HomeMy WebLinkAbout05/11/1983 P&Z Minutes• Olt' Planning and Zoning Board May 11, 1983 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 7:35 P.M., Wednesday, May 11, 1983 by Vice Chair, McLean. Members present: Goldade, Ostlie, Klaus, Doocy, McLean. Members absent: Johnson. Chairman, Prokop will arrive later. Mr. Kluegel, Zoning Official was also present. MINUTES Mr. Goldade moved to approve the minutes of the April 13, 1983 Planning and Zoning Board meetingas presented. Mrs. Klaus seconded the motion. Motion declared passed. RESOLUTION FOR RECLASSIFICATION OF A PORTION OF ASH STREET (COUNTY ROAD J) Mr. Art Hawkins who owns the only property to the north of Ash Street in this area was present to give his views of the reclassification. He pre- sented a map showing his property. When 35E was constructed it split his farm. He now owns land on both sides of 35E. He explained he was not concerned with the reclassification itself. He was concerned that the reason for the reclassification was for a long range proposal for a dia- mond interchange on the north side of Ash Street at 35E. This would affect his property (about 6 acres) on the east side of 35E. He felt if there will be a diamond interchange he hoped they would take the entire parcel. He 411 felt if only a portion was left it would be useless. Mr. McLean said that the Planning and Zoning Board could recommend that the diamond interchange be eliminated from the Comprehensive Plan. This would remove the City's interest in the interchange. He felt this would help in controlling the lake and prevent this area from becoming another dumping ground. Also if residences were constructed in this area it would give the City an additional taxable base where a diamond interchange would not. He felt a complete diamond interchange would not have a real impact on the traffic patterns. Mr. Ostlie asked Mr. Hawkins if his concern was that if this bacame a full diamond interchange he would not be adequately compensated for the land? Mr. Hawkins said, yes. Mr. McLean said he felt what Lino Lakes should be doing is removing the recommendation of a diamond interchange at this location. Mrs. Klaus felt a need should be shown for a full diamond interchange. Mr. McLean felt the request for reclassification from Ramsey County is so the County can have the entire Otter Lake Road in Ramsey County reclassified for State Aid purposes. Mr. Kluegel said he had talked to a Ramsey County Engineer who said the reason for the request is to make this portion of Otter Lake Road conform to the County Comprehensive Plan. This engineer • • Planning and Zoning Board May 11, 1983 Page -2- had also said there were no plans to alter or up grade Otter Lake Road in any manner. Mr. Goldade asked why Lino Lakes had proposed a full diamond interchange in their Comprehensive Plan? This was unknown. Mr. Goldade felt it would not have much impact on the City either way since most of the traffic is south of Ash Street. Mr. Ostlie felt he would rather leave the Comprehensive Plan as is if it were not for the question of adequate compensation for Mr. Hawkins. Mr. Doocy moved to recommend that the City keep and maintain County Road J (ASh Street) east of 35E as a collector street, and recommend disapproval of Ramsey County's request to reclassify it to a more intense use. The motion was seconded by Mrs. Klaus. Motion declared passed. Mr. Goldade, Nay. The Board felt there should be a study to show the need for the reclassif- ication and upgrading of Ash Street. VARIANCE - NOREN r. Jerome Noren asked the Planning and Zoning Board for a variance to Ord- inance #85 (Moratorum) so that he can deed ten plus (10 +) acres to his son who wishes to build a house. This property is in the Rural classification and meets all requirements in the proposed Zoning Ordinance for subdivision in a rural area. There is a 66' wide strip of land running east from this parcel. Mr. Noren explained many years ago this was a hunting access to the now dead Cedar Lake. It was noted that under the proposed ordinance a variance will not be re- quired for a long driveway. He was told that the driveway will have to be constructed and maintained to provide access for emergency vehicles. Mrs. Klaus moved to recommend approval of the variance for Mr. Jerome Noren on property at 6198 Holly Drive. This subdivision is in conformance with the Comprehensive Plan and the new proposed zoning ordinance. Mr. Goldade seconded the motion. Motion declared passed. Mr. Noren was told this item would be carried to the Council on May 23, 1983 and he should be at that meeting. FEASIBILITY - VARIANCE, BRUGGEMAN Mr. Bruggeman came before the Board to talk about a plat revision and the feasibility of dividing several outlots on Bald Eagle Lake in the area of West Oaks into small 25' wide lots to be sold with lots on the west side .of Bald Eagle Road. This would be a matter of marketing for him. He said there would be parking on the west side of the road for these lots. Mr. Ostlie asked if this was commonly done? Mr. Bruggeman did not know. Planning and Zoning Board May 11, 1983 Page -3- Mrs. Klaus asked if this was mainly to offer access to the lake? Will there be docks? Mr. Bruggeman said possibly. Mr. McLean felt there would be a problem with accumulating a lot of material on this property and there would be a traffic problem. He also felt that if the landowner wanted he could sell his lake lot to someone living outside of Lino Lakes. Mr. Bruggeman said he would combine titles of the house lot with the lake lot so this could not be done. Mr. Prokop felt the land was very low and marshy and was