HomeMy WebLinkAbout09/14/1983 P&Z Minutes• Planning and Zoning September 14, 1983 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order by Vice - Chairman McLean with the following members present; Ostlie, Klaus, Doocy, Cody;, Goldade; Absent; Prokop. MINUTES - August 10, 1983 Mr. Ostlie - Page 5, paragraph 2 - felt the motion dealing with the Molin noise abatement was not stated correctly. He felt the noise abatement should satisfy the Planning and Zoning and the Council. Mr. Ostlie corrected the minutes in include "an agreement between Molin and the residents as to the noise abatement" Mrs. Klaus, who had seconded the motion, accepted the correction. Mrs. Klaus corrected Paragraph 9, page 5, the sentence should read "Lake shore lots ". Mr. McLean asked about the front footage on lake shore lots - Mr. Kluegel said 75' frontage, the set back depends on the classification of the lake - some are 150'- some 175' and can be as low as 50' on certail lakes. Existing lots are grandfathered in with some suggestions as to use of person who own adjacent lots. Page 5, under Old Business - Mr. Ostlie said there was an open question - IIIshould there have been an answer? Mr. Kluegel felt the material is there 10 days before the meeting - Mr. Doocy noted that he had picked these remarks from Mr. Short at the last meeting. Mr. Ostlie moved to approve the minutes as corrected. Seconded by Mr, Goldade. Motion carried unanimously. BUILDING OFFICIAL's REPORT Mr. Kluegel reported on the actions taken by the Council; ..Adopted the Shoreland Management Ordinance ..Approve Mr. Wolters rezoning request ..Will hold an informational meeting on the sewer district in connection with the Rice Lake Estates plat. Mr. McLean had some questions in reference to the AT &T Conditional Use Permit which Mr. Kluegel answered. Some of Mr. McLean's concerns will be discussed at the Public Hearing scheduled for September 26, 1983. CONDITIONAL USE PERMIT - PAUL WOLTER This conditional use permit request is for the expansion of his business in the form of an additional building at the present location for the purpose of storing his equipment. III Planning and Zoning discussed the following items; landscaping ..replacement of the existing sign ..the odd shape of the lot due to the drainage ditch ..proposed graveled parking area (Ordinance requires cement, blacktop or water sealed surface). Planning and Zoning September 14, 1983 - page two - IIIIt was also noted that any proposed water sealed surface must be approved by the City Engineer. ..the parking area was noted on the plat ..front area to be seeded and maintained ..temporary sign to be replaced by a permanent sign within one year ..buffer requirement of 40' - this is not on the plat ..no exterior storage on the South aide ..fence with plastic strips to be along South line. The durability of the plastic strips was discussed with Mr. Wolters explaining. Mr. Ostlie questioned Mr. Wolters on the feasibility of constructing the new building further North, thus adding footage to the buffer zone to the South. Mr. Wolters noted that the area between the building is necessary for the parking of equipment in the new building - must have the area for maneuvering the trucks and trailers. Mrs. Klaus felt the building in itself provided sufficient buffer to the South - She was more concerned with the area to the West. Mr. Goldade moved to recommend to the Council approval of this Conditional Use Permit for Mr. Paul Wolters for the construction of an additional structure with the stipulation that Mr. Short's recommendations be followed and the driveway and parking surfaces to either cement, blacktop or, if III a water sealed surface, must have the City Engineer's approval, the temporary sign to be replaced by a permanent sign within one year. Seconded by Mrs. Klaus. Motion carried unanimously. DOUGLAS BOE - BUILDING AND SITE PLAN REVIEW This is a proposed building for Lot 1, Block 2 in the Lino Industrial Park located on Industrial Boulevard. This street is not in but the lot side that line abutts Lilac. However, Anoka County has requested this building face the interior street in order to driveways exiting onto Lilac from the industrial park. It was suggested the developer be required to put the interior street in for at least the side lot line of this lot. The construction of the building, the insulation, the matter of ventilation since there will be quite a lot of arc welding inside, the parking lot sur- face, the absence of elevations (this is available on the original plat), the landscaping plan ( there was a suggestion that the well be located away from the parking lot should there be a need to expand in that direction) the matter of an advertising sign, the separation of the work area from the show room area of the building,(this is within the province of the building inspector and must comply with OSHA regulations) - these items were all discussed by the Planning and Zoning Board members. The general consensus of the Board was the street must be installed by the developer for the length of the side lot line in conformance with Anoka .County's request; there is to be no exterior storage; no accessory building; parking area and driveway must conform to the LI requirements; the topo- graphy is on the original plat; there is adequate parking for the present; landscaping plan is adequate; a time table for completion is needed. The Board suggested one year for completion. Planning and Zoning September 14, 1983 - page three - 411 Mr. Cody moved to recommend approval of the site and building plans for Lot 1, Block 2, Lino Industrial Park with the following stipulations; 1) Developer construct street on side lot line for the length of that lot, 2) no exterior storage, 3) no accessory building 4) driveway and parking lot constructed according to ordinance 5) landscaping plan to be completed within one year from issucance of permits. Seconded by Mrs. Klaus. Motion carried unanimously. CONDITIONAL USE PERMIT - DOG KENNEL - S. Todoroff /J. Torgerson A sketch of the proposed dog kennel to be located at 920 Evergreen Trail was presented showing the location of the kennel and the runs for the animals. At the present time there are two adult German Shepards and one puppy. Ms. Todoroff has a show dog Champion female which she plans to breed witn a suitable male is located. This is the reason for the kennel request. The noise factor was discused and Ms. Todoroff said she has had only two complaints in the seven years she has lived at that location. She also pointed out that the animals are inside by 10:00 P.M. Mr. Ostlie asked how far between homes in that area and Ms. Todoroff said approximately 60 to 70 feet. •Mr. Goldade moved to recommend to the Council approval of a kennel license for S. Todoroff /J. Torgerson at 920 Evergreen Trail per be plans submitted. Seconded by Mrs. Klaus. Motion carried unanimously. VARIANCE - WILLIAM LAHTI The variance request is for a side yard set back on a corner lot in Shenandoah III. Mr. Lahti pointed out that his driveway is overlapping the required 30' side yard setback at the present time.and he is requesting a 10' variance to the 30' requirement. It was generally felt by the Board members that this side street will be used in the future and a variance to the side yard set back could cause problems. Mr. Goldade questioned why these short side streets were not finished at the time of the other streets in order for the house to face the side street or at least, the garage could face the side street. Mrs. Klaus said she had driven out and looked at this and felt that she did not want to create a problem by allowing a building to go in that would be on the setback. She had also looked at the home that had constructed the garage and then requested the variance and felt it was completely out of place in the neighborhood and created an eye sore. • It was suggested that Mr. Lahti construct his garage facing the side lot line and use that portion of the street for a driveway. There was some questions as to the legality of this. Someone suggested that he construct an attached garage but if the setback is maintained, there is only room for a single garage. Planning and Zoning September 14, 1983 - page four - IIIMr. Goldade moved to recommend to the Council denial of this variance request for a corner lot side yard setback at 6567 Hokah Drive for Willaim Lahti. The Ordinance requirement should be followed; the lot has room for construction with proper setbacks. Seconded by Mr. Doocy. Motion carried unanimously. CONDITIONAL USE PERMIT - FILLING IN FLOOD PLAIN - Bruce Hanson Mr. Hanson was unable to attend this meeting however, the information the Planning and Zoning Board had requested was available. Since the rules and regulations for the filling has been set by the Army Corps of Engineers, there was a questions as to the necessity of Mr. Hanson being present. Mr. Ostlie suggested that the permit be withheld until all the debris has been removed before the filling. Mr. Ostlie moved to recommend approval of the Conditional Use Permit at 6980 Lake Drive as submitted by Mr. Bruce Hanson be contingent upon the removal of the debris and his fulfilling all Army Corps of Engineer's requirements. Seconded by Mr. Goldade. Motion carried unanimously. PLAT SKETCH PLAN - S. Drewlo The proposal is for the development of land located to the East of LaMotte's 410 Third Addition. Mr. McLean pointed out that the easement indicated on the South end of the land as a County Road still belongs to the developer and is not County property. All the land to the South of this easement is County Park and even though this is not a full 60' easement, Mr. McLean suggested that a normal driving surface with a boulevard only on the City side of the street. Mrs. Drewlo had presented a proposal that the existing park land be vacated, sold to her, and a parcel in the new plat be dedicated for pprk purposes. The original park contains 1.7 acres. It was pointed out this is for LaMottes Second and Third Additions. Mrs. Drewlo was under the impression that the acreage they are planning to develop was included in this acreage when the original park was donated to the City. She is proposing to trade a 1.7 acre parcel for the existing park. This must go before the park board for their consideration. Mr. Goldade requested Mr. Kluegel to research the minutes for any indication of this agreement and present this information to the Park Board for their consideration. The general consensus of the Planning and Zoning was that the sketch looked feasible and when this is considered by the Park Board, the suggestions of the property owners should be considered as to the park land. 410 SIGN ORDINANCE DRAFT The Planning and Zoning members felt they needed more time to study this draft and requested that this be put on the October agenda. OLD BUS Planning and Zoning September 14, 1983 - page five - 410 OLD BUSINESS • • Mr. Kluegel reported to the members that the final plat of the Rice Lake Estates will be presented to the Planning and Zoning for their comments before the public hearing before the Council. NEW BUSINESS There were several questions on new home construction which Mr. Kluegel answered. Mrs. Klaus moved to adjourn. Seconded by Mr. Goldade. Aye
