HomeMy WebLinkAbout04/13/1983 P&Z MinutesPlanning and Zoning Board April 13, 1983 Isregular meeting of the Lino Lakes Planning and Zoning Board was called to order by Chairman Prokop at 7:30 P.M., Wednesday, April 13, 1983. Members present: Doocy, McLean, Prokop, Klaus, Goldade, Ustlie. Members absent: Johnson. Mr. Kluegel, Zoning Official and Mr. Schumacher, City Administrator were also present. MINUTES January 12, 1983 - Mr. Doocy moved to approve the minutes as corrected. Mr. Ostlie seconded the motion. Motion. declared passed. Mr. McLean abstained. March 9, 1983 - Corrections as follows: after the 6th paragraph, page 1, title the sect- ion, BILL HAWKINS - CITY ATTORNEY. 1st page, end of 8th paragraph add a paragraph saying "Mr. Kluegel noted this registration procedure was effective January 1, 1983." 2nd page, 4th paragraph, 4th sentence, add the word "owner" after the word property. 3rd page, 9th paragraph should read "Mr Goldade referred to item #1 again." Item #3 change to Item #2, Item #4 change to Item #3, Item #5 change to Item #4, Page 4, Item #6 change to Item #5 Item #7 change to Item #6 Item #9 change to Item #7 ilkMcLean moved to approve the March 9, 1983 minutes as amended. Mrs. Klaus seconded the on. Motion declared passed. March 23, 1983 - Mr. McLean moved to approve the minutes as presented. Mr. Doocy seconded the motion. Motion declared passed. March 30, 1983 - Mr. McLean moved to approve the minutes as presented. Mr. Ostlie seconded the motion. Motion declared passed. VARIANCE - ROBERT WALLS Mr. Walls had presented a metes and bounds subdivision for information purposes at the March 9, 1983 Planning and Zoning Board meeting and the Board and Mr. Hawkins had sugg- ested that Mr. Walls redraw his proposal into 22 acre lots with a 60' easement over two lots. Mr. Walls had previously recorded his subdivision during a break in the moratorum in April, 1982. This new drawing reflects what the Board had requested regarding record- ing an easement for street purposes over lots C & D. Mr. McLean moved to recommend to the Council that the application for a variance to Section 5, Ordinance 85 be accepted from Mr. Robert Walls and his property.the reason being the subdivision was recorded in April, 1982 when the moratorum was not in effect and Mr. Walls has met the requirements of the Planning and Zoning Board. Mr. Ostlie seconded the motion. Mr. Doocy asked when utility easements are recorded? He was referring to lot G. Mr. McLean explained that since the easement for egress and ingress is recorded any other easements clot G could be recorded when the lot is presented for development. • Planning and Zoning Board April 13, 1983 Page -2 On the vote for recommendation for approval, motion carried unanimously. Mr. Walls was informed that this would be placed on the April 25, 1983 Council agenda for their action. VARIANCE - MELVIN AND IDA REHBEIN Mr. Rehbein explained his Mother, Ida Rehbein has requested the variance to split off seven (7) acres from her twenty (20) acre parcel to give to Melvin so he can combine it with his ten (10) acre parcel. Mrs.' Rehbein has already deeded the seven (7) acres to Melvin and she wants the variance so the subdivision can be recorded with the County. This will give Melvin a total of seventeen (17) acres and leave Ida with a total of thirteen (13) acres. Mr. McLean asked what zone is this land located? It was explained it was Rural with a ten (10) acre minimum for a building site. Mr. Schumacher explained that this request is consistent with the Rural Classification. Mr. McLean moved to recommend to the Council that the application for a variance to Ord- inance #85, Section #5 for Mrs. Ida Rehbein enabling a lot split between Ida Rehbein and Melvin Rehbein be consumated in a total of seven (7) acres. The reason for the recommend- ation is that the lot split is consistent with the Rural Classification in our new zoning ordinance and the intent of the Comphrensive Land Use Plan. Mrs. Klaus seconded the motion. Mr. McLean amended his motion to require a Certificate of Survey with a complete legal des- cription prior to this being brought before the Council. Mrs. Klaus seconded the amendment. Goldade asked that the variance request form be changed to read seventeen (17) acres of thirteen (13) acres to Ida Rehbein. On voting on the amendment all voted Aye. Motion declared passed. On the original motion all voted Aye. Motion declared passed. Mr. Rehbein was told this would be on the Council agenda April 25, 1983 if he could get his Certificate of Survey by April 20, 1983, otherwise this could be on a later Council Agenda. PRELIMINARY PLAT - ROY STANLEY - SUNSET OAKS II Mr. Stanley explained this preliminary plat had Council approval in June, 1980. At that time the Council had told him not to record the plat until the municipal sewer issue was decided. This issue could have had an impact on this preliminary plat. Since that time the sewer issue was settled and now he wishes to record his plat. Mr. McLean asked if there was any evidence of committment from the Council. He was told there was nothing in the minutes. Mr. Marvy, Mr. Tilsen, Mr. Stanley and Mr. Kluegel checked the proposed zoning map. This area is designated Expansion Residential, one building site per five (5) acres. Marvy explained to the Board that because of the location and layout of the site it ould not be possible to subdivide without installing some streets. If the five (5) acre minimum stands only four (4) building sites could be realized and it would not be worth- while to subdivide in this manner. It is also not possible to hold this property until such time that municipal sewers are available. It becomes a dead piece of land. • Planning and Zoning Board April 13, 1983 Page -3- Mr. McLean' said that the question before the Board then is feasibility, can Mr. Stanley proceed and record this plat? It was his feeling that it cannot be recorded since it does not follaa the intent of the proposed zoning map or the Comprehensive Plan. Mr. McLean recommended that the preliminary plat of Sunset Oaks II not be accepted for final plat due to the moratorum and that it is not in adherence with the intent of the Comprehensive Plan for the proposed zoning ordinance. Mr. Goldade seconded the motion. Motion declared passed. FEASIBILITY, CAPITAIN' S PLACE, LAKES ADDITION III - JOHN DOYLE Mr. Doyle was not present. Mr. Doocy moved to table this item. Mr. McLean seconded the motion. Motion declared passed. FILL FLOOD PLAIN DISTRICT - SURFSIDE SEA PLANE BASE - BRUCE HANSON Mr. Kluegel explained he has asked Mr. Hanson to appear tonight to explain that Mr. Hanson is depositing demolition material, (concrete, steel, re -rod, brick) at the sea plane base which is in the Flood Plain District. Mr. Hanson explained he is doing this to build up the existing runway and lengthen it. Mr. Kluegel explained he was informed of this action by a neighbor and issued an order to Mr. Hanson to cease and desist until all permits are issued (DNR, Corp of Engineers, Rice creek Watershed District, Anoka County Health Department) and conditions of the permits are �t. Mr. McLean asked when the permits were applied for, after the fact? Mr. Hanson said, Yes. Mr. McLean asked when the material was installed? Mr. Hanson said most November, but all in 1982. Mr. McLean asked when he started applying for permits. Mr. Hanson said he started in December , 19 82 . Mr. Prokop asked if he was aware these agencies had to be informed of this landfill? Mr. Hanson said "No ". Mr. Hanson said the runway will be extended all the way to Aqua Lane. This had originally been a runway but had deteriorated over the years. Mr. Kluegel noted that the current Flood Plain Ordinance requires a Conditional Permit for this type of construction and all other agencies be informed of this action. The re- ason Mr. Hanson is here tonight is for information only to let the Commission know of this situation and to let them know they will be receiving a request for a Conditional Permit. Mr. Ostlie asked if the 2,300 foot runway is consistant with the proposed new zoning ord- inance? Mr. Hanson said if the ordinance is written after the state guidelines the runway will be in conformance with the new ordinance. Mr. Hanson said the state is after him to complete the runway so that it can be licensed by the state. or. Prokop said it looks like there is a lot of ground work to be done before this issue an be resolved; RCWD, PCA, Anoka County Health Department, etc, the final site drainage plan, the effect of filling in terms of storm water runoff etc. Mr. Hanson said he has talked to all these agencies and it appears to him that each agency is waiting to see what the other is going to do. • Planning and Zoning Board April 13, 1983 Page 4- Mr. Goldade asked that Mr. Hanson be supplied with a list of requirements to be met before he returns to the Commission for consideration of a Conditional Use Permit. Mr. Ostlie asked the reason for extending the runway? Is it to allow larger air planes to land? Mr. Hanson said the state requirement is 2,000 feet for a runway and it is for safety reasons. (He did not say anything about landing larger air planes.) Mr. Schumacher asked that Mr. Hanson give the Commission a copy of the Metropolitan Airport Commission approval. A five minute recess was called at 9:00 P.M. DEVELOPMENT PROPOSAL - RICE LAKE ESTATES - DONALD SPAGENSKI Mr. Zack Johnson, a planning consultant, appeared for Mr. Spagenski who was also in the audience. He explained that they wish to present the concept at this time, not asking for plat approval or zone change approval, but asking for feelings and comments about this de- velopment proposal before they go into more detail engineering and bring back a preliminary plat. Mr. Johnson explained the analysis process regarding the land and how the proposal was de- loped. He had larger more detailed maps with him for his