under the impress- ion that the area was designated by the Department of Natural Resources as a northern pike spawning area. Mr. Bruggeman said it was a spawning area. Mr. McLean said his personal feelings are that there is a safety problem with this proposal and common docking would be more feasible. Mr. Prokop noted that this area is designated as Rural (10 acre minimum) in the proposed zoning ordinance. This subdivision would not be consistent with this ordinance or the Comprehensive Plan. Mr. McLean noted this item does not need Planning and Zoning Board action and it is the feeling of the Board that this is not a feasible plan. ler here were several residents from West Oaks in the audience and they voiced opposition to Mr. Bruggeman's proposal. PROPOSED ORDINANCE - LIMIT TIME ON BUILDING PERMITS Mr. Kluegel explained that at the last Planning and Zoning Board meeting the Board had asked him to come to them with a suggestion on a proposed ordinance for setting time limits on building permits. Mr. Kluegel explained the City is currently following the state building code but a stricter ordinance can be adopted by the City setting time limits. The problem of temporary occupancy permits was discussed. Mr. Kluegel explained he can issue a temporary occupancy permit when the safety and health situations in a building are met. Mr. McLean asked if it would be possible to put a time limit on a temporary occupancy permit? Mr. Goldade said he favored some sort of time limit, however, he felt people who build their own houses need every encouragement. Mr. McLean felt the phrase "good and satisfactory reason" for extending the time limit for a temporary occupancy permit was too liberal. He felt City Attorney, Hawkins could add tighter language to this passage. IIIThe proposed zoning ordinance was consulted and there was a definition of "Temporary Occupancy" in this ordinance. Mr. McLean suggested maybe the temporary occupancy portion should be eliminated from the proposed zoning ordinance. Mr. Prokop asked how then would you take care of a "hardship • Planning and Zoning Board May 11, 1983 Page -4- situation ", or what if a partially completed building is destroyed and the builder has to start over? Mr. McLean said through the variance procedure. Mr. McLean said he favored the idea of the house being totally completed before any occupancy be granted. Mr. McLean said he is suggesting that there be a 120 day limit to get the house (building) sided. Mr. Goldade suggested in addition that the build- ing be ready for any occupancy permit in 140 days. This may be a temporary or a complete occupancy depending on how much of the house (building) is completed. Mr. McLean suggested further that maybe a temporary occupancy permit should be renewed with a renewal fee. Mr. Ostlie suggested that maybe the 140 days be changed to 180 days for an occupancy permit. It would be up to the Building Inspector to determine if a temporary occupancy permit or a permanent occupancy permit should be issued. Mr. Ostlie asked if there should be the clause that the house be started within 90 days of issuing the permit. Why not just say the house must be started and the exterior be completed within 120 days. The feeling was the 90 day limit on starting the building was a good tool for prodding. •he consensus was that the house (building) must be started within 90 days or the permit lapses. The exterior must be finished within 120 days and must be ready for occupant' (temporary or full) within 180 days. Mr. McLean asked Mr. Klegel to check with Mr. Hawkins regarding the "good and satis- factory reason" clause. OLD BUSINESS Mr. Ostlie asked about the Shoreland Management Ordinance. Mr. Kluegel said Mr. John Stein from the DNR will attend the next Planning and Zoning Board meeting. Mr. Prokop suggested approaching the DNR about the Bruggeman lot split request and see what their feeling is about this. Mrs. Klaus asked when there will be a new Planning and Zoning Board member. It was explained that Mr. Johnson has not officially submitted his resignat- ion. When this happens the Council will appoint a new member. NEW BUSINESS Mr. Kluegel reminded the Planning and Zoning Board of the continuation of the public hearing on the proposed Zoning Ordinance and Zoning Map set for May 24, 1983 at 7:00 P.M. at City Hall. Mr. McLean asked about the Dennis Wegan property. Mr. Kluegel explained he is now building a house next to his pole building. The water problem with •r. Sherer has been before the Council and should be resolved. Mr. Doocy asked if the Planning and Zoning Board will be involved with the BMX race track in the City Park? Mr. McLean felt this was not compatable with a ball field or picnic area which had been established by the Lion's • Planning and Zoning Board May 11, 1983 Page -5- Club. There will be traffic and parking problems with this track. Mr. Prokop was concerned about what happens when you esculate the use of a park. He used a park in White Bear as an example. Mr. Kluegel told the Board the Council had asked Mr. Volk and Mr. Schumacher to work with the track promoter in this matter. Mr. McLean said there is suppose to be a "play back" between the Park Board and the Planning and Zoning Board. Maybe the present Park Board does not know about this aspect. Mr. Doocy suggested the exchange of minutes between the Park Board and Planning and Zoning Board. Mr. Kluegel said the Sign Ordinance will have to be reviewed by the Board. Mr. McLean felt there should be large improvements on this ordinance. Mr. Prokop moved to adjourn at 9:35 P.M. Mrs. Klaus seconded the motion. Aye. • •
