Special Meeting
March 23, 1983
411/A Special Meeting of the Lino Lakes Planning and Zoning Board was called to order Wednesday,
March 23, 1983 at 7:30 P.M. by Chairman Prokop. Members present: Prokop, Goldade, Ostlie,
L. Johnson, Doocy, McLean. Members absent: Klaus. Mr. Kluegel, Zoning Official and Mr. Bill
Short, City Planner were also present.
The purpose of this meeting was to review the proposed Zoning Ordinance and Zoning map and
send them on to the Council for their consideration.
Mr. Johnson asked Mr. Kluegel if he felt that there was anything in this proposed ordinance
that was not enforceable. Mr. Kluegel felt it was a good document.
Mr. McLean noted that Mrs. Anderson had reviewed a portion of the Ordinance and had several
comments and corrections. These comments or corrections were made not as a private citizen
but as a proof reader of the document.
- Page 8, Item 56. Farm Definition, 40 acres, should it be 10 acres? This item will be add-
ressed later in these minutes.
- Several places in this draft ordinance it refers to specific ordinance numbers such as
Ordinance #65 or #85. The City ordinances are being codified and this draft ordinance should
refer to the Lino Lakes City Code and a specific section rather than the ordinance number.
Mr. Short asked the staff to point out these errors in this draft ordinance.
Mr. Johnson moved to approve the changes in this draft to reflect the codification or new
1110 ity Code. Mr. Doocy seconded the motion. Motion carried unanimously.
- Page 13 (108) suggest the word "building" be added to definition. Mr. Doocy moved to add
the words "and /or building "to the end of the sentence. Mr. McLean seconded the motion.
Motion declared passed.
-Page 20, (4), 1st paragraph on top of page, defining minimum lot size for five (5) and ten
(10) acre lots. Should this include a statement regarding easements as part of the lot size.
Mr. McLean moved to correct the definition of Subd.5, Section (4) as follows: "The minimum
lot size and width requirements established in this Ordinance shall be computed excluding all
roadway rights of way with the following exceptions: 5- and 10- acre lots in the Rural and
Expansion Residential Districts may include road right of way (to the centerline of a road-
way) in calculating such requirements up to 107 of their minimum lot size. Mr. Goldade
seconded the motion. Motion declared passed.
-Mr. Short noted that the proposed ordinance contains a definition for agriculture and for
limited farm but not for farm. Mr. McLean moved that item #57, Farm on page 8 be rewritten
to delete the word (40) and substute (10). Mr. Goldade seconded the motion. Motion de-
clared passed.
- Page 22, Item (13). Roadside Stands. Mr. Johnson moved to accept this verbatum as written.
Mr. McLean seconded the motion. Motion declared passed.
Page 40. 3(A). 2nd paragraph. Mr. McLean moved to change the 2nd paragraph to read, "The
4110 lanning Commission shall review and recommend approval or disapproval to the City Council.
hey may also suggest such conditions as they deem necessary to the approval of site and
uilding plans. The Planning Commissions recommendations will be passed on to the Council for
their review and approval or disapproval. He also moved to add the word "recommendations"
to the end of the 1st paragraph. Motion seconded by Mr. Johnson. Motion declared passed.

- Page 42, Subd. 5, Section (1), 2nd paragraph. Mr. McLean moved to change the last sentence
of this paragraph to read "the zoning districts provided in 1005.6 of this Ordinance ". Mr.
Goldade seconded the motion. Motion declared passed.
Mr. Johnson moved that on top at the left corner of each page the section number and des-
cription be noted as continued from the previous page. Mr. McLean seconded the motion.
Motion declared passed.
- Page 50, Subd. 2, (3). 1st sentence, typo error, should read, "to reduce the possibilities
"of' not "or".
- Page 57, (7), Conditional Uses, should read, "The following are conditional uses in the
"ER" District, not "R" District. Mr. McLean moved to change this sentence to correct the
error. Mr. Johnson seconded the motion. Motion declared passed.
-Mrs. Averbeck noted on page 43, Items 4(B) and (C), paragraphs refer to Subd. 6. (4)(A).
This should refer to Subd. 5. (4)(A) in each paragraph. Mr. Goldade moved to change the
draft to reflect this change. Mr. Doocy seconded the motion. Motion declared passed.
- Page 60, 62 regarding density. Requirements for floor area are larger for multifamily
dwellings than for single family dwellings. There was discussion and it was decided this
is what was intended for this ordinance.
Page 76, Subd. 10, (3), Conditional Uses. Are these the only conditional uses in this
istrict?

