - acre lots. Mr. Cody stated that this issue is not urgent at this time since the comprehensive plan amendment which would create the need for a plan for subdividing one acre lots has not yet been approved. He directed Mr. Miller to compile copies of the methods used by other communities and reports on how the methods are working and submit to the Board for the next P & Z meeting. OLD BUSINESS (NO NEW BUSINESS) Street Numbering - Mr. Irwin is looking into a street number program. Rolling Hills Drive - Mr. Prokop reported, contrary to the 6/8/87 Council minutes, page 3, that the condition of this street is that it has been broken up. Meeting adjourned by unanimous decision at 9:33 P.M. • • PLANNING & ZONING BOARD July 8, 1987 Page Four CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA Ordinance No. 04 - 87 AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B, ZONING ORDINANCE OF THE CITY OF LINO LAKES BY AMENDING DESIGN REQUIREMENTS FOR OFF - STREET AREAS. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended as follows: AMENDMENT: Section 8, Subdivision 4 (C). All access drives, drive- ways, approaches, sales lots, and parking areas shall be surfaced with asphalt or concrete in a manner approved by the City Engineer. Exceptions are access drives, drive- ways, approaches, sales lots, and parking areas in the rural and residential districts of the City that serve farm and residential principal and accessory uses on par- cels of more than one acre. These may be surfaced with 1) class 5 gravel, 2) pea rock, 3) crushed rock, or 4) agricultural lime in a manner approved by the City Engi- neer. On parcels of less than one acre, asphalt or con- crete surfaces are required. II. AMENDMENT: Section 4, Subdivision 28, Paragraph 3: (Add underlined sentence) to read: Access drives to principal structures which traverse wooded, steep or open field areas shall be constructed and maintained to a width and base material depth suffi- cient to support access by emergency vehicles. All access drives (driveways) shall comply with the following stand- ards. See also Section 8, Subdivision 4 (C). The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended regard- ing Exterior Storage. AMENDMENT: Appendix B, Section 4, Subdivision (24) Exterior Storage is amended to read as follows: (5) Parking and use of semi - trailers for storage pur- poses is prohibited in all districts. II. Save as above amended, said Ordinance No. 2 shall stand as initially passed and as previously amended. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended regard- ing Exterior Storage. AMENDMENT: Appendix B, Section 4, Subdivision (24) Exterior Storage is amended to read as follows: (6) All storage yards shall have fully maintained sur- faces of any of the following: 1) class 5 gravel, 2) pea rock, 3) crushed rock, 4) agricultural lime, 5) asphalt or concrete, as determined by the City. The surfaces shall be prepared and maintained in a manner approved by the City Engi- neer. II. Save as above amended, said Ordinance No. 2 shall stand as initially passed and as previously amended. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended by adding the following Definition: AMENDMENT: • Appendix B, Section 3, Subdivision 2 Definitions is amended to read as follows: (100) Outdoor Storage /Storage Yards - An outside area where equipment or material relating to the principal use of a parcel of land is stored. The stored items are not for sale or display but are used in the everyday operation of the principal use. II. Save as above amended, said Ordinance No. 2 shall stand as initially passed and as previously amended. The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: I. Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota passed by the City Council on May 24, 1983 is hereby amended as follows: AMENDMENT: Appendix B, Section 6, Subdivision (17) "GI" General Industrial District. Paragraph (8) Conditional Uses add (V): Open storage of materials and equipment when fenced and screened and relating to the principal use. II. Save as above amended, said Ordinance No. 2 shall stand as initially passed and as previously amended.
