HomeMy WebLinkAbout12/09/1987 P&Z Minutes• • • PLANNING AND ZONING BOARD DECEMBER 9, 1987 Vice Chairman Arlene Averbeck called to order the regular meeting of the Lino Lakes Planning and Zoning Board at 7:00 p.m. Wednesday, December 9, 1987. Board members present: McLean, Joyer, Irwin, and Nelson. Board members absent: Chairman Cody and Prokop. Also present were: John Miller -City Planner, Pete Kluegel - Building Official, and Connie Husby-- Secretary. CONSIDERATION OF MINUTES: Mr. Irwin noted that the second page of the November minutes be corrected as follows: the first and second paragraph should be 12 X 188 instead of 12 X 238 regarding the Apitz property. Mr. McLean moved to second the motion to accept the minutes as corrected. The motion was carried unanimously. OPEN MIKE: Clarence Scharpen's property borders Gottwald's property. Mr. Scharpen owns 40 acres north of the Lino Lakes Elementry School. (This property of his is land locked) Gottwalds property is RX2 for development. Clarence is seeking access to a road when Gottwald's property is sold and divided into lots and blocks. Ms. Averbeck replied that Clarence would have to wait until the developer plans the road. The Board told Mr. Scharpen that he would be notified when Mrs. Gottwald decides to sell. Mr. Prokop joined the meeting at 7:10 p.m. STEVE KAISER: No Show ED VAUGHAN - CONSIDERATION OF A CONDITIONAL USE PERMIT REQUEST FROM ED VAUGHAN TO OPERATE A HUNTING PRESERVE AT 1403 BIRCH STREET, APPLICATION #87-28. Ed Vaughan owns 307 acres of land north of Birch Street in the south central part of the city. The land is held as an investment by Mr. Vaughan and he hopes to eventually subdivide it for residential purposes. He has stated, "As soon as sewer is available the hunting preserve is done." Discussed were: * Loudness of shots -- too early in the morning. * Too close to R1 district! • MOTION: Ms. Nelson moved to approve the application #87 -28 Ed Vaughn to operate a wild game farm shooting preserve subject to the recommendations listed on the City Planners report #1 -12. Mr. McLean wants to add #13 to the recommendations that reads: termination of the conditional use permit to operate a wild game farm upon receipt of noise nuisance complaints. RECOMMENDED ACTION: Motion to recommend approval to the City Council of Application 87 -28 to permit Ed Vaughan to operate a "Wild Game Farm" at 1403 Birch Street with the following conditions: 1. Hunting be permitted only from September 15 through March 31, and 2. Hunting be limited to Pheasants, Quail, and Chukar Partridge only, and 3. One hour of daylight be required in the morning before release of any birds or hunting activity, and 4. There be no hunting after sunset, and 5. The property be posted, and 6. The number of groups hunting at any one time be limited to not more than four each with a maximum of four numbers, and 7. All game laws listed in Minnesota Small Game Regulations apply with the exceptions listed for operating a game farm, and 8. The applicant obtain a Minnesota Department of Natural Resources Private Shooting Preserve License for each year of operation, and 9. The applicant follow Department of Natural Resources Commissioner's Orders No. 1880 and 2042 as amended in operation of the wild game farm, and 10. The applicant be responsible for internal monitoring and policing of the activities of the wild game farm and its guests, and 11. The conditional use permit be subject to annual review by the City of Lino Lakes, and 12. Termination of the conditional use permit to operate a wild game farm upon a ban on hunting for all adjacent and contiguous properties. 13. Termination of the conditional use permit to operate a wild game farm upon receipt of noise nuisance complaints. Mr. Prokop seconded the motion. The motion was carried unanimously. CONSIDERATION OF REVISION OF PROPOSED ORDINANCE 06 -87 FROM CITY COUNCIL ACTION OF JULY 27, 1987. After the board members discussed this proposed ordinance a motion was made. MOTION: Jeff Joyer moved that the Planning Commission recommend adoption by the Council Ordinance #06 -87 as presented. Cheryl Nelson seconded this motion and the motion was passed with Mr. McLean voting no. DISCUSSION & REVIEW OF PROPOSED RESIDENTIAL DEVELOPMENT STANDARDS INCLUDING ESTABLISHMENT OF AN EXECUTIVE HOUSING DISTRICT The City Council reviewed the standards and sent them on to the Planning and Zoning to see what they have to say about it. The Planning and Zoning Board discussed the increased housing standards and the executive housing districts. The board members were concerned though that not enough time had been given to studying these changes that Mr. Prokop defined as "significant ". The Planning and Zoning Board asked for a joint meeting with the City Council. Mr. Joyer was opposed to increasing minimum standards and he argued that developers reacting to the market place should have responsibility for determining the types of homes that are built in the city. No specific changes in minimum standards were suggested by the Planning and Zoning Board. MOTION: Mr. Prokop moved to accept the concept of increasing minimum housing standards, but expressing reservations and requesting a meeting with the City Council as soon as possible. Mr. McLean seconded the motion. Motion passed with Mr. Joyer voting no. OLD BUSINESS: NONE NEW BUSINESS: NONE The meeting adjourned at 9:10 p.m.