Mr. Short changed the last sentence to read "manufactured home sales, but only those units
which would be installed in the park. Manufactured homes sales shall be terminated when the
manufactured home park is completely developed." Mr. McLean moved to accept this change.
Mr. Johnson seconded the motion. Motion passed unanimously.
Mr. Short felt that no other uses such as, public parks, churches, etc. would be appropriate
for this district. There will be private playgrounds as a requirement.
- Page 81, (HH) is intended to be private.
Mr. Short noted the Manufactured Home Park District was drafted by Mr. Short with Mr. Paul
Howards help and has not been reviewed by the Planning Commission.
Page 76, Subd. 10, (I), 2nd to last sentence, change word "section" to "district ".
-Page 77. (iii) word "applicant" is mispelled.
- Page 78, (5), (C), Mr. Goldade moved to change this section to read, "Each lot or site shall
encampass an area of not less than 6,000 square feet excluding roadways, walkways or general
park property." Mr. McLean seconded the motion. Motion declared passed.
-Page 78, (5) (E) , Mr. Johnson moved to change word "sidewalk" to "commonwalk". Mr. Goldade
seconded the motion. Motion declared passed.
Page 78, (5) (F), 5th sentence should read, "This zero side yard setback allowance will only
be permitted if the distance to the manufactured home that shares that side lot line is at
least 30 feet distance." Mr. Johnson moved to accept this change. Mr. Goldade seconded the

motion. Motion declared passed.
- Page 78, (5) (H) (I). Mr. McLean moved to delete sections H & I from the ordinance
entirely. Mr. Doocy seconded the motion. Motion declared passed.
- Page 78, (5) (H). Add section. Mr. Goldade moved to add a section labeled (H) which reads,
"Common walks when deemed necessary shall be a minimum width of three (3) feet." Mr. McLean
seconded the motion. Motion declared passed.
-Page 78, (5) (K), Mr. Goldade moved to change the words "building inspector" to
"zoning official ". Mr. McLean seconded the motion. Motion declared passed.
The meeting was recessed at 9:50 p.m. for ten minutes.
- Page 79, (5) (N) add, Mr. Johnson moved to change the word "sidewalk" to "walkway". Mr.
McLean seconded the motion. Motion declared passed.
-Page 79, (5) (R). Mr. Johnson moved to add to the paragraph; "screening shall meet the
requirements established in 1005.04, Subd. 25. Mr. Goldade seconded the motion. Motion
declared passed.
- Page 79, (5) (T), Mr. Doocy moved to add to this sentence, "all shall meet all standards
established by the City ". Mr. McLean seconded the motion. Motion declared passed.
Page 79, (5) (U), Mr. McLean moved to insert in the first sentence; "one accessory build -
ng not larger than 120 square feet for outside..." Mr. Johnson seconded the motion. Mot-
ion declared passed.
-Page 80, (5) (X), Mr. Johnson moved to delete this section entirely. Mr. Goldade seconded
the motion. Motion declared passed.
-Page 80, (EE), (i), Mr. McLean moved to rewrite the paragraph to read; "Each manufactured
home site shall have off - street parking space paved with concrete and /or bituminous for two
(2) automobiles." Mr. Doocy seconded the motion. Motion declared passed.
-Page 80, 81, (EE) (iii), Mr. Johnson moved to rewrite the paragraph to read, "Access drives
off roads to all parking spaces and manufactured home lots shall be paved with concrete or
bituminous." Mr. Doocy seconded the motion. Motion declared passed.
-Page 81, (6) (C), Mr. Johnson moved to rewrite this paragraph to read; "Permit Issuance.
Upon approval, the Zoning Official shall issue a Certificate of Occupancy to the installer.
Permit shall state the date of issuance and shall precisely describe the location of the
manufactured home." Mr. Doocy seconded the motion. Motion declared passed.
Mr. Prokop moved to have this section of the ordinance re- alphabetized. Mr. McLean seconded
the motion. Motion declared passed.
Mr. Johnson moved to continue the meeting until March 30, 1983 at 7:30 P.M. Mr. McLean
seconded the motion. Aye. 10 :40 P.M.
