HomeMy WebLinkAbout07/14/1982 P&Z MinutesPlanning and Zoning July 14, 1982 0 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 7:30 P.M. by Chairman Johnson with the following members present; Goldade, Juleen, McLean, Klaus, Prokop, Doocy. Absent; None. MINUTES - JUNE 9, 1982 Mr. McLean questioned the correction that had been made. Mr. Schumacher explained that the motion on the Henriksen property should have read that the entire parcel was approved for the lot splits - the original minutes had only noted that the variance was granted for one lot. Mr. McLean moved to approve the minutes as presented and amended. Seconded by Mr-Doocy. Motion carried unanimously. REPORT ON COUNCIL ACTION Mr. Schumacher reported there had been no Council action. However, there is one item the Planning and Zoning Board should be aware of and that iS the proposed ordinance on manufactured housing. This has to do with the new state law that allows manufactured homes to be in any residential area of a City. This law takes effect August 1, 1982. This ordinance would give the City some control on the placement of this type of homes. rr, Mr. McLean moved that Ordinance No "` amending Ordinance #56,dealing with manufactured housing, be adopted by the Council as presented. Seconded by • Mr. Juleen. Motion carried unanimously. Mr. Prokop was concerned with the stipulations as to the anchoring of these homes. He felt there should be some specifications on this problem. Mr. Kluegel was asked to look into this matter and report back to the Planning and Zoning Board. VARIANCE - LYNDAL NELSON Mr. Johnson asked Mr. Kluegel if he had an information on this matter and Mr. Kluegel said, no, other than what is present in the folder. Mr. Nelson noted that his home was a Sussel package and he said when the foundation was poured, the Building Inspector was never there. The fact that his home is constructed too near the side lot line was not discovered until the lot next door was built on. Mr. Nelson is asking for a variance to the side yard set -back. There was much discussion on the many facets of this problem. Mr. McLean asked how near the side lot line and Mr. Nelson said, about six inches. Mr. McLean felt that no action should be taken until there is a survey and they know exactly what they are dealing with. The past minutes of the Planning and Zoning Board dealing with this subject was discussed and the suggestions that had been made at that time. 410Mr. Prokop moved that this request be tabled until Mr. Nelson has a complete survey of his propoerty and the exact location of where his home is con- structed and any information relative to purchasing necessary property from his neighborhood and information as to having to move the house. Seconded by Mr. McLean. Motion carried unanimously. Planning and Zoning July 14, 1982 Page Two "' SIGN PERMIT - MR. RYGG There was no one present to speak on this. Mr. Prokop moved to table. Seconded by Mr. Doocy. Motion carried unanimously. Mr. McLean asked if this 297 square side - Mr. Kluegel, Yes. McLean - it says metal and wood - which is what? It would appear that this is sheet metal overlaying wood. Mr. McLean - where is the location? Need a more definitive location. Mrs. Klaus suggested that the distance to any other signs in the area be noted. BUILDING PERMIT - R. Neff This is a proposal for a pole building along Lake Drive. Mr. McLean asked if there is a survey? There was none. Mr. Johnson pointed out that he had discussed this matter with Mr. Neff several times and he had been told that a certificate of survey showing the location of all buildings. Mr. Johnson felt that perhaps this should be discussed since the proposed building is much larger than the primary residence. He asked for the consensus of the Board - Mr. McLean asked if the use of this property was residential and was told, Yes. He felt that the building would have to be Orelated to the residence. Mr. Johnson felt that if the general consensus of the Board that this permit would be denied, then it would unnecessary to go to the expense of having a survey completed. He told Mr. Neff that he was trying to save him some money and time. Mr. Prokop - this will store four cars? also boat storage? This is a 44x56 building - why so large? Someone from the audience said that part of the structure was for a carport. Mr. Prokop noted that this is not shown on the sketch any place. Mr. McLean moved to table to allow Mr. Neff time to have a survey prepared, get drawing that are adequate, dimension correct, get a complete picture. Mr. Johnson felt that a variance is needed rather than a Speeial Use Permit. Mr. Prokop seconded the motion. Mr. Johnson noted that this is not in conformance with the Comprehensive Plan and the zoning in that area. If Mr. Neff prepared all the materials asked for in Mr. McLean's motion, there is no assurance that this would be approved. The motion carried unanimously. 411ZASTROW - SPECIAL USE PERMIT This request had been tabled from last meeting for further information. Mr. Kluegel not that the parking area had been revised. Planning and Zoning July 14, 1982 Page Three The various items that had been missing at the last Planning and Zoning Board presentation, had been supplied and these items were discussed at this time. Mr. Juleen moved to approve this Special Use Permit application, with the stipulation that the business as shown on the application dated 6/14/82 be installed within 60 days after Council approval. Seconded by MR. Prolop. Motion carried unanimously. OLD BUSINESS Flood Plain Ordinance - Mr. Kluegel asked for Planning and Zoning comments on this ordinance. The general consensus of the Board was this has been prepared by the men who have the knowledge and there were no adverse comments for any Board member. Mr. McLean moved to recommend to the Council adoption of this Ordinance subject to Engineer and Attorney stipulations. Seconded by Mrs. Klaus. Motion carried unanimously. NEW BUSINESS Mr. Prokop asked the status of the proposed packets with a check list for Slanning and Zoning Board items, has any progress made on this? Seconded by Mrs. Klaus. Motion carried. •