presentation and explained the ation of the Park Land on the east, Hodgson Road on the north, the City of Circle Pines on the south and the proposed commercial development on the west. He explained they wished to avoid major cut or fill operations on the land, leave it as natural as possible. He further explained the area is proposed for multiple family on the proposed zoning map. Also the severelimitation of the site due to steep slopes and wet lands were addressed. Trees and vegitation are proposed to be distrubed as little as possible. The proposal is for about 120 to 130 homesites on 432 acres. About 10+ acres are undevelop- able, 6+ acres are to be right -of -ways, 1 acre for a convenience commercial site. There would be 25 - 26 acres left for single family development, an average lot size of 9,400 sq. ft, smallest lot size, 7,800 sq. ft. Approximately 30% of the developable site will be 7,800 sq. ft. lot sizes. This will be all single family, corner occupied homes in the price range of high $40,000 to law $50,000. Mr. McLean pointed out the proposed ordinance requires a minimum of 9,000 sq. ft. lot sizes. Mr. Johnson said he is asking that the Board consider variation of lot sizes to better re- tain the natural amenities of the land but keeping the total site to an average of 9,400 sq. ft. Mr. Johnson explained these lots will have municipal sewer and water. The smallest house will have a minimum width of 24feet and minimum sq. ft. of 1,050. Some lots will be at a ttle higher quality and will have higher quality homes placed on them. ' 0 r. McLean and Mr. Prokop felt they wished to adhere to the 9,000 minimum sq. ft. lot size and 70' front footage size required by the ordinance. Planning and Zoning Board April 13, 1983 Page -5- ft. Johnson said each site will have a paved driveway. Garages will be optional. Mr. McLean asked about park dedication. Mr. Johnson said they prefer not to put in an active park. It was noted that Baldwin Park in Circle Pines is very near the site. It was felt the Board would like to see a completed tot lot or maybe even more than one at this site. The tot lot or lots should be developed by the plat developer before the area is fully occupied. Mr. McLean said if the Board deviates on the minimum sq. .footage in this area they will be asked to deviate in other areas of the City. Mr. Ostlie noted if this was developed Pi,7D they could deviate lot sizes. Mr. McLean felt this was not wise since the area will have to be rezoned regardless. Mr. Johnson said he appreciated the Boards comments and he will take them and apply them to his planning. The construction of the manufactured house itself was also discussed at this time. OLD BUSINESS Mr. McLean asked Mr. Kluegel if he has been checking the auto carrier people on Ash Street? Mr. Kluegel said yes, and will probably be going to court with at least one home caner. Mr. Goldade asked about the garage being built on the - ;est section of Ash Street. Mr. Kluegel explained that although work was progressing very slaaly, this will be an earth berm .me. Mr. McLean asked if there is a time limit on a building permit? Mr. Kluegel explained that as long as there is progress shown on the building the permit is valid. Mr. Prokop asked Mr. Kluegel to check on an ordinance that would require a building permit to be completed within a certain time period. He would like Mr. Kluegel to note each building where a permit has been issued but for some reason or another never completed so that the Planning and Zoning Board could make a recommendation to Council on an ordinance that would alleviate this problem. Mr. Ostlie asked about the "State Wide Standards and Criteria for the Management of Municipal Shoreland Areas in Minnesota" which he understood needs the Planning and Zoning Boards attent- ion. Mr. Goldade said that the Board had made a request of the staff to get a copy of the state criteria for this Board to use as a guideline. NEW BUSINESS Reclassification of County Road J - The Board had received a letter from Mr. Bill Short, City Planner regarding Ramsey County's proposal to reclassify a section of County Road J from Otter Lake Road to the 35E freeway from collector to minor arterial. Mr. Short in his letter explained he did not know what that impact on the potential for construction of a full dia- mond'interchange would be. He felt there would be no technical problems. Mr. McLean felt it might impact Mr. Hawkins who owns property north of County Road J and had been inquiring about obtaining a building permit for this property. Kluegel said he had talked to Paul Kirkvold, Ramsey County Engineer, who told Mr. Kluegel the change of classification would enhance the prospect for a full diamond interchange. Mr. McLean felt this situation needs more information from Mr. Short. • Planning and Zoning Board April 13, 1983 Page -6- Mr. McLean moved to refer this matter back to Mr. Short and advise him of the situation with Mr. Hawkins.
