PLANNING & ZONING BOARD
August 12, 1987
Cody asked consideration of minutes. McLean and Prokop joined meeting. Irwin
questioned ordinance recommendation to City Council regarding hard surfaces of
storage yards. Asked if Planning and Zoning hadn't deleted "engineer's approval"
statement. After further discussion, minutes approved as submitted.
Joyer joined meeting.
Open Mike
Gary Shipman, Lois Lane address. Asked to construct 26 x 30 accessory building.
Pete explained that lot size limits building to 10 x 12. Cody: Planning and
Zoning Board must stick with ordinance. Regulations were adopted after great
consideration. Shipman asked can an ordinance be changed? Cody said yes
and he explained the process to Shipman. Shipman asked that a copy of the
variance requirements be sent to him.
Tom Donlin asked to be placed on the agenda for a minor subdivision. He stated
he had been before the Planning and Zoning Board in June. He had all the material
needed and the planner had reviewed the proposed subdivision. Cody polled the
Planning and Zoning members and it was agreed to place the item on the agenda.
Randy Schumacher explained the status of Hanson Block. He reviewed the efforts
to get them to the Moline site. He asked if a special meeting could be held to
consider the plans. Planning and Zoning Board agreed. McLean and Prokop warned
of precedent and -v that others could expect the same treatment.

Building Official Report
Pete explained the City Council's actions on Tuma, Rud, Dennis Erickson and or-
dinance amendments on outside storage, storage yards and storage in the General
Industrial District.
Outlot J
Joyer announced he would not participate in consideration of this item. Pete
reviewed the request and indicated that it had been brought to the City staff's
attention that Outlot "J" had been incorrectly included in a zoning change that
should have only affected the adjacent "Quadrennium property ". Outlot "J" had
always been zoned Limited Commercial. No discussion of this rezone could be
found during the public hearings or quadrant meetings which justified other
zoning map changes during 1983.
Howard Rezone
• Paul Howard explained this request. He showed photos of the property. He has
removed the existing home, purchased land contingent on rezoning. McLean moved
recommendation to City Council to approve request #87 -21, rezoning of approximately
oyr� _- -lone -half of the land from E -R to R -6 District for reasons found in Mr. Miller's
`�°,Vt professional opinion. Averbeck seconded it. Motion was unanimous.

St. Paul WAterworks
Peter Rosenthal (Lino Lakes address) appeared. Randy gave the full background
of negotiations with St. Paul Waterworks. Averbeck asked about lot sizes. Cody
asked that if the motion is made it include reasons for action. Prokop asked
about forcemain. Rosehthal showed the location on a map. Prokop stated location
should be shown on map and included in legal description. There was much discussion
about future roads in this area. Irwin questioned lot dimensions and angles.
Prokop questioned procedures. Rosenthal amended application to three parts to be
87 -20A, 87 -20B, 87 -20C. McLean moved and Joyer seconded to recommend approval
of application #87 -20A, a minor subdivision of parcels a, b, c, and remainder.
The survey to include the locations of the forcemains and any other easements.
The planner's comments were referenced as justification. Motion was unanimous.
McLean moved and Joyer seconded parcels d, e, f, and remainder. Motion was
unanimous.
McLean moved and Joyer seconded parcels, g, h, i, and j with a 30 foot easement
across water portion of parcel J. Motion was unanimous.
Donlin
Tom Donlin appeared before the board. Lavayne Dupsala also appeared. He was
the surveyor for the minor subdivision. He explained the configuration of the
parcel. The St. Paul Waterworks parcel, the existing parcel where Donlins
now live and the building site for the present property owners. Miller
noted that despite bizzare shape the parcel met all city zoning and subdivision
requirements. Cody assigned application number #87 -22 to the request. McLean
moved to recommend approval of minor subdivision #87 -22 for a 10 acre parcel
shown as parcel A. Averbeck seconded it. Motion was unanimous. It was asked
that full copies of materials be submitted to the Planning and Zoning Board in
the next agenda packet.
Allen Court Street Vacation
Pete explained proposal. Randy stated there was "no real need" to vacate the
street. He explained that the potential for higher density development existed
in the area and that present large lots could be subdivided when sewer becomes
available. Nelson moved to recommend denial to the City Council (based on
Randy's comments). McLean seconded the motion. Motion was unanimous. Randy
explained procedure and City Council's requirements for public hearings to
petitioners.
Twilight Acres
Joyer left the Board Meeting. Averbeck questioned if this was the right time to
discuss this request. Irwin felt it would help in future discussions with Met
Council if we could show how one acre parcels might work. Randy reviewed recent
discussions with Met Council and indicated MUSA changes to serve in -fill areas
would probably be final answer. Additional discussion of 22 acre parcels followed.
Members agreed they could take no action until Met Council decided comp. plan
issues. McLean moved to table Twilight Acres discussion until comp. plan is
finalized. Averbeck seconded the motion. Motion was unanimous.
Prokop moved to adjourn the meeting at 9:38 P.M. McLean seconded it. Motion was
unanimous.

AN ORDINANCE AMENDING THE CITY CODE, APPENDIX B, ZONING ORDINANCE
OF THE CITY OF LINO LAKES BY AMENDING DESIGN REQUIREMENTS FOR OFF -
STREET AREAS.
The City Council of the City of Lino Lakes, Anoka County, Minnesota
does ordain:
I.
Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota
passed by the City Council on May 24, 1983 is hereby amended
as follows:
AMENDMENT: Section 8, Subdivision ). All access drives,
driveways, approaches, sales lots, and parking
areas shall be surfaced with asphalt or concrete
in a manner approved by the City Engineer. Except-
ions are access drives, driveways, approaches, sales
lots, and parking areas in the rural and residential
districts of the City that serve farm and residential
principal and accessory uses on parcels of more than
one acre. These may be surfaced with 1) class 5
gravel, 2) pea rock, 3) crushed rock, or 4) agricultural
lime in a manner approved by the City Engineer. On
parcels of less than one acre, asphalt or concrete
surfaces are required.
II.
Save as above amended, said Ordinance No. 2 shall stand as initially
passed and as previously amended.
This Ordinance shall be in full force and effect from and after
its passage and publication according to City Charter.

The City Council of the City of Lino Lakes, Anoka County, Minnesota
does ordain:

Ordinance No. 2 of the City of Lino Lakes, Anoka County, Minnesota
passed by the City Council on May 24, 1983 is hereby amended regard-
ing Exterior Storage.
AMENDMENT: Appendix B, Section 4, Subdivision (24) Exterior Storage
is amended to read as follows:
