Planning and Zoning Board
August 10, 1983
The regular meeting of the Lino Lakes Planning and Zoning Board was
called to order August 10, 1983 at 7:30 P.M. by Chairman Prokop with
the following members present: Goldade, Ostlie, Klaus, Prokop, Doocy,
Cody. Absent: McLean.
MINUTES - JULY 13, 1983
On considering the minutes of July 13, 1983, Mrs. Klaus noted that on
Page 7, paragraph 7, discussion on the extension of the street in the
Rice Lake Estates, should this be clarified - they have contacted Mr.
Schmitz and he did not seem to have any problems. Page 1, paragraph 2,
under 'Goertz Conditional Use Permit' the date should read 'May 12, 1982"
Page Three, paragraph 6, delete "Motion declared passed ", rewrite actions
to clarify. last paragraph, page three, 1st line change word 'would'
to 'should'; page 5, 4th paragraph, change 'assessory' to accessory';
last paragraph change word 'necleous' to 'nucleus'
Mrs. Klaus moved to approve the minutes as corrected. Seconded by Mr.
Goldade. Motion carried unanimously.
UPDATE - MR. KLUEGEL
Mr. Kluegel noted that the zoning map is official and each member should
have a copy. Mr. Prokop said he did not receive a copy and requested
that each member receive an up -to -date copy of the map,
Mr. Kluegel reported on the actions taken by the Council in reference
to the Rice Lake Estates. Mr. Prokop felt the P &Z would like some input
as to the tot -lot and the Park Board's recommendation for cash.
Mrs. Klaus asked if the P &Z does not have the right to recommend as to
the parks - Mr. Goldade wanted it understood that this Board was not
trying to take over the Park Board's responsibilities as to Parks - but
had felt this tot lot is needed and therefore made the recommendation.
EASEMENT - ELIASON
Mr. Eliason asked what is planned for access to his lot - he now has two
easements on his property.
Mr. Prokop pointed out the alignment of the roadways in the area on a
map and suggested that West Road be designed to go North, thus eliminating
the use of the existing easements.
Mr. Doocy felt this matter had been discussed approximately a year ago
and the general consensus of the P &Z was that the streets in the area
should go North and South /East and West and not zig -zag through the area.
Mr. Cody pointed out that no matter what the recommendations are from
this Board at the present time, they could be altered in the future and
he could be in trouble if he relied on these recommendations.
CORDELL - METES & BOUNDS SUBDIVISION
Mr. Kluegel presented the prior actions on this property. The property

is located East of Lake Drive, just South of Pine Street and is the
Alcock Estate. Mr. Cordell wants to split this into 3 parcels of land
in order to settle the Estate.
The various aspects of this division was discussed and cleared. Mr.
Goldade moved to approve the subdivision by metes and bounds per the
revised survey dated May 6, 1983. Seconded by Mr. Ostlie. Motion
carried unanimously.
WOLTERS - REZONE LI - CONDITIONAL USE PERMIT
Mr. Short's letter of May 9, 1983 was read by the members. Mr. Wolters
is asking to rezone his property from GB to LI and a Conditional Use
Permit for an additional building. The rezone will be dealth with first.
It was generally conceded that Mr. Wolter's operation is more consistent
with LI than with GB - is also bordered on the North by LI.
Mr. Goldade moved to recommend Planning and Zoning approval of the
rezoning request at 7791 Lake Drive in that it is bordered on the North
by LI and his currect activities is consistent to LI. Seconded by Mr.
Cody. Motion carried with Mr. Ostlie voting, No.
On considering the Conditional Use Permit, Mr. Goldade moved to table
this request for a Conditional Use Permit. Mr. Wolter's to provide a
complete site plan to include landscaping and screening. Seconded by
Mrs. Klaus. Motion carried unanimously.
MR. Cody emphasized that this site and building plans must comform to
the applicable ordinances.
BILL MOLIN - REZONE - LI TO GI - CONDITIONAL USE PERMIT
Mr. Kluegel noted that Mr. Molin was not present. There was a motion
to table. Mr. Schumacher explained that the Council had established a
Public Hearing on this request for August 29, 1983 at 7:15 P.M.
The general consensus of th e Planning and Zoning members was that the
rule of this Board is not to discuss an agenda item urhless the applicant
is present and they questioned the Council setting a Public Hearing be-
fore the Planning and Zoning Board had made a recommendation.
Mr. Schumacher suggested that Mr. Kluegel review this matter before this
Board takes any action.
The motion and the second to table this item was removed. Mr. Ostlie
moved to postpone this item to later in the agenda. Seconded by Mr.
Goldade. Motion carried unanimously.
NORTHWEST AMPS - AT &T - CONDITIONAL USE PERMIT
This request is for the construction of a transmission tower on the East
side of the City, East of 135E, on the Acton Property.
Mr. Kluegel presented this request. Mr. Tom Araka, who represents the
Amps Company.

He explained the operation and use of this tower and noted that this
will contain equipment only.
The request is for a small building to contain the equipment and a 150'
free standing pole. It was emphaized that this transmission will not
interfere with any other type of equipment. The immediate area will be
fenced and the grounds will be according to the requirement of this
Board.
There was concern with the 20' access easement - Mr. Kluegel felt there
was no problem with this. It was pointed out this is just a driveway
for a maintainance man who would probably only be in the area 2 or 3
times a year.
This facility will not be expanded -nor can any other commercial firm
use this facility for transmission.
Mr. Goldade moved to recommend to the Council the approval of the
application for Transmission tower for a Conditional Use Permit for
Nothwest Amps at the site 2209 Phelps Road on the Acton property for
the reasons that it is in an industrial site and conforms with the land
usage of the area. Seconded by Mr. Cody.
Mr.Goldade requested that the driveway be of crushed limestone. this
stipulations was accepted by Mr. Cody. Motion carried unanimously.
41, SHORELINE MANAGEMENT - Mr.Jab'h Stine
•
Mr. John Stine of the DNR was here to discuss the Shoreline Management
Ordinance. This is a draft ordinance and has beenpresented to the P &Z
for their discussion. Mr. Stine presented the background on this require-
ment and the reasons why.
Mr. Stine discussed the requirements set forth in this ordinance for
the development of shoreline properties. He noted there are 15 potential
areas in conjunction with lakes and 14 areas classified as basins that
would be affected by this ordinance.
Mr. Stine pointed out that, in order for this ordinance to be approved
by the DNR, the City must change the lot size requirements from 11,250
square feet to 20,000 square feet for J-et shore lots.
There was discussion on the 20,000 square foot requirement. Mr. Stine
offered the alternative of computing the available lots, if there was
no public lands and the number of lots with the public lands deleted.
Mr. Doocy moved to recommend approval os this Shoreland Management
Ordinance with the exception of the numbers on page 6 regarding water
front lots, changing the numbers presented in the Natural Enviornment
waters from 11,250 to 20,000 and the recreational development waters
from 11,250 to 20,000. No.3- Zoning Provision; No.1- single family detached
No B - sewered areas. Seconded by Mr. Goldade.
Mr. Stine pointed out there are some changes in a letter dated July 12,
1983. Mr. Doocy included those changes in his recommendation„

Mr. Goldade seconded this. Motion carried unanimously.
MOLIN REZONE - CONDITIONAL USE PERMIT
Mr. Kluegel presented this request and the reasons for the request.
Mr. Molin is requesting the addittion to the existing building to be
used for storage. The land is currently zoned LI. The manufacture of
cement products is an allowed usage under GI but not LI.
Mr. Schumacher summarized the reasons for this noting that in order to
bring this operation into conformance with the new Zoning Ordinance it
is necessary to rezone to GI. This area is defined as industrial in
the comprehensive land use plan. Mr. Schumacher read Mr. Short's letter
on his review of this request. Mr. Short recommended the rezoning of
the property from LI to GI.
Mr. Schumacher felt this zoning was an oversight at the time of the
public hearings. If it had been realized that Molin Concrete was being
zoned as a non - conforming use, Mr. Molin would have been notified in
order for him to have appeared at those meetings and voice his objections.
Mrs. Klaus was concerned that this business is being intensified and it
is adjancent to a residential area.
It was pointed out that if the zoning remains LI, this plant cannot
be expanded. Under GI, expansion may take place with a Conditional Use
Permit.
Mr. Doocy asked how big is the currently used area - the yarding area?
Is this the only area that used in the business? No one knew the answer
to the area used and this is the only area used at the present time.
Mr. Schumacher pointed out that when this operation was began, the LI
zoning was the only classification under Ord. #6 that this could be zoned.
Mr. Schumacher pointed out that Mr. Molin has been working all summer
on a water plan for the RCWB in order to complete this expansion.
Someone asked why Mr. Molin did not show up at the hearings on the zoning
map and Mr. Schumacher pointed out that all persons who were non - conforming
were notified and this property was overlooked in that it was presumed
that it was put into the correct classification.
There was a suggestion that only a portion of this property be zoned to
GI, the remaining be left as LI.
Mrs. Klaus moved to recommend to the Council that the Molin Concret
rezone application be revised to includeanlythat part of the property
necessary to support the operation as it presently exists. Seconded by
Mr. Cody. Motion carried unanimously.
On considering the Conditional Use Plan, Mr. Kluegel was asked if the
site and building plans have been reviewed in accordance with the Ordinance?
This would include Items A thru I in the zoning Ordinance.
Mr. Kluegel said he had no problems with this request. The requirements
on pages 40 thru 45 are the ones being referred to and Mr. Kluerl said
they have been complied with.

• There was a question on whether this permit could be considered before
the actually rezoning of the property.
Mr. Henriksen complained about the noise and this was discussed. The
starting times were discussed and it was noted that the work starts about
6:00 A.M. There was discussion on looking at some type of sound screen-
ing. It was suggested that Mr Molin work with Mr. Kluegel to look into
some type of noise abatement.
Mr. Ostlie moved r, the Conditional Use Permit
for Molin Concrete, 415 Lilac be contingent upon the applicant
return to the P &Z with a modified plan whereby area to be rezoned to GI
be limited beyond what it would presently be, and as a contingency for
the conditional use permit, that a noise abatemen

scheduled for August 29, 1983 at 7:15 P.M.
OLD BUSINESS
Mr. Doocy noted that Mr. Short had made the comment 'that he had little
time to review' both the Wolter's and Molin's request - is there some
way these can be forwarded to Mr. Short sooner?
IIIThe guidelines of what should or should not be forwarded to MR. Short
was discussed. The P &Z felt that he should be involved in all Rezoning
request, plats,
Mr. Prokop asked about the packets - Mr.Kluegel said there should be some
revision of those forms.
NEW BUSINESS
There was no new business.
Mrs. Klaus moved to adjourn. Seconded by Mr. Doocy. 11:47 P.M. Aye.
