HomeMy WebLinkAbout03/10/1982 P&Z MinutesPlanning and Zoning Board March 10, 1982 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order by Chairman Johnson. Members present: Goldade, McLean, Prokop, Klaus, Johnson. Members absent: Doody, Juleen. Mr. Reinert and Mr. Kluegel were also present. MINUTES Mr. Johnson stated the Clerk had sent a note to the Board requesting the members to speak louder and to use their microphones. Mr. McLean moved to approve the Lino Lakes Planning and Zoning Board minutes of February 17, 1982 as presented. Mrs. Klaus seconded the motions. Motion carried unanimously. Mr. McLean noted that Mr. Schumacher is not going to be at this meeting as planned. MR. SCHUMACHER'S REPORT Mr. Johnson asked Mr. Kluegel if he had anything to report for Mr. Schumacher. Mr. Kluegel said no. Mr. Reinert reported the Council had directed the City Attorney to begin working on a bonding policy for Lino Lakes, He noted that the plat Lakes Addition #7 is before the Council now and bids have been received for improvements. The letting of the bids have been delayed 35 - 45 days to allow the Council time to get a bonding policy in place. The variance for Gregg Olson was granted. The Special Use Permit for Glenn Rehbein was issued on the basis that the building was for storage and light maintenance. A public hearing was set for March 22, 1982 for Nathe's request to rezone oneof his lots to R -3. Mr. McLean noted the action of the Planning and Zoning Board was for approval of the rezone without the park- 4110 ing lot, the Board wanted the dwelling to be a separate piece with its own entry for the convenience of those people and it is a variance because there is less than the required frontage on the street. VARIANCE - SZYMANSKI Mr. Szymanski is requesting a variance to transfer title of a parcel of land less than the required 22 acres. Mr. McLean requested that all legal drawings be in- cluded in the packets. Mr. Szymanski said that the purpose for this piece of land was to run his cattle from one piece of property to another. Mr. McLean asked where Mr. Szymanski's frontage is and Mr. Szymanski said he did not have frontage but used a cartway from Rondeau Lake Road West for access to his property. Mr. McLean asked if he plans to develope this property in the future. Mr. Szymanski said it is all peat land and does not expect to build there. Mr.Prokop asked if it was possible to get a lease or an easement. Mr. Szymanski said he had not talked to the land- owner about anything but purchasing. There was a lot of discussion regarding the fact that Mr. Szymanski has no road frontage and the problems he would encounter when he tries to sell his homestead and transfer title. Mr. Prokop asked Mr. Szymanski if he would be amenable in approaching the present landowner of the 33' square parcel to see if he could lease or obtain easements. Mr. Szymanski said he would ask the landowner but he would rather buy the property. Mr. Prokop moved the request for a variance by Mr. Szymanski dated March 4, 1982 •be tabled pending Mr. Szymanski's inquiry into the option of either (A) leasing the property in question or (B) obtaining easements accross the property in quest- ion. Mr. McLean seconded the motion. Motion carried unanimously. iVARIANCE FEASIBILITY - PLEMMONS • Planning and Zoning Board March 10, 1982 Page -2- Mr. Plemmons explained that his property is located at the very southwest corner of Lino Lakes on County Road J. and he would like to divide his property into three homesites. He is facing a financial problem. Mr. McLean read Section 5.05 of Ord- inance #56, Variances and Appeals which states that variances may be granted if a hardship is being created by the shape or the condition of the parcel in question. In this case the hardship is not with the land. Mr. Prokop noted this area is designated as Expansion Residential in the Lino Lakes Land Use Plan, one house per five acres and as a Board preferred to not grant spot rezones. Mr. Plemmons explained his financial condition and said this is the only way out of his situation. There was further discussion regarding the Land Use Plan and that the Land Use Plan is a guideline and the Zoning map and the Zoning ordinances have not been implemented. The Board suggested several buy back plans. Mr. McLean noted that the moratorum has expired regarding dividing property (Ord - inancd #78) and our present ordinances say that parcels of property of 21/2 acres or more can be split and sold without a variance or without City approval. Mr. McLean suggested dividing Mr. Plemmons parcel into two 2.9 acre home sites with each parcel containing at least 150 feet frontage and recording them at the County. Mr. Prokop said that although the City has adopted a Comprehensive Land Use Plan, the support ordinances are not in place yet therefore, there is this loop hole. Mr. Plemmons asked if the Planning and Zoning Board could act on a request for the variance on the plan he presented (3 homesite). Mr. McLean explained that this was not possible since he had not completed the necessary variance forms and had not paid the fee. Mr. Prokop said the best the Planning and Zoning could do tonight was recommend a division into two 22+ acre lots since Mr. Plemmons needs to resolve this before April 16, 1982 and the Council would not be able to consider the var- iance before April 26, 1982 without going to a Special meeting. Mr. Plemmons thanked the Board for their time and suggestions. OLD BUSINESS Mrs. Klaus asked about theplanned City tour and Mr. McLean said that arrangements have tenatively have been made for the 20th of March to use the Civil Defense van for the tour at 9:00 a.m. at City Hall. Mrs. Klaus asked about the Comprehensive Land Use Plan and the zoning map. Mr. McLean said the Planning and Zoning Board would make recommendations to the Councl regarding the map. Barton- Aschman have already submitted a map to the City that is much like the map in the Land Use Plan. The actual zoning map will be in much more detail, areas more defined. Mr. Reinert made a comment about the Charter Commission but I could not pick this up off the tapes. NEW BUSINESS Mr. McLean asked about the life of a building permit. Mr. Kluegel stated that the • Planning and Zoning Board March 10, 1982 Page -3- is permit owner has to start his project within six months and as long as there is progress the permit is valid. Mr. McLean suggested that our policy be changed to require a termination date for building permits to be completed and requested the Building Inspector to look into this. • • Mr. McLean asked about trailer permits during construction and wanted to know if we follow the ordinance. Mr. Kluegel said the one issue at this time is for Dufour on Old Birch Street. He said he knew the Council recently took action on this but felt if we are not presently following the Ordinance we should change the ordinance. He felt the staff is not performing according to the ordinance direction. Mr. Rein- ert explained the Council had extended his permit until August 1, 1982 put he must apply for another 90 day permit about the first of April. He personally felt each further permit should be at an excelerated rate of fee payment. Mr. Prokop moved to recommend to the Council that the setting of fees for a 90 day permit on trailers for hardship cases for construction purposes be reexamined with the idea that perhaps the exceleration of permit fees be considered. Mr. Johnson thought this may be compounding the problem because it was a hardship to give the trailer permit to begin with. Mr. Prokop said the Council could always waive the fee. Mr. Reinert felt there should be a real definition of hardship. Mr. McLean seconded the motion. Motion carried unanimously. Mr. McLean talkddabout extending or reinstating the moratorum on platting until such time that the zoning map and supporting ordinances are adopted. The purpose would be to cover the period that we're trying to deal with in the old moratorum so we do not have some things happen that we will regret later on. Mr. McLean asked Mr. Kluegel for a definition of a mound on -site septic system. He asked if Gregg Olson's system would be a mound system and Mr. Kluegel said there are several types of mound systems. There was further discussion on mound type systems. Sign applications were questioned by Mr. McLean. Are they coming before the Planning and Zoning Board? Mr. Kluegel explained what the ordinance said. Mr. McLean mentioned the sign at Otter Lake Road and Otter Lake Drive. Mr. Kluegel said there was no permit issued and he said he would have it removed. ADJOURN Mr. McLean moved to adjourn at 9:28 p.m. Mr. Prokop seconded the motion. Aye.
